One of the main human goals is to achieve the state of happiness. Almost all people ask themselves the question of how to attain this goal. For thousands of years, philosophers and spiritual leaders and, nowadays, researchers representing various disciplines of social sciences, have been searching for the right answer to this question. One of the dilemmas intertwined in the debate about the essence of happiness relates to the tension expressed by the question “to be or to have”; the tension between the spiritual and the material world; between sacrum and profanum. Can accumulation of money and material possessions make us happy? Starting with the message passed on by a German psychoanalyst Erich Fromm in his essay “To Have or to Be” and the wisdom derived from the classic philosophical and religious works, I will attempt to define the relation between the state of happiness and the attachment to money and possessions or the attachment to social and transcendent values. This difficult, yet crucial, problem will be analyzed in the context of the current psychological knowledge related to the emotional and cognitive consequences of taking a materialistic approach to life. Erich Fromm and other thinkers who had lived hundreds of years before him, suggested that greed and pursuit of material possessions did not appease the human longing for happiness. The latest experimental research, conducted by psychologists, economists and scholars representing other disciplines of science, seem to strongly confirm these assumptions.

The article presents the problem of cheating in Polish schools. 1,070 students of high schools were examined. The aim of the research was to establish relationships between amotivation, external motivation, introjected motivation, motivation based on identification and internal one, and cheating, help to cheat and reluctance to help to cheat. The results show that amotivation, introjected and internal motivation are predictors of cheating. Only the external motivation turned out to be the predictor of help to cheat; on the basis of internal motivation it is possible to anticipate reluctance to help to cheat.

Since the dawn of time people have felt the need to protect their private lives. Contemporarily, the right to privacy remains one of the basic human rights. There are very few voices advocating that an individual shall be deprived of a possibility to keep any information about them in secrecy. Such views receive strong criticism as the majority of social groups and circles is likely to accept some constraints only due to the necessity to provide safety to communities. However, the issue whether other living creatures are entitled to be granted with the right to privacy does not remain a widely discussed matter. First signals pointing to the fact that functioning of animals may result in establishing some sorts of private spheres by them date back to as early as a few decades ago. They did not, however, bring about any wider interest whatsoever. Several years ago Brett Mills, Ph.D. raised the aforementioned question with regards to the manner in which the groups producing wildlife documentaries operate. His position stood up against strong opposition from numerous environments and backgrounds, including such ones acting in favour of animals. Animals’ right to privacy remains an interesting issue and ought to be analysed in a more profound manner. My article aims to present in detail the issue of animals’ right to privacy with special emphasis put over physical distance and the right to be let alone.

What does an actor do in a biographical film? This question may seem inane, or at least less than serious; however, the terms frequently used to describe and assess the actors work in general - to embody a character, to play them, to play a role - suggests the existence of a certain designatum, which is the point of reference for the role. In the case of a fictional story, we may ignore the semantic multivalence of such terms. In a biographical film, however, the existence of a real originator of the role gives additional, almost ontological meaning to phrases such as “embodying a character” or “playing a role”. In my reflections, I use as my starting point the assumption that the actors performance in a biographical film and the “conception of a character” result from two basic components: 1. Interpretation of the role - constituting a proposal to analyse the heros character. It is usually supposed to extract more profound meanings and senses out of the biography. To put it more simply, the interpretation of the role is supposed above all to help the viewer to answer the question of who the hero was (what they were like) and why? 2. Adaptation - this includes the physicality of the character: their appearance, body language, facial expressions, voice (the tone, modulation, accent, phrasing, dialect - if the authentic person used one, etc.) In my article I try to answer the questions: Where should we seek the essence of biographic acting? How can we avoid exaggeration and falsehood, which could kill the role?

One can note that the issue of children rights has always been topical and while there is still plenty of complex topics to be studied, the author yet invites to return to the basics of the child’s rights, and in particularly, to the need to protect the child’s identity as a legal value. The purpose of the article, therefore, is to clarify the meaning of the child’s right to identity enshrined in the international, and in particularly, the 1989 Convention on the Rights of the Child, and according Latvian legislation. With the assistance of a descriptive method in conjunction with a historical method the article marks the historical events of the last quarter of the 20th century leading to formation and contemporary understanding of the right to identity. Historical remarks are followed with a smooth transition into the analysis of the international and Latvian legal framework. The used sources among others include a number of international, European and Latvian legal acts, as well as accessible interpretative manuals, monographs, comments, transcripts and other sources for a better understanding of the contents of the legislation. The named analysis has been performed with the use of legal comparative, systemic and analytical research methods.

While the existing literature focuses on analyzing individual hedges and comparing their use by native and non-native speakers, little attention has been paid to the teaching of conversational hedges. Research reveals that despite their pervasive nature in spoken discourse, hedges are regarded by teachers as ‘verbal garbage’ (Schiffrin 1987), not worthy of teaching. The aim of this study is to investigate college teachers’ perceptions of hedging devices in spoken discourse as well as their attitudes to the teaching of hedges. A questionnaire was administered to elicit the teachers’ responses. The results indicate that college teachers are aware of the significance and usefulness of hedges in spoken discourse; nevertheless, they have doubts about the value of teaching them. The paper will conclude with a discussion of the pedagogical implications of these findings.

This paper aims to briefly describe the two types of strategies (strategic orientations), namely: play-to-win (PTW) and play-not-to-lose (PNTL) as well as to propose some tools for their operationalization within the framework of public management by local governments at county level. The PTW strategies are related to offensive approaches and benefiting from emerging opportunities – they can be defined as “results oriented”. The PNTL, are defensive, based on the current (or even historical) standing of an organization – they can be defined as “survival oriented”. Some examples of possible applications and management tools of the PTW vs. PNTL thinking to the situation of local governments will are described. These tools may be helpful in identifying the specific approach in strategic thinking of local governments. The analysis of the two approaches is of particular importance for the measurement of intellectual capital at county level. The PTW vs. PNTL implies the type of investment decisions and budgetary spending policies as well as attitudes and behaviours promoted locally.

Make-To-Stock (MTS) and Make-To-Order (MTO) are the two traditional strategies in production management. In the case of the MTS there is a growing demand for a new approach, which is called Make-To-Availability (MTA) strategy. The paper characterizes and compares the MTS and MTA strategies. The comparative analysis based, among others, on computational experiments carried out in a computer program developed in Microsoft Visual Studio 2017 Environment was presented. The models have been prepared for both strategies with the same assumptions: external conditions (market demand) and internal conditions (structure of the production process). The investigation of how the strategies respond to various scenarios of demand intensity was done. The simulation models were prepared and validated for the case of the production line in one of the industrial automation company. The research shows that the use of the MTA strategy in the majority of cases gives much better results than the use of the MTS strategy due to the minimization of storage costs and the costs of non-fulfillment of the customers’ demand. The directions for further research were also presented.

