The article presents an analysis of military law in the legal system of the Republic of Poland. On the one hand, it is a very specialized area of law, and on the other, it is a very extensive field regulated in several hundred national legal acts of varying importance (universally and internally binding), as well as by international law. The author attempts to organize the subject matter of military law and to specify its elements divided into subject-specific blocks. At the same time, in order to ensure a better understanding of the nature of military law, the article discusses the role of the Armed Forces of the Republic of Poland in times of peace, crisis, and war.The author used critical analysis of literature on legal science and security sciences, and source materials: mainly acts of universally binding law (the Constitution, acts, and regulations), as well as acts of internally binding law (instructions, ordinances, resolutions, decisions, guidelines, and agreements of various state authorities).

Opis:
The opinion presents major differences in the legal situation of clients- entrepreneurs in relation to (legally privileged) recipients being household owners and consumers. Moreover, the author presents legal arguments for an extension of the protection standard regarding privileged entrepreneurs to micro-entrepreneurs and small entrepreneurs under the European Union legislation and in compliance with the national one. The opinion contains arguments for a specific national legislation, which would provide content to the state obligation to provide assistance to the development of entrepreneurship, in particular the micro-entrepreneurs, and which would facilitate an effective use of liberties of a uniformed EU market in the trans-border dimension.

Under the proposed amendment of Hunting Law, decisions on compensation issued by a province governor (wojewoda) could not be appealed to an administrative court based on the alleged illegality. The author points out that there should not be a situation in which two decisions are made in the same case, one by a public authority and the other by the court of general jurisdiction, none of which has effect on the binding force of another one. An analysis of the bill allows us to conclude that the decision of the voivodship governor, to the extent to which the case will be decided upon the judgment of the court of general jurisdiction, will cease to have effect. The author argues that in order to ensure greater legal certainty it could be advisable to regulate expressly the mutual relationship between the administrative and civil law procedures and the decisions issued in the course of each of them.

Opis:
Space law is clearly oriented towards creation of soft law instruments and their subsequent implementation directly into national law. However, it is not an ideal method for regulating the peaceful use of outer space. At least a few problematic issues should be noted. Firstly, the lack of scrutiny by parliaments with regard to soft law standards accepted by States. Secondly, the multiplicity of soft law documents on the same subject matter – especially in the case of space debris (IADC, UN, ISO or ESA), which may not be fully identical. Thirdly, developments in space technology mean that existing soft law standards may nevertheless be outdated in practice. Fourthly, the creation of new soft law is not always a quick process. However, implementation of international soft law relating to outer space into domestic law ensures that international norms are binding under national law. It thus strives to guarantee both the development and the effectiveness of international space law, despite the absence of new treaty regulations.

The article raises the question of the influence of the EU clinical trials of medicinal products legislation on the Polish criminal law. Although this issue does not fall within the scope of the Article 83 of the Treaty on Functioning of the European Union, its significant importance results from the expected beginning of application of the Regulation No. 536/2014 of the European Parliament and of the Council of 16 April 2014 on clinical trials on medicinal products for human use, and repealing Directive 2001/20/EC. The impact of the EU legislation on member states’ criminal law in the field of clinical trials is based on the principle of pri- macy. Three directions of this impact can be distinguished concerning Regulation No. 536/2014. The first is the exclusion of the unlawfulness of the acts prohibited by the chapter 19 of the Polish Criminal Code within the scope of the prerequisites for the admissibility of clinical trials. The second is the de facto depenalisation of the behaviors described by in Article 126a (1) (3–5) of Pharmaceutical Act. The indicated two effects may take place ex lege with the beginning of application of Regulation No. 536/2014, if there is no change in the Polish law beforehand. The realisation of the third direction depends on the decision of the Polish legislator, who is required to introduce effective, proportionate and dissuasive penalties applicable to infringements of the Regulation No. 536/2014. The type of these measures is left to the discretion of the member states, but the current legal situation combined with the principle of assimilation prompts us to suppose that the choice of criminal penalties will be sustained.

The article deals with the issues of non-uniformity of law, as the opposite of uniformity of law, which is today regarded by lawyers as an equivalent to unification and codification of law. Lack of clarity, stability and certainty of law, as well as the objectification of law by the state, resulting in inflation of law or defects of legislative techniques, are not the only causes of non-uniformity of law. Therefore, the problem is perceived in a wider sense – as a state of imbalance between social norms of which legal order consists. The article examines in detail current social determinants of the lack of uniformity of law in Poland.

