The paper is interested in how the repositioning of organized labour in Europe in the last 20 years has affected its capacity to answer the current fiscal crisis of the state. While there is reason to expect a growing discontent among unions' core constituencies with the unequal way that the costs of the crisis are being distributed, unions don't seem to be able to organize this discontent, and turn it into a source of countervailing power against 'markets' and the state. In order to understand this outcome, the paper makes three arguments. First, it shows that European integration since the 1980s has at its core been a neoliberal project which has aimed at restoring capitalist power and institutionalizing permanent austerity. It then argues that trade unions have become integrated into this project in a paradoxical way: while their institutional representation has been enhanced, they have simultaneously experienced a significant loss of autonomy and capacity to achieve substantial gains for their constituencies. As a result, trade unions approach the current fiscal crisis of the state from a peculiar state-dependent position, which limits their capacity to organize the growing discontent in a sustainable way.

Opis:
The objective of this paper is to define the role and position of works councils in the countries of Central and Eastern Europe as well as to identify the scope of their functions. The establishing of such employee participation institutions in these countries was the result of the implementation of the European Union directive of 2002, which established a general framework for informing and consulting employees. Initially, trade unions were reluctant or even had a hostile view of works councils. They saw them as rivals and feared that they would lose their monopoly in representing employees. With time, in most cases, trade unions mitigated their averse attitude and began to use works councils as a field for their own activity and as a possibility for extending the range of information. However, works councils are relatively scarce in Central and Eastern Europe and most do not exercise their statutory rights in full.

Opis:
Which institutions may be important in terms of trade union density and how significant they are? Although the status of trade unions may be very different among states, unions are still a very meaningful component of labour markets. In this paper, we contribute to the debate about the institutions that may affect the outcome of trade unions in different legal systems. Firstly, we draw on the theoretical underpinnings of trade union activity and density. Then, we conduct an empirical analysis of the relationships between trade union density in a particular country, country’s legal origins and government’s ideology. In this way, the paper enriches an underexploited niche in institutional research devoted to labour market issues.

The paper focuses on discourse and discourse analysis as a tool for shedding light on the phenomena of trade union recruitment and organization. The author employs discursive data from interviews with numerous trade union officials in Slovenia as a means of shedding light on the process of organizational sense-making, identifying the specific terms officials employ to describe the world of Slovenian trade unionism and trade union organizing. In her analysis, the author argues that age seems to be the most significant factor distinguishing the perspectives among the interviewed officials, pointing thus to the significance of generational changes for understanding the challenges to trade union organizing in Slovenia today.

The paper deals with an organised labour response to recent migration to Northern Ireland from the New Member States (NMS) following EU enlargement in 2004. A trade union's approach to the problems confronting migrant workers is analyzed in the context of neo-liberal reforms of the labour market and shrinking of the welfare state. These changes have taken place in the context of a specific region still struggling to overcome the legacy of a long-lasting conflict from the 1960s until 1998 Good Friday Agreement. Furthermore, an innovative approach to migrant workers organising combining elements of solidarity and membership mobilisation and aiming at promoting a political and class solidaristic cross-sectarian agenda developed by the Independent Workers' Union (IWU) is examined. The results are based on a research programme undertaken by the IWU to uncover the nature of the relationship between migrants, labour market changes and the trajectory of sectarianism in the north.

The paper analyses steel restructuring at one of the major steel companies in Poland. It traces the restructuring history from the 1990s up to recent times, arguing that restructuring was heavily influenced by EU-accession conditionality and by the sector-oriented policy of Polish trade unions. While steel restructuring is often considered a major success story in Poland, this article, basing its argument on the life trajectories of the redundant workers, highlights the downside of a sectoral approach which operates at the expense of regional restructuring.

This article examines how the United Kingdom (UK) trade unions organise Polish migrant workers in the aftermath of post EU enlargement migration, and what forms of inclusion strategies they implement. The benefits and limitations of various inclusionary approaches are scrutinised through the analysis of semi-structured interviews conducted with officers of three different large trade unions. These unions have at times, applied similar and at other times very different strategies, which depend on the unions' structures and decision-making. These approaches vary from equal treatment and the 'level playing field' approach to special treatment. While the first combined approach has resulted in some positive experiences in locating and recruiting Polish members, further inclusion through activism, however, calls for a special treatment approach.