The author begins with noticing an apparent absence of the problem of faith in the twentieth-century philosophy and its surprising return at the end of this century, notably in Gianni Vattimo’s and Julia Kristeva’s works. By creating a kind of dialogue between Stein’s phenomenology and Kristeva’s psychoanalysis, the author analyses the concept of faith from those two apparently distinct perspectives. In the discussion of Stein’s attitude recalledare her personal experiences as a philosopher along with her claims on faith as a foundation of knowledge of God, supplied by love and acting. From Kristeva’s point of view, far from the former one, the need of faith is a result of specific ‘going beyond oneself’ that is necessary in a process of forming one’s personal identity. While Stein believes in God, Kristeva believes in man.

For years, publishing the results of archaeological studies has given rise to multiple controversies. A rapid growth of the number of examined sites and discovered monuments has long ago exceeded the intellectual productivity of researchers. Museum storerooms are brimming with piles of boxes containing invaluable monuments without any chances for publication. The only opportunity for archaeologists to quickly issue the research results is to change the organisation of investigations and the principles of conducting work, predominantly to modernise the methods of documentation. Suitably performed and skillfully illustrated work should become, immediately after its completion, material for pertinent publications. Such an attempt had been made two years ago in Gdańsk by a team from the Institute of Archaeology at Warsaw University, while examining the area of the Dominican Centre. The two volumes have become the source of enormous satisfaction among researchers dealing with the history of Gdańsk, although they were also criticised for workshop shortcomings. At the same time, the very sense of socalled rapid material publications was questioned. The purpose of the presented text is to defend the idea of rapid publication, with the initial premise being that the fundamental duty of every archaeologist completing his excavation work is to publish its outcome before he embarks upon successive research.

Purpose: This study is a contribution to the validation of the Motivation to Lead (MTL) scale proposed by Chan and Drasgow (2001) in order to measure three types of motivation to be a leader: affective, social-normative and calculative. This research examines the psychometrical properties of the MTL scale in the Estonian context. Methodology: The sample of 517 military and non-military individuals from the Estonian Defence Forces, Estonian Police and students from Tallinn University participated in the study. The original MTL scale was expanded by with the addition of ideological and patriotic dimensions proposed by Amit and colleagues (2007). The factorial structure of the MTL Scale was analysed by using exploratory and confirmatory factor analysis (respectively N = 170 and N = 347). Findings: The results confirmed that both three- and five-component MTL scales are applicable in the Estonian context; the pool of 35 items was reduced into 25 items with good internal reliability. Moreover, the results showed correlations between leadership self-efficacy and MTL components, and differences between leaders’ and non-leaders’ MTL. The results indicate that the MTL scale can be a reliable and useful instrument to measure leadership motivation in the Estonian military context. Originality: This study is the first to adapt the MTL scale to the Estonian context. In addition, it examines the validity of ideological and patriotic MTL as part of the general MTL construct outside of the Israeli samples.

Ojciec opowiada się za ludźmi prostymi. Objawia im więź istniejącą między Nim a Synem i jednocześnie zakrywa ją przed pychą uczonych (11, 25–27). Ojciec powinien spotykać się z bojaźnią ze strony ludzi, ponieważ rozstrzyga o ostatecznym losie człowieka. Wzmianka o możliwości definitywnego odrzucenia przez Ojca zostaje złagodzona Jego troską i wiedzą o każdym szczególe życia człowieka (10, 28–31). Z faktu, że Bóg jest Ojcem, wynika powszechne braterstwo łączące uczniów, które nie ma nic wspólnego z jakąkolwiek formą zależności. Uczniowie są bowiem zależni jedynie od Ojca w niebie (23, 9).
The Father advocates the simple and humble. He reveals the bond between Him and the Son, and at the same time hides it from the pride of the scribes (11, 25–27). The Father should meet with a respectful fear of the people because He ultimately decides on the fate of man. The note of the possibility of definitive rejection by the Father is mitigated by His care for and knowledge of every detail of human life (10, 28–31). From the fact that God is the Father can be derived an apparent common brotherhood that connects disciples which has nothing to do with any form of dependency. The disciples are only dependent on the Father in heaven (23, 9).

The quest for and the discovery of the meaning of life, so basic to human existence, play a fundamental role in the process of self‑discovery, that is, in the examination of our own identity, subjectivity and the “self”. Underlying this quest are not merely vague approximations to what man is, but clear fundamental dimensions of humanity: freedom and responsibility.Etty Hillesum and Victor Frankl, take different perspectives on the meaning of life of a person who experiences himself, the world, others and God in the face of war and extreme circumstances (Etty perished in Auschwitz, Frankl survived the concentration camps). However, they both point to the universal trait of the utmost engagement of the will and the assumption of responsibility for one’s life, despite the inevitability of death and the prevalent “cultural hibernation”.In both analyses, freedom appears as a response to reality, to the here and now. That response, as such, means taking responsibility for reality and its shape. Hence it an important question to ask would be what it means to take control of one’s destiny. Is it an obligation, a task, life’s demand, or perhaps just submission to what life may bring? Freedom, which is constantly threatened, must fight for itself. This happens owing to the will to live, which first evokes meaning and then the obligation of taking responsibility for oneself, for others, and even for God himself.

The paper presents the testing results analysis of the bullet-, knife-, stab- and needle-proofness in the aspect of material applied into the inserts for the body armour, manufactured according to the needs of Police officers as well as an individual orders. The PN-V-87000:1999 Polish Standard does not include the stab resistance tests. Therefore the following documents have been used as the basis of this type of tests: NIJ 0115.00 US Standard; PBB-08 test procedure of the MORATEX Institute - "Stab resistance of personal body armour", comparable with the NIJ 0115.00 Standard; PBB-06 test procedure of the MORATEX Institute - "Samples resistance against military knife type 92" developed on a basis of the Standard Body Armour - Part 2: Stab resistant vests (ISO/DIS 14876-2:1996). The summary of presentation shows: the projectile impact energy; the depth of projectile penetration for the samples of protective inserts for the tests used.

