The objective of the paper is to describe the author's concept of considering the negotiations between internal stakeholders as a specific tool for the creation of company's strategy. Firstly, the definition of such negotiations is presented, in the context of the general interpretations of negotiations. The most important is their definition as interactive decision making process. Secondly, specific features of such negotiations as a tool for business strategy creation are discussed. Two types of those negotiations are distinguished: multiparty and multiply ones. Thirdly, the possible strategies for conducting such negotiations are suggested, according to their two types. Finally, the assessment of proposed concept is presented, i.e. its advantages and disadvantages are listed as well as the directions for further research are pointed out.

The objective of the paper is to present the effects of empirical research, constituting practical verification of the author’s methodological concept of planning negotiations in a company. The research object were negotiations between several dozen small and medium-sized consulting companies and their clients, concerning the elaboration of conditions and rules for carrying out consulting projects. Firstly, the suggested methodological concept of negotiations planning was described. Secondly, the objectives and scope of research were presented. Thirdly, their methods, objects and process were characterized. Fourthly, the considered methodological framework was identified within the selected area, i.e. research findings were listed. Fifthly, conclusions from the research were formulated, i.e. that framework was evaluated. Finally, recommendations from the research were elaborated, i.e. directions of the desired changes in that framework were suggested.
Celem artykułu jest prezentacja rezultatów badań empirycznych stanowiących praktyczną weryfikację autorskiej koncepcji metodycznej planowania negocjacji w firmie. Przedmiotem badań były negocjacje pomiędzy kilkudziesięcioma małymi i średnimi firmami doradczymi a ich klientami, dotyczące określenia warunków i zasad realizacji projektów konsultingowych. Po pierwsze, omówiono krótko proponowaną metodykę planowania negocjacji. Po drugie, przedstawiono cele i zakres badań. Po trzecie, scharakteryzowano ich metody, obiekty i przebieg. Po czwarte, dokonano identyfikacji rozważanej metodyki w wybranym obszarze, tj. zestawiono wyniki badań. Po piąte, sformułowano wnioski z badań, tj. oceniono tę metodykę. Wreszcie opracowano zalecenia z badań, tj. wskazano kierunki jej pożądanych zmian.

This work provides a survey of the properties of SAW method (Simple Additive Weighting) which is one of the simplest and mostly used multiple criteria techniques. The work is presented by focusing mostly on the application of SAW in the support of bilateral negotiations. The strengths and limitations of the proposed approach are discussed and the suggestions of modifications of the classical algorithm are presented from the viewpoint of applications in the negotiation process. The function assigning a score to the negotiation packages, determined by the use of modified SAW procedure is a useful tool facilitating linear ordering of negotiation packages, the estimation of potential concessions, the implementation of a negotiation strategy and the analysis of negotiation compromise

The paper considers some problems of negotiations between competitive subjects on regulated market. It is assumed that two subjects (players) have to compete with each other on the retail market and cooperate on the wholesale market. The wholesale market is regulated. The role of the regulator is to support players in negotiations, especially by introducing recommended solutions when the negotiations were broken off. It is considered how introducing a recommended solutions influence the process of negotiations on the wholesale market and a decision problem of choosing retail strategy, that precedes the process of negotiations. A decision problems of a regulator are also formulated. The problems are discussed in context of competition and cooperations between operators on the telecommunications services market.

The road to statutory regulation of legal personality of the Catholic Church in Poland "of the people" was extremely tortuous and had its turbulent history. In my analysis, I present how it came to pass the so-called "May's laws" and type this process in the whole relation between state – church, in the decade of eighties of the twentieth century. As I prove in my analysis, the way of conducting the work on the statutory regulation of the legal personality of the Catholic Church depended directly on the condition of the mutual relations and especially of the current, in a given period of time, concept of the religious policy of authorities, which in the last decade of the existance of the PRL had variable and dual character.

