Opis:
Advances in information and communication technologies impact the requirements the citizens have with respect to state administration. Nowadays, the citizens expect continuous expansion of electronic channels in administration to be able to access various offices and settle their administrative affairs online. The purpose of this publication is to present the current state of development of e-administration in Poland and to highlight the barriers that must be overcome in order to assure smooth operating of e-administration platforms which are supposed to be user friendly and reduce the costs of functioning of the State. This study presents a method of measuring the level of digitization of public administration by means of the E-Government Digital Index. Conditions for development of e-services in Poland as compared to other countries and the use of available e-services in Polish voivodships are also presented. The data used in this study were provided by the Central Statistical Office and the United Nations Department of Economic and Social Affairs.

The purpose of the article was to present the role and specifics of a significant function of administration, consisting in the organization and provision of public services. Therefore, an analysis was made regarding, among other things, the legitimacy of the administration to perform public tasks, using the example of the administering administration, contemporary understanding of the function of public administration and the shape of contemporary Polish public administration. The role of administration evolved from the direct provision of public (social) services through its own institutions towards direct organization of the provision of services, to limiting its role in organization and responsibility for the standard of services provided by non-public entities. The administering administration is the area of administration that is subject to ever more intense privatization processes. The forms of the administration’s operation, means, as well as entities acting within the framework of this function, have also changed. Such a system improves provision of the services. The ability to adapt public administration to challenges and expectations of modern society in connection with organizing and providing public services, becomes truly important. The administration that is responsible for organizing and providing public services should be conciliatory – it should support the development of the individual, protect them and not limit itself to the administrative and controlling role only. The role of the administration must be modified and the civic sector is a complement to its activities.

Na ukształtowanie się administracji publicznej w danym państwie, jej strukturę, zadania i formy działania ma wpływ wiele czynników. Są to czynniki dość różnorodne, działające mniej lub bardziej intensywnie, zmieniające się w czasie lub działające stale. Administracja publiczna, podobnie jak i inne organizmy społeczne, powinna wykazywać odpowiednią elastyczność, aby móc dostosowywać się do zmieniających się warunków otoczenia czy do przyjmowania coraz to nowych zadań. Niektórzy uznają tempo jej przekształceń za na tyle duże, że sami „administratorzy” za nimi nie nadążają. Zmiana jest dzisiaj rzeczą charakterystyczną dla administracji i dotyka najbardziej nawet konserwatywnych i zachowawczych struktur. Ma miejsce zarówno w warunkach reżimów politycznych o autorytarnej naturze, jak i w rozwiniętych i ustabilizowanych postaciach demokracji liberalnej. Administracja publiczna jest elementem systemu politycznego i jest przez politykę warunkowana. To z tego obszaru płyną impulsy, które inicjują tendencje do „modernizacji” administracji. Właśnie czynnikom wpływającym i sprzyjającym procesom reformowania administracji publicznej, a także ich znaczeniu w aspekcie politycznym, ideologicznym, finansowym i międzynarodowym poświęcony jest ten artykuł.
There is a constant need of public administration improvement and those innovations which usually introduce significant changes are called reforms. Public administration alike other social organisms should be elastic enough to adopt the changing environment conditions or the deal with the new types of tasks. Moreover, public administration must meet the needs which arise in the given period of time; otherwise, it shall slow down its development, leading to the routine and stagnation. Nevertheless, from the point of view of the principles stipulated by the national law, the public tasks for public administration should be determined by the constitution to the widest extent possible. The constitutional regulation of public tasks impedes their reduction by way of legislation, moreover, it restrain the government and local selfgovernment administration's freedom to dispose such tasks and enable the execution of government members constitutional liability for failure to carry out their duties.

This paper tackles staff problems of contemporary public administration. It starts with an analysis of the dependence between the efficiency of administration and the effi ciency of public servants in administration, whose efficiency depends on the level and quality of their qualifications. The analysis was carried out in three perspectives (i) with regard to the whole public administration of the State, (ii) with regard to the State and government central administration and (iii) with regard to regional public administration, on the example of the Lower Silesia region. It was assumed that the quality of the staff in administration is related to and depends on the legislation regulating the recruitment for public administration offices. The relevant provisions determine the choices made in the recruitment process and the subsequent creation of career paths. However, unstable and poor legal provisions have a negative impact on the quality of public administration personnel, which is manifested in poor performance, high employment fl uctuations and a diminishing interest among the younger generation in a career in public administration. This, in turn, may distort the natural generation exchange of administration staff in the future. As can be seen from the statistical analysis conducted in respect of the numbers of public administration employees and the fluctuation among them, as well as the demographic structure examined with regard the gender, age and length of employment, the initially assumed hypothesis of the negative consequences of the inconsistent legislative policy governing the regulations of the public administration staff. The sociological picture illustrating the attitudes among the members of the society to public administration confirms the hypothesis of the poor condition of public administration and a loss in confi dence in its activities or actions. The main reason for the current situation is that the constitutional principle of the neutrality of civil servants is realised only by orders that prohibit combining civil service with political activity, but do not limit or reduce the strong and direct influence exercised by political parties on the legal regulations within public civil service or the policies of appointing candidates to key administrative positions in (not only government) offices.

Discussions on the importance and opportunities of the public-private partnership have been taking place for many years. The article presents an analysis of public-private partnership which is usually considered a form of realisation of public tasks. It is less frequently regarded as a tool for introducing changes in the public administration as such. In their article, the authors emphasise the specific role that public-private partnership can play in designing public sector policies, and its application related to the lack of funds for effective realisation of public tasks. Public-private partnership allows then for changes in the public management model, by transforming public administration towards administration that is responsible for the whole society.

Different authors at different times have given an unequal definition to the term of public administration compared to what it is used today. The author Georges Vestel has defined the public administration as “the set of activities aimed at maintaining the public peace and meeting other needs of the general interest. This definition corresponds to the etymology of the term administration - “administration” which means “to serve”. But Jean-Jacques Rousseau in his work, Social Charter, defined the public administration under the government term. He stated that: “I call a government or a supreme administration the legitimate exercise of the executive power. Some authors use “administrative” and “executive” terms in an alternate way, with the same meaning. Other authors make a clear distinction between terms. They define the state administration as “an activity which is carried out for the concrete fulfilment of the functions of the state and the duties of the organs of the state administration”. So these authors distinguish the state administration from the executive activity which the executive bodies perform. The paper aims to suggest a set of strategies and improvements by starting from a theoretical background of the definition of power balance and separation in public administration and governing bodies and its evolutionary definition over time, and by reflecting those findings as a set of suggestions, by considering the actual Albanian Code of Administrative procedures, strategies and practices.

In my thesis, the topic of which is Communication in State and Public Administration, I would like to pay attention to problems that arise to civil servants in everyday verbal contact in the offices of civil service as well as to other people. Many misunderstandings or conflicts can be reached here. Communication is a means of mutual influence of persons. It is thus a real proprietor of the social process. It enables social interaction which makes a social being from human being. Pressumption of communication is a certain commonly recognized set of meanings within particular group or society. Communication in society has a lot of various forms and aspects. On the basis of analyzing particular communication processes, a theory of social communication has been gradually created as a common base of those scientific disciplines that deal with examining the interaction of information in society. All of us are involved in the process of communication in society. A human being must communicate. Their personal development, involvement in the process of work, emotional and esthetical sphere inevitably require contacts as well as information exchange with other people. To explain the status of civil servants in the mentioned context it is therefore necessary to introduce a legal framework of their position.