In his process of development, man cannot dispense with such principal values as truth, good, justice, beauty, freedom or happiness. It is, among other things, pedagogy which speaks about that which represents each value. It says how to gain values in human life, and classifies them. It proves that some of them are authentic, others are often seemingly good, and there are also relative values. Thus the whole formative process tends to work in a pupil an ability to make a choice of that which is best among variously understood proposals. The formative process aims at a harmonious integration of the chosen values in a concrete, personal life of man. Pedagogy is thus axiologically oriented, i.e. towards values. The pupil will sooner or later be confronted with the questioning of the principal values. He will face a belief that values are essentially subjective. The man who is incessantly confronted with apparent values, must in the formative process, to which he is subjected while at school, in his family, or in another social setting, face a clear concept of absolute values, fully comprehended by him. This is linked with his aspirations to reach the top of his potentialities, of which he is aware or not. And this is nothing but putting into practice of the plans of God the Creator He has in relation to His creation. For man cannot consciously tend towards his aim which ends half way. He may not gain the top, yet he should not lose sight of it. The formative process is to serve for this end, and this is the topic of the present work.

At the beginning of the 1990s Poland, like the majority of the Central and East European countries (CEECs) undergoing transformations, overcame its initial distrust and began to recognize that the only path to regional stability and national economic growth was economic integration. The Central and Eastern European Free Trade Agreement (CEFTA), signed by the Czech Republic, Hungary, Poland, and Slovakia on 21 December 1992 in Cracow, provided for the elimination of a number of trade barriers and the growth in commercial exchanges between the signatory nations, aimed at facilitating their integration with the European Union at a later stage. This article constitutes an attempt to assess the main effects of the implementation of CEFTA on the functioning of its member states as well as their further integration as Member States of the EU. It also presents the main provisions of the modernized CEFTA 2006, and the current problems related to implementation of the agreement. It also discusses the opportunities and prospects for Croatia, as a former CEFTA member state, upon its scheduled accession to the EU in July 2013. This article is intended as an introduction to further and deeper analysis in this area.

The aim of the study is to present a concept for researching the production-for-inventory environment. The article focuses on the comparison of two production stockpiling environments, namely that of Make-to-Stock (MTS) and its developed version, Make-to-Availability (MTA). The article also presents research concepts related to the evolution of the MTS environment. The article presents the characteristics of production for inventory and for availability, while the matter of maturity models is also presented and a gap in the research is identified. The target and scope of the research is defined and the research program is discussed, and the research methods used at individual research stages have been identified. The status of the level of advancement of the research is presented,as are conclusions from previously undertaken research as well as further directions for this research, recommendations for the future, and the expected results of this work. The synthesis of the research will be to propose a maturity model for organisations functioning in the MTS / MTA environment.

The conceptual approach to real social phenomena and problems, as well as factors influencing and shaping them, although theoretical in nature, has momentous practical consequences. The issue of nature, and in a narrower sense of climate, constitutes a telling and representative example of the implications of the theoretical and methodological orientation adopted to study society and its relationship with the environment and its resources. This short paper aims to highlight the consequences of the shift in research perspective from ‘political economy’ to ‘political sociology’ in the context of climate change and its challenges. The article’s main argument is to outline the implications of the change of reference point for the conceptualisation and operationalisation of theoretical frameworks related to social problems and challenges, which, nota bene, are conditioned directly and indirectly by the state of the ecosystem. And the central thesis is that a fundamental reorientation towards nature and climate change within the dominant capitalist system will only be camouflaged maintenance of the status quo (accompanied noisily by a series of technological and fiscal solutions that solve nothing).

Waterland (1992), directed by Stephen Gyllenhaal on the basis of the screenplay by Peter Prince, is a film adaptation of Graham Swift’s novel under the same title, published in 1983. The book could be called unfilmable although the history of cinema knows examples of successful screenings of apparently unfilmable novels, e.g., The French Lieutenant’s Woman. In the case of Swift’s novel, the main potential difficulties could be seen in its wide scope, its intricate mosaic character, and its style. The article analyzes the changes introduced in the adaptation, including the shift of the contemporary action from Greenwich, England to the American city of Pittsburgh. The way of connecting the present with the past by means of “time travel” is discussed. Consequences for possible interpretation resulting from omitting certain elements of the book and introducing new material as well as changing the order of presentation of some of the scenes are shown. Comments on the film are juxtaposed with interpretations of some aspects of the novel taken from key critical texts on Swift’s book. Also specifically cinematic solutions present in Gyllenhaal’s movie are taken into account.

Who is man actually and in essence? To this question differently answer the various personality dominants and world outlooks, expressing themselves, in truth, in different life styles and thus revealing the complex multifariousness of human existence, and yet, on the whole, taking into account the autotelic, non-instrumental, unlosable and common to all individuals value — identical since non-produced — perhaps best describable as a personal (supraparticular) human dignity. On this how far that value, within various thinking and acting systems, will be appreciated and affirmated, namely in such or other type of internal and environmental culture, will depend the future of the humanism idea, and even its full and adequate understanding, leading towards mutual respect, tolerance, and common assent to the right of differing in opinions and actions based on this exactly unlosable and immovable fundament, which is human dignity. Neither under the sign-board “homo faber” nor „homo ludens” there is a rescue for mankind: the productivistic and psychodelic mentalities are both infected with the same phisicalism, cutting off man from others’ subjectivity and from his own. The very humanization of man’s world is its re-personalization : instead to reificate the human world one ought to restore to things — even those inanimate — a full spiritual, interpersonal sense.

