This study paper analyses the regulations applicable to the text of an employment contract. Consideration is given to the type of contract, contract conclusion date, work commencement date, nature of the work, location of the workplace, compensation for work, working time limits, allowances due for business travel, and specific regulations concerning the working time. The purpose of the research was to find out whether the parties to an employment contract enjoy flexibility in determining the foregoing contractual issues or if their liberty in this respect is largely restricted. The article embraces the amendment to the Labour Law regulations pertinent to fixed-term employment contracts, which took effect on 22 February 2016, as well as the amendment to the National Minimum Wage Act, in place as of 1 January 2017. The legal-dogmatic analysis has demonstrated that an explicit conclusion with regard to the flexibility of the parties involved in an employment relationship in setting out certain elements of the employment contract is impossible to reach. For some components, the leeway is greater (e.g. the nature of the work, the location of the workplace), while for other elements, it is more restricted (e.g. the type of contract, compensation for work). Also, the sources of such restrictions are dissimilar – Labour Law regulations, provisions within other primary and secondary legislation, provisions of collective labour agreements and other collective agreements, or, finally, the very nature of the employment relationship.
W opracowaniu dokonano analizy regulacji odnoszących się do treści umowy o pracę. Podjęte rozważania dotyczą rodzaju umowy, daty jej zawarcia, terminu rozpoczęcia pracy, rodzaju pracy i miejsca jej wykonywania, wynagrodzenia za pracę, wymiaru czasu pracy, należności z tytułu podróży służbowych oraz szczegółowych regulacji odnoszących się do czasu pracy. Celem przeprowadzonych badań było rozstrzygnięcie, czy strony umowy o pracę cieszą się elastycznością w kształtowaniu powyższych elementów w umowie o pracę, czy też ich swoboda w tym zakresie jest w dużej mierze ograniczona. Artykuł uwzględnia nowelizację przepisów kodeksu pracy dotyczącą terminowych umów o pracę, która weszła w życie dnia 22 lutego 2016 r., a także znowelizowaną ustawę o minimalnym wynagrodzeniu za pracę w brzmieniu obowiązującym od dnia 1 stycznia 2017 r. Przeprowadzona analiza dogmatyczno-prawna wykazała, że jednoznaczna konkluzja dotycząca elastyczności stron stosunku pracy w kształtowaniu elementów treści umowy o pracę nie jest możliwa. W przypadku niektórych składników jest ona większa (np. rodzaju pracy, miejsca wykonywania pracy), w przypadku innych elementów ograniczenia są dalej idące (np. rodzaju umowy, wynagrodzenia za pracę). Odmienne są również źródła tych ograniczeń – przepisy kodeksu pracy, przepisy innych ustaw i aktów wykonawczych, postanowienia zakładowych źródeł prawa pracy czy wreszcie istota stosunku pracy.

The purpose of this paper is to analyse the existing model of employment arbitration in Poland in force since 2005. According to Article 1164 of the Code of Civil Procedure, arbitra¬tion clauses in employment disputes can only be established once a dispute has already arisen. In reality, this post-dispute voluntary regulation has no practical value and employment ar- bitration is an instrument used extremely rarely in Poland. On the basis of examination of applicable laws, the author shows that in given factual and legal circumstances a reasonable employee and a reasonable employer shall seldom have a cause to simultaneously agree to arbitrate an already existing dispute. By applying the com- parative method at the same time, the paper examines possible criteria of distinguishing categories of disputes, agreements, persons and other conditions that would permit a valid arbitration clause in employment agreements. In conclusion, the author demonstrates that, firstly, the existing voluntary post-dispute employment arbitration model in Poland is a fictitious one and requires reform and, sec- ondly, that both a full elimination of arbitration clauses in employment agreements and a full arbitration clause for all future disputes are too blunt a tool not taking into account the real needs and requirements of today’s employees and employers. The author calls for a more nu- anced regulation of employment arbitration in Poland.

In Lower Silesian Voivodeship the structure of employment, measured by a percentage share of employed persons in sections of an economy, has been evolved in 1999- 2010 years. The main changes took place after 2001 year. The application of Wroclaw taxonomy to the analysis of the structure of employment in Lower Silesian Voivodeship shows two homogenous sets of objects during period 1999-2008. First set covers period 1999-2001 and second covers period 2002-2008. Changes in the second set were smaller than in the first one. Structures of employment in Lower Silesian Voivodeship and Poland in 1999-2010 are not similar. Only a similar tendencies of changes in both cases are observed

This article presents the problems of employment retention and flexibility. Organizations are mainly focused on employees who have high and rare competences. Retention is typical for this group of workers so they get contracts for an unspecified time (typical form of employment). On the contrary flexibility is typical for workers with low and easy available competences. Hence, they usually get limited time contracts. The models of employment can be also matched with the retention and flexibility. Permanent job and retention of workers are typical for traditional model of employment. In flexible model there are three different groups of employees, i.e.: stable workers, peripheries workers and outside collaborators. Peripheries workers and outside collaborators constitute the flexible / inconstant part of employment in the organization. This paper also shows that organizational culture and personnel strategy have an impact on employment retention and flexibility. We can find kinds of organizational culture and personnel strategy which either support or not retention or flexibility.

In view of the challenges faced by the Polish labour market and the growing role of foreign labour force, it seems to be necessary to verify the factors stimulating and hindering the use of foreign workers. This article aims to present the factors from the perspective of employers and employees. Establishment of incentives for employment and impede the use of foreign labour force is crucial in the perspective that may appear on the Polish labour market. Already is observed a lack of manpower in certain industries and occupations (e.g. construction, agriculture), which is related to one side of the international migration of native labour force, on the other by mismatch of skills of Polish workers to labor market needs. The article uses the results of studies conducted in the Opole Voivodeship among employers of foreigners and among foreign workers. Employers as barriers of employment of foreigners pointed formal and legal conditions. However, for foreigners the biggest hurdle was the lack of knowledge of Polish language. Among the demands of changes that may facilitate the use of foreign workers, employer pointed reduce of formality and foreigners have mentioned whiling away the time needed for obtaining visa.

In formulated long-term strategy “Europe 2020” attention is focussed on problems in the sphere of employment. Therefore one of the objectives of the strategy is to reach the employment rate on the level of 75% for women and men aged 20 to 64 by 2020. In National Reform Programs; individual EU member states adjusted their employment objectives to local needs while considering situations on their labour markets and practical probability of changes. Due to differences in social and economic situation in EU-28; and consequences of economic crisis particularly noticeable in individual countries; these objectives are diversified. Achieving the high level of this indicator does not reflect the full situation on the labour market because of rising unemployment and underemployment. Underemployment in the form of over-education; under-qualification or involuntary part-time jobs refers to a growing number of social group; particularly women and young people. The questions that naturally arise from these considerations apply not only to the employment rates; but also to the scale of labour underutilisation; the consequences of this phenomenon for the economy; society; both on micro and macro level. The main research questions are: “What is the scale and dynamics of employment and underemployment in the European Union?”; “How big are disparities across UE?”; “Is there a relationship between high employment and low underemployment?”; “What are the chances to achieve employment objectives in 2020?” Considering the aforementioned conditions; the goal of the paper is to present a diversity in employment and underemployment rate in EU-28 between 2008 and 2014 and to assess a potential probability of achievement of employment objectives by individual member states in the perspective of 2020. The execution of the goal formulated in this way imposed the structure of the paper that includes: 1) definition of underemployment; 2) review of employment objective in “Europe 2020” strategy; 3) analysis of the changes of employment and underemployment in EU-28 between 2000 and 2014; 4) presentation of employment objectives formulated in National Reform programs; and the assessment of their implementation.

The long-term strategic objectives of EU Rural Development Policy in the next (2014-2020) programming period are as follows: competitiveness of agriculture, sustainable management of natural resources and balanced territorial development. In this strategy, agriculture remains to be a key element solution for rural problems. In cooperation with four villages of Nograd County in Hungary, a survey, carried out in the summer of 2012, questioning the local population about their economic and social conditions, the situation of local communities and development ideas, with special focus on the role and potential of agriculture, was conducted. Having analysed the role of agriculture in employment, based on literature and research conducted, it is worth highlighting its significance in solving rural problems and ought to be considered when constructing new rural policy, especially in the following topics: the social functions of traditional agriculture based on local resources, the strengthening of viable farms, the increasing importance of diversification and labor- -intensive products with high added-value.
Długoterminowe cele strategiczne UE dotyczące Polityki Rozwoju Terenów Wiejskich na najbliższy planowany okres (2014-2020) to przede wszystkim: konkurencyjność rolnictwa, zrównoważone zarządzanie bogactwami naturalnym i zrównoważony rozwój terytorialny. Dla tej obranej strategii sektor rolny pozostaje elementem kluczowym, jako rozwiązanie problemów, z którymi borykają się tereny wiejskie. W 2012 r. przeprowadzono ankietę wśród mieszkańców czterech wsi węgierskiego regionu Nógrád. Lokalną ludność zapytano o ocenę swojego statusu ekonomicznego i społecznego, a także o pomysły na dalszy rozwój społeczności, uwzględniając rolę i potencjał rolnictwa. Należy podkreślić kluczową rolę jaką spełnia rolnictwo w rozwiązywaniu problemu zatrudnienia na terenach wiejskich. Podkreślono także funkcje polityki rozwoju tych obszarów, tj. społeczną tradycyjnego rolnictwa opartą na zasobach lokalnych, wspieranie opłacalnych gospodarstw rolnych, rosnące znaczenie dywersyfikacji oraz pracochłonnych produktów o wysokim podatku VAT

One of the prerequisites for the creation of employment opportunities is the overall condition of the economy, however, this prerequisite is not the only one required for the guarantee of the increase of employment. Factors influencing the employment rate are connected to the entrepreneurial environment, which is one of the basic factors of creation of work opportunities in the market economy. In the future, the growth of the employment rate will be connected to the quality of the work force as well as of the renewed economicpolitical concept with a priority on the knowledge economy based on the learning competence.
Jednym z podstawowych warunków dla tworzenia możliwości zatrudnienia jest ogólny stan gospodarki, jednak ten warunek nie tylko jeden wymagany jest dla gwarancji wzrostu zatrudnienia. Czynniki wpływające na poziom zatrudnienia połączone są z otoczeniem, które jest jednym z podstawowych czynników tworzenia możliwości pracy w gospodarce rynkowej. W przyszłości wzrost wskaźnika zatrudnienia będzie podłączony do jakości siły roboczej, jak również odnowionej koncepcji gospodarczo-politycznej z priorytetem w gospodarce opartej na wiedzy w oparciu o kompetencje uczenia się.

Opracowanie stanowiące doniesienie z badań skupiono na trudnościach w uzyskiwaniu zatrudnienia przez osoby z nadwagą oraz otyłe. Wyniki badań ukazują, że w śród objętych badaniami 112 pracodawców (62 kobiet, 50 mężczyzn) tylko 15 kobiet i 7 mężczyzn zatrudniało osoby z nadwagą pod warunkiem, że otyłość nie utrudniała tym osobom wykonywania czynności zawodowych. Wyników tych badań nie można uogólniać, wskazują one jednak, że nadmierna waga ciała może utrudniać procesy przystosowawcze łącznie z uzyskiwaniem pracy.
The study constituting informing from examinations was focussed on problems in getting the employment by overweight persons and obese. Findings are showing, that employers provided with examinations 112 (of 62 women, 50 men) 15 women and 7 men only employed overweight persons provided that the obesity didn't make it difficult for these persons the performance of activities professional. It isn't possible to generalize results of those surveys, however they show that the exaggerated body weight can hinder adaptation processes including getting a job.

