Opis:
W 1919 r. na mocy dekretu Tymczasowego Naczelnika Państwa ustanowiono w ustroju państwa polskiego Prokuratorię Generalną Rzeczypospolitej Polskiej. Sejm Ustawodawczy uchylił dekret i zastąpił go ustawą. Nowy porządek prawny pozwolił objąć ochroną prawną udzielaną przez Prokuratorię Generalną, obok majątku Skarbu Państwa, także majątek kolei państwowej. Aktywność Prokuratorii w ramach czynności służbowych obejmowała zastępstwo prawne oraz konsultacje prawne. W ramach agendy kolejowej zajmowano się interpretacją prawa regulującego ustrój kolejowy państwa, a także własnością i zobowiązaniami kolei oraz ochroną interesu publicznego związanego z działaniem kolei państwowych.
The General Counsel’s Office of the Republic of Poland came into existence by a decree of the Chief of State on 7th February, 1919. On July 31, 1919, the Parliament revoked the decree of the Chief of State and passed the appropriate bill. The General Counsel’s Office of the Republic of Poland protected the public and property interests of the Treasury and the Polish State Railways. The judicial replacement and legal opinion were provided in such matters as the interpretation of the law, the property, obligations and the protection of the public and property interests of Polish railways.

Opis:
The subject of the study is to present the evolution of the legal need to protect goods and interests remaining after the partition of the Poland. The necessity of such protection appeared even in the pre-partition period. However, the specific form of institutional protection of Polish goods and interests, for the first time, took place in the Duchy of Warsaw, and then in 1816, in the Kingdom of Poland. The aim of this study is to demonstrate the positivist work of the Polish elite to protect what remains aft er the partitions with the hope of building a material foundation for an independent homeland. The author does not undertake an in-depth discussion on the status of the Kingdom of Poland. The work is based mainly on the analysis of the constitution of the Kingdom of Poland of 1815 and the decision of the Tsar of Russia of 1816 to establish the General Counsel’s Office. In addition, the views of the doctrine on the subject were referred to. As a final conclusion, we should point to the statement of the positive role played by the General Counsel’s Office of the Kingdom of Poland.
W artykule ukazano ewolucję potrzeby prawnej ochrony dóbr i interesów Rzeczypospolitej Polskiej po rozbiorach. Konieczność takiej ochrony pojawiła się jeszcze w okresie przedrozbiorowym, jednak konkretnej formy instytucjonalnej nabrała ona najpierw w Księstwie Warszawskim, a następnie w 1816 r. w Królestwie Polskim. Celem tego opracowania jest wykazanie pozytywistycznej pracy elit polskich nad ochroną tego, co pozostało po rozbiorach – z nadzieją budowania materialnego fundamentu pod niepodległą ojczyznę. Autor nie podejmuje pogłębionej dyskusji nad statusem Królestwa Polskiego. Praca opiera się głównie na analizie przepisów konstytucji Królestwa Polskiego z 1815 r. oraz postanowienia cara Rosji o utworzeniu Prokuratorii Generalnej z 1816 r. Ponadto przywoływane zostały poglądy doktryny z zakresu tematu. We wnioskach końcowych należy wskazać pozytywną rolę, jaką odegrała Prokuratoria Generalna Królestwa Polskiego