Information and communication technologies have undergone substantial development in recent decades. These changes have been manifested not only in the economy, but also in people’s everyday life, as modern technologies have fundamentally transformed working methods, leisure activities, and administrative processes. The strong influence of advanced trends has also left changes in public administration. The international concept of eGovernment has come to the fore, known in Slovakia due to the development of the Internet public services under the “informatization” of public administration. In Slovakia, as well as throughout the world, the primary objective of electronification is to increase the obligations of the state administration, reduce corruption, improve communication within the public administration itself, increase transparency, save finances, eliminate empty bureaucracy, and simplify the contact of citizens with the authorities. eGovernment allows individual states a range of options for delivering public services electronically, such as interactive collaboration or providing information online. In spite of all the advantages brought by information and communication technologies, the Slovak Republic still lags behind in the implementation of computerization in public administration. In the field of electronic public administration, individual processes are constantly influenced primarily by external changes (political), but also by internal changes (organizational). These are precisely the types of changes that can be described as limiting factors for the development of eGovernment. The objective of the present paper is to analyze how public policy actors in three studied countries influence the development and implementation of electronic public administration. The analysis will then culminate in the proposal of appropriate solutions to remove the identified barriers for the conditions of the Slovak Republic.

As regards the regulation of correspondence between public entities and professional attorneys or entrepreneurs, the Bill introduces, as a rule, a consistent and comprehensive system of electronic delivery. Doubts are raised by the definition of a public entity in the context of provisions on administrative proceedings. The sponsor of the Bill did not indicate directly whether the database of electronic addresses would be a public register. The obligation imposed on professional attorneys and entrepreneurs to possess an address for electronic delivery will facilitate the determination of this address for the needs of public entities. In the author’s opinion, there is no justification for a significant differentiation of vacatio legis.

One of the basic duty of each state is to ensure food safety. The Polish institution, which is designated to carry out tasks of ensuring food safety in Poland is the State Sanitary Inspection (PIS).The goal of this institution is, among others, supervision of hygiene conditions in the scope indicated by the legislator, including health conditions of food, nourishment and items of use. Toguarantee food safety PIS primary is taken operation in the field of current sanitary supervision.The tasks of the PIS are performed by the public administration bodies determined by the legislator which are Chief Sanitary Inspector (GIS), the state regional sanitary inspector, as the governmental administration body in the region, the state district sanitary inspector, as the governmental administration body in the district and the state border sanitary inspector for the border crossing areas, airports, seaports and vessels in the territorial waters. The auxiliary institutions of state sanitary inspectors are the sanitary and epidemiological stations under their control.In order to fulfill the duties imposed on state sanitary, the state sanitary inspectors and GIS have a lot of rights, primarily control, determined by the legislator.

Opis:
The article depicts the essence and peculiarities of the functioning of right to good administration in Ukraine and Member-States of EU, which is the subject of the study of Ukrainian and European administrative law doctrine. It has been established that good administration, as a subjective right, provides grounds for the effective enforcement of the rights of individuals. At the same time, maladministration is manifested in a func-tional sphere – the activities of national, regional and local ombudsmen and the European Civil Rights Ombudsman. It is stated that these concepts are basic for European and global administrative law and have direct influence on Ukrainian administrative law.

The purpose of the article is to implement the characteristics of the administrative contract as a component of the system of public administration tools. It is determined that the system of tools for the implementation of functions by public administration bodies must meet the requirements of efficiency of settlement of management tasks, mobility of implementation of management decisions, accessibility of administrative procedures, and openness of regulations and administrative acts. The system of tools of public administration includes decisions, actions or omissions of public authorities and local governments, which have fundamental legal significance and consequences for individuals. It is emphasized that the implementation of the concept of «good governance» must comply with the democratic principles of building the rule of law, the achievement of which requires the use of the system of tools defined by current legislation. The components of the system of public administration tools include bylaws (actually identifying them with regulations), administrative acts, administrative agreements, administrative acts and acts-plans. The normative-legal character of the administrative agreement is determined, which to some extent identifies it with the normative acts of the subjects of power, emphasizing the bilateral and multilateral nature of such relations. It is substantiated that administrative contracts have similar features that are similar to other instruments of public administration, in particular, the need to conclude them in accordance with the established procedure, aimed at satisfying subjective public rights, and so on. It is established that the distinctive features of an administrative agreement are its voluntary nature of adoption, bilateral and multilateral nature of the regulation of public relations, and one of the parties to the agreement is always the subject of power. It is concluded that in the implementation of administrative- contractual relations there is a situation of legal equality of its parties, so the mechanism for ensuring its implementation is specific. It is concluded that an administrative agreement is a public accession agreement, the content of which is the implementation of management functions related to the provision of public services, ensuring the efficient use of public property between the subject of power at the initiative of a non-governmental entity. It is substantiated that in the current conditions in order to ensure the availability of legislation, as well as to avoid the situation of emergency accumulation of an array of regulations, it is proposed to supplement the draft Law of Ukraine «On Administrative Procedure» with the following provisions: «administrative contract implementation of management functions related to the provision of public services, ensuring the efficient use of public property, concluded between the subject of power at the initiative of a non-governmental entity.

Administration is a very important mechanism for implementing tasks of the state, which consists of various types of bodies and institutions. As a collection of mechanisms it is responsible for the practical implementation of the functions of the state. This means that the way the administration is organized, especially its functioning, affects the quality of the performed tasks and translates into the image of the state in the eyes of the citizens. Dysfunctional administrative apparatus of the state is unable to solve problems and social needs, satisfy the aspirations and can even inhibit the development of civilization and culture of entire societies. In modern democracies, the administration carries out not only those tasks that are part of the classic catalog of its functions, but also fulfills the additional responsibilities of membership in supra and international structures that shape the contemporary social order. Such various range of tasks clearly shows that the meaning of the administration existence is undertaking relevant organizational, managerial and planning actions. Administrative apparatus is to be helpful in solving social problems and to serve the public – Lat. administrare. In the context of the changes and transformations of contemporary states and societies that are taking place under the influence of various factors (globalization, regionalization, integration processes, economic crises, armed conflicts), the right to good administration begins to be an issue of a particular importance. Nowadays, it is not only a fundamental right of every citizen and the principle of European administrative law, but, above all, it becomes a condition for efficient satisfaction of still growing needs and aspirations of individuals, social groups and whole societies.

There are some typical relations that can be observed in public administration, including management, supervision, control, co-ordination and co-operation. The latter two are seldom subject to scrutiny by administration law academics. The purpose of this article is to initiate a discussion on filling this gap. In most cases, co-ordination is performed in connection with management, supervision or control. This type of co-ordination can be described as functional. However, independent co-ordination also exists. Due to the limited number of positive law regulations regarding this type of co-ordination, it is usually limited to the co-ordinating body applying non-executive measures. The co-ordination relationship in administration law is an unusual type. At least three entities are necessary for such a relationship to exist, namely a co-ordinator and two co-ordinated parties. The analysis of co-operation in public administration is possible upon considering the principle of general co-operation as a separate one. This principle could have the status of a general administration law principle, but the positive law does not currently formulate this principle directly. However, it can be derived from various applicable rules, including rules of constitutional importance. This principle dictates that all public administration entities must co-operate with each other. The article attempts to define forms of co-operation, indicating their diversity. Many issues related to co-ordination and co-operation in administration still require scientific explanation. A further stage should involve regulating these activities within the framework of the positive law. This could be implemented by future act – the “General Provisions of Administrative Law”.