This article presents reflection made in the field of Roman legal thought in selected Polish legal regulations with potential impact on the functioning of the individual. The universal form of the principle – regardless of the legal system – implies a potential threat to the functioning of the individual in the form of uncertainty. The purpose of this publication is to indicate the need to update legal regulations regarding the indicated matter – in particular – in the form of an obligatory examination for the courts of the statute of limitations in a situation where a natural person is a party to the proceedings. Accurate provisions of the Code of Administrative Procedure, Code of Civil Procedure and selected court sentences were presented. In the research process, was made extensive use of qualitative research methods, including in the form of analyses (e.g.: legal and institutional analysis, comparative analysis, system analysis and methods: analysis and logical construction), generalization and implication. In turn, among quantitative research methods, intensively was used statistical analysis and a diagnostic sounding survey. In addition to the literature analysis – important support of the research process was the examination of documents (including provisions of national law) and available sources of knowledge about the problems studied. The source material included both open access and published studies in specialist journals. At this stage of the research, have been analysed the applicable legal regulations and selected sentences of Polish Courts. The mentioned above, empirical methods included the following: a diagnostic sounding survey – conducted in the form of surveys using the CAWI technique. The empirical stage ofthe research also consisted in the assessment of the legal status. The cognitive and utilitarian premises of the problems are the implementation of the adopted hypothesis: Ignorantia iuris nocet Principle in connection with numerous amendments to regulations may have negative consequences for the functioning of the individual.

The paper describes the development of criminal law as the originally private law sector and points to changes that ultimately have changed the nature of criminal law so that it is now considered to be a public law sector. Criminal law during the period of the high and late Middle Ages on the territory of Slovakia had the character of a public law sector. Recovery after committing the crime was left to the injured person or his family. The relationship between the injured (or his survivors) and the perpetrator was largely private in nature. The state originally did not interfere or interfere only at a minimum with this relationship. Only in the course of time has this element of a largely private legal relationship been also given a public-law element, only in the age of Modern Times the criminal-law relations had the character of public law. This article describes the changes that have occurred in the course of time in the area of criminal law, the ways of punishment, and the changes which have led to the transformation of criminal law into the public law sector

This paper explores the issue of the value-based life and upbringing towards the values on the grounds of legal conditions in which the Polish educational system exists. Multiple standards are imposed on educational space and law, including especially education law, has been subject to major inflation, therefore, at the moment law is becoming one of the crucial factors that determine the structure and function of all subjects and institutions of education. Law not only determines the formal context of the system within which education occurs but also influences organizational aspects of ongoing educational activities as well as individual areas of experiencing and learning both the school and the law. As a consequence, the law is able to and should support the process of leading students towards the value-based life. All the subjects and institutions of education as well as authorities decisive in terms of education should put and effort in searching for a knowledge on a good law and make establishment of such law a basic concern and task. Good law can lead to a value-based life or constitute a measure of the protection of values that are promoted and implemented within the educational system. Depriving school of humanity is also reflected in the legal sphere – a chaos that occurs in the educational reality under the influence of continuous amendments to the education law. This paper is aimed at considering the state and structure of the current law on the protection of values in education.

A notary, as a person who performs activities that play a huge role in legal transactions and produce extremely significant effects, is obliged to act in accordance with the law and behave with dignity – both in private and public life. The notary is responsible for the breach of these rules. As a rule, the following types of liability are mentioned: civil, criminal, disciplinary, and tax. Based on Art. 19a of the Law on Notaries, a notary public is subject to compulsory third-party liability insurance for damages caused while performing notarial activities. There are doubts about the nature of the civil liability of a notary and its scope. This article aims to provide a clear answer on this matter.

The article deals with the issue of referrals to the study of criminal law as sources of inspiration for the enforcement of public law rules of competition and consumer protection (Act of February 16, 2007, on Competition and Consumer Protection (Journal of Laws of 2021, item 275) (oukk)). It is now widely accepted in antitrust jurisprudence that although the liability of the parties to the proceedings before the President of the Office of Competition and Consumer Protection (UOKiK) is not of criminal nature, and fines imposed by the President of UOKiK are not penalties within the meaning of the Criminal Code, the rules of judicial verification of the correctness of UOKiK’s decisions imposing these sanctions should meet the requirements analogous to those applicable by a court adjudicating in a criminal case. However, while there is little doubt that antitrust authorities should be required to apply standards of protection of fundamental rights as derived from the study of criminal law and international sources (European Convention on Human Rights, Charter of Fundamental Rights), the issue of transferring to competition and consumer law other standards recognized in criminal law remains open. The current jurisprudence contains divergent positions on this issue. The Supreme Court emphasized that „there are no justified grounds for applying the provisions of the general part of the Penal Code under the regime of administrative liability” (case I NSK 4/18). On the other hand, it approved references by analogy to the solutions taken from the Criminal Code in the absence of similar provisions in the uokk (case I NSK 8/19) or in cases where competition law uses concepts taken from criminal law (case I NSK 62/18). The article presents both of the jurisprudence lines mentioned above. In addition, the article point outs issues of competition and consumer protection law in the case of which, in the author’s opinion, the use of concepts derived from the study of criminal law would be justified.

