The present paper synthetically presents the main assumptions and development of the public management in Poland.

Opis:

Finance has always been under close scrutiny. Public finance is considered to play a particularly paramount role in world economies. Public finances are complex phenomena that are subject to assessment both within a given country, but also on the basis of an EU methodology (universal for Member States). The aim of this article is to conduct an extensive research on the significance and the development of public finance in the Polish economy over the years 2010 – 2020. The analysis shows that the statistical reference points to persistent imbalances in Poland’s public finances, which manifest themselves in cyclical public deficits. Overall, both the level of income and expenditure in relation to GDP in Poland is at a moderate level in comparison with many European Union countries. The paper includes a critical analysis of the scientific literature and empirical data. This analysis is considered to be vital from the perspective of economic development of countries.

Opis:

Co-production of public services is an increasingly popular tool in public management, although it is still a new phenomenon in Poland. Despite the attention researchers give to co-production, some significant gaps remain. In this article, the author attempts to examine the legal possibility of implementing co-production by the Polish local government by local initiative and Solecki Fund. The article aims to examine how major Polish cities gathered in Union in Polish Metropolises used local initiatives. The next step in research is to find out how Solecki Fund is spread among rural areas according to statistical data. It is proved that only a handful of local governments in Poland are truly engaged in co-production. However, Solecki Fund can be shown as an excellent example of citizens’ engagement. It is presented a possible agenda on what can be done to make co-production more popular and used on a regular basis not only in metropolitan but also rural areas.

The article compares three dominant theories of public management and discusses whether these theories meet the needs of public management practice in 21st century. The authors first discuss challenges related to public sector management, indicating the increasing role of public sector in modern economy. The next section focuses on the differences between organisations operating in public and private sectors. Next, the article outlines three main theories of public sector management: hierarchical approach (classical theory of bureaucracy), market approach (New Public Management) and network approach (New Public Governance). In the final section the authors present the comparative analysis of these theories and discusses their relevance to contemporary public management.

The paper examines the issue of public service ethos and poses a question how that specific culture fits into the framework of public management. The author states that in the early 21st century, the Weberian model of bureaucracy is under increasing pressure of market-logic driven models of public management. On the other hand, an alternative to both classic bureaucracy and modern public management seems to have emerged in the form of public governance theory. In the context of contradictory influences, Poland 's administration finds itself at a crossroads nowadays, as it struggles with the bureaucratic legacy and underdeveloped public service ethos, while entering the foreign land shaped by not entirely compatible logics of the market and public governance.

The author argues that public governance in Poland should be oriented toward the characteristics of interactions among a diverse set of policy actors. Public governance has been defined as a problem solving process in which formal government -- as a cabinet of ministers and public administration -- is no longer the only leading policy actor. Instead there is a network of various actors from within government and from without that contributes to decisions processes and policy outcomes. This change is a result of the decentralization of power. To understand the barriers that block the policy creation process requires an analysis of networks and attention to the pluralistic approach to public governance.

The functioning of forest districts in Poland should be based on their mutual cooperation with local authorities in order to achieve social interest, one of the examples of which is construction or reconstruction of roads. Due to the fact that achieving mutual investments encounter real legal problems arising from underspecified and unclear concepts, an assessment should be made of whether the construction and reconstruction of forest roads is a public purpose and also answer, what is a forest and forest road within the meaning of the provisions of the Act. It is necessary to present views of legal science and jurisdiction of administrative courts. The judicial direction of administrative courts is not beneficial for achieving investments; it does not even take into account that one of the investors’ purposes – forest districts – is nature management. Presenting the contrary argumentation to judicature positions should help courts make a proper assessment in the interpretation of provisions.

Opis:

The system of education allows various legal entities to participate in providing educational services. A look at the public administration in the scope of public education reveals not only a multitude and variety of educational services, but also a diversity of administrating entities. We should assume that functioning and organization of schools in the public domain is affected, as a rule, by economic and political circumstances. And it does not matter what legal entity runs such schools or educational facilities. Economic or political problems related to providing educational services depend specifically on current educational policy of state and local government authorities. By virtue of the educational law that envisages decentralization of the state educational services, it was assumed that the local government authorities’ responsibility does not need to mean performing educational services unassisted, but they may delegate their performance to legal entities other than public ones. This paper aims at pointing out the contribution of non-public entities to providing educational services. Relevant questions are asked about the ways of performing educational services and limits to the privatization of educational services contrasted with the responsibility for meeting educational needs of local communities.

This article deals with the economic budget of local governments units. This paper includes the study of local government units in the Podkarpacie region and the main subject of the article are evolution directions of income policy and government spending in 'gminas' (communes). The analysis of local government finance between the years 1999-2008 emphasizes the changes in the priorities of public spending. Reorientation are not only trends, also the nature of realizing budgetary economy. As a result, it seems a reasonable approach to the revision of these changes.and analysis of their substrate. Not without significance is the impact of legislative amendments to change the financial management local government units. The article outlines the above subjects and the nature of its deliberations in a way that reflects the theme of comprehensive changes taking place in local government finance.

In the global rankings of generalized trust, Poland occupies a low position. Polish people are rather distrustful. Analyses of trust endeavour to isolate (distinguish) distrust. Distrust is more and more often defined as a separate definition, not only as the opposite to trust. Analysis of distrust seems indispensable, in particular with reference to the public sector. Public sector organizations point out at building trust. The article is an attempt to systematize the concept of distrust through analysis of trust and separation of basic differences in both concepts (trust and distrust) was made. A great significance of distrust towards entities (organizations) of the public sector may be observed. The objective of the article and research was to prepare a theoretical basis for the studies on distrust in the Polish public sector. The paper includes theoretical frameworks, which may be used for a detailed research on the role and significance of distrust in the public sector. The paper is based on the literature review and generally available data.

Opis:

The article focuses on the construction of public roads in Poland. In the introductory section the basic rules for financing such investments are discussed. It is highlighted that investment in road infrastructure is very expensive for the state budget and local government, even with financial support from the EU funds. In this context, public legal partnership (PPP) has become a very useful and cost-effective institution for carrying out public tasks. This article describes the possible partners of PPP and the legal nature of the related contract, highlighting the three main types of public-law partnerships that can be applied to the construction of public roads in Poland. The article concludes with recommendations regarding legislation governing the construction of public roads and public-private partnership.

Discussions on the importance and opportunities of the public-private partnership have been taking place for many years. The article presents an analysis of public-private partnership which is usually considered a form of realisation of public tasks. It is less frequently regarded as a tool for introducing changes in the public administration as such. In their article, the authors emphasise the specific role that public-private partnership can play in designing public sector policies, and its application related to the lack of funds for effective realisation of public tasks. Public-private partnership allows then for changes in the public management model, by transforming public administration towards administration that is responsible for the whole society.

The state sector in the Italian economy dates to the 1930 s. Although back than it was considered a temporary solution to help strategically important companies survive the Great Depression, it quickly grew. In the era of globalization, state and public organizations must be effective. One of the conditions of this effectiveness is the creation of intra-organizational trust. The author identifies factors, that affect this trust, and formulates a definition of public trust and intra-organizational trust. It was stated among others, that public trust to the organization can be reduced due to lower lever of intra-organization trust. It was also stated, that staff willingness to remain in the organization does not depend only on job satisfaction. A lack of willingness to sharing by employees the knowledge and skills with others can be considered as an indicator of the level of intra-organizational trust. A high staff fluctuation can be considered as an indicator of a lack of trust in the organization.

Objective: New public governance is one of the most popular paradigms in public administration management. The aim of this article is to examine the co-production of public services, which is gaining interest in many European countries, including Poland, and to find out how co-production is defined, what the reasons to pay attention to this tool are, how we can distinguish between different models of co-production and, last but not least, what the possibilities and drawbacks of introducing it into practice are. Research Design & Methods: The article is a literature review based on the most important public management journals. Findings: In conclusion, the author shows new ways of defining co-production and presents a proposal for further research strategies for the co-production of public services. Implications / Recommendations: The meaning of co-production of public services has varied over the last few years due to the fact that various new elements have emerged. Therefore there is still a huge field, to cover such as conducting research about the use of social media in the co-production of public services. Contribution / Value Added: The most recent literature review about co-production was conducted by Vooberg in 2014. As a result, this article refreshes the knowledge about it and proposes a new research agenda for the future.