The paper presents the quantitative changes that have occurred in employment among the rural population of Opole Voivodship after Polish accession to the European Union - over the years 2006-2010. Determination of these changes was possible because in 2006 and in 2010 there had been conducted quantitative research on the same sample group and with usage of the same research method. The comparative analysis of results of the research proved that within four years both the number of people working permanently in Poland and working abroad have changed. The results also indicated significant differences in the trends of changes between the two groups of the population living in Opole Voivodship - among the autochthon population who have the Polish and German citizenship and among non-autochthonous population who have only Polish citizenship.

This paper examines circumstances inducing employers to introduce employment flexibility policies. The issue is discussed in terms of flexibility in the quantitative, functional, time-related, and financial aspects of employment. At the same time, an effort is made to demonstrate that employer efforts at introducing flexibility in employment should be examined not only in terms of opportunities, but also risks. The primary risk is associated with limited receptivity on the part of employers towards the issue of employment security, with its resulting problems of organizational trust, decreased employee loyalty, and other consequences that impact company operation.

In independent Poland, the foundations for a new area of law, that is, labour law were laid, abandoning the previously crucial principle of freedom of contract underlying the contractual relationship between an employee and the employer. On March 16, 1928, the President of the Republic of Poland issued an ordinance on labour contracts, defining mutual obligations of employees and their employers under an employment contract based on which the employee undertook to perform work for the employer against remuneration. The legislator permitted the conclusion of employment contracts in writing, orally or in any other customary form accepted in a given workplace. In exchange for the work performed, the employer was obliged to pay appropriate contractual remuneration, as specified in the employment agreement. Importantly, this ordinance contained a number of protective regulations that were designed to protect the worker and make his position towards the employer more equal. They included regulations concerning remuneration protection or the employer’s obligation to specify work rules. Most importantly, however, the ordinance protected the worker from immediate and unjustified dismissal.

The latest Eurostat projections show that both population and labour force ageing change employment profiles by age in the European Union countries even in case of an increase in labour force participation and employment (The 2012 Ageing Report). My research question is how basic individual (such as age, education, household position, place of residence) and contextual characteristics (such as the business cycle and the regional labour market situation) influence on employment opportunities in Poland. I test whether the impact of different factors varies with age, which has been categorized to reflect different stages of the life course: youth and young adults (15–29 years old), prime aged (30–54 years old), and older workers (for women: 55–59, for men: 55–64). To answer the research question three types of multilevel logistic models were applied: (a) general models with age as one of the basic determinants, (b) models for each age group for non-agriculture and agriculture. The data used come from the Polish Labour Force Survey (BAEL) of the years 1998–2008 and regional labour market data. The analysis reveals that there are differences in influence of individual and context variables on employment odd ratios between age groups, sex and employment sectors.

The purpose of the paper is to identify the dynamics and structure of employment transformations in Poland post accession to the European Union. The fundamental component of the paper is the analysis of the changes in economic activity and in employment structure. In the whole period included in the analysis (from 1999 to 2010) there existed a clear, positive relationship between changes in the structure of production and changes in structure of employment in Polish economy. The highest labour absorptiveness of labour resources (expressed both in absolute units and in dynamics measures) that was typical of the sectors and spheres of the lowest rates of labour productiveness growth i.e. market and non-market services), was a characteristic feature of Polish economy in the studied period

This study presents a dynamic general equilibrium model with an explicit employment period and investigates economic fluctuations to a temporary productivity shock. Numerical experiments indicate oscillatory responses of new hiring and employment to the shock which are not observed in a standard flexible price model. The explicit employment period constructs an overlapping structure of employment which results in the oscillatory response. This study also examines the effects of change in employment period to economic fluctuations and shows that the variations in new hiring are higher when the employment period is long.

Research background: Among the determinants of the socio-economic development of the region, an important role is played by its endogenous potential. It is reflected in the industry structure of the region, formed in the process of its historical development. The industry structure is the basis for the development of regional specialisations. One of the criteria for defining specialisations is the employment structure by sections and divisions of the national economy. The definition of regional specialisations is indispensable for planning the development policy and for formulating regional strategies. Purpose of the article: The main objective of the paper is the analysis and evaluation of employment structure as a criterion for the delimitation of industries identified as smart specialisations in the region. The study covers the case of selected region in Poland at NUTS-2 level ? the voivodeship of Małopolska.  Methods: The study is based on GUS unpublished data (Statistics Poland) for 2009 and 2018. It makes use of descriptive statistical analysis methods and structure and dynamics ratios, as well as Florence?s specialisation coefficient. Findings & value added: The research has shown that the employment structure indicating the presence of the region's specialisation in given industries is an important, but not sufficient criterion for the evaluation, whether the delimitation of industries recognized as smart specialisations was appropriate. In the light of the conducted research, it seems fully justified to grant the status of smart specialisation in Małopolska to Information and Communication Technologies as well as to Creative and Leisure Industries. In the context of changes to employment dynamics and structures, the possible development-oriented smart specialisations are as follows: Manufacture of metals and metal products, Electronics and machine industry, and Chemistry. On the other hand, the identified specialisations: Life science and Sustainable energy are not in line with changes in the region?s employment structure. The paper proposes one of the possible ways of precise identification of distinctive regional industries with high development potential. The structure of employment and changes occurring in this area make it possible to determine the main forces of the region's endogenous potential, and thus may form the basis for the determination, and in the longer term, assessment of the relevance of identified regional smart specialisations. The added value of the study is, therefore, an attempt to assess, on the example of a selected region, to what extent changes in regional specialisations reflected in the existing employment structure confirm the accuracy of the selection of industries identified as regional smart specialisations. The presented case is an exemplification of the proposed method, which can also be successfully applied to other European regions.

In Poland, as in other European Union countries, childcare is perceived as females' chore. In this article availability to current and potential parents of teleworking and flexible working time are analysed. Differences in age, gender and other socio-economic attributes were analysed.

Wykonywanie pracy na podstawie innej niż stosunek pracy przybiera rozmaite postaci. Najczęściej odbywa się na podstawie stosunków cywilnoprawnych, które cechuje zasada swobody umów, czego konsekwencją jest możliwość swobodnego ukształtowania treści stosunku prawnego. Ostatnie lata znamionuje jednak stopniowe zwiększanie regulacji zatrudnienia niepracowniczego realizowanego na podstawie umów cywilnoprawnych. Wprowadzanie minimalnej stawki godzinowej, ograniczenie zatrudnienia w handlu w niedziele i święta, świadczenie pracy tymczasowej na podstawie umów cywilnoprawnych czy dużo wcześniejsze szerokie przyznanie praw pracowniczych wykonawcom umów o pracę nakładczą, a nade wszystko objęcie prawem do bezpiecznych i higienicznych warunków pracy każdego, kto wykonuje pracę, uzasadnia stawianie pytań o dalszy kierunek zmian.
Performance of work on a basis other than an employment relationship takes various forms. Predominantly, it takes place based on civil law relationships, which are characterised by the principle of freedom of contract, which results in the possibility of freely shaping the content of any such legal relationship. However, recent years are marked by a gradual increase in regulations of employment other than based on contracts of employment, i.e. based on civil law contracts. Introducing a minimum hourly wage, limiting employment in trade on Sundays and public holidays, providing temporary work under civil law contracts or the much earlier widespread granting of employment rights to contractors in the putting-out system and, above all, granting the right to safe and hygienic working conditions to everyone who performs work justifies asking questions about future developments.

The article presents a brief overview of the research so far and theoretical considerations on the differences that make an individual choose a non-traditional form of work. Some people deliberately choose alternative employment due to its flexibility, freedom and variety of tasks offered. Individuals preferring this type of employment mainly due to the said characteristics are referred to as voluntary employees. A coercive flexible employee is someone who perceives his/her employment as unattractive and undesirable, and it is only inability and lack of chances to find a permanent or a different type of employment that makes them choose this type of employment for a specified period of time or on short- term basis. Given the choice between a flexible form of employment and “permanent” job, assuming that conditions offered are acceptable, they do not hesitate to choose the latter.

In his article, the author discusses the possibility of court control over various ways of termination of employment and non-contractual employment from the angle of the constitutional right to court trial and protective function of the Labour Code. The article presents the scope of courts’ control in cases when contractual or non-contractual employment is terminated, as well as the legal nature of the ruling on restoration of employment and compensation if legal deficiencies have been found with regard to the termination of employment. The issue of legal measures that courts have at their disposal in cases when the termination of employment has been questioned is also discussed in the article, as well as possibilities to more broadly apply compensation claims instead of restitution claims.

The aim of this article is to present practical difficulties and their solutions and also to illustrate effects of the introduced amendment to Art. 29 § 2 of the Act of June 26, 1974 of Labour Code. The author shows how this regulation was shaped in previous amendments in his attempt to answer how the finally introduced amendments have improved the situation of employees. Consequently, the aim of the article is to present the benefits resulting from this change, but also the risks arising upon introduction of the latest amendment. The author considers the question whether the procedure, however simple from the point of view of the legislative technique, is not an unfortunate attempt to patch the legal gap, which is often the subject of abuse. In the text, the author also wonders how the amended provision affects the situation of people starting work and what it alters in the case of people who have been in the labour market for years.

Purpose – Self-employment is considered one of the responses to precarious employment, particularly among those who lost jobs during an economic crisis. Although starting a new business is widely available, operating new ventures remains challenging. This article aims to explore the premises of self-employment success, namely self-employment intention and proactive coping as crucial predictors of further performance. Design/methodology/approach – The authors recruited participants among initially unemployed individuals who participated in the entrepreneurial program aimed at creating self-employment. Since entrepreneurs are expected to have specific personal characteristics important for performance, the authors assessed proactive coping as the key factor for self-employment intention. Findings – The results depicted proactive coping as crucial in performing own ventures in the long run, which suggests that self-employment intention may change over time. Practical implications – Proactive coping is particularly appropriate for self-employed at any stage of the entrepreneurial process because it maintains the intention to perform own business. Thus, the findings underline the need for proactive coping training for entrepreneurs, particularly those previously unemployed. Originality/value – As the self-employment intention may differ in time, the importance of being proactive in operating small businesses increases.

Opis:
Work represents a particular economical, social and psychological relevance to the worker. Because of a personal dimension of work, that involves human beings, it cannot be separated from workers. The approach to human labour as not a market product, but as a human being, is contained in the statement that ‘labour is not a commodity’, firstly expressed in the International Labour Organization’s 1944 Declaration of Philadelphia. The reference to this assumption more recently on the occasion of the 100th anniversary of ILO activities clearly evidence that the history of labour has come full circle and the idea of decent work for workers has returned to being the centre of labour law regulations. The concerns relating to the inadequate protection of workers coincided in time with the transformative change in the world of work. With this in mind, it is then worth considering more deeply whether a decent job is an ‘exclusive’ and ‘luxurious’ ideal, and leave outside its scope a number of workers who are in need of protection because of their unique situation. The position of Poland in this picture will be analysed.

In the study I exploit European Social Survey Round 5 data to identify the determinants of temporary employment in Poland. As in this country the share of employees working under contracts of limited duration is the highest among all European Union member states, identifying the determinants of temporary employment is important not only for individuals but also for the policy-makers. The results of the analysis are supplemented with an investigation of the determinants of temporary employment for people younger than 30 years old as this phenomenon is commonly associated with young employees.

The population is a source of a country’s state potential that aids the achievement of strategic plans. Well-being of the population is a guarantee of successful implementation of employment programs in the context of market economics. The main task of state regulation is to reach the desired goal and targets under the conditions of contemporary and actual environment. Research objective The objective is to review the implementation of state programmes in regards to population employment and to analyse the actual concepts of state politics development in regards to employment, its efficiency in the present environment of social tension of a region – Aktobe oblast. Methods By means of analysis the general scientific research methods have been defined – system methods based on analysis and evaluation of practical and operative data of official statistical sources of Committee on Statistics of Republic of Kazakhstan, the data of city department of Aktobe Employment Centre. Conclusions The article generalizes the systems of state principles in implementation of state programmes for elimination of social threats leading to different external and internal threats, poverty and social tension in the region. It reveals the legal steps and responsibility of the employment parties, relationship of unemployed citizens and the state.

