W ocenie TK od ustawodawcy wymaga się, aby prawo było tworzone w sposób klarowny. Nie zostało to wzięte pod uwagę w przypadku nowelizacji Ustawy z 13 września 1996 r. o utrzymaniu czystości i porządku w gminach. Narzucono gminom obowiązek zorganizowania systemu odbierania odpadów komunalnych od właścicieli nieruchomości, którzy mieliby ponosić tego koszty w drodze opłaty za gospodarowanie odpadami komunalnymi. W ustawie jednak nie sprecyzowano charakteru tej opłaty. W konsekwencji powstała niejasność, który z organów nadzoru nad działalnością jednostek samorządu terytorialnego jest właściwy do zbadania uchwał podejmowanych na podstawie ustawy o utrzymaniu czystości i porządku w gminach. W tej kwestii wypowiedziały się sądy administracyjne, jednak wyrażone stanowiska były rozbieżne, mimo iż oparte były na tych samych aktach prawnych. W artykule ukazano polemikę organów publicznych.
From Constitutional Tribunal point of view, lawmaker is obliged to create law in possibly clear way. It was not taken into consideration in case of amendment to act from September 13th 1996 regarding keeping cleanliness and order in boroughs. Boroughs had to organize pick up system for municipal waste from property owners, who would have to cover the costs of the whole process as municipal waste management fees. However, the act does not define the character of this fee. As a result there is the uncertainty, which organ of supervising the local self-government units activities is correct to research on resolutions taken basing on keeping cleanliness and order in boroughs act. There are few statements issued by administrative courts, though they are incompatible, despite the fact that were based on same deeds. The article shows the polemic of public bodies.

To investigate the nature of dormancy in Hypericum androsaemum, H. scabrum, H. lydum and H. tetrapterum seeds which did not show germination under nor mal laboratory conditions. The 15 day long germination experiment under the constant light pre ceded by 30 min soaking in water (tap water, 40, 50 and 60°C hot water), GA3 (50, 100 and 150 ppm) and H2SO4 (1, 2 and 3%) was per formed. The germination response to the pre-soaking treatments was variable and discussed as a possible result of double dormancy involving partially dormant embryo and a chemical inhibitor for H. androsaemum and H. scabrum. Seed germination was restricted only by hard seed coat in H. lydum, and H. tetrapterum indicating the presence of physical dormancy.

Receptor histaminowy H3 został odkryty w 1983 roku przez Schwartza [1]. Od tego czasu w wielu ośrodkach naukowych trwają poszukiwania aktywnych ligandów H3. Literatura opisuje liczne związki, które są aktywne (antagoniści/odwrotni agoniści) wobec H3, jednak w chwili obecnej niewiele leków znajduje się w rutynowej praktyce klinicznej (betahistyna, pitolisant). Antagoniści/odwrotni agoniści H3 stanowią atrakcyjny cel w poszukiwaniu nowych leków. Dane przedkliniczne i kliniczne wskazują na ich potencjalną przydatność w leczeniu różnych chorób ośrodkowego układu nerwowego (OUN) takich, jak: narkolepsja, katalepsja, ADHD, choroba Alzheimera, a ponadto zaburzeń metabolicznych czy alergii.
The histamine H3 receptor was discovered in 1983 by Schwartz and coauthors [1]. In many scientific centers, the search for active H3ligands is continued to this day. The literature describes a many compounds that are active (antagonists/inverse antagonists) against H3, however at present, only few drugs are found in routine clinical practice (betahistine, pitolisant). H3 antagonists/inverse agonists are an attractive target in the search for new drugs. Preclinical and clinical data indicate their potential usefulness in the treatment of various central nervous system (CNS) diseases, such as narcolepsy, catalepsy, ADHD, Alzheimer’s disease, as well as metabolic disorders or allergies.

Opis:
A simple graph G admits an H-covering if every edge in E(G) belongs to at least to one subgraph of G isomorphic to a given graph H. For the subgraph H ⊆ G under a total k-labeling we define the associated H-weight as the sum of labels of all vertices and edges belonging to H. The total k-labeling is called the H-irregular total k-labeling of a graph G admitting an H-covering if all subgraphs of G isomorphic to H have distinct weights. The total H-irregularity strength of a graph G is the smallest integer k such that G has an H-irregular total k-labeling. In this paper, we estimate lower and upper bounds on the total H-irregularity strength for the disjoint union of multiple copies of a graph and the disjoint union of two non-isomorphic graphs. We also prove the sharpness of the upper bounds.