It is a term that is also used in economic literature to describe a particular type of economic activity in the public sphere. However, despite the legal definition the category of public utility is not satisfactory and variously interpreted. The discussion conducted in the article is twofold. First, it refers to the formula of public utility enterprises; secondly, it refers to the analysis of the essential characteristics of this sphere of activity. To achieve this goal the author used literature review and legal acts. As a result, the findings concerning the conditions for the functioning of the public utility were presented and the author made an attempt to redefine the term. The article highlights the merits of the enterprise model in a separate legal regime, appropriate to the specific nature of public utility as derogation from the logic of the market.

The article focuses on the issues and problems caused by the economic crisis of 2008 for public-private partnership (PPP). The challenges faced are presented from the point of view of a public entity, a private partner and a financial institution, as well as the relationships between these parties and the influence of economic issues on these relations. The most crucial of these challenges seems to be: the pressure on public finance and growing difficulties in financing the public infrastructural investments, the rise of the economic risk of investments and the necessity of sufficient and appropriate transfer and management of risk, and finally – the lack of interest of financial institutions to finance long-term liabilities. The aim of the author is to provide a precise description and diagnosis of the issues mentioned above, which might improve the strategic management of PPP market as well as management of projects. The article is based on experience, documents and working papers concerning the countries and markets of the European Union but the presented conclusions should be of more universal nature.

The purpose of this paper is to show implementation of EU directive 2003/98/EC on the re-use of public sector information to the Polish law. The right to re-use is passed over on even broader discussion so there is a need to undertake that issue. In accordance to the EU directive 2003/98/EC, re-use of public sector information means the use by persons or legal entities of documents held by public sector bodies, for commercial or non-commercial purposes other than the initial purpose within the public task for which the documents were produced. The definition in Polish Access to the Public Information Act is not precise and cause problems in interpretation. Too broad approach to set up the conditions for re-use of public information can cause excessive stringency in activities of administrative bodies and as a result undermine the effectiveness of new law as well as well as other limitations not required by the directive. There are also serious doubts regarding calculation of fees for re-use. Generally the whole implementation seems to be not fully thought out and coherent.

This paper proposes an assessment of the non-linear relationship between public deficit and public investment in debt situation. We use an endogenous growth model, with productive public spending, that we test empirically using the interaction model of Brambor et al. (2002), over the period 1980-2015, in Senegal. The results of the estimates show a change in the regime of the relationship between public investment and public deficit for public debt level equal to 80% of GDP. When public debt is below this threshold, any increase in the deficit has an expansive effect on public infrastructure spending. When public debt is above the threshold of 80% of GDP, an increase in the deficit has a recessive effect on public investment.

The article looks at the issue of public health understood as an important factor of production. The author also analyzes the impact of the population’s health on economic growth. Korporowicz discusses a variety of approaches to public health, with a particular emphasis on a socioeconomic approach. She highlights the economic aspect of health as a component of human capital that creates the basis for examining living conditions and socioeconomic development. Health also needs to be evaluated for the purposes of economic calculations in the area of health protection policies, the author says. Such evaluations are used to determine the costs of health insurance, for example in the case of car accidents. The author counters a popular belief that the level of human capital is exclusively associated with education and public spending on education. According to Korporowicz, the health status of the population influences the level of human capital, while healthcare needs to be treated as a major socioeconomic category. Health is a resource that is subject to wear and can be enhanced and partly replenished by adequate investment. It plays an increasingly important role in the structure of production. Without it, uninhibited economic growth is impossible, the author argues. Korporowicz sets out to prove that health and healthcare can be analyzed in terms of the theory of public goods. Health is an asset that can be used in a specific way, the author says, but its benefits cannot be directly accessed through the market; nor is health subject to competition because the more health there is among individuals, the more society benefits as a whole. This is what sets public goods apart from private goods, which means that the idea of analyzing health on the basis of the public goods theory is justified, the author argues. It needs to be assumed that economic growth is impossible without a healthy and efficiently functioning innovative and creative society, Korporowicz adds. In modern economies, economic efficiency strongly depends on the intellectual potential and health of the population, the author concludes.

Crowdfunding is a form of funding projects (business, scientific, social, artistic, etc.) based on small but numerous payments, collected mainly through Internet communities. The article presents the current state of interest in this form of public art funding, both in Poland, and abroad. The analysis of crowdfunding websites shows several features of this mechanism used for public art funding. It encourages artists to engage in more active participation on the Internet, especially on social networks’ level, which is particularly important in the all-or-nothing financing system. Crowdfunding also encourages people to be more active citizens, as financial support for specific projects in the field of public art is not only an endorsement, but also a real act of participation in the processes of creation of public space. On the other hand, crowdfunding has very limited ability to control and influence the artistic and social value of projects. Reliance on the “wisdom of the crowd” may therefore lead to the promotion of mediocre initiatives, neither presenting a high aesthetic value, nor bonded to the space in which they are to be found. There are also other risks associated with crowdfunding of public art, such as the risk of rollover of such initiatives from public institutions (e.g. local governments) solely on the shoulders of citizens, or the lack of intellectual property protection.

In this paper I addressed the issue of the engagement of museums in climate change. The problem of climate change is so important in the current social context that, despite its difficult political connotations, it cannot be ignored by museums, especially if we consider a museum as an element of a public sphere. Climate change is a challenge in 21st century. Climate change will present challenges that are of long-term nature, multidimensional and global phenomenon. It could impact directly on museums. I assume museums can provide a safe place for dialogue around climate change. Museums can also inform publics about the science of climate change and help to equip people with knowledge, shape their attitudes and behaviour, and strengthen the mechanism of participation. Potential barriers in effective communication could be the problem of uncertainty of our knowledge about climate change, scientific discourse in the process of communication and getting visitors involved.

The purpose of the article was to present the role and specifics of a significant function of administration, consisting in the organization and provision of public services. Therefore, an analysis was made regarding, among other things, the legitimacy of the administration to perform public tasks, using the example of the administering administration, contemporary understanding of the function of public administration and the shape of contemporary Polish public administration. The role of administration evolved from the direct provision of public (social) services through its own institutions towards direct organization of the provision of services, to limiting its role in organization and responsibility for the standard of services provided by non-public entities. The administering administration is the area of administration that is subject to ever more intense privatization processes. The forms of the administration’s operation, means, as well as entities acting within the framework of this function, have also changed. Such a system improves provision of the services. The ability to adapt public administration to challenges and expectations of modern society in connection with organizing and providing public services, becomes truly important. The administration that is responsible for organizing and providing public services should be conciliatory – it should support the development of the individual, protect them and not limit itself to the administrative and controlling role only. The role of the administration must be modified and the civic sector is a complement to its activities.

The Recruitment Procedure Applied to Candidates for Uniformed ServicesThe article deals with regulations concerning the recruitment procedurę which precedes employment of officers of uniformed services. The legislator did not decide to introduce a uniform model of recruitment procedurę for all uniformed services, which is justified given specific tasks performed by particular services. Regardless of the justified differences between recruitment procedurę concerning various uniformed services, a substantial similarity may be shown, namely that all of them arę associated with the right of access to the public service, laid down in Article 60 of the Polish Con-stitution of 2 April 1997. The rationale for such considerations is justified by the signif-icance of the problem, but also by the fact that regulations governing the recruitment procedurę arę marginalised by law scientists. The purpose of the study is to resolve the doubts concerning the legał naturę of the recruitment procedurę and the activities tak-en in its course as well as to assess the provisions governing the recruitment procedurę in the context of the right of access to the public service and the formal guarantees of that right. As a result of the analysis of the relevant provisions, it has been found that the recruitment procedurę for candidates for uniformed sendces is public administra-tion proceedings. Activities undertaken by the entity conducting a particular procedurę arę "other public administration activities" within the meaning of Article 3(2)(4) of the Act on proceedings in administrative courts of 30 August 2002. The activities of the entity conducting the proceedings, such as exclusion of the candidate to take part in the recruitment process, staying of proceedings against a particular candidate and the finał assessment may therefore be the object of a complaint lodged with the admin-istrative court. Also recognised is the need to introduce legał provisions systematising the issue of notification of recruitment for vacant positions in uniformed services as the basie condition for the implementation of the right of access to the public service.

