    The aim of the paper is to provide further insights into the mechanisms contributing to the integration of immigrants in higher education. Recent immigration waves into Europe place pressure on European communities; However, mass immigration is only expected to increase. The immigrants’ influence on their host countries depends on their economic performance and how well they adapt. In this regard education serves as a key component towards successful integration. As European higher education transforms the influence of these reforms on the participation rates of immigrants is of relevance. A comparison between the participation rates of immigrants following the Europeanization of the Scandinavian higher education system provides interesting insights to these issues.

    Opis:
    The main aim of this paper is to examine whether or not the legal amendments to Polish criminal law for the prevention of illegal immigration were necessary and if so, whether they are proportional to the perceived threat posed by such migration. The paper discusses the implementation of the relevant EU legislation, viz. Council Framework Decision 2002/946/JHA of 28 November 2002 on the strengthening of the penal framework to prevent the facilitation of unauthorised entry, transit and residence; Council Directive 2002/90/EC defining the facilitation of unauthorised entry, transit and residence; Directive 2009/52/WE/EC of the European Parliament and of the Council providing for minimum standards on sanctions and measures against employers of illegally resident third-country nationals; and the Council of Europe Convention on the Prevention of Terrorism; and the direct effects of this legislation on Polish criminal law as presented in the Polish Criminal Code (Arts. 264a and 259a k.k.), the aggravation of the penalties in Art. 264 § 3 k.k.; and the institution of Ustawa o skutkach nielegalnego zatrudnienia cudzoziemców nielegalnie przebywających na terytorium Polski (the Act on Liability for the Employment of Illegal Immigrants on Polish Territory). In addition, the article considers the effectiveness of the new criminal provisions, particularly on the basis of the number of convictions.
    Głównym celem artykułu jest ocena zmian jakie zostały dokonane zmiany w polskim prawie karnym w zakresie zapobiegania nielegalnej migracji. Autorka stara się udzielić odpowiedzi na pytanie czy zmiany takie są konieczne, a jeśli tak, to czy są one proporcjonalne do postrzeganego zagrożenia związanego z migracją. Analizie poddano implementację europejskich aktów prawnych tj. Decyzji Ramowej Rady 2002/946/WSiSW z 28 listopada 2002 r. w sprawie wzmocnienia systemu karnego w celu zapobiegania ułatwianiu nielegalnego wjazdu, tranzytu i pobyt, Dyrektywa Rady 2002/90/WE z 28 listopada 2002 r. definiującej ułatwianie nielegalnego wjazdu, tranzytu i pobytu, Dyrektywy Parlamentu Europejskiego i Rady 2009/52/WE/WE z 18 czerwca 2009 r. przewidującej minimalne normy w odniesieniu do kar i środków stosowanych wobec pracodawców zatrudniających nielegalnie przebywających obywateli krajów trzecich, a także Konwencji Rady Europy o zapobieganiu terroryzmowi. Te akty prawne miały bezpośredni wpływ na polskie prawo karne, którym było wprowadzenie art. 264a kk, 259a kk, zaostrzenie kary w art. 264 § 3 kk i wprowadzenie ustawy o skutkach nielegalnego zatrudnienia cudzoziemców nielegalnie przebywających na terytorium Polski. Ponadto autorka poddała analizie skuteczność nowych przepisów karnych, zwłaszcza na podstawie liczby wyroków skazujących.

    The first Chinese immigrants arrived in the United States in the 1820s and initially their presence did not result in improving the American perception of China. On the contrary – intense immigration from China led to the development of racist and xenophobic attitudes towards the Chinese (Yellow Peril), which culminated in the Chinese Exclusion Act of 1882. During the Second World War, China became an important ally of the United States, which triggered a succession of changes to laws barring Chinese immigration (Magnuson Act). Contemporary Chinese Americans – particularly Taiwanese Americans – can be located in the upper spheres of immigrant population: they are considered to be a well-educated and affluent group. This paper presents the historical and contemporary socio-economic characteristics of the Sino-American population set against a historical and legal background.

