    This article aims to draw up a summary of effects of literature studies in the field of substance, classification and characteristics of telecommunications services. Thus, the article includes definitions of telecommunication, services, and in consequence also the definition of telecommunications services. Analysis of the definition also includes art. 2 of the Act of 16 July 2004 on Telecommunication Law. In article is presented the role of telecommunications services, classification of telecommunications services in terms ofvarious criteria (subject of the service, characteristics perceived by subscriber, user of the service, kind of telecommunications network) and other aspects of the economics of these services.

    Artykuł poświęcony jest skutkom uznania usługi rozprowadzania programów za usługę telekomu-nikacyjną, co nastąpiło w wyniku orzecznictwa sądowego i zmiany stanowiska regulatora rynku. Zmiana nastąpiła w celu zapewnienia abonentom takiej ochrony, jaka przysługuje użytkownikom usług telekomunikacyjnych, choć wbrew utrwalonej, literalnej wykładni przepisów unijnych i kra-jowych. Poza oczekiwanymi zmianami dotyczącymi relacji prawnych między dostawcą usług a abonentem, ujawniły się również nieoczekiwane skutki nowej interpretacji, dla których brak od-powiedniego uzasadnienia celowościowego. Artykuł analizuje uboczne skutki tych zmian, które wykraczały zasadniczy cel nowej interpretacji oraz proponuje rozwiązania powstałych problemów, w szczególności dotyczących opłaty telekomunikacyjnej oraz pokrywania kosztu usługi powszechnej.
    The Article concerns the consequences of declaring the service of ‘providing television services to subscribers’ to be a ‘telecommunications service’, which resulted from judicial developments as well as from a statement of the Telecommunications Regulator. The change was meant to provide subscribers of television services with legal protection corresponding to that available to subscribers of telecommunications services, breaking free from the established, literal interpretation of EU and national law. However, apart from the expected changes concerning the relationships between service providers and subscribers, the paper shows also the unexpected results of the new interpretation which, in turn, do not have the necessary justifications. The Article analyzes the side effects of the new interpretation, which exceeded its main goal, and proposes solutions to emerging problems in particular in relation to the telecommunications fee and covering the costs of universal services.

    Przedmiotem artykułu jest omówienie zagadnienia kwalifikacji działalności przedsiębiorcy jako działalności telekomunikacyjnej w rozumieniu przepisów ustawy Prawo telekomunikacyjne. Pomimo prawnych definicji poszczególnych rodzajów działalności, określenie statusu szeregu usług świadczonych z wykorzystaniem sieci telekomunikacyjnych nastręcza istotnych problemów praktycznych. Niesie to za sobą ryzyka dla przedsiębiorców związane z brakiem uzyskania stosownych uprawnień do prowadzenia działalności telekomunikacyjnej, pomimo istnienia takiego obowiązku, lub z uzyskaniem wpisu do rejestru przedsiębiorców telekomunikacyjnych dla działalności, która nie stanowi działalności telekomunikacyjnej. Pojawiające się nowe rodzaje działalności oraz rozwój nowych technik komunikacji jedynie pogłębiają powyższy problem. Częściowego wyjaśnienia oraz dodatkowych wskazówek w zakresie wykładni prawnych definicji poszczególnych rodzajów działalności telekomunikacyjnej dostarcza orzecznictwo Trybunału Sprawiedliwości Unii Europejskiej. W wielu przypadkach to przedsiębiorca jednak musi podjąć stosowną decyzję dotyczącą zgłoszenia swojej działalności do rejestru przedsiębiorców telekomunikacyjnych. Wprowadzenie nowych kategorii usług łączności elektronicznej w przepisach Europejskiego Kodeksu Łączności Elektronicznej, przy pozostawieniu dotychczasowych niejasności definicyjnych, nie tylko nie eliminuje powyższego problemu, ale może go nasilić. Celem artykułu jest próba wyjaśnienia wątpliwości interpretacyjnych, co pozwoli nakreślić linię demarkacyjną pomiędzy regulowaną działalnością wymagającą dokonania wpisu do rejestru przedsiębiorców telekomunikacyjnych a działalnością pozostającą poza zakresem przepisów ustawy Prawo telekomunikacyjne. W pracy zastosowano metodę dogmatycznoprawną przy analizie piśmiennictwa i orzecznictwa krajowego, a pomocniczo również orzecznictwa sądów unijnych.
    The article aims to present the issue concerning the classification of entrepreneurs’ activities consisting in a telecommunications activity within the meaning of the provisions of the Act of 16 July 2004: Telecommunications Law. Despite the legal definitions of specific types of activities, determining the legal status of many services provided with the use of telecommunications networks poses significant practical problems and, consequently, increases risks for entrepreneurs as they lack the appropriate authorisation to conduct telecommunications activities required by regulations or obtain entry into the register of telecommunications entrepreneurs for an activity that is not telecommunications. The emergence of new activities and the development of new communication techniques only increase the above-mentioned problem. Partial explanation and additional guidance on the interpretation of legal definitions of specific types of telecommunications activities are provided by case law of the Court of Justice of the European Union. However, in many cases, it is an entrepreneur who eventually has to make the appropriate decision regarding notification of his activity to the registry of telecommunications entrepreneurs. New categories of electronic communications services introduced by the regulations on the European Electronic Communications Code do not solve the problem and even increase it due to definition-related ambiguities left unresolved. The article makes an attempt to clarify interpretative doubts in order to allow defining a demarcation line between regulated activities requiring entry into the register of telecommunications entrepreneurs and activities remaining outside the scope of the provisions of the Telecommunications Law.