This study focuses on the new procedure of electronic deliveries in administrative jurisdictional proceedings, as regulated by the provisions of the Code of Administrative Procedure. The primary research objective was to describe de lege lata the modes of individual deliveries, indicating their mutual hierarchy, while also addressing several issues related to the relationship between the Code and the Act on Electronic Deliveries. Both normative acts necessitate co-existence, and thus determining which of them and in which situational variants will be qualified as lex generali. This task is by no means facilitated by the fact that the characteristics of the framework regulation can be found in the Code, while the Act “model” regulates the rules of communication involving public entities. The main thesis presented in the study underscores the need for a systemic interpretation of the provisions of the latter Act. The author also believes that the definition of the scope of exclusions from the application of the Act was not designed appropriately. The issues raised have not been the subject of articles thus far.

The author argues that public governance in Poland should be oriented toward the characteristics of interactions among a diverse set of policy actors. Public governance has been defined as a problem solving process in which formal government -- as a cabinet of ministers and public administration -- is no longer the only leading policy actor. Instead there is a network of various actors from within government and from without that contributes to decisions processes and policy outcomes. This change is a result of the decentralization of power. To understand the barriers that block the policy creation process requires an analysis of networks and attention to the pluralistic approach to public governance.

The article presents selected problems concerning instructions in public administration. First, attention is paid to the official instruction. It is issued in service relationships, which differ from employment relationships. By issuing an official direction, the service superior obliges a subordinate employee to perform a specific official activity, including to submit a declaration of knowledge on public issues. An official direction is an individual administrative act.These official instructions are issued when it is necessary to correct the performance of public tasks by a subordinate employee. The obligation to comply with an official instruction is not absolute. The addressee of the instruction may raise objections and even refuse to execute an unlawful official instruction.Instructions issued by a superior authority to a subordinate authority constitute a separate group. Such an instruction is an internal act. It may concern the method of performing tasks or taking specific actions within the scope of operation of a subordinate authority. Instructions issued between public administration authorities are aimed at adapting activities to the directions of public policy and correcting the manner of performing public tasks. There is no appeal against an instruction issued by a superior authority. These are binding.The last category concerns intervention orders. The intervention order does not result from organizational superiority or official subordination. This is a request addressed to the public administration authority to take action to abolish the danger in emergency situations. Intervention orders are issued in particular in matters of protection of life, public health, property, protection of civil rights, maintenance of public policy.

Opis:
The article focuses on inactivity of the public administration in the Slovak Republic. It analyses this malfunction of the public administration from the point of view of the legal theory, international legal regulation as well as national legal regulation. The emphasis is on the national legal regulation that should provide effective legal remedies on how to eliminate inactivity of the public administration – namely the Constitution of the Slovak Republic, the Act on Administrative Proceeding and the Act on Administrative Justice Procedure. The article analyses the new legal regulation on a judicial review of inactivity stipulated in the Act on Administrative Justice Procedure and compares it with the previous legal regulation. The aim is to conclude which legal regulation is more effective and describe why it is so.

Administracja publiczna wykonując złożone zadania, dysponuje charakterystycznymi dla niej strukturami organizacyjnymi opartymi w głównej mierze na monokratycznych organach. Funkcjonowanie struktur tej administracji związane jest z istnieniem aparatów pomocniczych jej organów, składających się z komórek organizacyjnych oraz zróżnicowanego pod względem statusu prawnego personelu. Szczególną rolę w działalności administracji odgrywają funkcjonariusze publiczni, którzy przejmują na siebie najistotniejszą część spraw publicznych. Pamiętając, że administracja może podejmować aktywność jedynie w granicach prawa i na podstawie norm prawnych, niezwykle istotne wydaje się działanie funkcjonariuszy publicznych zgodne z określonymi reżimami. Gwarancją takiego stanu rzeczy są liczne przepisy należące do różnych gałęzi prawa, odnoszące się do odpowiedzialności za czyny wykraczające poza te normy. Podjęte w opracowaniu rozważania koncentrują się na zróżnicowanych aspektach odpowiedzialności funkcjonariuszy publicznych.  
Public administration perform complex tasks and have characteristic organisational structures mainly based on monocratic bodies. The operation of these structures within this administration is related to the existence of auxiliary apparatuses of its bodies, consisting of organisational units and staff of different legal status. Public officials play a special role in the administration’s activities as they are responsible for taking over the most important part of public affairs. Bearing in mind that the administration may undertake activities only within the limits of the law and on the basis of legal norms, it seems particularly important that public officials act in accordance with specific regimes. The guarantee of such a state of affairs is provided by numerous regulations belonging to various branches of law relating to liability for acts exceeding these norms. The considerations undertaken in the study focus on various aspects of public officials’ liability.

The social expectations regarding satisfaction of collective needs, while accounting for individual ones, change, and so do the functions of public administration. Due to the strong connection between public administration tasks and the legal forms of actions used for their implementation, the objective of science of administrative law is to constantly look for new concepts and tools that would enable a proper scientific description and a systematic approach to legal forms of administrative actions. At present, none of the divisions presented in the literature is exhaustive and none can be considered to be offering a full systematization of the legal forms of actions which currently exist in administrative law. One of the most frequently accepted classifications divides the forms of action into imperative and “non-imperative” ones; this classification provides certain antinomy and dśs not conform to the public administration which is legally complex and takes many forms. The existence of imperative administrative actions is unquestionable, but the current doctrinal understanding of “non-imperative” actions needs to be analyzed in more detail. Is the administration really fully imperative or fully “non-imperative”? If we use such an alternative, do we actually deprive ourselves of the possibility of creating a catalogue of legal forms, which reflects the multiformity of contemporary administration, perceives the full spectrum of public administration dominance and diversity of forms, and which assumes a decrease in (or even elimination) of this attribute? Bearing in mind the predilection for the above-mentioned dominance, are we not forced, here and now, to affirm the possibility of full bilateralism in administrative actions?

The development of information society and continuous demand for fast and efficient administration services rendered for the benefit of citizens call for constant improvement of e-services and automation processes in administrative formalities. This paper evaluates services rendered by public administration based on E-Government Digital Index and then presents online services provided by the Polish Social Insurance Institution (ZUS). The paper also reviews ZUS development strategy for 2021-2025 which is supposed to lift the burden incumbent on the social security premium payers, to fast forward dealings related to administrative matters and, finally, to seal the public finance.

This article deals with the economic budget of local governments units. This paper includes the study of local government units in the Podkarpacie region and the main subject of the article are evolution directions of income policy and government spending in 'gminas' (communes). The analysis of local government finance between the years 1999-2008 emphasizes the changes in the priorities of public spending. Reorientation are not only trends, also the nature of realizing budgetary economy. As a result, it seems a reasonable approach to the revision of these changes.and analysis of their substrate. Not without significance is the impact of legislative amendments to change the financial management local government units. The article outlines the above subjects and the nature of its deliberations in a way that reflects the theme of comprehensive changes taking place in local government finance.

The aim of this article is to identify the main principles for how the public sector functions in a post-industrial society. The research method adopted was a meta-analysis of the results of research by various authors on the issues of managing the development of post-industrial society. The subject of the meta-analysis was primarily literature in the field of knowledge management, development economics and new growth theories. The post-industrial society presented in the article appears as a land of happiness, where everyone works together to multiply the common good, guided by the following principles: knowledge gives access to power because post-industrial society is a meritocracy; social standing depends on diligence and willingness to take advantage of the offers of the educational system; the role of the state is to provide and safeguard open access to the ruling elite for anyone who wishes to learn and improve their conduct by developing objectively formulated, fair and impartial procedures for filling public sector positions. Decision-makers, i.e. those who have power, are not only professionals but also people who put the common good before self-interest. Representatives of the science sector set the directions of state policy and prepare strategies for achieving them. The science sector is independent of government and business, which is manifested in the freedom of to teach and conduct research. Social inequalities are being tackled and citizens can monitor the spending of public funds, since we are dealing with a welfare state. The prevailing political system is participatory democracy. Citizens participate in the life of society on an equal footing, and decisions about the future of society are consulted with them. Political decentralization in the management of public administration is common.

