The article discusses the problem of natural justice which has been considered by Aristotle in his (1) Nicomachean and Eudemian Ethics and (2) Magna Moralia. In his Nicomachean and Eudemian Ethics Aristotle says of natural justice that it is changeable and not the same everywhere. The implication seems to be that no action, not even murder, is always wrong. But, as is evident especially from his Magna Moralia, Aristotle distinguishes justice into the “what” (equality), the “in what” (proportion between persons and things), and the “about what” (what things are exchanged with which persons). The article concludes that Aristotle allows for variability only in the “about what,” while in the “what” and the “in what” he allows for no variability.

The present qualitative study sought to unravel English as a foreign language (EFL) teachers’ perceptions and experiences of classroom justice and injustice. By employing purposive sampling, 31 EFL teachers in Iran were targeted to respond to an open-ended questionnaire. Subsequently, five of them took part in a follow-up, semi-structured interview. All data analyses were conducted via MAXQDA software. The main findings of the study were as follows; (1) The procedural, interactional, and distributive justice dimensions emerged in the teachers’ accounts of justice and injustice; (2) classroom justice was highlighted more saliently in teachers’ accounts than classroom injustice; (3) the teachers mainly had positive evaluations of their justice practices; and (4) they regarded educational and institutional factors, student-related factors, and teacher-related factors as the three major sources of challenges faced by EFL teachers when enacting classroom justice. It is hoped that by unraveling and reflecting on their justice and injustice behaviors, EFL teachers be prompted to go for their instructional justice betterment and more skillfully handle daily challenges that they face when trying to act fairly in the classroom.

Názov článku je pápežským mottom Pia XII., ktoré preberá latinský preklad prorockého textu v Iz 32,17. Pius XII. nastupuje na Petrovu katedru v pohnutých rokoch vypuknutia najväčšieho ozbrojeného konfliktu v dejinách ľudstva. Motto doslovne znamená: „Dielom spravodlivosti je mier“ či „Dôsledkom spravodlivosti je mier“. Príspevok sa pokúsi túto dôsledkovú vetu osvetliť panoramatickým prehľadom vnímania cnosti spravodlivosti v antike, Písme a v morálnej teológii a v jej silnom vplyve na mier vo svetle súčasného magistéria Cirkvi. V prvých dvoch častiach príspevku sa preto pokúsime kontextuálne definovať spravodlivosť z pohľadu morálnej teológie. Opíšeme spravodlivosť z pohľadu mravnej a spoločenskej cnosti, ako aj klasické typologické rozdelenie a pokúsime sa vystopovať fontes, z ktorých čerpá Magistérium. V tretej a štvrtej časti príspevku budeme hovoriť o dôležitosti konceptu spravodlivosti v Písme a magistériu sociálnej náuky Cirkvi a zvláštnu pozornosť zameriame na dôležitosť tohto učenia v ostatnej sociálnej encyklike pápeža Františka Fratelli tutti v snahe o zodpovedanie otázky, či je táto encyklika krokom k spoločnému budovaniu trvalého mieru v duchu predošlého magistéria alebo v nej nachádzame pokus o zrieďovanie hodnôt a krok k vytvoreniu akéhosi svetového globálneho náboženstva, ako by sa niektorí mohli obávať.
The title of this article is a papal motto of Pope Pius XII, which adopts the Latin translation of the prophetic text in Isaiah 32:17. Pius XII ascends the Chair of Peter in the turbulent years of the outbreak of the greatest armed conflict in human history. The motto literally means “The work of justice is peace”, or “The consequence of justice is peace”. This paper will attempt to illuminate this corollary phrase with a panoramic survey of the perception of the virtue of justice in antiquity, Scripture and moral theology and its powerful impact on peace in the light of the contemporary Magisterium of the Church. In the first two parts of this paper, therefore, we will attempt to contextually define justice from the perspective of Moral theology. We will describe justice in terms of moral and social virtue as well as classical typological divisions and attempt to trace the fontes from which the Magisterium draws. In the third and fourth parts of the paper we will discuss the importance of the concept of justice in Scripture and the Magisterium of the Church’s social doctrine, and we will pay particular attention to the importance of this teaching in Pope Francis’ recent social encyclical Fratelli tutti in an attempt to answer the question, whether this encyclical is a step towards building lasting peace together in the spirit of the previous Magisterium, or whether we find in it an attempt to dilute values and a step towards the creation of a kind of world global religion, as some might fear.

W artykule poruszono zagadnienie zrównoważonego rozwoju. Przedstawiono je z perspektywy sprawiedliwości społecznej. Zasadniczy wątek dotyczy sprawiedliwości międzygeneracyjnej skierowanej na przyszłe pokolenia. Przyjęto założenie o potrzebie uporządkowania dyskusji na temat zasady zrównoważonego rozwoju jako zasady sprawiedliwości społecznej, opierając się o pełną definicję tego pojęcia z raportu komisji Brundtland. Uznano, że część dyskusji to wynik nieporozumienia wynikający z ograniczenia definicji do jednego z dwóch składających się na nią zdań. Dyskusja może być uporządkowana dzięki uwzględnieniu postulatu ograniczenia potrzeb do podstawowych potrzeb ludzi najbiedniejszych oraz postulatu uwzględnienia możliwości technicznych i sposobu organizacji społeczeństwa w danym czasie. Potrzeby te zinterpretowano zgodnie z definicją potrzeb podstawowych J. Rawlsa. Następnie pokazano, że sama zasada sprawiedliwości międzygeneracyjnej nie budzi wątpliwości, jeśli odnosi się ją do przeszłych pokoleń lub do następnych dwóch–trzech pokoleń. W centrum uwagi postawiono zatem zagadnienie słuszności rozciągnięcia tej zasady na wszystkie możliwe przyszłe pokolenia. W celu uzasadnienia tak rozumianej zasady sprawiedliwości międzygeneracyjnej omówiono stanowiska oparte na teorii interesu.
The article treats the topic of sustainable development that is depicted from the perspective of social justice. The keynote concerns intergenerational justice directed towards future generations. It has been assumed that there is a need to set in order the discussion regarding the principle of sustainable development as a principle of social justice basing on the concept from the Brudtland Commission Report. It has been acknowledged that part of the discussion is a result of misunderstanding as the definition was limited to one or two sentences. Furthermore, the discussion might be ordered thanks to the postulate of reducing needs of poorest people to basic ones and taking into account technical possibilities and a way of organizing the society in given time. The needs were interpreted according to Rawls’ basic needs definition. The article further demonstrates that the principle of intergenerational justice itself does not raise doubts if related to past or next two or three generations. Hence, the legitimacy of the extension of this principle to all possible future generations stays in the limelight of the article. In order to substantiate the principle of intergenerational justice the article discusses the positions based on the theory of interest.

Transitional justice is resorted to within the framework of transition from armed conflict to peace and from authoritarian regimes to the democratic ones. To reach the aims of transitional justice and to better integrate the needs and perspectives of the indigenous peoples that very often are victims of serious human rights violations in the transitional context, as well as the colonisation context, indigenous instruments of justice may be utilised. As such they may be treated as complementary to other transitional justice mechanisms. The article aims to find a new perspective on the complementary role of the indigenous justice and the State justice systems within the framework of transitional justice as well as to take into account the indigenous peoples’ needs and customs. The overall aim of the paper is to answer the question whether it is desirable for such indigenous justice instruments to complement the State justice systems through a better integration of the needs and customs of indigenous peoples. In the concluding remarks, a model of complementarity model of transitional justice that includes indigenous instruments will be proposed.

The author’s motivation for undertaking this research was his own anxieties; anxieties arising from the global ecological and environmental emergency. The aim of my research was to determine young people’s awareness of the climate emergency and their agency (possible actions) related to remedying this phenomenon. In conducting the research, a mixed quantitative and qualitative strategy was used with an online survey, thus examining the opinions of the respondents. The text analyses the answers to questions eliciting opinions on the climate and environmental emergency (a term used in one of the European Parliament’s relevant resolutions), with particular regard to the possibility of stopping the aforementioned crisis. Respondents were primary and secondary pupils, and university students. Among the conclusions, the following should be singled out: 90.3% of respondents agree that we are dealing with an ecological and environmental emergency, but only 12.5% believe that we will stop the crisis, while 29.8% do not, and 57.7% do not know. Most importantly, the analysis of young people’s statements reveals the pessimistic nature of their opinions, revealing the fading hope of remedying the emergency. In combination with the literature review, this sends an alarming message about the need to act not only to deal with the crisis but also in the field of information addressed to all social groups. In summary, there is evident fear that predictions of disaster may turn out to be self-fulfilling prophecies (as defined by Robert K. Merton). The demonstrated ability of young people to influence politicians offers us a hope that we might prevent such a disaster. For such action to succeed, it needs to take place both inside and outside of schools and universities.

Historical memory can be divided into three main levels: collective (national), mass and individual. The ratio between them can be different: the same, overlap or contradicting each other. So when forming the collective historical memory should be made of the three main factors: political order, their own interests’ agents, the desire not to offend or not to initiate an active disagreement from those who have personal experience that has formed an opinion on this period, or event. Memory is expressed in signs and symbols, affecting both the mind and the subconscious mind; it constantly recharges sense of national identity, loyalty lifestyle and righteous actions. The history of society during war clearly identifies basic principles of nature as an individual and society as a whole. The military component is one of the most accurate tests of justice and legality, correctness of life as individuals, social groups and the whole society. Therefore, the study of the formation of national memory, using military experience, allows high accuracy to determine the major features of mentality. For the history of formation of the memory of the American society, exactly the Vietnam War can be called the most striking example of the use of memory about it to prove its creditability.

The paper refers to selected issues of exploitation in the face of justice. The analysis is based on the definitions of exploitation contained in the Polish Penal and Civil Codes. The main goal is the identification of the necessary and sufficient conditions for the recognition of exploitation as being unjust. A supplementary question will refer to a specific type of justice which should be considered in this case. In this respect, we should consider retributive, distributive and social justice. Another important factor in this regard is the accepted theory of value. In the presented considerations, we will focus on the labour theory of value. The principal issue can be expressed by the questions whether exploitation is ipso facto unjust and how the phenomena of exploitation and justice are related to each other.

Some of these concepts assumes and requires existence of some kind of social persons. By briefly analysing those notions the author tries to show the specificity of particular types of meanings assigned to the social justice.