The magnetotransport in the vicinity of the metal-insulator transition in La$\text{}_{1.85}$Sr$\text{}_{0.15}$Cu$\text{}_{x}$Zn$\text{}_{1-x}$O$\text{}_{4}$ is studied in the mK temperature range. Both longitudinal and transverse magnetoresistance are negative indicating the importance of spin effects. The magnitude of transverse magnetoresistance is larger than the magnitude of longitudinal magnetoresistance, indicating the absence of positive orbital magnetoresistance, in sharp contrast to strongly underdoped La$\text{}_{2-x}$Sr$\text{}_{x}$CuO$\text{}_{4}$. Both transverse and longitudinal magnetoresistance are proportional to the relative change of zero-field conductivity. This suggests that low-temperature localization of carriers may originate in the spin-disorder scattering on the spin droplets around Zn-impurities.

Hole-doped $La_{2/3}Ba_{1/3}MnO_{3}$ (LBaMO), $La_{2/3}Ca_{1/3}MnO_{3}$ (LCaMO) and $La_{2/3}Ce_{1/3}MnO_{3}$ (LCeMO) thin films were grown heteroepitaxially on 0.1 wt.% Nb-doped $SrTiO_{3}(100)$ (STON) substrates by magnetron sputtering. The prepared LBaMO/STON, LCaMO/STON, LCeMO/STON heterostructures demonstrated nonlinear rectifying current-voltage characteristics. Negative magnetorestance values have been indicated at low bias, meanwhile bias-dependent magnetoresistance has been measured at positive bias voltage values U > U_d where U_d is the interfacial potential, corresponding to a steep current increase at a forward bias.

Three main stages of the intrinsic morphology transformation of MBE grown CdSe fractional monolayers in ZnSe with increase in their nominal thickness w in the 0.1-3.0 monolayer range were found using both structural and optical characterization techniques. Emergence of the extended (15-30 nm) CdSe-enriched quantum-dot-like pseudomorphic islands at w>0.7 monolayer with the density increasing up to 2.5×10$\text{}^{10}$ cm$\text{}^{-2}$ at w=2.8 monolayer is clearly displayed in the optical properties of CdSe fractional monolayer nanostructures. The below critical thickness CdSe fractional monolayers having extremely high quantum efficiency can be very perspective as an active region of ZnSe-based blue-green lasers.

Opis:
The nonlinear diffusion equation is derived by taking into account the local variations in the solvent density, within a mechanism of diffusion driven by random particle collisions. Analytical solutions for the case of spherical-symmetric nonlinear diffusion equation for spread of impurities in gas and solids are obtained and discussed. In this case, the solutions of the nonlinear diffusion equation are similar to solutions of Bernoulli equation. We note that the obtained solutions can be used to describe the shapes of impurity gas of high concentration or smoke clouds.

We describe the design of the Canadian Macromolecular Crystallography Facility 08ID-1 protein crystallography beamline that is being built at the Canadian Light Source. An in-vacuum small gap undulator will illuminate the beamline providing high X-ray brilliance and beam properties available at the Canadian Light Source that will allow studying small crystals (>20μm) and crystals with large cell dimensions (<1000Å). The planned automation of the beamline will allow for its remote usage.

In recent years, research of metal oxide semiconductor-based sensors has focused on morphology modification of thin film structures. One of the promising materials that is being developed is SnO₂. In this research, nanostructured SnO₂ thin film was grown using the ultrasonic spray pyrolysis and chemical bath deposition methods with and without external magnet assistance (0.1 T). As precursor solution of the ultrasonic spray pyrolysis process, the SnCl₂·2H₂O is dissolved in distilled water, with pH varied by adding 37% HCl solution. The precursor solution for the chemical bath deposition process was SnCl₂·2H₂O, which is dissolved in urea solution with pH customized by adding the NaOH solution. All resulting nanostructured SnO₂ thin film samples were characterized by using X-ray diffraction and scanning electron microscopy techniques. The resulting morphologies of SnO₂, prepared by chemical bath deposition, using magnetic field, HMTA framework-assisted chemical bath deposition, and ultrasonic spray pyrolysis are spherical, cubic, and spherical, respectively. The sensor response pattern of nanostructured SnO₂ thin films, prepared by all tested methods, to 30 ppm CO, is similar in that the response increases with the increase of working temperature. The SnO₂ thin film prepared by ultrasonic spray pyrolysis method shows the greatest sensitivity value of 95.12%, with a response time of 216 seconds and a recovery time of 558 seconds, at working temperature of 300 degrees Celsius.