This paper presents different models of capitalism and trade unionism that have emerged in CEE over the last 25 years. It then traces challenges and unions' strategic responses in five policy areas: membership recruitment; mergers and organisational restructuring; collective bargaining; political engagement and social partnership; and international trade union cooperation. The paper argues that trade unions in the new EU member states do have the potential for strategic innovation and, conceivably, organisational renewal. In order to revitalise, however, they need to take on board the concerns of an increasingly diverse workforce and invest more resources in organising.

Trade unions in Poland have not built the stable and long–term relations with political parties as are observed in Western democracies. By analysing the historical and symbolic background of the transformation to a democratic civil society and free market economy, political preferences of working class, trade union membership rates, and public opinion polls, we argue that, in case of Poland, the initial links between political parties and trade unions weakened over time. Polish trade unions never had a chance to become a long–term intermediary between society and political parties, making the Polish case study a double exception from the traditional models.

The paper evaluates the increasing focus on organizing activity within British trade union movement and its main purpose is to draw attention to the wider reasons why organizing is important. Contrary to a dominant the authors claim that organizing is more than simply recruiting members; it is about mobilizing members so that they have greater influence over their working lives. Outcomes of organizing campaigns can only be understood within a much broader evaluation of the purpose, strategies and context in which they take place. in the paper the authors evaluate the impact of the 'turn' to organizing in the United Kingdom trade union movement, especially after launching of the Organising Academy in 1998. While there are a lot of accomplishments resulting from organizing activities, they cannot overshadow less optimistic phenomena within the union movement such as stagnation in membership, failed attempts to reach new sectors of the economy, and worsening climate around organized labour since the outbreak of the financial crisis in 2008.

Polski Kodeks pracy w art. 943 nakłada na pracodawców obowiązek przeciwdziałania mobbingowi. Nie wskazuje sposobu realizacji tego obowiązku. Ogranicza się do określenia odpowiedzialności pracodawcy. Ustawa o związkach zawodowych również nie precyzuje kompetencji związków dotyczących mobbingu. Stanowi natomiast, że zadaniem związku zawodowego jest ochrona godności oraz interesów moralnych osób wykonujących pracę zarobkową, zarówno zbiorowych, jak i indywidualnych. Występują więc postulaty, aby w działaniach i ewentualnych ciałach mających przeciwdziałać mobbingowi czynnie uczestniczyli przedstawiciele organizacji związkowych. Jednak dopuszczenie przedstawiciela związków zawodowych do organizowanego przez pracodawcę przeciwdziałania mobbingowi mogłoby grozić naruszeniem negatywnej wolności związkowej, dóbr osobistych lub danych osobowych osób uczestniczących w postępowaniu, które nie są członkami związku.
In Poland the obligation to counteract bullying (mobbing) is imposed on employers by Article 943 of the Labour Code. The method of fulfilling this obligation is not indicated. The regulation is limited to precising the employer’s liability. Also the Act on Trade Unions does not deal with the trade unions’ competences in the field of bullying (mobbing). Yet, it proclaims the protection of dignity and moral interests of persons performing work, both individual and collective ones, as one of the tasks of trade unions. Thus, it is sometimes suggested that trade union’s representatives should take active part in activities and possible bodies aiming to counteract bullying (mobbing). However, admitting a trade union’s representative to employer’s activities aiming to counteract bullying might lead to infringement of the negative freedom of trade unions, personal rights and data of those people involved who are not trade union’s members.

The economic crisis began in France in the second half of 1930. It reached its peak in 1934 and 1935 and resulted in a very high unemployment rate. To cope with these difficulties, the French government decided to protect French workers by limiting the number of foreign workers. The Poles had to return to their country under increasingly restrictive conditions. Woe betide strikers, union members and communists. The number of Poles fell by 17% between 1931 and 1936. After the respite provided by the Front Populaire, which was more concerned about foreign workers, the Poles lived in fear of having to leave France. The most politically committed joined the International Brigades during the Spanish Civil War.