Celem artykułu jest analiza pojęcia sprawiedliwości w ujęciu prawnym na przykładzie sprawiedliwości podatkowej. Autor, definiując pojęcie sprawiedliwości, wskazuje na jej wieloaspektowy i złożony charakter oraz na brak normatywnej definicji tego pojęcia. W artykule został poruszony aspekt sprawiedliwości opodatkowania przez pryzmat zasad składających się na pojęcie sprawiedliwości podatkowej. Przedstawiono także ujęcie sprawiedliwości podatkowej w Konstytucji RP, uwzględniając różnice w opodatkowaniu osób fizycznych i prawnych z punktu widzenia zasady zdolności płatniczej.
The aim of the paper is to analyze the concept of legal justice on the example of tax justice. By defining the concept, the Author points out its multifaceted and complex character, noticing the lack of a normative definition of the idea of legal justice. The article deals with the taxation justice through the prism of taxation justice principles. The author recognizes also the inclusion of tax justice in the Constitution, taking into account differences in the taxation of natural and legal persons from the payment capability principle point of view.

This article is part of a larger project that explores how to channel people’s passion for popular arts into legal social justice by reconceiving law as a kind of poetry and justice as dance, and exploring different possible relationships between said legal poetry and dancing justice. I begin by rehearsing my previous new conception of social justice as organismic empowerment, and my interpretive method of dancing-with. I then apply this method to the following four “ethico-political choreographies of justice”: (1) the choral dance of souls qua winged chariot-teams (from Plato), (2) a dancingly beautiful friendship with the community (from Aristotle), (3) a tightrope-dance of the cool (from Al-Farabi), and (4) humans dancingly reimagined as positioned actors in fluidly moving groups (from Iris Marion Young). I then synthesize these analyses into “dancing justice,” defined as the dynamic equilibrium sustained by a critical mass of a community’s members comporting themselves like social dancers.

This paper argues that neither the relational approach nor the non-relational approach to global justice is at once necessary and sufficient to deal with complex cases of global (in)justice. In this intervention in the dispute between relational and non-relational approaches, the aim of the paper is not to support one side and oppose the other, but to combine both approaches in order to arrive at a more robust approach. Using the strengths of the relational approach to compensate for the weaknesses of the non-relational approach and vice versa, the aim of the paper is to set out a mixed, combinatorial or synthetic approach that will be used to address complex cases of global (in)justice. Rather thandiscussing how the synthetic approach applies to a particular complex case of global (in)justice, the paper shows how a synthetic approach that intends to address complex cases of global (in)justice will look like. Perhaps, colloquially in Hegelian dialectics, the relational approach can be seen as a thesis, the non-relational approach as an antithesis and the combination of both approaches as a synthesis.

In Polish psychology there has been no systematic research so far on the experience of contact with courts and on the evaluation of this experience using the theory of procedural justice. Polish psychologists do not have Polish instruments measuring procedural justice at their disposal. The Procedural Justice Scale is a measure operationalizing the dimensions of procedural justice according to Tyler’s model: respect, neutrality, voice, understanding, and influence. The aim of the present article is to present the work on the revised version of the Procedural Justice Scale, measuring procedural justice operationalized exclusively in psychological terms, and to present the psychometric properties of this scale. In particular, the author tested the reliability of the instrument and verified its validity based on confirmatory factor analysis, scale intercorrelations, and intergroup differences. The results confirmed the five-factor structure of procedural justice. They also confirmed the criterion validity of the measure, reflected in correlations with validation instruments.

The article discusses the issue of the fundamentals of justice. Despite the dominant narratives about the conventional nature of this category, it is claimed that the fundamental of justice is the inherent human dignity. Justice finds its his real and substantial foundation in the dignity of the human person. Therefore, the inherent (innate), non-transferable, inalienable dignity, which is associated with the essence of man, is the foundation of justice and its requirements requiring to “give to each what he deserves” (suum cuique tribuere), to give “to each his own” or his due, which means the natural human rights, the most rudimentary of which is the right to life and the right to personal development. The assertion of those basic human rights is not a matter of any convention, agreements, contracts or the will of the legislator, or any political games, but a matter of justice, natural justice.
W artykule podjęto zagadnienie podstaw sprawiedliwości. Pomimo dominujących narracji o konwencjonalnym charakterze tej kategorii przyjęto, że podstawą sprawiedliwości jest przyrodzona godność człowieka. Sprawiedliwość znajduje swą realną, bytową podstawę w godności człowieka. Tak zatem wiążąca się z samą istotą człowieka przyrodzona (wrodzona), niezbywalna, nieutracalna godność jest podstawą sprawiedliwości i jej wymogów nakazujących „oddać każdemu to, co mu się należy” (suum cuique tribuere), oddać „każdemu, co jest jego”, co jest własne, co jest należne. A chodzi o naturalne uprawnienia, prawa człowieka, z których najbardziej elementarne to prawo do życia i prawo do osobowego rozwoju. Zagwarantowanie/urealnienie tych uprawnień, podstawowych praw człowieka, nie jest kwestią jakiejś konwencji, uzgodnień, umowy, woli prawodawcy czy gier politycznych, lecz kwestią sprawiedliwości – naturalnej sprawiedliwości.

Artykuł prezentuje koncepcję sprawiedliwości społecznej na tle idei sprawiedliwości ogólnej. Idea ta jest obecna w dyskursie filozoficznym od zarania dziejów, początkowo opierana na prawie naturalnym, a w nowożytności – na umowie społecznej. Wiodącym ujęciem jest Ulpianowski nakaz oddania każdemu, co mu się słusznie należy, przyjęty przez myśl autorów religijnych. W naukach prawnych idea sprawiedliwości łączy się ściśle z ideami równości, godności osoby ludzkiej, wolności oraz demokracji. Nie należy jednak utożsamiać sprawiedliwości z równością. Na tle idei sprawiedliwości ogólnej narodził się postulat zachowywania zasad sprawiedliwości społecznej, obecny także w polskiej Konstytucji.
This paper shows the conception of social justice against a background of an idea of general justice. The idea exists in philosophic debate since dawn of history. At the beginning justice was based on natural law, but from renaissance its meaning is strictly related to social contract. Ulpian demand of “constant and perpetual will to render to every man his due” is the leading concept, received also in religious field. In law sciences the idea of justice is strictly connected with such ideas of equality, dignity of human person, freedom and democracy – but justice is not the same as equality. Against the background of general justice has been born a postulate of social justice, which is present also in the Constitution of the Republic of Poland (of 1997).

Restorative justice is without any doubt one of the most important steps in the development of criminal law, which at the same time increased the level of humanity in the approach towards perpetrators and victims and managed to achieve the principle goals of criminal law. A few decades have passed since its idea and approach was borrowed from the traditional communities that among themselves applied it for centuries and it was transformed into the new approach of justice offering many benefits to the community where it is established. Formally, it has been more than 20 years since Bosnia and Herzegovina embraced restorative justice within its criminal law. This paper aims to discuss how much de facto it has been applied in this country and to present results of interviews with representatives from legal theory and practice where they refer to restorative justice and its major challenges for application and propose mechanisms for overcoming existing difficulties. In this article, the authors use normative, descriptive scientific methods and statistics and interviews as tools for the collection of data.

The task of corrective justice in Aristotle’s ethics is the rectification of harms or injuries resulting from voluntary or involuntary interactions between persons. However, the scope of this form of justice is not clear. In its widest conception it would include all harms done to a person against her will and without her fault. According to a narrower conception, instead, it is only an injury caused by an unjust or wrongful action that requires compensation. But in fact Aristotle distinguishes several concepts of unjust action. As a result, the narrower conception appears in various versions which are discussed in this paper.

Autor, w siłą rzeczy skrótowo zaprezentowanych analizach, stara się pokazać specyfikę poszczególnych rodzajów znaczeń nadawanych „sprawiedliwości społecznej”. Sprawiedliwość społeczna będąca przedmiotem analizy w tym artykule utożsamiana jest ze sprawiedliwością ogólną (prawną) i rozdzielczą.
In the 1840’s, due to Luigi Taparelli and Antonio Rosmini, the term of “social justice” emerged. Since that time, its meaning has developed in many ways. In the literature of the subject, one can find numerous identifications of “social justice”. This paper brings up some applications of the notion. The author, in inevitably approximate analyses, tries to show the specificity of particular types of meanings assigned to the notion of “social justice”. The article focuses on the identity of this term with justice framed as a legal and distributive justice.

The article entails the proposition to broaden the set of principles of distributive justice by formulating two classes of principles, which are a generalization of Rawls', and conservative principles of evaluating justice. The need to enlarge the set of rule of justice is justifi ed by the great degree of fi t between the orderings of goods divisions marked by the new principles and the evaluations made by the people under study. Empirical results point to the existence of a new normative dimension which can aid in ordering both the classic as well as the new rules of justice - from radically egalitarian to conservative. Generalized principles of evaluating justice form a coherent theoretical construct with the generalized rules of just choice, which we proposed with Piotr Swistak in 1995.

The article discusses the issue of fairness of the decision to resolve a dispute in mediation. The discussion concerns mediation in civil cases. In civil law relations, referring to Aristotle’s classical distinction of distributive justice (iustitia distributiva) and corrective justice (iustitia commutativa), which is the starting point of any serious discussion of justice, it is corrective justice (iustitia commutativa) that is meant here. The author indicates the obstacles to the fairness of the decision to resolve a dispute in mediation, which are mainly the problems involving the findings of fact and the substance of the settlement. Moreover, the article discusses the issue of procedural justice whose norms (rules) are not implemented in mediation proceedings. In conclusion, the author claims that the essence of mediation in civil cases is not the pursuit of justice. Mediation does not assume that the resolution is to be fair, that is not the point here. It is emphasized, however, that the institution of mediation is necessary and has its advantages, but currently the practical importance of this form of dispute resolution in the Polish legal system is little.
W artykule podjęto zagadnienie sprawiedliwości decyzji rozwiązującej spór w mediacji. Rozważania dotyczą mediacji w sprawach cywilnych. W stosunkach cywilnoprawnych, nawiązując do klasycznego rozróżnienia Arystotelesa, które jest punktem wyjścia wszelkich poważnych rozważań o sprawiedliwości, na sprawiedliwość rozdzielczą (iustitia distributiva) i sprawiedliwość wyrównawczą, chodzi o sprawiedliwość wyrównawczą (iustitia commutativa). Autor wskazuje przeszkody, jakie pojawiają się, by można było mówić o sprawiedliwości decyzji rozwiązującej spór w mediacji. Dotyczą one w szczególności problemu ustaleń faktycznych oraz istoty ugody. W artykule podjęto ponadto zagadnienie sprawiedliwości proceduralnej, której normy (reguły) w postępowaniu mediacyjnym nie są realizowane. W konkluzji autor stwierdza, że istotą mediacji w sprawach cywilnych nie jest dążenie do sprawiedliwości; w mediacji nie zakłada się, że rozwiązanie ma być sprawiedliwe, nie o to chodzi. Podkreślono jednakże, iż instytucja mediacji jest potrzebna, ma zalety, jest ważna – niemniej aktualnie praktyczne znaczenie tej formy rozwiązywania sporów w polskim systemie prawnym jest niewielkie.

