Opis:: The NOMAD project was a survey to examine the noise-related content of instructions supplied with machinery offered for purchase in Europe. The project collected more than 1 500 instructions from machines covering 40 broad machine-families and from 800 different manufacturing companies. These instructions were analyzed to determine compliance with the requirements of the Machinery Directive, and assess the quality of information. The general state of compliance of machinery instructions with the noise-related requirements of the Machinery Directive was found to be very poor: 80% of instructions did not meet legal requirements. Some required numerical values relating to noise emissions were often missing. Where values were given, they were often not traceable to machine operating conditions or measurement methods, and not credible either against stated conditions/methods or as warnings of likely risk in real use. As a consequence, it is considered highly likely that, in making a machinery procurement decision, employers are prevented from taking noise emissions into account, and understanding what is necessary to manage the risks from noise relating to equipment that is procured. Recommendations are made for actions aimed at bringing about a global improvement to the current situation. Targeted actions are now proposed by “ADCO Machinery Group” aimed at raising awareness of the legal requirements, responsibilities and actions required among the various groups who have parts to play in the system – machine manufacturers, machine users, occupational safety and health professionals, and standards-makers. Recommendations are also made aimed at providing, or improving, tools and resources for all these actors.

Opis:: The management of the sludge with its definite development has been the issue of greatest importance over the last decade in a majority of sewage treatment plants in Poland. The reason for this is the increasing amount of sludge as well as meeting the legal requirements imposed on sludge producers. On the basis of a sewage treatment plant in Kostrzyń a legal outline of some of the aspects of sludge management, including the natural usage of the sludge, has been presented. Furthermore, the thesis shows an attempt to change the final selection of sludge neutralizing in the sewage treatment plant.
Gospodarka osadami na przykładzie oczyszczalni ścieków w Kostrzynie nad Odrą W ostatnim dziesięcioleciu w większości oczyszczalni ścieków w Polsce, priorytetowym zadaniem jest gospodarka osadami. Powiększająca się ilość osadów ściekowych, jak również spełnienie wymagań prawnych, skłania zarządzających oczyszczalniami ścieków do dokonania najlepszego wyboru zagospodarowania osadów ściekowych. Na podstawie funkcjonowania oczyszczalni w Kostrzynie nad Odrą przedstawiono zarys prawny wybranych aspektów gospodarki odpadami, w tym przyrodniczego wykorzystania osadów. Ponadto ukazano próbę zmiany wyboru ostatecznego unieszkodliwienia osadu w oczyszczalni w Kostrzynie.

Opis:: The article is devoted to the coverage of the issue of criminal - legal protection of intellectual property at the present stage of state development. Some issues of optimization of the ratio of criminal – legal and civil – legal protection of intellectual property, the issue of differentiation of criminal – legal protection of personal non-property and / or property rights of intellectual property to literary, artistic and other work (copyright) and personal non-property and / or property intellectual property rights for performance, phonogram, videogram and program (transfer) of broadcasting organization (related rights). Unambiguous interpretation, logical wording in determining the signs and boundaries of socially dangerous acts and a clear relationship with other legal norms inevitably affect the correctness of law enforcement, provided that the legal constructions cover legal relations enshrined in the form of criminal offenses, delimiting criminal behavior from other actions and inaction . However, the effectiveness of the mechanism and legal effectiveness of criminal – legal protection of intellectual property, the quality of the relevant criminal – legal prohibitions and their qualified and active application should be recognized as more significant in terms of functional purpose and impact on legal relations. Thus, of course, the process of combating crimes against intellectual property directly depends on the degree of effectiveness of law enforcement agencies, both international law and legislation of Ukraine, as well as methods and techniques of intellectual property protection, which also contributes to the modern development of civil law, criminal law and procedural institutions of regulation and protection of intellectual property rights in view of the dynamics of such crimes, their type of affiliation, as well as persons who may be involved in their commission. At the same time, there is no doubt that even perfect criminal law prohibitions cannot completely replace the professionalism of a law enforcer, his technical equipment, his knowledge of regulatory legislation and high-quality investigative and operational-investigative activities.

Opis:: European Court of Human Rights states that the execution of final decisions is a compulsory provision for a fair hearing and a successful conlusion of a trial. The right to a court protected by Article 6 would be illusory if a Contracting State’s domestic legal system allowed a final, binding judicial decision to remain inoperative to the detriment of one party. Execution of a judgment given by any court, is considered to be an integral part of the “trial” for the purposes of Article 6. Based on the Article 1 of European Convention for Human Rights member states of European Council are obligated to implement the the decisions of ECHR in their domestic legislation in the context of building an efficient legal system. This paper aimes to analyze the legal system of member states regarding the reinforcment of decisions looking forword to identify issues, commonalities and diferences among states. What is the procedure followed in the process of execution? What do we understand with “Reasonable timeframe” and which are the legal requirements in which are based “Concrete deadlines” within a judicial decision should be executed? What is the significance of the enforcment agents in this process?