The aim of the article is to present the evolution of the structure of the public finance sector’sincome and expenditure between 2004 and 2011 and an attempt to find and evaluate thedeterminants of those changes.The author verifies the hypothesis of a systematic increase in significance of the state budgetand appropriated funds as instruments of the redistribution of wealth occurring together with theprocesses of centralisation of income in government sub-sector and decentralisation ofexpenditures (due to increased transfers to the local government sub-sector). In order to verify thishypothesis data concerning income and expenditures of the public finance sector between 2004and 2011 has been standardised, aggregated and analysed in the most crucial cross-sections.Issues raised in the article are extremely important in the context of remedial actions and anongoing discussion in economic circles on the role of the expenditure rules in public financesector. That being so, the report brings high value to the financial sciences and economics.

Opis:

This paper proposes an assessment of the non-linear relationship between public deficit and public investment in debt situation. We use an endogenous growth model, with productive public spending, that we test empirically using the interaction model of Brambor and al. (2006), over the period 1980-2017, in WAEMU countries. The results of the estimates show a change in the regime of the relationship between public investment and public deficit for public debt level equal to 75% of GDP. When public debt is below this threshold, any increase in the deficit has an expansive effect on public infrastructure spending. When public debt is above the threshold of 75% of GDP, an increase in the deficit has a recessive effect on public investment.

This paper aims to prove that during the transformation process in Poland of the sectors of general economic interests due to specific economic characteristics of those sectors and the fact that interests of three groups participating in the decision making in this process: government, management and employees turned out being non controversial prevented loosing the monopoly status they initially enjoyed. The method used was the analysis of the stages of negotiation illustrated by subsequent documents of official strategies chosen for three sectors: railway, electricity and the final result illustrated by the structure of the market. Preventing the monopoly status permitted those groups seeking the rent, the monopoly status created or even demand that rent in the form of subsidy from the public authorities budgets by the threat of the strike which is the grave threat in the sectors delivering the service of general economic interest.

Opis:

Restoring public finance sustainability in the European Union after the recent financial crisis requires the application of diversified fiscal policy measures. These measures are indicated in fiscal stability programmes designed by the European Union Member States. This article discusses such programmes implemented in France and Germany. The author presents scale, sources and implications of public sector debt in these countries, analyses structure of revenues and expenditures and examines objectives, reform agendas, selected means and expected outcomes defined in these programmes.

The book ‘A Game on the Future of Public Services in Poland’, edited by Wiesława Kozek and published in 2011 by University of Warsaw Publishing House, comes exactly on time to deliver up-to-date comparative information about the public sector restructuring in Europe and its impact on the quality of the public services. The editor and the authors of nine chapters (Wiesława Kozek, Agnieszka Maciuk-Grochowska, Beata Radzka, Julia Kubisa, Damian Podawca, Piotr Ostrowski, Joerg Flecker, Christoph Hermann) draw from the results of three-year project PIQUE (Privatisation of Public Services and the Impact on Quality, Employment and Productivity), as well as research of the Sociology of Work and Organisation Unit of the Institute of Sociology, University of Warsaw. The PIQUE project was carried out in the years 2006–2009 and founded by the European Commission 6th Framework Programme. Based on the project’s results, the book cover four sectors, electricity, postal services, local public transport and health services/hospitals in six European countries (Austria, Belgium, Germany, Poland, Sweden and the UK). The sectors were chosen to reflect the diff erentiated levels of liberalisation and privatisation and the variety of regulatory solutions. Obviously, the main focus of the book is on Poland, but the authors pay particular attention to the international contextualisation of their sectoral and company cases.

The purpose of this article is to demonstrate that theory-guided public relations practice is more likely to contribute to socially responsible behaviours by organizations than public relations approaches that are based solely on the emphasis on skills and the elaboration of “techniques,” and, to be frank, solely on the mythology of “best practice.” Consequently, theory-guided public relations may be better suited to bridge the gap between service for an organization and service for society. The article sets out with a short historical overview of the relationships between public relations theory and practice. It then goes on developing a methodological and empirical context designed to show connections between theory and practice. Furthermore, the paper highlights diff erent types of practitioners. Finally, a summary including prospects closes the article. Due to this, the following research question confirms these assumptions: how and why can theory-guided public relations contribute to socially responsible behaviours by practitioners?

Opis:

The study concerns the subjective limits of the public subjective right to public information. It attempts to answer the question of the addressee of the claim characterizing this right in the Polish legal order from the perspective of constitutional regulations and the provisions of the Act on Access to Public Information. The analysis focuses on the interpretation of the statutory concepts of “public tasks” and “entity performing public tasks” using the method of doctrinal interpretation as necessary in this respect. At the same time, such an understanding of doctrinal interpretation was adopted, according to which it is an interpretation carried out  in the process of implementing the law, i.e. in specific circumstances, by the entity implementing this law and made from the point of view of the science of law, i.e. when referring to scientific arguments in the justification of the position and proposed solutions presented. For this reason, the results of the doctrinal interpretation of the terms “public task” and “entity performing public tasks” were also referred to the views presented in the jurisprudence of administrative courts. The analysis led to the conclusion that an “entity performing public tasks” within the meaning of the Act on Access to Public Information can be spoken of when the obligation to act    of a specific entity corresponding to the content of the public task is anchored in     a legal norm addressed to this entity, and the responsibility for its implementation is borne by the public-law community (state, self-government communities), of which this entity becomes a body in the functional sense. At the same time, this analysis justifies the conclusion that the theoretical constructions of administrative law, apart from their obvious scientific value, also have operational significance, and the need or even necessity to use the method of doctrinal interpretation in the area of this law seems obvious.

Funkcjonowanie administracji publicznej powinno służyć podnoszeniu dobrobytu społeczeństwa poprzez efektywnie działające struktury, ale także dążeniu do stworzenia korzystnego klimatu inwestycyjnego. Szczególne znaczenie w tym zakresie ma obniżanie kosztów transakcyjnych i znoszenie barier instytucjonalnych utrudniających prowadzenie działalności gospodarczej. Biorąc pod uwagę rolę administracji publicznej we wzroście konkurencyjności gospodarki należałoby podjąć próbę budowy nowoczesnego i efektywnego aparatu administracji. Wymaga to jednak zmiany optyki widzenia problemu i przesunięcia punktu ciężkości z biurokracji w kierunku dobra publicznego zarówno obywateli, jak i podmiotów gospodarczych. Celem artykułu jest przedstawienie roli administracji publicznej w rozwoju społeczno-gospodarczym i wykazanie, iż konkurencyjna gospodarka wymaga efektywnie funkcjonującej administracji publicznej. W tekście przedstawiono także specyfikę funkcjonowania sektora publicznego, wskazując przy tym na kluczowe cechy dóbr i usług publicznych. Postawiono tezę, iż administracja publiczna, będąc częścią sektora publicznego, ma jednocześnie klasyczne właściwości przypisywane dobrom publicznym i tym samym może być uznana za dobro publiczne. Co więcej, administracja publiczna może być rozpatrywana niejako w podwójnej roli, jako instytucja sama w sobie jest bowiem dobrem publicznym, ale także jako instytucja, która świadczy dobra i usługi publiczne. Niniejszy artykuł stanowi teoretyczne rozważania nad administracją publiczną rozpatrywaną w kontekście dobra publicznego.
The functioning of public administration should serve to enhance the well-being of society through efficient structures, but also to create a favorable investment climate. Particular im-portance in this regard is to reduce transaction costs and remove the institutional barriers to do-ing business. Considering the role of public administration in increasing the competitiveness of the economy, one should attempt to build a modern and effective administration apparatus. However, this requires changing the perception of the problem and shifting the focus from bu-reaucracy to the direction of the public good of both the citizen and the business. The purpose of the article is to present the role of public administration in socio-economic development and to demonstrate that a competitive economy requires an effectively functioning public administration. The text also presents the specificity of the functioning of the public sector, indicating at the same time the key features of public goods and services. The thesis has been made that public administration, being part of the public sector, has at the same time classic properties attributed to public goods and thus can be considered a public good. What is more, public administration can be considered in a dual role, as an institution is in itself a public good, but also as an institution that provides public goods and services. This article is a theoretical consideration of public administration considered in the context of public good.