In the face of the European integration, the legal protection of national symbols enjoys momentous significance. The present turbulent times and numerous conflicts, the etiology of which is – e.g. social or political in nature – require an attempt to make a scientific overview of the situation. In this article I will examine the scope of standardization of the protection of national colors in the Polish law, the Italian law and the Community legislation. The study takes into account the historical and contemporary judicial decisions. I will try to answer the question whether the scope of protection of the Community colors in the Polish law is sufficient? The analysis of the examined normative acts has led me to the conclusion that the Polish legislator, after the restoration of independent statehood, attached a great importance to the normative grounds ensuring protection of colors of the national symbols. The Italian constitutional adjustment, compared to the Polish one in the scope of the national colors, is very sparse. Aside from the Community rules, each member state – as a result of historical development – has developed its own model of protection. The colors of the European Union are not expressly protected under the Polish normative regulations. However, de lege ferenda, I reckon that for the interests of legal certainty, the legal status in this field should be amended and relevant norms should be laid down.
W obliczu integracji europejskiej, doniosłego znaczenia nabiera prawna ochrona symboli narodowych. Współczesne czasy nie są spokojne. Liczne konflikty, których etiologia ma charakter społeczny, polityczny, nakazują próbę dokonania scjentystycznego oglądu sytuacji. W niniejszym artykule zbadam zakres normowania ochrony barw narodowych w prawie polskim i włoskim oraz wspólnotowym. W badaniach uwzględnię historyczne i współczesne orzecznictwo sądowe. Spróbuję udzielić odpowiedzi na pytanie o to, czy na gruncie prawa polskiego zakres ochrony barw wspólnotowych jest wystarczający? Analiza zbadanych aktów normatywnych doprowadziła mnie do wniosku o tym, że polski prawodawca po odzyskaniu niepodległego bytu państwowego przywiązywał dużą wagę do normatywnych podstaw mających zapewnić ochronę barwom jako symbolom narodowym. Włoska regulacja konstytucyjna, w porównaniu do polskiej, w zakresie barw narodowych jest bardzo skąpa. Pomimo regulacji wspólnotowej, każde z państw członkowskich – na skutek rozwoju historycznego – wykształciło własny model tej ochrony. Barwy Unii Europejskiej nie są expressis verbis chronione na gruncie polskich regulacji normatywnych. Moim zdaniem, de lege ferenda, dla pewności obrotu prawnego, należałoby stan prawny w tym zakresie zmienić i stosowne normy subrogować.

Each country which allows for organ transplantation developed legal regula-tions concerning the related procedure the objective of which is to both ensure the safety of the procedure and to prevent trafficking in human organs . There are however substantial differences between the solutions adopted by particular legislators .The most commonly used models include the legal construct of explicit consent (represented by Norwegian legislator) and presumed consent (adopted in Poland) . A half-way model described as a bridge between those two constructs is the gift law construct adopted in the USA .The analysis of particular legal regulations related to transplantology may have an impact on amendments to Polish legislation aiming at an increase in the number of organ transplants .

Opis:
Mediation was popularized in modern times in the United States. Its origins were found in the mediation of labour disputes between unions and employers, as a means of avoiding strikes, and currently it is used more and more frequently in individual employment matters. While mediation is not as widespread in Poland to date, its use in labour and employment cases appears to have a similar arc of development. Since the 1990s, mediation has had a central and positive role in resolving collective labour disputes, and now it is being used increasingly in individual employment cases. This paper explains these developments, with a particular focus on the evolution and scope of employment mediation under Polish and European Union law. The author concludes that although the basic framework exists for mediation to develop further in Poland, further reforms would be helpful to ensure its success.

In his article, the author deals with the relationship between tax, financial and administrative law. He states that, in the historical context, financial law has formed in the field of administrative law. He stresses out the symbiosis between these two branches of law. According to the author, the scope of legal regulation, expressing the relationship between tax law, financial law and administrative law, is determined expecially by two major areas: athe organization of the financial administration or tax administration, as well as the resulting legal status and competence of the bodies of public administration, which are financial, or tax bodies at the same time, bthe legal regulation of legal procedure at the financial or tax bodies. In the following text, the author analyses the legal solutions of both basic areas of relationships between tax law, financial law and administrative law in detail.