The purpose of this article is to present the possibilities of measuring the efficiency of processes in public administration offices in the context of quality management systems which operate in them and which are conformable to the requirements of BS EN ISO 9001:2009. The first part of the paper presents the results of the analysis of the possibility of measuring the effectiveness and efficiency of processes. Next, the article describes the results of the diagnosis implementation of measurement processes studied in marshal offices, for the analysis of these processes effectiveness. The study involved three selected marshals’ offices having implemented a quality management system complied with the requirements of ISO 9001. In these units a self-assessment based on the guidelines of ISO 9004, unstructured interviews with proxies for the quality management system and in-depth documentation studies were conducted. Studies showed an insufficient preparation of these units to measure the effectiveness of processes, including the implementation processes of administrative services. In the final part taxonomic meters are proposed to measure the effectiveness of processes .

This article deals with corruption and trust in the public administration of nine countries of the former Western bloc and neutral states, which underwent different institutional development compared to post-communist countries, which were susceptible to corruption due to a strongly centralized public administration with complex decision-making processes and the considerable power of officials. Despite the different institutional development of the public administration in Western countries, these countries are not always perceived by the public as trustworthy and not corrupt. This article reveals that in countries like Switzerland, Norway, and Finland, civil servants are perceived by the public as rather trustworthy and not corrupt, whereas in countries like Spain and France, the opposite is true. Using statistical methods, this article also demonstrates that the perception of the involvement of civil servants in corruption and their unequal treatment of citizens diminishes their trust in the eyes of the public. The experience of respondents with bribery on the part of civil servants reduces confidence in the public administration in only two states. In the other seven, this variable was statistically insignificant.

Public administration minimizes or eliminates threats affecting the security level. Crisis management activities are described in the Act on Crisis Management, which defines in the area of crisis management: competent authorities, their tasks and rules of operation, planning documents and financing of activities. The county self-government has its own and commissioned tasks of above communal nature, related to the removal of direct threats to public safety and order, defense, flood protection, including equipment and maintenance of the county flood prevention and fire protection and prevention of other extraordinary threats to human life and health and the environment. The cooperation of public administration within the framework of fusion on the county level has an impact on the efficiency of managing the security system organized at this level.

The article presents selected issues of the multiformity of tasks performed by the public administration based on the example of the administration of measures in the context of diversification of legal forms of activities in the public administration according to two criteria: functions performed by the administration of measures in the economy and the authoritative and non-authoritative forms of activities. The first part of the paper presents the legal forms of activities in the administration of measures according to the following functions: economic police, reglamentation, economic supervision, economic management, planning and support of the economy. Moreover, selected public tasks within the above functions are analyzed. The second part of the article provides an analysis of new tasks of the administration of measures in relation to the privatization of public tasks referring to the field of conformity assessment of products in terms of authoritative and nonauthoritative forms of activities, which are subject to evolution as a result of the economic development and the europeanisation of metrological regulations.

Due to the need for public sector reforms, a number of actions are being undertaken to improve the delivery of public services. New Public Management is one of the concepts that assumes the introduction of management methods and techniques modelled on the private sector into the public sector. In line with this new concept of customer management, service recipients are perceived not as supplicants but as customers. The aim of the article is to present the directions of changes in information flows in relations between public administration and economic entities related to the implementation of new public management. The article presents the basic assumptions of the New Public Management concept. Subsequently, the attention is paid to the types of information and methods of communication in relations of public administration with business entities. Electronic means are becoming one of the most important channels of information flow. The implementation of modern information and communication technologies enables electronic data exchange, creation of electronic documents, e-services and electronic access to information.

The contribution is focused on one of the most fundamental ethical values and principles applied in public administration environment – responsibility and personal accountability of public officials and administrators, who have to be liable and answerable for their deeds and actions towards certain community, regional or local, and towards general public as well. The introductory part deals with the explanation of two concepts in question, responsibility and accountability regarding the processes of making, guarding and managing agreements, decisions and expectations in any relations, covering the area of public administration from the ethical point of view. The theoretical contemplation takes into consideration teleological and deontological conceptions, followed by practical summary of the public administration accountability mechanism. Finally, the basic ethical aspects and accountability levels are dealt with, keeping in mind that inner and outer influences on administrators’ and public officials’ accountability are connected with their behavior and decision-making.

The aim of this paper is to analyze the information policy of selected central offices on the Internet. In the first part of the article the author defines the nature of information policy. Then the author intends to verify the following thesis: the central offices do not conduct a sufficiently effective information policy. This is due to the lack of systematic action, improper preparation of the content of the messages and the inability to cater to the needs of people with disabilities. The author answers the following research questions: whether the actions taken by the audited offices are in line with a specified strategy or just perform ad hoc actions; whether the information provided is written in intelligible, understandable language and if it is accessible to people with disabilities. Particular attention will be given to the content available on the Internet, in particular on the websites of central offices.

The aim of the article is the presentation of the agreement as the form of activity of public administration. These forms are being defined as the predicted type determined by the law of the specific activity of the administrative body. The attempts of systematization of forms of action of public administration take into account various criteria. Among others to these forms are numbered administrative acts, normative acts, forms of factual activities and agreements. The last years brought special interest in the problems of bilateral forms of the activity of public administration, above all agreements in the nearly administrative. The agreements as the legal form of the activity of administration are divided into two fundamental groups. The first group contains agreements of civil law. In the second group there are public legal agreements. Based on the more detailed division, double-sided forms of action of administration include civil agreements, administrative agreements, administrative arrangements and settlements. The use of construction of legal agreement in the sphere of actions of public administration has its own specific. The doctrine of public law indicates the characteristic features of used agreement at the level of public law.
Artykuł ma na celu przedstawienie umowy jako formy działania administracji publicznej. Formy te definiowane są jako przewidziany prawem określony typ konkretnej czynności organu administracji. Próby usystematyzowania form działania administracji publicznej uwzględniają rozmaite kryteria. Do form tych zaliczane są m.in. akty administracyjne, akty normatywne, formy działań faktycznych i umowy. Ostatnie lata przyniosły szczególne zainteresowanie problematyką dwustronnych form działania administracji publicznej, przede wszystkim umów w prawie administracyjnym. Przyjmuje się pogląd na temat podziału umów jako prawnych form działania administracji na dwie zasadnicze grupy. Do pierwszej zaliczają się umowy prawa cywilnego, do drugiej zaś umowy o charakterze publicznoprawnym. Na podstawie bardziej szczegółowego podziału dwustronne formy działania administracji obejmują umowy cywilne, umowy administracyjne (publicznoprawne), porozumienia administracyjne i ugody. Wykorzystanie konstrukcji prawnej umowy w sferze działań administracji publicznej ma swoją specyfikę. Doktryna prawa publicznego wskazuje na charakterystyczne cechy umowy wykorzystywanej w płaszczyźnie prawa publicznego.

In one of the many definitions of public administration it was stated that it is the fulfillment of individual and collective needs of citizens, resulting from the co-existence of people in society, realized by the state and its dependent organs. One of the needs of an individual is the need for safety. Ensuring the safety of citizens is realized by the public administration, due to its service to the society as an executive apparatus possessing a democratic mandate of political power, in service of the law created by said organs. A particular role in the area of defence belongs to authoritative administration, which performs tasks including reversing risks and removing dangers, including the realization of tasks and undertakings aimed at military preparation in case of war. The aim of the following article is to present the tasks and competences in the area of protecting the President, the government, government administration officials on duty and local self-administration of the Slovak Republic. Various methods have been used to reach the pre-determined goal, primarily the method of document investigation, which made it possible to gather, sort, describe and scientifically interpret the legal acts of the Slovak Republic regarding defensive matters.

