Opis:

As security is one of the basic human needs, we need security systems that can prevent crimes from happen‐ ing. In general, surveillance videos are used to observe the environment and human behavior in a given location. However, surveillance videos can only be used to record images or videos, without additional information. There‐ fore, more advanced cameras are needed to obtain other additional information such as the position and move‐ ment of people. This research extracted this information from surveillance video footage using a person tracking, detection, and identification algorithm. The framework for these is based on deep learning algorithms, a popu‐ lar branch of artificial intelligence. In the field of video surveillance, person tracking is considered a challenging task. Many computer vision, machine learning, and deep learning techniques have been developed in recent years. The majority of these techniques are based on frontal view images or video sequences. In this work, we will compare some previous work related to the same topic.

Niniejszy artykuł przedstawia refleksję nad twórczością, rozumianą jako zadanie osoby. Główny problem badawczy zawiera się w pytaniu: w czym wyraża się twórczość jako zadanie osoby? W pierwszej części artykułu został zaprezentowany przegląd perspektyw rozumienia twórczości, które są przedstawione w literaturze. W części drugiej przeprowadzono analizę jakościową swobodnych wypowiedzi nauczycieli. Podjęte analizy umożliwiły sformułowanie odpowiedzi na postawiony problem badawczy.
The article below presents a reflection on creativity, understood as a person’s task. The main research problem is contained in the question: what is creativity expressed as a task of a person. The first part of the article reviews the perspectives of understanding creativity that are presented in the literature. In the second part, a qualitative analysis of teachers’ free speech was carried out. The undertaken analyzes made it possible to formulate a response to the research problem posed.

The considerations’ point of departure is as follows: the biological nature’s transgression affects realization of a person. I start with a short description of this thesis. Next I relate achieved data to the situation of people who cannot develop their personal capacities because of physical or mental disabilities. Such a situation fuels the perennial philosophical (and pedagogical) debate about the value of live. And I also make a little contribution in this discussion. Namely, I argue that disabled people do not live in a less valuable way.

The term personalism and the problem of the mystery of person has long occupied a prominent place in the study of philosophy. One of the most famous proponents of the idea of personalism is a French philosopher Emmanuel Mounier. His broad philosophical education has become an inspiration to attempt to create a philosophy  defending the value of man as a person. Starting from Christian thought he tried, using multiple and sometimes conflicting philosophies, to build a personalistic  system, the center of which is a person. It was reflected in his selection of collaborators publishing  in his journal “Esprit”, where philosophers of various denominations wrote, but the source of their common interests was a person. Personalism, according to Mounier, is a philosophy that comprehensively solves the problem of the person, on spiritual and material levels, and is a counterweight to the individualistic and collectivist tendencies. Trying to explain the mystery of the person, he does not give a precise definition, because the person is not the object, which can be simply defined. Personalism developed by Mounier is not a closed system, but just like the human being it is in the process of continuous becoming. It is a response to the crisis of man searching his identity as a person in the world.

W pracy Домански'ego(1974) rozważa się pewien model gry antagonistycznej związanej z ciągiem zmiennych losowych niezależnych, przyjmujących wartości 0 i l. Celem niniejszej pracy jest znalezienie rozwiązania dla wersji z czasem ciągłym modelu gry z Домански(1974). Zakłada się, że czas przebywania w stanie l jest zmienną losową o znanej dystrybuancie F( t), t ~ O. Zmodyfikowana gra jest grą na produkcie (O, co) x [O, co) z nieciągłą funkcją wypłaty. Stosując metodę dodatnich transformacji całkowych rozwiniętą przez Karlina(1959) dla gier czasowych uzyskujemy postać strategii optymalnych w rozważanej grze.
The author considers a game of timing over [0,∞)×[0,∞) with a pay-off function discontinuous at the main diagonal. The game has its origin in a game in which two producers seek the favour of a buyer who drops the attempt to buy the production after a random time. Under certain regularity assumptions and by means of the known method of S. Karlin [Mathematical methods and theory in games, programming and economics, Addison, London, 1959; MR0111634], the author shows the existence of a unique pair of mixed optimal strategies, which are distribution functions over [0,∞). These are concentrated on a finite interval and continuous in the whole domain with the exclusion, perhaps, of 0. Some gaps in the representation do not diminish the value of the paper.

Here is a philosophical examination of some themes presented by Milan Kundera in The Art of the Novel, as well as in his novels Immortality and The Unbearable Lightness of Being. The discussions of the first-personal perspectives of the novel’s author, both as appearing in and as contrasted with that of a character in the novel, as these unfold in implicit subtle comic, social-political contexts, prescind from these contexts and dwell instead on fictional renditions of the senses of personhood and its individuality especially as embodied in the face and as implied in relations of love. Of special interest is Kundera’s thesis that the irreplaceable uniqueness of the individual is one of Europe’s finest illusions.

Opis:

The capability of a robot to follow autonomously a person highly enhances its usability when humans and robots collaborate. In this paper we present a system for autonomous following of a walking person in outdoor environments while avoiding static and dynamic obstacles. The principal sensor is a 3D LIDAR with a resolution of 59x29 points. We present a combination of 3D features, motion detection and tracking with a sampling Bayesian filter which results in reliable person detection for a lowresolu tion 3D-LIDAR. The method is implemented on an outdoor robot with car-like steering, which incorporates the target's path into its own path planning around local obstacles. Experiments in outdoor areas validate the approach.

The above question can be answered briefly: the human zygote is a person, for man is a person. Thus formulated question is not a question that is asked by the biologist who does research on the origins of human life. Its answer is involved in the philosophical debate on the very concept of person. Here we deal with two separate scientific disciplines: philosophy (philosophical anthropology, to be precise) and biology (especially embryology). The discussion on the status of the human zygote demands respect for the competencies of either science. Otherwise, we might neutralize the concept of person, or demand of the biologist (as a biologist) to transcend the empirical character of his discipline towards philosophical abstraction. Let us add that the concept of person functions also in theology and law. Therefore the question about the personal status of the human zygote transcends the competencies of biology. The biologist, precisely speaking embryologist, will not dwell on the anthropological disputes about the concept of the human person. Rather, he will ask whether the human zygote is a man, that is a representative of the homo sapiens species, according to generic category. Respectively, we have two questions referring to the same zygote, or the primary stadium of our human existence: the questions about its human and personal status. Do they in fact concern the same, or we are dealing here with two, equal dimensions of human existence? The large number of answers given today to the question about the status of the zygote and successive developmental stages of man arouse doubts as to the unambiguous status of the zygote. One thing is certain in this discussion: we were all zygotes in the beginning. The way to answer them is, as it seems, first to make the concept of person more accurate, and then to answer how for we can refer this concept to the human zygote.

Two of its main subjects participate in education at its every level and teacher. Accepting a personalistic approach to them, in which a person is understood as a person, we simultaneously accept a universalist, reflective and wise way of approaching education, the center of which is a person with his individual, biological, psychological, social, spiritual and religious dimensions. The essence of early school education boils down to the development of the human person, his personality maturity. Mutual teacher–student relations are focused on the actualization of the person’s qualities to fulfill his humanity more fully.

Celem artykułu jest analiza roli liderów w kształtowaniu różnego typu dopasowań pracowników w miejscu pracy. Realizacji tego celu służyły zarówno studia literatury przedmiotu, jak i wyniki dotychczas przeprowadzonych badań empirycznych, poświęconych tej problematyce. Kluczowymi działaniami lidera, które zwiększają dopasowanie człowiek– praca, są: modyfikowanie środowiska pracy, dostarczanie zasobów, udzielanie podwładnym wsparcia, rozwijanie ich kompetencji oraz kształtowanie postaw. Wzmacnianiu dopasowania do zespołu służy socjalizacja, budowanie pozytywnych relacji grupowych oraz facylitacja interakcji, a także kreowanie pozytywnego klimatu organizacyjnego. W przypadku zwiększania dopasowania pracownika do organizacji istotne jest wzmacnianie identyfikacji z firmą i kształtowanie spójności grupowej.
The purpose of the article is to analyze the role of leaders in shaping different types of employee fit in the workplace. To complete this aim, research of literature and to‑date empirical studies devoted to this issue was conducted. The key activities of the leader that increase person–job fit are: modification of work environment, provision of resources, supporting the subordinates, developing employee competencies and creating attitudes. Person–team fit can be sustained by way of socialization, building positive group relations and facilitation of interactions, as well as creating positive organizational climate. In the case of increasing person–organization fit, it is essential to reinforce identification with the company and create group cohesion.