Readiness to learn to read must be shaped at the level of preschool education. One of the innovative methods of teaching pre-school children to read is the natural language teaching method developed by Wenda Pye. The programme consists in the teaching of listening, speaking, reading and writing using games and creative activities. The learning process is accompanied by children’s creative activity. Therefore, the natural language teaching method is perceived not only as the process of language learning but also, and most importantly, as educating through language, where language is both a means of communication and a thinking tool. The concept is based on the belief that child’s language is a specific phenomenon determined, on the one hand, by natural child development and, on the other hand, by child’s interactions with the environment. Consequently, child’s language education should be enhanced by a subtle help from an adult, who – by the use of provocation, arrangement and gentle encouragement to take actions – opens up a new, unknown space to the child, i.e. the world of writing. Language plays a role of a factor that integrates various fields of knowledge and different types of child’s activity in reality perception and acquisition. Natural situations used in the teaching of reading, which create occasional educational situations, inspire the child and simultaneously introduce him into the world of writing. Thus, learning to read should be accompanied by learning to write. The discovery of new values that the novel language of signs has with regards to information acquisition increases child’s motivation to verbalise his own thoughts and to learn to read and write. Emotional engagement facilitates memorizing a story or new vocabulary. It sensitizes the child to the graphical, phonological and semantic dimension of a given word by making a direct link between the graphical representation and the sound. A point of departure for natural language teaching is a short and simple text and illustrations that highly relate to it. Texts form stories included in little books entitled “Sunshine Library”. There is a series of 40 books designed for pre-school children self-study of reading. The books are graded at four levels of difficulty. Didactic aids used in the series are very well organised and introduce already consolidated semantic structures, providing new contents regarding language competence at a slow pace. Each book is composed of three stories. Typically, the first story includes one text with carefully selected new language structures. The following two stories serve the purpose of material consolidation. The essence of the books are pictures, which should be in line with the text because the basis of reading is to associate an image with its graphical representation. The print used in the books is large, legible, the words are clearly separated, and every sentence starts with a new line. The stories are simple and presented with repetitive sentence patterns. Natural language teaching develops and deepens child’s natural willingness to speak, read or draw graphical symbols. Speech is here not only the foundation of child’s expression and learning to read and write, but also a support for child’s paralanguage activity. The article presents the use of the natural language teaching method in pre-school children education.

The author researches the issue of love in Thomas Aquinas´s Summa Theologiae. He researchs the possibility of upbringing for love, and from what point of view this education is needed. The author concludes that the concept of love is quite different in the Summa Theologiae. In the context of Aquinian ethics, virtue points out that friendly love, as a unique phenomenon of human beings, is not necessary and therefore not only permits but also requires it to be developed through education.

Opis:
Preparation for learning to read and write in the first grade of elementary school is an important factor that co-determines success both in learning and in the future adult life of every human being. In one of her former studies (Olechowska 2005), the Author of the article showed that children who started learning to read and write when their phonematic hearing was not fully developed had poor results in acquiring these skills and – what is more – their results got worse over time in the early years of elementary school as compared to their peers without such difficulties. The conclusions from her former studies not only confirmed the findings of research conducted worldwide (Matthew Effects, Stanovich 1986), but they also justified the need for further research whose findings could help better prepare children for learning to read and write in school. In this article, the Author ponders over selected factors that can contribute to children’s difficulties in learning to read and write in school based on analyzing her observations of activities for five-year-old children in selected preschools. Based on this analysis, she divides exercises done by children in terms of the (specific and nonspecific) components of readiness for learning to read and write that were distinguished by G. Krasowicz-Kupis. She also points to possible sources of children’s future difficulties in reading and writing that lie in a significant imbalance in language exercises in terms of the individual components and in some other factors noticed during her observations. Research tasks and analysis of the material in the light of contemporary knowledge were to help to better identify possible areas of critical importance for preparing final year preschoolers for reading and writing. The conclusions formulated made it possible to point to the need for taking specific preventive actions within the scope of the problem under study.

Artykuł analizuje możliwość potraktowania postanowień Karty Praw Społecznych Rady Europy jako standardu określającego minimalny poziom ochrony uprawnień socjalnych w skali kontynentu europejskiego. Uprawnienia te są analizowane jako element obywatelstwa europejskiego. Brak jednolitej koncepcji obywatelstwa UE sprawia, że poszczególne państwa członkowskie EU nie realizują wspólnego modelu przestrzegania praw socjalnych. Taka sytuacja sprzyja interwencji unijnych i krajowych organów wymiaru sprawiedliwości, albowiem stosowanie w praktyce trzech różnych standardów ochrony praw społecznych a limine uzasadnia wątpliwość równego traktowania i nasuwa podejrzenie o naruszeniu przepisu o zakazie dyskryminacji obywateli Unii Europejskiej ze względu na przynależność państwową. W artykule przeanalizowano następujące prawa regulowane postanowieniami Europejskiej karty społecznej: prawo do ochrony zdrowia, pomocy społecznej, mieszkania i edukacji.
The article analyzes the possibility of treatment of the Charter of Social Rights of the Council of Europe as a standard specifying the minimum level of protection of social rights in the scale of the European continent. These rights are analyzed as part of European citizenship. Because of the absence of a uniform concept of the Union citizenship, the individual Member States of the European Union do not apply the common model of compliance with the social rights. The effect of this is the intervention of the Union and domestic judicial authorities, since the practical application of the three standards of protection of social rights a limine puts in doubt the equal treatment and gives rise to the suspicion that the provision prohibiting discrimination of the Union citizens on grounds of nationality is violated (article 18(1) TFEU). Claims for social benefits regulated by the European laws are no longer treated by the EU judiciary as privileges which may be satisfied at the sole discretion of the competent public authorities. The article analyzes the following rights regulated in the provisions of the European Social Charter: the right to health care, social assistance, housing and education.

This essay addresses the much discussed problem of archiving digital poetry. Digital media are labile, and several writers of digital poetry are incorporating the media’s ephemerality into their poetics. Rather than rehash arguments that have been taking place within the field of digital media and digital poetics for years, I turn to the field of contemporary art curation and preservation, a field in which curators and archivists are struggling with the very immediate concerns, ethical and otherwise, related to archiving works that are made from ephemeral media. One particular digital poem that has recently broken, has recently become unreadable, is Talan Memmott’s Lexia to Perplexia. Memmott composed the poem in 2000, and he incorporated the poem’s inevitable obsolescence into the text of the poem itself. He has since refused to “fix” or “update” the poem, because he contends that that would make it something other than what it was intended to be. Rather, he is choosing to let the poem die because that is what the poem is supposed to do. This essay concludes with a discussion of the political implications of acknowledging the ephemerality of digital media, the resistant potential of the poem when its ephemerality is embraced, and some ways in which archivists can preserve the memory of the poem without necessarily preserving the poem itself.

This paper contextualizes and analyzes the main emerging approaches to the understanding of the right to be forgotten and its application in praxis, using legislation and judicial practice of the European Union and Ukraine as reference scales. By bridging the gap between positive and interpretative orders of law implementation, which were previously imperatively opposed and considered mutually exclusive in the Ukrainian legal system, the paper supports the arguments that the process of mastering the protection of right to be forgotten requires a further mindset shift equally for-Internet providers and all involved law enforcers.