This contribution deals with the protection of consumer rights which must be clear and certain. At the same time, it is not possible to protect the important interests of the stability of the financial market and its actors and, at the same time, to protect those who use the services of these actors. After all, the interests of the parties in a contract are not entirely compatible, the client wants to receive the lowest possible price of capital and the borrower the highest possible price. A body that will protect one party will not be independent with regard to the other interest being protected. The idea of all the Financial Ombudsmen created after 2008 is precisely that of protecting one party, the consumer/customer, who, in his or her own way, is the guarantor of the banks' liquidity security. This idea prevails where the consumer of financial services is effectively protected. The Ombudsman is, in a way, a consequence, but also a guarantor of financial stability and the financing system, and not speculation on consumers.

The segmentation of extralinguistic reality in various languages in many cases does not overlap, which is one of the sources of translation difficulties. The problem is particularly evident in the area of law because different communities mold this sphere of life in divergent manners, creating institutions unknown to other legal systems or building up conceptual networks specific to those systems. This last issue has become the subject of analysis. The author examines selected English law based and Polish criminal law terms, revealing semantic shifts between them and the consequences of the shifts for the translation process. The investigated terms are as follows: homicide, murder, manslaughter, assault, battery, and burglary. The author studies their legal meanings juxtaposing them with the meanings of the Polish terms proposed in dictionaries and glossaries as equivalents for the English terms (for instance, morderstwo, zabójstwo, pobicie, naruszenie nietykalności cielesnej, kradzież z włamaniem, włamanie). The analysis confirms the soundness of a comparative approach to the translation of legal terminology advocated by Peter Sandrini: in order to decide whether a proposed equivalent can be used, its notional content must be compared with the notional content of the original term in a given context.

The paper deals with the specific organization of the shared custody regime in Spanish Law. This requires a separate analysis of two aspects: how the physical organization will be and how the time will be distributed among the parents. With regard to the first question, there are two possible alternatives for the physical organization of the shared custody regime: that the children remain in the same home and the parents rotate, or that the children rotate between their parents' homes. Both possibilities are analyzed, considering the advantages and disadvantages of each, as well as their practical repercussions, through the study of the judgements of our courts. With regard to the second aspect to be analyzed – the distribution of time between parents, as we know, shared custody does not necessarily imply an equal distribution of time, although it does seem to be similar, as this is the main data that allows it to be differentiated from an exclusive custody regime that involves a wide regime of visits for the non-custodial parent. The paper attempts to determine the necessary time requirement to be able to speak of shared custody and addresses the issue of the specific duration of periods of alternation – which may be long and extended in time or, on the contrary, short and frequent. For this, once again, the jurisprudence emanating from our courts is taken into account, as well as the doctrine of the authors who have worked on this issue.

The article concerns primarily the effects of the membership of the European Union on national (Polish) law and, to a limited extent, on the political system of a state. The conclusions presented in the article are of universal value. Although the article deals with Polish affairs, the principles, tendencies and consequences identified are typical of the relationship state – the EU, both before and after accession, regardless of the state concerned. It should be, however, noted that the path to membership and the membership itself are different in each case. The practice of the Polish membership of the European Union, its systemic dimension and the changes in the national legal system (Europeanisation) do not differ significantly than in the case of other Member States. Europeanisation of Polish law, politics, economy, culture and society has been in progress since the 1990s. One can differentiate between two stages of Europeanisation: before and after Poland’s EU accession, each characterised by different conditions. Over time, this process, on the whole, has been undergoing numerous changes but it has never weakened in importance. Poland faces issues such as poor legitimation of integration processes, supremacy of the government over the parliament, passivity of parliamentary committees in controlling the government and EU institutions in the decision making process, as well as dilution of responsibility for decisions taken within the EU. The process of Europeanisation relies mostly on direct application of the standards of EU law in the national legal system, implementation of directives into national law and harmonisation or standardisation of national legal solutions so that they comply with the EU framework. It is also reception of a common, European (Union) axiology.