    Przedstawiono wybrane aspekty powszechnej usługi telekomunikacyjnej w polityce Unii Europejskiej, ze szczególnym podkreśleniem znaczenia tej usługi w programie kształtowania europejskiego społeczeństwa informacyjnego na obecnym etapie. Korzystając z dokumentów UE, omówiono podstawowe właściwości usługi powszechnej, zwracając uwagę na jej aspekty społeczne oraz umocowanie prawne w polityce organów państwowych. Przeanalizowano także wnioski wynikające z nowego pakietu regulacyjnego dla rynku komunikacji elektronicznej w kwestii usługi powszechnej w telekomunikacji. Ponadto scharakteryzowano stan prawny usługi powszechnej w Polsce na tle rozwiązań wspólnotowych, ukazując występujące rozbieżności dotyczące określenia usługi, obowiązku jej świadczenia oraz zasad finansowania. Zaproponowano sposób postępowania przy pracach nad dostosowaniem polskiego prawa telekomunikacyjnego do prawa wspólnotowego w kwestii usługi powszechnej.
    The paper presents selected aspects of the universal telecommunications service in European Union policy, with particular emphasis on the significance of this service on the programme for shaping the European information society at the current stage. The basic properties of the universal service have been described with the use of EU documents with particular emphasis on the social aspects and the legislative authority of the policies of state authorities. The conclusions arising from the new regulatory package for the electronic communications market has also been analysed in terms of the universal telecommunications service. Furthermore, the legal status of the universal service in Poland have been characterised in comparison with Community solutions, illustrating the differences that exist in the definition of the service, the duty to provide them and the principles its financing. A method of proceeding has been proposed in the work on adjusting Polish telecommunications law to Community law on the matter of universal service.

    The European Commission, European Maritime Safety Agency (EMSA) and Member States of the European Union have expanded the scope of operation of the Vessel Traffic Monitoring and Information System (VTMIS). This project was established in accordance with the requirements of the Directive 2002/59/EC of 27 June 2002. Part of these measures are currently implemented in Poland and are co-financed by the European Union (EU) project entitled “National Maritime Safety System – KSBM”. It is implemented with a time delay in two stages: KSBM-I and KSBM-II. KSBM-I was located on the main list of individual projects of the Operational Programme “Infrastructure and Environment” for 2007–2013. The project is realised with the support of EU funds financed in the Priority VII “Environmentally-friendly Transport” under Measure 7.2 “Development of Maritime Transport”. The works were and are based on contracts signed 28.02.2011 (Stage I – KSBN-I) and 20.12.2012 (Stage II – KSBN-II). The first stage involved the purchase and installation of radar, computer and radio equipment and construction of radio communication network. The second was related mainly to the wire communication network. The system covers Polish coastal waters and seaports from Szczecin and Świnouj- ście to the border with the Kaliningrad Region. This paper presents concept of the system and the state of its implementation.

    In this paper, a general framework for modelling stochastic service curves for communication networks is presented. It connects with each other two approaches to the traffic analysis and performance evaluation of communication systems, namely, the one which is called a deterministic network calculus with its stochastic counterpart. Thereby, it enables to treat any communication traffic in a consistent way. Further, as we show here, it enables also achieving new results. Derivation of the above model is presented in details in this paper. Finally, some hints are given how the method presented in this article could be applied in maritime telecommunications area.