Abstract This paper investigates the relationship between the implementation of the Family 500+ benefit, changes in female employment and female economic inactivity. The analysis is based on macro data and is focused on the years 2016–2019. To examine the relationship, this study uses decomposition of the employment-to-population ratio change into labour supply and unemployment components, analysis of changes in the structure of nonparticipants and the shift-share method. Considering that the reaction to the child benefit may differ across age groups, this study found that since the introduction of the Family 500+ benefit, the employment-to-population ratio for women aged 25–39 (the most likely age group to be raising children and therefore to receive the benefit) stagnated, their labour force participation rate decreased and the percentage of nonparticipants due to family and household responsibilities increased.

This paper presents the cornerstones of the conceptual distinctions necessary to map out a separate category of workers, namely “economically dependent self-employed workers” (who fall between dependent subordinated employees and independent self-employed entrepreneurs) from the perspective of the EU law and the laws of selected Member States. The author considers how the economic dependency of self-employed workers should be defined, which method(s) of protection should be applied to these workers, and what scope of protection they should enjoy. The observations in this paper serve as a basis for de lege ferenda recommendations for the Polish legislator. At present, there is no separate category of “economically dependent self-employed workers” in Polish law.

Świat pracy zmienia się. Praca stała się bardziej niepewna w kategorii bezpieczeństwo pracy, wynagrodzenia i warunków pracy. Z punktu widzenia pracodawców, często spotykają się oni z wykwalifikowanymi pracownikami, ale też i brakami w umiejętnościach, a zapewniając elastyczne warunki pracy stają się warunkiem sine qua non dla skutecznego działania. Zapewnienie elastycznych form pracy jest obecnie nieodłączną częścią wizerunku marki wielu organizacji, szczególnie w przypadku rynku pracy dla pracowników, rynku który stał się rynkiem globalnym. W związku z tym praca, pod względem czasu (godzin pracy) i lokalizacji (miejsca pracy), staje się hybrydą dla wielu pracowników i pracodawców. W nowej gospodarce XXI wieku, wykonywanie pracy będzie zatem bardzo różnić się od pracy w przeszłości.
The world of work is changing. In comparison with the communist era, jobs have become more precarious, in terms of job security, remuneration and working conditions. From the perspective of employers, often faced with skills shortages and skills gaps, providing flexible working arrangements is a sine qua non for effective operation. Provision of flexible working arrangements is now part and parcel of the brand image of many organisations, particularly where the labour market for staff is global. Consequently work, in terms of time (working hours) and space (location), is increasingly hybrid for many employees and employers. In the new economy of the 21st century, working practices will look very different from in the past.

Opis:
The purpose of this paper is to demonstrate the employment costs and advantages of employing a foreign labour force. The analysis was made based on the dual labour market theory, whereas employers were divided into employers of foreigners in occupations from the primary and secondary labour market. The analysis was based on 263 semi-structured interviews with employers from the Opolskie Voivodeship (Poland). The respondents were contacted in several ways. Firstly, the CAWI (Computer-Assisted Web Interview) and then PAPI (Paper & Pen Personal Interview) methods were used. The study showed that there is a significant statistical relationship between the labour market segment in which an employer hires a foreign employee, and the advantages gained by the employer. On the other hand, the study demonstrated no statistical relations between the labour market segment and the barriers for employing foreigners and their evaluation made by employers.

This article presents the impact of the global crisis on employment in the OECD countries, and in particular is an attempt to explain why the impact is of a different scope in particular countries. Particular attention has been paid to the question of the role played by labour market institutions (such as employment protection legislation and fixed-term employment). The global economic crisis has influenced the situation in the labour markets of OECD countries, causing declines in employment and increases in unemployment. Changes in the level of employment in individual countries varied. Between 2007-2012 declines in production took place in the majority of OECD countries. Declines in real wages were also observed in those countries. On the other hand, in the period of 2005-2012 relatively small changes in labour market institutions occurred. With respect to both the stringency of employment protection legislation, as well as the share of fixed-term employment, there were no clearly visible trends in the data during the period of economic crisis. The econometric verification of theoretical hypotheses was performed using annual data from the 2005-2012 period for 26 OECD countries, and itshows that GDP and real wages were statistically significant determinants of employment size in the analyzed period. The study also confirmed the hypothesis of the existence of a non-linear (U-shaped) relationship between employment elasticity with respect to GDP and the level of stringency of employment protection legislation, as well as the share of fixed-term employment in the total number of employment contracts. The results show that the smallest declines in employment during a crisis might be expected in countries where the level of EPL is close to 2, and the share of fixed-term employment in the total number of employment contracts is close to 18%.
Przedmiotem artykułu są skutki globalnego kryzysu dla zatrudnienia w krajach OECD, a w szczególności próba objaśnienia przyczyn ich zróżnicowanych rozmiarów w poszczególnych krajach. Szczególną uwagę w tym objaśnieniu zwrócono na pytanie, jaką rolę odgrywają tutaj instytucje rynku pracy, a w szczególności prawna ochrona zatrudnienia i umowy o pracę na czas określony. Globalny kryzys gospodarczy przekładał się na sytuację panującą na rynkach pracy krajów OECD powodując spadki zatrudnienia i wzrosty bezrobocia. Zmiany rozmiarów zatrudnienia w poszczególnych krajach były zróżnicowane. W latach 2007- 2012 w większości krajów OECD wystąpiły spadki rozmiarów produkcji. Obserwowano w nich również spadki rozmiarów płac realnych. Stosunkowo niewielkim zmianom w latach 2005-2012 podlegały natomiast czynniki o charakterze instytucjonalnym. Zarówno w przypadku restrykcyjności prawnej ochrony zatrudnienia, jak i w przypadku udziału zatrudnienia na czas określony nie wystąpiły wyraźne tendencje zmian tych wartości w okresie trwania kryzysu gospodarczego. Weryfikacja ekonometryczna wysuniętych hipotez teoretycznych została przeprowadzona w oparciu o dane roczne z lat 2005-2012 dla 26 krajów OECD i wykazała, że PKB i płace realne były istotnymi czynnikami determinującymi rozmiary zatrudnienia w analizowanym okresie. Potwierdzono również hipotezę o istnieniu nieliniowej (U-kształtnej) zależności pomiędzy elastycznością zatrudnienia względem PKB a stopniem restrykcyjności prawnej ochrony zatrudnienia oraz udziałem zatrudnienia na czas określony. Uzyskane wyniki wskazują, iż najmniejszych spadków zatrudnienia w okresie kryzysu możemy się spodziewać w krajach, w których poziom EPL jest bliski 2, a udział umów o pracę na czas określony w liczbie umów ogółem jest bliski 18%.

Farming has been considered as main source of income for rural households in Nigeria, despite their involvement in other income generating activities. Focusing on income derivable from farming alone may be partially responsible for the ineffective poverty reduction strategies in Nigeria. Using the National Living Standard Survey data collected by the National Bureau of Statistics, this paper investigated the composition and determinants of non-farm incomes of rural households in Nigeria. The results show that the share of farm, non-farm wage (NFW)- and self-employment (NFS) incomes in total household incomes were 24.3%, 43.0% and 23.7% respectively. Households whose heads are male (0.647), had formal education (0.522), increased the likelihood of households’ participation in NFW activities, while access to credit (-0.307) and having larger farm size (-0.221) decreased it. Access to credit (0.379); community participation (0.103); larger family size (0.193) and possession of capital assets (0.069) increased the likelihood of participation in NFS-employment activities, while having larger farm size (-0.211) decreased it. The study concludes that policy targeting poverty reduction should focus on providing enabling environment for poor households’ access to non-farm activities in the study area.

Goal – the article analyses the most important legal acts regulating the employment of foreigners in Poland. The article aims to evaluate the adequacy of the introduced legal changes to the needs of the Polish labour market. The assumed hypothesis was that the legal regulations on the employment of foreigners in Poland are adjusted to the changes in the economic reality. Research methodology – the article includes an analysis of the available literature and the current legal acts that regulate the studied problem. Moreover, observations con cerning the adaptation of Polish legal regulations to the constantly growing interest of foreigners in the Polish labour market were made in the article. Score/results – the conducted analysis allowed us to verify the research hypothesis positively. It has been acknowledged that the provisions of Polish law in the field of employment of foreigners have been adapted to the changing economic conditions, al though the procedure for obtaining work permits for foreigners remains complicated. Originality/value – the article shows a cross-section of changes that have taken place in Polish labour law in the field of employment of foreigners in recent years.Changes in the Polish labour law have been presented chronologically, which helps to organize the knowledge on the topic. Moreover, it also considers the current problem of the COVID-19 pandemic and its impact on legal aspects of employment of foreigners in Poland.

In this paper we undertake an attempt to assess an impact which levels of education and vocational skills both have on the individuals’ position in the labor market. This position we define on the basis of probability of loosing a job by the employed and odds of finding a job by the unemployed. The work presents the results of the preliminary research on the employment of foreigners’ that were conducted among Polish banking institutions being the international corporations with a global reach. The initial results of the analysis shows the potential impact that specific employment policies exert on personal attitudes of foreign executives and operations of the companies in which they are employed. The analysis described in this work identifies the most important elements which hinder the development of those banks whose employment policies are based on the assumption that hiring foreigners is more beneficial than taking on local managers regardless of their familiarity with Polish market mechanisms. The qualitative research that were conducted in the form of the scenario-based interviews, were carried out with both, a group of managers (mainly heads of HR departments and senior executives) cooperating with the foreigners on everyday basis, and the foreigners themselves. The preliminary studies have revealed a number of trends and phenomenon that were described within this work.

This paper shows important trends on the contemporary labor market in the area of forms of employment. Possibilities for the implementation of flexible forms of employment in the shipbuilding industry are demonstrated in experience gained through the EUROSTER Project, financed by the European Social Fund. The paper examines the best employment structures for use in the businesses of this industry. Professions that can be performed applying flexible forms of employment are also looked at. Research among the managerial staff of the shipbuilding industry is used to present opinions on implementation of such forms and structures. Lastly, this paper looks at problems linked with barriers to undertaking changes in forms of employment in the companies.

Aim – The study aimed at defining the role of innovation as a factor related to shaping the regional labor market. The Author, based on the results of the available data, attempted to define the relation between innovative activity companies and employment and to verify the hypothesis that the implementation of innovation has influence on the increase of working positions and results in a change in the structure of employment in the region. Research methodology – The paper presents selected data from the Central Statistical Office, including mainly the results concerning the outlays on R&D, the activity of companies in Podlaskie voivodeship, and employment, including the division into PKD sections from 2007. On the basis of the conducted study there was conducted analysis of the impact that the implementation of innovations in particular sections has had on the increase of employment in them. Result – The influence of innovation on employment is connected to so-called creative destruction, which means that on the one hand innovation destroys existing working positions, but on the other hand it creates new ones – more specialized and requiring new knowledge. Originality/value – The analysis of the impact of implementing innovations on the employment level in particular sections of Podlaskie voivodeship.

Transportation and delivery play a vital role in the economy, an efficient transportation system has a determining role in it. Its importance is far more significant than what the transportation sectors proportionally represent. Knowledge-intensive business services are one of the most dynamically developing areas in contemporary economies and at the same time they constitute one of the fundamental pillars of a knowledge economy. These are related, among others, to research and development activity, legal activity, activity in the sphere of architecture and engineering or information technology services. Interest in knowledge-intensive business services (KIBS) is a result of rapidly occurring changes in recent decades, the creation of a knowledge economy and an information society, the growing importance of knowledge and human capital as well as innovativeness. The scope of the employer’s obligation to make contributions is determined by the question of whether the employer concluding a civil law contract with a person maintains at the same time an employment relationship (of full‑time nature) with that person, or whether that person is employed under a contract of employment with another employer. The author claims that in the first case the employer is obliged to make old‑age, disability and accident contributions for that person, in respect of both the contract for employment and civil law contract. In contrast, the entity concluding a civil law contract with a person who maintains an employment relationship with another entity, it is not obliged to make such contributions. The same rules apply to the employment of a postgraduate student.

