    Charakterystyczną cechą infrastruktury przesyłowej jest jej przebieg przez bardzo dużą liczbę nieruchomości charakteryzujących się różnorodnym statusem ochronnym (grunty rolne i leśne, obszary Natura 2000, parki narodowe i krajobrazowe, grunty zabytkowe, tereny zurbanizowane, grunty zagrożone powodziami). Biorąc pod uwagę powyższe oraz uwzględniając fakt, że grunty rolne i leśne w Polsce stanowią ok 91% powierzchni kraju, a sieć Natura 2000 pokrywa ok. 20% jej powierzchni lądowej, należy stwierdzić, że skala wpływu urządzeń przesyłowych na przestrzeń rolniczą jest bardzo duża. Celem niniejszego artykułu jest analiza oddziaływania linii elektroenergetycznych wysokich i najwyższych napięć na przestrzeń rolniczą, na etapie fazy realizacji inwestycji oraz eksploatacji urządzenia przesyłowego.
    The characteristic feature of the transmission infrastructure is its course over numerous properties of diversified protection status (arable lands, forest lands, Natura 2000 sites, national and landscape parks, his torical areas, urban areas, areas threatened by floods). Considering this, as well as the fact that in Poland arable and forest lands cover about 91% of the entire country, and the Natura 2000 network covers about 20% of lands, it should be stated that the level of impacts of transmission installations on the agricultural space is considerably high. The objective of this paper is to analyse impacts of power lines (of high and very high voltages) on the agricultural space at the stage of investments implementation and exploitation of transmission installations.

    Opis:
    The paper attempts to estimate chances for modernisation of the Byelorussian energy system in the years 2011–2016. In accordance with the government strategy, in 2015 Byelorussia is to become an energy independent country. The ambitious government plan provides for modernisation of several tens of power facilities. It also aims at reducing the dependence of the domestic energy sector on Russian energy sources. However, the modernisation plans of the energy system include a significant risk, as their financing largely depends on obtaining foreign loans. The current implementation rate of the government strategy indicates that chances for modernising the outdated Byelorussian energy system are small. Only commissioning of a nuclear power plant will end Byelorussian problems with electric power shortages.
    В статье проведена оценка шансов модернизации белорусской энергетики в 2011–2016 годах. Согласно правительственной стратегии в 2015 г. Беларусь должна стать энергетически независимым государством. Амбициозный правительственный план подразумевает модернизацию нескольких десятков энергетических объектов. Его целью является также уменьшение зави- симости национальной энергетики от российского энергетического сырья. Планы модернизации энергетической системы включают в себя большой элемент риска, так как их финансирование, в значительной степени, обусловлено получением заграничных кредитов. До сих пор темп реализации правительственной стратегии указывает на малые шансы модернизации устаревшей белорусской энергетики. Только запуск атомной электростанции избавит Беларусь от проблем с дефицитом электроэнергии.

    This paper will be devoted to the most acute point of intersection between sector specific regulation and the enforcement of competition law – a parallel scrutiny of the market position and behaviour of EMITEL TP, an incumbent infrastructure holder in the Polish broadcasting transmission field, by the national telecoms regulator and the antitrust authority. After presenting the relevant EU background, the discussion will focus on four basic factors that have influenced the relationship between antitrust and regulation in this case. The peculiarities of national legislation transposing the EU liberalisation package will be considered first, followed by the state of competition in Polish telecoms and the potential existence of prohibited market practices. Emphasis will be placed here on the use of the antitrust concept of relevant market definition in the framework of sector-specific regulation. The analysis will continue with an assessment of the differences between the two types of market intervention noted by the authorities in the context of a potential competence dispute. In conclusion, the need will be presented to shift the current focus placed on the separation of antitrust enforcement and regulation, which has made them both ineffective in achieving their purpose, towards that of their combination in order to facilitate the emergence of competition in the Polish broadcasting transmission services field.
    L’article concerne le point le plus aigu d’intersection entre la réglementation sectorielle et le renforcement de la loi de concurrence – le contrôle parallèle de la position sur le marche et le comportement de EMITEL TP, le propriétaire d’infrastructure dans le domaine de la radiodiffusion en Pologne, par le régulateur national des télécommunications et l’autorité chargée de la politique de concurrence. Après avoir présenté le contexte de l’UE, la discussion se concentrera sur quatre facteurs clés qui ont influencé les relations entre les politiques de concurrence et la réglementation sectorielle dans ce cas-là. Les particularités de la législation nationale transposant le train de mesures de libéralisation de l’EU seront considérées d’abord, suivies par l’état de concurrence dans les télécommunications en Pologne et l’existence potentielle des pratiques du marche interdites. L’emphase sera mise ici sur l’usage de la définition du marché en cause aux fins du droit de la concurrence, dans le cadre de la réglementation sectorielle. Dans la partie suivante, l’analyse sera centrée sur l’évaluation de la différence entre les deux types d’intervention sur le marche notés par les autorités dans le contexte d’ un conflit possible en matière de compétence. Dans la conclusion, le besoin de tourner l’attention mise actuellement sur la séparation du renforcement de la loi de concurrence et la réglementation sectorielle, qui les avait faits inefficaces en atteignant leurs objectifs, vers la combinaison de les deux, afin de faciliter l’émergence de la concurrence dans le domaine des services de radiodiffusion.

