The reviewer gets involved in a polemic with the authors of "The Economic and Professional Self-Government in the Political System of Poland" by Robert Kmieciak, Paweł Antkowiak, and Katarzyna Walkowiak. The editorial aspect of the work evokes a positive response, but the reviewer has doubts concerning the concepts presented by the authors, believing that the publication gathers and repeats ideas that have previously been discussed in the literature of the subject. In the postmodern era, Europe, including Poland, is strikingly characterised by the migration of citizens, caused among others by the process of European integration or globalisation, enhanced by the fact that territorial, transport and language barriers cease to exist. There are two types of migration: external (among countries) and internal (among regions or municipal units). The process mentioned, apart from all its positive aspects, may simultaneously lead to a weakening or even loss of local identity as well as social bonds on the local level. These two elements, however, are absolutely vital for the proper functioning of a local self-government community. The process of erosion of social bonds is also influenced by a consumerist and hedonist lifestyle. Therefore, a question arises about the future shape of the self-governmental community, which consists of all the inhabitants of a principal unit of administrative division of a country. Such a community with its territory constitutes the local self-government, which not only takes part in exercising public authority, but also as a result of the process of decentralising public authority, accomplishes an essential part of its objectives. Thus, the first element of the presentation will be introducing the political shape of the local self-government, set by the norms laid out in the constitution and the European Charter of Local Self-government, based on legal dogmatics and empirical method (analysis of the jurisdiction of the Constitutional Tribunal, the Supreme Court and the Supreme Administrative Court). Second, the presentation will attempt to verify the thesis concerning the level of threats for the future functioning of the institutions of the local self-government, caused by contemporary social, economic and cultural changes. A measurable factor verifying the thesis will consist in the analysis of the participation of the local communities in the direct way of exercising authority by the members of the self-governmental community, namely the attendance in local elections). A positive answer to the thesis formed may constitute a basis for de lege ferenda conclusions, concerning the shape of local self-government institutions in Poland.

The need for rationalization of expenditures, the desire for greater financial discipline and the search for savings as a part of economy of physical and financial resources determine the need of development and continuous improvement of mechanisms (instruments) aimed at enlarging the efficiency of self-government finances. Internal audit is an instrument that could enhance management of self-government entities in the rationalization of finances, as well as in protecting society against wasteful and inefficient spending of public funds. This article attempts to assess the internal audit as an instrument supporting the efficiency of self-government finances. According to the survey it is demonstrated that internal audit in its current statutory form and in the way it is realized by the majority of self-government entities is focused primarily on legality criteria, paying less attention to the economic criteria for evaluating local finances, ie. efficiency and thriftiness.

Public administration in Poland has taken the form of a system of entities with different tasks and objectives, as well as different competences. It is a part of the classical model based on the functioning of two separate components, such as the state administration, including the government and local self-government. From the perspective of a democratic state governed by the rule of law, the existence of local self-government is extremely important, and even becomes a necessity. Therefore, the deliberations addressed in the paper focus on the functioning of this form of public administration at the lowest level of basic division of the state, which is the commune. The presented research is an attempt to indicate the legal status and position of commune self-government not only in the broadly understood local self-government but also in the whole public administration system.

The reform of Polish self-government in the 90's has led to the restoration of local democracy. However, the self-governmental institutions soon fell into crisis, having nearly lost the social trust required for the realisation of their mission. The principal cause behind this phenomenon was the atrophy of moral, political and legal responsibility of the local authorities towards the communities that have elected them. There is a twofold source of weaknesses and dangers for Polish self-government: the erroneous way of introducing changes in the system of government, and the forthcoming sociopolitical phenomena that hampered or even made it impossible to achieve some of the goals of the reform. We support the radical revision of legal regulation to remove these weaknesses. The basis for such a change will be the principle of subsidiarity as a governing rule for the entire system of public authority. This will ensure that the communities of inhabitants are seen as primary subjects of self-governmental power, and their power is rooted in citizens' rights to self-government. It is also necessary to ensure a truly pluralistic character of territorial power. Thus the citizens and their associations will have an influence on the election and functioning of the selfgovernmental bodies. The Author warns against the risk of emergence of a class of local and regional 'mandarins' in Polish public life – a class of practically ineradicable and systematically deficient leadership, likely to emerge should the mechanisms of democratic responsibility fail to be restored into the governmental bodies. The article ends with suggestions of particular legal changes aiming at the correct formation of Polish self-governmental institutions in both morally and socially rightful sense.