    Imigracja w dzisiejszej Europe jest wielkim problemem. Zjawisko to jest potencjalnie niebezpieczne dla narodowego, kulturowego i religijnego status quo Polski. Zgodnie z polskim prawem, wolność religii powinna być zagwarantowana  każdemu, kto znajduje się pod opieką tego prawa. Wolność religii zawiera w sobie prawo do posiadania świątyń. Prawo to jest przyznane każdemu Kościołowi lub związkowi wyznaniowemu. W korzystaniu z tego prawa nie ma rozróżnienia czy lub w jaki sposób Kościół lub związek wyznaniowy jest umocowany w prawie polskim. Wynika z tego, że nie ma bezpośredniej drogi prawnej, aby zabronić imigrantom budowania świątyń. Niedawno zmieniona ustawa z 2003 roku o planowaniu i zagospodarowaniu przestrzennym zawiera przepisy dotyczące tzw. krajobrazu priorytetowego. Powyższe regulacje mogą być użyte przez władze samorządowe, aby zapobiec zmianom w krajobrazie np. widoku miasta, przez wydania zakazu budowania świątyni z pewnymi architektonicznymi elementami.  Zakaz ten nie może być zakwalifikowany jako naruszenie wolności religijnej, ale jako ograniczenie korzystania z tego prawa. Zakaz taki jest całkowicie uprawniony przez prawo autochtonów do zachowania narodowej, religijnej lub kulturowej spuścizny.
    Immigration in to-days Europe is a huge problem. The phenomenon is potentially dangerous for the national, cultural and religious status quo of Poland. According to the Polish law, freedom of religion shall be ensured for everyone, who is under Polish law. The freedom of religion includes the right of possession of sanctuaries. The right in question is granted to every Church or religious organization. In exercising the right, there is no distinction, if or in what legal way a Church or religious organization is recognized by Polish law. It means, that there is no direct legal way to prevent immigrants from building shrines. The newly updated law of 2003 about planning and developing of spatial (ustawa o planowaniu i zagospodarowaniu przestrzennym) contains the provisions about so called “priority landscape”. The regulations in question can be used, by the local authorities, to prevent changing the landscape, e.g. of a town, by banning building a shrine with certain architectonic elements. The ban cannot be classified as an infringement of religious freedom, but only as a limitation of exercising it. The ban is fully justified by the rights of autochthons to maintain the national or religious cultural heritage.

    The last large wave of Polish immigrants (estimated at around 115,000) came to Canada in the years 1981-1996, mainly due to Canadian preferential immigration laws and family reunification programs. As the democratization of post-communist countries was progressing, emigration to Canada became a far easier venture for Central and Eastern Europeans. Currently they are subject to the same immigration procedures as immigrants from other regions. Acting upon the immigration law introduced in 1967, Canada prefers well-educated immigrants with significant capital, persons in economically productive age (between 21 and 49), professionally qualified, and competent in either of Canada’s official languages. In 2008 Canada abolished visas for Polish tourists. A year later the Canadian government launched a typical work and travel program for Polish young people, enabling them to gain up to one-year of work experience in Canada. Despite all these efforts and due to the fact that EU labor markets opened wide for Poles, immigration from Poland to Canada fell below one thousand people per year. Also, Canadian authorities gradually introduce new restrictions aimed at issuing work permits only to those who have guaranteed jobs and are highly unlikely to be a burden on the Canadian health care system and social services. Therefore, Canada’s government has recently been very actively promoting Canada among the most preferred groups of immigrants, including Poles living and working in the British Isles.

    Federacja Rosyjska (Rosja) wypracowywała rozwiązania prawno-organizacyjne pozwalające uregulować strumienie migracyjne tak, by minimalizować obszar nielegalnej imigracji i związanych z tym zagrożeń. Szereg problemów natury innej aniżeli migracja, z jakimi boryka się Rosja, sprawiały, że walka z nielegalną imigracją nie była priorytetem, więc i skuteczność walki ze zjawiskiem nie była najwyższa. A przecież Federacja Rosyjska jest krajem nie tylko zasilającym kanały nielegalnej imigracji w Europie. Jest ona, tuż po USA, krajem, który posiada na swoim terytorium największą ilość nielegalnych imigrantów. Problem migracji, w tym nielegalnej, istnieje. Rozwiązania w zakresie walki z nią są z punktu widzenia poznawczego interesujące. Okoliczności te legły u podstaw niniejszego opracowania.
    The Russian Federation (Russia) has developed legal and organizational solutions to regulate migration flows so as to minimize the size of illegal immigration and the associated threats. Given the number of other problems of different nature Nielegalna migracja w Rosji 104 than migration faced by Russia, the fight against illegal immigration was not a priority, so the effectiveness of fighting the phenomenon was not high. The Russian Federation is a country supplying illegal immigration channels both in Europe and outside it. It follows the USA, the country with the largest number of immigrants on its territory. The problem of migration, including the illegal one, still exists. From a cognitive point of view, the solutions which can be implemented to fight it appear to be interesting. These circumstances constitute the bases of this study.