This article discusses the concepts of “justice” and “injustice” in Shakespeare’s two plays: Merchant of Venice and Measure for Measure. The application of laws and its effects on the social life are the basic themes of this study. Shakespeare concluded these plays so masterfully and open endedly that it is now reader’s responsibility to decide whether the court and society are “just” enough. This study tries to give some examples from both of the plays admitting that the concept of “justice” is hard to define. The conclusions will shed further light on the discussion about the justness of Shakespearean plays.

Love and truth are the two attributes of a well-functioning society. Unfortunately, these two basic values are often being devalued in the modern world. The reason for this is the lack of a sense of justice. Especially because in the social and cultural context the truth is often relativized. In this context it is worth analysing the Pope Benedict XVI’s encyclical Caritas in Veritate , in which one should pay attention to a construction of the society in which today’s human person lives.Love and truth are the two attributes of a good society in with each human is equipped. From the very beginning, the human person is called to be directed by love and truth. He or she is called to this truth by his or her Christian life and ontic dimension of his or her nature. Society without love and truth will be threatened with agony, because it will not only stop developing but also its wrongly understood economical status will become a road to nowhere. That is why we should definitely accept the thesis that homo economicus must convert into homo religiosus in the name of love and truth, so that society will be good. Let love in truth leads to a good society, which the whole world is for us.

On the example of a workload dispute (a version of a ‘border dispute’) I present the general problem of two persons – M and P – with equal entitlements to one commodity, which is equally desired by both of them. They are both moderately altruistic; they are not angels untempted by a selfish willingness to get their own way, nor are they devils, who want to destroy others even if it leads to self-destruction. As human beings operating in a world of limited goods, they are so physically and intellectually feeble that neither of them is able to permanently enslave the other and submit him to the second person’s will. Such being the case, each solution to the problem means that the profit of one person is the loss of the second. The question, whether justice is possible at all, suggests itself whether in a situation when people are more or less equal, or with limited altruism and/or selfishness and scarce resources.

W latach 40 XIX wieku Luigi Taparelli i Antonio Rosmini wprowadzili do publicznego obiegu termin „sprawiedliwość społeczna”. Od tamtego czasu znaczenie tego pojęcia znacznie się poszerzyło. Literatura przedmiotu notuje liczne identyfikacje tego konceptu. W tej części wskazane zostały utożsamienia sprawiedliwości społecznej ze sprawiedliwością wyrównawczą (w odmianach: karzącej, naprawczej i wymiennej). Niektóre z tego rodzaju identyfikacji zakładają istnienie podmiotów kolektywnych. Występują one jako czasowe bądź przestrzenne grupy społeczne i kohorty.
In the 1840’s, due to Luigi Taparelli and Antonio Rosmini, the term of “social justice” emerged. Since that time, its meaning has developed in many ways. In the literature of the subject, one can find numerous identifications of the term “social justice”. The article focuses on the identity of this term with justice framed as: a commutative justice (in its varieties: retributive, restorative and justice of exchange). Some of these concepts assume the existence of some kind of social persons. The author, in inevitably approximate analyses, tries to show specificity of particular types of meanings assigned to the notion of “social justice”.

This paper concerns the road Poland is on to introduce restorative justice procedures within its criminal justice system. The author describes the difficulties Poland has already overcome and is still facing. In addition, the paper shows the possible dangers we are not willing to see yet. The restorative justice procedures are introduced in the name of victims. They are aimed at observing the victims' rights and interests within the criminal justice system. Restorative justice is also to bring back the conflicts to their owners. The new developments are aimed at achieving this goal. The author discusses the invisible aspects which, if not diagnosed, named and prevented in time, can steal again the conflict from those most involved in it. It was once stolen by lawyers, judges and prosecutors who officially acted for the victims' good and support. Today, an identical process is possible with mediator taking the lawyers place.

The article deals with the problem of the sense of justice of Internet recruitment procedures among young adults. Meta-analysis of studies on the sense of justice of the recruitment process shows that it is extremely important for both employers and job candidates. Influencing the attitude of a candidate to the organization, it provides a number of both positive and negative effects. In order to investigate the problem, in case of young adults (as people which entering the stage of development, which one of the main goals is to find a job), it has been conducted a three-part test to determine the perceived level of justice of e-recruitment procedures, as well as its impact on the assessment of the recruitment announcement and recruiting organization. On the basis of the Internet survey (N=280), we found significant differences between categories of significance for justice (transparency, objectivity, feedback, job information and freedom of expression) and predictions as to the actual course of Internet recruitment. Furthermore, in the experimental variant we demonstrated that the assessment of the general announcement is only to ensure a fair procedure for the provision of feedback.
W artykule poruszono problem poczucia sprawiedliwości w odniesieniu do procedur rekrutacji internetowej wśród młodych dorosłych. Metaanalizy badań nad poczuciem sprawiedliwości procesu rekrutacji wskazują, że jest ono niezwykle ważne zarówno dla pracodawców, jak i kandydatów do pracy. Wpływając na nastawienie kandydata w stosunku do organizacji, niesie ze sobą szereg pozytywnych i negatywnych efektów. W celu zbadania problemu w przypadku młodych dorosłych (jako osób wchodzących w stadium rozwojowe, którego jednym z głównych celów jest znalezienie pracy) przeprowadzono trzyczęściowe badanie mające na celu określenie postrzeganego poziomu sprawiedliwości procedur e-rekrutacyjnych oraz jego wpływu na ocenę ogłoszenia rekrutacyjnego i rekrutującej organizacji. Na podstawie przeprowadzonej za pośrednictwem Internetu ankiety (N=280) stwierdzono istotne różnice między istotnością dla badanych kategorii sprawiedliwości (przejrzystości, obiektywności, informacji zwrotnej, informacji o pracy i swobodzie wypowiedzi) a przewidywaniami co do rzeczywistego przebiegu rekrutacji internetowej. Ponadto w wariancie eksperymentalnym wykazano, że na ocenę ogólną ogłoszenia wpływ ma wyłącznie zapewnienie sprawiedliwej procedury dostarczania informacji zwrotnej.

The issue of values is essential for Amartya Sen’s political philosophy, likewise for the early works of John Rawls. Considering the fundamental political value of social justice, Sen rejects the Rawlsian attitude because of the erroneous concept of human nature, adopted by him, which led him to a „blind” morality. He proposes a diff erent approach, referring to the notion of human capabilities on which his own theory of justice is based and he investigates it in the framework of political philosophy, which takes into account the qualitative dimension of human choices. Martha Nussbaum also builds her theory of justice on this notion, however, she derives it from the Aristotelian concept of man so that it takes on a deeper philosophical meaning. The aim of this paper is to compare and to assess both these concepts of justice, referring to human capabilities, as well as to shed some light on the new path of research in political philosophy opened by them.

The objective of the paper was to determine the impact of procedural and distributive justice upon organization commitment of age-diversified employees. The objective was achieved in the course of a study encompassing two employees’ age groups: the first, consisting of people aged below 30 (N=555), the second, encompassing those aged above 50 (N=520). Respondents were employed in large and medium Polish companies. Results of the study allow to conclude that regardless of respondents’ age, the change in the perception of organizational justice will exert a positive impact upon organization commitment. The intensity of affective commitment is influenced primarily by procedural justice (in both age groups). Regardless of employees’ age, continuance commitment depends upon the perception of distributive justice.
Celem artykułu było określenie wpływu poczucia sprawiedliwości proceduralnej i dystrybucyjnej na poziom zaangażowania (organization commitment) pracowników w rożnym wieku. Do realizacji tak postawionego celu przeprowadzono badania w dwóch grupach pracowników: do 30 roku życia (N=555) i powyżej 50 roku życia (N=520), zatrudnionych w 57 dużych i średnich polskich przedsiębiorstwach. Wyniki badań pozwalają na stwierdzenie, że niezależnie od wieku badanych, zmiana postrzegania sprawiedliwości organizacyjnej wpłynie na pozytywne zmiany w poziomie organization commitment. Na poziom affective commitment wpływa przede wszystkim poczucie sprawiedliwości proceduralnej (w obu badanych grupach wiekowych). Niezależnie od wieku badanych, poziom continuance commitment uzależniony jest od postrzegania sprawiedliwości dystrybucyjnej.

The courts are crucial for political power legitimization, conflict resolution as well as harmonization of law and legal cultures of the EU Member States. Important factor in all these processes presents the public trust in the judiciary and in the law application by courts. This problem is of particular importance in the former communist countries, including Poland. In the first part of this paper, in the context of several socio-legal studies, the various historical and institutional (historical experiences, social and economic reforms) and subjective (personal contacts with the system of justice) factors are debated. These factors influence the level of trust to courts and judiciary. In the next two parts, the paper analyzes the results of surveys on the opinions about courts and judiciary conducted in Poland after 1989, and the results of our in-depth survey commissioned by the Polish, National Judiciary Council, conducted in 2009. In the conlusion of the paper we are debating the trust in courts against the background of other public institutions, in the context of political independence of courts and the procedural justice implementation. Both of them – political independence courts and fulfillment of procedural justice principle – are factors crucial for modernization and liberal democratic consolidation in the contemporary Poland.