Ta ostatnia również postuluje to, co faktyczne, a skoro kluczowe znaczenie ma ciągły charakter doświadczenia, wiążę to, co faktyczne Reesa z tym, co bieżące. Uznaję, że w ramach jego pomysłu ruch (czas) wyrażony jest przez wykonanie serii (trzech) szczególnych kroków (mających swój charakter klasyczny).
The paper addresses Tobias Rees’ project to practice the anthropology of the actual, which aims at grasping what is not known and thought yet with reference to man and the human. What is at stake is a movement (of thought) as such. Rees wants to escape both the spatially framed classic anthropology and the timely framed what he calls the anthropology of the emergent. The latter also claims the actual, and since Rees underlines the ongoing nature of experience, I associate his actual with the current. I find his project to express movement (time) through the performance a series of (three) particular steps (quite classically identified).

Zwrócono również uwagę na relacje tego rodzaju działalności gospodarczej z kwestią odpowiedzialności, która obecnie jest przedmiotem wielu kontrowersji w debatach społecznych i politycznych.
The article aims to analyse the emerging forms of economic activity that are an alternative to the traditional markets. The features of peer-to-peer markets, mainly highly reduced barriers to enter them may be interpreted as society’s expression of economic freedom. The article describes the potential of blockchain, the technological foundation of some P2P solutions, being also called “enabler” or “changer” in today’s very dynamically evolving world. Also, special attention has been paid to the relation of these type of economic activities with the question of responsibility which is now the subject of many controversies in social and political debates.

In contemporary contract and consumer law, obligations to inform are an example of instruments (protective ones) which imposes on business entities a duty to make a statement of knowledge (a representation), the content of which is determined by regulations and the purpose of which is to aid the consumer in taking a well-informed, rational decision. Appropriate regulations referring to liability for failing to carry out this obligation to inform aim to maintain optimal trust between the contracting parties and, as a result, lead to a balance in the parties’ position, at the same time upholding the principle of the freedom of contract. In accordance with the fundamental assumption in European consumer law, one’s liability towards a consumer should meet the criteria of both efficiency and proportionality, which means that one should not strictly consider such liability purely formally, i.e., as maintaining an economic balance between the parties. The sanction the company shall incur is to serve the actual satisfaction of the interests of the consumer, and not only to make a profit. Additionally, the sanctions for neglecting the obligation to inform are expected to encourage companies to comply with them. Neglecting this obligation to inform in the pre-contractual phase may take the form of not providing information which is required and explicitly defined by law or providing incomplete information. A large amount of detail in determining a business’s responsibility is presumedto guarantee the consumer knowledge of his/her rights and to enable him/her to evaluate the risks resulting from entering into a particular transaction. One must not, however, ignore the fact that providing excessive, thus illegible, information must be treated equally to non-disclosure of such information, which may result in infringement of the aforementioned regulations. Neglecting the obligation to inform may also arise in such a case where the consumer is not provided with a particular piece of information, despite the lack of a definite legal basis in this regard – such as a detailed regulation contained in an act – but such a duty would result from a general loyalty duty between the contracting parties. In the beginning, it should be noted that the liability for an infringement of the pre-contractual obligation to inform is characterised by system heterogeneity. In particular, it refers to the distinct consumer protection regime. It is very often the case that depending on the contractor’s status (professional or nonprofessional) the legal consequences of failing to inform or improperly informing are framed in different ways. One must bear in mind the difference between solely the failure to inform or to improperly carry out the pre-contractual obligation to inform (pursued within pre-contractual liability, fundamentally according to an ex delicto regime) and the consequences arising from the content of the delivered information, i.e., the guarantee of definite elements in the legal relationship of an obligatory nature (assigned to the classic liability in an ex contractu regime). The subject of civil liability for the infringement of duties to inform can be analysed from two perspectives: firstly, from an economic point of view, i.e., whether for the aggrieved party and for the market at large it would be more favourable for the infringement of the duty to inform to be pursued within an ex contractu or ex delicto regime, and secondly, from the perspective of the theory of law, whether for the system of contract law it would be better for this liability to be pursued within an ex contractu or ex delicto regime. In response to the second question, the position of academics is that the liability for the violation of trust due to failing to properly inform the consumer should be pursued in an ex delicto system in order to maintain the internal cohesion of contract law.

Opis:
Marriage is a profound communion of life and love established by the Creator and normalized by His laws. It is the strongest bond that can exist between a man and a woman. The concept of marriage is closely connected with its monogamous character. Spouses in the sacrament of marriage get the proper grace from Christ, designed to improve love and to strengthen their indissoluble unity. Nowadays marriage is experiencing a crisis. Therefore, it would be presented not only as a covenant community or an institution, but as a vocation. The vocation is an act of summoning, which involves the mission consisting in completing a given task. The essence of a Christian vocation stemming from baptism is a dialogue of the freedom of God and a man, preceded by the choice of the person and commission of the given mission. A sacramental marriage is the way of bounding with God and following Christ, that is the most appropriate way to holiness for spouses. Therefore, an important message for a modern man is to present marriage as a vocation that is addressed to two people, which should be accepted by them and implemented. This situation also requires a change of the pastoral perspective and new opening not only for spouses, for whom marriage is a way to bind with God, but there is the needed to be opened to those for whom marriage is only the fulfillment of the requirements by the Church to get married.
Małżeństwo jest głęboką wspólnotą życia i miłości, ustanowioną przez Stwórcę i unormowaną Jego prawami. Jest najsilniejszą więzią, jaka może zaistnieć między kobietą i mężczyzną. Pojęcie małżeństwa łączy się ściśle z jego monogamicznym charakterem. Małżonkowie w sakramencie małżeństwa otrzymują od Chrystusa właściwą im łaskę, przeznaczoną do doskonalenia miłości i dla umacniania ich nierozerwalnej jedności. W obecnych czasach małżeństwo doświadcza kryzysu. Warto byłoby zatem ukazać je nie tylko jako przymierze, wspólnotę czy instytucję, ale jako powołanie. Powołanie jest aktem wezwania, które wiąże się z posłannictwem polegającym na wypełnieniu określonego zadania. Istotą powołania chrześcijańskiego wynikającego z chrztu św. jest dialog wolności Boga i człowieka, poprzedzony wyborem osoby i zleceniem jej misji. To właśnie sakramentalny związek małżeński jest sposobem związania się z Bogiem, pójścia za Chrystusem, czyli najwłaściwszą dla małżonków drogą kroczenia do świętości. Dlatego ważnym przesłaniem dla współczesnego człowieka jest ukazanie małżeństwa jako powołania, które skierowane jest do dwojga ludzi i powinno być przez nich przyjęte i realizowane.