Decoupling has been diagnosed since the second half of the last century. It is conceived as a kind of separation, appearing in a variety of organisations, in situations in which established principles or rules, aimed at normalising interpersonal relationships or governing the rules of conduct, despite being officially established, are  not implemented. Another situation may also occur. It arises when individuals know and accept the guidelines, but for multiple – often subjective – reasons, they do not materialize as they are blocked by individual decisions. This results in serious consequences of a social, economic, legal or managerial nature. How they be prevented? Solutions based upon ethics seem to be a sound base to counteract the destructive consequences of decoupling. Human conscience is one of the fundamental ethical categories. Deep rooted in every person, it shapes behaviour, even though its impact can also be minimised. It turns out that a properly formed conscience gives better results in personal activity on both the individual and human levels. Also, conscience enables the correct interpretation of what is prohibited and what is expected, and thus becomes the perfect tool for countering decoupling. Finally, it can be assumed that as long as man has a well-constituted conscience and follows its guidance, the negative effects of a split between the recognized rules and their actual observance can be minimised.

Development of technoscience and technologies in our times cause a lot of dangers regarding human being. It is happening on an unprecedented scale. Social media can manipulate posts and mediated data. Neuro-science, bio-science and technologies mixed with agencies can lead to manipulation of personal data. Even our brains are in danger because of taking part in computer games. Furthermore, in fact nobody knows how financial markets operate. All this regards people in all the world. These processes are not depending on citizens because are not recognised. Reality is endangered by falsehood: social falsehood. The article shows some of ways can provide stability and clearness in human ethic which oppose these falsehood. This ethic is based on Christian anthropology, in particular two attitudes: solidarity and protest (against badness) in opposite of attitudes conformity and avoidance. Solidarity and protest would ensure security in human ambience, eliminate unfair practices of manipulation, especially in virtual life. In view of technoscience and technologies only return to basic of human existence arouse hope for develop of human being. In spite of this anthropology which is real and positive answer for these dangers everyone have to find exit from these dangerous situations by myself.

Przedmiotem analiz autora jest pięć pojęć prawnych: osoba fizyczna, osoba prawa, ułomna osoba prawna, fiskus (Skarb Państwa) oraz osoba prawna prawa publicznego. Pomimo że termin „osoba fizyczna” jest powszechnie używany, autor opowiada się za usunięciem tego pojęcia z przepisów prawa, ponieważ pojęcie to jest reliktem skrajnej postaci jurysprudencji pojęciowej będącej wykwitem skrajnej postaci pozytywizmu prawniczego, poza tym nie koresponduje ono ze współczesnymi trendami zmierzającymi do konstytucjonalizacji prawa cywilnego, a zwłaszcza że współczesnymi koncepcjami praw człowieka. Autor zwraca uwagę, że pojęcie to nie występuje w polskiej Konstytucji. Za relikt uważa również pojęcie fiskusa (Skarb Państwa): jest to swoisty anachronizm, a więc relikt dawnej koncepcji fiskusa, która święciła triumfy w XIX w. Pojęcie to odwraca uwagę od rzeczywistej istoty państwa jako podmiotu prawa. Autor opowiada się także za usunięciem z dyskursu cywilistycznego pojęcia osoby prawnej prawa publicznego, które przedostało się z nauki prawa administracyjnego do dyskursu cywilistycznego. Jest ono reliktem metodologii, jaką stosowali szeroko w XIX w. specjaliści prawa administracyjnego. Metoda ta polegała na zapożyczaniu z nauki prawa cywilnego pewnych pojęć i recypowaniu ich do nauki prawa administracyjnego. Zdaniem autora na gruncie prawa cywilnego pojęcie to nie posiada wystarczających walorów normatywnych i poznawczych. Autor zwraca również uwagę na naturę pojęcia osoby prawnej. Jego zdaniem, w przeciwieństwie do terminu „ułomna osoba prawna”, jest to pojęcie pierwotne w języku prawnym i prawniczym. Nie poddaje się więc definiowaniu.
The author analyses five legal concepts: a natural person, a legal person, a defective legal person (Article 33¹ of Polish Civil Code), the Fiscus (State Treasury) and a public law person. Although the term ‘natural person’ is widely used, the author advocates removing this concept from law. In his opinion, this concept is a relic of the extreme form of conceptual jurisprudence, which is an efflorescence of the extreme form of legal positivism. According to the author, this concept is not compatible with modern trends aimed at the constitutionalization of civil law, and especially with contemporary concepts of human rights. The author notes that this concept does not appear in the Polish Constitution. The author also considers the concept of Fiscus (State Treasury) to be a relic. In his opinion, this is a kind of anachronism, and thus a relic of the former concept of the Fiscus, which prevailed in the nineteenth century. This concept diverts attention from the real essence of the state as the subject of law. The author is also in favour of removing the concept of ‘legal person of public law’ from civil law discourse. This notion migrated from the study of administrative law to civil law discourse. It is a relic of the methodology widely used by specialists in administrative law in the nineteenth century. This method consisted in borrowing certain concepts from the science of civil law and adopting them in the science of administrative law. According to the author, under civil law, this concept does not have sufficient normative and cognitive values. The author also draws attention to the nature of the concept of ‘legal person’. In his view, contrary to the concept of ‘defective legal person’, it is a primary concept in the language of the law and the language of legal discourse. Therefore, it cannot be defined.

In the current Act on NIK, a definition of “a person responsible” cannot be found, nor can be that of “perpetrator – a person who committed an irregularity”, although the legislator has used the former term in several articles of the act without, however, explaining it, and without solving the problem. For example, a post audit statement should indicate persons responsible for irregularities, and the scope and consequences of those irregularities, on the basis of the material gathered in the audit file. This is probably the most significant provision of the Act on NIK, related to the issue discussed in this study. The author, referring to linguistic, systemic and usefulness-related interpretation of the provisions regulating the activity of NIK, as well as post-audit statements, attempts to answer these doubts.

The article discusses the issue of standards of the right to defence and takes into account the recent amendments of the Code of Criminal Procedure. The analysis is conducted against the background of minimum standards of the right to defence set out under European law. A reference introduced to the title of the Code includes the assertion that the legislator has implemented the provisions of Directive of 22 October 2013 on the right of access to a lawyer in criminal proceedings and in European arrest warrant proceedings, and on the right to have a third party informed upon deprivation of liberty and to communicate with third persons and with consular authorities while deprived of liberty as well as Directive of 9 March 2016 on the strengthening of certain aspects of the presumption of innocence and of the right to be present at the trial in criminal proceedings. However, it should be emphasized in this context that as a result of changes made in the discussed scope in the years 2016-2019, the legislator not only failed to fully implement the aforementioned Directives, but even introduced modifications that led to lowering the standards of the right to defence and guarantees of its implementation, both in material as well as formal terms.

The article is devoted to the issue of organizing inclusive education in Russian universities. The authors of the article offer a comparative analysis of the concepts used in the psychological and pedagogical Russian literature and practice: “invalid” and “person with disabilities”. The article focuses on the psychological and pedagogical organization of educational activities at the university with psychology students, taking into account their nosology. The idea of subjectivity is inextricably connected to the concept of human seen as a person, as found in the field of humanist psychology. Slow in education focuses not on the pace of learning, but on the enjoyment of learning and the spontaneity found at the root of the participation in the learning process. Slow helps to practice contemplation, internal balance, dialogue, empathy, and intellectual openness.

Author in of the presented article focused his attention on the nature of personal and real privileges. As the study shows, the legislator took a stance on the issue of the nature of privileges in can. 78 §§ 1-3 CIC. The legal definition of privilege codified in can. 76 1 CIC contains a presumption allowing for the opposite evidence. This means that the permanence of a decision of this type is of a conditional nature. In other words, it is not an essential element of this institution. Can. 78 §§ 2-3 CIC, on the other hand, codifies the dispositions concerning the cessation of two principle categories of privileges, i. e. personal and real privileges. The cessation of both types of privileges is of a natural character. A personal privilege granted to an individual is extinguished with the person’s death and is not inherited by the heirs whereas a privilege concerning a legal personality ceases when the conditions codified in can. 120 § 1 CIC are met. Finally, a real privilege becomes extinguished through the complete destruction of be thing or place. Still, in the case of a local privilege, the legislator bases on legal fiction allowing for the revival of a privilege if the destroyed place is restored within fifty years. In conclusion, the author points out that prescriptive arrangements concerning the nature of personal and real privileges codified in can. 78 § 1-3 CIC result from positive law. The legislator establishing them bases on the mechanism of legal fiction.