A psychological analysis of the functioning of people in the work envi- ronment has been conducted on the basis of the results of quantitative research carried out among workers employed in nine forms of flexible employment, drawing on a model of selected psychological variables, in- cluding employment choice autonomy, attribution of organizational mem- bership, form and content of psychological contract, and attitudes towards work and social skills, including personal flexibility and assertive behav- iour. Work satisfaction in flexible types of employment has also been stud- ied, along with the psychological cost associated with this type of employment.

Research background: This paper observes especially the position of cities, urban areas in the context of global value chains - GVCs. Global value chains reflect specialization and labour division of companies, mostly multinational enterprises - MNEs. MNEs can be considered flagships of some industries. Such flagships influence suppliers and purchasers. MNEs are a part of networks or have got access to such networks that combine dispersion of the value chain, the boundaries of the firm and across national borders. Purpose of the article: The impetus for this work was to look at the position of Slovak cities (Bratislava, Žilina) in order to look for sectors that can help to develop the city and its adjacent regions, particularly cross-border regions. The paper discussed how the attribute of the cross-border regions gives the cities more advantageous position in GVCs. Methodology: Applying the method of location quotient allowed to shed a light on the GVCs, which cities participate in. Some cities were in a position to take advantage of participation in GVCs. Findings & Value added: Examined cities are located in the western part of the Slovak Republic. Discussion about the attribute of the cross-border regions can stimulate new ideas for finding causalities in city sprawl or in specialization patterns in the industrial structure of the city. Discussion further fosters the comparison of two cities strengths and weaknesses of each of them that were summarized in terms of employment and industrial exploitation of GVCs. This is the first finding and value added of the paper. The second one is that the method of location quotient is simple but provides clear evidence of the regional development or decline in particular industries and at the time of observation.

From January 1, 2019. Amendments to the Act of July 5, 2018 amending the provisions on trade unions and some other acts apply (almost in full). Amendments to the Polish act are a consequence of the Committee for the Freedom of Association, Labor Law Organizations and the judgment of the Polish Constitutional Tribunal. The main and expected effect of the amendment is the extension of coalition freedom in trade unions. This issue is important not only for the consistency of the legal system with international law, but also for social reasons. Concluding civil law contracts in the place of employee forms of employment is a common practice in Polish conditions. The main problem is that the civil law contract has a purpose other than the employment contract. Contracts of mandate and provision of services are the basis for the implementation of actual and legal activities. Besides, the legislator does not have any real actions aimed at eliminating the defective practice. The text is an attempt to synthetically summarize the motives of the amendment, as well as its effects and tests.
Od 1 stycznia 2019 r. obowiązują (niemal w całości) zmiany wprowadzone ustawą z dnia 5 lipca 2018 r. o zmianie ustawy o związkach zawodowych oraz niektórych innych ustaw. Zmiany w Polskiej ustawie są następstwem zaleceń Committee on Freedom of Association Labour Law Organizations i wyroku Polskiego Trybunału Konstytucyjnego. Zasadniczym i oczekiwanym skutkiem nowelizacji jest poszerzenie wolności koalicji w związkach zawodowych. Kwestia ta jest istotna nie tylko ze względu na spójność krajowego systemu prawnego z prawem międzynawowym, ale także ze względów społecznych. Zawieranie umów cywilnoprawnych w miejsce pracowniczych form zatrudnienia jest częstą praktyką w polskich warunkach. Zasadniczy problem wiąże się z tym, że umowy cywilnoprawne mają inne przeznaczenie i cel niż umowa o pracę. Umowy zlecenia i świadczenia usług są podstawą realizacji czynności faktycznych i prawnych. Pomimo to, ustawodawca nie podejmuje żadnych realnych działań zmierzających do wyeliminowania wadliwej praktyki. Tekst jest próbą syntetycznego omówienia motywów nowelizacji, a także jej skutków. W prowadzonych badaniach zostanie wykorzystany dorobek literatury i orzecznictwa. Analiza obejmie projekt nowelizowanej ustawy i materiały legislacyjne, a także źródła prawa międzynarodowego.

Issuing of a work inspector’s permission for a child to take up work or other gainful activities is a guarantee that he or she will be employed in appropriate conditions. It’s purpose is to protect a child from work that is dangerous and threatening to it’s development. The purpose of this article is to examine the legal nature of the permission as well as the elements that it must contain in order to be considered lawful. The dogmatic analysis of the aforementioned issue will be supported by empirical research based on data obtained from the Labor Inspectorate.
Wydanie zezwolenia inspektora pracy na podjęcie pracy lub innych zajęć zarobkowych przez dziecko jest gwarancją, że będzie ono zatrudnione w odpowiednich warunkach. Jego celem jest zabezpieczenie dziecka przed pracą niebezpieczną i zagrażającą jego rozwojowi. Celem artykułu jest zbadanie charakteru prawnego wskazanego zezwolenia, a także elementów, które musi ono zawierać, by uznane było za zgodne z prawem. Dogmatyczna analiza powyżej wspomnianego zagadnienia poparta zostanie badaniami empirycznymi przeprowadzonymi na podstawie danych uzyskanych z Inspekcji Pracy.

Shifts in the trisectoral structure of economy are directly connected with the development level of a given country, which is in turn accompanied by changes in the labour market: jobs disappear in some sectors and are established in others. The growth of employment in the service sector is accompanied by a systematic drop in the number of persons working in industry and agriculture, which is defined as an economy servication process. The direction of changes in polish economy corresponds to the changes in the EU-15, which confirms the convergence of employment structures, and what was the purpose of this article. However, it should be stressed that the direction and dynamics of changes taking place within each sector is insufficient, especially with regard to the high-tech sectors.

The foregoing study attempts to present the institution of the employee’s subordination in evolutionary terms. From the very beginning of the labour law, the criterion of subordination, defined mainly as submission of the employee to the authority of the employer in the work process, was described in the literature of the subject and judicial decisions as an inherent (necessary) constituent of the employment relationship (the most basic structural feature of that relationship), distinguishing it from other forms of employment, especially a relation under civil law. The author analyzes the approach of the legislature as well as the views of the labour law doctrine and judicature made in relation to this criterion over subsequent periods in history. Finally, the study is concluded with some de lege ferenda postulates as to how to shape the institution of employee’s subordination in the provisions of the labour law.
Przedmiotem niniejszego opracowania jest próba ukazania instytucji pracowniczego podporządkowania w ujęciu ewolucyjnym. Kryterium podporządkowania, którego istotą jest poddanie się pracownika kierownictwu pracodawcy w procesie wykonywania pracy, w literaturze przedmiotu i orzecznictwie sądowym od początku prawa pracy stanowiło nieodłączny (konieczny) element stosunku pracy (najbardziej podstawową konstrukcyjną cechę tego stosunku), odróżniający go od pozostałych form zatrudnienia, zwłaszcza tych o charakterze cywilnoprawnym. Autor analizuje sposób podejścia ustawodawcy oraz poglądy doktryny prawa pracy i judykatury formułowane w przedmiocie tego kryterium na przestrzeni kolejnych okresów historycznych. Rozważania kończą postulaty de lege ferenda co do sposobu ukształtowania instytucji pracowniczego podporządkowania w przepisach prawa pracy.

Cel – Celem rozważań jest pokazanie (w ujęciu syntetycznym) w jakim kierunku dokonały się zmiany w sferze polityki zatrudnienia po II wojnie światowej, ze szczególnym uwzględnieniem działalności publicznych służb zatrudnienia. Ze względu na szeroką problematykę badawczą rozważania są ograniczone do aspektów prawnych, przeobrażeń organizacyjnych, celów i kierunków działania tych służb – pomija się ich efektywność. Metoda badań – W artykule wykorzystano naukowe metody historyczne: filologiczną i statystyczną. Dokonano analizy tekstów źródłowych proweniencji państwowej: aktów prawnych, źródeł drukowanych (głównie statystycznych), źródeł archiwalnych. Wyniki – Publiczne służby zatrudnienia w Polsce ewoluowały w latach 1918-1949. Zmiany dotyczyły struktury organizacyjnej, podstaw prawnych funkcjonowania oraz zadań. W latach 1918-1939 podstawowymi instytucjami rynku pracy były urzędy pracy. Ich działalność ukierunkowana była na łagodzenie skutków bezrobocia. W latach 1944-1949 politykę zatrudnienia realizowały na szczeblu lokalnym urzędy zatrudnienia. Ich zadaniem było uzyskanie pełnego stanu zatrudnienia i „racjonalne” wykorzystanie siły roboczej.
Purpose – The purpose is to show (in a synthetic way) the direction of the changes in the sphere of the employment policy, with special reference to activities of the public employment services after World War II. Due to the wide range of the research issues, the considerations are limited to legal aspects, organizational transformations, goals and directions of the activity of these services, and omit their effectiveness. Research method – The article uses scientific historical methods: philological and statistical. An analysis of the source texts of state provenance was carried out: legal acts, printed sources (mainly statistical), archival sources. Results – The public employment services in Poland were evolving in the years 1918-1949. The changes concerned the organizational structure, the legal basis for functioning and tasks. In 1918-1939, labour institutions were the basic institutions of the labour market. Their activity was aimed at mitigating the effects of unemployment. In the years 1944-1949, employment policies were implemented at the local level by the employment offices. Their task was to provide full employment and rational use of labour force.

We still know relatively little about the processes of economic transformation in medium-sized towns, which are the cornerstone of the settlement system of many rural areas, together with small towns. This paper considers a group of 39 towns in Northern Italy, located in the area between Asti and Rovigo. Using data from the Italian National Institute of Data Statistics (ISTAT), we investigated the dynamics of the number of the employed at businesses in the periods of 2001–2011 and 2012–2017, the different specialisations of the towns and their ability to attract employees within the respective employment areas. Locally differentiated performance and evolutionary trajectories are evident, preventing us from being able to think of medium-sized (but also small) towns as a coherent whole. It is also clear how the drive towards centralising employees in towns increased following the Great Recession.

Selected results of the qualitative research about social and individual consequences of non – typical forms of employment are presented. The research was carried out in the Lubuskie voivodship in 2011. They seem to show that the inhabitants of this province are aware of advantages and disadvantages of the flexible labour market. For some people flexible job contracts offer a chance to create self-made careers. Some people declare flexible jobs as a substitute under a lack of full-time jobs in searching for job. They understand that flexible jobs counteract unemployment and guarantee any income. However, they complain about uncertainty related the contract duration, income, and irregular work intensity. There are also opinions that when combined with a stable contract non-typical forms of employment offer opportunities to stabilize a financial situation.