    The telecommunications industry in last decade went through the dramatic changes motivated by mobility, wireless technologies and miniaturization. The continuous increase in the complexity and the heterogeneity of healthcare telecommunications infrastructures requires reliable methodology to assess the quality of service provision. This article presents a cost effective methodology to assess the user's perception of quality of service provision utilizing the existing Staffordshire University network by adding a component of measurement to the existing model presented by Walker. This paper offers a cost effective approach to assess the QoS provision within the University campus network, which could be easily adapted to any campus network or healthcare organization in the world.

Do porównania cen za usługi telefoniczne i ich struktury w poszczególnych krajach wykorzystano metodę koszykową OECD.
    The paper presents price comparison of PSTN services provided by the fixed network in Poland, with focus on price changes in 2004 in relation to prices of similar services in the EU countries. The OECD basket method has been used to compare prices of telephone services and their structure in selected countries.

    Omówiono zachodzące zmiany na rynku usług telefonicznych w Unii Europejskiej, ze szczególnym uwzględnieniem rozwoju telefonii ruchomej, oraz przedstawiono wynikające z tego wnioski dla zawartości usługi powszechnej w telekomunikacji. Podkreślono, że malejące znaczenie usług telefonii stacjonarnej przy powszechnej dostępności usług telefonii ruchomej wskazuje na potrzebę przeanalizowania formuły usługi powszechnej pod kątem zasadności zachowania obligatoryjnego dostępu do usług telefonii stacjonarnej oraz wprowadzenia w miejsce obecnej usługi powszechnej dwu odrębnych usług: usługi socjalnej oraz usługi cywilizacyjnej w telekomunikacji. Ponadto zwrócono uwagę na potrzebę regionalizacji rozwiązań prawnych dotyczących usługi powszechnej w UE. Podkreślono, że podstawowe zalecenia dyrektywy 2002/22/EC o usłudze powszechnej pozostają w ścisłym związku z potencjałem społeczno-gospodarczym krajów wysoko uprzemysłowionych w Unii Europejskiej przed jej rozszerzeniem. Przeanalizowano specyfikę problematyki usługi powszechnej w nowo przyjętych państwach członkowskich UE, zwracając uwagę na niski wskaźnik zamożności społeczeństw oraz niedorozwój infrastruktury stacjonarnej przy jednoczesnym szybkim rozwoju telekomunikacji ruchomej w tych krajach, co powinno być brane pod uwagę przy opracowywaniu koncepcji usługi powszechnej dla tego regionu.
    Changes in telecommunications services in the European Union with the attention paid to mobile telephony hale been discussed showing their impact on universal service content. Decreasing importance of fixed telephony and at the same time ubiquitous access to mobile telephony services suggests necessary re-assessment of the universal service formula with guaranteed access to fixed telephony services and replacement of the current universal service by two separate types of services: social service and civilization service in telecommunications. Additionally, there is need for regionalization of legal framework for universal service in the EU. It has Bern pointed out that basic regulations of the 2002/22/EC directive on universal service are closely connected with the socio-economic potential of the highly developed countries of the EU before its extension. Specific aspects of the universal service in newly joined countries have been analyzed revealing theirs low wealth index and undeveloped fixed-line infrastructure simultaneously with fast developing mobile telecommunications, which should have impact on the concept of universal service for this region.

    Przedstawiono wpływ regulacji konkurencji, zgodnie z postanowieniami pakietu regulacyjnego 2002, na podejmowanie nowych inwestycji typu greenfield, niezbędnych do realizacji nowego etapu strategii lizbońskiej i2010. Scharakteryzowano w zarysie zasady regulacji konkurencji na rynku komunikacji elektronicznej na obecnym etapie, z uwypukleniem szczególnej roli konkurencji usługowej oraz zależności między realizowaną polityką regulacyjną a inicjatywami inwestycyjnymi i innowacyjnymi operatorów. Na podstawie analizy dokumentów, wypowiedzi oraz materiałów prasowych zaprezentowano krytyczne spojrzenie na regulację konkurencji w nowych warunkach biznesowych w Unii Europejskiej, zwracając przy tym szczególną uwagę na rozwój usług dostępu szerokopasmowego.
    According to the 2002 regulatory package the influence of the competition regulation on the undertaking of new "greenfield" investments has been presented as being necessary to fulfill the next phase of the Lisbon strategy i2010. Current principles of competition regulation of the electronic communications market have been briefly characterised, pointing out special role of the service competition and interrelations between current regulatory policy and infrastructure investments and innovative initiatives of the operators. Analysis of the available documents, statements and press articles has led to a critical view on the competition regulation in the new business conditions in the EU, with special attention paid to evolution of broadband services.