The article aims to help realize that to understand the changes which take place in space policy and space law, it is necessary to abandon the old course of thought and think the other way. The author exposes thesis that force to take a look at the law in a different way. He states that: all sources of international law (specified in Article 38 of the Statute of the ICJ) and EU law are in force in the Polish legal order, with the exception of international agreements, which only apply if they are ratified by the Republic of Poland and published in the Journal of Laws of the Republic of Poland. The legal policy (conducted by the competent authorities in each forum based on the specific procedures) is the ius reflex, which inspires the development of lex and vice versa. The law applies beyond the borders of states’ jurisdictions (res communis) in the maritime and outer space and becomes a constitutional element of the new civilization (market and culture), which gradually affects the law within the jurisdiction of states (sovereignty and sovereign rights). The power of law ceases to guarantee the resolution of international conflicts, which forces the application of the law of force. The sine qua non condition to survive the new civilization is to protect humanity and to share resources fairly in the process of transformation.

After World War II Polish law was based on law of the USSR. Family law played important role in the reception of Soviet law, because it was the first example of applying Soviet rules. According to Soviet doctrine and legislation, family law was treated as an independent branch of law, separated from civil law. The construction of private law was rejected. The process of adapting Soviet rules started in 1949, when Polish and Czechoslovak lawyers were working together on draft of Family Code. No one of important Polish lawyers supported the idea of separation of family law from civil law at the beginning of works. Later they were forced to change their views and some of them (especially Seweryn Szer) supported the idea of separation of family law strongly. In the late 50’s the discussion about localization of family law was very emotional and open. It was the result of changing political situation (fall of the Stalinism). However, there was no political consent to prepare one civil code and that’s why two codes were passed in 1964: Family and Guardianship Code and Civil Code. The reception of Soviet rules in Polish family law was superficial. According to the prevailing opinion, the existence of separate Family code did not create independent branch of law and family law was regarded as a part of civil law. The supporters of the idea of separation were not able to construct the convincing theory about it. Present attempts to retain separated family code have no historical justification.

The article deals with the problem of actual questions of tax law science. In connection with this, the author points out that not only is tax law a new branch of Slovak law, but tax law science is also a new event of legal science. The background for an investigation of the matter is to understand tax law as a new, independent branch of law, which is a part of the legal order of Slovak republic. Furthermore, the author concentrates on the definition of the subject of tax law science. He states that the subject of tax law science is formed by these basic areas: a) tax-law institutes and tax-law legal regulations, b) tax, or tax-law relationships, c) tax legislation and law making in the area of taxes and fees. The author also pays adequate attention to the aim of tax law science, its functions and the methods it uses. In the final parts of the article, the author concentrates on specific basic areas of problems, which may as well be indicated as the current objectives of tax law science.

In particolare è inammissibile l’enfatizzazione dei ‘Trattati’ sino al punto di minacciare l’uomo e l’ambiente. Il diritto romano indica la via per impedire l’assoggettamento agli interessi economico- finanziari di pochi.
The proclamation of rights without contextual means to ensure. is not an effective source of justice and leads to a justice crisis. A new ‘model’ must be proposed , which sees the Roman law and process as a source of innovative suggestions and ideas that apply to the present. In particular, it is important to emphasize the ‘Treaties’ as threatening to man and the environment. The Roman law indicates the way to prevent the underlying economic and financial reign of the few.

Międzynarodowy reżim prawa energii jądrowej charakteryzuje unikalne połączenie oraz wzajemny wpływ wiążącego prawa oraz niewiążących dokumentów przyjmowanych przez organizacje międzynarodowe. Jedną z najważniejszych jest Międzynarodowa Agencja Energii Jądrowej, a przyjmowane przez nią wytyczne oraz zalecenia są uważane za wzorcowe w praktyce legislacyjnej państw niezależnie od położenia geograficznego, kultury prawnej czy obecności energetyki jądrowej w kraju. Determinuje to szerokie zastosowanie tych dokumentów w charakterze soft law. W artykule oceniono możliwości ich wdrożenia do prawa energii jądrowej w Polsce. Zbadano także wpływ soft law na rozwój tej gałęzi prawa łącznie z wykazaniem powiązań pomiędzy prawem międzynarodowym, europejskim oraz krajowym. W wyniku badań wykazano, że zastosowanie soft law w polskim prawie energii jądrowej znacząco wpłynęło na jego dostosowanie do międzynarodowych standardów.
The international regime of nuclear energy law is characterized by the unique combination and mutual influence of binding law and non-binding documents. These documents are adopted by international organizations. One of the most important organisation is the International Atomic Energy Agency, and the guidelines and recommendations adopted by this organisation are considered to be exemplary, hence their worldwide application as soft law. In the article below, the author examines the possibilities of implementing these documents into the nuclear energy law in Poland. The impact of soft law on the development of this law area is also examined, including a demonstration of links between international, European and domestic law. As a result of the research, the author shows that the application of the soft law in the Polish nuclear energy law significantly influences its adjustment to international standards.