In this work, the most important issues related to legal aspects of closing and remediation of landfills used for storage of waste other than hazardous and inert waste, which means mainly for municipal waste storage, are considered. The work also refers to the required monitoring which should be performed in post-operation period. The analysis and evaluation of such process has been performed upon the example of the selected inoperable landfill located at the territory of Nowy Sącz district.

Opis:: The dynamic development of motorization causes inadequate parking places in the city centers as well as in their outskirts. The emergence of new residential buildings and public utilities results in the need to create new parking spaces. Due to the problem of limited development space as well as the high cost of building plots, investors decide to create one or multi-storey closed garages. The area of these garages often reaches several tens of thousands of square meters. For these new parking spaces, an adequate and effective ventilation system should be provided, which at the same time functions as a residential ventilation system, and has a fire ventilation function as a means of protecting escape routes and rescue teams during a fire.

Opis:: Artykuł przedstawia problematykę zapewnienia jakości i bezpieczeństwa produktów żywnościowych w transporcie drogowym. W artykule omówiono wybrane akty prawne odnoszące się do transportu drogowego żywności, do których należą międzynarodowa umowa dotycząca transportu szybko psujących się artykułów żywnościowych (ATP) oraz system kierowania bezpieczeństwem podczas transportu żywności (HACCP). Zaprezentowano ogólną charakterystykę całego procesu transportowania produktów spożywczych oraz omówiono pojazdy dostosowane do jego realizacji. Następnie opis ano naczepy chłodnicze, a także przedstawiono wymagania, co do temperatur i pojazdów, w których odbywa się cały proces dostaw towarów żywnościowych. Dokonano również analizy danych statystycznych dotyczących przewozu produktów żywnościowych w Polsce w latach 2008-2016.
The article presents the issues of ensuring the quality and safety of food products in road transport. The article discusses selected legal acts related to road transport of food, including the Agreement on the International Carriage of Perishable Foodstuffs and on the Special Equipment to be Used for such Carriage (ATP) and the Hazard Analysis and Critical Control Points System (HACCP). The general characteristics of the entire process of transporting food products were presented and vehicles adapted to carry it out were discussed. Next, refrigerated semitrailers were described, as well as requirements for temperatures and vehicles in which the entire food supply process takes place. An analysis of statistical data on the transport of food products in Poland in the years 2008 -2016 was also carried out.

Opis:: The paper provides an analysis of current Polish regulations on polycyclic aromatic hydrocarbons (PAH) in water. The issue was also described in relation to international law. Inconsistency in regulations in terms of definitions of the sum of PAH is highlighted. The influence of PAH concentrations on the classification of water chemical status and the assessment of drinking water quality was analyzed based on the results of concentrations of six PAHs: benzo(b)fluoranthene, benzo(k)fluoranthene, benzo(a)pyrene, dibenzo(ah)anthracene, benzo(ghi)perylene and indeno(1,2,3-cd)pyrene. The PAH concentrations were determined in 36 water samples, including 28 samples of spring water and eight samples of snowmelt. The results obtained for most of the samples revealed elevated concentrations of benzo(a)pyrene. The authors underline the fact that a separate assessment of benzo(a)pyrene, the sum of six PAHs, and the sum of four PAHs unveil inconsistency in water quality evaluation. The results also suggest that only benzo(a)pyrene should be considered in the classifications mentioned, since its determination gives the actual view on the water quality in terms of PAH concentrations. The assessments for the sum of six PAHs and four PAHs in accordance with existing regulations indicate higher quality classes, meaning a better water quality in comparison with the concentration of benzo(a)pyrene itself.

Opis:: Corocznie w Polsce w wypadkach drogowych ginie ponad 800 pieszych. Jedną z głównych przyczyn tych wypadków jest ich niedostateczna widzialność, szczególnie w warunkach nocnych. Skuteczną metodą poprawy widzialności pracowników wykonujących m.in. remonty dróg oraz pieszych jest zastosowanie przez nich akcesoriów odblaskowych, odbijających światła reflektorów samochodowych w kierunku źródła. W artykule omówiono wymagania prawne dotyczące wprowadzania do obrotu akcesoriów odblaskowych, ich konstrukcję, ograniczenia w stosowaniu oraz wymagania techniczne określone w normie europejskiej.
Over 800 pedestrians are killed in road accidents in Poland every year. Inadequate visibility. especially at night, is a main cause of these accidents. Retro-reflective accessories, which reflect the light of car headlights towards their source are effective in improving road worker s' and pedestrians' visibility. This article discusses the legal requirements for marketing retro-reflective accessories, for their construction, limitations m use and technical requirements set out in a European standard.