Personel medyczny, a w szczególności pielęgniarki i położne są zawodami bardzo pożądanymi, zarówno w kraju jak i za granicą. Sposób zatrudniania pielęgniarek i położnych wynika między innymi z możliwości finansowych, organizacyjnych szpitali oraz obowiązujących form prawnych, a także określonego kierunku, zasad rozwoju zawodowego pracownika medycznego (określonej grupy zawodowej). Literatura przedmiotu oraz rynek pracy wskazują na różne możliwości stosowania form zatrudnienia, co znacząco wpływa na proces kształtowania kapitału ludzkiego i polityki kadrowej szpitali. Celem opracowania jest zwrócenie uwagi na sprawność stosowania elastycznych form zatrudnienia, potwierdzone wynikami badań (obejmujących okres 2013-2015) w jednym ze szpitali w regionie środkowopomorskim. Wysoka odpowiedzialność osób zarządzających, kształtujących i dbających o jakość świadczonych usług, a także zwiększanie wartości podmiotu, gwarantuje odpowiedni dobór oraz alokację personelu medycznego. Oznacza to, że odpowiedzialne i efektywne zarządzanie szpitalami ukierunkowane na kształtowanie i gwarantowanie wysokiego standardu jakości życia, możliwe jest między innymi poprzez zapewnienie odpowiedniego kapitału infrastrukturalnego, ludzkiego przy stosowaniu różnych form zatrudnienia.
Medical staff, and in particular nurses and midwives are very desirable jobs, both at home and abroad. The method of employing nurses and midwives results, among other things, from the financial and organizational capacity of hospitals and legal forms in force, as well as the specific direction and principles of professional development of a medical professional (a specific professional group). The literature on the subject and the labor market point to various possibilities of using forms of employment, which significantly affects the process of shaping human capital and personnel policy of hospitals. The aim of the study is to draw attention to the efficiency of using flexible forms of employment, confirmed by research results (covering the period 2013-2015) in one of the hospitals in the Central Pomeranian region. High responsibility of persons managing, shaping and taking care of the quality of provided services, as well as increasing the value of the entity, guarantees appropriate selection and allocation of medical personnel. This means that responsible and effective hospital management aimed at shaping and guaranteeing a high standard of quality of life is possible, inter alia, by providing appropriate infrastructure capital, human capital when applying various forms of employment.

Opis:
Background: Legislative changes introduced at the turn of 2006/2007, which resulted in the sanctioning of a simplified employment procedure of foreigners, constituted a breakthrough in the process of liberalizing the access of economic immigrants to the labour market of Poland. Possibilities of employing a foreigner based on the employer’s statement on the intention to entrust a job to foreigner are often attributed to having a positive impact on the functioning of the labour market, as it involves transferring some of the short-term employment of economic migrants from the gray zone to legal employment. The possibility of using this procedure to legalize entry of foreigners into Poland proved to be the cause of numerous cases of abuse. The subject of the research is the changes in the rules of the short-term employment of foreigners in Poland and their socio-economic consequences; the results are presented in this paper. Research purpose: The aim of this study is to discuss and assess the main changes in the rules of entrusting short-term employment to foreigners that have been in force since 2018. Methods: The study presents the results of the analysis of the content of legal acts. Furthermore, the data aggregated by the Ministry of Labor and Social Policy, characterizing the scale of demand for short-term work of foreigners, are presented and interpreted. Conclusions: It should be emphasized that the introduction of a new type of work permit for a foreigner (S-type work permission) and the correction of the so-called simplified procedure are actions that should positively affect the accuracy of measuring the scale of the phenomenon, the level of control over this type of employment, as well as the activity of foreigners coming to Poland in order to provide seasonal work. There is a concern that the lack of possibility to apply the simplified procedure in some sections of the Polish Classification of Activities may, however, contribute to the undesirable increase in the scale of illegal employment of foreigners in seasonal work.
Przedmiot badań: Zmiany legislacyjne wprowadzone na przełomie lat 2006/2007, skutkujące usankcjonowaniem tzw. procedury uproszczonej zatrudniania cudzoziemców, stanowiły przełom w procesie liberalizacji dostępu imigrantów zarobkowych do rynku pracy w Polsce. Możliwości zatrudnienia cudzoziemca na podstawie oświadczenia pracodawcy o zamiarze powierzenia wykonywania mu pracy przypisuje się nierzadko pozytywny wpływ na funkcjonowanie rynku pracy w Polsce polegający na przeniesieniu części krótkoterminowego zatrudnienia imigrantów zarobkowych z szarej strefy do zatrudnienia legalnego. Możliwość wykorzystania tej procedury do zalegalizowania wjazdu cudzoziemców do Polski okazała się być jednak powodem licznych nadużyć. Przedmiotem badań, których wyniki zaprezentowano w niniejszym opracowaniu, są zmiany zasad krótkoterminowego zatrudnienia cudzoziemców w Polsce oraz ich społeczno-gospodarcze konsekwencje. Cel badawczy: Celem niniejszego opracowania było omówienie głównych zmian w zasadach powierzania krótkoterminowego zatrudnienia cudzoziemcom obowiązujących od 2018 r. oraz dokonanie ich oceny. Metoda badawcza: W opracowaniu zaprezentowano wyniki analizy treści aktów prawnych. Dokonano ponadto prezentacji i interpretacji danych agregowanych przez Ministerstwo Rodziny Pracy i Polityki Społecznej, charakteryzujących skalę popytu na krótkoterminową pracę cudzoziemców. Wyniki: Należy podkreślić, że wprowadzenie nowego typu zezwolenia na pracę cudzoziemca (zezwolenie typu S) oraz korekta tzw. procedury uproszczonej stanowią działania, które mogą wpłynąć pozytywnie na dokładność pomiaru skali omawianego zjawiska, na poziom kontroli nad tym typem zatrudnienia, jak również samą aktywnością cudzoziemców przybywających do Polski w celu świadczenia pracy sezonowej. Istnieje obawa, że brak możliwości stosowania procedury uproszczonej w niektórych sekcjach PKD może przyczynić się jednak do niepożądanego wzrostu skali nielegalnego zatrudnienia cudzoziemców przy pracach sezonowych.

Protection of jobs has become one priority aim of the legislator during the crisis caused by the SARS-CoV-2 coronavirus pandemic. In the justification of the draft Act of 2 March 2020 on special solutions relating to the prevention, neutralisation, and combating of COVID-19 and other contagious diseases and the ensuing crisis situations (COVID Act), it was emphasized that the aid mechanisms introduced in the Act were supposed to prevent mass collective redundancies. And although the legislator tried to preserve sustainable employment during the COVID crisis, only a part of the introduced legal provisions offered a guarantee of work to employees. This article aims to provide an overview and assessment of the aid mechanisms implemented by the Polish legislator to protect jobs during the COVID crisis. The anti-crisis activities of the legislator, intended to preserve sustainable employment, can be divided into indirect and direct measures. An analysis was carried out taking into account the above division. Based on the analysis, reflections are formulated on the effectiveness of the implemented aid mechanisms. Finally, conclusions for the future are offered.

Mediation was popularized in modern times in the United States. Its origins were found in the mediation of labour disputes between unions and employers, as a means of avoiding strikes, and currently it is used more and more frequently in individual employment matters. While mediation is not as widespread in Poland to date, its use in labour and employment cases appears to have a similar arc of development. Since the 1990s, mediation has had a central and positive role in resolving collective labour disputes, and now it is being used increasingly in individual employment cases. This paper explains these developments, with a particular focus on the evolution and scope of employment mediation under Polish and European Union law. The author concludes that although the basic framework exists for mediation to develop further in Poland, further reforms would be helpful to ensure its success.

W ostatnich latach Kraków stał się jednym z najważniejszych miast lokowania centrów usług wspólnych przez światowe korporacje. Celem artykułu jest poznanie sposobu postrzegania pracy w centrach outsourcingowych na podstawie opinii zatrudnionych tam pracowników. Przeprowadzona analiza badawcza wykazała, że praca w centrach usług finansowo-księgowych jest szansą dla młodych ludzi na rozpoczęcie interesującej kariery, szybki awans oraz możliwość rozwoju zawodowego w środowisku międzynarodowym. Łatwość zatrudnienia w innym centrum usług oraz otwarta ścieżka kontynuacji kariery w działach ekonomiczno-finansowych tradycyjnych przedsiębiorstw jest potencjalną szansą na zmiany, które urozmaicają wykonywanie powtarzalnych i rutynowych procesów księgowych, oraz sposobem na radzeniem sobie ze stosunkowo płytką hierarchią.
According to Tholons’ Top 100 Outsourcing Destinations report, Krakow is the best location for Business Service Centres in Europe. The financial SSC workforc consists mainly of young graduates. In general, they are seen as experts in finance and accounting. On the other hand, it is often believed they are treated as number crunchers with little chance of professional development. The purpose of this article is to examine the image of employment in financial SSC. We have conducted a survey among employees, with special focus on job satisfaction. In particular, we have analysed the motivation to start a career in SSC, perceptions of current duties and the prospect of future development.

Structural features of economies constitute disregarded aspects of relations between economic development and social issues. Economic research on inequalities are focused on connections between income disparities and economic growth. Independently, sectoral characteristics of economies are evaluated taking into account their influence on dynamics of growth. The existence of both mainstreams in research pays attention to interrelations: social inequalities and risks – sectoral structure. This is a field of discussion in the study. The aim of the paper is to verify the existence of relations between sectoral structure and social inequalities and risks. The analyses were conducted concerning EU economies, that, despite intensive integration process, are still differentiated by the level of socio-economic development. The starting hypothesis assumed positive influence of structural modernity on limiting social problems. The structure of economies was described by shares in employment of three sectors e.g. agriculture, industry and services as well as by shares in employment of the service sector sections (G-U NACE Rev. 2). Structural modernity was assessed using a model, which was adopted using Luxembourg as the most developed economy in the EU. Social issues were considered in their economic dimension. That is why they were described by the most commonly used indicators of income inequalities that are Gini coefficient and income quintile share ratio (S80/20) and by the rate of risk of poverty or social exclusion. Statistics in use were extracted from Eurostat database and cover the most up-to-date information accessible while preparing the paper that is 2011 year. The analyses were based on correlation indicators that were statistically verified at significance level of α = 0,05. Indicators that characterized total employment relationships in every economy were counted with the usage of Kukuła measure of structural differences. The results of research confirm the existence of interrelationships between structural characteristics of employment and income inequalities and social risks in the EU economies. First of all, they allow to conclude that a big scale of rural employment coexists with big income disparities and intensive problems of poverty and social exclusion. Meanwhile, a big share of employment in the service sector appears in economies with small scale of risks of poverty and exclusion. Moreover, simultaneous evaluation of total employment distribution between the three sectors shows essential relations with poverty. The EU economies which are characterized by more modern structures are experiencing less intensive social problems. The conducted analyses additionally indicate that each kind of activities realised within the service sector in a different way influences issues of income inequalities and poverty. Social problems are more intensive in economies with a big share of employment in retail and wholesale trade. In a contrary, low income disparities and social risks are present in economies with high share of employment in knowledge-intensive services (information and communication; professional, scientific and technical activities). Moreover, minimal social risks and inequalities are observed in economies with a big share of employment in human health and social work activities. General modernity of structure of employment in service sections coexists with small social problems.

Aim Caste studies conducted among Muslims in India generally focus on establishing the existence of caste system among Muslims but they seldom talk about different types of oppression and inequalities faced byMuslim women.This empirical study exploreshow gender and caste identities and their mutual intersectionality impact education,occupation and income choices and actual attainments of Muslim women. Methods This study is part of a larger study conducted among Muslims of Kashmir in India.Primary datawas collected from 704 eligible respondents (Male=392, Female=312) using mixed methods. Three layers of ‘caste like’ and ‘caste’ groups existing in the research area are identified and gender situation within these groups are comparatively examined. Results Each of the ‘caste like’ and ‘caste’ groupshas patriarchal caste capital.Higher professions within the government and private services are largely acquired by upper caste male Muslims or other male and female Muslims having rich cultural and social capital. There is preponderance of lower caste male Muslims in low income self-employment but lower caste Muslim females seldom find say in family based business and compelled to join low paid private jobs. More than fifty percent educated Muslim females are unemployed. Conclusion Although patriarchy is the general rule here, not all women face discrimination and inequality in the same way. Upper caste Muslim women often witness so called benevolent restriction of choices whereas lower caste women are the most excluded and marginalised section of the society who face double discrimination due to patriarchy and interwoven caste positions which severely impacts their educational as well as employment choices and attainments.

In June 2019 the profiling of support for the unemployed was eliminated (introduced in middle of 2014). The process of support profiling was supposed to more accurately dedicate support to people registering in employment agency, but over time the profiling became a routine procedure. Statutory support instruments for people detached from the labour market were also symbolic. The Constitutional Tribunal, the Ombudsman and the employees of the local (poviat) employment agencies themselves spoke critically about the support profiling. According to them the profiling system prevented those people from operating effectively due to the limited range of forms of assistance that could be used in the established assistance profile. The purpose of my article is to try to answer the question of why the profiling did not work in Polish conditions. The article contains conclusions from a short study on this issue conducted in poviat employment agencies in January 2020.