In this study, an attempt has been made to characterize the conditions and the way of conducting negotiations in the closed loop of aluminium waste supply chain. This study focuses on the negotiations on this type of waste between the waste producer (aluminium producer) and the buyer (recycler) and it differs from the negotiations conducted in traditional logistic channels. The motive for the research was to establish that this type of negotiation had not yet been described in the literature on the subject. The research consisted in the analysis of documentation from 69 negotiated deliveries of aluminium dross from various EU countries to a Polish company dealing in its processing and the analysis of conducted structured interviews with representatives of 14 companies selling or buying aluminium dross from various EU countries. The investigation confirmed the research hypothesis that negotiators in a closed-loop supply chain apply intensified strategies to build the trust of the other party in the conducted negotiations and that closed loops are mainly price-based negotiations based on classical purchasing behaviour.
W niniejszym opracowaniu podjęto próbę scharakteryzowania warunków oraz sposobu prowadzenia negocjacji w zamkniętej pętli łańcucha dostaw zgarów aluminiowych. U podstaw rozważań leży teza, że negocjacje dotyczące tego typu odpadów na linii wytwórca odpadów (producent aluminium) - odbiorca (recykler), różnią się od negocjacji prowadzonych w tradycyjnych kanałach logistycznych. Motywem podjęcia badań było ustalenie, że ten typ negocjacji nie został jeszcze opisany w literaturze przedmiotu. Badanie polegało na analizie dokumentacji z 69 negocjowanych dostaw zgarów aluminiowych z różnych krajów UE do polskiego przedsiębiorstwa zajmującego się ich przerobem oraz analizie przeprowadzonych wywiadów ustrukturyzowanych z przedstawicielami 14 przedsiębiorstw sprzedających bądź kupujących zgary aluminiowe z różnych krajów UE. Badanie potwierdziło postawione hipotezy badawcze, zgodnie z którymi negocjatorzy w zamkniętych pętlach łańcucha dostaw stosują wzmożone strategie zmierzające do zbudowania zaufania drugiej strony oraz że w pętlach zamkniętych prowadzi się głównie negocjacje oparte na cenie, bazujące na klasycznych zachowania zakupowych.

Purpose: This study was of a theoretical character and aimed at presenting various descriptions of the interactions between all possible pairs of four well-known negotiating styles dependent on personality traits. Methodology: This study was based on analysis of the interactions as well as authors’ experiences from their observations and analyses on human behaviors during numerous negotiations and roleplay exercises arranged at the courses for practitioners. The stress was put on analyzing the interactions occurring between people representing both different and the same negotiating styles. Findings: The attempt at describing such interactions was successful and promising for farther research. The concept constitutes a useful tool for analyzing human behavioral aspects of different types of business negotiations, within the process of their planning, conduct and evaluation. Nevertheless, the concept will be a subject of subsequent authors’ research, focusing on its improvement mainly by searching more precise features of negotiating styles and interactions between them. Practical implications: The concept can be applied to analyze many real negotiation situations as well as within the experiment to be arranged by the authors to examine those interactions within the hundreds of pairs of negotiators solving particular case studies. Thus the description of such interactions can be treated as a specific hypothesis. Originality: In general, the suggestion for solving complex, difficult and essential issues of negotiating styles was presented but was rarely investigated in the literature on negotiations. In particular, an original concept of describing the interactions between those styles was suggested.

In a Firm-Idea company, a specific institutional model of organisation and performance, and all kinds of processes, including negotiations, are conducted differently than in a traditional company. Therefore, the objective of the paper is to characterise negotiation processes pursued in Firm-Idea companies through a comparative analysis of the literature and the author’s original ideas. Specific features of idea-negotiations are distinguished based on typical, general concepts of negotiations. Their three substantial dimensions are described, i.e. values, relations and cooperation. In effect, the paper offers a comprehensive description of negotiations viewed as an efficient tool useful in different types of processes in Firm-Idea companies.
W Firmie-Idei jako specyficznym modelu organizacji i funkcjonowania instytucji wszelkiego rodzaju procesy, także negocjacyjne są realizowane w odmienny sposób niż w tradycyjnej firmie. Celem artykułu jest zatem scharakteryzowanie procesów negocjacyjnych realizowanych w Firmie-Idei. Dla realizacji tego celu wykorzystano analizę porównawcza literatury przedmiotu oraz oryginalne koncepcje autora. Wyodrębniono specyficzne cechy idea-negocjacji, opierając się na typowych, ogólnych interpretacjach pojęcia negocjacji. Opisano ich trzy zasadnicze wymiary, tj. wartości, relacje i współdziałanie. W efekcie uzyskano ich wszechstronny opis jako skutecznych narzędzi przydatnych do realizacji różnego typu procesów w Firmie-Idei.