Opis:
The CAF method consisting of basic nine criteria is its main construction taken from the EFQM model. The formula for carrying out analysis possesses more guidelines, namely 28 auxiliary criteria divided into 9 main criteria. The auxiliary criteria treat the subject contained in the main criteria more precisely and make up an auxiliary tool for developing issues placed in the basic criteria. The Common Assessment Framework CAF is a method requiring an assessment based on knowledge and experience of workers directly connected with an assessment process of the organisation’s activities. The application of the auxiliary criteria of the CAF method to the organization’s assessment requires their adjustment / modification in order to adapt them to the correct assessment and the organisation’s activities. It is necessary to conduct the adaptation so that the general conception for the given criterion should be kept and relevant to it, besides it is necessary to be guided by a desire to obtain sufficient information. Undertaking the detailed assessment can turn out demanding and give unsatisfactory results, e.g., fail an assessment of activities of the organisation’s individual elements. However, the detailed work assessment can turn our attention to the need for the introduction of changes or modifications which can also improve work at every level and in every function of the organisation. Using the CAF method for assessment of one’s own activities is aimed at improving work environment.

The subject of the publication is a description of water services institutions. This is a new institution under the Water Law, which came into force on 1 January 2018. Its introduction was the result of the implementation of the Water Framework Directive into Polish law. According to the definition of the Act, water services consist in providing the possibility of using water in a wider range, e.g., water intake, or discharging wastewater above a certain amount. Water services are provided to all who have a need to use water to such an extent. They are universal. They are also paid for. The method of determining the amount of fees, fines and possible execution are regulated by law. The fees are paid to the State Water Holding – Polish Waters. This entity is to operate water management in Poland from 1 January 2018. Water services are an example of public services, the provision of which is one of the basic tasks of a modern state of Western civilization. They are also a new form of water management in Polish law.

This paper deals with public consultations, which are a form of direct democracy. The assumptions of such consultations were discussed from the theoretical and legal perspective. In the theoretical approach, an attempt was made to determine the direct democracy features and its relationship with the idea of local government well as understanding public consultations. Provisions of the local government l and by-laws were analysed from the legal perspective. Public consultations also h a wider context, which is determined by public participation and a new philosophy of government. The object, consultation involves not only consulting the public about a specific document, but also a comprehensive approach to cooperation with citizens.

The article looks at the relations between the financial law in Poland and various public management theories. The author claims that institutional design of the Polish financial law seems to be rooted in administrative law and orthodox conceptions of bureaucracy, although new ideas and institutions that are implemented might stem from the New Public Management. The author argues that such implementation without prior substantial systemic changes may result in counter-productive effects. Although changes are unquestionably necessary, current reform proposals lack holistic vision of the public finance sector and aim at short-term political benefits.

The private persons in any democratic state should have a right to dispute the administrative decisions affecting their rights, freedoms or interests before (among others) competent independent courts. It is the key precondition for the principle of transparent and responsible public administration as an integral part of democratic governance. In addition to the “judiciary control of the administrative decisions”, the private persons` human rights against the public administration may be also protected through the Ombudsman office. The increasing importance of the afore mentioned issues relating public administration and the various types of control of the administrative acts been long time ago reflected in the mandate of almost all of the key international inter-governmental organizations, especially the European ones including the Council of Europe, the European Union and the OSCE. The establishment of both effective public administration and administrative justice system has been for a long period of time among the most “important and urgent” final strategic objectives of almost any country in the Balkans region, including Albania, Macedonia and Kosovo. This process included (among others) establishing European-like Ombudsman offices in these countries. Against the above background the present paper firstly explains why the administration action must be controlled by the public, and it then outlines the European Right of Good Administration, the Ombudsman Office`s mandate. This is then followed by presenting the concept of European Administrative Space in terms of the Role of the OECD-SIGMA in Developing the Standards of Good Administration. Against the preceding sub-sections the paper further presents the basic legislative framework for action of the National Ombudsman Offices in Albania, Macedonia and Kosovo, which is then followed by a short review of the actual state of play of the Principle No.2 of the SIGMA European Principles for Public Administration (as specifically related to the accountability) in the three countries, on the basis of the relevant international monitoring reports, including the most recent EU Commission`s Progress Report on those countries. The paper finally concludes that Albania, Macedonia and Kosovo all have already established the basic legislative framework for establishing their national administrative judiciary system alongside which there is the one related to their own national Ombudsman office as well, while all of them are still more or less far from being fully in line with the principle No.2 of the SIGMA European Principles for Public Administration (as specifically related to the accountability). As to later, the paper particularly stresses that Albania, Macedonia and Kosovo have (more or less) adopted rules on independent status, functioning and powers of their own ombudsman office and other oversight institutions in line with the relevant international standards, but their administrations are still too far of being ready and willing to fully implementing the ombudsman institutions` recommendations. The fully implementation of the above Principle No.2 is therefore one of the most important and serious present challenges for Albania, Macedonia and Kosovo on their individual road towards the EU membership, in terms of building up their individual European administrative capacity.

Opis:
Co-production of public services is an increasingly popular tool in public management, although it is still a new phenomenon in Poland. Despite the attention researchers give to co-production, some significant gaps remain. In this article, the author attempts to examine the legal possibility of implementing co-production by the Polish local government by local initiative and Solecki Fund. The article aims to examine how major Polish cities gathered in Union in Polish Metropolises used local initiatives. The next step in research is to find out how Solecki Fund is spread among rural areas according to statistical data. It is proved that only a handful of local governments in Poland are truly engaged in co-production. However, Solecki Fund can be shown as an excellent example of citizens’ engagement. It is presented a possible agenda on what can be done to make co-production more popular and used on a regular basis not only in metropolitan but also rural areas.

Cel niniejszego artykułu sprowadza się do zaprezentowania specyfiki funkcjonowania jednostek administracji skarbowej oraz reguł i zasad ich postępowania w kontekście pojawiających się przed nimi dylematów, wynikających w znacznej mierze z sukcesywnego postępu globalizacji. Poniższe treści w pierwszej kolejności koncentrują się głównie na ocenie istoty jednostek administracji publicznej, w tym na motywie ich aktywności ukierunkowanym na realizację dóbr publicznych. Na dalszym etapie przedstawionych rozważań zakres dociekań naukowych skupia się na analizie charakterystyki organów administracji skarbowej oraz ich funkcji, w kontekście których postuluje się wdrożenie koncepcji New Public Management. W tym aspekcie artykuł porusza zarówno kwestię jej genezy, uwarunkowań, jak i kluczowych założeń. Końcowe treści niniejszej pracy wskazują na liczne korzyści będące konsekwencją wdrożenia owej idei do działalności jednostek administracji skarbowej, zwracając tym samym uwagę na wynikający z tego tytułu sukces całego sektora dóbr i usług publicznych.
The aim of this publication concerns to presentation of functioning nature of administration treasury units and rules of their activity in context of dilemmas appeared before them, which are result of successive globalization’s progress especially. At first the contents presented below concentrate mainly on appraisal of essential of public administration units and a motive of their activity oriented on public goods realization. The next investigations focus on analysis of characteristic of treasury administration units and their functions where postulates implementation of New Public Management conception. In this aspect relates to both the issue of its origin, conditions as well as main assumptions. The final contents of this publication leads on a number of values which are result of implementation this idea to activity of treasury administration units and the success of public goods and services sector.