The article is regarding principles of employing employees of the Forest Service at the Forestry Commission. The article explained the definition of the national forest household, the forest district and the forest service and comprehending the employer which the state treasury was discussed (as an organizational unit), but activities of the work in law, according to Art. 35a forest district manager is making the sec. of 1 act on forests. Deliberation also concerned the criteria for the employment that candidates have to fulfill (Polish citizenship, capacity to act in law, using the height of public laws, suitable qualifications, clean disciplinary record, adequate medical condition, employment in whole working hours). The legal grounds on which employees of the forest service are being employed (employment contract and vocation) were characterized. It was pointed out that in the upcoming changes of the legal acts concerning forests employment will be exclusively based on employment contract.

Teleworking in fact operating on the polish labor market already in since the nineties; has been pursued at the beginning the in civil law forms of employment. The amendment of the labour code of 2007 put teleworking in the polish labor law, as an official, based on the regulations of employees legal form of employment. "Teleworking" means work performed far away from the traditional, conventional place of employment, with contemporary ICTs. Teleworking as a modern type of employment, provides an easy way to reconciliation of work and family life and the use of flexible work arrangements, involving the possibility to exercise in any place and at any time. But it turns out that in practice the use of teleworking in Polish firms are still not common and full of barriers.

The aim of the research was to assess the potential of the bioeconomy in Poland in comparison with the European Union countries. The research used an indicator of added value, the number of people employed and the value of turnover for individual sectors included in the bioeconomy. An analysis of the structure of indicators in Poland in 2020, compared to other EU countries, allowed us to determine the level of development of the country’s bioeconomy. The analysis shows that Poland is a leader in terms of employment in the EU bioeconomy. However, the assessment of potential in terms of added value and value of turnover in the bioeconomy placed Poland in fifth position. The reason for this is Poland’s characteristic fragmented agrarian structure and excessive employment in the agricultural sector. An opportunity to redress the imbalance is to obtain EU funding and support for research and innovation.

People with severe disabilities, such as severe mental disabilities and autism spectrum disorders, do not participate in the open, competitive labor market to the same extent as people without disabilities or other forms of disability. Sheltered employment is an internationally accepted approach for the vocational integration of people with severe disabilities, which introduces integration in sheltered workplaces mainly with other people with disabilities and ongoing support from the Government or self-government. Therefore, sheltered employment can be defined as the employment of a person with a disability under particular conditions. This paper presents the legislative framework regarding sheltered employment in Poland and Greece and the ways sheltered employment takes place in each of the two countries with the corresponding comparisons and conclusions. The results show a need for a more precise and more comprehensive legislative framework on sheltered employment in Poland and Greece. Alternative options for the vocational integration of people with severe forms of disabilities, such as supported employment programs, need to come to the fore. Supported employment seems to be the only effective and efficient way for people who have particular difficulties in finding and keeping a paid job in the open labor market to take up paid employment on an equal basis with other people. Does the concept of supported employment have a chance to prove itself on Poland and Greece’s open labor markets and become a complementary tool in the vocational activation of people with disabilities? Legislative regulations, system projects, and stable sources of financing are necessary for both countries.
Osoby z poważnymi niepełnosprawnościami, takie jak upośledzenie umysłowe i zaburzenia ze spectrum autyzmu nie uczestniczą w otwartym, konkurencyjnym rynku pracy w takim stopniu jak osoby pełnosprawne lub osoby z innymi niepełnosprawnościami. Szansą dla tej grupy jest zatrudnienie chronione. To podejście do integracji zawodowej osób ze znacznym stopniem niepełnosprawności jest akceptowane na całym świecie. Jego realizacja odbywa się poprzez integrację osób niepełnosprawnych oraz stałe wsparcie: ze strony rządu lub samorządu. W artykule przedstawiono ramy prawne dotyczące zatrudnienia chronionego w Polsce i Grecji oraz sposoby jego realizacji wraz z odpowiednimi porównaniami i wnioskami. Wyniki wskazują na potrzebę bardziej precyzyjnych i kompleksowych ram prawnych dotyczących zatrudnienia chronionego w Polsce i Grecji. Tu na pierwszy plan wysuwają się alternatywne sposoby integracji zawodowej osób z poważnymi niepełnosprawnościami, takie jak programy zatrudnienia wspomaganego. Zatrudnienie wspomagane wydaje się jedynym, skutecznym i efektywnym sposobem na podjęcie pracy zarobkowej na równych zasadach przez osoby, które mają szczególne trudności w znalezieniu i utrzymaniu płatnej pracy na otwartym rynku pracy. Czy zatem koncepcja zatrudnienia wspomaganego ma szansę stać się komplementarnym narzędziem w aktywizacji zawodowej osób z niepełnosprawnościami w Polsce i Grecji? Z pewnością w obu krajach niezbędne są nie tylko stabilne źródła finansowania dla działań aktywizujących osoby z niepełnosprawnościami, ale również odpowiednie regulacje prawne oraz projekty systemowe.

W artykule zdefiniowano pojęcie elastycznych form zatrudnienia oraz dokonano ich przeglądu z uwzględnieniem rozwiązań w zakresie czasu pracy i zatrudnienia na podstawie umów prawa cywilnego. Poddano analizie przesłanki rozwoju tych form z podziałem na przesłanki technologiczne, gospodarcze i społeczne. Zwrócono uwagę na ambiwalentność tych form zatrudnienia niosących ze sobą zarówno korzyści, jak i zagrożenia. Ukazano rolę państwa i prawa pracy w zakresie ochrony pracowników przed negatywnymi skutkami niektórych rozwiązań.
The notion and the classification of the flexible forms of employment including working time solutions and work carried out under civil law contracts have been presented in the study. The premises of the growing flexibility of employment in technological, economic and social aspects have been discussed as well. According to the opinion of the author flexibility of employment is an ambiguous fenomenon having at the same time chances and threats both. Although the role of the state and legal system is to protect workers from negative results of some solutions.

This article is focused on selected aspects of the economic ‘fate’ of Tourism and Recreation graduates of the University of Łódź (UŁ). Its aim is to seek answers to the question: ‘What determines graduate employment?’ Surveys conducted by the Career Office of University of Łódź among graduates one year after graduation in 2014, 2015 and 2016 are the empirical basis. Tourism and Recreation graduates were compared with others from the Faculty of Geographical Sciences UŁ. The logistic regression technique was used to predict the status of graduate employment based on independent variables. The strongest predictors of graduate employment were structural and institutional characteristics. The quantitative results were interpreted in the context of the modern role of universities.

This paper provides a possible answer to the question of why so few people with disabilities enter the labor market. Introductory remarks on the importance of work and being employed in human life are followed by different definitions of disability. By reference to the basic facts about employing people with disabilities in Poland, the author identifies and examines the obstacles that make it difficult for a disabled person to get a job. Along with architectural barriers in the workplace and unfavorable attitude of the employers, there is another factor that narrows down the range of job offers available to disabled individuals: an average level of education in this group of people, comparing to others, is lower. As a consequence, job and life opportunities for this social group remain significantly limited.

  It is important to conduct the analysis of the situation of underemployment in the Polish labor market. The purpose of this paper is to present the essence of underemployment and whether one can observe a growing number of underemployed. In the first part of the article, the notion of underemployment and its main features in light of the literature are defined. Then, an attempt is made to define the scope of underemployment focusing on the EU and Polish labor markets (the article is based on available Eurostat statistics). Research pilot studies on underemployment have been conducted in the West Pomeranian Voivodship. The conclusions stemming from the analysis are included in the final part of the article, and they describe the relatively bad situation of underemployment in the Polish labor market. Therefore, it can be concluded that there are two aspects to the Polish labor market, as there are so-called “good” workplaces and substandard workplaces.
Potrzeba analizy problemu niedostatecznego zatrudnienia na polskim rynku pracy jest bardzo istotna. Celem niniejszego artykułu jest przedstawienie istoty underemployment i czy rzeczywiście zauważa się rosnącą liczbę niedostatecznie zatrudnionych. W pierwszej części artykułu określono pojęcie niedostatecznego zatrudnienia i jego główne cechy w świetle literatury. Następnie podjęto próbę zdefiniowania zakresu niedostatecznego zatrudnienia, skupiając się na unijnym rynku pracy (artykuł opiera się na dostępnych danych Eurostat) i w Polsce. W zachodniopomorskim województwie przeprowadzono badania pilotażowe dotyczące underemployment. Wnioski wynikające z analizy są zawarte w ostatniej części artykułu i stanowią o relatywnie złej sytuacji substandardowo zatrudnionych na rynku pracy. Dlatego można stwierdzić, że polski rynek pracy jest dualny, gdyż występują na nim tzw. „dobre” miejsca pracy oraz substandardowe miejsca pracy.

My paper presents the employment situation by the Visegrad Four (V4) countries (Poland, Czech Republic, Slovakia and Hungary) in the recent years. I have chosen the analysis of the employment policy, unemployment and the regional disparities because they have been more and more used in the economy and can be considered an actual question. The extensive economic literature deals with the role of the state it plays in the area of employment and revitalising demand in order to treat economic crisis; it also includes the probable benefits and drawbacks of the measures. My hypothesis states that the employment position of the Visegrad Four is different in the European Union relation, and in the V4 relations, its human resource position is weak, the level of employment is low, which is influenced by several factors and the four countries have different employment trends. The methodology of the paper is the analysis of available statistical data, the study and critical analysis of the situation.

The purpose of this article is to present the initiative of the West Pomeranian Voivodeship in Poland, which is aimed at increasing the professional activity of persons with disabilities. The developed and tested model of the employer’s assistant is, in the special pedagogy, a new quality directed towards the labour market. The Employer’s Assistant does not deal, in essence, only with a person with a disability, but mainly with the environment of employers to hire persons that suffer from disabilities. In the article, I refer to the assistant of the disabled person as a result of the biopsychosocial model of disability, which creates a great opening to the discussion on various models of assistance. I would like to point out the specific consequences of the lack of employment among people with disabilities. I present the premises of the employer’s assistant model and the evaluation of its effectiveness, the main consequence of which is the ability to build social capital of persons with disabilities. By cooperating with many environments, the employer’s assistant develops specific social behavioural patterns and becomes a foundation of social activity of persons with disabilities.

Based on participant observation and ethnographic interviews with Polish women working in kindergartens in Norway, this article studies the migrant women’s employment trajectories, including adaptation processes in the workplace and integration into the wider Norwegian society. In this paper, I aim at answering the following questions: How do Polish migrant women go about seek-ing employment in Norwegian kindergartens? How do they adapt to the new work environment? How do they deal with cross-cultural differences in childcare? How did they learn new norms and values within the institutional context of kindergartens? The research indicates that employment in kindergartens was not merely a way to provide for one’s livelihood, but was also a mechanism to establish and develop a closer relationship with members of the Norwegian society, a tool facilitating meaningful connections with the new country.

The article addresses an important issue from the point of view of the allegations formulated by the employers’ circles towards higher education regarding the incompatibility of educational programmes with the needs of the labour market. The author shows the shape of the adventure tourism brought to life at the Academy of Physical Education in Kraków. In the article the author presents the results of research in an attempt to answer the question whether such a profile creates a better chance for a career in the tourism industry. The research is a survey of preferences of employers during recruitment for a position related to tourism in companies organising tourist events. Results of this study indicate that in most companies experience is the strongest asset of candidates for a job. Adventure tourism major, however, is welcomed by the vast majority of respondents. The method used in this study refers to a small trial – this is due to the limited number of Polish companies organising adventure tourism or events with its elements. Among the few companies for which education is particularly important, a degree with a major in adventure tourism is an asset. Even those respondents for whom education is not a priority positively perceive the obtaining a degree in adventure tourism, as students of such major gain experience, acquire the skills needed to organise various tourist events and develop passions and interests which are also important in the tourism industry.