The professional self-government, as a component of the decentralised public authority, is an institution which derives its legitimacy from the supreme legal act, the Constitution of Poland. Its basic framework is set out in Article 17(1) of the Constitution, according to which: “By means of a statute, self-governments may be created within a profession in which the public repose confidence, and such self-governments shall concern themselves with the proper practice of such professions in accordance with, and for the purpose of protecting, the public interest”. The ratio legis of this regulation is the possibility of statutory entrustment of certain professional corporations with the performance of public tasks in authoritative forms appropriate for public administration. This study presents of the functions and tasks that the legislator has provided for the professional self-government of judicial officers. Currently, the provision regulating the tasks performed by the judicial officers’ self-government is Article 195 of the Act of 22 March 2018 on judicial officers, according to which the tasks of the judicial officers’ self-government include in particular: 1) supporting the administrative supervisory bodies in supervising the conscientious performance of service by judicial officers and the proper performance of duties by assessors and trainees, 2) participating in ensuring the conditions for the performance of the statutory tasks of judicial officers, 3) representing judicial officers and assessors, 4) the professional development of judicial officers and assessors, and participation in the training of trainees, 5) establishing and promoting the principles of professional ethics and ensuring their observance, 6) conducting research into the functioning of judicial enforcement. The authors analyse the normative material regulating the issue in question. Looking through the prism of theoretical concepts of professional self-government, they also assess the legitimacy of the solutions adopted by the legislator. Consequently, they make de lege lata remarks and de lege ferenda postulates.

This article’s aim is to examine a dependency between local government administration at a municipal level and the level of local entrepreneurship. This paper attempts to answer the question of whether the size of the local government administration has features of stimulant or de-stimulant in the process of setting up a business. In other words, does the size of public administration at a local level (municipal level) have a positive or negative impact on creating new business entities? This is important due to at least a couple of reasons. First of all, the current research achievements are not extensive, when it comes to the publications that link entrepreneurship and the size of local government administration. Secondly, the problem of entrepreneurship determinants constitutes still topical and not fully investigated (or explained) aspects of local economy development. Thirdly and finally, the authors of this article have proposed and copyrighted an approach to the quantification of the size of local government administration, modifying commonly used measures of local public administration. Thus, this article fits not only into the explanation of the entrepreneurship phenomenon and its determinants, but also contributes to the development of knowledge about dependencies between the size of local self-government and the entrepreneurship level. It expands the knowledge resource on analyzed dependencies and re-orients current approaches to similar research.

The core of the local self-government stems from the Western (Latin) civilization values. European Nations have always fought for the qualities and perseverance of local self government. Currently it is considered an attribute of local democracy, although in the European tradition it has long been related to the pluralist values of social life organization. The communes; freedom, and their independence from the local government have been derived from natural law and seen as a condition for a healthy social system. Contemporarily, local self-government as a law and ability for local communities to manage a range of public matters independently, has been anew recognized as a social system value in uniting Europe. Yet there have also revived certain historical threats to the local selfgovernment arisen from central and local bureaucracy, particularism, and bribing local power elites. In such case, the fight for a local government that complies with Latin civilizational values acquires a special meaning.