In our paper, we approach the question of the relationship between a teacher and a student from an interdisciplinary methodology that integrates philosophical, ethical, and pedagogical knowledge. Starting from a notion of a person as being open to reality and constitutively religated to it, we wish to discern how to establish adequate relationships with each of the individuals existing within it. Specifically, we focus on the interpersonal dimension that can be established in a school context. As a result of this reflection, we propose a series of guidelines in relation to some linguistic expressions, to be carried out according to the student’s own understanding.

Economics and ethics are practical sciences. The common research subject of both sciences is man. Economics is looking for an answer to the question of how to manage in business life. Ethics looks for the answer to the question of how to live. Because man is a person, his value brings consequences for all areas of human activity. This also applies to the market. The market is one of the foundations of economic life and is a great good for people and societies. The market is defined in different ways. It is worth comprehensively describing what the market is, emphasizing its personal character. In economics, attention is paid to market failure, understood mostly as the ineffectiveness of management (deviation from the model market, which is perfectly competitive). The negative impact of the market on society is also identified. Although moral aspects are increasingly taken into account in the concept of market failure, there is no general theory that attempts to capture market in moral aspects. Therefore, it is worth asking whether such a theory is possible. The construction of the moral theory of market failure can be a reference point to the analysis of market practices and institutional conditions from an ethical point of view.

When dealing with citizens, public administration has numerous opportunities for abuse of its privileged position. The study of public subjective rights of disabled persons in public law is important because the relation under administrative law is not an equal relation. The state is always the stronger party. When a party to this relation is a person with a dysfunction of the body, a situation is created which is highly unfavourable for this person because of the natural tendency of the state system (including public authorities) to use its privileged position. This can result in actual discrimination of persons with disabilities. The purpose of the law is the common good and welfare of individual persons. Respecting the welfare of persons with disabilities in the public law guarantees the realization of the common good. One can not create the law while ignoring the rules governing human life. As Petrażycki wrote, “the highest good to which we should strive in policy in general and legal policy in particular – is the moral development of man and the rule of highest rational ethics among human beings, namely, the ideal of love” (Petrażycki, 1968, translation mine).

The article deals with the problem of authority in the fundamental aspects of the philosophy of dialogue, which in the I-You relationship acquires a specific meaning. The dialogical plane emphasizes the tension between the subjects, showing the dynamics of the meeting as well as its specific movement and variability. The concept of Martin Buber and Józef Tischner was recalled, opening a new discourse on the fundamental role, meaning and sense of authority today. Buber says that the dialogue itself appears as relation of beings, while Tischner shows the meeting as an event in which the agathological horizon of good and evil is present, which in both concepts puts a new light on the problem of authority. Authority not only internally assumes turning “to” someone/ the Other, but also assumes being “for” someone/ the Other and towards someone/ the Other.

Young people function in two worlds, the real and the virtual. The impact of digital media is very significant. However, significant people and authorities must play an important role in the process of growing up. Despite their strong anchoring in the virtual world, young people feel the need for social relationships. They need good role models, inspiring conversations, listening skills and strong reference points. The article attempts to outline several perspectives and problems in the subject area. The personality of the significant other is important in implementing the idea of positively creating good role models among young people. Its influence can be decisive for a young person’s entire life.
Młodzież funkcjonuje w dwóch światach, realnym i wirtualnym. Oddziaływanie mediów cyfrowych jest bardzo znaczące. Jakkolwiek jednak w procesie dorastania istotna rolę muszą odgrywać osoby znaczące, autorytety. Mimo mocnego zakotwiczenia w świecie wirtualnym młodzi ludzie odczuwają potrzebę relacji społecznych. Potrzebują dobrych wzorców, inspirujących rozmów, wysłuchania i mocnych punktów odniesienia. W artykule podjęto próbę zarysowana kilku perspektyw i problemów w przedmiotowym obszarze. Istotne znaczenie w realizacji idei pozytywnego kreowania dobrych wzorców wśród młodzieży ma osobowość samej osoby znaczącej. Jej wpływ może być decydujący w całym życiu młodego człowieka.

Opis:

The subject of this article is nomenclatural interpretation of the notions of “a person of interest”, “a suspect” and “a defendant” in Polish Code of Criminal Procedure – the parties in criminal proceedings who are suspected of committing a crime or who are charged with a crime. The article discusses the legal definitions of the word “suspect” according to Article 71 § 1 of the Code of Criminal Procedure (i.e. a person against whom a statement of objections has been issued and a person who has been charged on the grounds of examination of the person in question as a suspect) as well as the word “defendant” according to Article 71 § 2 and 3 of the Code of Criminal Procedure (sensu stricto and sensu largo). Moreover, the article provides an overview of the available definitions of “a suspect” and “a person of interest” – parties named directly in the Code of Criminal Procedure. In addition to that, the article discusses the notion of “actual suspect” (whose definition and understanding varies in the doctrine), which emerged from the previously effective Code of Criminal Procedure. The article analyses the legal standing of such an “actual suspect” in the context of Article 233 § 1a of the Criminal Code (a regulation which is considered potentially unconstitutional). While discussing the figure of the “suspect”, the author analyzes terms such as “issuing” and “preparation” – in connection with Article 71 § 1 and 313 § 1 of the Criminal Code and the lack of agreement within the discipline regarding the precise time at which the statement of objections has been issued (which is connected with obtaining the position of the passive party to proceedings in criminal procedure).Moreover, the article discusses in some detail the legal standing of a person against which a motion has been presented, according to Article 354 of the Code of Criminal Procedure, regarding the discontinuation of proceedings and issuing preventive measures protecting the person of an insane perpetrator – in the context of nomenclature.

CEL NAUKOWY: Celem artykułu jest próba uzasadnienia tezy, zgodnie z którą współczesne wychowanie stanęło wobec szczególnego, pilnego wyzwania – mocnego oparcia się na antropologii afirmującej człowieka. Wymaga tego sytuacja z jednej strony wzmagającej się krytyki humanizmu, z drugiej – przedłużającej się pandemii koronawirusa. PROBLEM I METODY BADAWCZE: Metodą badawczą jest analiza współczesnej sytuacji społeczno-kulturowej i pozycji w niej człowieka i człowieczeństwa w świetle personalistycznej myśli filozoficznej D. von Hildebranda, Ch. Delsol i R. Spaemanna. PROCES WYWODU: Autorka wychodzi od charakterystyki obecnej sytuacji kultury dystansującej się coraz bardziej od idei humanizmu. Równocześnie zwraca uwagę na trudne konsekwencje wychowawcze sytuacji pandemii. Stawia tezę, że jedyną właściwą odpowiedzią jest afirmacja człowieka. Potrzebę takiej postawy uzasadnia, odwołując się do personalizmu chrześcijańskiego w ujęciu D. von Hildebranda, Ch. Delsol i R. Spaemanna. Wywód kończą wnioski dla wychowania. WYNIKI ANALIZY NAUKOWEJ: Przeprowadzona analiza prowadzi do wniosku, iż jedynie personalizm chrześcijański pozwala w pełni uzasadnić potrzebę afirmacji człowieka, wyjaśnić jej rozumienie i wskazać sposoby realizacji tej postawy. WNIOSKI, INNOWACJE, REKOMENDACJE: Wnioski przeprowadzonej analizy dotyczą możliwości kształcenia postawy afirmacji człowieka, wrażliwości na człowieczeństwo. Zdaniem autorki potrzebne jest kształcenie postaw wobec człowieka i świata warunkujących postawę afirmacji człowieka i świata – a to znaczy postaw uznania, zachwytu, podziwu, bezinteresowności.
The need for affirmation of a human as a challenge for upbringing             The article attempts to justify the thesis that in the current situation of an increasing criticism of humanism on the one hand, and a coronavirus pandemic on the other, upbringing requires anthropology which affirms a man. We are talking about raising the value of humanity, related to responsibility for others, oneself and the world. Personalism rooted in Christianism represents such anthropology. The views of Dietrich von Hildebrand, Chantal Delsol and Robert Spaemann, which are mentioned in the text, are the examples of personalistic approaches emphasizing the importance of affirmations of a man and the world. The philosophy of R. Spaemann was subjected to a deeper analysis, from the perspective of consequences for the upbringing. The analysis showed that according to this philosopher, the affirmation of a man is an expression of respect for the human person. The basis of affirmation is an attitude of selflessness. The text ends with educational conclusions formulated in the light of the need for the affirmation of a man and the world. As well as  and training of the selflessness.