Opis:
W lutym 1919 r. na mocy dekretu Tymczasowego Naczelnika Państwa Józefa Piłsudskiego utworzono Prokuratorię Generalną Rzeczypospolitej Polskiej. Sejm Ustawodawczy uchwaloną w lipcu 1919 r. ustawą utrzymał w ustroju państwa Prokuratorię i scentralizowany model ochrony interesów prawnych i majątkowych państwa. Sejm Ustawodawczy powierzył Prokuratorii także ochronę interesów majątkowych kościołów. Ochrona Prokuratorii przyjmowała postać pomocy prawnej w drodze zastępstwa prawnego lub czynności konsultacyjnych albo opiniodawczych. Ochrona Prokuratorii, traktowana przez kościoły jako forma nadzoru państwowego, została zniesiona w 1926 r. Agendę prowadzoną przez Prokuratorię po 1925 r. w kategorii określanej jako sprawy wyznaniowe wypełniały czynności zmierzające do ochrony interesów publicznych i majątkowych państwa w stosunkach z kościołami i innymi związkami religijnymi.
The General Counsel’s Office of the Republic of Poland came into existence be a decree of the temporary Chief of State Józef Piłsudski on 7 February 1919. Six months later, on 31 July 1919, the Polish parliament revoked the decree and passed a new law establishing a centralized model for the protection of the legal and property interests of the state and churches. Protection afforded by the General Counsel’s Office of the Republic of Poland had the form of legal representation and legal opinions. This protection, regarded by the churches as a form of state’s supervision, was abolished in 1926. After 1925 the affairs of the Orthodox Church, Evangelical Churches, and Jewish religious communities were narrowed down to the protection of the state’s public and property interests in relation to the churches.

The paper argues that the original normativity that provides the basis for Habermas’s model of the public sphere remains untouched at its core, despite having undergone some corrective alterations since the time of its first unveiling in the 1960s. This normative core is derived from two individual claims, historically articulated in the eighteenth-century’s “golden age” of reason and liberty as both sacred and self-evident: (1) the individual right to an unrestrained disposal of one’s private property; and (2) the individual right to formulate one’s opinion in the course of public debate. Habermas perceives the public sphere anchored to these two fundamental freedoms/rights as an arena of interactive opinion exchange with the capacity to solidly and reliably generate sound reason and public rationality. Despite its historical and cultural attachments to the bourgeois culture as its classical setting, Habermas’s model of the public sphere, due to its universal normativity, maintains its unique character, even if it has been thoroughly reformulated by social theories that run contrary to his original vision of the lifeworld, organized and ruled by autonomous rational individuals.

The article concerns the issue of common good in the activity of public administration. It is exactly the aspects of this “good” which have a direct influence on the motives behind administrative actions. It turns out that what is “common” can be understood as pertaining to entire society, but also in relation to individual interests. The public administration, although traditionally connected only to the public interest, also implements the good of the individual and this not only indirectly, as it has been noted in the literature of the subject so far, but also independently. Because the common good has its different aspects in the sense that it does not have to mean only values of a strictly general dimension. This may be significant for the definitional purpose to the very administration itself and testifies, at the same time, to the multidimensional nature of contemporary public administration. The considerations are developed with reference to potential relations of public interest and the individual one, in which the most important place is occupied by conflict of these interests.

The inclusiveness of education drives sustainable public relations for reliable crime statistics report is determined by power play among critical actors in the sector whose interest are dichotomized into vested and entrenched interests that shaped public opinion on education and crime rate. Access to education can only be inclusive when all stakeholders are involved in its planning, execution and delivery of knowledge in a manner that does not discriminate in access and delivery. However, there is a disconnect between what knowledge is allowed to feed public opinion using public relations by the entrenched and vested interest in the education and law enforcement sectors. While clamor for inclusive education heighten across social class, the cost component of access is not accessible to all. Therefore, the paper argues that deepening equity and inclusiveness in education and law enforcement will neither allow access discrimination nor spurious reportage within the public domain using public relations. It further posits that disparage public opinion on education and law enforcement using public relation mutilate reality and creates false impression that negatively affect planning and development. Edwin Sutherland (1947)`s Differential Association-reinforcement theory of criminal behavior provided the framework while the design was exploratory. Qualitative data was purposively gathered from National Open University of Nigeria (NOUN), University of Abuja (UA), and Divisional Police Headquarters Lugbe. The preliminary fi ndings reveal that equity and inclusive education is necessary sustain objective public relation that will not misguide professional and public on crime statistics in Nigeria.