We report on the development of new generation of magnetic relaxation sensors based on soft magnetic melt-spun ribbons with the composition $Fe_{63}Co_{21}B_{15}Cu$. The as-quenched amorphous alloy was subjected to thermomagnetic heat treatment in order to obtain sensor cores with optimized magnetic properties. The relaxation characteristics obtained for these cores by employing upgraded sensor electronics were compared to those based on the model simulations using Matlab-Simulink environment. The operational field range of new developed sensor core reached 300 μT within the frequency band 0-500 Hz, i.e. it is markedly extended as compared to the currently used cores based on the commercial VAC 25X material while keeping the similar sensitivity.

Using radiation in industry and medicine brings its hazardous effects. On account of this, people have started to be exposed to extra radiation. Thus radiation protection is developed in parallel with the utilization of radiation. In order to be protected from radiation three different criteria have to be taken into account, these are time, distance and the shielding. Shielding is the most effective way. An effective shield should cause a large energy loss on a small distance without emission of more hazardous radiation. In the world, more than three-hundred nuclear facilities have been used to fulfill the needs in the fields of scientific research, energy, agriculture and industry. In addition to this in medical centres radiation beams have been used for treatment and diagnosis. It is extremely important to protect the human body from radioactive rays. Barite is a mineral which can be used for shielding because of barium, which is a high atomic number element. The shielding property of barite is utilized in fabrics. Barite coated fabrics having characteristics of retaining radiation was obtained by penetrating barite into the fabrics via coating method. The linear attenuation coefficients (μ) of the coated barite fabrics were measured at the photon energies of 662, 1173 and 1332 keV obtained from ^{137}Cs and ^{60}Co γ-ray sources, respectively. As detailed elsewhere, the measurement has been performed using the gamma spectrometer that contains NaI(Tl) connected to 16k channels multi-channel-analyser. In this study, cotton polyester blend fabric was used. To apply barite mineral to fabric via coating method, it was grinded to a size of 2-10 microns by using jaw crushers. FK 800/N type transparent compound was used as adhesive. The coated fabrics were prepared with different volumes of barite. For this purposes four different types of fabrics have been produced, where the rate of barite was 0%, 40%, 50% and 60%. The results of experiments show that barite coated fabrics have blocked radiation. When barite ratio increases, the amount of absorbed radiation also increases.

This paper is devoted to the use and further development of the single crystal growing technique invented by Professor Jan Czochralski (1885-1953). The possibilities of the Czochralski technique are demonstrated. Further improvements were introduced at the Scientific Research Company "Carat" (Lviv, Ukraine) to grow large size complex oxide single crystals. The paper presents an overview of some single crystals grown with the use of a modified technology. Growth parameters and properties of resulting crystals are summarized to show a high potential of the Czochralski technique as an industrial technology to grow large-size, high quality, and structurally perfect single crystals of complex oxides.

Multi-objective optimization in development and operational planning of power systems becomes crucially important for system designers or operators. In addition, appropriate procedures increasingly involve comparison of scenarios, each with variables that have to be neither dimensionally nor qualitatively comparable. Selecting the best solution is usually performed posteriorly by comparing the results of different scenarios. In order to eliminate unnecessary calculations during the optimization, especially in the case of large number of scenarios, it is useful to eliminate the scenarios with bad indicators. This process can significantly reduce the computational time. It results in a timely elimination of all inferior scenarios, thus simplifying the decision-making. This paper analyses the methods and the efficiency of comparison of different scenarios being simultaneously processed using NSGA-II and MOPSO optimization procedures. The proposed procedures are discussed in the example of selecting the type, the size and the location of FACTS in transmission networks. Different scenarios consider the common types of these devices, wherein the number of devices depends on the system. The paper proposes the reduction of the optimization procedures. The displacive phase transformations can be considered as composed of two processes, namely, pure displacements, shuffling or shearing of atomic planes, and supplementary homogeneous lattice deformation changing also the dimensions of the moving planes. Such deformation causes shape memory effect when the structural transformation is reversed. General displacements of atomic planes will be examined, i.e. γ-surface type calculations will be reported for single plane shuffling, alternate shuffling of every other bcc atomic plane and successive displacements of parallel atomic planes producing in combination with homogeneous deformation the close packed structures. The results of calculations using the many-body potentials of the Finnis-Sinclair type will be compared with ab initio calculations that indicate in which way the phase transformation can be initiated.