Purpose: Despite the popularity of employee engagement in the past decade, organizations across the globe struggle with disengaged employees at work. The purpose of this paper is to critically reflect on issues relating to employee engagement and to develop a conceptual framework that explains the linkages between organizational climate, procedural justice, distributive justice, perceived organizational support, and employee engagement with the aim of fostering higher levels of employee engagement in organizations. Methodology: The paper provides a systematic review of the literature on employee engagement and reviews from peer-reviewed journals written in English on the topic and published in 1985–2019. Findings: Research in this field shows that engaged employees are perceived as employees who work harder, are willing to go the extra mile, and are more passionate about the work they do and the quality they present to produce better results that drive business growth. Today, more than ever, organizations understand the importance of their employees and view them as the most important asset to their businesses. Hence, keeping employees committed and engaged has become one of the key focuses for organizations. Originality: Previous studies have not considered a holistic model of employee engagement from the angles addressed in this paper nor has such a model been tested on a global or regional scale. This study contributes to the literature on employee engagement by proposing a conceptual framework through which organizations can have important insights into how to engage their employees. Zdaniem autora, w rozstrzygnięciu istniejących dylematów jest pomocna teoria sprawiedliwości Johna Rawlsa.
The question of justice has been the subject of numerous considerations for centuries, not only among scientists. The requirement of intra- and intergenerational justice is also inherent in the concept of sustainable development. While the former has been relatively generously explained and justified, the latter still raises many doubts. The essence of social justice and the controversy arising from its practical implementation are presented in the paper. According to the author, John Rawls' theory of justice is helpful in resolving the existing dilemmas

In the discussion concerning the understanding of what hell is, the opinion of the Russian philosopher Nikolai Berdyaev is very important. He is strongly opposed to the attempts to rationalize the problem saying that, sooner or later, they breed fear and anxiety. Hell is pure subjectivity, the inability to go beyond the circle of our spirit’s constant torment. Therefore, hell is not related to objectivity. Rather, it is a total confinement, a state of helplessness. It is being imprisoned in time, which has no end, a dream, from which it is impossible to wake up. Thus, it is not the result of God’s decision, a punishment for committed sins. On the contrary, it is the result of choice, being in favor of your own loneliness. Ultimately, it will remain only a creation of our rationalization. Therefore, we must have hope (which perhaps will be false) that hell does not exist.

The article analyzes the concept of justice in both procedural and substantive aspects of civil law, with regards to John Rawls’ notion of “procedural justice”. The basic problem of the article is the question if each outcome of a fair procedure is just by the token of the fairness of the procedure. The author argues that such a standpoint, claiming that the procedure itself creates a just decision, will be incompatible with Article 45 paragraph 1 of the Polish Constitution. This paragraph grants the right to just adjudicature, which takes into account the whole substantive law. There are areas in law where conflicts between the procedural and the substantive justice are possible. Such an area is the adversary trial proceedings and evidentiary proceedings. The Court of Justice of the European Union emphasizes that there are such groups of legal entities (eg. consumers), for which it is necessary to regard ex officio all of facts pointing to the unjust treatment of consumer. The similar point of view was expressed by the Supreme Court of Poland. The Supreme Court of Poland allowed an evaluation of a claim which includes principles of justice, even if the defendant doesn’t take any position. This belief agrees with the standpoint of E. Waśkowski, who emphasized that the sentence should be “rightful”.

Rawls’s theory of justice is based on Kant’s ethics and the theory of social contract. Rawls tries to obey two rules: of universalizations and universality and of the maximization for the least privileged. His theory can be used to judge the ethical position of business firms. It follows from my studies that a just organization of a firm is rare in times of transformation. This may be another reason for mass emigration and it must be taken into account in future debates of the economic development.

The institution of a public authority is governed above all in art. The first paragraph of Article 51 TFEU, under which the provisions of this chapter [the right of establishment editor. the author] shall not apply to activities which in a MemberState are connected, even occasionally, with the exercise of public authority. This provision therefore shows that, to put it briefly, to qualify an activity as an exercise of public authority excludes me from the regime of rules governing the right of establishment, which in turn means that these activities can be carried out bynationals of any Member State. The issue of a public authority under the provisions of EU law, especially theprimary law was repeatedly the subject of litigation pending before the Court ofJustice of the EU. It should be noted that the previous decision for the subject toexercise of public authority referred to the different activities, it being noted that several judgments, the subject of which was the profession of lawyer is evaluatedfrom this perspective. It should be noted that the Court, in decisions that were made in 2011 for the profession of a notary public has unequivocally stated that the notary does not exercise public authority, which is a clear contradiction of existing generally accepted views of the doctrines of law of EU Member States in this regard.

The aim of this article is to analyse an issue discussed by philosophers and legal scholars since ancient times: the violent origins of law. In other words, it attempts to respond to the following questions: can we ultimately trace the origins of law back to violence, and could it be that law is in fact a continuation of violence by other means? To this purpose, there will be retraced the law-violence relation as portrayed in the Greek tragedy The Eumenides where Aeschylus focuses on Orestes’ trial, is of particular relevance when it comes to questioning the origins of law. At the same time, there will be followed the footsteps of Michel Foucault and Walter Benjamin who had the undoubted merit of having brought to light, within the tragic framework of the twentieth century, the relationship between law and violence.

The Security Council’s new activism, particularly in the field of “individualized sanctions”, gives impetus to the debate on whether, and to what extent, the most powerful organ of the UN should be subject to judicial review. This article analyses and categorizes the various strategies already employed in international courts, such as, e.g., “denial of justice”, incidental control, full review of implementing acts, the “as-long-as” rule, and various instruments of judicial self-restraint. The author suggests that “jurisdiction”, understood as encompassing the procedural aspects of the problem, should be regarded as a “door-opener” to judicial review. As regards its substantive dimension, the existence of primary responsibilities on both sides (the Security Council and the judiciary) should be taken into consideration. The author demonstrates that the principle of loyalty and cooperation means, on the one hand, respect by the Security Council for judicial review from inside of the UN system, and on the other hand, respect for Security Council prerogatives from external courts. Taking into account the evolution of a duty of loyal cooperation between different systems within the global legal order, and in expectation that the ICJ will defend the international rule of law, we may speak of a “modern vision of the administration of justice.”

W kolejnym omówieniu orzecznictwa Międzynarodowego Trybunału Karnego przedstawiono główne idee zawarte w Decyzji dotyczącej roszczenia Jean-Pierre’a Bemba Gombo o odszkodowania i naprawienie szkód, która została wydana 18 maja 2020 r. W szczególności uwagę poświęcono szczegółowym aspektom żądania Bemby, wyjaśniono przyjętą przez Trybunał interpretację art. 85 Statutu MTK, a także prezentuję całościowy ogląd na temat prawa, które dostarcza ofiarom pomyłek sądowych środków odwoławczych przed międzynarodowymi trybunałami karnymi, jak i filozofii leżącej u podstaw tych przepis. Na marginesie odniesiono się także do podejmowanych w ostatnim czasie działań Stanów Zjednoczonych, które wymierzone są w Trybunał, włącznie z sankcjami oraz innymi środkami odstraszającymi przyjętymi w tym celu w ostatnich miesiącach.
In this overview of the case law of the International Criminal Court, the author examines the decision that was issued by the ICC on 18 May 2020 pursuant to Jean-Pierre Bemba Gombo’s claim for damages on account of miscarriages of justice and other violations of his rights that allegedly had taken place during his ICC trial. The paper summarizes the Court’s reasoning and interpretation of Article 85 ICC Statute. In passing, it also casts light on recent anti-Court activities undertaken by the United States, including sanctions and other deterrents adopted by President Trump for this purpose.

The relations between the sovereign courts and the intendants contain a tormented and unsuccessful history, marked since the Grand Siècle by the difficult passage from the traditional jurisdictional management of the kingdom, considered inefficient, to an organisation that supports the triumph of the absolute and administrative monarchy. In these southern lands of the kingdom of France, torn apart by the Protestant reformation and the wars, the institutional upheaval which prepared the modern state and the Napoleonic granite masses, was carried out through strong embarrassments which opposed the intendant of the generality to the court of aids in Montauban. As soon as they were created, the magistrates of the jurisdictional company multiplied the manoeuvres against the intendant to safeguard their contentious attributions and the control of the municipal funds. Their particularistic actions were denounced by the intendant, who was there to make the king present everywhere in the kingdom and was zealous in his service. Since then, all the elements were in place for the outbreak of a noisy quarrel – the lawsuit against the intendant Gaspard Lescalopier – which worried the government at the turn of the reign of Louis XV, in the middle of the tax war in 1749, when King Louis XV, whom the subjects looked upon as a charming prince, became „Louis the Unloved”. These tumults prevented the modernisation of the French monarchy and led to the troubles of the Revolution.

Transitional justice in the post-communist countries of Eastern Europe concentrates on the problem of the lustration of former secret service officers and their clandestine collaborators and on the question of access to files created by the communist political police. The aim of the article is to present the Polish experience in this field in view of the theoretical framework available in transitional justice literature. Thus, the text begins with definitions of some basic notions connected with dealing with the past. The article also proposes three basic models of transitional justice. The third part offers an account of Polish lustration and public disclosure measures and assigns those instruments to the models of transitional justice. The final section presents some concluding remarks on the evolution of Polish lustration.

The goal of the article is an attempt to give an answer to the question whether the concepts of compromise on the management of the public administration may be used in the management of the justice system and if so to what extent? The article presents selected concepts of the management of the public sector with regards to their possibilities of adaptation for the needs of the justice system. It also shows the specificity of justice system Justice system plays an important role in the course of shaping an efficient state. In the light of the praxeological understanding the state is an organization, i.e. the entirety consisting of linked different networks contributing to the success or inducing failure of the entirety. A poorly managed justice system as a part of the entirety may be a serious obstacle on the way to modernize the management of the country. Therefore the discussion over the optimal model of management of justice system becomes an urgent challenge in the science of management. The prevailing role of justice system is meting out justice and other functions must comply with the prevailing role – ergo they play an ancillary role to the main role. No one and nothing may interfere in the competences of the independent court in meting out justice even the internal and external administrative supervision. It seems that the response to the needs of the justice system may be the model of participative bureaucracy as a combination of different bureaucratic models and other organizational models with the awareness of the needs of the responsible court.

  RESEARCH OBJECTIVE: Do Smith, Hume and other Scots have an argument to reject John Brown’s claim in his Estimate that a society based on self-interest lacks cohesion? And can they do so without accepting Hobbes’ argument that the necessary cohesion can only be provided by the threat of coercion from a sovereign? THE RESEARCH PROBLEM AND METHODS: Problem: The eighteenth century debate on the nature of commercial society. Method: Analysis of key texts in the debate as it occurred in Scotland. THE PROCESS OF ARGUMENTATION: The Scots argue that a society where everyman lives by exchanging, operating on the assumption of selfinterest, is a more peaceable, more equitable and thus more cohesive than that envisioned by Brown. When reinforced by the rule of law, self-interested behaviour supports mutually supportive behaviour. Ultimately this embodies a constant and universal principle of human nature. Human behaviour is not random or chaotic and a commercial society not only exemplifies that fact but also sustains a form of societal life superior to any that has one before. RESEARCH RESULTS: Nostalgia for an earlier time is mis-placed. For all its vehemence Brown’s critique is mis-directed and thus unjustified. CONCLUSION, INNOVATIONS AND RECOMMENDATIONS: This selection of the Scots should be widened to investigate whether Ferguson, Kames, Wallace among others have the same resources as Hume and Smith to rebut Brown.