    El objetivo de este trabajo es analizar el Régimen de Regularización Migratoria para ciudadanos senegaleses realizado en el año 2013 en el contexto de la nueva ley migratoria argentina, ley enmarcada en la perspectiva de la gobernabilidad migratoria. Las ideas que exponemos son resultados preliminares de una investigación en curso enfocada en analizar el impacto que tuvo el programa regulatorio en el colectivo de migrantes senegaleses. El caso senegalés vuelve a mostrar las limitaciones de la ley de migraciones, más allá de sus avances en materia de derechos para los migrantes. La inmigración persiste concebida como problema a partir de la irregularidad, donde los migrantes sólo pueden ser aceptados cuando su presencia lo amerita o cuando demuestran medios de vida “lícitos y útiles”. Y si bien para la ley la migración es un derecho, éste es ejercido de manera discrecional hacia ciertos grupos, por ejemplo, a través de la exigencia de visados.
    The purpose of this study is to analyze the regime of migratory regularization for Senegalese ci-tizens in the year 2013 in the context of the new Argentine immigration law. The ideas that we present are preliminary results of an ongoing study focused on analyzing the impact that the regulatory program had on the collective of Senegalese migrants. The Senegalese case shows the limitations of migration law, beyond advancement of rights for migrants. Immigration continues to be conceived as a problem of irregularity, migrants can only be accepted when something warrants their presence or when they show that their lives are “lawful and useful”. And while migration is a right, it is exercised in a discretionary way towards certain groups, for example, through the requirement of visas.

    W 2014 roku doszło do zapoczątkowania ocieplania relacji pomiędzy Waszyngtonem a Hawaną. W kolejnym roku otwarto amerykańską Ambasadę na Kubie i po 70 latach nieobecności pojawił się tam z wizytą amerykański sekretarz stanu. Zmiany w polityce zagranicznej obu państw zaowocowały wzmożoną migracją Kubańczyków do USA. Począwszy od zapowiedzi o normalizacji stosunków w 2014 roku, zaczęła narastać liczba Kubańczyków obawiających się, że USA zmienią swą dotychczasową politykę przywilejów wobec kubańskich uchodźców. Administracja amerykańska próbując uniknąć kolejnego exodusu z wyspy zapewniała wówczas, że zmian w polityce imigracyjnej nie będzie. W styczniu 2017 roku prezydent Obama ogłosił, że USA kładą kres polityce wet foot, dry foot, która oznaczała dotąd, że Kubańczyk zatrzymany na morzu był zawracany na wyspę, a ten któremu udało się stopą dotknąć amerykańskiego brzegu otrzymywał prawo pobytu w USA. W prezentowanym artykule poruszone zostały problemy współczesnej fali uchodźczej z Kuby do USA wpisane w kontekst historyczny.
    In 2014 presidents Barack Obama and Raul Castro declared changes in mutual relations between the USA and Cuba. The following year American Embassy in Havana was opened and for the first time for 70 years American Secretary of State visited the island. At the same time the number of Cubans fleeing to the United States started to grow. Cubans were afraid that their privileged status under American immigration law could soon disappear. American administration declared no changes in the United States policy toward Cuban refugees, probably because it was afraid of starting a stampede. In January 2017, however, president Barack Obama declared the end of “the wet foot, dry foot policy” that granted refugee status to each Cuban who reached US shores. Cubans intercepted at sea were returned to Cuba. The article shows contemporary situation of Cuban refugees fleeing the island as well as the historic background of the problem

    Przedmiotem niniejszego opracowania jest analiza ustawy o cudzoziemcach z 2013 roku, jako najnowszego dokumentu prawnego dotyczącego imigracji do Polski.     Opis:
    A careful analysis of the American immigration law points at two important tendencies. First, the directions for regulations concerning immigrants have been mainly formed on the federal level, while the state regulations had to accord with the rules established by the Congress. If the Supreme Court determined the constitutional range of guarantees granted to immigrants, it mainly decided on the division of competences then in force between the state and federal governments. Second, the interpretation of immigration law has depended on political factors, often described as ideological. On one had, these have been in line with the general direction of U.S. politics, on the other hand, they could have been subject to a more liberal or conservative approach to the scope of protecting immigrants' rights The aim of this paper is to depict the above-mentioned tendencies by means of an analysis of selected opinions of the United States Supreme Court, which due to their precedent character confirmed the direction of the state's policy concerning the status of immigrants. It is worth researching whether and how did the liberal or conservative sentiments of the Supreme Court Judges as well as the political interest of the governing administration affect the interpretations of the constitutional status of legal and illegal immigrants. For the purpose of this analysis over 30 opinions of the Supreme Court have been chosen. which in the author's opinion constitute the fundamental research material for evaluating the directions in which the constitution had been interpreted regarding the immigration of the American state.