The paper presents the results of the research on the implementation of group interests in the legislative process in Poland, made on a sample of 1365 laws passed in 1990- 2011. Two mutually related questions are analyzed: the state of the Polish legislation and the impact of various interest groups on the shape of law. The results of the research do not give a direct insight in the process of the legislative lobbying; they only document the fact of the existence of certain privileges in the law, favouring some interest groups at the expense of the whole society. The results of the analysis indicate that the legislative process is significantly influenced by such factors as current economic situation in the country, the state of public finance, time distance to the next parliamentary election, and the political position of the person that performs the function of the minister of finance.
В статье представлены результаты исследования вопроса реализации групповых интересов в процессе законотворчества в Польше на основе анализа 1365 законов, принятых в 1990-2011 гг. Авторы анализируют два взаимосвязанных аспекта: состояние польского законодательства и влияние групп интересов на содержание законов. Результаты исследования не дают прямого ответа на вопрос о способах лоббирования законов, но доказывают факт наличия привилегий в законах для некоторых групп за счёт всего общества. Полученные результаты указывают, что существенное влияние на создание законов оказывает актуальная экономическая ситуация страны, состояние публичных финансов, близость или отдаленность во времени ближайших парламентских выборов, а также политическая позиция лица, которое в данный момент занимает должность министра финансов,

Autor stawia tezę dotyczącą kulturowych źródeł strukturalnych cech obecnej postaci systemu reprezentacji interesów grupowych w Polsce. Wskazuje na znaczenie czynników długiego trwania. Szczególną rolę przypisuje myśli i ideologii romantycznej, która okazała się trwałym wpływem w Polsce. Wytworzyła trajektorię, na której kształtowały się pojęcia i instytucje, w tym pewne odruchowe reakcje w sferze relacji między grupami interesów. Zaowocowały one specyficznym podejściem do przetargów interesów. Kluczowe było to, że ta ideologia daleka była od rozumienia społeczeństwa jako kontraktu między grupami reprezentującymi odrębne interesy. Oznaczało to, że trudna do uformowania była płaszczyzna myślowa, która sprzyjałaby rozumieniu zróżnicowania ludzkich interesów i tym samym ich godzenia interesów w oparciu o uzgodnione zasady. Ponadto autor wskazuje na znaczenie czynników socjologicznych, czyli na cechy struktury społecznej i relacji społecznych w Polsce kształtujących się przez długie odcinki czasu. Wskazuje na znaczenie zjawisk, które uznawane są za pochodną tak zwanej próżni socjologicznej. Porusza zagadnienie tradycyjnie wysokiego poziomu konfliktowości w polskim społeczeństwie, przewagi konfliktów ideologicznych nad sporami o interesy materialne. Autor charakteryzuje również generalne cechy systemu artykulacji interesów. Wskazuje na takie jego cechy, jak silna polaryzacja, konfrontacyjność, pojmowanie interesów w sposób egzystencjalny. Za bezpośrednie źródło tego stanu rzeczy uznaje słabe zapośredniczenie systemu w szeroko akceptowanych regułach i normach.
The author offers the thesis relating to the cultural roots of structural characteristics of the current form of the interest representation in Poland. He claims the importance of the long-term factors in the history and underlines the role played by the ideology of romanticism which had an significant influence over Poland. It created the trajectory shaping notions and institutions including some of gut reactions in the area of relations among interest groups. The key fact was that this ideology was far away from understanding a society as social contract among different interest groups. As a result the rules of collective thinking were very difficult to establish in such a way which would be conducive to rules-based collective bargaining. Moreover, the author points out at the importance of sociological factors including the characteristics of social structure and social relations shaped during the long periods of time. He underlines the importance of the social phenomenons which are the outcome of social vacuum like a long tradition of confrontation-based social relations in the Polish society, predominance of ideological conflicts over material ones. The author characterizes also a general components of interest articulation with the essential features like strong interest polarization, confrontational tendencies, existential types of interests. All of that result from weakly rooted social norm and rules.