    Celem artykułu jest przedstawienie roli energetyki w bezpieczeństwie państwa w XXI wieku. Pojawienie się nowych zagrożeń oraz zmiana podejścia do prowadzenia polityki bezpieczeństwa państwa powoduje, ze obszar energetyki stał się kluczowym atrybutem w prowadzeniu polityki zagranicznej. Obecny światowy rynek elektroenergetyczny boryka się z problemem zabezpieczenia infrastruktury sieci przesyłowej przed zewnętrznym ingerowaniem, który może doprowadzić do zachwiania się gospodarki i rozwoju poszczególnych państw. Infrastruktura sieci przesyłowej jest najbardziej newralgicznym. Postępująca w XXI wieku cyfryzacja przyczynia się do tego, że wszystkie decyzje i czynności życiowe podejmowane przez człowieka potrzebują głównie energii elektrycznej. Bez znaczenia jest, czy wykorzystywana jest ona podczas wykonywania operacji w systemie informatycznym, czy też w magazynowaniu żywności. Jednym z głównych problemów wytwarzania, dystrybucji i zapewnieniu bezpieczeństwa w spółkach energetycznych jest modernizacja, utrzymanie, jak również budowa nowej infrastruktury sieci przesyłowej. Dlatego tak ważny elementem energetycznym jest bezpieczeństwo elektroenergetyczne infrastruktury sieci przesyłowej.
    The aim of the article is to present the role of electricity security in state security in the 21st century. The emergence of new threats and a change in the approach to the conduct of state security policy make the energy sector a key attribute in conducting foreign policy. The current world electricity market is struggling with the problem of securing the transmission network infrastructure against external interference, which may lead to an economic disturbance and the development of individual countries. The infrastructure of the transmission network is the most critical. The ongoing digitization in the twenty-first century contributes to the fact that all decisions and life activities made by a person require mainly electricity. It does not matter whether it is used during operations in an IT system or in food storage. One of the main problems of generation, distribution and ensuring safety in energy companies is the modernization, maintenance and construction of new infrastructure of the transmission network. That is why the electricity security of the transmission network infrastructure is such an important energy element.

    The problematic issue, which appears during a real estate market value appraisal, is to include the technical infrastructure equipment that occurs in the property’s borders. The limitations in exercise of law powers depend mostly on the type of equipment. The term transmission line easement which is implemented into the Civil Code, regulates the form of ownership of this equipment but don’t explain the valuation of recompense, that is due on this ground. The level of this is based on the value, which is estimated by different people, using various approaches, methods and techniques of valuation and depends upon proper easement interpretation. It can take an effect in the discrepancy between obtaining valuation results.
    Problematycznym zagadnieniem, które pojawia się przy określaniu wartości rynkowej nieruchomości, jest uwzględnienie znajdujących się w jej granicach urządzeń infrastruktury technicznej. Ograniczenia w wykonywaniu praw do nieruchomości uzależnione są przede wszystkim od rodzaju tych urządzeń i ich przebiegu. Wprowadzone do ustawy Kodeks cywilny pojęcie służebności przesyłu reguluje co prawda kwestię własności sieci uzbrojenia terenu lecz nie wyjaśnia sposobu, w jaki należy ustalać wynagrodzenie z tytułu ustanowienia tego typu ograniczonego prawa rzeczowego. Jego wysokość bazuje na wartości, która jest określana przez różne osoby, przy wykorzystaniu różnych podejść, metod i technik oraz opiera się na różnej interpretacji służebności przesyłu jako ingerencji w prawo własności nieruchomości. Z tego powodu wyniki przeprowadzanych w tym zakresie wycen mogą być znacząco rozbieżne.

    The article presents technological solutions of the communication and data transmission area that are indispensable for the organization of smart metering. As the term “smart metering” is very broad, particular attention has been focused on solutions based on the GSM-based wireless transmission that makes possible to flexibly model the process of remote meter reading with the use of the existing technological infrastructure. The article determines factors that can decide over the application of a such communication type as well as technical specifications to be met in order to develop a system that could successfully operate over an extensive network. Characteristics of the communication equipment used in real-time metering and billing systems have also been presented.