The EU-Turkey relations date back to 1960s when the European project started. With the Ankara Agreement of 12 September 1963, Turkey became an Associate member of the European Economic Community which was then an economic organisation from which today’s EU emerged. The EU’s December 1997 sidelining of Turkey’s application for full membership turned the direction on 3 October 2005 and Turkey begin its accession negotiations with the EU. Since then there is still ongoing debate based on cultural, economic and political assessment whether Turkey will fit to be a member of the EU. From the perspective of the institutional norms of Copenhangen criteria, the EU could possibly embrace all countries, regardless of culture, religion and historical background. The EU’s uncompleted institutional structure gives rise some spatial, temporal and thematic scopes which introduce some new accession criteria such as European state, European identity, absorption capacity, open-ended process and approval of the member states which will make more complicated Turkey’s full membership bid to the EU. Despite Turkey’s institutional reforms which bring the country that much closer towards fulfilling the Copenhagen criteria and its dynacmic economy which makes Turkey as the second country that fits the Maastricht criteria in Europe, European politicians and citizens remain deeply divided on Turkey’s accession bid to the EU as a full member. As a consequence, the alternative accession proposals which depreciate the full membership of Turkey are argued by the EU’s core members. The purpose of this article is to answer the vague accession criteria, the different accession proposals towards Turkey and explain the new bargaining position of Turkey for its accession bid to the EU. The exclusion of Turkey from the EU’s enlargement process will be evaluated by different theoretical approaches which constitute the interplay of the liberal intergovernmentalism, historical institutionalism and path dependency process, rationalist approaches and sociological institutionalism.

The aim of the didactic and educational activity of every university, especially the military one, is to prepare the graduate intellectually and professionally to live in society. When creating educational programs in a specific field of knowledge or subject of education, it is assumed that their implementation will ensure that the teachers acquire the necessary minimum of required competences. In such a case, the authors of didactic programs always have a number of doubts or dilemmas such as: To what extent do the assumed competences correlate with the requirements and needs of the social reality, especially the professional one, in which the graduate is prepared to act? To what extent do the content of the curricula and the organization of the didactic and educational process ensure the acquisition of the assumed team of competences by the teachers? Of course, there are many more dilemmas of this type. Not all of them can be unequivocally resolved, if only due to the complexity of social situations in which the accuracy and reliability of the competences acquired by students are verified. Curricular education of students of military universities in the fields of study: national security, is aimed at, among others, the best possible preparation of future officers to command a sub-unit as well as managers and managers to manage human teams in state and local government institutions dealing with the organization and protection of public safety. An important element of the process of commanding a military sub-unit as well as managing in a situation of a potential threat is the ability to make accurate decisions as well as efficiently act and motivate subordinates and co-workers. In situations of uncertainty and insufficient information, and at the same time not only a potential but also a real threat to health and life, this requires not only appropriate psychophysical predispositions but also specific professional competences, especially in the area of distinguishing competences. Bearing the above in mind, the content and purpose of the article will be to introduce theoretically into the issues of social competences, seen from the perspective of a manager - leader - manager, and also an attempt to show the conditions of the manager's functioning - in various social situations, his role, tasks and qualifications, ensuring efficient management of the organization, these include: priorities in the implementation of tasks, skills, creative attitude and preparation for conducting negotiations. Requirements for modern managers - organization leaders - are extremely high, and meeting them does not guarantee only success. They lead people who, above all, need to be taught and prepared: to work in their position, to live in society, as well as to bring each other closer and focus around each other. Employees are different, they are strong and weak, full of pride and quite humble, curious about the world and, despite their different ages, overwhelmed by apathy. All of them, thanks to the work of managers and their competences, knowledge and skills, become good employees at various levels of the organization, and then managers. However, the basis of a manager's work is also, and perhaps above all, communication skills, the basis of which are negotiations.

