In the doctrine of criminal law, the term “qualified attempt” denotes two cases. Firstly, the term “qualified attempt” describes a situation in which, when the perpetrator, in their intent to commit a criminal act, directly aims to commit it but does not succeed (attempt), while fulfilling all premises of another criminal act (commission). In the second case, the term “qualified attempt” describes a situation in which the attempt at the commission of a criminal act is covered by the impunity clause on the basis of active grief, while the act of the perpetrator needs to be classified as a commission of a different criminal act. The article, following a general overview of the literature on the subject, presents the author’s own understanding of the term “qualified attempt”, which consists in the differentiation among attempt, cumulatively qualified attempt with commission, and non-punishable attempt subsumed as a punishable commission.

The institution of attempt is used relatively frequently in the practice of justice system.Importantly, it always separates the punishable stage of attempt from punishable preparatory activities, and therefore constitutes the limit of criminalization. Despite its practical importance, using of the indicated legal structure, raises a number of doubts that are related to the proper interpretation of the normative concepts comprising it. A consequence is moving the limit of punishability of the crime by adjudicating authorities. It can raise some objections – from fundamental principle of criminal law inthe form of nullum crimen sine lege point of view. The article discusses the problems of that appear in jurisdiction in connection with the application of the attempt institution; these problems raise interest among doctrine. The author confronts irreconcilable judgments. The Author searches interpretative solutions that seem the most appropriate from theoretical and dogmatic structure of the successful attempt and inept attempt point of view.

This article attempts to assess the marketing strategies implemented by banks in Poland , especially after the Polish accession to the EU. It is a result of the analysis of secondary sources and the author’s own primary research (project funded by the State Committee for the Scientific Research). The author formulates the hypothesis that since 2003 marketing activities of banks and the effects of these activities have been systematically improving. The marketing strategies of banks in Poland, especially after accession to the EU can be described as professional. The expenditure on marketing research has been steadily growing. New innovative banking products have been widely introduced. Banks set prices for their products not only based on cost but also on the prices of competing products and, increasingly, demand forecasts . Various forms of distribution of banking products have developed, Internet channel being the one of the most intensely growing. Promotional activities were carried out professionally. It can be assumed that the marketing strategies of banks were one of the main factors positively influencing their financial performance and competitive position in the market .
Celem artykułu jest próba oceny strategii marketingowych realizowanych przez banki w Polsce, szczególnie po wejściu Polski do UE. Artykuł powstał w wyniku analizy źródeł wtórnych i własnych badań pierwotnych (projekt KBN). Sformułowano hipotezę, według której systematycznie od 2003 roku następuje poprawa jakości działań marketingowych banków w Polsce i efektów tych działań. Strategie marketingowe banków w Polsce szczególnie po wejściu do UE można określić jako profesjonalne. Systematycznie rosły nakłady na badania marketingowe. Wprowadzane były powszechnie nowe produkty bankowe. Banki ustalały ceny na swoje produkty nie tylko w oparciu o koszty, ale także na podstawie cen produktów konkurencyjnych i coraz częściej prognoz popytu. Rozwijały się różne formy dystrybucji produktów bankowych, a szczególnie intensywnie kanał internetowy. Profesjonalnie realizowane były działania promocyjne. Można przyjąć, że strategie marketingowe banków były jednym z głównych czynników wpływających pozytywnie na poprawę ich wyników finansowych i pozycji konkurencyjnej na rynku.

Wartością dodaną tekstu jest autorska propozycja pomiaru innowacji – harmonia, której zarys oraz wzór obliczania wartości innowacji stanowi wkład własny autora w poruszaną problematykę.
The article presents positions and proposals related to the concept of innovation, criteria divisions of innovations, features and the essence of innovation, the limits of its occurrence both in the organization and in the economy. The essential part is the analysis of the current achievements in the field of measuring innovation and innovation, attempt to divide and assign particular measurement tools to specific ones types of innovation and innovation areas. The added value of the text is the proposal to measure innovation – the harmony which outline and pattern of calculating the value of innovation is the author’s own contribution to the discussed issues.