    Recent years have witnessed the publication of a number of research papers and books seeking to assess threats of electoral victories of anti-establishment politicians and political parties, described as authoritarian populists. This essay focuses on three books directly addressing the origins and threats of authoritarian populism to democracy. It consists of six sections and the conclusion. The first section presents findings (Norris and Inglehart) based on surveys of values of voters of various age cohorts concluding that authoritarian populism is a temporary backlash provoked by the post-materialist perspective. The second section examines the contention, spelled out in Levitsky and Ziblatt, that increase in openness of American political system produced,  unintentionally, a degradation of the American political system. The third section continues brief presentations focusing on to the causes and implications of “illiberal democracy,” and “undemocratic liberalism” (Mounk). The fourth section examines developments in the quality of democracy in the world showing that despite the decline in Democracy Indices, overall there was no slide towards non-democratic forms of government in 2006–2019. The next two sections deal with dimensions missing in reviewed books; the notion of nation-state, international environment, civic culture and, in particular, dangers of radical egalitarianism to democracy. The last section concludes with regrets that the authors ignored rich literature on fragility of democracy and failed to incorporate in their analyses deeper structural factors eroding democracy: by the same token, return to the pre-populist shock trajectory is unlikely to assure survival of liberal democracy.

    At the turn of the 19th and 20th centuries, the American reform movements tried to match American ideals with the challenges of the times. Progressive attitudes highlighted the necessity of reforms. The Chinese issue, often risen in the public dialogue, was the subject of deliberation of the Supreme Court, the Congress, and the federal executive branch of government. Chae Chan Ping v. United States and subsequent cases established the doctrine of consular noneviewability referring to immigration law and delineating the scope of judicial review for decisions concerning the admission of immigrants to the United States. They also strengthened the plenary power doctrine. We may ask if the Supreme Court judgments were in conformity with the ideas of American Progressivism. Unfortunately, the Chinese Exclusion Cases were not compatible with the visions of progressive reformers and reflected anti-Chinese sentiment rather than an aspiration for reforms.
    Na przełomie XIX i XX w. ruchy reformatorskie w USA próbowały dopasować amerykańskie ideały do wyzwań czasu. Postępowe podejście podkreślało konieczność reform. Często podnoszona w dialogu publicznym kwestia chińska była przedmiotem rozważań Sądu Najwyższego, Kongresu i federalnej władzy wykonawczej. Chae Chan Ping v. United States i kolejne sprawy ustanowiły doktrynę consular non-reviewability odnoszącą się do prawa imigracyjnego i wyznaczającą zakres kontroli sądowej dla decyzji dotyczących przyjmowania imigrantów do Stanów Zjednoczonych. Wzmocniły one również doktrynę plenary power. Możemy postawić pytanie czy orzeczenia Sądu Najwyższego były zgodne z ideami amerykańskiego progresywizmu. Niestety, Chinese Exclusion Cases nie były kompatybilne z wizjami postępowych reformatorów i odzwierciedlały raczej antychińskie nastroje niż dążenie do reform.

    O Brasil está inserido em uma dinâmica migratória enquanto origem, passagem e destino de mo-vimentos migratórios. Nesse contexto, o aumento dos números de entrada em comparação com a segunda metade do século XX, a diversidade de origem desses migrantes, o fechamento de fron-teiras de antigos hostlands e a facilidade de entrar no país, aliado com a notoriedade que adqui-riu no Sistema Internacional nos últimos anos, fez com que o país se deparasse com uma nova realidade. O governo Rousseff deparou-se com um cenário no qual surgem os primeiros reflexos da entrada de haitianos, além de outros grupos, como os sírios e venezuelanos, além de localida-des asiáticas e africanas, as quais também tiveram um aumento na entrada de seus nacionais no Brasil. Essa situação teve continuidade durante a gestão de Temer e evidenciou a inadequação da política migratória brasileira, impondo aos governos a tomada de medidas no sentido de pro-curar estabelecer um viés de atuação pautado nos direitos humanos e nos ditames constitucio-nais. A metodologia utilizada recorre à literatura acadêmica pré-existente junto à coleta e análise de documentos oficiais, além de reportagens de veículos midiáticos que versem sobre o tema nos âmbitos nacional e internacional.
    Brazil is inserted in a migratory dynamic of origin, passage and destination of migratory movements. In this context, the increase of entry numbers compared to the second half of the twentieth century, the diversity of origin of these migrants, the closing of borders of former host countries and the ease of entering the country, combined with the notoriety acquired on the in-ternational stage in recent years, has forced the country to face a new reality. The Rousseff gov-ernment faced emerging reactions to the entry of Haitians, as well as other groups that had en-tered Brazil in larger numbers, such as the Syrians and Venezuelans, as well as Asians and Afri-cans. This situation continued during Temer’s administration and it evidenced the inadequacy of Brazilian migration policy; it forced governments to take measures to try to establish a plan of action based on human rights and constitutional dictates. The methodological approach was to consult pre-existing academic literature, as well as collect and analyze official documents and media reports on the subject, both national and international.