Discussion of the austenite-single-variant martensite interfaces in Cu-Al-Ni alloy is performed in the frame of a topological model of martensite interfaces. This model takes into account admissible defects lying in the interface. The results are compared with the experimental data obtained on the foils of Cu-Al-Ni alloys deformed in situ in a transmission electron microscope.

We considered practically important case of nonlinear diffusion in the anisotropic plane where diffusion coefficients for diffusion in x and y axis directions can be different. This equation was transformed using similarity variables. The approximate analytical solution of the transformed equation expressed by power-series expansion for two variables about the zero point including only the first terms. The graphic representations show sufficient accuracy of the obtained analytical solution.

In this work, we study the dynamic behavior of a cement crusher. During its operation, several faults can occur. Our objective is to monitor the gear defect and other defects and make the necessary corrections. We model a part of the system: the gear transmission of the entire pinion-crown. We proceed to the simulation using a simulation program. Afterwards, we study the vibration behavior of the entire kinematic chain of the machine where we conduct programming vibrations of measurement points across all levels using vibration analysis software. The vibration measurements are realized with the aid of a data collector. The results of theoretical simulation are confronted with the analysis of experimental vibration measurements in order to determine the severity of mechanical faults and to establish an adequate vibratory prognosis.

A survey is given of different kinds of metal-insulator transitions (MIT) in doped semiconductors. The role of electron-electron Coulomb interactions and of disorder is discussed vis-a-vis millikelvin experimental results for semimagnetic semiconductors (SMSC) in the vicinity of MIT. Critical behavior of conductivity tensor components and dielectric susceptibility at the magnetic field-induced MIT in p-type Hg$\text{}_{1-x}$Mn$\text{}_{x}$Te is compatible with the model in which the MIT is a result of quantum localization driven by disorder-modified electron-electron interactions. At the same time the critical behavior of the Hall coefficient suggests that, in addition to electrons forming the Fermi liquid (FL) and undergoing localization at the MIT, there is certain a concentration of local electron moments, even on the metallic side of the MIT. The formation of these moments can presumably be described in terms of a disordered Hubbard-Mott model.

The rate parameter K$\text{}_{3}$ of solvent-solute energy transfer and the rate parameter K$\text{}_{7b}$ for solvent-quencher energy transfer are determined experimentally under ultraviolet excitation for a system Ethyl 1 butyl-2-methyl-5 ethoxycarboxy methoxy indole-3-carboxylate (EBMEC) in a deoxygenated system comprising 1:9 mixture of toluene-cyclohexane as a function of temperature in the range of 20-70°C, using bromobenzene as a solvent quencher. The data is analysed in terms of compact equation formed by combining Voltz et al. and Birks and Conte models. The interaction distance for the energy transfer from the excited solvent to solute molecules and solvent to quencher molecules are determined using this equation. The magnitude of the interaction distance indicates that the excitation energy transfer takes place due to long-range interaction in the case of solvent-solute energy transfer and short-range interaction in the case of solvent quencher energy transfer in dilute systems.

Solar cells are photovoltaic devices that convert sun energy directly into the electrical energy. Solar panel is composed of multiple solar cells that are combined together. Depending on the power demand, solar panels are connected to each other in series or parallel. Thus, electrical energy from the solar array systems is created to meet the needs. Solar panels are used on roof and wall systems in buildings and power plants. In solar array design, radiance, temperature, shading, surface angle and effect of series-parallel connection, which are factors affecting the operation of solar panels, should be considered. Shading significantly reduces the efficiency of a solar array system. Shading can occur entirely or partially due to dynamic or static obstacles. The effect of shading varies by location at which the solar panel is formed. In this work, design and optimization of solar arrays, positioned over a large area, having different time constant shading effects, was performed in order to minimize shading effect.

Opis:
The turning process is one of the best used processes in the mechanical industry. Therefore, the choice of the cutting parameters is very important in order to obtain a good machined surface quality. In this study, an analytical model and a modeling of the contact of the cutting tool with the work piece are developed for an orthogonal cutting process with a thermal analysis at the contact. The main aim is to predict the temperature while machining. By using the high-speed machining, we notice that the greater part of the heat, generated by the cutting process, is discharged into the cutting tool and the work piece. Indeed, when the cutting parameters, such as the cutting speed or the feed increase, the temperature increases too.