Artykuł omawia kształtowanie się i realizację ideę samorządu terytorialnego na Pomorzu. W pierwszej części pracy autor starał się przedstawić dążenia środowisk regionalnych, w tym opozycji demokratycznej do przebudowy państwa w duchu samorządności lokalnej i regionalnej w okresie przed transformacją ustrojową na przełomie lat osiemdziesiątych i dziewięćdziesiątych XX wieku. W drugiej części przedstawiono problemy, jakie się ujawniły po wprowadzeniu samorządu gminnego w 1990 roku i próby ich rozwiązania we współpracy międzywojewódzkiej i projektowanej reformie regionalizacyjnej. Trzecia część opisuje województwo pomorskie, które powstało w związku z reformą samorządową 1998 roku i problemy związane z umacnianiem jego podmiotowości w systemie ustrojowym Rzeczypospolitej Polskiej. Artykuł podejmuje też kwestię przyszłego statusu samorządu regionalnego Pomorza.
In this article the author undertakes to answer the question on how the idea of territorial self-government in Poland as well as of Pomeranian Voivodeship evolved and how it has been implemented. In the fi rst part of the text the author presents the aspirations of various social circles in the region, including representatives of democratic opposition, for reconstructing the state so as to establish local and regional self-government. This part covers the period before the administrative reform, that is turn of 1980s and 1990s. The second part serves to identify the problems which arose after the territorial self-government was introduced in 1990. It also presents the attempts at solving them via interregional cooperation and further reforms. The third part presents Pomeranian Voivodeship established as the result of the self-government reform of 1998 as well as problems related to anchoring it in the administrative system of the Republic of Poland. The article concludes with a set of research questions on the future status of the regional self-government in Pomerania.

The study presents critical reflections on the course and results of Polish local self-government reforms from March 1990, when after 40 years of the system of territorial soviets (national councils), self-government was reintroduced into communes, until January 2018, when an attempt to improve the systemic institutions of self-government in communes, poviats and voivodships was once again revisited. The author points out significant discrepancies between the basic ethical and political values of local self-government, i.e. democracy, independence and efficiency, and the changing content of self-government systemic laws as well as the practice of local authorities’ operations, and formulates proposals aimed at repairing Polish local self-government by adjusting its organisation and functioning to the principles resulting from the Constitution of the Republic of Poland and the European Charter of Local Self-Government. He considers as the most important the elimination of pathological phenomena of simulated local democracy which include: a drastically low turnout in elections and referenda, the disappearance of democratic responsibility of local self-government bodies, and the autonomy of the directly elected executive body of the commune from the influence of the local representation. From this point of view, he positively assesses the new regulations, strengthening the guarantee of transparency of operations carried out by local self-government bodies and control rights of councillors, as well as expanding the catalogue of initiative, consultative and control powers of citizens. He points out, however, that ensuring real democracy in of the local authorities requires a deeper reconstruction of the principles of self-government, the election process, and strengthening the role of representation in creating and enforcing the responsibility of executive bodies.

The author notes that under applicable law the local self‑government unit may provide financial support for church projects involving the reconstruction of historic monuments, as laid down in the Act on the Protection of Cultural Property. However, it is not clear whether they can support the construction, extension, reconstruction of chapels aimed at creating conditions for the operation of special pastoral service in local medical establishments and nursing units. However, funding of other church projects out of the budgets of self‑government units, including the construction and development of churches, is not allowed. The author points out that in the event that during the public consultation in the local community residents have chosen to implement projects (tasks), which are not related to the tasks of the municipality, this does not bear a duty to recognize them in the draft budget or local self‑government or in the approved budget. If the local self‑government authorities have taken such a decision, the regional chamber of audit should declare it null and void, due to non‑compliance with the law.