The article deals with the problem of national security in the contemporary world which is greatly influenced by the process of globalization and digitalization. The paper highlights the role of national security in modern state building. The following issue has been of great interest to many outstanding scientists worldwide especially since the beginning of the XXI century. However, the subject matter of national security in the system of public administration has not been clearly defined yet. Therefore, the paper analyzes the approaches to define national security and points out its distinctive features. Moreover, it emphasizes the fact that at the level of national, regional and global relations the concept of national security is often associated with security strategies. Thus, the article puts emphasis on the predominant characteristics that help to distinguish between these two concepts. In addition, the research clarifies the characteristic features of national security as well as state security. Security, like many other categories of social sciences, does not have a conclusive definition. What is more, the category of security has an interdisciplinary significance. Therefore, scientists define it in accordance with the subject matter and the specifics of cognition and research. Nevertheless, many outstanding scholars view security as an anthropocentric category related to man’s socialessence and value. Accordingly, security presupposes having freedom from the risk, danger and the threat of change to the worse. Most scientists agree that security is a constituent of every aspect of human life. Consequently, security issues consideration is of great significance. All in all, nowadays it is greatly important to achieve a state of security as our globalized society frequently leads to different challenges and dangers. The results of the research contribute to better understanding of the issue and make it possible to introduce effective mechanisms of public administration in the field of national security.

The article is focused on public diplomacy viewed as the instrument of soft power of the state and the ability to persuade and create reputation as well as cultural and institutional attractiveness. Moreover, the paper emphasizes the importance of the correct formation of priorities and values of the state, and skillful national branding. The authors pay a particular attention to the foreign policy of the Republic of Finland in the context of public diplomacy service. Hence, developmental phases of the Finnish public diplomacy were given. In addition, a special attention was paid to the functional features of public authorities with reference to public diplomacy viewed as an important factor in international relations and the national interest protection of Finland. Therefore, the spheres of public diplomacy such as the cultural, educational-scientic, public, or digital diplomacy of Finland are under analysis, too. Additionally, the means and methods of public diplomacy, including those practiced in Ukraine were under particular attention. Thus, a special emphasis was put on the national brandmark and international position of the State. Based on the conducted empirical research which conrms the necessity of further cooperation between Ukraine and Finland, aimed at implementation of public diplomacy tools, there were given recommendations concerning the execution of the means and methods of "soft power".

Nowadays, many developing countries such as China, India and Vietnam, etc. have been trying to improve public service culture in public service organizations through eliminating corruption, more integrity, and training and improving good corporate governance. Based on theories background on public service culture, or public administration culture and conflicts of interest, this paper aims to evaluate real situation of interest conflicts in public enforcement in Vietnam nowadays; then, it will use a combination of logic and synthesis, qualitative and quantitative methods, and inter-social scientific industries analytical method to propose some recommendations to reduce conflicts of interest in public enforcement in the country on the basis of further clarifying the concept of “public service culture” and “conflict of interest” in public service. For instance, the paper suggests that we need to amend regulations on giving and receiving gifts, and increase the control over assets and income. Last but not least, we suggest future desired research direction: we can expand researches to other emerging markets in Asia, China, India, Malaysia, Myanmar, etc.