John Henry Newman as the history of a man who decided to re-evaluate his ethos in line with what his conscience showed him to be a duty to fulfil. Here conversion is understood as a long process of development, where the moment of decision is only the finał element. What seems to be an illumination and impulse is only seemingly a sudden change. In faet, it stems from personal and tacit thought, from the mystery of the person.

According to anti-pedagogy, any form of upbringing aimed at something or someone only masks the object of the educated, making them essentially puppets, appropriately controlled from without. Any purposeful approach to upbringing appeals to attributes that make the pupil not turn out to be what he/she is, but what his/her educators would want him/her to be. This approach is in direct contradiction to personalistic pedagogy, which posits an ultimate reality and value in personhood by emphasizing the significance, uniqueness and inviolability of the person, as well as the person’s essentially relational or social dimension. By emphasizing the autonomous value of a human being as a person and in propagating this with full affirmation, one is thus postulating that programs of activities supporting its development are to be subordinated to personal and spiritual values, and not to economic and technical values. This article presents the contemporary discourse between anti-pedagogy and the personalistic pedagogy with a special emphasis on Polish authors.

Neither individuality nor substance can provide a sufficient account for the uniqueness of human persons. This problem is demonstrated with respect to the various ways one can describe the human person; matter, substantial form, essence, and nature. It is nature that describes beings as they exist. Because human nature is distinctively rational, human beings are most appropriately described as persons. An investigation of personality reveals that each person stands in a unique relation to being by virtue of the acts of intellect and will. Therefore, only personality provides a sufficient account of the uniqueness of individual persons. But because personal uniqueness is an aspect of relation, it cannot be conceived outside that relation. And as the person’s relation to being is tantamount to his ability to enter into communion, uniqueness necessarily implies communion.

In modern economic theories, human qualities are treated as autonomous production factors, which are called “human capital”. However, these theories provide no description of the relationship between human capital and the man who is its “bearer”, nor an explanation of the formation process of that capital. In the thesis, the author tries to justify it as follows: human qualities, including knowledge and skills, are an integral part of a human being, that is, they are involved in every human act. It is, therefore, wrong to analyse their economic significance in isolation from the whole structure of human activity. Through his or her action, man discovers the potential in things and relationships in the form of the possibility of using them for a particular purpose. Capital is thus realized by the human potential of things that form a system for transforming the world. In the first part of the article, a general description of human capital will be provided. In the second part, it will be criticized, while in the third part, there will be an attempt to show the proper relationship between man and capital from the perspective of personalism.

The article indicates ontological bases which are at the ground of the religious education in Christianity. The touched problem considers issues of Christian anthropology and concerns the category of the person. The definite concept of the man forejudges applied pedagogic manners, that is the way of the approach to the pupil. The characteristics of the person indicates that for purposes of efforts of the man is his salvation, that in Christianity is the achievement of Communion with God, therefore the Christian religious education in its message points soteriological goals and measures. Although there have been many studies conducted to analyze the effects of person- -organization fit (POF) and person-job fit (PJF) on individual outcomes, little is known about which of these fit associates stronger with individual variables (i.e., intention to quit job, IQJ, and perceived individual performance, PIP). Therefore the purpose of the study is to compare the relationships of PJF and POF with IQJ and PIP. The sample of the study consists of security guards working at a private company’s civil aviation safety department. Totally 98 security guards participated to the research. Results indicated that, the relationships of PJF and POF with IQJ and PIP were not significantly different. Consequently the results indicate that POF and PJF associate similarly with critical individual outcomes.

The thought, the testimony of the life and philosophy of Mother Teresa wants to emphasize the primacy of love, respect for the dignity of the person and the defense of human rights inviolable and non-negotiable, first and foremost the right to life, which is that from the moment of conception and is sacred and inviolable. Mother Teresa gave importance to spiritual charity and the charity body, without which man is deprived of the future and of life itself. The ideal of the life of Mother Teresa is an ideal of simplicity and generosity, especially for the poor, the suffering and vulnerable children, in whom she sees the face of Christ incarnate. Mother Teresa has marked the twentieth century with the testimony of his life certainly exemplary educational point of view, ethical and legal, and has at the same time affirmed the need for a new humanism relational and transcendent, essential basis for building a just and coexistence peaceful.

The article shows the lost paradigms of human nature. It is also a sign of concern for respect for human dignity. The source of reflection is the thought written in the latest catechetical documents and the teaching of the Second Vatican council. The aim of the article is to recall theoretical assumptions important in catechetical ministry and to research for practical guidelines for their implementation. This goal is done through three points. The first is a reference to the philosophical and theological foundations that determine human dignity. The next step is to consolidate catechetical paradigms that express concern for the right view of man and his dignity. The third element is research for specific actions to promote human dignity. All considerations are interdisciplinary. His main thoughts and conclusions are the space of theological sciences. However, the issue raised requires the correlation of theological content with philosophical premises.

The aim of the authors is to recreate the heterosterotype of a humanities person through an analysis of notions communicated by students of non-humanities majors. Their task was to explain who a humanities person is, which professions they may practice, which competences are characteristic for people with such backgrounds and what differences may be noted between people who have studied in distinct fields; finally, the respondents were asked to answer whether humanities persons are needed today.

Relations between persons in the contemporary world often resemble those of the same persons towards objects. We are accustomed to ‘use’ – and even see – others as if they are, to put it in Kantian terms, merely a means to an end, and not as if they are an end in themselves. Such blurring of lines between objects and persons surely has significant moral and political consequences. However, in this paper I reach instead for a very traditional example and suggest it as a possible model for understanding these contemporary issues. I’d like to offer an analysis of icons, with regard to the concepts of latreia (worship) and proskynesis (devotion), developed and discussed in the Byzantine empire during the era of iconoclasm. By revisiting this old quarrel, I wish to invert the issue of persons becoming (like) objects, since in the case of the icons the question is whether an object can and should be treated as a person. Such an inverted image could, in my opinion, offer us a new perspective on contemporary intersubjective relations and present us with a double optic, which can teach us to distinguish between esteem for objects and respect for persons.

Dieser Beitrag ist ein Versuch, eine personalistische Interpretation der Erziehung und Selbsterziehung von Prof Wojciech Chudy zu nähern. Ein Kontext für das unternommene Problem ist körperliche Dimension von einem Menschen und ihre Bedeutung im Prozess der Personenpubertät. Zwei erste Teile des Beitrags haben (inhaltlichen) einen sachlichen Charakter; der dritte Teil ist ein Zeugnis von Wojciech Chudy – von dem Menschen, der in des Wortes voller Bedeutung, sich selbst erzogen hat. Im ersten Teil mit dem Titel Die Person und Selbsterziehung wurde Entwicklungsleistungsfähigkeit der Person gezeigt, in der moralische Pflicht der Erziehung des Menschen eingewurzelt ist. Man hat das Wesen von Erziehung und seinen Zusammenhang mit der Selbsterziehung aus der Sicht des ethischen Personalismus dargestellt. Als Schlussfolgerung hat man eine Definition der Selbsterziehung bestimmt, die den Kontext der Verantwortung des Menschen für sich sowie in der weiteren Bedeutung – für erkannte Güte zeigt. Im zweiten Teil mit dem Titel Verantwortung für die Dimension des Leibes hat man Integrationsrolle des Körpers im Prozess der Personenpubertät beschrieben und den Wert des Leibes als Strukturelement des Menschen betont. Problem der Selbsterziehung als Verantwortung für Körper hat man sowohl im positiven Aspekt analysiert, diese Elemente betonend, die entwickelt werden sollen, als auch im negativen Aspekt, diese Elemente zeigend, die Beherrschung und Disziplin brauchen. Im Zusammenfassung des sachlichen Teils hat man Zusammenhang der Selbsterziehung mit dem ganzen Leben des Menschen dargestellt. Es ist eine Konsequenz der Personenweise der Existenz des mit der Würde gekennzeichneten Menschen.

Opis:

The article deals with a matter of the redress for damage awarded due to the death of a close person. This paper provides a general overview of “the deceased person” term and entitled person to make a claim - “the close person” term. The text aims to briefly explain the available legal resources as well as the amounts typically awarded in such cases. Under the Polish Civil Code, the article 446 § 4 is the basis of a claim. The author describes conditions for an application and functions of the provision. The most important is that the bereavement dam- ages depend on size and intensity of the negative impact in the entitled person’s mental and emotional sphere. Compensation seeks to alleviate the pain after the loss of a close relative. The author also emphasizes the need for amendment in the Polish legislation and presents de lege ferenda postulates.