In a globalisedworld, innovationis the driving force of the economy. In Poland, the public sector can support innovation to a large extent thanks to the Public Procurement Law, amended in 2016, which introduced a new procedure - innovation partnership. Judging by the scale of public spending, public procurement can become a powerful tool for the development of innovation in the economy. The aim of this article is to examine how innovation partnership can influence the effectiveness of investment projects. The assessment of processes related to the purchase of innovative solutions by the public sector with the use of public procurement and the innovation partnership mode shows that the use of this mode in various sectors of the economy may significantly improve the quality of tasks performed by them. In the study, the model method was applied based on the evaluation of the practice of using innovation partnerships in selected countries and the analysis of the transferability of these solutions to Poland. The evaluation took into account the specificity of public procurement procedures and innovation partnerships resulting from legal conditions and the national socio-economic environment. Weaknesses in the application of this procedure were identified, which cause that the innovation partnership is not a commonly used mode of investment projects implementation, and recommendations were formulated in order to reversethis trend.  JEL Classification: O30, O31, O38

Not always the public space gives good energy to the recipient. Sometimes, contrary to the expectations of the originators of consumer offer for this space, it is even considered to be repulsive. The phenomenon of generating good or referred to as bad energy by urban public spaces existing in reality, is an interesting research topic. It can accommodate both the newly created public spaces, old, historic spaces currently being reformed and iconic space. The way to create new successfully cases of public spaces is relying on multidisciplinary studies of the sociology and psychology of architecture.

The aim of the publication is an attempt to define the notion of processed public information as mentioned in the act from September 6, 2001 about access to public information. Due to the lack of relevant statutory definition it was of key importance to refer to judicial record in this field as well as doctrinal standpoint. The authors first focused on the already existing definition of public information, characterizing simple public information as well as processed public information according to analysis of number of sentences by Supreme Administrative Court as well as Regional Administrative Court . This let them categorize certain type of information as processed information. Finally, the publication refers to procedural key issues connected with examination of public information questions in the case when it is categorized as processed public information.

This article attempts to present and explain the functioning of the market mechanism of the market of one percent. The article discusses the problem of the unintended consequences of intended actions, which were induced in to the Polish tax system by “1% mechanism”. It is about the possibility of donating 1% income tax due from individual taxpayers to public benefit organizations. As a result of the implemented regulations a market of one percent has been created, on which public benefit organizations conduct competitive struggle for money which taxpayers can dispose. This article aims to explore the mechanism of competition on the market of one percent and understand methods of competitive struggle. The article makes the hypothesis that the public benefit organizations can either alone carry the burden of competition for the 1% tax, or offload it onto their mentee. The article makes references to the statistics of the Ministry of Finance and the implementation and financial report of investigated organizations.

Problematyka religijnych public relations jest nieustannie pogłębiana. Dzięki temu wzrasta świadomość tego, jak ściśle mogą się wzajemnie zazębiać i przenikać konstytutywne elementy instytucji Kościoła oraz teorii i praktyki public relations. Te ostatnie mogą zatem być postrzegane jako składowa procesu eklezjotwórczego. Opracowanie odzwierciedla eklezjotwórczy potencjał public relations przez analizę działań mających na celu upowszechnianie orędzia religijnego, aktów kultu religijnego, aktywności dobroczynnej i charytatywnej.
The range of problems of religious public relations becomes more complex. Thus, scholarly awareness of constitutive elements of the Church institution as well as theory and practice of public relations are seen as more mutually linked and inter-related. All of this can be seen as a component of ecclesia-forming processes. This study refl ects the public relations ecclesiaforming potential; the goals are achieved through the research on a wide range of activities, such as spreading of a religious message, acts of religious cult, and charity agency.

The work of a public institution spokesperson is undoubtedly vital for creating the image of an institution and building its credibility. Both the Constitution of the Republic of Poland and the implementing acts resulting from it (primarily the Press Law and the Act on Access to Public Information) guarantee freedom of the press and freedom in the performance of journalistic activities. All this, in turn, is to serve the purpose of exercising social control over the actions of these institutions, which function to provide citizens with access to the necessary benefits, such as protection, support, or quality of life improvement. These institutions are financed from public funds to facilitate their use by every citizen and take actions to gain or strengthen trust and credibility among citizens. With the concept of a public institution defi ned in this way, it certainly also includes public and local government administration and services responsible for the security of the state and its citizens. While fulfilling the obligations imposed by the law in the field of informing the public and transparency, all these entities implement the adopted press and information policy. In most cases, the responsibility for its implementation rests with the press spokespeople, who must meet the challenges facing them. They must be aware that they act based on the law and adapt to the needs and expectations of journalists as much as possible. Based on relations with journalists, they create the image of the represented institutions. However, the freedom of the media and the obligations to provide journalists with information are not absolute. They are often subject to restrictions resulting from laws limiting the provision of information. Therefore, the secrecy of the conducted preparatory proceedings, personal data protection, professional secrecy, business secrets, among others, make it impossible to implement a fully open media policy. Building credibility so crucial for every public institution is the basis of PR activities, and press spokespeople are, after all, part of them. It is impossible to do with lies, half-truths, or fake news, which are so popular nowadays. Thus, there is a rule to avoid lying and carefully check the information provided in contact with the media. The consequences of failing to apply this rule can be detrimental to the spokesperson, the institution represented, or the authority of the state that governs the institution. In their activities, public institutions should be guided by the public good, serving political forces exercising power with equal commitment, limiting their operations to the execution of decisions made by politicians. In the work of apolitical press spokespeople of public institutions, such activities must translate into — very broadly understood — apolitical communication.

Globalizacja, rozwój technologiczny oraz kształtowanie się nowoczesnych społeczeństw obywatelskich niosą zmiany w funkcjonowaniu administracji publicznej. Celem artykułu jest omówienie współczesnych koncepcji zarządzania publicznego: nowego zarządzania publicznego oraz koncepcji kształtujących się na bazie idei governance. W we wnioskach krytycznie odniesiono się do możliwości zastosowania tego paradygmatu, wskazując na obiektywne bariery związane z naturą biurokracji oraz kapitałem społecznym.
Globalization, technical progress and emerging of modern civic societies cause significant changes in the public administration. The main goal of the paper is to describe contemporary conceptions of the public governance: new public governance and other conceptions like multilevel governance. The author concludes with pointing at various problems in implementation of this paradigm that are related to the nature of bureaucracy and social capital.

Pojmowanie przedsiębiorstw napotyka na trudności związane rozróżnieniem ich publicznego, czy też prywatnego charakteru. Tradycyjnie publiczny charakter przedsiębiorstw sprowadza się do ich finansowania przez państwo. Ekonomiczne podstawy publicznego charakteru przedsiębiorstw pozwalają wyróżnić dwa, poza zasilaniem w środki pieniężne, kryteria tego podziału: dostarczanie dóbr publicznych i publiczny kapitał właścicielski. W opracowaniu zdefiniowano przedsiębiorstwo jako formę prowadzenia działalności gospodarczej przez przedsiębiorców, omówiono sektor publiczny, wyodrębniono dobra czyste i uniwersalne sektora publicznego oraz rozróżniono kapitał publicznych i prywatnych przedsiębiorców, pozwalający wyodrębniać konsumpcję zbiorową i indywidulaną. Wiedza ta jest przydatna dla nauki o finansach oraz ekonomii sektora publicznego.
The concept of enterprise involves problems with the differentiation whether it is public or private in character. Traditionally, the public character of enterprise results from the fact that it is financed by the state. The economic bases for the public character of enterprises lead to the distinction of two criteria of such division (apart from money supply) i.e. the provision of public goods and the public ownership capital. The paper defines enterprise as a form of economic activity performed by entrepreneurs, discusses public sector, separates pure and universal public goods and differentiates the capital of public and private entrepreneurs which facilitates the distinction between mass and individual consumption. Such knowledge is useful in the research on public finance and economy.