It is the duty of the judge to care for justice and peace in the community of God’s people. Justice is a virtue which the judge ought to demand also from himself. Therefore, he should permanently improve moral precepts in himself. He ought to develop good manners and everything which can influence the realization of the principle of justice. The article “The principle of justice in the service of the judge of ecclesiastical court” consists of three parts. The first part deals in general with the notion of justice itself. In the second part, some statements of the Popes, John Paul II and Benedict XVI, on justice in ecclesiastical courts are presented. The notion of justice as an essential attribute of the judge of ecclesiastical court is discussed in the third part of the article.

Justice (perfection) of a democratic law-abiding State expressed as an environment of social life: this is an issue, that very frequently is present upon the lips of jurists, politicians, political scientists, legislature members, but also: ethicists, bioethicists, moralists, theologians, and others. This subject has been also taken for reflection because of the fact, that we are living in such a system, and more: we must struggle with many problems, which make one ask: is the democratic system that is being constructed founded on sufficiently healthy foundations, so that it may be possible to say that we are all equal in relation to the law being passed and that its principles are just? So we have taken up here an ethical reflection on the subject of the philosophy of law and State (that is: philosophy of care for our life environment) predominant in the European Union, the directives of which, coming from different treaties and agreements, are being applied to our home legislature. The main axis, around which our reflections were developed, where the basic principles of the Christian concept of social justice. These are the basis for interpersonal and international dialogue. These principles are: «peace», «solidarity », «justice», «freedom », «truth» and «love». The main conclusion stemming from this article is: in the concept of State and law of today there is a lack of a permanent point of reference, and this point of reference should be the principle of social justice based on objective truth.

Euthymia, the founding concept of Democritus’ ethics, is a thing of the soul, as he says himself, an intimate, eminently personal happiness. What place is given, then, to other individuals in this ethics? Can one be happy without the others? In order to answer these two questions the present paper examines the relevant utterances in which references to the others appear and concludes that despite a clear depreciation of the conjugal bond an altruistic dimension is very strong in this ethics and that several important ideas lie behind this concept.

The author finds the submitted proposal for amendments to be consistent with the Constitution of the Republic of Poland. The above‑mentioned proposal extends the competence of the Minister of Justice in the field of supervision of administrative activity of the common courts, which is however limited to new opportunities for obtaining information of the activities of the courts, and does not breach the balance of powers principle. In the author’s view, in the proposed Article 37f §1 (2) of the Law on Common Courts Organization a reservation should be added to explain that it is just about the exercise by the Minister’s of Justice actions “specified in the Act” that are indispensable to counter the irregularities in the administrative work of the courts, or to be applied in case of their occurrence. Moreover, he raises objections to the proposed Article 37f § 1 (3) of the above‑mentioned Act, according to which an external administrative supervision has to include “an analysis and assessment” of application of the law by the courts. That provision is in conflict with Article 8 (2) of the Act and lacks precision. According to the author, it would be advisable to supplement the proposed bill with an obligation to adjust the implementing provisions to the amended Act and to extend the period of vacatio legis.

Successful involvement of employees requires factors determining the level of involvement to be identified. The research problem was posed in the form of the following question: Does a correlation between organizational justice and employees’ involvement exist? The objective of the paper was to determine the relationship between variables, define its strength, and indicate HRM practices which may exert a positive impact upon the perception of organizational justice and boost employees’ involvement at the same time. In order to achieve such a goal, a study encompassing 2,076 employees of 57 large- and medium-sized Polish companies was conducted. Results of the study prove that a statistically significant correlation between procedural and distributive justice, and employees’ involvement exists. The strength of the relationship differs depending on various types of involvement.
Warunkiem skutecznego budowania zaangażowania pracowników jest identyfikacja czynników go warunkujących. Problem badawczy sformułowany został jako pytanie: czy istnieje związek pomiędzy poczuciem sprawiedliwości a poziomem zaangażowania pracowników? Celem artykułu jest wykazanie związku między zmiennymi, określenie siły tego związku oraz wskazanie praktyk z zakresu ZZL, które mogą pozytywnie wpłynąć na postrzeganie sprawiedliwości organizacyjnej i jednocześnie wzmacniać poziom zaangażowania pracowników. Do realizacji tak postawionych celów przeprowadzono badania w grupie 2076 pracowników zatrudnionych w 57 dużych i średnich polskich przedsiębiorstwach. W wyniku przeprowadzonych badań można stwierdzić, że istnieje statystycznie istotny związek pomiędzy sprawiedliwością proceduralną i dystrybucyjną a zaangażowaniem pracowników. Siła tego związku różni się w przypadku różnych rodzajów zaangażowania.

Artykuł 2. Konstytucji RP z 1997 r. stwierdza, że Polska „jest demokratycznym państwem prawnym, urzeczywistniającym zasady sprawiedliwości społecznej”. Sprawiedliwość społeczna należy do zasad ustrojowych i zdaniem prawników nie stanowi podstawy do roszczenia podmiotowego. Współczesne rozumienie Ulpianowskiej idei sprawiedliwości – „Oddać każdemu, co mu się należy” – wspiera się na koncepcji sprawiedliwości dystrybutywnej Johna Rawlsa, opartej o równość proporcjonalną. Tekst analizuje poziom czterech wyznaczników sprawiedliwości społecznej, z jakimi mamy do czynienia w Polsce: nierówności dochodowe, system podatkowy, bezrobocie i ubóstwo. Struktura ładu społeczno-gospodarczego w naszym kraju, powstała i utrwalona w okresie transformacji, nie pozwala na stwierdzenie, że w Polsce istotnie w pełni urzeczywistnia się zasady sprawiedliwości społecznej.
Article No. 2 of The Constitution of The Republic of Poland (1997) states that Poland „shall be a democratic state ruled by law and implementing the principles of social justice”. Social justice is one of the principles of government and, according to lawyers, does not constitute grounds for subjective claims. Contemporary understanding of the Ulpian idea of justice (suum cuique): giving everyone his due, derives from the conception of distributive justice by J. Rawls, which is based on proportional equality. This paper discusses the levels of four social justice indicators that Poland now deals with: income inequality, tax system, unemployment and poverty. The structure of the socio-economic system in Poland, which was founded and established during a period of transition, (presented in paper by statistical data and international comparisons) does not support the conclusion that Poland indeed fully embodies the principles of social justice.

The article addresses the issues of natural justice and distributive justice. The traditional formula “to render to everyone his or her own” (suum cuique tribuere) was taken as the point of departure. The discussion leads to the conclusion that natural justice concerns every person, and that everyone is entitled to inherent, innate rights, fundamental human rights. The exercise of natural justice ensures basic participation in the goods of the community, namely the state. This is so because this justice requires that every person be provided with an existence appropriate to the dignity of the human person. The relationship between natural justice and distributive justice exists at the level of elementary objective needs. Natural justice, when exercised, in a sense meets the formula “to render to everyone according to their legitimate needs”, meeting objective, basic needs, but this applies only to part of society. This justice is broader, it does not boil down to these elementary needs and, of course, it relates also to other things than needs. In a sense, it could be said that natural justice “intervenes” where justice applied according to the principles of proportionality is not enough. Man, with his or her guaranteed natural, equal rights enacted as positive law in line with natural justice, through his or her own action “uses justice” by using (positive) law and provides himself or herself with a decent life. However, natural justice does not omit anyone, its implementation actually replaces the formula of distribution justice “render to everyone according to legitimate needs”. In distributive justice, equality is about proportion to the contribution made, but also to the merit. Of these two principles, the guiding principle, because of its universality, is the formula “render to everyone according to their contribution”: those who contribute more to the good of the community, receive more.
W artykule podjęto zagadnienie sprawiedliwości naturalnej i sprawiedliwości rozdzielczej. Jako punkt wyjścia przyjęto tradycyjną formułę „oddać każdemu to, co mu się należy” (suum cuique tribuere). Rozważania prowadzą do stwierdzenia, że sprawiedliwość naturalna dotyczy każdego człowieka, a należne są mu przyrodzone, wrodzone uprawnienia, podstawowe prawa człowieka. Realizacja sprawiedliwości naturalnej zapewnia w zakresie podstawowym udział w dobrach wspólnoty, jaką jest państwo. Sprawiedliwość ta bowiem wymaga, by każdemu człowiekowi zapewnić egzystencję odpowiadającą godności osoby ludzkiej. Związek sprawiedliwości naturalnej ze sprawiedliwością rozdzielczą występuje na poziomie elementarnych zobiektywizowanych potrzeb. Sprawiedliwość naturalna, gdy jest urzeczywistniana, niejako wypełnia wyróżnianą przez niektórych formułę „każdemu według »usprawiedliwionych« potrzeb”, zapewniając zobiektywizowane, podstawowe potrzeby, co dotyczy jednak tylko części społeczeństwa; sprawiedliwość ta jest szersza, nie jest zawężona tylko do tego rodzaju elementarnych potrzeb i oczywiście nie tylko potrzeb dotyczy. Można by w pewnym sensie powiedzieć, że sprawiedliwość naturalna jakby „interweniuje”, gdy nie wystarcza stosowanie sprawiedliwości według zasad proporcjonalności. Człowiek mający zagwarantowane przyrodzone, równe prawa, wpisane w prawo pozytywne, uzgodnione treściowo ze sprawiedliwością naturalną, poprzez własne działanie, korzystając z prawa stanowionego (pozytywnego), niejako „korzysta ze sprawiedliwości” i zapewnia sobie godziwe życie. Jednakże sprawiedliwość naturalna nikogo nie pomija, jej realizacja w istocie zastępuje formułę sprawiedliwości rozdzielczej „każdemu według »usprawiedliwionych« potrzeb”. W sprawiedliwości rozdzielczej równość polega na proporcji; należy oddać proporcjonalnie, ogólnie rzecz ujmując, do wkładu, ale także do zasług. Z tych dwóch zasad wiodąca, z uwagi na jej powszechność, jest formuła „każdemu według wkładu” – ten, kto bardziej przyczynia się do dobra wspólnoty, otrzymuje więcej.