The status of the child in the context of contemporary socio-cultural processes that are reflected in the market is the main issue discussed in this paper. It may be surprising to concentrate on children and the market, while the sphere of economic exchange is the scene of such actions as work, production and consumption which seem to be reserved to adult members of the society. Although there are issues – such as kids advertisement and its consequences, and children’s participation in the process of buying – that are discussed, the range of problems that deserve consideration is far wider. The questions analyzed in this paper concentrate on two aspects. First of them is the influence of the market sphere on the life of children as members of the families and the society. The question that should be asked here is whether a child can and should be regarded as any other consumer, or should be protected – e.g. against controversial marketing practices. The second group of problems is connected with the objective way of treating children which leads to formation of something that can be called the markets of children”. Both these sets of issues are the stimulus to analyze the way of understanding a child and its status in the society. It is also done through taking into consideration such issues as current concepts of socialization, antipedagogy, infantilisation and adultisation that influence and shape market processes. Finally the analysis undertaken in this paper leads to an attempt to answer the question whether in the current context children are seen as persons or resources.

The article discusses the possibility of a new personalistic anthropology rooted in philosophia perennis and modern phenomenology, based on the thoughts of German anthropologist Hans Eduard Hengstenberg. Unlike Wojtyła and Stein, who did not create a new synthesis based on Husserl’s or Scheler’s phenomenology and the metaphysics of Thomas Aquinas, Hengstenberg was able to create an original concept of the human person involving metaphysical and phenomenological inspirations. It is personalism, based on the phenomenological theory of a spiritual act (Scheler) and the metaphysical theory of constitution (Plato, St. Augustine). According to Hengstenberg, the possibility of a new personalistic philosophy starts with a phenomenological analysis of three basic attitudes of human behavior: consensual to the object of cognition and emotion, contrary to the object of cognition and emotion, and utilitarian. The metaphysical heart of Hengstenberg’s personalism forms the theory of the metaphysical constitution of the spirit, body and personalistic principle.

At the beginning, the author presents some basic intuitions determining the necessity for philosopher’s reflections on not only numerical singularity, but also individuality. Then he considers briefly four selected types of individuality, namely: anything existing, the universe, a person and the Absolute. Nevertheless, for different reasons, in each of these cases it is possible to assume an impossible to fully express entity, that is, individuality. The next part develops the idea of a person’s individuality which stays directly linked with his or her permanent act of self-creation. The essence of the act would lie in a radical distinction between the person and any other human being as well as in generating the own, absolute personal otherness. At more accurate, largely speculative characteristics of this act it turns out to be necessary to redefine such categories like duty, responsibility, trust.

The paper focuses on the need to reflect on the methodological foundations of pedagogy and its practical aspect. This problem should be discussed due to the challenges of contemporary life and the so-called critical trends (including anti-pedagogy) that are dominating in pedagogy. According to the author, one can find in the thought of Karol Wojtyła – John Paul II some grounds for such a conception of pedagogy that could face the challenges. The author pinpoints that the personalistic conception of Wojtyła is rooted in experience. It can also be interpreted in terms of classical metaphysics. Accordingly, practice can make use of the rich experience and pedagogical theory is firmly grounded in philosophy. Education here is understood as perfection of one's own humanity with „participation in truth and love” as its essential element. Building this kind of conception should take into consideration some specific elements of Karol Wojtyła's thought. They are as follows: the relation to truth and freedom based on the truth are of fundamental importance; taking into account the practical aspect (a concrete personal pattern), personal understanding of praxis; highlighting the communal aspect (man lives in a community and for a community). This conception of pedagogy attempts to defend the transcendental and subjective character of truth. Consequently, it is capable of showing the way how to solve the most important problems in pedagogy, such as the crisis of education and authority, setting theory in opposition to practice, excesses of individualism, depersonalisation of social structures and mechanisms.

La personne comme sujet immuable, inalienable − et par suite éternel − c'est aussi la valeur primordiale, valeur des toutes autres valeurs, diverses sujets de correspondance réelle à celle-la. C'est pourquoi chaque personne humaine est une image spécifique des Personnes Divines. Et voilà le fondement d'une éthique personnaliste chrétienne, relationelle («communionistique»), mais pas relative. Par conséquent la valeur morale sensu stricto est avant tout et partout un mode d'affirmation interpersonnelle, c'est-a-dire une manière d'amour integral, une forme de dilection constante, autodonative et fidèle, une expression mutuae personarum prosistentiae. La métaphysique d'être comme être et la métaphysique des valeurs (comme valeurs) − toutes les deux − se montrent d'ici réciproquement bien complémentaires.

Work and broadly understood professional activity constitutes a very significant element of human being’s functioning as it empowers the person, gives the sensation of ability, being independent and needed. Moreover, it is an important part of success while aiming at self-realization. Performing professional work by a disabled person enables him or her to feel socially useful and determines their position in a social hierarchy. It must be said that disabled people constitute the group of people for whom professional work means not only the improvement of their financial situation, but, most of all, it raises their self-esteem. Still, too many disabled people remain vocationally inactive for various reasons; it is not only because of their health. Even though work could give the disabled people some independence, they are forced to fight stereotypes, employers’ ignorance, architectural barriers as well as their own anxiety and low self-esteem. The endless search for the person responsible or blaming others for the present situation will not improve anything. It can only inhibit the process of employing the person with a disability, which may lead those people to adapt demandingness as their way of life. The consequence would be learned helplessness.

The article is an attempt to link the philosophy of Levinas with the bioethical issues of the beginning of human life. The author refers to those statements of Levinas in which he describes who a person is, what is human body, being male/female, fatherhood. The ethical-anthropological character of Levinas’ thought makes it a profound source for contemporary discussions on moral themes, bioethical problems included. However, certain difficulties arise on account of the philosopher’s highly individual language. The aim of the article is to confront the language o f Levinas with the traditional language of Aristotelian-Thomistic philosophy and colloquial language. The text is a proposition how to build bioethics not only on Aristotelian-Thomistic philosophy or utilitarian or pragmatic philosophy but also on the philosophy of Levinas, as it sheds additional light on the problem of man, existence, life and interpersonal relations.

Everyone has the right to participate in society, regardless of his or her current personal situation, level of psychosocial functioning or experience. No reason can justify marginalisation or exclusion of people from social life at any stage of their lives. The aim of the article is an attempt to characterise the adulthood of people with profound intellectual disabilities on the basis of subjective assessment of their mothers. The methodology applied was that of a qualitative research, where the main research technique was narrative interviews. The results of the research demonstrate that adulthood is the stage of life when people with profound intellectual disabilities and their caregivers require special support in mental, spiritual, social, societal and educational dimensions.

A person is responsible for the implementation of values and at the same time is responsible for treating himself/herself as a value. A human person is capable of self-determination, because s/he can act deliberately. Through self-reflection, a person can choose a course of action for himself/herself and assert “inner self” to the outside world through their choices. The person is also responsible to himself/herself for self-fulfillment. It’s the fulfillment of a person that leads to happiness, which consists in the realization of freedom by choosing the truth. It is associated with the relationship to other people and to God. In this article, the issue of religious education in the family, with special attention to Christian values, as the foundation of education has been presented. Firstly, the author highlights the most significant values in religious education, which is freedom of the person, love, responsibility, and then he shows the role of values in the transmission of content: salvation, Jesus Christ, the Church and Mary.

The quest for and the discovery of the meaning of life, so basic to human existence, play a fundamental role in the process of self‑discovery, that is, in the examination of our own identity, subjectivity and the “self”. Underlying this quest are not merely vague approximations to what man is, but clear fundamental dimensions of humanity: freedom and responsibility.Etty Hillesum and Victor Frankl, take different perspectives on the meaning of life of a person who experiences himself, the world, others and God in the face of war and extreme circumstances (Etty perished in Auschwitz, Frankl survived the concentration camps). However, they both point to the universal trait of the utmost engagement of the will and the assumption of responsibility for one’s life, despite the inevitability of death and the prevalent “cultural hibernation”.In both analyses, freedom appears as a response to reality, to the here and now. That response, as such, means taking responsibility for reality and its shape. Hence it an important question to ask would be what it means to take control of one’s destiny. Is it an obligation, a task, life’s demand, or perhaps just submission to what life may bring? Freedom, which is constantly threatened, must fight for itself. This happens owing to the will to live, which first evokes meaning and then the obligation of taking responsibility for oneself, for others, and even for God himself.

According to the author basis of a consideration is the Council’s Directive 2011/96/EU of 30th November 2011 on the Common System of Taxation applicable in the Case of Parent Companies and Subsidiaries of Different Member States. According to its rules, it is important that both a parent company and a subsidiary one have registered offices for tax purposes in different Member States. Another crucial thing is the avoidance of double taxation in an economic meaning regarding income pay out to the parent company by the one. Furthermore Article 5 of the above-mentioned directive states a principle, according to which a profit paid to a parent company by a subsidiary one is exempt from tax deducted with regard to a source of a revenue. Article 5 fulfills the assumption that double taxation in a legal meaning ought to be eliminated.