Celem niniejszego artykułu jest zwięzłe opisanie procesu negocjacji ze szczególnym uwzględnieniem fazy przygotowań. Artykuł powstał na bazie wniosków i przemyśleń z kilkuletnich badań własnych, poświęconych negocjacjom (szczególnie biznesowym). Jako wieloletni negocjator i prezes Krajowego Stowarzyszenia Negocjatorów autorka uważa, że faza wstępna jest często niedoceniana, choć ma wielkie znaczenie dla rezulta‑ tów negocjacji. Zarówno badania własne – analiza porównawcza literatury przedmiotu, badania ankietowe i studia przypadków – jak też praktyczne doświadczenia związane z negocjacjami pozwoliły na opracowanie autorskiego modelu negocjacji. Autorka wyraża nadzieję, że jej artykuł zainteresuje menedżerów, których umiejętność prowadzenia nego‑ cjacji stanowi istotny element portfela kompetencji, a także pracowników naukowych, zajmujących się zawodowo tą problematyką.
The aim of this article is to describe the negotiation process including the preparation phase. The article is based on conclusions and thoughts drawn from the research which has been conducted by the author for a few years. As an experienced negotiator and the president of the National Negotiators Association the author knows from autopsy that the initial phase is often underestimated, although its influence on the outcome of negotiations is crucial. The research allowed the author to briefly present arrangements and the authorial negotiation model. The article may be of interest to managers who very often have to negotiate different agreements and contracts and whose negotiating skills constitute essential part of their competence portfolio. Such competences are required from many specialists, particularly those involved in commerce.

Negotiation is a type of bilateral communication. It is commonly used in conflict resolution, or to reach an agreement between two parties. The paper examines 200 people working in IT departments in the Silesian Voivodship to gauge their knowledge and awareness of the negotiation process. 101 men and 99 women joined the survey. All respondents were adults. 35.5% of respondents were people aged 18-25, 23% aged 26-30, 14% aged 31-35, 7.5% aged 36-40, 3% aged 41-45, 8% aged 46-50, 4% aged 51-55, and 8% were people over 55 years old. The condition for joining the survey was at least a one-time participation in negotiations to resolve a conflict.

In a negotiation process, knowing the preferences of the decision-maker and building a negotiation offer scoring system are very challenging tasks. There are many different methods that can be used to develop such a negotiation support tool, including, but not limited to, techniques based on the multiattribute utility theory (MAUT) or the outranking relation, for instance SAW, AHP or PROMETHEE II. In this paper we present the procedure of evaluating the negotiation template using an unconventional and inventive method called SIPRES, which combines the key elements of the revised Simos’ procedure and the ZAPROS method to elicit the negotiator’s preferences over some reference solutions. This transparent and easy to implement technique – thanks to the ZAPROS-like approach applied within it – allows the decision-makers to define their preferences in a simple manner, providing an effective method for analysing the trade-offs between the alternatives using selected reference alternatives only. Simultaneously, the revised Simos’ procedure, applied in the method, allows for determining the cardinal scores of the alternatives. Thus, sophisticated negotiation analyses can be carried out. As an illustrative example the problem of basketball contract negotiations is discussed.

The article deals with the issues related to a police negotiation system. In particular, it focuses on the specificity of negotiations in situations connected with organized crime. It describes the essential rules as well as the history and organization of the police negotiation system in Po-land. In the article the author presents the classification of negotiation situations relating to the activity of organized criminal groups.