The subjective context and dimension of administrative law objectively generate a diverse and rich catalogue of causes and manifestations of its multifaceted nature. In this respect, further diversity can be observed, namely that of conditionings and consequences, its crucial aspect being the distinction into administering bodies and subjects of administration. The analysis of the multiform nature of legal-administrative entities can yield particularly interesting results when the participants of administration change their roles (including the role changes which, from the perspective of the distinction between administering bodies and subjects of administration – run across borders). The analysis confirms the importance of taking care of the systemic approach and unification of the doctrinal and normative approach to the question of the multifaceted character of legal-administrative entities.

Nowadays the requirements for good governance under the pressure of global development crisis become not only legitimate but even necessary. Good Governance concept is relatively known in theoretical area, first of all in area of good governance principles. Principles such as efficiency, transparency, efficiency and responsibilities etc. are the basis of the concept of Good Governance. The second important aspect of the concept is the procedural feature because the processes running (including decision making) create a basic area for the application of the principles. The primary research question is how Good Governance concept could be implemented in to the practice for support modern democratic public administration. The procedural aspect of the concept requires a direct connection with the new trends in public management, which are influenced by New Public management. New Public management is trying to revitalize the processes of public organizations with inspirations of wellestablished managerial methods from private sector (including process management and others). Good governance concept and New Public Management have been inspiration for administrative reforms in many countries. The paper deals with the possibility of using the process management in intraorganizational area in public organizations for better governance in wider perspective. It’s focusing on analysis of benefits of process management in the context of keeping the selected good governance principles. Part of the paper is to analyse some of critical factors determining the implementation of process management in the public sector in Slovakia.

The research on territorial reforms on the local level has so far focused on municipal amalgamations. However, less is known about municipal splits – a phenomenon that is less frequent, but that occurred in several European countries in recent decades. This paper deals with municipal splits in Slovakia after 1989, and it examines a set of factors that supported municipalities in their effort to obtain independence. The findings show that the massive wave of splits that began shortly after 1989 was primarily motivated by the aim of reversing the consequences of the amalgamation that had been conducted by the Communist regime. Hence, the question of identity was the main trigger leading to municipal splits. On the other hand, the analysis found that economic factors had only a limited role in the establishing of new municipalities in Slovakia.

Such an environment for data analysis supports public institutions, inter alia in decision-making processes regarding the management of sustainable development of cities, regions, the state. Likewise, the Business Intelligence class through technological solutions such as Raciborz ESIM improves communication between a public institution and the information society.

In the opinion of the author, the amendment contains a number of regulations improving and increasing the effectiveness of enforcement proceedings in administration. It introduces, among others, a new institution in such proceedings, i.e. sale of movables by the debtor with the consent of the enforcement authority and voluntary payment of the debtor. Rules on the distribution of the amount obtained from administrative enforcement adjust the enforcement procedure to the requirements of the EU law. One of the changes beneficial to the debtor is the exclusion from enforcement of, among others, „500+” benefits, following the example of the regulation contained in the provisions on court enforcement.

Modern society is increasingly reliant on digital technologies, thus bringing with it not only opportunities but also threats. This is particularly relevant for the area of the public sector, which by definition serves citizens. This particularity is consists in citizens frequently optionally rather than obligatory entrusting their data via ICT systems. In this context, cyber security is becoming a key research area, and this research is essential for understanding and effectively responding to increasingly complex cyber threats. This study aims to conduct a quantitative and qualitative analysis (within a selected range) of cyber security data for the period of 2020–2024 for the data published in the Scopus repository database.

This article presents, on the basis of the classification of actors of public policy presented by Suwaj and Wenclik, local government entities involved in the implemen-tation of public policies. Through examples of the functioning in practice, the image of the participants in local government is shown as “those that directly affect the shape of the (national) public policy, are directly involved in its creation”, a fact which results from belonging to the category of public administration. In turn, the remainder of the image is presented as local government entities “who are not directly involved in mak-ing decisions about the shape of public policy, although their opinions may be impor-tant in its shaping”. Such a view leads to the perception of municipalities, counties and provinces as entities “suspended” between the central authorities and the specific interests determined by local communities and the broadly understood local govern-ment sector.

The considerations presented in this article are based on several assumptions. First of all, the human environment and the set of its elements are constantly changing. In the early periods of evolution and development of humanity, man lived in conditions given by nature itself, no different than in natural conditions. However, even then, he was also exposed to threats, mainly natural, including disasters. Secondly, with the passage of time and development there was a very large population increase, which caused changes in quite primitive interpersonal and social relations. More and more organized communities, states began to emerge. With this development, new threats also appeared. In addition to the natural threats, which were already natural by their very name, the threats of a social nature began to emerge from the natural world around us, characterized by continuous and dynamic changes. Thirdly, man, who wanted to effectively deal with the problems of the threats he faced, created safety systems. One of them is the public security system. Fourthly, in today’s security environment there is a paradox that in practice these systems function, and in theory there is no commonly accepted definition of public security. The circumstances outlined above determined the shape of this article, the essence of which was to work out a compromise definition of public security based on the interpretation of this concept by recognized authorities in the field of law, administration and security.

The article analyzes the methods and criteria for evaluating the effectiveness of e-governance and e-democracy used in the countries of the European Union and the United States in the context of their implementation in the activities of state authorities and local self-government in Ukraine. It is emphasized that the main activity of the executive power is the provision of services to citizens, therefore, the concept of the effectiveness of the activities of state authorities and local self-government is inextricably linked with the effectiveness of the provision of public services. It is proved that modern information and communication technologies are an important tool for improving the efficiency of the provision of public services, which should be able to be used correctly, because according to the results of evaluating the effectiveness of the provision of electronic public services by the executive power, it is possible to judge the effectiveness of its activities as a whole. It is noted that currently the effectiveness of e-government is evaluated in two ways: 1) assessment of the readiness of e-government and 2) assessment of the socio-economic effects of e-government. It is emphasized that for Ukraine today, one of the priority tasks in the implementation of administrative reform is the active use of the national system of indicators for evaluating the effectiveness of e-government, taking into account the methodological approaches proposed by the world community. This will allow quickly responding to problems and risks on the way to promoting reforms.

Przedmiotem studium jest analiza ewolucji funkcjonowania służby cywilnej w latach 1996-2009. W artykule za pomocą wprowadzanych w życie aktów prawnych dokonano analizy w zakresie tworzenia korpusu służby cywilnej, organizacji jej struktur, m.in.: Urzędu Służby Cywilnej, Szefa Służby Cywilnej, Państwowego Zasobu Kadro Dyrektora Generalnego oraz Rady Służby Cywilnej. Ponadto analizie poddano zasady rekrutacji, organizację służby przygotowawczej, oceny pracownicze i wyższe stanowiska w służbie cywilnej. Założeniem artykułu jest omówienie regulacji prawnych opracowywanych i uchwalanych przez parlament i rząd. Artykuł uzupełniony został danymi empirycznymi ukazującymi realizację założeń ustawowych bądź ich brak. Założeniem niniejszego opracowania jest również ukazanie dysfunkcjonalności systemu i wynikającego z tego chaosu. W konkluzji wyłania się obraz braku wizji ustawodawcy oraz lekceważenia niezwykle istotnego elementu życia publicznego, jakim jest korpus służby cywilnej.
The study analyzes the evolution of the civil service in the years 1996-2009. It is based on incorporated legal acts which refer to the creation of the civil service corps and its organization structures, i.e. the Civil Service Office, the Head of the Civil Service, the Civil Service Council, The National Staff Resources, General Director, the Public Service Council. What is more, the author studies recruitment rules, the organization of preparatory service, staff evaluation and executive posts in the civil service. The aim of the paper is to discuss legal regulations developed and passed by the parliament and the government. It includes empirical data showing whether the statutory provisions were implemented. Moreover, it shows how the confusion in the matter resulted in problems of the entire system. In conclusion, it shows the lack of imagination on the part of the legislator or their disregard for the extremely important element of public life which is the civil service corps.