According to the author, it should be recognized that it is admissible to conclude an employment contract, to which a completely incapacitated person would be a party. In such a case, the contract should be concluded by a guardian of such a person. Employment of a totally legally incapacitated person should meet the requirements of the Act on Vocational and Social Rehabilitation and Employment of Disabled Persons, including those relating to the performance of work in sheltered employment conditions or in a position adapted by the employer to the needs of such person. The assessment of the admissibility of employing a completely legally incapacitated person in a kindergarten as a janitor should be performed assessing each case individually, taking into account the cause of incapacitation and the scope of facilitations introduced by the employer.

An individual residing abroad is not subject to Polish tax jurisdiction in relation to the income acquired abroad. In the case of a taxpayer resident in Poland, returning from temporary stay abroad for work purposes, the amount of his income tax due in Poland, payable also on income earned abroad, will be calculated in accordance with the provisions of the Law on Income Tax from Individuals and the agreement on avoidance of double taxation concluded by Poland with the country in which the taxpayer had earned income (receipts). The situation of each such person may be different depending on the country in which he/she obtained income, as well as the fact whether - except for income earned abroad - he/she also obtained in this period income from sources located in Poland.

The issue of dynamism plays an important role in Karol Wojtyła’s philosophical anthropology. His study takes into account the context of the philosophy of being and the philosophy of consciousness. He emphasizes the importance of experiencing one’s own subjectivity in the course of dynamism. The purpose of the article is to present the structure of human dynamism proposed by Wojtyła. It contains three types of dynamism: dynamism of suppositum, dynamism in a human being (when something happens to him) and dynamism of human action. The first is in the metaphysical field, two more in the phenomenological field. This structure also contains the fieri factor understood as directing the dynamism to the subject.

Wokół zagadnienia osób niesamodzielnych skupiają się różnego rodzaju rozwiązania prawne, z których wynikają określone uprawnienia dla danej osoby oraz obowiązki innych podmiotów prawa prywatnego oraz organów władzy publicznej. Wobec tego status osoby niesamodzielnej musi być analizowany w kontekście Konstytucji Rzeczypospolitej Polskiej. Akt ten wyznacza pozycję jednostki w państwie i określa ramy ochrony, którą władze publiczne muszą jej zapewnić. Mimo, że pojęcie „osoby niesamodzielnej” nie pojawia się w żadnym z przepisów Konstytucji, należy uznać, że jej status wyznaczają konstytucyjne zasady. W szczególności są to zasada godności, zasada sprawiedliwości społecznej oraz zasada pomocniczości. Konstytucyjny katalog praw człowieka wskazuje na konieczność wsparcia osób niesamodzielnych, w tym na konieczność zapewnienia im minimum egzystencji, dostępu do opieki medycznej, a także na obowiązek stworzenia warunków, by mogły one, stosownie do własnych potrzeb, uczestniczyć w życiu społecznym. Ustawodawca ma dużą swobodę w kształtowaniu systemu instytucjonalnego wsparcia osób niesamodzielnych. Musi przy tym uwzględniać zasadę pomocniczości, a także inne wartości. W szczególności musi zadbać o to, by godność osób niesamodzielnych nie została naruszona.
Issues related to dependent persons include various types of legal solutions that bring about certain rights for a given person as well as obligations to other private law entities and public authorities. Therefore, the status of a dependent person must be analyzed in the context of the Constitution of the Republic of Poland. This act determines the position of an individual in the state and defines the framework of protection that public authorities must provide him or her with. Although the concept of “dependent person” does not appear in any of the provisions of the Constitution, it should be recognized that its status is determined by constitutional principles. In particular, they are the principle of dignity, the principle of social justice and the principle of subsidiarity. The constitutional catalog of human rights points to the need to support dependent people, including the need to provide them with a minimum subsistence and access to medical care, and also the obligation to create appropriate conditions for them to participate in social life according to their own needs. The legislator has great freedom in shaping the institutional system of support for dependent people. It must take into account the principle of subsidiarity and other values. In particular, it must ensure that the dignity of dependent people is not violated.

This article will refer to the analysis carried out by Dietrich von Hildebrand about the human person to elaborate on the anthropology of the person. The notion of value and the notion of importance. From the phenomenological method and the influence of philosophical realism, Hildebrand will renew the Aristotelian notion of the person to express its uniqueness and the possibility of capturing value and realizing it as a guideline for the solution to the current crisis of values and humanity as philosophers like Byung Chul Han or Günther Anders have described it.
Um die Anthropologie der Person zu entwickeln, beziehe ich mich in dem Artikel auf die von Dietrich von Hildebrand durchgeführte Analyse der menschlichen Person sowie auf seinen Begriff von Wert und Bedeutung. Auf der Grundlage phänomenologischer Methode und des philosophischen Realismus will Hildebrand den aristotelischen Begriff der Person erneuern, um seine Einzigartigkeit und die Möglichkeit, Werte zu erfassen, auszudrücken und ihn als einen Weg zur Lösung der gegenwärtigen Werte- und Menschheitskrise zu betrachten, wie es solche Philosophen wie Byung Chul Han und Günther Anders auffassen.
W celu wypracowania antropologii osoby, w artykule odwołuję się do analizy ludzkiej osoby, pojęcia wartości i znaczenia przeprowadzonej przez Dietricha von Hildebranda. Na podstawie metody fenomenologicznej i realizmu filozoficznego Hildebrand chce odnowić Arystotelesowskie pojęcie osoby, by wyrazić jej wyjątkowość oraz możliwość ujęcia wartości i potraktować to jako drogę do rozwiązania obecnego kryzysu wartości i człowieczeństwa, jak to ujmują tacy filozofowie, jak ByungChul Han czy Günther Anders.

Usually philosophers worry about the existence of mind, or consciousness, or persons, or other difficult-to-explain phenomena. Having posited matter or nature, or fields, they wonder where can person or consciousness originate? This kind of thinking is backward. Only persons ask such questions. Persons exist. I turn the tables on the traditional problem of person by asking whether anything impersonal really exists. I argue that the impersonal almost exists, using the theory of feeling of Max Scheler and supplementing it with insights from Alfred North Whitehead and Josiah Royce. Even though feeling almost succeeds in divesting itself of the pre-supposed act of the person, but its concrete actuality blocks such complete self-abstraction.

Th e business name of an entrepreneur who is a natural person may be composed of its sole name and surname. Th e business name of an entrepreneur, who is the foundation, is the name of the foundation. The idea of human rights is connected to the modern perception of law founded on subjectivity, in the context of which rights are authorizations of individual action versus a higher authority, resulting in a subjectivity of law. The huge importance of the thomistic perception of the person is connected with the issue of relations between the individual and society, as well as relations between law and state, since Thomas Aquinas foresaw what we call ‘rights of man’. Thus, the person, in a metaphysical context, is associated with natural order, since natural sociability forms the basis of a person’s supernatural fulfillment. Because of his social nature, the person is also a carrier of social relations and a product of his own encounter with other persons. In this way, Thomas Aquinas makes a synthesis of man per se, as part of mankind, and man as a person vis-à-vis others in the sphere of justice, consisting ‘in rendering to each one his right’. Ius is a relation of justice concerning what is right (iustum) from the point of view of the other, “to whom something is due.” Aquinas can be considered a forerunner of human rights of the modern era, as demonstrated by the issue of natural equity, the issue of unjust law and obedience and the issue of political legitimization. In this framework, “human” or “natural” rights are considered moral rights. However, in the sphere of law they are perceived only within the community and common good, by no means constituting exclusive and absolute rights but only rights corresponding with duties and obligations. The Thomistic approach expresses both the free side of man vis-à-vis the state and its structures (in the spiritual level) and the egalitarian demand of law within social relations. Furthermore, it places the sphere of law on the background of common good and common interest. The Thomistic approach of the human person is a response to the modern perception of legal subjectivity and the priority of individuals, associated with the ideology of rights and leading to a confrontation of individual and society and a division of man to natural man and citizen, a product of the antithesis between society and state.