One of the most important vectors of Ukraine’s contemporary development is its active policy in bilateral relations with the leading European countries, since such a policy opens the way for recognition of its European identity and forms unlimited opportunities for international cooperation on a mutually beneficial basis. Among the closest partners and the most reliable allies of Ukraine was and remains Poland, because here, hundreds of thousands of Ukrainians live, work and study without any special problems. In addition, the strengthening of strategic partnership with Poland contributes to the practical realization of the European choice of Ukraine. On the other hand, Poles are interested in the territorial integrity, independence and European orientation of Ukraine, seeing it an ally in confronting external threats. In connection with the aforementioned one of the most important directions of the study of the state and prospects of modern Ukrainian-Polish relations is the elucidation of the sources and methodology of their comprehension comprehension. Although any classification is conditional, it is still worth trying to identify the main sources whose potential is intended to strengthen the relations between the two countries and outline the methodological aspects of their use in order to strengthen Ukrainian-Polish cooperation. First of all, such sources should include the following. 1. The ideological and theoretical work of the representatives of Ukraine and Poland, aimed at finding ways to deepen mutual understanding between the two peoples. At the same time, particular attention should be paid to strategic considerations expressed on both sides, as well as reservations about the risks that accompany bilateral relations. Along with this, the important points for studying are the positions of people who are distinguished for their diligence, openness to mutual respect and mutual understanding. The ideological and theoretical potential of Ukrainian and Polish intellectuals, aimed at convergence, the dialogue of the cultures of the two countries, still needs to be properly studied and systematized, and can serve as an important basis for the state-building efforts of Ukraine and Poland in the future. 2. External and domestic legal acts and documents of strategic direction aimed at strengthening of bilateral relations. This vector of relationships was already established at the turn of the 20th - 21st centuries in the relevant international legal and internal documents: the Declaration on the Principles and Main Directions of Ukrainian-Polish Relations (October 13, 1990); Treaty on Good Neighborhood, Friendly Relations and Cooperation (May 18-19, 1992); Agreement on the legal status of the Ukrainian-Polish border (January 12, 1993); Communique on the results of the meeting of the Consultative Committee of the Presidents of Ukraine and the Republic of Poland (September 27-28, 1995); Joint Statement for Understanding and Integration (May 21, 1997); Security Strategies of the Republic of Poland (2000); National Concept of Strategic Partnership Relations with the Republic of Poland (July 27, 2001); in a paper presented by the Polish political experts «The Eastern Policy of the Union in the Perspective of its Expansion through the States of Central and Eastern Europe - the Polish Point of View» (October 2003). Sufficiently strong legal and regulatory framework for bilateral relations between Ukraine and Poland is evidence of a gradual strengthening of political, economic, international legal and cultural cooperation. At the same time, a number of problems remain inadequate. First of all, it concerns border cooperation, common historical heritage, education, labor migration, etc. 3. Institutional system for the provision and coordination of mutual strategic interests of the two states. Today, this coordination is jointly carried out by: the Advisory Committee of the Presidents of Ukraine and the Republic of Poland; Ukrainian-Polish Mixed Commission on Trade and Economic Cooperation; Ukrainian-Polish and Polish-Ukrainian parliamentary groups; Permanent Ukrainian-Polish Conference on European Integration; Polish Institute in Kyiv; Ukrainian-Polish, Polish-Ukrainian forums, Foundation Research Center Poland-Ukraine and others. In addition, there are a number of research structures in each of the countries that are highly specialized in the Polish-Ukrainian and Ukrainian-Polish issues. Accordingly, this direction should be monitored and the current evaluation of the effectiveness of these or other structural units should be carried out on the subject of a real impact on the quality of bilateral relations. At the same time, mutual understanding should be sought on the basis of openness, dialogue, compromise, and the avoidance of the formation of structures focused on unilateral consideration of disputed problems. 4. State-political decisions in the field of security policy, anti-hybrid foreign-policy threats. A real threat to the entire European security system was the aggressive policy of Russia in 2014. Under these conditions, Ukraine was the leading outpost of protecting European values and democratic order. Systemic comprehension of the existing experience in a vital military-strategic sphere will help to optimize the directions of further cooperation, in particular on such important issues as: the final determination by Ukraine of the transition to international standards in the military sphere; exchanging experience of reforming the troops and maintaining their combat readiness at an appropriate level; combining the efforts of all EU countries in combating hybrid threats, as well as conducting a single foreign and security policy; consolidated actions of the European states in relation to the offending state (point of application of sanctions, embargo, etc.); to develop, on the basis of the UN, a common position on the unconditional implementation by all countries of the world of the requirements of international law and the search for ways to improve it in order to resolve non-standard situations; the study of the NATO countries by the unique Ukrainian experience of functioning the state in a hybrid war. 5. The ideological and theoretical potential of public events (scientific conferences, debates, discussions, official meetings) that promote reconciliation with respect to controversial historical events, the dissolution of persistent stereotypes. From time to time, the recurrence of historical hostility between the two neighboring countries is given significant, including at the official level. First of all, these are the negative manifestations of mutual opposition, such as: the war of monuments to the dead Poles and Ukrainians; the dissemination at the level of mass consciousness of outdated stereotypical ideas humiliating national dignity; attempts to politicize the policy of memory through speculation on the tragic events of the past, in which the representatives of both nations suffered; the criticisms of the Polish radicals about the re-establishment of the Commonwealth at the borders of 1939 and the ill-conceived statements of some Ukrainians, which prompted «to forget about Poland for 25 years». The realization by Poland of offensive historical politics in Ukraine creates a reciprocal reaction in the issue of Ukraine’s implementation of its policy of memory and causes various kinds of distortions. Therefore, under the current conditions, monopolization of the policy of memory at the state level, without involving the general public, is extremely dangerous for the future. This remark applies to both Poland and Ukraine. Thus, despite current problems, today we have every reason to state the significant level of Ukrainian-Polish cooperation. At the same time, in the bilateral relations between Ukraine and Poland it is worth looking first and foremost on positive things, consolidating in the mass consciousness what unites the two Eastern European countries, to highlight the views of people who for years build a Polish-Ukrainian understanding: translate books, establish scientific cooperation, restore cemeteries, collect help for soldiers who guarantee European security in eastern Ukraine. The progressive forces of both countries, regardless of the various kinds of provocations, should be abstracted from the insinuations of the marginal environment, reveal wisdom in assessing historical events, and determine common priorities not only for the medium term, but also for the long-term perspective. The level of mutual relations between the two countries depends on the possibility of realizing the needs of national minorities - Ukrainian in Poland and Polish in Ukraine. In addition, the strengthening of intergovernmental cooperation will contribute to establishing closer cooperation between Ukrainian and Polish societies in general, which depends largely on the future of both countries in the European House of Spies.