The paper is about sustainable public procurement as a new global trend in the development of a sustainable economy. The main question raised is the following: how could sustainable public procurement be implemented in Russia? We aim to answer the question by presenting the findings of survey, covering public procurement practices of 51 contracting authorities and documentation analysis of 400 public tenders, and investigating Russian legislation. The conducted survey aims to identify the aspects of sustainable public procurement already used by public authorities in procuring practices in Russia. The analysis of Russian legislation allows to define in which sections of procurement documentation different aspects of sustainability could be included. This paper provides a unique survey of sustainable procurement practices across the Russian public sector. Research also shows the prerequisites of implementation of sustainable public procurement in Russia.

The article aims to estimate the current level of public finance sustainability in the European Union, taking into account the starting fiscal position, the possibility of withdrawing fiscal impulses, the future costs of population aging, and possible financial market responses. The author achieves this objective by using an indicator method similar to that used by the European Commission. However, this method has been modified by diversifying projected GDP growth rates and public debt interest rates, Gajewski says. The assumption is that the interest rate may vary depending on the response of financial markets to the debt-to-GDP ratio. The author demonstrates that almost all EU countries have lost their medium- and long-term fiscal sustainability. Greece and Ireland appear to be the worst off among the analyzed countries, Gajewski says. Both these economies suffer from a high structural budget deficit and potentially high costs of population aging. Most other countries will also be forced to make strong fiscal adjustments to achieve primary surpluses far exceeding those in the period before the financial crisis. The calculations also show that Sweden, Estonia and Bulgaria boast the highest levels of public finance sustainability in the European Union, the author concludes.

The article deals with the issues of the innovations implemented in public transport. Their theoretical background was defined in the form of the latest concepts of territorial development: the theory of sustainable development, circular economy, and smart city. The examples of innovations quoted above have been analysed in terms of their impact on: the local community, the environment, health, safety, and economic and social aspects. The main conclusion drawn from the analysis is that technical innovations in public transport contribute to improving mobility, the comfort and safety of commute, and, at the same time, have a positive impact on the environment.

From the 1980s onwards, in developed countries (and not only) we observe an upward trend in the ratio of public debt to GDP. In many countries public debt has exceeded GDP, and in the world's most indebted country – Japan – has exceeded 250% of GDP and continues to grow rapidly. These figures raise concerns among economists and emerge questions about whether public finances in these countries are on a sustainable path. In order to answer these questions, the criteria for assessing the sustainability of public finances need to be specified. This problem was already investigated by classical economists, but the definition and the formal conditions for a balanced fiscal policy have been specified by economists almost two centuries later. The aim of this article is to present the evolution of theoretical research on the problem of sustainability of public finances

Problems of sustainable economic development also apply to urban transport. The European Union emphasizes the creation of a sustainable transport system in which public transport will function more efficiently. Currently not all possible means of transport are used in public transport. Attempt to introduce transport water means in public transport does not always have a successful result. Existing solutions do not fully meet the postulates requested in passenger transport. The article analyzes the main technical and financial conditions and makes proposals necessary for the implementation of water public transport. Special attention in these proposals is paid to Szczecin agglomeration.

Theoretical background: Participatory budgeting enables the co-creation of local budgets through discussions between residents and local authorities. Thanks to this, it is possible to implement those investments that are important for the local community. By voting, the citizens may participate in the process of creating local development. Purpose of the article: The purpose of the article is the diagnosis of the concept of public governance and tools used within the framework of co-management, with particular emphasis on the participatory budget on the example of the city of Lublin in 2015–2021. Research methods: The analysis covered existing data from budget resolutions of individual cities, reports from the Lublin Research Group and from Internet sources. The publication includes both quantitative and qualitative research. Main findings: The participatory budget of Lublin is characterized by a relatively high share of funds allocated to the implementation of tasks in total budget expenditure compared to other provincial cities in Poland. For several years, there has also been a noticeable decline in the turnout of people voting for projects under the participatory budget. Thanks to a detailed analysis of the functioning of the participatory budget of the city of Lublin, compared to other provincial cities in Poland, there is a need to promote the idea of social participation more strongly.

Goal – The aim of the paper is to analyse the significance of the economic category referred to as stock-flow adjustment (SFA) for the evaluation of the level and dynamics of public debt in Poland. The category is an important part of the analyses called excessive deficit procedure (EDP) conducted by The European Commission. It is also a major contributor to the growth of public debt. It is also related to political activities which fall into the category of creative accounting. Stock-flow adjustment is, therefore, a threat to the stability of public debt. In spite of all this, SFA is not taken into account in Polish documents related to debt management. Research methodology – The analysis performed by the Author is based on the desk research method. It is mostly a qualitative analysis, relying on the literature and both strategic and operational documents of the European Commission and the Polish Ministry of Finance. Stock-flow adjustment is widely regarded in literature as an expression of the hidden part of public debt dynamics. This paper offers an evaluation of SFA’s influence on public debt and its different degrees across both developing and developed countries. Moreover, the documents of the European Commission and the Polish Ministry of Finances are analysed from the point of view of SFA. Score – The analysis undertaken in the paper reveals that stock-flow adjustment has a strong impact on the occurrence of the so-called debt pikes, i.e. sharp increases in public debt. Many authors’ conclusions confirm that SFA considerably affects the level of debt. They also associate it with the restrictiveness of fiscal rules and creative accounting. Thus, SFA is an important element of public debt sustainability. SFA is included in European Commission analyses, but fails to be recognized by Polish documents. It is strongly recommended that SFA is taken into consideration in public debt management in Poland.

W tekście zaprezentowano wyniki badania ankietowego przeprowadzonego z udziałem 1 217 pracowników administracji publicznej w Polsce. Jego celem było określenie kulturowych determinant wprowadzania reform zgodnych z zaleceniami Nowego Zarządzania Publicznego (NZP) i New Public Governance (NPG) w polskiej administracji. Wyniki świadczą m.in. o tym, że polscy urzędnicy niechętnie akceptują wdrażanie mechanizmów konkurencji w urzędzie oraz że preferują rozwiązania typowe dla logiki hierarchicznej. Wśród czynników sprzyjających wprowadzaniu reform zidentyfikowano wyższy niż w całej populacji poziom deklarowanego zaufania oraz świadomość, że obecny stan administracji publicznej w Polsce jest niezadowalający. Przeanalizowano również, w jaki sposób przekonania urzędników zmieniają się w zależności od miejsca zajmowanego w hierarchii administracyjnej, oraz porównano ich przekonania z deklarowanymi przez ogół populacji Polaków.
The paper is based on an opinion survey of 1217 Polish public administration employees, which was conducted in order to asses cultural determinants of the successful introduction of the New Public Management and the New Public Governance reforms. The results show that Polish public administration employees are not very eager to accept the implementation of competitive mechanisms in their workplace, and that they prefer solutions rooted in the hierarchical logic. It was concluded that factors positively affecting the probability of successful reforms are: the level of trust, which is higher among them than among the general public, and high awareness of the present dismal state of the administration. The opinions shared by the public administration employees were also compared with those expressed by the general population; regional differences in opinions were also analyzed.

This article looks at international trends in collaboration between businesses, public sector and social enterprises. In the first section the authors discuss benefits of implementing the pay‑for‑outcomes approach. The second section focuses on social impact bonds – a financial mechanism in which private investors pay for a set of interventions to improve a social outcome that is of interest to a government. The role of social enterprises as important partners of the public sector is also discussed. Due to the need for public sector reforms, a number of actions are being undertaken to improve the delivery of public services. New Public Management is one of the concepts that assumes the introduction of management methods and techniques modelled on the private sector into the public sector. In line with this new concept of customer management, service recipients are perceived not as supplicants but as customers. The aim of the article is to present the directions of changes in information flows in relations between public administration and economic entities related to the implementation of new public management. The article presents the basic assumptions of the New Public Management concept. Subsequently, the attention is paid to the types of information and methods of communication in relations of public administration with business entities. Electronic means are becoming one of the most important channels of information flow. The implementation of modern information and communication technologies enables electronic data exchange, creation of electronic documents, e-services and electronic access to information.

