The purpose of this paper is to draw attention to the nature of decisions issued by the President of the Office of Competition and Consumer Protection regarding the imposition of penalty payments on entrepreneurs for infringements of the Protection of Competition and Consumers Act of February 26, 2007, which is one of the indications of restrictions on economic freedom. Special attention has been paid to the criteria applied by the President of the OCCP for imposing penalty payments while indicating the changes introduced by amendments to the Act which came into force on January 18, 2015.

Opis:
The article presents issues related to the issuing of decisions by the President of the Office of Electronic Communications on matters laid down in Article 15 of the Telecommunications Law with the omission of a consultation procedure. According to the Telecommunications Law, the President of the Office of Electronic Communications, based on Article 17 of the above-mentioned Act, is eligible to take decisions without a consultation procedure. A decision in this mode cannot be issued for a period longer than six months. The article contains an analysis of specific decisions of the President of the OEC issued in this mode and judicial rulings. Furthermore, the article thoroughly analyses the requirements for departing from a consultation procedure and presents the course of a consultation procedure.
Przedmiotem artykułu są zagadnienia związane z wydawaniem decyzji przez Prezesa UKE w sprawach określonych w art. 15 ustawy Prawo telekomunikacyjne z pominięciem postępowania konsultacyjnego. Zgodnie z ustawą Prawo telekomunikacyjne, Prezes UKE, na podstawie art. 17 wskazanej ustawy, ma możliwość wydawania rozstrzygnięć bez przeprowadzania postępowania konsultacyjnego. Decyzja w tym trybie nie może być wydana na okres dłuższy niż 6 miesięcy. W artykule zanalizowano konkretne decyzje Prezesa UKE wydane w tym trybie oraz orzecznictwo sądowe. Ponadto dokonano szczegółowej analizy przesłanek pozwalających na rezygnację z postępowania konsultacyjnego oraz przedstawiono przebieg postępowania konsultacyjnego.

The aim of this case comment is to discuss whether it was justified that the General Court in its judgment dated 9 February 2022 in the case Sped-Pro (T-791/19) annulled the European Commission’s Decision No. C(2019) 6099 final dated 12 August 2019 r. (case AT.40459) connected to the potential abuse by PKP Cargo of a dominant position on the market for rail freight in Poland. In this judgement, the General Court argued on the basis of the rule of law principle and applied analogically the judgment on the European Arrest Warrant. In this regard, the analysis starts with the rule of law principle, the judicial independence of courts and administrative authorities, the obligation of loyal cooperation between European Union and member states to ensure fulfilment of the obligations arising out of this Treaty, both in the light of Union law and European courts case law.The next part of this case comment attempts to assess whether the General Court was justified in analogically applying the judgement dated 25 VII 2018 r. C-216/18 PPU Minister for Justice and Equality on the European Arrest Warrant in the field of European policy on competition. The analysis ends with the description of the practical consequences of the Commission’s finding that the President of UOKiK and the Court of Competition and Consumer Protection are not independent. In the last part of the text, the author also indicates the consequences of the proper implementation of the Directive ECN+ for analysing the scope of independence of the President of the Office of Competition and Consumer Protection. The author indicates the necessity to separate in future analysis the issue of the independence of the President of the Office of Competition and Consumer Protection (national administrative competition authority) and the Court of Competition and Consumer Protection, which in Polish is a common court.

Every action of the President of the Office of Competition and Consumer Protection [PL: Prezes Urzędu Ochrony Konkurencji i Konsumentów] must be taken in the public interest – the primary purpose of the antimonopoly regulation is to protect the business of entrepreneurs and consumers in the public interest. The President of the Energy Regulatory Office [PL: Urząd Regulacji Energetyki] is also governed by public interest activities. Under the applicable law, he is responsible for the development of competition, and one of his duties is to counteract the adverse effects of natural monopolies and balance the business of energy companies and fuel and energy consumers. In the Act on competition and consumer protection [PL: ustawa o ochronie konkurencji i konsumentów], the notion of public interest is defined very generally. However, the Act on Energy Law [PL: ustawa – Prawo energetyczne] precisely specifies which elements shall be taken into account by the President of the Energy Regulatory Office each time when making a decision. A number of his activities aim to balance the business of energy security with the protection of energy companies’ business and consumers’ business, including issuing decisions on approval of tariffs. The President of the Energy Regulatory Office ensures the implementation of the public interest in this respect, and such interest cannot be understood differently by another regulatory authority under another act. Otherwise, a violation of the axiological coherence of the legal system occurs. In this particular context (in terms of the implementation of the public interest), priority should be given to the utility regulatory authority (the President of ERO) and not to the antimonopoly authority. However, in this case, we are not dealing with a contradiction of the wording of the provisions but with a potential contradiction in terms of the understanding and application of the public interest premise. Therefore, the provisions of utility acts constitute a lex specialis in this respect to the Act on competition and consumer protection – taking into account this particular approach, such contradiction does not occur. Consequently, it should be concluded that if a given action of the President of ERO (an administrative decision issuance) implemented the public interest by the Act (and was maintained in legal transactions, was not repealed, etc.), it thus excludes the possibility of taking action by the President of the Office of Competition and Consumer Protection which was based on the need to protect this public interest.