This empirical research investigates state based factors affecting the inward FDI employment among fifty states of the United States, uses annual data for the period of time from 1997 to 2007 and identifies several state-specific determinants of FDI employment. The results indicate that the major factors exerting positive impact on inward US FDI employment are: real wages, infrastructure, unionization level, educational attainment, FDI stock and manufacturing density. In addition, the results show that gross state product growth rate, real per capita taxes and share of scientists and engineers have negative impact on FDI employment. Our findings indicate the importance of selected variables in evaluating the effects of FDI flow on state employment.

The aim of this paper is presenting the situation of the labor market in the European Union after the crisis in 2008 and the comparison of the labor market situation in Kosovo in 2014. In the light of modern economic crisis, it is worth to analyze the development of the situation on the labor markets in the EU and in selected countries of the world since 2008. This allows to examine changes in the level of employment under the influence of both the dynamics of the recession and the antirecession policies used. The level of unemployment is closely linked to the dynamics of GDP. Recorded in the EU and in other countries of the world, increase of the unemployment rate from 2008 confirms the strong interdependence of these indicators. To sum up the situation on the European labor market, it is worth noting that the progressive process of increasing the flexibility of the labor market favors the competitiveness of the economies of the European Union. This does not mean, however, that as a result of the changes observed do not appear negative effects (e.g. Spain). It therefore appears necessary to further reduce barriers to movement of labor and services within the European Union and the use clearly positive experiences of labor market reforms.

Purpose - The aim of the article is to indicate the macro factors shaping the phenomenon of concealing income by self-employed workers. Research method - This article uses the comparative analysis method together with an analysis of critical literature. The empirical element employs dependency analysis methods. Results - The conducted analyses indicate the lack of a relationship between the level of economic development of the state and the scale of the phenomenon of income concealment. Similarly, it has been demonstrated that there is no evidence of a correlation between the level of unemployment and the rate of self-employment and the scale of income concealment by self-employed people. The results of the conducted analyses allowed the identification of two paradoxes. The first consists in the existence of a negative relationship between the scale of income concealment and the size of the grey economy, while the second consists in the occurrence of a positive relationship between the friendliness of the tax system for entrepreneurs and the scale of lowering the tax base. Originality /value / implications /recommendations - The article supplements an existing research gap. The research undertaken thus far concerned the analysis of factors influencing the international diversity of the grey sphere size. However, no detailed analysis was carried out regarding the impact of macro factors on the shaping of the grey economy, including the lowering of incomes by self-employed workers. The original contribution of the article is also the study of the relationship between the size of the phenomenon of income understatement and the size of the grey economy.

Od 1 stycznia 2019 r. obowiązują zmiany w Kodeksie postępowania cywilnego wprowadzone Ustawą z dnia 22 marca 2018 r. o komornikach sądowych. Ustawodawca dokonał m.in. zmiany art. 8211 Kodeksu, która ma na celu umożliwienie dłużnikowi prowadzenia działalności w okresie zawieszenia postępowania egzekucyjnego. W dotychczasowym stanie prawnym dłużnik, będący np. przedsiębiorcą, pomimo zawieszenia postępowania egzekucyjnego był pozbawiony dostępu do środków bieżących na rachunkach bankowych, co mogło skutkować zaprzestaniem prowadzenia działalności gospodarczej. Opracowanie jest próbą omówienia motywów nowelizacji, a także jej skutków. Analiza obejmuje znowelizowaną ustawę oraz orzecznictwo. 1 Dz.U. z 2018 r. poz. 771.
From January 1, 2019. Amendments to the Code of Civil Procedure introduced by the Act of March 22, 2018 on Court Bailiffs apply. The legislator changed, inter alia, legal provision 8211 of the Code of Civil Procedure. The above amendment is intended to enable the debtor to conduct business while the enforcement proceedings are suspended. Under the current legal status, the debtor, who is, for example, an entrepreneur, despite the suspension of enforcement proceedings, was deprived of access to current funds in bank accounts, which could result in the cessation of business activity. The text is an attempt to discuss the motives of the amendment, as well as its effects. The analysis will cover the amended act and jurisprudence. 1 Dz.U. z 2018 r. poz. 771.

Literature review has shown that the demographic dimension of the labour market changes remains generally overlooked. The paper aims at filling the gap. The main question asked in the paper is: what are the long-term consequences of the crisis 2008–2009 for youth labour market in the European countries? In order to answer the question, the changes in youth employment to population ratio in 33 European countries are analysed. Any change in the employment to population ratio is a result of combined demographic and labour market effect. While the demographic changes vary between countries; it is argued that a crosscountry comparative analysis that does not take into account the role of demographic shifts is likely to provide a misleading picture of the labour market conditions.

Celem opracowania było dokonanie analizy porównawczej powszechnie wykorzystywanych mierników prawnej ochrony pracowników. Badanie przeprowadzono dla wskaźników publikowanych przez OECD, Heritage Foundation, Fraser Institute oraz Światowe Forum Ekonomiczne. Uzyskane wyniki dla krajów OECD wskazały, że zróżnicowanie metod konstrukcji tych wskaźników powoduje, iż współczynnik korelacji między nimi jest w wielu przypadkach mniejszy niż 0,5. Szacunki ekonometryczne dowiodły przy tym, że uzyskiwane wyniki odnośnie do wpływu prawnej ochrony pracowników na elastyczność dynamiki PKB i poziomu zatrudnienia zależą od wykorzystanego miernika tej ochrony. Uzyskane rezultaty wskazują, że analizowane wskaźniki nie powinny być traktowane jako bliskie substytuty.
The aim of the article was to compare commonly used measures of the employment protection legislation. The study was conducted for the indicators published by the OECD, the Heritage Foundation, the Fraser Institute and the World Economic Forum. The results obtained for the OECD countries indicate that different methodological assumptions adopted during the construction of these indicators have led to the low level of correlation among them (in many cases even less than 0.5). Moreover, the conducted econometric analysis has indicated that the results concerning the influence of employment protection legislation on the elasticity between GDP dynamics and the level of employment depend on the chosen measure of employment protection. In consequence, the analysed employment protection indicators should not be regarded as close substitutes.

The present elaboration is dedicated to the analysis of labour market transformation since the codification of Polish labour law to the present day. Author emphasizes that the legal form of paid activity determines the legal status of the person concerned, both with relation to stability of employment and social security protection. Under centrally planned economy, the employment contract for an indefinite duration constituted the basic form of paid activity. Currently, however, various forms of work performance co-exist, many of them remain outside the scope of labour law. Author indicates deep segmentation of current labor market. He also pays attention to the fact that paid work quite often ensures neither life stability nor proper social protection.
Niniejszy tekst jest poświęcony analizie przekształceń rynku pracy, począwszy od kodyfikacji polskiego prawa pracy do czasów współczesnych. Autor wskazuje, że prawna forma prowadzonej działalności zarobkowej przesądza o statusie danej osoby, zarówno w kontekście stabilizacji zatrudnienia, jak i ochrony z zakresu ubezpieczeń społecznych. W realiach gospodarki centralnie sterowanej umowa o pracę na czas nieokreślony stanowiła podstawową formę działalności zarobkowej. Obecnie współistnieją jednak różne formy świadczenia pracy zarobkowej, często pozostające poza zakresem prawa pracy. Autor zwraca uwagę na głęboką segmentację współczesnego rynku pracy, a także na fakt, że praca zarobkowa często nie zapewnia stabilizacji życiowej ani odpowiedniego poziomu bezpieczeństwa socjalnego.

ObjectivesThe present study focused on the relationship between occupational activity and mental health during the first COVID-19 lockdown.Material and MethodsAt the turn of May and June 2020, an online survey was conducted on a representative sample of 3000 Poles (age: Me = 45 years). Working persons accounted for 52% of the respondents, while 38.1% were hired workers. Two standardized (0–100 pts) indices were defined. The level of mental health symptoms index (LMHSI) concerned the incidence of 4 problems within the past 2 months, whereas the change in mental health symptoms index (CMHSI) concerned the degree of mental health deterioration.ResultsThe mean value of LMHSI was 40.91 (SD = 26.97), and that of CMHSI 60.51 (SD = 23.97). In both cases, a worse assessment was obtained among women than among men. In the group of working respondents, the least advantageous results were found among those who worked casually or under a commission contract. Among the non-employed respondents, jobless persons and students were the group at risk. Remote work resulted in the deterioration of mental health in the light of CMHSI; however, a threat of changes in the professional situation affected LMHSI variability to the greatest extent The results of linear regression (R2 = 0.339) suggest that the increase in the CMHSI score (adjusted for LMHSI) is independently influenced by female sex, university education, remote work and a threat of the worsening of employment terms. The analysis of the interaction effect showed a stronger impact of the last factor in the group of women (p = 0.001).ConclusionsTo conclude, COVID-19 restrictions were associated with a negative impact on mental health which should be analyzed in the occupational context.

Subject and purpose of work: The publication comprises the analysis of the most important legislation governing the employment of foreigners in Poland and the data of significance to developing legal solutions in this area. The purpose of the paper is to evaluate the suitability of the adopted solutions to the needs of the labour market. Materials and methods: The performed legal analysis is closely related to the statistical analysis of the transformations of the Polish labour market which have taken place over the last 6 years, with particular attention to demographic and economic data. The authors also applied qualitative methods in the form of observations concerning the adaptation of Polish laws to the demand for hiring foreigners, as well as the presentation of the results of surveys analysing the opinions and sentiments of labour market participants, labour market forecasts published on a regular basis, and inspections carried out by authorised entities. Results: The systematic decrease in the Polish population and increasing staff deficits reported by employers are among the most important challenges. The deficits are largely supplemented by Ukrainian employees, yet there are growing concerns that difficulties in acquiring new staff may aggravate, as the competition in attracting foreign staff is becoming increasingly perceptible. In Poland, relevant legal instruments concerning the employment of foreigners are mostly stipulated in the Foreigners Act, the Act on employment promotion and labour market institutions, and in secondary legislation to these Acts. The laws are very complex, they lack comprehensive solutions in the field of foreigner employment policy, while competent offices and authorities experience difficulties in fulfilling their tasks. Conclusions: It is necessary to develop and implement a comprehensive strategy as part of employment policies, taking into account the urgent and actual demand of the labour market for foreigners’ work.
Przedmiot i cel pracy: Publikacja zawiera analizę najważniejszego ustawodawstwa dotyczącego zatrudnienia cudzoziemców w Polsce oraz danych istotnych dla kształtowanych rozwiązań prawnych w tym obszarze. Celem pracy jest dokonanie oceny adekwatności przyjętych rozwiązań do potrzeb rynku pracy. Materiały i metody: Dokonana analiza prawna związana jest ściśle z analizą statystyczną zmian zachodzących na polskim rynku pracy na przestrzeni ostatnich 6 lat, ze szczególnym uwzględnieniem danych demograficznych i gospodarczych. Autorzy zastosowali również metody jakościowe w postaci obserwacji dotyczącej adaptacji polskiego ustawodawstwa do zapotrzebowania na pracę cudzoziemców, jak również prezentacji przeprowadzonych badań opinii i nastrojów uczestników rynku pracy, publikowanych cyklicznie prognoz dla rynku pracy i zrealizowanych przez uprawnione organy kontroli. Wyniki: Jednym z największych wyzwań jest systematyczny spadek populacji Polski oraz wzrost deficytów kadrowych zgłaszanych przez pracodawców. Deficyty te w głównej mierze uzupełniają pracownicy z Ukrainy, jednak rosną obawy, że trudności w rekrutowaniu kadr mogą się pogłębiać, ponieważ coraz bardziej odczuwalna jest rywalizacja pomiędzy państwami o pracowników zza granicy. W Polsce odpowiednie instrumenty prawne dotyczące zatrudniania obcokrajowców zawarte są przede wszystkim w ustawie o cudzoziemcach, ustawie o promocji zatrudnienia i instytucjach rynku pracy, a także w aktach wykonawczych do tych ustaw. Przepisy te są bardzo skomplikowane, brakuje kompleksowych rozwiązań w zakresie polityki zatrudniania cudzoziemców, a właściwe urzędy i organy nie radzą sobie z powierzonymi im zadaniami. Wnioski: Konieczne jest przyjęcie i wdrożenie kompleksowej strategii w ramach polityki zatrudnienia, uwzględniającej pilne i realne zapotrzebowanie polskiego rynku pracy na pracę cudzoziemców.