Attempts to prosecute crimes without the involvement of the public are certain to end in a fiasco (Stanisław Waltoś). On 3 April 2018, the Act of 8 December 2017 on the Supreme Court entered into force (Journal of Laws of the Republic of Poland of 2019, item 825, consolidated text). The aforementioned act introduced lay judges to the Supreme Court. The lay judges of the Supreme Court are to rule on cases examined in second instance in the Chamber of Disciplinary Proceedings, and in cases brought by an extraordinary petition. The changes made seem to express the principle of the participation of the citizenry in justice, as articulated in Article 182 of the Constitution of the Republic of Poland. In fact, these changes appear to be groundbreaking and pose a number of risks to the proper functioning of the judiciary. The changes raise doubts as to whether lay judges will have jurisdiction in the cases examined in the Chamber of Extraordinary Control (which involve a considerable degree of legal complexity). Furthermore, the participation of lay judges in the courts of appeal is a solution hitherto unknown in the Polish legal system. Moreover, a sudden turn in the axiological preferences of the legislature is noticeable. The Legislature amended the Code of Criminal Procedure in 2006 (JL RP No. 89, item 556, as amended) and clearly expressed a critical attitude to the institution of lay judges, pointing out the need to professionalize the judiciary. 
Podejmowanie prób ścigania przestępstw bez udziału społeczeństwa musi zakończyć się fiaskiem (Stanisław Waltoś). Ustawa z 8 grudnia 2017 r. o Sądzie Najwyższym (t.jedn.: Dz. U. 2019, poz. 825), która wprowadziła do orzekania w Sądzie Najwyższym sędziów społecznych, weszła w życie 3 kwietnia 2018 r. Ławnicy SN, mają orzekać w sprawach rozpoznawanych w drugiej instancji w Izbie Dyscyplinarnej oraz w sprawach wywołanych wniesieniem skargi nadzwyczajnej. Wprowadzone zmiany zdają się, prima facie, realizować wyrażoną w art. 182 Konstytucji RP zasadę udziału czynnika społecznego w sprawowaniu wymiaru sprawiedliwości. W istocie mają charakter pozornie przełomowy, a zarazem niosą szereg zagrożeń dla prawidłowego funkcjonowania wymiaru sprawiedliwości. Budzi wątpliwości powierzenie orzekania w sprawach rozpatrywanych w Izbie Kontroli Nadzwyczajnej (o znacznym stopniu prawnej zawiłości) sędziom faktu. Nadto udział ławników w składach sądów odwoławczych jest rozwiązaniem nieznanym polskiemu systemowi prawnemu. Nie można stracić z pola widzenia nagłego zwrotu preferencji aksjologicznych ustawodawcy, który nowelizując k.p.k. w 2006 r. (Dz. U. Nr 89, poz. 556 ze zm.) jednoznacznie krytycznie wypowiedział się o instytucji ławników, wskazując na potrzebę profesjonalizacji sądownictwa.

This article tries to return to the essence of civil law which, with a little more than ten key contractual institutions, allows all disputes created from newly founded institutions to be examined and interpreted. Hence the study of Roman law and Roman legal tradition remain a constantreference to our continental law. However, this does not prevent them from being open to gradual enrichment.

This study outlines the rules that have created full gender equality, starting from the first generation of human rights to equal treatment and then positive discrimination, also briefly referring to the theoretical foundations. The study also points out areas where, besides ius cogens, the disadvantages of women in everyday practice have remained particularly significant. Thus, the second part of the study addresses the main issues of criminal law and workplace discrimination, supported by examples. It is deemed necessary due to issues of labour law and criminal justice practice illustrating most clearly why ensuring equality before the law does not suffice. At the same time, the need for much more gender-sensitive legislation and legal redress is being formulated, especially in the areas mentioned above.

In the article chosen issues of the relation of the Polish and the European agricultural law in basic concepts were presented. They made an appraisal of the need of the redefinition of these notions. In conclusion, it was found that only changes of a basic concepts may make it necessary to formulate a new agricultural legislation in a European perspective. They pointed also at issues of sending back legal for European regulations. They also dealt with linguistic issues and interpretation of formulated notions. It was emphasized, that the concepts of agricultural legislation contained in European law are concepts national law of particular importance. They are not only modifying already existing notions, but also, when the contradiction is occurring between them they are more important and should be applied in the given area of the regulation.