Artykuł prezentuje od strony teoretycznoprawnej i praktycznej współpracę Prezesa UKE z Prezesem URE. W pierwszej części zostały zaprezentowane przepisy dotyczące współpracy obu organów oraz możliwe formy współpracy wypracowane przez doktrynę. Treścią drugiej części artykułu jest analiza przykładów współpracy Prezesa UKE z Prezesem URE opartych na następujących dokumentach: Memorandum w sprawie współpracy na rzecz przeciwdziałania zjawisku kradzieży i dewastacji infrastruktury (dalej: Memorandum) oraz Porozumieniu na rzecz likwidacji barier w inwestycjach telekomunikacyjnych i energetycznych (dalej: Porozumienie).
The article presents the collaboration of the President of UKE and the President of URE from a theoretical and a legal perspective. The first part of the paper discusses provisions concerning the collaboration of both bodies and the possible forms of collaboration developed by the doctrine. The second part deals with the analysis of examples of collaboration of the two sectorial regulators, the President of UKE and the President of URE, based on the following documents: Memorandum on the Collaboration for Counteracting the Phenomenon of Theft and Devastation of Infrastructure and the Agreement on the Elimination of Barriers in Telecommunication and Energy Investments.

Autor prezentuje historyczne unormowanie Prezydenta w polskim prawie konstytucyjnym okresu 1918–1939. Ukazuje ewolucję i specyficzne cechy instytucji, od urzędu Naczelnika Państwa w latach 1918–1922, przez ograniczone unormowanie Prezydenta w Konstytucji z 1921 r. i jej nowelizacji z 1926 r., aż po oryginalną koncepcję głowy państwa w Konstytucji z 1935 r. Podkreśla zarówno widoczny, niekiedy negatywny wpływ uwarunkowań personalnych na unormowania konstytucyjne w II Rzeczypospolitej, jak też znaczenie polskiej tradycji dla procesu tworzenia i treści obecnie obowiązującej Konstytucji z 1997.
The author presents the historical regulation of the President in the Polish constitutional law of the period 1918–1939. He shows the evolution and specific features of the institution, from the office of the Chief of State in years 1918–1922, through the limited regulation of the President in the Constitution of 1921 and its amendment of 1926, to the original concept of the head of state in the polish Constitution of 1935. The author notes the visible, sometimes negative impact of personal conditions on the regulations contained in the constitutions of the Second Republic, as well as the importance of Polish tradition for the process of creating and the content of the currently binding Constitution of 1997.

Głównym celem przedmiotowego artykułu jest przedstawienie roli Prezesa Urzędu Ochrony Konkurencji i Konsumentów w polskim systemie ochrony konkurencji i konsumentów. Poza wskazaniem głównych kompetencji tego organu, przybliżone zostaną jego konstytucyjne podstawy działania oraz tryb powoływania i odwoływania. Główna teza artykułu sprowadza się do tego, że Prezes UOKiK pełni zasadniczą, podstawową funkcję w sprawowaniu publicznoprawnej ochrony konkurencji i konsumentów. Jest to jedyny polski organ antymonopolowy, wyspecjalizowany dodatkowo w ogólnorynkowej ochronie słabszych uczestników rynku. Trzy główne obszary aktywności Prezesa UOKiK to: ochrona konkurencji, kontrola koncentracji przedsiębiorców, a także ochrona konkurencji. Dokonane ostatnio zmiany legislacyjne w zakresie kompetencji organu ochrony konkurencji i konsumentów potwierdzają jego istotny wpływ na kształtowanie zachowań rynkowych przedsiębiorców.
The subject matter of the article is the role of the President of the Office of Competition and Consumer Protection in the Polish competition and consumer protection system. The analysis shows competences of this authority, constitutional basis of the functioning of this body and the procedure of appointing and dismissing the President of the Office of Competition and Consumer Protection. The main thesis of the article comes down to a conclusion that the President of the Office of Competition and Consumer Protection has a fundamental function in competition and consumer protection which is undertaken in the public interest. It is the only Polish antitrust authority additionally specialized in the market-wide protection of weaker market participants. There are three main areas of activity of the President of the Office of Competition and Consumer Protection: competition protection, control over the concentration of entrepreneurs and consumer protection. Recently made legislative amendments show that the competition and consumer protection authority plays an important role in forming market behaviors of entrepreneurs.