There is a growing literature on the conditions of Zimbabwean women working as migrant workers in South Africa, specifically in cities like Johannesburg. Based on in-depth interviews and documentary analysis, this empirical research paper contributes to scholarship examining the conditions of migrant women workers from Zimbabwe employed as precarious workers in Johannesburg by zooming in on specific causes of migration to Johannesburg, the journey undertaken by the migrant women to Johannesburg, challenges of documentation, use of networks to survive in Johannesburg, employment of the women in precarious work, and challenges in the workplace. Rape and sexual violence are threats that face the women interviewed during migration to Johannesburg and even when in Johannesburg. The police who are supposed to uphold and protect the law are often found to be perpetrators involved in various forms of violence against women. In the workplace, the women earn starvation wages and work under poor working conditions. Human rights organizations and trade unions are unable to reach the many migrant women because of the sheer volume of violations against workers’ rights and human rights.

Trade union organising has been one of the central strategies of trade union revitalisation in Central and Eastern Europe (CEE). The Anglo-American model of organising was transferred to the region in the 1990s. Poland was the first CEE country in which the organising approach was implemented by NSZZ 'Solidarność', then variety of trade unions followed. Organising has not brought about sustainable membership growth in the Polish trade unions even if it contributed to a number of qualitative changes, including the unionisation of multinational companies. Among the key challenges to further trade union membership growth, the paper points to a rapid increase of precarious employment in Poland. It is suggested that due to peculiarities of labour market and legal contexts that constrain union organising of precarious workers, trade unions need to seek for possible coalitions with the emergent employee associations, community groups and social movements. As the environment transformed, trade unions need to re-evaluate their strategic goals, organisational structures and mode of operation, which have remained unchanged over the years, and are barely adequate to the current demands, challenges and opportunities.

Although the competences of the EU in the field of industrial relations are limited, European standards concerning collective labour law have significantly affected domestic legal systems, including Polish law. EU legislation forced a reconstruction of a model of collective representation of employee interests. Polish law shifted from single- to double-channel representation with trade unions and employee councils (involved in information and consultation procedures). Under the influence of EU law the Polish legislator has established a number of collective procedures aimed at the protection of employee interests (e.g. collective redundancies, transfer of undertaking). As a rule, they reflect basic protective standards determined at the European level. There are, however, some lesser problems that weaken the effect intended by EU legislation. Nonetheless, implementation of European standards has contributed to the development of industrial relations and protection of workers.

Theoretically, there are many good arguments that unions should support a proposal on basic income. The main reason for the Danish trade unions resistance to basic income reform is that it would go against the short-term interest of the unions in organisational self-maintenance. Trade unions will lose power in relation to their members with a basic income. Trade unions have control over individual members by virtue of the collective agreement system and the labour law system. If you have a basic income system, the individual worker will decide when he or she wants to leave his workplace and strike. Suppose a single worker or a group of workers leave their workplace because of dissatisfaction with the working condition. In that case, they will be punished financially according to the rules of labour law rely on any support from their trade union.

The aim of the contribution is to define the approach of trade unions and social dialogue at national (tripartite) and sectoral level in Slovakia during the economic crisis and the impact of the crisis on results of collective bargaining of higher instance collective agreements. We collected data from the collective agreements in four sectors, public and civil service, education and science, metal and chemistry industry. By analysing collective bargaining at sectoral level and examining collective agreements of selected trade unions of the production and nonproduction sectors, we point out the minimum rates of pay increase in selected production and non-production sectors compared to chosen macroeconomic indicators during the crisis times. We try to examine the involvement of social dialogue in taking measures and solving the crisis and compare the economic crisis situation in 2008 – 2009 and during recovery with the coronavirus crisis. According to such experience we try to describe and afterwards assume the position and attitude of trade unions after the period of coronavirus crisis and developments in social dialogue (at national level) during the consecutive economic and social crisis.