Despite the traditional postulates of jurisprudence regarding the necessity to introduce flawless bills, each legal system struggles with issues which arouse controversy and become the subject of a lively political and legal debate. Even if the controversy affects millions of people and their private lives, the decision to solve it is limited by government policy. For example, this pattern is reflected in the married couples’ same surname issue in Japanese Family Law. Japanese courts investigated it yet did not provide any binding solution. The media have also increasingly raised this problem as an example of a private law defect requiring a fundamental change in the near future. Still, public awareness of the legal controversy is insufficient to overcome it. Even though a large part of Japanese society supports the reform of the married couples’ same surname system, the government protects it as an embodiment of Japan’s legal tradition and a symbol of family unity. Undoubtedly, the dispute regarding the need to revise Family Law went beyond the legal debate and became a significant political and social issue in the last three decades. Unfortunately, Western legal scholarship is still unaware of this vivid example of the 21st-century rivalry between the liberal/individual and the conservative/collective views in one of the most distinguished private law systems.

Orientation sentences for the remark 1. In the case of non-fully harmonised EU law, the fundamental rights of the Basic Law constitute the primary standard of assessment. Within the diversity of fundamental rights provided for by European law, the presumption is that the fundamental rights of the Charter of Fundamental Rights of the European Union (GrCh) are co-guaranteed by those of the GG(German Constitution). That presumption can only be rebutted if there is concrete and sufficient evidence to support it. 2. Threats from the dissemination of personal reports and information as part of public communication affect the scope of protection of the expressions of general personality law, not that of the right to informational self-determination. 3. The general right of personality does not give way to filtering and restricting publicly available information about one’s own person according to his own ideas. The unlimited public confrontation with previous positions, statements and actions, on the other hand, is not appropriate. 4. On the contrary, it is necessary to strike a balance with the interests of the content provider, with specific emphasis on the temporal aspect, availability and context of the information in relation to the communication conditions of the Internet.

In a common law jurisdiction, according to the principle of stare decisis judges are bound to interpret a constitutional or common law principle by applying authoritative cases already decided. Parties in disputes pending before the courts must find and assess the prior cases on which they can expect that judges will rely. Not very long ago, research for such precedent involved reviewing known cases and linking them to other cases using topical digests and citators. Success with this approach required a patient, persistent, thorough, and open-minded methodology. Modern information accessibility gives previously unimaginable quick access to cases, including with tools that promise to predict judicial tendencies. But this technological accessibility can have negative side effects, including a diminished research aptitude and a stilted capacity to synthesize information. It can also lead to an inadequate account of the human factors that often cause judges to depart from predictions based on logical inference from prior cases. This article considers the extent to which the identification of precedent is essential in legal analysis, yet is of limited value in predictability as a result of judges’ unavoidably human perspectives. With examples from landmark cases, the article illustrates that judges sometimes make decisions based on considerations that will not be revealed in a mechanistic application of precedent. The article considers how evolving legal research tools and methods give access to precedent that in some respects makes the process more scientific, but in other respects can obscure the realities of how cases are decided. The article also gives examples of this paradox as demonstrated by today’s students who are learning how to do research, drawn from years of the authors’ teaching experience.

Slovak competition law enforcement can be characterized by infrequency of leniency applications and near absence of private enforcement. As a result, the adoption of the Damages Directive is not likely to cause substantial breakthrough in Slovakia, be it with respect to the rate of leniency applications or in private enforcement. A comprehensive amendment of Slovak competition law took place in 2014. Changes introduced therein reflected, among other things, the practice of the European Commission regarding access to its file. A new approach was also introduced towards damages claims submitted against leniency applicants. The paper will first consider the question whether it is necessary to further redesign these new Slovak rules because of the adoption of the Damages Directive, or if they have been successfully pre-harmonized. Along with changes to Slovak competition law, procedural rules for civil courts were also re-codified. Hence the second part of this analysis will focus on the question if a new civil procedure framework, including obligatory harmonization, could foster private enforcement of competition law. Summarizing the resulting answers, the third question focuses on who could benefit from further changes to Slovak legislation – final consumers or enterprises that are involved in the production chain. Finally, will changes in Slovak legislation driven by the Directive be coherent with its overall legal system, or will they appear to be an odd and peculiar piece of legislation?