W pierwszej kolejności przedmiotem rozważań są normy pojmowane jako wyrażenia–typy. Taka norma istnieje, ponieważ jej cudzysłowowe imię własne nie jest nazwą pustą. To znaczy, że norma ta należy do uniwersum odpowiedniego metajęzyka. Innymi słowy, owa norma jest wartością zmiennej związanej tego języka. W ten sposób istnieją nie tylko normy pojmowane jako wyrażenia–typy, ale także normy pojmowane jako wyrażenia–egzemplarze, normy pojmowane jako znaczenia wyrażeń oraz normy pojmowane jako pary uporządkowane. Ponadto, normy pojmowane jako wyrażenia–egzemplarze istnieją też czasoprzestrzennie, bo są rzeczami. Natomiast ani normy pojmowane jako wyrażenia–typy, ani normy pojmowane jako znaczenia wyrażeń, ani normy pojmowane jako pary uporządkowane nie istnieją w czasie lub w przestrzeni, gdyż są abstrakcyjnymi bytami. W dodatku żadna norma nie istnieje intencjonalnie.
First of all, the subject of deliberation are norms understood as expression-types. Such a norm exists, because its quotational proper name is not an empty name. This means that the said norm belongs to the universe of appropriate metalanguage. In other words, this norm is a value of a bound variable of that language. Therefore, there exist not only norms understood as expression-types, but also norms understood as expression-tokens, norms understood as the meanings of expressions, and norms understood as ordered pairs. Moreover, norms understood as expression-tokens exist spatiotemporally because they are things. Meanwhile neither norms understood as expression-types nor norms understood as meanings of expressions, nor norms understood as ordered pairs exist in space or in time, because they are abstract objects. Besides, no norm exists intentionally.

Written in French towards the end of the fourteenth century and translated into English by William Caxton in 1484, The Book of the Knight of the Tower is a conduct book for girls. It is composed of numerous short narratives through which the Knight of la Tour Landry, after the loss of his wife, instructs his daughters on their duties. The purpose of this paper is to examine various pedagogic strategies used by the father-narrator to engage his young daughters, to hold their attention, and to make his lessons memorable. Attention will also be paid to the tone and formal markers of the work, which has been classified as an example of medieval children’s literature.

The purpose of this article is to present two tax preferences, in force from 1 January 2022, dedicated to taxpayers transferring their residence to Poland. Their way of design is an incentive to become a Polish tax resident, and their introduction to Polish income tax is justified by both economic and demographic reasons. The first of the instruments is a lump-sum tax on foreign revenue amounting to PLN 200,000, addressed mainly to natural persons with very high foreign income (high net worth individuals), who are ready to allocate significant funds for the implementation of socially beneficial projects. The second instrument stimulating the transfer of residence is the tax exemption due to the return to the country, which can be considered a type of ‘tax holiday’, as selected domestic income during the four tax years from the transfer of tax residence is subject to a limited tax exemption. The article indicates the stimulating nature of both concepts by analysing the conditions for their application in the context of a deviation from standard taxation rules. Moreover, the paper indicates that similar solutions are also applied in other countries.

Odpowiedzialność karna za nieprzeszkodzenie samobójstwu w polskim prawie karnym Streszczenie Artykuł został poświęcony problematyce nieprzeszkodzenia samobójstwu w polskim prawie karnym. Zagadnienie to ma charakter interdyscyplinarny i bardzo złożony. Ramy niniejszego opracowania pozwoliły na prezentację jedynie wybranych kwestii szczegółowych, takich jak: pojęcie nieprzeszkodzenia samobójstwu, prawo podmiotowe do samobójstwa oraz kwalifikacja prawna nieprzeszkodzenia samobójstwu. W świetle zaprezentowanych rozważań przyjęto, że zagadnienie odpowiedzialności karnej za nieprzeszkodzenie samobójstwu, rozumiane szeroko, jako niepodjęcie akcji ratowniczej w trakcie realizowanego już zamiaru pozbawienia się życia, jak i nieodwrócenie skutków takiego zamachu, kształtuje się odmiennie w zależności od statusu podmiotu dopuszczającego się zaniechania. Chronionemu z perspektywy jednostki prawu do życia odpowiada po stronie ogółu obowiązek ochrony życia, tj jednostka ma prawo do życia, wszyscy inni mają natomiast obowiązek, by je chronić.

The article discusses the notion of return migration with regard to its permanency and temporariness. In reference to selective patterns of return migration, factors conducive to permanent returns and to re-emigration, i.e. subsequent migration after the return, are examined with the use of a logistic regression model. Analyses demonstrated in the article are devoted to return migration to Poland in 1989-2002 and based on the 2002 Polish census data. The obtained results confirm earlier findings on the major role of the level of human capital and family attachments in shaping the nature of the return waves. It was revealed that return migrants who decided on a longer stay in Poland were more often living in Polish urban areas, and had higher human capital and stronger family attachments to Poland, when compared to re-emigrants. It was also observed that return migrants possessing dual nationality were the most likely to engage in re-emigration, while descendants of Polish emigrants tended to settle in Poland on a more permanent basis.

Safety of carrying bulk cargoes is an important problem in all stages of the supply chain. At the moment, soybean seed cake is one of the many bulk cargoes, which is the best substitute of protein in the composition of fodder. During the transport, soybean seed cake is mostly under the form of loose cargo and is carried by various and specialized means of sea and overland transport. There are occurred the quality changes of soybean seed cake during the transport processes that are understood as the followed cyclical operations of warehousing, handling and transportation by various means of transport. A lot of characteristics are subject to changes. They are decisive in the nutritional value and in the susceptibility of transport, and they are determining the basic quality-creative factors in the scope of usable quality called functional quality. Maintaining of initial quality of soybean seed in transport process depends on providing the optimal condition of storage, handling and transportation. The influence of functional quality factor that means susceptibility to oxidation in relation to safety of soybean seed cake sea transport is presented. The results of researches are provided on diagrams and evaluated by statistic methods.

For most active investors treasury bonds (govs) provide diversification and thus reduce the risk of a portfolio. These features of govs become particularly desirable in times of elevated risk which materialize in the form of the flight-to-safety (FTS) phenomenon. The FTS for govs provides a shelter during market turbulence and is exceptionally beneficial for portfolio drawdown risk reduction. However what if the unsatisfactory expected return from treasuries discourages higher bonds allocations? This research proposes a solution to this problem with Deep Target Volatility Equity-Bond Allocation (DTVEBA) that dynamically allocate portfolios between equity and treasuries.