Usiłowanie nieudolne, jako szczególna forma stadialna popełnienia przestępstwa, przy której sprawca nie zdaje sobie sprawy, że dokonanie jest ex ante niemożliwe z uwagi na brak przedmiotu lub brak środka nadającego się do popełnienia przestępstwa, stanowi źródło wielu – jak dotąd nierozwiązanych – dogmatycznych dylematów, z uzasadnieniem jego karalności na czele. Jednym z takich właśnie zagadnień jest dopuszczalność stosowania instytucji czynnego żalu wobec zachowania, które nawet gdyby sprawca go nie zaniechał, i tak nigdy nie sprowadziłoby niebezpieczeństwa dla dobra prawnego. Kwestia ta po raz kolejny pojawiła się w związku z ostatnią uchwałą Sądu Najwyższego z dnia 19.01.2017 r., w której Sąd analizował kryteria udolności usiłowania oraz dobrowolności odstąpienia. Autorka stara się wykazać, że po pierwsze nie ma żadnych przeszkód, by sprawca, który w swoim wyobrażeniu dobrowolnie odstąpił od dokonania lub zapobiegł skutkowi stanowiącemu znamię czynu zabronionego, mógł korzystać z takich samych przywilejów w zakresie odpowiedzialności karnej, co sprawca usiłowania udolnego (zwykłego), choć stosowanie przepisu art. 15 k.k. możliwie jest jedynie na zasadzie analogii. Po drugie, celem artykułu jest przybliżenie konstrukcji usiłowania chybionego, która pozwala na efektywniejsze i teoretycznie poprawniejsze rozwiązanie zarysowanych problemów.
Impossible attempt, as a special form of inchoate offences, where the offender fails to realise that the attempt could under no circumstances lead to the completion of the offence due to the nature of its object or the means by which it was to be committed, is a source of many unsolved dogmatic dilemmas, with the justification of its criminalization in the first place. One of such issue is the admissibility of applying the institution of “active regret” to behavior which, even if the perpetrator did not prevent its completion would never cause any danger to the legal good. This issue has once again appeared in connection with the last Supreme Court’s resolution of 19 January 2017, in which the Court analysed the criteria of the impossible attempt and the voluntariness of withdrawal. The author attempts to prove that, firstly, there are no reasons preventing one from treating an offender, who in his or her vision voluntarily gives up further execution of an offence or prevents its completion as the offender of effective (ordinary) attempt, although the application of Article 15 of the Criminal Code is possible only by analogy. Secondly, the objective of the paper is to explain in more detail the institution of failed attempt, which allows the outlined problems to be solved more effectively and in a more theoretically correct way.

This article presents for the first time a list of the possible archaeophytes from Iceland. In the present study, all the flowering plant taxa that are considered native/long established in Iceland were assessed against criteria designed to recognize possible archaeophytes. The assessment resulted in a list of 39 taxa meeting (or possibly meeting) at least one research criterion. Nineteen taxa were classified as possible archaeophytes, 10 were classified as non-natives of unknown age (due to the inability to classify them as neither archaeophytes nor neophytes using the available data), while the remaining 10 species were classified as uncertain (doubtfully native). The limitations of the present study in terms of both the methodology and the uncertainties connected with the classification of individual taxa are discussed.

Security and infrastructure are two closely related terms, which is why they are so often referred to at the same time. In today’s world, infrastructure is essential to ensure broadly understood security, and a lack of security will not fulfil its basic role. Today, identified threats and challenges to national security, and thus to the security of the state, evoke the need to participate in preparing all components of the defence system of the state. The management of state defence is a very complex process, requiring a properly prepared system to function reliably in times of peace, but also in times of crisis and war. Its role is to integrate individual elements of the defence system into a uniform and efficient whole. Effective defence activities and ensuring the security of its citizens and all its assets are the core activities of the state. The defence area of the state is now comprehensive in nature and is of interest to the entire apparatus of state power. The aim of the article is to present the role of the defence infrastructure in the life of the state, its relation to national security and an attempt to identify the defence infrastructure of the state, taking into account the key state infrastructure.

Celem tekstu jest ukazanie dyskursu o pokoleniach młodzieży, obecnego od co najmniej czterech dekad w naukach społecznych i humanistycznych. Przyjęta w niniejszym tekście cezura czasowa nie jest przypadkowa. Od połowy lat 60. młodzież urosła bowiem do rangi fenomenu społecznego, swoistej Teilkultur. Przyjęta w tekście perspektywa makrosocjologiczna wymagała przywołania wybranych koncepcji teoretycznych z zakresu socjologii młodzieży (T. Parsons, S.N. Eisenstadt, J. Habermas), ukazujących „młodość” jako odrębną fazę życia oraz „okres, w którym indywdualna historia przecina się z Historią” (Kłoskowska, 1987). Ukazany został także zarys filozoficznej (Ortega y Gasset), socjologicznej (Mannheim) i antropologicznej (M. Mead) refleksji nad problemem generacji. W tekście przywołuje się także szereg kontrowersji, narosłych wokół pojęcia pokolenia, m.in. jego zbyt „całościowy” i „kolektywny” charakter, medialne kreowanie oraz „urynkowienie” pokoleń. Czy problem generacji w tradycyjnym rozumieniu przestaje istnieć, ulega „postmodernistycznej destrukcji”? Tekst nie daje jednoznacznej odpowiedzi, a jedynie nakreśla pole badawcze i formułuje zasadnicze wątpliwości co do „naukowości” tego kuszącego pojęcia.