Regardless of the times in which we live, the notion of truth blends with the notion of untruth, wisdom with stupidity, faith with unbelief, justice with injustice, and lawlessness with unrighteousness. Human attitudes appear to be permanent, although there are a number of instruments with which to change them. Because of mass media, law has entered every person's life. Good law can be corrupted and bad law can be repaired; the point is to be properly prepared for it and to take on such a challenge when required by a justified situation. Principles of the law, the less comprehensive and more understandable for the citizen, the better accepted by the society. The fewer ridiculous, stupid and nondescript verdicts, the closer the law to the judge and judge. Regulations, orders and prohibitions cannot be divorced from reality, they must keep up with the flow of time. Otherwise, law becomes lawlessness, justice becomes injustice, and the rule of law disappears. The quality of values will be whatever the demand is.

Fourteen years after the enactment of Indonesian Competition Law, the public has had the chance to witness the enforcement practice of the Commission for the Supervision of Business Activities (the Kppu), the competition supervisory authority of Indonesia. Being recognized as an aggressive competition agency, the enforcement of Indonesian Competition Law seems to largely rely on the discretion of the Kppu. However, a review needs to take place not only of how the competition authority accomplishes its tasks, but also how the enforcement process is outlined in the provisions of the Law itself. Around 72% of the cases dealt with by the Kppu concern bid-rigging, 14% cover other types of cartel practices, further types of anticompetitive conduct account for the rest. Despite being criticized as having excessive authority covering the investigation, prosecution, and ruling on competition law cases, the Kppu faces problems in battling cartel practices because major legal flaws exist, for instance concerning collecting evidences. The discussion will be limited to the combat with cartels. Competition law enforcement through the Kppu is administrative in nature albeit with some criminal law influences (evidence). Although it is possible to enforce the law by means of criminal injunctions and private claims, they have rarely been used so far, mainly because Indonesian Competition Law lacks clarity. Problems with existing procedures are rooted in the Kppu’s inability to obtain sufficient evidences. Two propositions are made how to deal with these difficulties – using indirect evidence and implementing a leniency programme, both based on existing Indonesian Competition Law or by amending the Law and inserting new provisions which would explicitly allow the use of both indirect evidence and a leniency programme.
Quatorze ans après la promulgation de la Loi indonésienne sur la concurrence,le public a eu la chance d’assister à la pratique de l’application accomplie par la Commission pour la Supervision des activités commerciales (la KPPU), l’autorité de surveillance de la concurrence de l’Indonésie. Reconnu comme une autorité de la concurrence agressive, l’application de la Loi indonésienne de la concurrence semble se référer largement à la discrétion de la KPPU. Toutefois, un examen doit avoir lieu non seulement sur la façon dont l’autorité de la concurrence accomplit ses tâches, mais aussi la façon dont le processus d’application est décrite dans les dispositions de la Loi elle-même. Environ 72% des affaires traitées par la KPPU concernent des offres collusoires, 14% d’autres types de pratiques de cartel et encore d’autres types de comportement anticoncurrentiel compte pour le reste. En dépit d’être critiqué comme ayant autorité excessive couvrant des enquêtes, des poursuites, et des jugements sur les affaires de droit de la concurrence, la KPPU fait face aux problèmes rélatifs à la lutte contre les pratiques de cartel, car les grandes failles juridiques existent, par exemple en ce qui concerne la collecte des preuves. La discussion sera limitée à la lutte contre les cartels. L’application de la loi de la concurrence par la KPPU est de nature administrative mais avec quelques influences provenant du droit pénal (preuves). Bien qu’il soit possible d’appliquer la loi au moyen d’injonctions pénales et des demandes privées, ils ont été rarement utilisées jusqu’à présent, à cause de manque de clarté par rapport au droit indonésien de la concurrence. Les problèmes avec des procédures existantes sont enracinés dans l’incapacité de la KPPU d’obtenir des preuv es suffisantes. Deux propositions ont été faites sur la manière permettant de résoudre ces difficultés - en utilisant des preuves indirectes et en mettant en œuvre un programme de clémence, tous les deux basés sur la Loi indonésienne actuelle sur la concurrence ou en modifiant la Loi et introduisant des nouvelles dispositions qui permettraient explicitement l’utilisation des deux preuves indirectes et un programme de clémence

The analysis points out that the Crimean peninsula remains an integral part of the territory of Ukraine, as the annexation of the area by the Russian Federation is null and void under the law due to the breach of generally applicable rule of international law concerning the prohibition of aggression. Therefore, only Ukraine is authorized to manage the airspace above the region. In case of any aviation accident in the territory of Crimea, it is not permissible for International Civil Aviation Organization (ICAO) to recognize the competence of Russia in relation to carry out the investigation. Moreover, such recognition cannot ensue from an agreement between Russia and Ukraine, except for the delegation of responsibilities to investigate the accident in which a Russian plane has been involved.