Opis:
The paper focuses on the issue of public enforcement of consumer law in Poland. This analysis considers exclusively the stage of administrative proceedings and it does not concern judicial control over the decisions issued. The analysis aims at answering the question whether the phenomenon of legal impossibilism is to be observed in the domain administrative proceedings instituted by the President of the UOKiK with the purpose of implementing consumer policy. The hypotheses to be verified in the foregoing are as follows: (i) there are procedural mechanisms which enable an authority to effectuate protection of consumer rights, operating to the public benefit, and that (ii) it might be reasonable to expect that these mecha nisms are exploited in practice by the President of the UOKiK. The first part con siders the legal framework for enforcing consumer rights with the use of public law mechanisms in Poland. In the second part, the discussion revolves around the practical application of the legal instruments by the President of the UOKiK. The conclusions constitute a starting point to initiate further, in depth empirical studies related to the activities undertaken by the President of the UOKiK with the aim to effectuate protection of consumer rights in Poland.

The purpose of the article is to explore the basic principles of information policy formation in Ukraine in the context of hybrid information warfare; identification of features and problems of information policy and its impact on the public administration system. The results of the study show that since the beginning of Russia’s armed aggression against Ukraine and the widespread hybrid information war, the state’s information policy has changed its vectors and priorities. Confirmation of this was the adoption of a number of legislative documents, which identified the external enemy of the aggressor and outlined directions for the protection of national interests. It is analyzed that one of the main tasks in the information confrontation of the hybrid war is the formation of appropriate information policy and information security. It was pointed out that in the conditions of a hybrid war, a systematic approach should be devised to adequately respond to the state’s power structures to the challenges related to information confrontation. In order to minimize the spread of manipulative influences in the national information space, the formation of practical mechanisms for implementing the country’s information policy, establishing communication with civil society and raising the overall level of media literacy of society is a necessary question.