The study is of a mostly conceptual and scientific-and-research nature, and the analyses contained herein are of a universal character. The article discusses the issue of relations of justice in social life. These relations have been based on the example of the right to life from the moment of conception, as it is the first, basic, and superior right. It began with considerations regarding the notion of justice. As a starting point, the classic definition in the formula “to render to everyone his or her own” (suum cuique tribuere) was adopted. It was emphasized that justice is for every human being. It was stated that justice as a universal value and a principle-norm, from which obligations originate, “builds” relations between entities. The article mostly analyses the relation between entities A and B, where entity A is every human being (the scientific data justifying when a human being originates are also pointed out), and entity B is a holder of legislative authority, always defined as an individual body just because of the considerations of justice, and as such participating in the relationship of justice.
Opracowanie ma charakter przede wszystkim koncepcyjny i zarazem naukowo-badawczy, a analizy w nim zawarte mają charakter uniwersalny. W artykule podjęto zagadnienie relacji sprawiedliwości w życiu społecznym. Zegzemplifikowano je na prawie do życia od chwili poczęcia. Jest ono bowiem pierwszym, podstawowym i nadrzędnym z praw. Rozpoczęto od rozważań dotyczących pojmowania sprawiedliwości. Jako punkt wyjścia przyjęto klasyczne rozumienie wyrażone w formule „oddać każdemu to, co mu się należy” (suum cuique tribuere). Zaakcentowano, że sprawiedliwość dotyczy każdego człowieka. Stwierdzono, że sprawiedliwość jako uniwersalna wartość i jako zasada-norma, będąc powinnościorodną, „buduje” relacje między podmiotami. W artykule zanalizowano przede wszystkim relację zachodzącą między podmiotami A i B, gdzie podmiot A to każdy człowiek (przypomniano też dane naukowe uzasadniające, od kiedy jest człowiek), a podmiot B to piastun władzy prawodawczej (ustawodawczej) zawsze, właśnie z uwagi na sprawiedliwość, zindywidualizowany personalnie i jako taki w relacje sprawiedliwości wchodzący.

Artykuł dotyczy koncepcji sprawiedliwości zaproponowanej przez Chaima Perelmana w 1945 roku, stanowiącej kontynuację poglądów Arystotelesa oraz św. Tomasza z Akwinu, jednak pozbawionej ładunku emocjonalnego, który niesie za sobą to pojęcie. Perelman ujmuje swoją tezę w sześć hasłowych formuł sprawiedliwości. Podstawą korzystania z zaproponowanych formuł jest nakaz, mający urzeczywistnić czyn sprawiedliwy, tj. prawidło postulujące jednakowe traktowanie osoby należące do tej samej kategorii istotnej. Autor uwzględnia również rozważania dotyczące tego kto, komu i w jaki sposób ma rozdzielać to, co należne. Perelman zauważa, że stosowanie formuł jest względne i niemożliwe na sposób matematyczny, co prowadzi do wniosku, że rozstrzygnięcie wydawanej decyzji należy pozostawić prawości sędziego. Niebezpieczeństwo stosowania sprawiedliwości w tej formie polega na subiektywnym postrzeganiu rzeczywistości, a przez to na możliwości manipulacji formułami przy ich używaniu.
The article discusses Chaim Perelman’s conception of justice proposed in 1945. His concept is a continuation of Aristotle’s and St. Thomas Aquinas’s views, however, it rejects emotional load and formulates a theory through six keyword terms instead. The core foundation of using proposed formulas is the order to treat people that belong to the same social category equally, and this warrant is crucial to act rightly. The article includes thoughts on who, to whom and in which way should distribute what is someone’s due. Perelman notices that using these formulas is relative and mathematically impossible, what leads him to the conclusion that the final decision should depend on the judge’s righteousness. There is a risk of applying justice in such a form as it consists of subjective perception of reality that creates room for manipulation.

Rozwijana w Polsce w okresie potransformacyjnym polityka karna wobec przestępstw mniejszej wagi doprowadziła na zasadzie nieprzewidzianych konsekwencji (Merton) do nadmiernej inkarceracji. Tymczasem najczęściej nie jest ona właściwym środkiem rozwiązywania problemu społecznego, jakim jest przestępczość pospolita, a bywa, że problem ten ulega w konsekwencji nasileniu. W tym kontekście poszukiwanie rozwiązań wpisujących się w amerykańską propozycję powiązania wymiaru sprawiedliwości z działaniami naprawczymi (problem-solving-justice), profilaktycznymi i resocjalizacyjnymi wydaje się właściwym, jeśli nie jedynym możliwym sposobem wyjścia z pułapki nadmiernej prizonizacji. Przeciwdziała także nadmiernemu rozwarstwieniu społecznemu. Dlatego też próby wprowadzania rozwiązań znanych jako community court, które w praktyce nie są̨ dodatkowym sądem, ale przede wszystkim systemem wsparcia służby kuratorskiej w jej dalekosiężnych (a w praktyce rzadko osiągalnych) zamierzeniach, zasługują na szczególną uwagę. W artykule przedstawiony jest portret społeczny klientów toruńskiego centrum sprawiedliwości naprawczej z 2015 r. Przedstawione w tekście wyniki pochodzą z wywiadów ewaluacyjnych oraz wywiadów diagnostycznych, prowadzonych w centrach sprawiedliwości naprawczej w Toruniu i Białymstoku, powstałych dzięki wsparciu finansowemu Narodowego Centrum Badań i Rozwoju z siedzibą w Warszawie, realizowanych w ramach programu „Innowacje Społeczne” pt. „Pilotażowe wdrożenie modelu »Community Court« w Polsce jako instytucjonalnego pomostu pomiędzy wymiarem sprawiedliwości, organami samorządowymi i organizacjami społecznymi ułatwiającego realizację sprawiedliwości naprawczej w praktyce”.
The penal policy against minor offences developed in Poland in the post-transition period produced, as an unintended consequence (Merton), excessive incarceration rates. Meanwhile, incarceration is among the least effective means of addressing such social concerns as mass crime, and may even further aggravate the issue. In this context, the pursuit of solutions aligned with the American proposal to combine justice, corrective measures (problem-solving justice), prevention and rehabilitation seems to be an adequate, if not the only way out of the excessive prizonization trap. It also helps counteract excessive social stratification. For that reasons any attempts at introducing the solution commonly known as “community court” which in practice is not another court but the measure intended to support probation services in their far-reaching (and in practice rarely attainable) ambitions, deserve our special attention. The paper presents the social picture of clients of Corrective Justice Center in Toruń in 2015. Research results were established based on evaluation interviews and diagnostic interviews carried out in corrective justice centers in Toruń and Białystok. Centers were set up thanks to the financial support of the National Science and Research Center in Warsaw and were organized as a part of the “Social Innovations” Program, under the title “Pilot implementation of the Community Court Model in Poland as an institutional bridge between the justice, local government and social organizations, aimed at facilitating the realization of corrective justice in practice”.

The victimological research and their results revealed myths about the alleged need of the crime victims to seek revenge on the offenders for the injustice suffered. On the contrary, they showed that a vast majority of victims is concerned more about obtaining quickly, ideally informally, moral and also material satisfaction. Therefore, in the last two decades of the 20th century, the efforts made by experts from the criminal policy area, practice and academic work sites grow stronger in order to find alternative ways / paradigm to traditional criminal reaction to a crime. This effort was channelled into a movement now known as the restorative justice that brought a visible success for the crime victims both at the level of adopting new legislative measures and providing practical assistance while solving and eliminating the consequences caused by a specific criminal act. Concurrently, it opened space for further research focussed on identification of a real contribution of the restorative procedures and programmes for the crime victims, including the risks of their potential 'abuse' for these purposes. Despite a number of more or less important reforms, the Czech Republic has failed as opposed to other post-communist countries (including Slovakia) to adopt a new criminal law until the present time. Therefore, the criminal law from 1961 was amended more than 50 times between 1989 until yet. Currently, a draft of the new criminal law is being discussed in the Parliament, however, everything points to the fact there is not a enough of political will for its adoption. Nevertheless, it would be interesting to mention some of the most important changes that the new law would bring from the criminal point of view. The new Code abandons the existing material and formal concept of the criminal act (degree of danger for society) and replaces it by a formal concept. Besides this substantial conceptual intervention, a series of other important changes are taking place in the area of the criminal liability, for example: a new categorising of criminal acts, new legal concepts of error in facts and error in law, introducing a new institute of gross negligence, a new definition of indirect offender, extremely dangerous recidivist, precision of definitions covering circumstances eliminating illegality of a act (extreme necessity, necessary self-defence, admissible risk, etc).

The article aim is to answer the question whether Amartya Sen’s theory of justice – presented in the fullest way in his book The Idea of Justice (Oxford 2009) – may be regarded as intellectually attractive to legal philosophy. The analysis of this theory leads to the conclusion that it can be of limited relevance to that branch of philosophy. It is connected with the fact that Amartya Sen belongs to such a kind of thinkers who reject the focusing only on the institutions as a means to the realization of justice. Con¬sidering the so-called procedural justice, Sen refers only to the idea of an impartial spectator developed by Adam Smith, and essentially he is not interested in retributive justice. Thus, it seems that the richer theory of John Rawls still remains much more attractive for the jurisprudence. However, in the author’s opinion, some concepts created by Sen may be an important starting point for reflection on law, even apart from Sen’s entire theory. His notions of freedom (which can be adapted, for example, to judge paternalistic regulations) and of capability seem to be particularly inspiring from the point of view of legal philosophy.

The second novel written directly in French by Atiq Rahimi, A Curse On Dostoevsky, calls on the masterpiece Crime and Punishment by Dostoevsky. This novel shows various aspects of the hybridization of the author. The Russian novel is manifest in the French novel in two ways: implicitly by the moral reflections on the divine justice and the human justice, and explicitly by many elements of the text (title, epigraph, paratexts, quotations, paraphrases etc.). Being a lot more than a simple pastiche, the French novel is indeed the rewriting of the famous crime committed by Raskolnikov. It is its intertextuality which makes the novel of Rahimi a kind of dialogue with the novel of Dostoevsky on the mode of the rewriting of the reflections and the reformulation of the questions developed in the work of the latter. What are the similarities and the fundamental differences between the character of Rassoul, main character of Rahimi, and that of Raskolnikov, protagonist of Dostoevsky? How has Rassoul become a failed pasticheur? What punishment are they to be subjected to in a country engulfed in an endless fratricidal war? These are the questions to which the present study will seek to find the answers.