In this publication it is analyzed how premarital sex influences postponing a decision to marry and decision to have children. Basic reasons of postponing marriage are also presented. It is proved that premarital sex delays such a developmental task as selection of the spouse. It is explained that the decision to marry is influenced by the following factors resulting from premarital sex: cultural acceptance of sex outside marriage, trauma due to interruption of previous sexual relations. Longer period of fertility in case of men than women is also considered.

The article presents the role of silence in European culture in the context of common parlance. The following forms of silence have been distinguished: amorous, treacherous, political, and the silence of faith. It proves that silence remains an indispensable element in man’s recognizing of his place in the world. Therefore it should be treated as an act of liberation. Unfortunately, nowadays people do not try to use the gift of silence also in the religious sense, although God, whom we can reach, spoke and still speaks through his eternal world – Truth and no futile post-modern fortune-telling will dissuade us from the indicated hope.

Virtual electronic aids to navigation are being introduced into the present short range aids to navigation system in the form of Automated Information System radio-based aids. Research is also underway into the development of their equivalents for use in regions that feature hostile environments, are poorly charted and lack any infrastructure whatsoever to support traditional or radio navigation aids. Such aids are entirely virtual in nature and exist only as a digital data object that resides within an electronic navigation chart for display to mariners through an Electronic Chart Display and Information System. They are at present experimental in nature, and are not intended to replace existing physical or radio-based aids to navigation. Results of research are described in terms of fulfilling traditional navigation aid functions and the development of new functions that are only possible using virtual aids. Their advantages in design and implementation are highlighted, as are their limitations and shortcomings as compared to present methodologies. Notable, however, is the approach used to overcome limitations and shortcomings by considering attributes of the physical environment to ensure their proper location and display of correct characteristics. Such an approach is unique in the modern world, yet it emulates ancient methods of navigation using known landmarks and terrain features.

The idea of crediting and credit repayment is based on an assumption that each payment of the principal reduces the debt balance. This tendency is not followed in case of the hypothecary credit al-lowed and paid out in PLN and indexed to Swiss franc. Here, the balance of principal repaid in PLN is a function of currency exchange rate fluctuations. The situation denies then the idea of credit, according to which “you pay back as much as borrowed”. The cost of credit, calculated as a total of the LIBOR – credit in CHF (WIBOR – credit in PLN) rate and the bank’s margin specified in the contract. The purpose of the paper is to prove that a banking product like this does not meet the standards of crediting, the principal balance being dependent on the unforeseeable direction of changes. The purpose of the paper is to design a model of risk of the hypothecary credit indexed to Swiss franc, to enable the measurement of the loan payment risk. The model design methodology assumes control variables of the risk monitoring process to be included in the model structure. The estimated loan payment risk measures have revealed an upturn in the loan payment risk related to higher PLN/CHF rates and the resultant higher cost of credit accompanied by the loan principal growth. The risk dynamics estimations for the years 2006-2012 support the research thesis – the banking product analysed does not show the characteristics of a loan. Under growing PLN/CHF rates, the loan principal indexation translates into the debt balance escalation.

The main thesis underlying the methodological approach to argument evaluation holds that some arguments which employ knowledge-gaining procedures can be suc-cessfully evaluated by applying tools elaborated by the methodology of science, such as the rules for reasoning, classifying objects, defining, and questioning. The applica-tion of those rules to argument evaluation consists in comparing them with proce-dures employed in the case of argumentative practices performed either in scientific inquiry or in everyday life. In order to show how building the methodological ap-proach to argument evaluation could be started, I examine two cases of evaluating arguments by means of several methodological rules of defining. The idea of apply-ing the rules governing various knowledge-gaining procedures to evaluating argu-ments is present in philosophy of science and in argumentation theory, but so far it has not been systematically elaborated. The paper aims at justifying this idea as a promising research project.

The Zurich and Schaffhausen Universities of Teacher Education have ideal conditions for integrating computer-mediated activities into English language and methodology courses. This article describes a number of face-to-face and online computer-based activities and argues that learners who live in close proximity can nevertheless benefit from participating in online activities. Examples from each setting that promote in-class or online communication as well as help to provide opportunities for improving learners’ language and content competence will be described. This article attempts to provide arguments for students to participate in - and thus instructors to host – learning opportunities in computer-mediated settings.

The article displays the concept of the path leading to saintliness found within the extant early Christian works of the renowned theologian – Origen of Alexandria (185-253/254). The Alexandrian theologian creatively construes Saint Paul’s notions simultaneously employing allegorical exegesis to the biblical texts of the Old Testament. According to Origen, a Christian life is a dynamic process driven by two important life moments: 1) the conversion and baptism as a recovery of the slurred by sin God’s image and attaining of the state of initial holiness; 2) complete state of saintliness in the last days, towards which a Christian is progressing in his earthly life in order to perfect the semblance to God in himself through the acquisition of virtues. In Origen’s view of holiness, it is neither a state intricate to attain nor reserved only for the chosen ones, yet a bequest given by God at baptism, and at the same time tasked to every believer for life.

Following the current situation caused by the coronavirus pandemic, this study brings to light the way in which the traditional school (the notion “school” was used in this paper with reference to all levels of learning, both schools and universities) was replaced, in a somewhat forced way, with online school in a society pursuing the tradition of face-toface education. Given this aspect of e-learning and a possible higher exposure of their private life, for both students and teachers, the study will seek to answer the question: “Does online school represent a limitation of the right to private life?” through a series of legal arguments. However, before an answer is found, the right to private life and the right to education, as seen through Romanian legal regulations, as well as through the perspective of the European Convention on Human Rights, will be studied in detail. Last but not least, the concept of online school will be subject to analysis, from the perspective of both main parties involved in the education act, closely following the concept of private life.