The contribution is focused on one of the most fundamental ethical values and principles applied in public administration environment – responsibility and personal accountability of public officials and administrators, who have to be liable and answerable for their deeds and actions towards certain community, regional or local, and towards general public as well. The introductory part deals with the explanation of two concepts in question, responsibility and accountability regarding the processes of making, guarding and managing agreements, decisions and expectations in any relations, covering the area of public administration from the ethical point of view. The theoretical contemplation takes into consideration teleological and deontological conceptions, followed by practical summary of the public administration accountability mechanism. Finally, the basic ethical aspects and accountability levels are dealt with, keeping in mind that inner and outer influences on administrators’ and public officials’ accountability are connected with their behavior and decision-making.

Purpose: The aim of this paper is to determine the factors that influence the process of implementation of risk management process into municipal offices across Poland. Methodology: The Polish Public Finance Act requires public sector entities to put in place a risk management system within the framework of management control. The author conducted in-depth interviews with key personnel responsible for risk management in public administration units. Findings: The results of the research show that public sector organizations face certain problems in the process of implementing a risk management system. Employees seem to resist change. As a result of the project, four factors that influence the process of introducing risk management have been identified. Implication: Public sector organizations are mostly large, bureaucratic organizations, governed by numerous regulations, which all in all tends to hinder efficient management. The results of the discussed research are to support public entities in the process of implementing change. Value: The paper explores the importance of overcoming barriers to the process of implementing risk management in the public sector.

Opis:

Cannabis is the most popular illicit drug on the European market. Over 16 million young Europeans have used it at least once in the last few years. The recent trends in the consumption of marihuana differ between countries. Some countries face an increase in the prevalence of cannabis use, including Poland, where the level cannabis use has been systematically increasing since the 1990’s. According to a recent ESPAD study, 19% of Polish adolescents aged 15–16 have used cannabis in the last year. Marihuana is also a leading substance when analyzing the data of seizures and crimes. The recent EMCDDA Annual report on the drug situation in Europe notes the increasing potency in cannabis available on the market. Some countries face an increasing number of emergencies caused by marihuana, which was unlikely to have happened previously. In almost all European countries there is an ongoing discussion about loosening marijuana laws or its complete legalization. There is also ongoing discussion on the use of marihuana in therapy as a medicine. Many scientific studies are being conducted in this field. Some of the results are promising; however, there is no well-designed human trial which would unequivocally confirm that medical cannabis is effective as a medicine, or more effective than other medicines on the market. The problem is that the debate on the medical use of marihuana becomes more ideological and less professional. The medical use of marihuana is strongly supported by organizations lobbying for the legalization of cannabis use. Research on the medical use of cannabis should be continued, as there are some promising results supporting therapy in different medical conditions. However, the use of cannabis as a medicine should be discussed only among professionals. If marihuana is to be used for medical purposes, the fact that it is the most popular illicit drug in Europe is irrelevant.

he author presents the importance of the new European System of National and Regional Accounts (ESA 2010) for statistics of the general government sector. She pays particular attention to the development of data for the excessive deficit procedure. The article explains the methodological changes made to the studies in this field parallel to the ESA 2010. It discusses, among others, issues related to defining the deficit and debt of the general government, as well as the determination of their personal and of the on a new way registering transfer of liabilities of pension schemes. It also presents the impact of new methodological guidelines for the relationship of deficit and debt to GDP in the Member States of the European Union. (original abstract)

Purpose – Identification of factors determining the effectiveness of public schools’ management, and the establishment of means for developing the concept of measuring the schools’ effectiveness.Methodology – Review and assessment of concepts and studies present in Polish and international literature pertaining to the evaluation of public schools’ effectiveness.Findings – The hitherto methods for evaluating schools are unsatisfactory. It is largely associated with ambiguous definitions of schools’ effectiveness and identification of objectives and tasks schools are to achieve and undertake, associated with it. This, in turn, results from the fact that effectiveness assessment may by defined differently by various stakeholders. However, the measurement of effectiveness is necessary due to the fact that it facilitates the emergence of high quality educational services in Polish public schools.Research implications – The review of literature indicates that the assessment of educational added value over the course of several years of education seems valid. This means that rather than tracking final results achieved by students, the growth of students’ knowledge ought to be measured. The Data Envelopment Analysis (DEA) method may be helpful in relation to the above. The method seems well-suited for evaluating the effectiveness of NGO sector institutions, and takes non-financial factors into consideration, which will enable methodologically categorized knowledge on the effectiveness of schools’ management to be obtained.Practical implications – Results of the present study may be applied by institutions supervising public schools and by individuals who manage these institutions in order to perform periodic assessments of schools’ effectiveness, and who would stimulate the education quality improvement.Social implications – Results of the present study may foster the improvement of schools’ competitiveness and improvement of their educational actions’ quality.Originality/ Value – The paper supplements knowledge regarding the assessment of Polish public schools’ effectiveness.Type of article – A theoretical paper.

Opis:

The aim of this paper is to analyze the information policy of selected central offices on the Internet. In the first part of the article the author defines the nature of information policy. Then the author intends to verify the following thesis: the central offices do not conduct a sufficiently effective information policy. This is due to the lack of systematic action, improper preparation of the content of the messages and the inability to cater to the needs of people with disabilities. The author answers the following research questions: whether the actions taken by the audited offices are in line with a specified strategy or just perform ad hoc actions; whether the information provided is written in intelligible, understandable language and if it is accessible to people with disabilities. Particular attention will be given to the content available on the Internet, in particular on the websites of central offices.

The article traces the development of the budgetary situation in Greece since the early 1990s and aims to identify the main causes behind the public finance crisis in this country that began in 2009 and continued in 2010. The author discusses the most important implications of the crisis for the functioning of the euro area. The period covered by the analysis was divided into several subperiods: the period of 1990-1995, which saw the continuation of an expansionary fiscal policy initiated in the 1980s; the period directly preceding the country’s entry into the euro zone Jan. 1, 2001, marked by an improvement in Greece’s budgetary performance; the years after Greece’s entry into the euro zone and the return of the fiscal expansion policy; and the period when the country was forced to launch budgetary reforms. Greece’s current public finance problems are not only a direct effect of the global financial crisis, but also an outcome of domestic factors, which led to persistent economic problems in the country, including the loss of financial stability and decreased competitiveness. The following factors generate high budgetary expenditures and limit revenue in Greece (consequently leading to a high budget deficit and an escalation in public debt): low administrative efficiency, high operating costs of the public sector (high employment and a high level of wages in the public sector), excessive social spending, an inefficient pension system, an overregulated labor market and excessive regulation on markets for goods and services. Greece’s public finance crisis was therefore primarily provoked by structural problems that were evident still before the country joined the euro area and that have not been resolved since then. According to Baran, Greece met the budget deficit criterion for adopting the single European currency only because the country’s government artificially increased its revenues and resorted to statistical manipulation. Meanwhile, budget expenditures increased steadily, Baran notes, and an interest rate cut after the country’s euro-zone entry enabled public borrowing at a lower cost as internal problems accumulated due to abandoned reforms. The result was an explosion of the budget deficit and public debt in 2009. Fellow EU countries have decided to provide financial aid to Greece to maintain the stability of the euro and avoid a situation in which Greece’s problems would spill over to other member states, the author says. According to Baran, Greece is struggling with what is the most serious public finance crisis in this country since it joined the euro zone and adopted the single European currency in 2001. The country’s unresolved structural problems are the fundamental issue that underlies the crisis. Greece scores poorly in terms of competition and product market liberalization. The Greek economy has a low level of competitiveness due to labor market problems, an inefficient social security system and excessive public-sector employment. As a result, the government in Greece collects insufficient revenue and has high public expenditures, Baran notes. Fiscal consolidation has been based on higher revenues and lower interest payments since the mid-1990s. Despite powerful arguments for a radical domestic adjustment, all reforms have been marked by controversy and conflict between the government and its social partners.

The article briefly presents the history of concealing the truth about Katyń, which in many ways affected the formation of such attitudes. Instead of providing clear answers, however, further questions arise: Which aspects of the plan to shape the Polish model of “homo sovieticus” succeeded? To what extent were civic attitudes of Polish intelligentsia and future generations of Poles shaped by this model? Are we already a nation or still or only a federation of families? Is Katyń “...only private mourning, or perhaps ... a national disaster”?