W artykule autor skupia się na konstytucyjnej prerogatywie Prezydenta Rzeczypospolitej Polskiej jaką jest nadawanie statutu Kancelarii Prezydenta RP, która jest or-ganem pomocniczym prezydenta. Pierwsza części artykuł, odnosi się do podstawach prawnych nadawania statutu przez Prezydenta RP, natomiast w drugiej części autor, przedstawia poszczególne dokumenty z lat 1989–2017. W zakończeniu autor zwraca uwagę na podobieństwa oraz różnice w nadawanych przez Prezydentów RP statutach, w których określali Oni zasady funkcjonowania Kancelarii Prezydenta RP, która umożliwia prezydentom realizację założeń swojej prezydentury.
In this article, the author focuses on the constitutional prerogative of the President of the Republic of Poland, which is the granting of the statute of the President’s Chancellery. The aim of the article will be to analyze the individual statutes of the auxiliary body of the president, taking into account changes that have been made to the Law Office based on the documents issued. In the first part, the article refers to the legal basis for issuing statutes by the president, but the author in the subsequent parts focuses mainly on the analysis of documents issued by individual Presidents of the Republic of Poland.

This article is devoted to the issue of death as a premise for vacating the office of President of the Republic of Poland. The Constitution of the Republic of Poland comprehensively regulates the institution of substitution of the President of the Republic of Poland, specifying the legal forms of its execution and indicating the Marshals (of the Sejm and the Senate) as entities authorized to carry out the duties of the head of state. In the event of the occurrence of the death of the President, doubts arise as to the possibility of implementing civilian regulations at the time of triggering the procedure of substitution of the President provided for in Art. 131 of the Constitution. The analysis carried out in the article is aimed at answering the question of whether the Marshal of the Sejm (on whom the duty to assume the duties of head of state is incumbent), functioning in the field of constitutional law, is bound by the regulations applicable in principle on civil law grounds.
Niniejszy artykuł poświęcony jest problematyce śmierci będącej przesłanką opróżnienia urzędu Prezydenta RP. Konstytucja RP reguluje w sposób kompleksowy instytucję zastępstwa Prezydenta RP, określając prawne formy jej wykonywania oraz wskazując Marszałków (Sejmu oraz Senatu) jako podmioty uprawnione do realizacji obowiązków głowy państwa. W przypadku wystąpienia śmierci Prezydenta pojawia się wątpliwość co do możliwości wdrożenia regulacji cywilistycznych w momencie uruchamiania procedury zastępstwa Prezydenta przewidzianej w art. 131 Konstytucji. Przeprowadzona w artykule analiza ma na celu udzielenie odpowiedzi na pytanie czy funkcjonujący w obszarze prawa konstytucyjnego marszałek Sejmu (na którym ciąży obowiązek objęcia obowiązków głowy państwa) jest związany regulacjami obowiązującymi co do zasady na gruncie cywilnoprawnym.

Article 40 of the Energy Law Act of 10 April 1997 provides for the possibility for the President of the Energy Regulatory Office to order the continuation of economic activity by an energy company despite the expiry of a license. This is a special regulation related to the need to ensure the continuity of supplies and protection of recipients of energy services when required by social interest. Therefore, this regulation provides for an exception to the principle of the freedom to undertake, perform, and terminate economic activity. The purpose of this article is to draw attention to the fact that the necessity to ensure the provision of energy services in a continuous manner means that the state imposes an obligation on energy companies to continue economic activity, at the same time not guaranteeing the entrepreneurs sufficient compensation in the form of appropriate remuneration for continuing the economic activity. Pursuant to the provisions of the Energy Law Act of 10 April 1997, an energy company is only entitled to loss coverage and only in the amount limited to the justified costs of the ordered activity.