The idea of human rights is connected to the modern perception of law founded on subjectivity, in the context of which rights are authorizations of individual action versus a higher authority, resulting in a subjectivity of law. The huge importance of the thomistic perception of the person is connected with the issue of relations between the individual and society, as well as relations between law and state, since Thomas Aquinas foresaw what we call ‘rights of man’. Thus, the person, in a metaphysical context, is associated with natural order, since natural sociability forms the basis of a person’s supernatural fulfillment. Because of his social nature, the person is also a carrier of social relations and a product of his own encounter with other persons. In this way, Thomas Aquinas makes a synthesis of man per se, as part of mankind, and man as a person vis-à-vis others in the sphere of justice, consisting ‘in rendering to each one his right’. Ius is a relation of justice concerning what is right (iustum) from the point of view of the other, “to whom something is due.” Aquinas can be considered a forerunner of human rights of the modern era, as demonstrated by the issue of natural equity, the issue of unjust law and obedience and the issue of political legitimization. In this framework, “human” or “natural” rights are considered moral rights. However, in the sphere of law they are perceived only within the community and common good, by no means constituting exclusive and absolute rights but only rights corresponding with duties and obligations. The Thomistic approach expresses both the free side of man vis-à-vis the state and its structures (in the spiritual level) and the egalitarian demand of law within social relations. Furthermore, it places the sphere of law on the background of common good and common interest. The Thomistic approach of the human person is a response to the modern perception of legal subjectivity and the priority of individuals, associated with the ideology of rights and leading to a confrontation of individual and society and a division of man to natural man and citizen, a product of the antithesis between society and state.

The emergence of civil justice after the evacuation of Russians from the Polish Kingdom in 1915. This is one of the most important moments in the history of Polish judiciary. After more than a century of power invaders there is a chance to regain control over the administration and the judiciary. Polish lawyers had hoped that the occupiers leave the judiciary in their hands. Warsaw and Lublin - the fastest two centers operating in the Kingdom have become a role model for other courts. Regulations approved by the Committee of Citizens in Warsaw described the organization of the local judicial institutions. Its provisions became a model for the courts of Lublin, modifications resulted only from local relations. In addition to the changes in the organization and structure of the judiciary was introduced innovations in the rules of substantive law, both civil and criminal. They eased and modernize the existing legislation of the Russian case studies. The need for the establishment of the civil courts, as well as their functioning efficiently also testified by the number of pending cases. Polish lawyers hope to permanently take over the judiciary in the Kingdom were quickly snuffed out by the occupation authorities. Both in Warsaw and Lublin Polish citizens' initiative was considered as illegal and brought to its liquidation. However, experience has resulted in a few weeks on September 1 IX 1917 at the time of the recovery from the hands of the occupiers of justice.

A lot of controversy has arisen around the view expressed by Leon Petrażycki who proposes a division into intuitive and positive law. This division is not aimed, however, at contraposing that which is established by norms and that which could be referred to as desirable or ideal law. The content of intuitive law, just like that of positive – or statutory – law, is often equally irrational, barbarian, and backward. What Petrażycki has in mind is rather a significant, substantial difference between the two. It consists in a difference in the intellectual content of legal experience. Intuitive law does not contain any norms, but an awareness of the obligation to act in a certain way which is independent from any authorities. Intuitive law is individual and changeable, as its contents depend on one’s personal character. A certain similarity in intuitive legal experiences is, according to Petrażycki, largely dependent on the living conditions in the family and social group.

The communication and internet revolution has had a great influence on time and space contraction, and virtual space has become a platform for intellectual encounters beyond borders. Nowadays, in the time of the knowledge-based society and new communication technologies, the opening of formerly closed borders between “us” and the “others,” and, in consequence, the possibility of creating cosmopolitan identities in virtual space seem to be important problems. Ethical cosmopolitanism should become a determining condition for creation of such identities due to its claim that all people in the world should be treated as equals, regardless of their race,gender, set of beliefs, religion, or the place of their dwelling.The aim of the paper is to present the recent discussion on cosmopolitan identity in the era of the knowledge society, as well as to introduce the concept of strangeness and depict the sociological background and the current evolution of creating the collective identities. The main scope of the article is the discussion of conditions for creating the cosmopolitan identity in the internet space.

Adolf Reinach met and befriended Hermann Kantorowicz in one of Lujo Brentano’s political economy seminars during the 1901/1902 academic year at the University of Munich. After Munich, Kantorowicz would go on to be a major contributor to the Free Law Movement (Freirechtsbewegung) in Germany and play an important role in the development of the sociology of law in the 20th century. Reinach encountered the work of Edmund Husserl while studying with Lipps and later became central to the phenomenological movement in Göttingen. But all the while he remained interested in and focused on issues related to justice. His last scholarly publication before leaving for battle in WWI, Die apriorischen Grundlagen des bürgerlichen Rechtes (The a priori Foundations of Civil Law, 1913) published in the very first edition of the Jahrbuch für Philosophie und phänomenologische Forschung (Yearbook for Philosophy and Phenomenological Research) is a testament to this. Here we see Reinach taking his phenomenological education and applying it to entities of justice. I believe Kantorowicz inspired this lasting interest in matters of justice. This essay will focus on the influence of Kantorowicz on Reinach, and while doing so attempt to flesh out and contrast the ways in which these two men sought to overcome the problems of justice (Recht) of their time. Many of these problems still continue to be relevant today.

The article contains an analysis and interpretation of Michał Zadara’s play Sprawiedliwość [Justice] from the point of view of the relation between the performance and the phenomenon of persuasion. The director refers to the events of March ’68 to address the issue of expelling Jews from Poland. His aim is not only to reflect on the meaning of the event and to identify the guilty, but also to provoke legal interventions, to call for justice. This intention is connected with the idea of exceeding the fictional status of a performance in order to use it in social and political reality.

The cycle of individual and communal lives from birth to death is supposedly preserved by the government through institutions. However, political, social, and economic activities are engaged to make ends meet wherein the government is to serve as an unbiased regulator. The activities that play out in Southern Kaduna reflected politics of being on one side with interplay on origin, identity, religion, and locality. On the other hand, it reflects politics of belonging that play on kin, reciprocity, and stranger status. It has thus resulted in violence, suspicion, and persistent conflict. The study examines citizen’s inclusiveness in peacebuilding initiatives and the people’s perception of the sincerity of the government. The research relies on secondary sources where governmental and non-governmental publications and documents from relevant and reliable sources enriched the socio-historical approach, particularly those relating to contestation in the region. The study found out that just like situations in the other northwest states of the country, the crisis exacerbates by the government’s inability to mediate fairly between warring parties to ensure fairness and justice as well as failure to apprehend and punish the culprits, even as recommendations from the various interventions were unimplemented. Thus, the spate of violence continues.

The opinion relates to the compliance of a Deputy’s bill with the Constitution of the Republic of Poland. The author, following the presentation of the essence of the modifications proposed in the bill, argues that they cause significant extension of the powers of the Minister of Justice. This situation cannot be confused with the inconsistency of the proposed changes with the Constitution. Quoting the relevant judgment of the Constitutional Tribunal, the author shows that the administrative operations of the courts may be subject to external supervision by the Minister of Justice and, therefore, the purpose of the bill aimed to maintain administrative supervision over the activities of the courts and the granting of new powers to the minister cannot be questioned. The modifications proposed in the bill should be considered to be in conformity with the Constitution.

This article addresses the problem of fighting poverty on the basis of the liberal political philosophy of Amartya Sen. The aim is to demonstrate that this program has gained its practical embodiment in the work of Muhammad Yunus and the Grameen Bank he created. In this article I will reconstruct the main arguments of Sen’s political theory, in which the question of support is associated with the concept of social justice and based on the assumption of methodological individualism. This means that all programs and economic decisions that focus on the implementation of social welfare must be assessed from the perspective of individuals and must consider how they affect their lives. The criterion for determining a „good life” in the concept of Sen is not economic but political: it is the freedom of an individual realized in a society, including its scope and practical forms. Sen is an economist and political philosopher and Yunus is an economist-practitioner, but they both share a belief in the world development in increasing human freedom and poverty eradication, thanks to capabilities and creative activities of people. The political and economic institutions should then trigger the enterprise of individuals and enable them to extract themselves from poverty.

Social state is socially attractive but difficult and expensive model in the course of society development. This can be successful in case of strong, well organized societies which possess necessary means for social justice and development. Weaker societies which focus on development should choose modernity and competition.

The article presents various links between business and ethics. The idea of responsibility, used to describe legal, economic and ethical aspects, forms the main, unifying thread. The author employs it to analyze three spheres of human activity. The first sphere, the subjective one, concerns self-responsibility, when individuals are striving to satisfy their own needs and to achieve happiness. The second, the encounter with the Other, embraces two meanings: responsibility for and towards the Other. The third sphere, the social one, extends the idea of responsibility onto the historical community we belong to. The concept of co-responsibility is not confined to our life span, but it embraces the future generations as well. The author pinpoints an important element in creating the foundations of a given community, i.e., regulations that form its basis, especially the principle of justice, encompassing the distribution of goods. Many contemporary authors underline this ethical, political and economic aspect (Rawls, communitarians, Ricoeur, Habermas). The main thesis the author would like to substantiate is as follows: in business activities, the ethical conduct of an individual is not sufficient. It needs to be broadened to encompass other perspectives since contemporary societies are based on the multidimensional idea of co-responsibility.

Taxes are closely related to the functioning of the state. From the moral and social point of view, it should always be directed towards the common good. Implementing this principle, the state supports the improvement of citizens’ welfare. Provides them with collected taxes their services, such as internal and external security, education, culture, infrastructure, social services and others. The formation of fair tax system and the mechanism of budgetary resources also has great importance because of the importance of the whole economy. In addition, the state’s fiscal system applies to every citizen as a taxpayer. Therefore, this issue also has important ethical dimension of individuality. The article focuses on these issues, emphasizing an ethical perspective the following three issues: (1) The social context of contemporary reflections on the obligations to the state, (2) the state and its goals, and (3) the moral aspects of the duty to pay taxes.

Opis:
Judicial review of the legality of administrative acts is one of the most important elements of the rule of law. The institute of administrative justice began to develop in the 19th century: in 1872 The French Council of State was given a function of judicial review, the Administrative Court in Vienna (Austria-Hungary) was established in 1867, in Baden (Germany) in 1863, etc. After the First World War, administrative courts were established in several European countries. The law on the Supreme Administrative Court and its Jurisdiction in Czechoslovakia was adopted in 1918. The Law for the Supreme Administrative Court in Poland was issued in 1922. Administrative courts were also functioning in other countries (Latvia, Estonia). In Lithuania administrative courts were established for the first time in 1999, although up to fifteen draft laws on the Administrative Court were prepared in the interwar Lithuania. This article was written on the occasion of the centenary of the Polish administrative courts. Thus, the purpose of the article is to familiarize the readers with Lithuanian administrative courts, starting with the development of the institute of administrative justice from 1918 and ending with the perspectives of judicial review formed in that time. Therefore, the authors of the article set the following objectives: to remind of the origins of administrative justice in Lithuania from 1918 to 1940; to reveal the course of the establishment of administrative courts after the Restoration of the Independence of the Republic of Lithuania in 1990, briefly discussing who and on the basis of which legal acts controlled the legality of administrative acts during the Soviet era; to provide the insights of institutional development as well as competence development of the administrative courts; to present contemporary administrative process, giving some insights about the status quo; to present the features of and the most relevant reforms of administrative process. Abbreviations used in the article are as follows: CSARL – Central State Archive of the Republic of Lithuania, MDWLLAS – Manuscript Department of the Wróblewski Library of the Lithuanian Academy of Sciences.