Celem artykułu jest próba określenia cech i zakresu nowej sfery publicznej, wskazania jej uczestników, a także implikacji wynikających z jej funkcjonowania. Główna teza opracowania zawiera się w następującym stwierdzeniu: nowa sfera publiczna umożliwia łatwiejsze zaangażowanie społeczne w kwestie publiczne i daje lepsze możliwości agregacji preferencji, co powinno skutkować większą efektywnością działania sektora publicznego. Pojęcie nowej sfery publicznej zostało zaproponowane w opozycji do tradycyjnej – mieszczańskiej, zdefiniowanej przez J. Habermasa. Jej najistotniejszą cechą jest wykorzystanie sieci Internetu, a w szczególności jego asynchronicznych cech do budowania więzi, grup zainteresowań i grup nacisku, wpływających na zakres przedmiotowy sektora publicznego.
The aim of this paper is to define the characteristics and scope of the new public sphere, indicate its participants, as well as the implications of its operation. The main thesis can be summarized in the following statement: the new public sphere facilitates involvement in public issues and provides better opportunities for preference aggregation, which should result in greater efficiency of the public sector. The concept of the "new public sphere" has been proposed in opposition to the traditional, bourgeois public sphere, defined by J. Habermas. Its most important attribute is that it uses the Internet, in particular its asynchronous features, to build relationships, interest groups, and pressure groups, influencing the scope of the public sector.

Small municipalities, rural and urban, constitute a quarter of the total number of municipalities in Poland, and they are inhabited by about 6 percent of the inhabitants of the country. Similarly to larger units, they have a broad range of competencies, comprising their own tasks – aimed at satisfying the collective needs of the community, as well as commissioned tasks – related to the government administration, including the organisation, preparation and holding elections and referendums. Irrespectively of their size, all municipalities are obliged to realise public tasks. For NIK, the inspiration for this audit have been the analyses which show that small municipalities deal with numerous problems affecting their development opportunities and, consequently, affecting the lives of their inhabitants.

The opinion presents the subject of the dispute and the judgment in the case C-187/16, the comparison of legal and factual situation related to that case with measures proposed in the governmental Bill as well as assessment on the significance of this judgment for further work on this Bill. The state of law being assessed in the case C-187/16 is comparable to measures included in the governmental Bill. The main difference is that Osterreichische Staatsdruckerei is a private company, whereas the company mentioned in Article 17 of the bill shall be a company wholly owned by the State Treasury. Therefore, in the author’s opinion it is possible to encompass production of given documents by the exemption provided in Article 12 para. 1 of the Directive 2014/24, but under additional conditions. If the Company is not considered an entity covered by this exemption, invoking the need to protect essential security interests of the state would require supplementing the grounds of the Bill by taking into account the position of the Court of Justice in the judgment C-187/16.

In this draft position the author claims that Article 284 para. 2 of the Act on Public Finances imposes a disproportionate limitation on the constitutional right to public information and leads to violation of the essence of the right to information, and that the procedure for limiting access to the information provided in the contested provision does not comply with the requirement of proportionality, because is not able to improve the reliability and efficiency of the internal audit. He points out that the provision in question is incompatible with the appropriate provisions of the Constitution, as the documents produced by the internal auditor, as referred to in the examined article of the Act on Public Finances, do not form public information.

Public space is an important element of urban structure, playing various spatial, social and economic roles in towns/cities. Its quality influences the quality of life of the inhabitants and the attractiveness of the town as a whole. Public space located in town center is the most representative of its identity and image, and also serves multiple functions and activities. The quality of urban space depends on different factors, which have been discussed in professional literature for the last few decades. The author of this paper developed a model for assessment of the quality of public space in town centers based on studies of methods already used in Poland and abroad, and the analysis of trends and ideas which should be taken into consideration while constructing a set of criteria for assessment methods. The main goal of this paper is to present the methodology of research on the quality of public space in town centers using this model. An important element of the model is the proposed method of delimiting the research area – the town center – based on identification of key public space of a town. The model comprises three methods, which can provide valuable information on the quality of public space, and also serve as a basis for constructing ratings of towns in each of these methods and the model as a whole. The research conducted using this model in chosen medium-sized towns of the Łódź region showed that the results of ratings obtained using particular methods and the whole model coincide with subjective opinions on public space in town centers given by its users and professionals evaluating it.

Opis:

The accession of Poland to the European Union influenced Polish Public Procurement Law significantly. But Poland proved to be a quick learner and created Public Procurement System, governing not only public procurement sensu stricto, but also the award of concession contracts and Public-Private Partnerships, despite of the fact that rules concerning concession contracts and PPPs were absent at EU level. Thus there is no room left for legal uncertainty or any distortions in the functioning of the public procurement market in Poland. But after ten years Public Procurement System in Poland is still changing and will be a subject to major amendments during next two years.

The purpose of the article is to implement the characteristics of the administrative contract as a component of the system of public administration tools. It is determined that the system of tools for the implementation of functions by public administration bodies must meet the requirements of efficiency of settlement of management tasks, mobility of implementation of management decisions, accessibility of administrative procedures, and openness of regulations and administrative acts. The system of tools of public administration includes decisions, actions or omissions of public authorities and local governments, which have fundamental legal significance and consequences for individuals. It is emphasized that the implementation of the concept of «good governance» must comply with the democratic principles of building the rule of law, the achievement of which requires the use of the system of tools defined by current legislation. The components of the system of public administration tools include bylaws (actually identifying them with regulations), administrative acts, administrative agreements, administrative acts and acts-plans. The normative-legal character of the administrative agreement is determined, which to some extent identifies it with the normative acts of the subjects of power, emphasizing the bilateral and multilateral nature of such relations. It is substantiated that administrative contracts have similar features that are similar to other instruments of public administration, in particular, the need to conclude them in accordance with the established procedure, aimed at satisfying subjective public rights, and so on. It is established that the distinctive features of an administrative agreement are its voluntary nature of adoption, bilateral and multilateral nature of the regulation of public relations, and one of the parties to the agreement is always the subject of power. It is concluded that in the implementation of administrative- contractual relations there is a situation of legal equality of its parties, so the mechanism for ensuring its implementation is specific. It is concluded that an administrative agreement is a public accession agreement, the content of which is the implementation of management functions related to the provision of public services, ensuring the efficient use of public property between the subject of power at the initiative of a non-governmental entity. It is substantiated that in the current conditions in order to ensure the availability of legislation, as well as to avoid the situation of emergency accumulation of an array of regulations, it is proposed to supplement the draft Law of Ukraine «On Administrative Procedure» with the following provisions: «administrative contract implementation of management functions related to the provision of public services, ensuring the efficient use of public property, concluded between the subject of power at the initiative of a non-governmental entity.

This paper tackles staff problems of contemporary public administration. It starts with an analysis of the dependence between the efficiency of administration and the effi ciency of public servants in administration, whose efficiency depends on the level and quality of their qualifications. The analysis was carried out in three perspectives (i) with regard to the whole public administration of the State, (ii) with regard to the State and government central administration and (iii) with regard to regional public administration, on the example of the Lower Silesia region. It was assumed that the quality of the staff in administration is related to and depends on the legislation regulating the recruitment for public administration offices. The relevant provisions determine the choices made in the recruitment process and the subsequent creation of career paths. However, unstable and poor legal provisions have a negative impact on the quality of public administration personnel, which is manifested in poor performance, high employment fl uctuations and a diminishing interest among the younger generation in a career in public administration. This, in turn, may distort the natural generation exchange of administration staff in the future. As can be seen from the statistical analysis conducted in respect of the numbers of public administration employees and the fluctuation among them, as well as the demographic structure examined with regard the gender, age and length of employment, the initially assumed hypothesis of the negative consequences of the inconsistent legislative policy governing the regulations of the public administration staff. The sociological picture illustrating the attitudes among the members of the society to public administration confirms the hypothesis of the poor condition of public administration and a loss in confi dence in its activities or actions. The main reason for the current situation is that the constitutional principle of the neutrality of civil servants is realised only by orders that prohibit combining civil service with political activity, but do not limit or reduce the strong and direct influence exercised by political parties on the legal regulations within public civil service or the policies of appointing candidates to key administrative positions in (not only government) offices.