This publication focuses on defining the legal nature of the constructions of public-private partnership and administrative agreements under different legal systems, with particular emphasis on Polish regulations. Due to complex changes within the concept of public administration, alternative methods of its operation gradually appear. Unification of European legal structures and global socio-economic innovations are an impulse for the analysis of methods that allow adapting to the marketization of public tasks. The aim of the author is to assess the effectiveness of a hybrid forms of public-private partnership and administrative agreement combining the features of private and public law, based on the evaluation of doctrine and jurisprudence. Solutions taken from Polish legal acts on local government and the practice of public institutionsreflect the challenging problem of multilayeredness of obligations undertaken by aforementioned form. Extracting the conclusions from market research and cited government reports allows to formulate postulates de lege ferenda and accurate diagnosis of the activities of modern administration.

Human resources are the foundation of every organization’s development. In today’s ever-evolving globalization process, employees in public administration must have the skills and competencies they need to be able to carry out the tasks entrusted to them. Any organization resource, including human resources, must be subject to appreciation, resulting in an increase in the personal value of each employee. On the other hand, in order to properly and effectively raise the value of human resources in public administration, managers must be mindful of the correct process of directing people. This is especially important in the ever-changing environment of the organization. This process, however, is achievable through the implementation of humanistic management, a manifestation of the specific empowerment of every human being. This article is devoted to humanistic management issues, which, through the available legal, decision and organizational tools, support the process of proper management and directing the work of people in the public sector.
Zasoby ludzkie stanowią fundament rozwoju każdej organizacji. W obecnych warunkach nieustannie postępującego procesu globalizacji, pracownicy zatrudnieni w podmiotach administracji publicznej muszą posiadać odpowiednie umiejętności i kompetencje, dzięki którym są wstanie zrealizować powierzone im zadania. Każdy zasób organizacji, w tym zasoby ludzkie, podlegają procesowi aprecjacji, który przyczynia się do wzrostu wartości osobowej każdego pracownika. Natomiast w celu właściwego i skutecznego podnoszenia wartości zasobu ludzkiego w administracji publicznej, zarządzający muszą pamiętać o prawidłowym procesie kierowania ludźmi. Jest to szczególnie ważne w warunkach nieustannie zmieniającego się otoczenia organizacyjnego. Proces ten jednak jest możliwy do osiągnięcia dzięki wdrażaniu zarządzania humanistycznego, będącego przejawem szczególnego sposobu związanego z upodmiotowieniem każdego człowieka. Artykuł poświęcony jest zagadnieniom zarządzania humanistycznego, które za pomocą dostępnych instrumentów prawnych, decyzyjnych oraz organizacyjnych wspiera proces właściwego zarządzania i kierowania pracą ludzi w sektorze publicznym.

The Albanian regional governance system is based on both decentralization and deconcentration, each of them aiming at bringing services close to the public. To make the multilevel governance system work, the prefect is a keystone of public administration at the regional level. The paper is an analytical study case on the prefect’s institution in Albania, focusing on the challenges that prefects face, particularly related to their functions in supervising local government units. We decided to adopt a problem-oriented approach. Instead of a comprehensive picture of prefects, we focus on identifying concrete challenges as they are perceived by different stakeholders, analyzing their causes and proposing concrete measures that can address both. More concretely, the analysis looked at various dimensions of the prefect system, from a systemic perspective, based on the assumption that the prefects’ performance depends not only on the legal framework and norms, but even more on adequate institutional set-up, procedures and relations, and behaviour and capacities of stakeholders. The prefects are acting in a political and administrative system which is subject to change. If policy decisions are taken to change the overall system (for example, by giving the central state or the municipalities more power and responsibilities), the prefects’ legal roles and responsibilities, procedures and capacity requirements will have to be adapted accordingly. However, we leave it to the competent political bodies to reflect and decide on changes to the overall system.
Albański system zarządzania w regionach opiera się zarówno na decentralizacji, jak i na dekoncentracji. Dla zapewnienia funkcjonowania wielopoziomowego systemu zarządzania zwornikiem administracji publicznej na poziomie regionu jest prefekt. W niniejszym artykule przeprowadzono analizę instytucji prefekta w Albanii, koncentrując się na stojących przed nią wyzwaniach, w szczególności związanych ze sprawowaną przez prefekta funkcją nadzoru nad jednostkami samorządu terytorialnego. Postanowiono przyjąć podejście problemowe. Zamiast kompleksowego opisu statusu prefektów skoncentrowano się na identyfikacji konkretnych wyzwań z punktu widzenia różnych interesariuszy oraz dokonano analizy ich źródła i zaproponowano konkretne środki odpowiedzi na nie. W szczególności analiza dotyczy różnych wymiarów systemu prefektów z perspektywy ustrojowej, w oparciu o założenie, że skuteczność tych organów zależy nie tylko od ram prawnych i norm, ale jeszcze bardziej od układu instytucjonalnego, procedur i relacji, a także od zachowania i możliwości interesariuszy. Prefekci działają w systemie politycznym i administracyjnym, który podlega zmianie. W przypadku podjęcia decyzji politycznych w zakresie całościowej zmiany systemu (np. zwiększenia zakresu kompetencji i zadań państwa albo gmin) role prawne i zadania prefektów oraz procedury i wymagania co do skuteczności będą musiały zostać odpowiednio zmienione. Refleksję i decyzję na temat zmiany ustrojowej pozostawiamy jednak właściwym organom politycznym.

The last part of the article presents the institutionalisation of the notion of Governance in Polish law and practice of socio-political life.

This article describes and analyses Polish diaspora policy changes in the years 2011–2015. Two decades after the rebirth of the Polonia policy in 1989, it was completely rebuilt. Emphasising values and Poland’s obligations towards the diaspora was replaced by paying more attention to the interests and profitability of this policy. The authors demonstrate how New Public Management (NPM) concepts influenced this shift. Analysis of two different sources – documents programming Polish diaspora policy and interviews with experts and persons designing the Polonia policy – confirmed that NPM principles influenced Polish diaspora policy on five dimensions: organisational restructuring, management instruments, budgetary reforms, participation, marketisation/privatisation.

W 2010 roku rozdzielono w Polsce funkcję Prokuratora Generalnego i Ministra Sprawiedliwości, co stało się impulsem do modernizacji zarządzania zasobami ludzkimi zarówno w administracji sądowej, jak i administracji prokuratury. Celem artykułu jest wskazanie specyfiki zarządzania pracownikami administracyjnymi sądownictwa i prokuratury oraz przyczyn, dla których konieczne jest opracowanie rozwiązań uwzględniających specyfikę tych organizacji. Artykuł zawiera syntetyczne omówienie organizacji sądownictwa i prokuratury, krótkie omówienie wniosków z przeprowadzonych analiz obowiązującego prawa, wnioski z przeprowadzonych badań obejmujących blisko 350 sądów oraz 185 prokuratur.
The functions of Public Prosecutor General and Minister of Justice in Poland were separated in 2010. This set the stage for the modernization of human resource management in both the judicial and prosecution administrations. This article aims at identifying the specific management challenges of judicial and prosecution administrative employees and indicates the reasons for which it is necessary to develop different HRM solutions pursuant to the specific needs of the two organizations. The article contains a synthetic discussion of the organization of both the courts and the prosecutor's office, a brief overview of conclusions drawn from an analysis of existing law, and study conclusions involving nearly 350 courts and 185 prosecutor offices.