Niesłusznie pozostają one obecnie w całkowitym zapomnieniu. Celem artykułu jest dokonanie krytycznej analizy dzieł Antoniego Szymańskiego oraz zrekonstruowanie jego poglądów na temat sprawiedliwości społecznej. Analiza dzieł Antoniego Szymańskiego została przeprowadzona w kontekście encykliki Quadragesimo anno.
Taking into account the contemporary difficulties in determining the concept of social justice the views of Antoni Szymański cast light on the essence of those issues and seem to provide solutions to those unanswered questions. Unfortunately, they remain completely forgotten nowadays. The purpose of this study is to provide a critical analysis of Antoni Szymański’s works and to reconstruct his views on social justice.

Polish version of Colquitt's Organizational Justice Measure
Opis:
Objectives Organizational justice is an important predictor of employees’ well-being and job performance. Colquitt’s Organizational Justice Measure (OJM) was designed to assess four aspects of justice – distributive, procedural, interpersonal and informational. The lack of a Polish version of the tool, however, has precluded its application in Poland. The objective of this study was to test the psychometric properties of the OJM in a Polish sample. Material and methods The validating study was conducted on 2 participant samples (N = 209 and N = 659), employed in public and private companies. Both the exploratory and confirmatory factor analyses (EFA, CFA) as well as the estimation of internal consistency with Cronbach’s α method were conducted. Predictive validity was assessed by correlating organizational justice with job-related factors and outcomes, including job resources and counterproductive work behavior. Results The EFA and CFA supported a 4-dimension model of the OJM Polish version. This model indicated a better fit to data than the alternatively tested 1-factor, 2-factor and 3-factor models. The internal consistency of the scales was satisfactory, ranging 0.81–0.93 for various subscales. As expected, the overall organizational justice and the four subscales correlated positively with job resources and negatively with counterproductive work behavior. Conclusions The Polish version of OJM has satisfactory psychometric properties and may be useful in assessing organizational justice in a Polish setting. Aim/purpose - The purpose of this study is to investigate the impact of HRM practices on OCB-I (altruism and courtesy) and OCB-O (sportsmanship, conscientiousness, and civic virtue) by examining the mediating role of organizational justice perceptions (i.e., distributional, procedural, and interactional justice) and the moderating role of gender. Design/methodology/approach - The study is based on a national sample of 10 organizations from the banking industry in Kosovo and data were obtained from 459 employees. The statistical method involved regression analyses by constructing 14 different models through controlling demographics and the Sobel test for testing the moderator hypotheses. Findings - The findings of the study suggest that there are positive relations between HRM practices and both OCB-I and OCB-O. Additionally, HRM practices show positive relations with justice perceptions, while justice perceptions show positive relations with both OCB-I and OCB-O. Furthermore, justice perceptions play a mediating role in the relationship between HRM practices and both OCB-I and OCB-O. Gender moderates the relationship between HRM practices and justice perceptions, showing a positive relationship for females but a negative one for males. Lastly, gender also moderates the relationship between justice perceptions and OCB-O, being positive for males but negative for females.

The so-called debate between Jürgen Habermas and John Rawls concentrated mainly on the latter’s political liberalism. It dealt with the many aspects of Rawls’s philosophical project. In this article, I focus only on one of them, namely the epistemic or cognitivistic nature of principles of justice. The first part provides an overview of the debate, while the second part aims to show that Habermas has not misinterpreted Rawls’s position. I argue that Habermas rightly considers Rawls’s conception of justice as a moral one. In the last part, I discuss two key questions raised by Habermas. The first concerns the relation between justification and acceptance of the principles of justice. The second concerns the relation between two validity terms: truth and reasonableness.

One of the features of premodern era in Prussia was relatively low crime rate with a different structure than it is nowadays. Moreover, there was a different perception and functioning of sphere of justice and of law enforcement. With regard to the size of transgression, the rural territories characterized in minor transgression, whereas bigger cities characterized in more serious crimes; due to the fact that bigger cities did not give security against hunger, ensured anonymity and the ability for perpetrators to hide. Similarly to the contemporary world of crime, theft was a dominant crime, whereas murder was most severely punished. Furthermore, the role of crimes against morality was significant; importantly, the concept of sin was basically synonymous with crime and was reflected in the regulation matters. Generally, it was universal phenomenon and occurred not only in Prussia. Nevertheless, Prussia was reformed quicker. Moreover, the threat of vagrants and beggars, who did not have a dwelling, aroused concern; they might have constituted as much as 10% of the population in the 18th c. Aggressive behaviours and those associated with physical violence against women and children intensified. The ‘excessive’ beating was criticised, nonetheless the phenomena of beating as such was not considered as an offence. Violence com-mitted by a father and husband against his family belonged to the prerogatives of power. In the period of Enlightenment, the authorities of Prussia, and above all Frederick II brought about the elimination of a number of anachronisms in the perception and treatment of crime. Taking into consideration the European revolution, the above mentioned changes happened very quickly. Firstly, equality before the law was introduced, however it was not implemented properly; patrimonial jurisdiction, on the other hand, was at first limited and later on eliminated. Proportionate punishment appeared; tortures and the cruellest punishments ceased being applied. Imprisonment began to spread, along with the religious tolerance. Witch hunt and barbarous penalties for so-called moral offenses (sex before marriage, prostitution) were abandoned, likewise death punishment for homosexual and suicides etc. Since the 18th cen-tury the institution of the police began to develop, before that time it did not exist at all. The number of criminal activities increased due to urbanisation and industrialisation. Large agglomerations emerged, giving their dwellers anonymity; moreover, the phenomenon of strong family, which at the same time was an economic unit, withered. In the industrial capitalism the central place was occupied by the nuclear family. The member of this family was a worker who was at risk of unemployment with a weak sense of security. It is difficult to assess the impact of the increasing secularization on the increase in crime. However, the negative influence of wrecking the old social and community ties (religion, family, and commune) has to be highlighted. Rebellions caused by hunger (either connected with infertility or epidemics) were other major aspects of crime in the 19th c.

Nowadays, heritage conservators are required to have not only a wide variety of technical but also social and human skills. The shift from a material-based conservation to an approach that focuses on subjects instead of objects (Muñoz Viñas, 2005, p. 147) is a structural approach in contemporary theories of conservation. This tendency towards subjectivity created many possibilities by exposing the multiple perspectives that surround a conservation object. At the same time, it made very clear that conservation objects are contextual and contingent (Clavir, 2009, p. 141). This dichotomy between the tangible and intangible features of a conservation object, however, has been successively overlooked in most conservation endeavours. Prior to the conservation decision-making, institutions usually identified the main stakeholders, with publics and communities being part of that sphere together with owners, artists, and conservators, among others. The decision-making process, however, does not engage with communities in practice. This situation is very problematic for the conservation of cultural heritage objects in general, but it becomes truly hazardous for the preservation of cultural heritage with strong intangible features, such as social artistic practices, ethnographic objects, public art, participatory or performance art or even built heritage, which necessarily involves strong cooperation with communities and artists. After all, to whom are conservators preserving cultural heritage? What is the purpose of conserving cultural heritage for “future generations” if “present generations” are not called to decide in that process? This paper attempts to reflect upon these questions through histories around two buildings in Lisbon that had relevant roles during the Portuguese dictatorship (1933-1974).

This article discusses the problem of gift from the perspective of philosophical person-alism. Since there are different doctrines of gift, it first provides an overview of anthro-pological, sociological, philosophical, ethical, and religious approaches to the nature of gift. Then, it delineates the essential notes of the gift and its structure, and relates the gift to duties of justice. Finally, it shows that the gift constitutes an anthropological transcendental that helps us to better understand man and his supernatural dimension.

The concept of justice takes a central position in practical philosophy from the birth of philosophical reflection in the ancient Greece to contemporary discussions in political, social, and moral philosophy. This article presents a genealogy and development of the Greek concept of dikaiosyne (δικαιοσύνη). It starts with the first poetical appearances of a term dike (δίκη) in Homer’s poetry, continues with the analysis through its more sophisticated application by Hesiod, and finally it reaches the pivotal philosophical transformations of dike into dikaiosyne in The Histories of Herodotus.

Starting from the definition of the concept of law among the Ewe people, se (its literal meaning is a border that should not be crossed) and justice dzodzoenyenye (in the ontological sense) and nutefew (in the existential sense), this article presents the process of judgment and forgiveness in the culture of Ewe people living in southern Togo and Benin. In Ewe culture, the judgment process takes place within the community, the immediate family or among the villagers. Wrongdoing is defined as disregarding the relationship with the god Mawu, insulting the deities of Tro or voodoo, disrespecting ancestors or committing offenses against a family or village. These offences are reflected in the language, in expressions describing the misdeeds. Then the process of judgment itself is presented, with traditional judgment procedures, traditional trial, judgment, forgiveness and cleansing. The acts and consequences of adultery and the afofofo cleansing ritual are also analysed. The verdict itself, importantly, is dictated by a desire to resolve the conflict and put an end to the dissonance in the community.

The aim of this paper is to research, analyse and comparatively assess the real property tax and it´s Aristotelian (in)justice in various jurisdictions based on the stated quartet of hypotheses. Considering the high focus of jurisdictions on both sides of the Atlantic on human rights and democracy, it is highly relevant to pose the question centred around the hypotheses that (i) real property taxation, (ii) determination of basis, (iii) calculation and rate and (iv) use of proceeds of real property tax are (in)compatible with our perception of justice as founded by Aristotle. Various jurisdictions are analysed, while particular attention given to the Czech Republic jurisdiction case study. The research allows to enhance the understanding and appreciation of the real property tax system and offers preliminary suggestions and recommendations for its improvement in order to make it an effective, efficient and just fiscal tool matching the post-modern global society.