The goal of this paper is to analyse the prepared rights regarding supervision over maintaining of the administrator’s independence vested in the President of the Office of Rail Transport (UTK) in the light of the draft of amendment to the Law on railway transport. The regulations of the Law of 28th March 2003 on rail transport (consolidated text, Journal of Laws 2019, item 710) set the following tasks for the President of the Office of Rail Transport: supervision over fair and non-discriminating treatment of all applicants by administrators in relation to the access to the rail infrastructure and supervision over fair and non-discriminating treatment of all railway carriers in relation to the access to the service infrastructure objects by operators of service infrastructure objects. Currently, a draft of the Law on amending the Law on railway transport and the Law on commercialisation and restructuring of the state company “Polish National Railways” (UC 139) is proceeded, which extends the catalogue of tasks and competences of the President of the Office of Rail Transport.
Celem opracowania jest analiza projektowanych uprawnień w zakresie nadzoru nad zachowaniem niezależności zarządcy przysługujących Prezesowi Urzędu Transportu Kolejowego w świetle projektu nowelizacji ustawy o transporcie kolejowym. Przepisy ustawy z dnia 28 marca 2003 r. o transporcie kolejowym (tekst jedn. Dz.U. 2019, poz. 710) nakładają na Prezesa UTK takie zadania jak nadzór nad sprawiedliwym i niedyskryminującym traktowaniem przez zarządców wszystkich aplikantów w zakresie dostępu do infrastruktury kolejowej oraz nadzór nad sprawiedliwym i niedyskryminującym traktowaniem przez operatorów obiektu infrastruktury usługowej wszystkich przewoźników kolejowych w zakresie dostępu do obiektu infrastruktury usługowej. The article presents educational and informative actions taken up by the President of the Office of Electronic Communications aimed at increasing the awareness of consumers and developing pro-competition attitudes of telecommunications service provides. The detailed description includes such initiatives as the Programme for Certification of Telecommunications Services, realised in five categories, and the Centre for Consumer Information, including a website and a consumer hotline.

Po rozpadzie w sierpniu 1991 roku ZSRR i powstaniu na jego terenie nowych suwerennych państw wszystkie z nich w ciągu kilku lat powołały do życia urząd prezydenta. Instytucja ta okazała się dla nich bardzo atrakcyjna z różnych przyczyn: miała zapewnić stabilność polityczną w warunkach radykalnych transformacji ustrojowych, ułatwić przejście od autorytaryzmu ku demokracji, legitymizować polityczno-prawny status dawnej radzieckiej rządzącej nomenklatury. W latach niepodległości w państwach postradzieckich instytucja prezydenta przybrała różne formy. Spora część państw postradzieckich wybrała prezydencką formę ustroju poniekąd z elementami autorytarnymi, co znalazło odzwierciedlenie w dążeniu do stałego wzmacniania roli tej instytucji. Nieco mniej państw wybrało mieszaną formę ustroju, w której pozycja prezydenta jest w dużej mierze uzależniona od bilansu wewnętrznych sił politycznych. Ogromną rolę w określeniu wpływu instytucji prezydenta na system sprawowania władzy w państwach postradzieckich odgrywa zjawisko personifikacji instytucji prezydenta. Najmniej popularna jest parlamentarna forma ustroju, która chociaż zachowuje instytucję prezydenta, to jednak wyposaża ją w bardzo skromne kompetencje.
After the collapse of the USSR in August 1991 and the emergence of new sovereign states on its territory, they all formed the office of the president within a few years. It became very attractive to them for a number of reasons: it was able to guarantee political stability in the face of radical transformations of their systems, to facilitate the transition from authoritarianism to democracy, and to legitimize the political and legal status of the former Soviet ruling elites. During the years of independence, the presidency has taken various forms. A large part of post-Soviet states chose the presidential form of government in some places with signs of authoritarianism, which was reflected in the desire to constantly strengthen the role of this office. Few states have chosen a mixed form of government in which the office of the president is largely influenced by the balance of domestic political forces. The phenomenon of its excessive personification plays an important role in determining the influence of the president on the functioning of public authorities in post-Soviet countries. The least popular is the parliamentary form of government, in which the office of the president is left with very limited powers.

Resolution of Civil-Law Disputes by Means of the Administrative Decision of the President of the Energy Regulatory OfficeThe purpose of this article is to present the process of resohdng civil-law disputes by the President of the Energy Regulatory Office by means of an administrative decision under the Energy Law Act. In accordance with the provisions of Article 8(1) of the Energy Law Act, The President of the Energy Regulatory Office is authorised to re-solve disputes referred to in that provision which inherently belong to matters of civil law. Pursuant to Article 2(1) of the Code of Civil Procedurę, civil matters arę heard by common courts of law, except for those delegated to other bodies in special provisions referred to in Article 2(2). An example of such a special provision is Article 8 of the Energy Law Act, which excludes the admissibility of court proceedings in certain disputes to be resolved by the President of the Energy Regulatory Office. Thus, cases of disputes referred to in Article 8 of the Energy Law Act involve on the one hand a strictly civil law dispute and on the other a public authority (central government authority) which is to settle this dispute in a manner appropriate for it using its powers and non-equivalence of entities. Conseąuently, the civil-legal relationship characterised by voluntariness and equivalence of entities is shaped imperatively and unilaterally by a public authority by means of the administrative decision.