Apart from many legitimate concerns about ecology, the most important contemporary concern should be of anthropological nature and must address the human being as a person (Benedikt XVI). What is man? Are human beings free? What should human beings do? These Kantian questions also describe the main starting points of Karol Wojtyła’s philosophy in The Acting Person. With regard to the importance of the question (ecology of man) our challenge is divided into three parts. First, man is a person; second, his call is to liberty and last, responsible love is an emanation of personal dignity. In this manner the three important points in Wojtyła’s philosophy (person, liberty, love) are well characterized. The essence of man is his personal dignity as a source for the possibility of free (responsible) decisions – “the act”. The experience of morality is included in the experience of being a person. Wojtyła poses the question “how do I understand who I am throughout my acts?” Like Kant, the author emphasizes the importance of free will, conscientiousness as an obligation, which speaks to the conscious person. I determine myself through my own decision (person´s actions). For Wojtyła, participation in love is the basis of all human personal experiences. “Only persons participate in love”. Participation in the character of the other becomes – in the language of Wojtyła – “the choice of the other person in myself ”.

Humans as social beings feel natural attraction to being with other people, i.e. to establishing and maintaining relationships. Affiliations, such as friendship or love, significantly influence their development from the earliest years of life, either enriching or disturbing the quality of their functioning. Therefore, those who due to their health status or another life situation are marked by otherness, must be prepared to endure hardships. Consequently, persons with disabilities experience failures in their interpersonal contacts. They are often devoid of the opportunity to have a good friend or to experience true love, which may exacerbate their already difficult situation, often triggered within a family setting, where there was no acceptance and/or insufficient quality of parental love. All human beings, children in particular, need closeness and affection. Only then do they develop properly, experience happiness, see the meaning of their lives, feel loved and are able to reciprocate that love. Experiencing a disability or being a parent of a child with a disability may make love more difficult, perhaps even impossible. However, the desire for love can be so strong that it will manage to overcome all obstacles. Unfortunately, it may as well make life a grey existence filled with loneliness and suffering.

The notion “person” has been of great importance in European civilization for several centuries. The formation of its content range was conditioned by the philosophical, theological, and cultural influences of Europe’s two major civilization centres, namely the Byzantine Empire and the Roman Empire. The important question therefore becomes: What are the differences in the understanding of the concept of “person” between the world of the Christian East and the world of the Christian West. In search of an answer to this question, the article is a reflection on the views of an outstanding Orthodox theologian—Vladimir Lossky. For decades, his theological heritage has been inspiring both Orthodox and Catholic theologians, constituting an important point of reference in the interpretation of the Church Fathers.

The opinion deals with the rules of taxation of gains from financial assistance for acquiring accommodation, available for functionaries of the Prison Service who are in active service. The analysis covers the existing legal framework, as well as court and administrative practice in this area. The author points out that the said assistance meets the criteria to be considered revenue resulting from a services relationship within the meaning of the Natural Persons’ Income tax Act. This revenue is not exempt from income tax, and the Act does not specify separate (other than general) rules for establishing the moment of obtaining revenue fro that type of benefits. In such case, general principles are applicable, regardless of whether the assistance is deemed nonrefundable at the time of payment or after fifteen years of service.

  The Project “Sheep” resulted from the special educator and ethnologist cooperation, as addressing the need for using an experience and place by representatives of different scientific areas, the purpose of which was to combine professional competence in innovative teaching. The main goal was to raise funds to buy a sheep, then entrust it to the experienced shepherd from Koniaków who wanders along the Carpathians and reconstruct the old way of grazing. At the same time, the participation in this project has been used as an excellent opportunity to talk about building the local identity and cultural heritage values of the region and disabled people. This project also concerned people who are often barely visible in the human herd-people with disabilities.

Opis:

The author analyses and compares the normative approaches to the participation of the suspected and victim in proceedings for using preventive measures in criminal procedure. While comparing regulations within the scope of his interest published in the Code of Criminal Procedure of the year 1928, 1969, and 1997, the author emphasizes the necessity of undertaking analyses through the prism of regulations included in Mental Health Act. He also indicates the necessity to protect the rights of the suspected and victim not only during the preparatory proceedings, but most of all during the proceedings for using preventive measures. He points to the fact that the prosecuted person, who has been charged with a crime, ought to be a subject to special protection stemming from his or her state of mental health. He postulates that in the course of pre-trial hearing lead in accordance with Article 354 of the Code of Criminal Procedure, the participation of the parties – including the suspected person – should be treated as a rule, and only in exceptional cases the absence of the suspected with mental illness should be allowed. The author assesses negatively the regulation included in Article 354 of the Code of Criminal Procedure, which allows for using preventive measures against the suspected person even when a court appointed psychiatrists claim that his or her participation in proceedings is unnecessary. He compares this regulation to the operations of “kangaroo courts”.

Karol Wojtyła’s Osoba i czyn (in English translation known as The Acting Person) is certainly an extraordinary book having considerable significance for contemporary human philosophy. And because the philosophical or quasi-philosophical concept of the human person, consciously or not, explicitly or implicitly, is always at the root of any sociological, psychological, pedagogical or even economic theory, the importance of this work is even greater. It involves both the humanities and social sciences. The purpose of this article is to point out the benefits of this groundbreaking book. In particular, it allows us to rethink the paradigmatic foundations of these sciences. At the same time, it attempts to show how necessary is a critical revision of their own paradigmatic basis. I would also like to consider the essence of the human concept, especially from the perspective of critical realism. Especially, I deal with the issue of subjectivity and justification for the choice of this concept as the key to understanding individual agency. I am convinced that agency is only one dimension of subjectivity and does not allow us to understand the whole problem of autonomy, human freedom, and the meaning of humanity. Wojtyła’s The Acting Person seems to provide extremely important arguments in favor of my thesis. It also helps, I think, to understand the essence of individual subjectivity, issues of fundamental importance in our time, peculiarly, in the broadly understood human sciences.

W artykule podjęto próbę naszkicowania debaty w dziedzinie bioetyki dotyczącej pojęcia osoby. Wstępnie przedstawiono trzy rozumienia problemu: koncepcję osoby w filozofii naturalistycznej, we współczesnym komunitaryzmie i w jednym ze stanowisk humanistycznych. Analiza tych propozycjo prowadzi do wniosku, że osoba postrzegana jest jako byt empiryczny i psychologiczny lub jako wolny, tworzący siebie podmiot. Stwierdzenie to prowadzi do dalszych badań. W celu uniknięcia pewnego dualizmu w percepcji osoby zakorzenionego we wskazanych wyżej stanowiskach rozwinięte zostaje podejście personalistyczne. Podkreśla się w nim, że osobę należy rozumieć jako niepodzielną całość, łączącą w sobie jaźń – subiektywny aspekt osoby, z naturalno-cielesną stroną, która jest obiektywnym aspektem bytu ludzkiego. W ujęciu personalistycznym osoba jawi się jako wcielona subiektywność utworzona przez akt osobowego istnienia. W artykule takie rozumienie osoby przedstawione jest jako istotne dla rozwiązywania złożonych problemów bioetycznych.
This article endeavours to sketch the debate about the concept of a person in the realm of bioethics. Initially, it sets out three understandings of the issue, namely the concept of a person in a naturalistic philosophy, in the current of communitarianism and in one of the humanistic positions. The analyses of these approaches lead to the conclusion that a human person is perceived either as an empirical and psychological entity or as a free subjectivity creating him/herself. This thesis is stimulation to further research. In order to avoid a kind of dualism in perception of the person stemming from the stances outlined above, the personalistic approach is developed. This points out, that a human being should be depicted as one indivisible entity unifying in itself more strictly self, a subjective aspect of the person, with nature-body aspect which is an objective facet of being human. Given this personalistic perspective, a person comes out as an embodied subjectivity formed by the unique personal act of existence. In this article, such a concept of the person is argued as a vital support in the complex field of bioethical dilemmas.

The aim of the article is to describe and explain the meaning of the Polish construction czyjaś osoba ‘the person of some person; persona’. The basis of investigations is the material culled out from the Polish corpora database (NKJP) and Polish historical and contemporary dictionaries. In the syntactic, as well as semantic analyses of the unit in question (esp. its syntactic function and collocations with predicates) the author reaches to a conclusion that: 1) the expression czyjaś osoba is semantic entity; 2) this unit can’t function as an agent in a sentence (persona/the person of some person isn’t someone or something); 3) the language unit czyjaś osoba isn’t equivalent of the notion of person.