    The United States Secret Service is an American federal law enforcement agency that is part of the U.S. Department of Homeland Security. Until March 1, 2003, the Secret Service was part of the U.S. Department of the Treasury. The Secret Service has two distinct areas of responsibility: (1) Financial Crimes, covering missions such as prevention and investigation of counterfeiting of U.S. currency and U.S. treasury securities, and investigation of major fraud; (2) Protection, which entails ensuring the safety of current and former national leaders and their families, such as the President, former presidents, vice presidents, presidential candidates, visiting heads of state and foreign embassies. Protecting national leaders, visiting heads of state and government, designated sites and National Special Security Events has become more complex with the evolution of conventional and non-conventional weapons and technology. In meeting new challenges, the Secret Service will continue to provide progressive training, devise and implement sound security plans, measures, equipment and systems to ensure the safety of individuals, sites and events under Secret Service protection. The Secret Service’s unique investigative and protective mission is sustained by a strong, multi-tiered infrastructure of science, technology and information systems; administrative, professional and technical expertise; and management systems and processes.

    Autor analizuje porozumienie w sprawie jakości usług telekomunikacyjnych zawarte w październiku 2012 r. pomiędzy Prezesem UKE a dostawcami usług telekomunikacyjnych jako przykład sankcjonowanej samoregulacji sektorowej. W artykule przeanalizowane zostały zarówno przyczyny podjęcia dobrowolnych zobowiązań przez dostawców usług, jak i przyczyny ich usankcjonowania przez Prezesa UKE. Autor próbuje ocenić charakter prawny zawartego porozumienia, a także ustalić, na ile spełnione zostały oczekiwania Prezesa UKE co do zmniejszenia asymetrii informacyjnej istniejącej pomiędzy regulatorem a podmiotami regulowanymi.
    Author analyses the agreement on telecommunications services quality, concluded in October 2012 between the President of UKE and service suppliers as a form of sanctioned self-regulation. In this article the reasons for undertaking this voluntary commitment by industry have been analyzed as well reasons for their sanctioning. The author tries to establish the legal nature of the concluded agreement and assess if the expectations of the President of UKE as to the reduction of informational asymmetry have been met.

    Przedstawiono oceny i postulaty zgłaszane przez uczestników rynku komunikacji elektronicznej w trakcie etapu konsultacyjnego przeglądu ram prawnych dla tego rynku, które zostały udostępnione przez Komisję Europejską. W analizie wyodrębniono cztery podstawowe zagadnienia: ocenę funkcjonowania pakietu regulacyjnego 2002, postulaty w sprawie otoczenia prawnego, wpływ regulacji na inwestycje infrastrukturalne i innowacje, separację funkcjonalną. W materiałach respondentów zwrócono przede wszystkim uwagę na bardziej rozwinięte, uszczegółowione oceny i postulaty, zawierające opis problemu oraz uzasadnienie prezentowanego stanowiska. Podkreślono różnorodność opinii w sprawie oceny dotychczasowego dorobku regulacyjnego oraz postulowanych zmian w przyszłości, a zwłaszcza wyraźną różnicę stanowisk w sprawie podstawowych celów regulacji, instrumentów realizacji i okresu obowiązywania sektorowej regulacji ex ante. Do prawidłowego ukierunkowania zmian w ramach regulacyjnych jest konieczne przeanalizowanie i uwzględnienie różnych, często sprzecznych, stanowisk uczestników rynku, gdyż są one istotne do właściwego zrozumienia czynników sterujących rozwojem sektora komunikacji elektronicznej.
    This paper presents opinions and postulates put forward by electronic communications market players during regulatory framework consultations and recently released by the European Commission. The analysis concentrates on four basic aspects: assessment of 2002 regulatory package, suggestions towards legal environment, impact of regulations on infrastructure and innovation investments, and functional separation. Responses containing detailed opinions and postulates with problem descriptions and background of the views presented allow for deeper analysis, showing variety of opinions on present regulatory heritage and proposed future changes. The most diverse opinions relate to basic regulatory goals, their implementation instruments and periods of validity of ex ante sector regulation. In order to correctly shape changes within regulatory framework it is necessary to take into consideration and analyze often contradicting opinions of market participants, because it is important for proper understanding of steering factors in the development of electronic communications market.