In the context of democratic discourse, civil society is given a decisive role in the formation of power and influence on power. However, between the authorities (state and self-governing) and public organizations, as representatives of the interests of civil society, mostly subject-object relations are established, where the subject is the government. The article is devoted to finding an answer to the question: can the model of subject-subject relations between the government and civil society, where both social institutions are equal participants in the political process, have practical application? Analysis of social changes in Western Europe and Ukraine gives grounds to support the point of view of those scholars who consider civil society the basis of the state, a factor that gives a specific character to each state formation, regardless of the generality of democratic processes. At the same time, attention is drawn to the heterogeneity of civil society, which is a barrier to its consolidation and strengthening of subjectivity. There is a noticeable increase in competition between the state and civil society in terms of influencing society, as well as the manipulation of public movements by public authorities to achieve political goals. However, a fairly high level of public confidence in public organizations and the potential for their advocacy allow the use of public influence to activate the population and strengthen the position of civil society in relations with the authorities.

The subject matter of the commentary focuses on the issue of the functional and grammatical interpretation of the notion of ‘a person perform-ing a public function’, which, in the author’s opinion, does not directly refer to the public offi cer referred to in Article 115(13) of the Act of 6 June 1997 Penal Code. The author highlights the unjustifi ed perception of a person performing a public function by the Polish justice system as being viewed as a public offi cer as defi ned in Article 115(13) of the Penal Code. The main arguments focus on the risks arising from an overly broad in-terpretation of the concept of a person performing a public function. In fact, the lack of a defi ned set of persons performing public functions may give rise to a malfunction on the part of the entity obliged to make public informa-tion available, and thus to the constitutional principle of limiting the right to public information on the grounds of privacy.The fi nal part of the commentary is a refl ection on making public infor-mation available under the provisions of the Act of 15 July 2011 on Control in Government Administration, and a starting point for a broader discussion on the need to amend the current legal system.

The Development of public media in Latvia as a post-communist country has essentially been influenced by politicians. The political community has had consensus that certain reforms are necessary to ensure the development of public media given the changes in the communication space and its role in the facilitation of the strengthening of democracy, yet during the last fifteen years the political elite has not been able to come to a common agreement and to make decisions on systemic reforming and the development of public media. Since the communication environment has changed post digitalisation of television, the question about public media development and legitimisation has become increasingly topical. The aim of the study is to explore how the members of the parliament of Latvia (Saeima) position public service media (PSM) in Latvia and assess the public value of PSM. The theoretical framework for the research is based on the concept of public value „strategic triangle” (Benington & Moore 2011), which consists of three main elements: public value outcomes, the authorising environment and operational capacity. The study is based on qualitative research methods including 18 semi-structured interviews conducted with members of the Saeima in 2012 and 2013. The acquired data has been analysed by the principles of thematic analysis (Attride-Stirling 2001). Analysis of the interviews show that members of the Saeima recognise the need for public media to be independent whilst at the same time supporting a model in which public media is not supposed to have independent funding and they will continue competing with commercial media in the advertising market. High competition and resentment are characteristic features of the political elite in Latvia that apparently would also in future hamper the making of such decisions about public media that will facilitate their high-quality. Results of the research show the tendency for members of parliament to lack the necessary knowledge to formulate their opinion and to modulate relations of public media with society and their place in the overall media system in Latvia.

The subject of the publication is a description of water services institutions. This is a new institution under the Water Law, which came into force on 1 January 2018. Its introduction was the result of the implementation of the Water Framework Directive into Polish law. According to the definition of the Act, water services consist in providing the possibility of using water in a wider range, e.g., water intake, or discharging wastewater above a certain amount. Water services are provided to all who have a need to use water to such an extent. They are universal. They are also paid for. The method of determining the amount of fees, fines and possible execution are regulated by law. The fees are paid to the State Water Holding – Polish Waters. This entity is to operate water management in Poland from 1 January 2018. Water services are an example of public services, the provision of which is one of the basic tasks of a modern state of Western civilization. They are also a new form of water management in Polish law.

Opis:

Subjective judgment of the prosperity in Poland does not become better despite a constant economic growth. CBOS (Centre of Public Opinion Research) researches show that for Polish people (97%) health is the most essential matter and that 75% persons are dissatisfied with the health service activity. Even only these numbers let observe the lack of the public prosperity optimization in Poland. Public utility services are personal, so they affect directly a feeling of the well-being. Undoubtedly, the quality of the services mentioned affects positively or negatively the prosperity of the whole population. A possibility of a public utilities evaluation in five dimensions has been shown in this paper: (1) in a professional dimension, i.e. efficiency; (2) in an economical dimension, i.e. productivity; (3) in a process-wise dimension, i.e. TQM; (4) in a personal dimension, i.e. consumer satisfaction; and (5) in a social dimension, i.e. public prosperity improvement.

This statement provides an account of an eventful period in the recent history of Polish social dialogue (2001-2005). The author shares his experiences and reflections from the time when he served as the Minister of Labour and the Deputy Prime Minister, as well as the head of the Tripartite Commission for Social and Economic Affairs. The statement heavily relies on the author's book 'Loops of development' (Pętle rozwoju) published in 2007. The author argues that while structural reforms are inevitable in societies in transition, such as Polish, they should be introduced with caution. The role of public institutions and their viability is also stressed out. As the author claims, social dialogue, albeit of undeniable value, is prone to serious deficiencies, especially, if it retains a specific corporatist profile (that is, supporting special interest groups), which was the case in Poland in the early 2000s.

This article presents the material scope of public safety and public order in the context of the Polish police jurisdiction. The considerations are based on the assumption that safety, as one of the social rights, is an inalienable human right while human rights are the product of moral and political agreements between people. When attempting to define the material scope of the notions of "public safety" and "public order", it should be noted that both in the process of making and applying the law and in the legal literature, the use of the term "public safety and order" has been accepted. Nevertheless, the concepts of public safety and public order are not unequivocal. The relevant literature presented in this article is dominated by approaches that define both public safety and public order as a desirable state. Most often, public safety is related to the functioning of the state and its citizens, while public order refers to a narrower sphere of complying with norms and maintaining the efficiency of public institutions . Both concepts are of an administrative nature, i.e. they are concerned with issues related to the implementation and observance of regulations in force in a given country. Public order, just like public safety, is also a certain internal condition of a state, as no organised community can allow its members to exercise their will without any restrictions. Rules governing the conduct and coexistence of community members are defined by appropriate norms, such as customs, moral and religious principles or legal norms, all of which are subject to permanent changes, which in turn makes it necessary for the institutions established to protect public order and safety to adapt by systematic improvement of their organisation in the functional dimension.

The Constitution of the Republic of Poland guarantees each person the freedom to organise and to participate in peaceful assemblies. This liberty may be restricted by a dedicated act. The principles of conduct in the case of gatherings are regulated by the Act on Assemblies of 5 July 1990. In view of the above, the assumption that public gatherings are a special case of public congregation was adopted as the basis for the considerations presented in this article. The paper outlines a number of determinants affecting the safety of participants of public meetings, which will be both positive and pejorative in nature. The research conducted indicates that the participants of these assemblies will be subject to the influence of the assembly and aforementioned assembly will be influenced by them. All the more so since a public meeting is a gathering of people with a high power of interaction. The analyses and assessments carried out point to the significant role of state institutions in ensuring the security of public assemblies, which, in addition to their organisers, carry a huge burden of responsibility on their shoulders.

Opis:

This paper deals with public consultations, which are a form of direct democracy. The assumptions of such consultations were discussed from the theoretical and legal perspective. In the theoretical approach, an attempt was made to determine the direct democracy features and its relationship with the idea of local government well as understanding public consultations. Provisions of the local government l and by-laws were analysed from the legal perspective. Public consultations also h a wider context, which is determined by public participation and a new philosophy of government. The object, consultation involves not only consulting the public about a specific document, but also a comprehensive approach to cooperation with citizens.