In the publication the author took up the subject of the time concept used in Article 22 § 1 of the Labour Code. The study analyses the role and legitimacy of inserting the term concerning the working time in Article 22 § 1 of the Labour Code. This concerns, inter alia, relationships with terms such as subordination or working time. The article puts forward a thesis of possible broader understanding of the concept of the time of contract performance. This will create an option to extend this concept also to the legal relations not covered yet by protection in the context of their performance time.
W opracowaniu autor podjął tematykę użytego w artykule 22 § 1 Kodeksu pracy pojęcia czasu. Analizuje rolę i zasadność zamieszczenia w art. 22 § 1 Kodeksu pracy sformułowania dotyczącego czasu wykonywania pracy. Dotyczy to między innymi relacji z takimi pojęciami jak podporządkowanie czy czas pracy. Postawione zostały tezy dotyczące możliwego szerszego rozumienia pojęcia czasu realizacji umowy. Stworzyłoby to opcję rozszerzenia tego pojęcia również na stosunki prawne nieobjęte do tej pory ochroną w kontekście długości ich realizacji.

During the last years, there has been visible growth in the professional activity of women in Polish enterprises. In the Polish market, specialists in several given areas are needed, and there are more and more highly educated and qualified women entering the workforce. In the article, the main focus is on showing the differences in the employment possibilities of men and women in Polish enterprises. The differences were examined between women and men working in enterprises of the same size, and of different sizes. Age, education and origin of respondents were analyzed. The analyzes allow to judge further the economic development of Polish enterprises from the point of view of gender hiring practices.

The digital revolution, also called the fourth industrial revolution, constitutes another era of change, caused by the development of computerisation and modern technologies. It is characterised by rapid technological progress, widespread digitisation and an impact on all areas of life, including the provision of work. The changes affecting this area are so significant that there are proposals to remodel the definition of the employment relationship in the Labour Code. New forms of employment, which do not fit the conventional definition of an employment relationship, are emerging and gaining importance. An example could be employment via digital platforms. At the same time, there are also employment forms that do fit that definition, but deviate from the conventional understanding of the terms and conditions for performing work, which have undergone modification due to the use of new technologies. Teleworking, or working outside the employer’s premises, are examples of that. Employers get further opportunities to organise and control work, which often raises concerns due to the employee’s right to privacy, the protection of personal rights and personal data.

Objectives Lung transplantation not only saves a patient’s life but also creates the opportunity for becoming more self-reliant and getting back to work. The aim of this single center study was to assess the prospects of employment, as well as its influence on the quality of life and physical activity, of the lung transplant recipients of the Silesian Center for Heart Diseases in Zabrze, Poland. Material and Methods A retrospective study covered 67 lung transplant recipients of the Silesian Center of Heart Diseases. Only patients with ≥ 6-month follow-up were included. All of the patients gave their written consent to be included in the study before filling out the questionnaire containing questions about employment, income, education and how work affected their quality of life before and after lung transplantation. A physical capability assessment was performed by climbing flights of stairs and by means of a 6-min walk test, and spirometry parameters were also measured. Results Twenty of the patients included in the study (31.7%) were employed after lung transplantation, 63.2% of whom worked full-time. Profession was changed by 2 patients (14.3%). The patients diagnosed with cystic fibrosis were found to have the highest chance of finding employment after lung transplantation. The statistical analysis revealed that the employed patients were able to cover longer distances during the 6-min walk test (556 m, on average) than the unemployed ones (494 m, on average). Conclusions One in 3 patients finds employment after lung transplantation. Work improves the quality of life of the majority of lung transplant recipients. The patients who are employed are also in a better physical condition, and they are more self-reliant in comparison to those who remain unemployed. Lung transplant recipients with cystic fibrosis are most likely to find employment, and so are patients with higher education. Int J Occup Med Environ Health. 2019;32(3):379–86

Background: The research subject is the draft of Polish Labour Code, presented to the public in March 2018, prepared by the Labour Law Codification Committee established by the Regulation of the Council of Ministers of August 9, 2016, Journal Of Laws 1366. It was not referred to parliament. Research purpose: Analysis of the proposed legal bases for performing paid work, with particular emphasis on employment contracts and their types, as well as sanctions for applying the wrong basis for performing work. Methods: Dogmatic and legal analysis of the proposed Act with reference to the current wording of the Polish Labour Code. Conclusions: The draft of Polish Labour Code sets out the principle that paid work (this concept has not been defined) can be performed (except for the exceptions laid down in the Act) only in the legal forms provided for therein, Art. 1(2). They are classified as employment – which is divided into an employment (i.e. under employment relationship) and non-employment – and as self-employment, in which a group of economically dependent self-employed people is distinguished.
Przedmiot badań: Przedmiotem badań jest projekt kodeksu pracy, przedstawiony do publicznej wiadomości w marcu 2018 r., sporządzony przez Komisję Kodyfikacyjną Prawa Pracy powołaną rozporządzeniem Rady Ministrów z 9 sierpnia 2016 r., Dz.U., poz. 1366. Nie został on skierowany do parlamentu. Cel badawczy: Analiza proponowanych podstaw prawnych wykonywania pracy zarobkowej ze szczególnym uwzględnieniem umów o pracę i ich rodzajów, a także sankcji za zastosowanie niewłaściwej podstawy wykonywania pracy. Metoda badawcza: Analiza dogmatycznoprawna proponowanej ustawy z nawiązaniem do obecnego brzmienia kodeksu pracy. Wyniki: Projekt kodeksu pracy ustanawia zasadę, że praca zarobkowa (to pojęcie nie zostało zdefiniowane) może być wykonywana (poza wyjątkami ustanowionymi w ustawie) tylko w formach prawnych w nim przewidzianych (art. 1 § 2). Sklasyfikowane są one jako zatrudnienie – które dzieli się na zatrudnienie pracownicze (czyli w ramach stosunku pracy) i niepracownicze – oraz jako samozatrudnienie, w którym wyróżniona jest grupa osób samozatrudnionych ekonomicznie zależnych.

Entrepreneurs made up about a quarter of the burghers involved in the industry of the interwar Lviv. However, a vast majority of them were the owners of small workshops, large entrepreneurs accounted for less than 5% of this social class. But the small and medium-sized businesses dominated among the factories' owners. During the interwar period, the quantity of entrepreneurs decreased among the persons involved in the city's industry. There was also a tendency to reduce the use of the hired labour by them. The employment structure of the Lviv entrepreneurs during the 1920s-1930s did not change significantly, but it varied depending on the size of the share capital. A vast majority of the small artisans were employed in the sewing and haberdashery, food, construction, woodworking and metalworking industries, while the owners of large enterprises invested their capital in the food, printing, mineral, wood and paper industries. From the ethnic and denomination point of view, the Lviv entrepreneurs were dominated by two groups: Poles (Roman Catholics) and Jews, while Ukrainians (Greek Catholics) and the representatives of other nationalities accounted for a small percentage. However, during the years 1921-1931 they showed a rapid growth rate.

The aim of this article is to analyze the chances of having a job using Bayesian logistic regression model. In this study both young and middle-aged people have been considered. The individual characteristics of economically active people have a significant impact on their labour market status. In this research the commonly studied set of features has been extended by adding the following characteristics: marital status, financial situation of the household, health assessment and the fact of living with parents in the case of young people. In this study, Bayesian logistic regression model has been used. The Bayesian approach enabled us to incorporate information from previous studies.

The paper presents results of estimation of Cox proportional hazard model developed in order to identify the importance of employment for a first and a second childbirth for Polish women born in 1960 and after. The analysis is based on data from the first wave of the Generations and Gender Survey GGS-PL. The results show: a) positive and statistically significant effect of employment on the risk of having a first and a second child, b) negative, although weak impact of the length of statutory maternity leave on the risk of having a second child. The results cast in doubt the effectiveness of the new reform that introduces the possibility of taking longer maternity leaves in order to boost fertility.

Digitalizacja to nieodłączny proces postępu technologicznego w wielu dziedzinach, również w zakresie rozwoju sektora bankowego. W Polsce proces ten osiągnął bardzo wysoki poziom wpływając nie tylko na sferę usprawniania technologii i ulepszania danych elementów, ale również na zakres wykorzystania. Z procesów mających usprawniać pracę człowieka i wspierać go w czynnościach służących przede wszystkim klientom, ewoluowało do miana w wielu aspektach alternatywy dla czynnika ludzkiego. Postęp niesie za sobą zarówno korzyści i nieuniknione zmiany, ale również trudności z tym związane w wielu aspektach bankowości. Niniejsze opracowanie służy wskazaniu obszarów digitalizacji sektora bankowego oraz konsekwencji za tym idących dla bankowości w zakresie kadrowym. Za hipotezę przyjmuje się iż digitalizacja sektora bankowego ma znaczący wpływ na obecną i przyszłą strukturę zatrudnienia w sektorze bankowym w Polsce.
Digitalization is an inseparable process of technological progress in many areas, also in the area of banking sector development. In Poland, this process has reached a very high level, affecting not only the area of technology improvement and improvement of given elements, but also the scope of use. From processes designed to improve human work and support it in activities that primarily serve customers, it has evolved into many aspects of alternatives to the human factor. Progress brings both benefits and unavoidable changes, but also difficulties related to this in many aspects of banking. This study is aimed at identifying the areas of digitalization of banking sector and the consequences for banking in human resources field. The hypothesis assumes that the digitalization of the banking sector has a significant impact on the current and future structure of employment in the banking sector in Poland.

Schizophrenia is a serious mental disorder and has a huge economic burden related to direct and indirect costs. Direct costs include such expenditure as hospitalization. Indirect costs, however, result mostly from the loss of productivity. Although patients are frequently interested in job opportunities, unemployment is widespread among them. Thus, we evaluated opinions of medical universities students’ concerning situation on the labor market among those in the remission stage of schizophrenia. The study was carried out between October 2015 and October 2016 in Poland and other European Union countries using a self designed questionnaire. The study tool consisting of five questions was distributed to students by direct contact and via the Internet. Of a 5200 distributed sheets, we received 1036 questionnaires and 942 were finally analyzed. In the students’ opinion, patients are generally interested in finding a job but they are afraid coming back to work. Although unemployment is common among patients with schizophrenia, the number of patients capable of working is significantly higher than the number of those actually employed. According to results of the study, getting a job might be effectively supported by non-pharmacological interventions. Considering the noticeably higher number of patients capable of working compared to those employed, development of employment possibilities should be a priority for mental health care decision makers. It should lead to reduction of the patients’ concerns related to looking for a job. Moreover, comprehensive treatment could reduce the economic burden of schizophrenia.

Demographic ageing will affect the EU economy, public finances and adequacy and sustainability of pension systems. A key response to the challenge of ageing population is the extension of working lives. This paper seeks an answer for the question if the partial pension may be an efficient solution to make people work longer. Comparative analysis of the partial retirement in selected EU countries gives no unquestionable conclusions in this question, especially in terms of hours worked. The results highly depend on the construction of the partial pensions and the changes on the labour market. Taking into account both the further pension reforms to make people work longer and simultaneously the pressure on the pension replacement rates, the idea of the partial pension seems to be attractive and worth further research