The major issue addressed in this article is union involvement in conversions to employee ownership and the impact of such ownership on union roles and functions. The main point is that employee ownership appears to generate role conflict for unions as they thus potentially represent both employees and owners. The author hypothesizes that trade unions are ready to accept the conversion of a public firm to an EOC when the union is certain of maintaining political control over the company. There are two clearly defined situations in which unions might support a conversion: a) in the case of a failing firm that converts to employee ownership to save jobs; and b) in the case where a company is converted to protect it against a takeover by private competitors.

The paper presents similarities and differences in the perception of women's problems on the present Polish labour market by leaders of old and new social movements (i.e., trade unions and women's organisations respectively). Based on the qualitative research conducted in 2010-2011 in Silesia, the paper focuses on the issue of mutual perception of union leaders in trade industry and female leaders in women's organisations. It also analyses factors facilitating the integration of the both movements and their actual cooperation so far and emphasises the potential of their synergic cooperation.

The paper concentrates on the issues of interest representation for non-standard employees. The empirical findings from the European Union (EU) level are used as a frame of reference for analysis of the situation in Poland. Nonstandard employment is an ambiguous notion, so is, naturally, the concept of non-standard workers. In Poland nonstandard employment has been growing, mostly in a form of 'junk jobs'. Trade unions, and other institutional forms of collective interest representation, struggle to endorse problems faced by non-standard employees, with a moderate degree of success.

Labour market reforms have been undertaken to eliminate labour market rigidities in European countries since 1970s. The important features of the reforms are the reduction in adjustment costs and the introduction of fixed-term contracts (FTC). Some empirical studies point out that employment fluctuations have become more volatile after the reforms. This paper presents a model with FTC and analyzes the effects of the key features of the reforms. Numerical examples show that an expected productivity shock causes the oscillatory behaviour of employment. Moreover, a reduction in adjustment costs amplifies fluctuations. In the labour market literature, a number of studies point out the importance of trade unions in European countries. This paper also analyzes the effects of union influence, and the numerical examples indicate that the stronger union influence leads to larger employment fluctuations.

The paper is focused on the issue of economic democracy. Building on experiences of Germany with employee participation, and, in particular, the institution of co-determination (Mitbestimmung), the author argues that more democratic voice is neces- sary in modern economy to restore balance between the needs of the society as a whole and demands of the market. In course of the paper, the author examines four stages of democratisation, that is, first, the conquest of political democracy through winning of basic freedoms, second, broadening the scope of freedoms with incorporation of such rights as union representation, collective bargaining, and set of principles constituting 'welfare capitalism', third, struggle for industrial democracy, and, finally, reaching an even more advanced state of economic democracy. Next, the author's attentions shifts to the phenomenon of the 'cancer stage of capitalism', at which the foundations of the 'post- war compromise' between capital and labour have been destroyed and markets have been getting increasingly 'disembedded'. In the end, the prospects for overturning the current trend towards building an 'economic dictatorship' are discussed with particular attention given to trade unions, and their potential role in the process.

The article attempts to answer the question whether the economic freedom of the employer is not blindly limited by the model of trade unions, which do not conform to the modern economic reality, which, in the light of the principle of self-governance, often abuse their dominant position in the labor market. The author points to selected problems in the self-government of trade unions at the level of non-employment, pointing to the importance of the trade union statute, which determines the scope of protection of trade union activists in the sphere of individual labor law. The author puts forward the thesis that the basis for the balance of social partners is the observance of internal regulations by trade unions.
W artykule podjęto próbę odpowiedzi na pytanie, czy wolność gospodarcza pracodawcy nie jest ślepo limitowana nieprzystającym do współczesnych realiów gospodarczych modelem działania związków zawodowych, które często w świetle zasady samorządności nadużywają swej pozycji dominującej na rynku pracy. Autorka wskazuje na wybrane problemy w zakresie samorządności związków zawodowych na poziomie zakładu pracy, wskazując na znaczenie statutu związku zawodowego, który wyznacza zakres ochrony działaczy związkowych w sferze indywidualnego prawa pracy. Autorka stawia tezę, że podstawą równowagi partnerów społecznych jest przestrzeganie przez związki zawodowe swoich wewnętrznych regulacji.