This article presents in the first part the concept of Schelerian phenomenology of religion and claims that pre‐phenomenon of Holiness could not be take in the bracket of existence as usual because the religious act raised by Holiness itself is an heteronomic act of God‐Holiness realized in the man and giving evidence of the existence of its Reasoner. In the second part of this article two types of unity are presented: unity due to joint feeling with others (unmittelbares Mitfühlen — “Two parents stand beside the dead body of a beloved child”) and unity due to co‐operation of personal acts (Mitvollzug — “I live, yet not I, but Christ in me”). This two types of unities present the Other in a primordial way, which launched several criticism against Max Scheler’s mysticism. Phenomenology of act and mysticism seems to merge together in one point, calling Maieutic Birth, a their method becomes enactment of meaning (Vollzugstheorie der Bedeutung — Karl Friedrich Gethmann).

Pope John Paul II frequently describes humans in terms of personal being. One could say that this is one of the most fundamental aspects in his teaching. This text analyses the anthropology underlying his papal teaching in the context of the modern world and modern family life. The author emphasizes that the contemporary context reflects a multifaceted  crisis  affecting  humans.  The text explores a core aspect of Pope John Paul II’s teaching in his vision of the family, which is the issue of how to understand the human being as a person. Fundamentally the family is presented as a communion of persons, then a person is shown as the primary determinant in family education.

In literary research, the term ‘outsider’ seems almost absent. It appears slightly more often as a more general notion, but usually alongside three other terms (also not always well defined) to which it is subordinate: Stranger, Other and misfit. Within this heterogenous group, it acts as either a synonym or at best, as a notion close in meaning to the other three, a complement. It seems though that the term ‘outsider’ when referred to a literary character may, as an interpretative category (especially in first-person-narrative prose) prove useful and productive in terms of opening up the interpretation and analysis of a literary work towards dimensions other than those normally inhabited by the three usual companions of the ‘outsider’.

In the text, an attempt was made to analyse selected issues related to gerontology in the relationship to people with disabilities. The context of analyses is the tendency of social ageing tendencies, observed in Poland and in the world, especially in European countries. Selected areas of reflection are combined with the conviction that there is a need for research which would fill in the gap in the field of research carried out so far, focused on the issue of the broadly defined life situation of the people with disabilities in the senior years, which is in the scientific merit of Polish special needs education (pedagogics). There is a justified fear that these individuals are more likely to experience marginalisation and exclusion in many areas of life than people of similar age in the general population.

Treating tutoring as the model of teaching and bringing up and transferring it to land of relations occurring between people, first to remember we should about personal his character, and only later about abilities of different type thanks, with which relations champion – pupil will be more and more excellent and more effective. Specific so persons and their awareness about oneself, persons living in the determined context, are most essential in tutoring and one isn't allowed about it to forget, or to belittle their meaning, for sociotechnical manipulations.
Traktując tutoring jako wzorzec nauczania i wychowania oraz przenosząc go na grunt relacji zachodzących pomiędzy ludźmi, w pierwszej kolejności pamiętać powinniśmy o osobowym jego charakterze, a dopiero później o różnego typu umiejętnościach dzięki, którym relacje mistrz – uczeń będą coraz bardziej doskonalsze i efektywniejsze. Konkretne więc osoby oraz ich świadomość o sobie samych, osoby żyjące w określonym kontekście, są najistotniejsze w tutoringu i nie wolno o tym zapominać, ani umniejszać ich znaczenia, na rzecz socjotechnicznych manipulacji.

To the question “What are we?”, the common-sense answer is “human beings”; but many philosophers prefer to say we are “persons”. This paper argues that the philosophical use of “person” (to mean, roughly, a conscious, rational agent) is problematic. It takes us away from the sound Aristotelian idea that our biological nature is essential to what we are, and towards the suspect Lockean idea that a person could migrate from one body to another. This dualistic Lockean conception is often laid at Descartes’s door, but Descartes himself in many passages underlines our status as human beings. There is a further danger in the idea of personhood as rational agency if (following Kant) it is seen as that which makes someone worthy of moral respect. Respect should be recognized as an inalienable and absolute human entitlement, independent of our circumstances, capacities, group-membership, qualifications or faculties.

The location of these studies within the interpretative orientation ensures an opportunity to get to know the perspective of the Respondents (in this particular case – the homeless). Work on self-presentation is based on the assumption of symbolic interactionism, according to which the basis of interaction is defining the situation, proceeding through interpretation, so reading the meaning of the partner's action and definition, informing the partner about the intentions of action. Therefore, work on self-presentation is an attempt to read the meaning of a partner's activity, based on a specific way of imagining a partner, and thus – the way of treating him and the mechanisms accompanying work on self-presentation.

J. Ratzinger/Benedict XVI as a pope and author of the idea promulgating the Year of Faith is presented in the paper with his concept of faith. The striking element of Ratzinger’s theology is a personal approach to faith. Faith as an encounter triggering conversion is a fully positive and existencial experience of God, who engages the whole person and personality (unitotality of faith), the reason and love. This attitude of faith builds human praxis and shapes interpersonal relations. Here comes the phenomenon of the Church, which the Pope treats as a source and place of faith, especially with reference to liturgy, owing to which the true relation with the Trune God is established and developed.

Opis:

The speech given by St. Pope John Paul II at the UNESCO headquarters in Paris on June 2, 1980 has a special place among his numerous addresses concerning culture. Referring to the cultural changes which took place in the last three centuries the pope stood up for culture, emphasising that, in an individual dimension, culture represents the constitutive element of life of every man and, correspondingly, in a social dimension, it provides a support for self-determination and for the freedom of nations. Formulating such a message, the pope referred to Polish experiences, in order to highlight the significance and the primacy of the person and to point out the subjective meaning of a nation and the ethical dimension of culture. In the papal message one can also find a call for cultural opposition against contemporary subjectivism and other tendencies heading towards the disinheritance of man and to the shutting of the door of the universal horizon of hope and love, which is based on manifold human experiences from the past.

Opis:

A guardianship court may appoint in non-litigious proceedings a guardian for a disabled person (Article 183 of the Polish Family and Guardianship Code, hereinafter: FGC) and for a partially incapacitated person (Article 181 FGC). It is not always possible to precisely delimit the areas of application of these provisions which entails problems in practice. Particularly problematic is the nature of the guardianship established for a disabled person and for a partially incapacitated person and the scope of the powers of both guardians. Especially debatable is the status of the guardian of a partially incapacitated person, who has not been authorized by the court to manage the assets of the ward and represent him/her. The purpose of this article is to indicate the scope of action of the guardian appointed for a disabled person and for a partially incapacitated person together with the determination of their status. The guardian is established for a partially incapacitated person, who, under the authority to represent and manage the property of the ward, is the ward’s statutory representative. The guardian appointed for a disabled person, who is not a statutory representative of this person, has a different status. The guardian under Article 183 FGC provides, above all, factual assistance to a person who has not been incapacitated, even if the person is affected by mental dysfunctions, while the guardian under Article 181 FGC provides assistance in legal acts, procedural acts and factual acts not relating to legal acts for a person who has been partially incapacitated.
Sąd opiekuńczy w trybie postępowania nieprocesowego może ustanowić kuratora dla osoby niepełnosprawnej (art. 183 k.r.o.) oraz dla osoby ubezwłasnowolnionej częściowo (art. 181 k.r.o.). Precyzyjne rozgraniczanie zakresów stosowania wskazanych przepisów nie zawsze jest możliwe i w praktyce nastręcza sporo problemów. Problematyczny jest zwłaszcza charakter kurateli ustanowionej dla osoby niepełnosprawnej i dla osoby ubezwłasnowolnionej częściowo oraz zakres uprawnień obu kuratorów. Dyskusyjny jest szczególnie status kuratora osoby ubezwłasnowolnionej częściowo, którego sąd nie upoważnił do zarządu majątkiem i do reprezentacji kuranda. Celem niniejszego artykułu jest wskazanie zakresu działania kuratora ustanawianego dla osoby niepełnosprawnej i dla osoby ubezwłasnowolnionej częściowo wraz z określeniem ich statusu. Dla osoby ubezwłasnowolnionej częściowo ustanawiany jest kurator, który na podstawie udzielonego upoważnienia do reprezentacji i zarządu majątkiem kuranda jest jego przedstawicielem ustawowym. Odmienny status ma kurator ustanawiany dla osoby niepełnosprawnej, który nie jest jej przedstawicielem ustawowym. Kurator z art. 183 k.r.o. świadczy przede wszystkim pomoc faktyczną dla osoby, która nie została ubezwłasnowolniona, nawet jeśli dotknięta jest dysfunkcjami psychicznymi, natomiast kurator z art. 181 k.r.o. świadczy pomoc w czynnościach prawnych i procesowych oraz w czynnościach faktycznych niezwiązanych z czynnościami prawnymi dla osoby, która została ubezwłasnowolniona częściowo.