W artykule przedstawiono porównanie współczynnika stosunku sygnału do szumu (SNR) dla synchronicznych oraz asynchronicznych przetworników analogowo-cyfrowych. Badania wykonano dla trzech modeli stochastycznych sygnałów wejściowych o rozkładach Gaussa, równomiernym oraz sygnału sinusoidalnego. Oszacowano spadek wartości współczynnika SNR dla asynchronicznego przetwornika analogowo-cyfrowego typu Sigma-Delta w porównaniu z klasycznym przetwornikiem synchronicznym, wywołany odpowiednio nieliniowością bloku próbkującego (-10dB) oraz niejednoznacznością procesu kwantyzacji (-3dB).
This paper shows the difference between the SNR level for classical synchronous analog-to-digital converters (ADC) and asynchronous Sigma-Delta analog-to-digital converters (ASD ADC) (Fig. 2) [4, 5]. Simulative evaluation shows that the conversion quality for ASD ADCs is about 2 bit worse than for classical synchronous ADCs (Tabs. 1 and 2). The reason for such a difference is firstly the nonlinearity of an ASD ADC sampling block (ASDM) (-10dB in SNR value) and secondly the quantization noise whose variance value is two times bigger than in case of classical ADCs ( 3dB in SNR). Such big quantization noise is caused by the need of measuring the time position of two independent pulse edges with uniform probability density function (pdf) for the quantization error [8]. The difference for these two measurements yields a triangular distribution which overlaps consecutive quantization intervals (Fig. 1b) and is the source of uncertainty of the digital word at the ASD ADC output [8]. Simulations were performed for four configurations of sampling and quantization blocks, the classical ADC and three other sets of linear/nonlinear sampling blocks and certain/uncertain quantization blocks. Such simulation methodology shows the influence of properties of each element of the signal path in the ASD-ADC on the quantization noise pdf (Fig. 3). The SNR is evaluated for three stochastic models of input signals: Gauss, uniform and sinusoidal signal. Comparison requires assuming the proper amplitude and frequency domain, because of balance between the dynamic range and bandwidth of the ASD ADC.

The main purpose of the paper is to explore how cluster organisations (COs) take advantage of direct (F2F) and indirect (ICT) contacts in fulfilling their main roles. The paper addresses the research question: “How important are Information and Communication Technologies at each level of advancement of cluster cooperation?” The research was conducted in 2016 in four purposefully selected cluster organisations representing metal and ICT industry. The basic method of data collection was an in-depth individual interview. The authors applied the qualitative content analysis as the procedure to analyse the interviews. The research sample comprised of 30 cluster members. The research was based on an original theoretical concept referring to the trajectory of the development of cooperative relationships in cluster organisations. Four levels of development of cluster cooperation as well as three main roles of cluster organisation were distinguished. At each level, COs play one of three identified roles: a direct resource supplier (providing access to resources), a broker (facilitating resource exchanges) and an integrator (integrating into different dimensions), which gives a total of 12 specific roles. The research has shown that both direct and indirect contacts were significant both in fulfilling the roles assigned to the cluster organisations as well as in developing the cluster cooperation. It has been also observed that ICT importance was slightly different at each level of a CO’s development. Only in one identified role (at level II: Process integrator) the importance of ICT tools was at least as great as F2F contacts. The research study contributes to the literature which refers to the question of face-to-face contacts established in geographical proximity versus the ones set up by using Information and Communication Technologies in cluster organisations. It was noticed that even though ICT plays a significant role in the functioning of COs, they cannot replace face-to-face contacts. They can only be their important complement at every level of CO development. There are also some limitations connected with the qualitative approach, which does not allow the author to generalise the findings. The first limitation is the small research sample. The second limitation is the subjectivity characterising qualitative research, mainly due to the applied techniques of data collection and analysis.

This paper is dedicated to telecommunication companies’ reactions and responses to critical opinions, complaints and claims published by their customers on Twitter, a microblogging website. The manner in which service providers respond to negative comments and complaints of their customers seems crucial in the process of creating and reinforcing a given company’s image online. The aim of the analysis was to determine the communication strategies used by service providers in response to negative comments of their customers and the impact of such strategies on the company image and customer relationships. Given the specificity of Twitter, the analysis was also intended to identify the influence, if any, of the medium on the form of the interactions and the communication strategies employed. The research proves that the most commonly used strategies of reacting to customer complaints and claims are requests for information, apologies, explanations, as well as underestimation of the misconduct and rejection of the complaint.

This article attempts to explain the causes of the formation and preservation of the polysemy of the verb czuć (to feel, to smell, to taste, to see) by using the knowledge of synesthesia from various scientific disciplines. The ambiguity of the verb can be justified by the metaphorical extension of the concrete senses over abstract ones and the preservation of the remains of the original way of sensing when, at a certain stage, the received stimuli and the accompanying emotions or thoughts are not differentiated or specified. D. Buttlerowa clarifies that such a situation is a reflection of the synthetic and sensational perception of the world characterising the old ethne and every human being in infantry and early childhood. The combination of impressions coming from different senses facilitates learn ing, memorising and acquiring language early in life. Giving consideration to research from various disciplines of science permits the discernment of the reasonability to preserve the ambiguity of czuć and understanding of its cause rather than perceiving it as an example of denying the tendency for clarity and precision in language.

Abstract: The Presidential Commission of the Russian Federation to Counter Attempts to Falsify History to the Detriment of Russia’s Interests (Комиссия при президенте Российской Федерации по противодействию попыткам фальсификации истории в ущерб интересам России), established in 2009, was intended to serve as Russia’s response to similar attempts at institutionalisation in the Central and Eastern Europe region (such as the historical commissions in the Baltic states, and the Institutes of National Remembrance in Poland and Ukraine). At the same time, its activities showed a multidimensional approach, combining elements of security policy with education, culture and media, public and non-public memory policy, and formal and informal activities. Although the official emphasis was mainly on the external (foreign) determinants of the Commission’s genesis, it also became an important element of domestic policy. The Commission only operated for three years (2009–2012), but its importance as a tool of Kremlin policy cannot be overestimated. It turned difficult historical issues into “historical weapons”; introduced international public discourse to the Russian narrative, which was constructed in a spirit of confrontation with the memories of its neighbours; coordinated the activities of formal state organisations, as well as those which operated as nominally non-state bodies but were financed by the state; expanded the community of expert research which argued the Russian narrative while undermining others from abroad; and examined the options for transmitting the desired attitudes and opinions to wider audiences, creating systemic mechanisms of what has been called “counteracting the falsification of history.” The aim of this article is to show the institutional and organisational aspect of this phenomenon.

To resist is to fight against the Forgetting ; it's to build its own Identity The principal aim of this paper is to examine two novels of the caribbean writter Maryse Condé, Moi, Tituba sorcière noire de Salem and Les derniers rois mages. I will analyse in these how notions of both personal and collective cultural identity are explored so as to overcome the old perception of Négritude and Panafricanism. Many of her novels embrace the idea of searching, her protagonists are often on some type of quest and searching for an authentic homeland. Much of her work revolves around the notion of asking questions, but not necessarily providing answers, and reflecting on the history of her people. On different levels, Condé does not allow her work to be limited by boundaries of any type. That´s her own way to resist.