Opis:: Projektowanie, wykonywanie i eksploatacja budynków o niskim zużyciu energii jest procesem złożonym i wymaga znajomości wielu zagadnień w zakresie materiałów budowlanych, budownictwa ogólnego, fizyki budowli, instalacji budowlanych, systemów odnawialnych źródeł energii oraz projektowania architektonicznego. Realizacja obowiązujących wymagań technicznych w tym zakresie polega na sprawdzeniu wielu parametrów całego budynku ale także jego przegród zewnętrznych i ich złączy. Ich określanie wg obowiązujących przepisów prawnych i norm przedmiotowych budzi wiele wątpliwości i niejasności w zakresie procedur obliczeniowych i interpretacji zagadnień fizykalnych. Na podstawie prowadzonych obliczeń i analiz autorzy podjęli dyskusję w zakresie metod obliczeniowych w tym zakresie, proponując zmiany w zapisach prawnych i procedurach obliczeniowych. W pracy scharakteryzowano wybrane czynniki kształtujące budownictwo niskoenergetyczne: parametry fizykalne elementów obudowy budynku, wspomaganie nowoczesnych systemów wentylacyjnych, parametry charakterystyki energetycznej. Część obliczeniowa pracy dotyczy analizy parametrów fizykalnych elementów obudowy budynków o niskim zużyciu energii oraz parametrów charakterystyki energetycznej budynków z uwzględnieniem kryterium oszczędności energii i izolacyjności cieplnej. Kształtowanie układów materiałowych przegród zewnętrznych i złączy budowlanych wymaga uwzględnienia innowacyjnych materiałów izolacyjnych oraz specyficznych parametrów powietrza wewnętrznego i zewnętrznego. Zastosowanie do obliczeń i analiz profesjonalnych programów komputerowych pozwala na uzyskanie miarodajnych wyników. Uwzględnienie wielu spójnych ze sobą czynników: architektura budynku, rozwiązania konstrukcyjno-materiałowe przegród zewnętrznych i ich złączy (elementy obudowy budynku), rodzaj i sprawność systemu wentylacji oraz systemów c.o., c.w.u., zastosowanie odnawialnych źródeł energii, integralne zarządzanie budynkiem w zakresie produkcji energii pozwala na uzyskanie optymalnych parametrów charakterystyki energetycznej budynku i ograniczenie emisji CO2 do atmosfery.
The Directive 2010/31/EU introduces a new building standard (NZEB) in all member states of the European Union from 1.01.2021. In Poland, a low-energy building has been defined. The design, construction and use of such building is a complex process and requires knowledge of many aspects concerning building materials, general construction, building physics, installations, renewable energy systems and architectural design. Implementation of the current technical requirements in this area encompasses examining many parameters of an entire building but also of its external walls and joints. Defining them according to the applicable legal regulations and relevant standards evokes many questions and uncertainties regarding calculation procedures and interpretation of physical aspects. On the basis of conducted calculations and analyses, the authors have started a discussion on calculation methods in this field, proposing changes in legal regulations and calculation procedures. The paper describes selected factors influencing low-energy buildings: physical parameters of building envelope elements, support of modern ventilation systems, energy performance parameters. The calculation part of the work concerns the analysis of physical parameters of the elements of low-energy building envelope and energy performance parameters of a buildings with consideration of energy saving and thermal insulation criteria. Formation of material systems of external walls and building joints requires taking into account innovative insulation materials and specific parameters of the air inside and outside of a building. The use of professional software for calculations and analyses provides reliable results. Many coherent factors such as: architecture of a building, structural and material solutions of the external walls and their joints (elements of the building envelope), type and efficiency of the ventilation, central heating and hot water systems, use of renewable energy sources, integral management of the building in the field of energy production help to obtain optimal parameters of energy performance of the building and reduce emissions of CO2 to the atmosphere.

Listy sporządzone zostały według przyjętej klasyfikacji przepisów bhp, odnoszących się do prewencji bezpośredniej i pośredniej.
This article discusses the possibility of preparing control lists to help employers in the wood industry check the compatibility of their actions in the field of occupational safety and health (OSH) with legal requirements. Those lists come with short descriptions of the requirements in OSH regulations relevant to this industry and a list of those regulations. Opis:: Purpose: The methodology for assessing compliance with legal requirements in machine plant purchased old and new (often imported from third countries) and used in Polish industry was presented. Application of the presented methodology may be one of the actions allowing verification compliance with legal requirements. Design/methodology/approach: The advanced methodology for assessing machinery compliance with legal requirements. Findings: On the basis of research and analyzes, non-compliance in the scope of minimum requirements was found. A proposal of solutions improving the safety of the analyzed machine plant was also presented. Research limitations/implications: Safety related to machine operation plays a key role for the EU economy. Therefore, the utilized machinery meeting legal requirements is an important element. The author, in carrying out machine compliance assessments, will present in subsequent studies research on safety areas for which the occurrence of non-compliance is most often identified. Practical implications: Application of the developed methodology may facilitate the implementation of works related to the assessment of machine safety. Social implications: The implementation of solutions focused on ensuring work safety is a manifestation of the involvement of the top management in shaping the OSH culture. Originality/value: The article presents a proposal for a methodology for assessing whether the machine plant used in industry meet with compliance to legal requirements. The presented methodology can be used by producers and employers.

As a response to growing use of chemicals in conventional agriculture and to the increasing demand for organic honey, organic beekeeping methods have become popular in recent years. These methods are considered friendly for bees and, at the same time, minimize the risk of accumulation of contaminants in bee products. The paper presents the requirements for organic beekeeping according to current European Union regulations.