The main goal of the following article is to design an improved version of the negotiation game created by prof. Alan Fowler (Fowler, 1997). I have tried to achieve this by constructing four separate versions of the game which represent different approaches while preserving rules, chosen basic technical assumptions and the simplicity of the base game. Each version of the game is supposed to i.a. make it less obvious, create new negotiation possibilities (including potential cooperation), widen the course of action, make the game more enjoyable for the players and implement elementary mathematical foundation to the game's root (with regard to Game Theory). Firstly, the article presents the description and the analysis of the base game. Afterwards, the four versions are presented with the follow-up summary and recommendations. Additionally, the article is supported by interactive Excel spreadsheet which enables the reader to have a more detailed view into the analysis and to carry out their own. Since the game has not been created as a mathematical exercise, the strictly mathematical notions are very limited and simplified to make the article reader-friendly for wider audience.

In the sketch Sen sielski - an attempt at scrutiny Maciej Urbanowski tries to interpret the well-known poem by Czechowicz pointing out that a specific 'rhetoric of purity' is present in it. This rhetoric - that has been as yet seldom analysed - started appearing in the poetry of the author of dzień jak co dzień [a day like every day] in the second half of the 1930's. Urbanowski stresses that the motif of 'purification', around which the 'lyrical action' of Sen sielski is focused fits the poem in the pattern of 'pure poetry' that was intriguing for Czechowicz at that time, but also in the poet's personal mythology. Czechowicz's dramas written at the same time are also an important interpretation context for Sen.... This allows Urbanowski to look for manifestations of Czechowicz's religious anxieties in Sen sielski, including his often neglected ties to Catholicism, which at that very time became the subject of lively interest with writers, mainly owing to Maritain and his neo-Thomist aesthetics.

The paper deals with problems linked with calculating an equilibrium unemployment rate. Select issues concerning the theoretical aspects of the Phillips curve and Non-Accelerating Inflation Rate of Unemployment (NAIRU) estimation methods based on the Phillips curve are presented. An expectations-augmented Phillips curve was estimated using quarterly unemployment data, according to the Labor Force Survey (LFS) and core inflation excluding food and energy prices in 1995-2003. On this basis, a NAIRU level of around 12% was determined for the analyzed period using Elmeskov’s procedure. The NAIRU rate obtained in the research is similar to the equilibrium unemployment rate estimated by other authors who used unemployment inflow and outflow balance models. Poland’s NAIRU is at a high level. For example, in the United States, the corresponding rate runs at about 6%. Consequently, it is necessary to determine the causes behind this situation and take adequate measures do decrease NAIRU in Poland in the near future.

The penitential rite, describe in the Book of Leviticus, was performed in the earliest, ahistorical stage of development of the chosen nation. This rite was practised in the Salomon’s Temple and in local churches as well. Originally (Nb 28-29), there was no name for the rite, however the calling of assemblies is known in the seventh month, on the tenth day of the month. Definitively, the biblical scene of the penitential rite is presented in the Book of Leviticus (Lv 16). It is supposed that, the after-deportation text of Leviticus (chapter 16) is a sacerdotal halachic midrash of previous text (Lv 23; 26-32), which is based on different texts (Nb 28-29 and Ex 30). The whole text was supplemented with a penitential rite from the deportation time. Yet, the origin of the annual penitential rite remains unknown. If we acknowledge that the interpretation of the rite has survived throughout the centuries in apocryphal theology, then we can associate its origin with annual penitential rite of seminomadic Hebrew tribes. Hence, we can connect the feast with a hope of fulfillment the promise made by God with Abraham.

Opis:
Recent developments in Computer Assisted Language Learning (CALL) have led language teachers to engage in designing online learning activities to suit their learners’ particular needs by integrating current Web 2.0 tools into their teaching practices. This article will focus on the InGenio Authoring Tool and Learning Environment designed by the CAMILLE Research Group at the Universitat Politécnica (UPV) in Valencia, Spain and will describe one of the courses for learners of English designed and published on the Internet using this tool. To conclude, the article will refer to user satisfaction by discussing some of the findings resulting from evaluation questionnaires.

Nasal consonants feature in phonological systems of both Polish and Welsh, yet, apparently, they are active in a different manner and to a different degree. The paper aims fi rst at establishing the ‘players’ – the prototypical segments and their nonprototypical variants. The relevant inventories seem to be comparable, however, the contextually and non-contextually dependent realizations vary considerably in the two systems. Polish nasal consonants do not appear to have terribly complex phonology, their occurrence and phonotactics seems to be dictated through use (Bybee, 2001). Nasal segments in Welsh, on the other hand, are actively involved in the alternation of Initial Consonant Mutation, where they occur as strengthened equivalents of plosives through (possibly) assimilation (Buczek, 1995). It remains to be discovered whether nasals in general (and the so-called voiceless nasals in particular) are independent categories or rather, additionally they feature as nonprototypical variants of plosives. There is, indeed, substantial overlap here. Secondly, the paper looks at certain instances of what appears to be sonorant lenition in Welsh, where nasals [m] and [n] are broken into complex consonantal diphthongs [mh] and [nh] respectively (Pilch, 1975). In its entirety, this paper examines the two systems, hinting at the similarities and exploring the points of difference, especially in cases where the similar phonetic realizations possibly result from different categorical membership.