Deprivation of an entity of acquired rights deriving from an administrative act is possible through the combined application of administrative provisions of substantive and procedural law. The limits of durability acquired under an administrative decision rights are the constitutional principle of the protection of acquired rights and the general principles of administrative procedure. The permanence of the right acquired by the administrative decision is not absolute. Repeal or change of the administrative decision is possible only in the mode provided in the law, since the administrative decision makes use of the presumption of regularity. The deprivation of administrative and legal powers in the area of public law takes place in the context of an assessment of the implementation of an administrative decision carried out by a state body. This assessment is possible with the use of two procedural institutions for the expiry of an administrative decision and a substantive institution for the withdrawal of rights. The body assesses whether the addressee of an administrative act has implemented the administrative decision not only in accordance with its content but also the provisions of the generally applicable law. The deprivation of a party of an acquired right is often accompanied by the need to award damages (grant compensation). The procedure and premises for claiming compensation liability have been regulated in the provisions of substantive administrative law. The principle of the effectiveness of public administration bodies is one of the basic principles of administrative law. Its application is not limited only to the creation of law, but also includes the application of law by public administration bodies. The problem of the efficiency of operations of state bodies is of particular importance not only in the area of enforceability of an administrative decision, but also its authorising function. The efficiency of operations of entities in the State structure is assessed through the prism of the implementation of a given administrative decision.

Good Practice in Estonian E-Government: Recommendations for PolandIn the world of far-reaching globalisation and the rapid development of information technology, digitisation of the public sector seems to be inevitably benefiting both ad-ministration as a whole and its customers. At the time of Polands accession to the European Union, the process intensified due to the standards set by the EU. A similar action was taken by Estonia which joined the European Union at the same time as Poland. Over the years, there have been significant differences between these countries in the development of digital public administration. Estonia, in a relatively short period and with limited financial resources, has become one of the most digital countries in Europę. Thus, Poland should be inspired by Estonian practice as regards the implemen-tation of eGovernment.

Legal Aspects of Lobbying in Decision-Making Processes of Public AdministrationThe process of decision-making in public administration is multifaceted, with the deci-sion being the result of complex proceedings aimed to settle a case or reach a specific goal. Public administration works in this area mainly in the legał environment, but not only. The decision-making process is determined by social conditions and includes agency of various persons whose conduct and actions lead to certain conseąuences. Due to the different tasks of public administration, its activity is not merely a result of the will of a given body but it can also be initiated by applicants interested in the attainment of defined objectives, including through lobbying. The essence of lobbying is to influence, within the confines of law, decisions of public authorities in a particular direction. In Poland, lobbying is nów an institution regulated by the Act of 7 July 2005 on Lobbying Activity in the Lawmaking Process (OJ No 169, item 1414).Lobbying is also very common in the European Union, where the phenomenon is not only acceptable, but even desirable.Lobbying is seen as bringing benefits for both parties consulted. Since disintegration of former Yugoslavia, Slovenia applied series of reforms in all spheres of life, including public administration. The main reform was contracted on introduction of modern trends in public administration. The article discusses main reforms of Slovenian public administration and their efficiency to change the bureaucratic system into an effective modern one. However, the article aims to understand modern Slovenian public administration within the elitist approach, which seems to explain certain malfunctions of Slovenian public administration after these reforms.

Research of modern thesaurus of “coordination” concept and generalization according to deductive analysis of different scientific views allowed us to conclude that coordination should be considered in the form in which it acts at the level of management practice. In a specific manifestation in public administration, coordination is vigorous activity of the subject that stipulated the disclosure of its essence through the managerial relations thesaurus and its related categories: managerial interrelations, managerial interaction, managerial communications. It is proved that for the public administration system the most appropriate classification is the division of managerial relations, depending on the way of achieving the end result of public authorities staying in relations: subordinated, coordinative, reordinated.

Why do some public administrations perform better than others? This is an important question because the performance of public administration is an important factor of a country’s competitiveness and economic outcomes. Our outcome index for public administration captures ‘good governance’, which includes the six components of the World Bank index, representing responsiveness, effectiveness, and legitimacy of governments. Northern Europe scores especially well on good governance, followed by Oceania, Western Europe, Northern America, and Eastern Asia. Central, Eastern, and Southern Europe obtained the lowest scores in the public administration outcome index. Professionalism (as a dimension of the quality of public administration), freedom of the press, the degree of decentralization, and intensity of ICT expenditure were significantly positively correlated with good governance. Spending on tax administration, on the other hand, was significantly negatively correlated with good governance.
Dlaczego niektóre administracje działają lepiej niż inne? To ważne pytanie, bo działanie administracji publicznej jest istotnym czynnikiem konkurencyjności i wyników gospodarczych kraju. Nasz indeks wyników administracji publicznej pozwala uchwycić koncepcję good governance, na którą składa się sześć wskaźników opracowanych przez Bank Światowy, a wśród nich: reaktywność, efektywność i legitymizacja rządu. Najlepiej w zakresie good governance wypada Europa Północna, za nią plasuje się Oceania, Europa Zachodnia, Ameryka Północna i Azja Wschodnia. Europa Środkowa, Wschodnia i Południowa wypadają najgorzej w dziedzinie osiąganych przez administrację publiczną wyników, które obejmuje nasz indeks. Profesjonalizm (jeden z wymiarów jakości administracji publicznej), wolność prasy, stopień centralizacji i poziom wydatków na technologie informacyjne i komunikacyjne są istotnie pozytywnie skorelowane z good governance. Z kolei wydatki na administrację podatkową są istotnie negatywnie skorelowane z good governance.

Ukrainian society inherited a well-developed and expensive system of social services, which included various state institutions that belonged to different departments. Billions of hryvnias of budget funds were spent on these institutions, social services were not provided in full, and social services recipients were almost isolated from the family and society. Changing the priorities of state policy in solving these problematic issues requires not only legislative decision-making, but also practical implementation at all levels and, above all, at the local level, as well as reforming the system of public administration. The article describes the preconditions and peculiarities of the implementation of the reform of the social services system in Ukraine in order to successfully implement the goals of sustainable development. The article highlights the conceptual foundations of deinstitutionalization reforms in Ukraine. In the social policy of Ukraine, deinstitutionalization has become a top priority, primarily in the orphaned children social protection implementation, although it, to some extent, deals with other key categories involved in the process, namely, people with limited mental capabilities, the elderly, and offenders. The main advantages and risks of implementing this reform are analyzed. The application of the gate-keeping mechanism is suggested. Successful deinstitutionalization is possible only with the close cooperation of the state, public, charitable and religious organizations. The actions of all branches must be coordinated and lead to a common result.

The Critical Management Act creates a legal basis for dealing with critical infrastructure. It contains the following definition: critical infrastructure includes systems and functional objects which are connected with each other, including: buildings, devices, systems, key services for a country and its citizens’ security and other systems and objects which deal with ensuring efficient functioning of public administration bodies as well as institutions and enterprises. At national level, the protection of critical infrastructure is coordinated by the Government Centre for Security. In accordance with the critical management act, which is in effect at present, the legislator defines that critical infrastructure is created by systems and consists of functional objects connected with each other: buildings, devices, systems, key services for a country’s security and its citizens’ security and other objects and services which deal with ensuring efficient functioning of public administration bodies as well as institutions and enterprises The article contains an enumeration of the systems which are included in critical infrastructure.

A crucial element of the mechanism to prevent corruption in public administration is the explicit procedure of reacting to corruption events, regardless of whether it is based on ISO procedures or if it results from another system of legal solutions. The statutory anti-corruption solutions introduced in public institutions in the form of management control involve the staff abiding by ethical values, and they serve to improve the transparency, legal conduct, and ethics in the operations of a public administration office. The results of empirical research confirm that the implemented management control procedures form integral parts of the anti-corruption system in public entities.