Opis:
The article considers public security as a component of national security. Public security is one of the priorities of state policy in the field of national security. Successful public safety is the implementation of a set of measures in the field of landscaping: installation of traffic lights in appropriate public places, construction of underpasses, construction of indoor stops for citizens waiting for the arrival of public transport, etc. A well-thought-out system of planning and construction of settlements or public places, maintaining them in good condition, which promotes work and recreation of citizens, reduces the degree of threat to public safety from the occurrence of unexpected and dangerous situations. And neglect of public amenities can lead to favorable conditions for those who commit offenses and encroach on public safety. A special place is occupied by local governments, they are the closest power to the population, have the necessary powers and resources to attract citizens to maintain public order, increase their social activity in creating decent living conditions in a given area. The state defines local self-government as an independent level of government to which the people are entitled. First of all, it presupposes the organizational separation and independence of local self-government from state power, its independence in resolving issues of local importance, but independence within its own powers, as provided by the constitution. The main powers of local governments to ensure public safety and public order include: monitoring compliance with the law in the territory; application of measures of state coercion (usually, it is a question of bringing to administrative responsibility for the offenses connected with local government); protection of public order, carried out mainly by the police; ensuring the safety of citizens. Accordingly, local governments may be endowed with additional powers in the field of public order and protection of citizens’ rights. Protecting the rights of citizens is an important component of ensuring security both at the individual level and at the level of the entire state. The sense of security that is transmitted inside and outside the country can be considered part of the attractiveness of the image of the country abroad.

W niniejszym artykule zostały opisane kluczowe kompetencje i umiejętności potrzebne kierownikom jednostek samorządowych w wykonywaniu ich ról menadżerskich i funkcji zarządzania. Szczególny nacisk położono na umiejętności decyzyjne, czyli te kompetencje, które umożliwiają kierownikom podejmowanie właściwych decyzji. W część badawczej postawiono pytania: Jakimi kompetencjami powinni charakteryzować się kierownicy administracji samorządowej? Czy decyzje kierownika administracji samorządowej wymagają posiadania innych, specyficznych kompetencji niż w przypadku tzw. klasycznego menedżera organizacji biznesowej? W celu odpowiedzi na tak postawione pytania posłużono się wynikami badań własnych przeprowadzonych na grupie 208 kierowników z 75 różnych urzędów administracji samorządowej województwa śląskiego.
The article presents managerial competencies’ issues in the decision-making aspect. We have claimed that there is a need for employing a new managerial (and not only administrative or political) paradigm in managing local government administration institutions. In the study part we have posed the following questions: What competencies should the managers in local government administration have to make appropriate decisions? Do decisions of the manager of the council administration require the possession of different, specific competences than in case of the manager of the business organization? The studies have been based on surveys of 208 managers from the 75 local government administrations from Upper Silesia region.

One of the greatest achievements in the process of political transformation in Poland involves the broad decentralization of the public authorities, where a larger number of independent entities with public competences exist alongside a single center. Decentralization is embodied by self-government, which has therefore become an important element of the democratic regime co-creating a network of links related to the distribution of power, property and resources across society. Undoubtedly, self-government which works in favor of citizens’ groups being organized as corporations contributes to the increased efficiency of public authorities in the territorial and special dimension. Based on this, self-government should be understood not as a unidimensional entity involved only in territorial relations. There is also special self-government, established according to different criteria, which plays an important role in the system of the representation of the interests of defined circles. It is divided into professional self-government and, first and foremost, business self-government. Importantly, self-governments should be approached from a slightly different angle – not only in the administrative and institutional context, but also from the point of view of the realization of the interests of organized social groups, that is in terms of governance, which can improve the functioning of local authorities, for instance as concerns the emergence of metropolitan areas. The harmonious development of all forms of self-government, irrespective of the type of bonds connecting its members, as well as the consolidation of participatory processes, is one of the prerequisites for a stable democratic regime.
Jednym z największych osiągnięć procesu transformacji ustrojowej w Polsce jest szeroka decentralizacja sfery władztwa publicznego rozumiana jako system, w którym istnieje większa liczba samodzielnych ośrodków dysponujących kompetencjami publicznoprawnymi przy jednym centralnym. Będący egzemplifikacją decentralizacji samorząd stał się zatem ważnym elementem demokratycznego systemu politycznego, współtworząc sieć powiązań odnoszących się do podziału władzy, majątku i zasobów w społeczeństwie. Nie ulega wątpliwości, że działając na rzecz zorganizowanych korporacyjnie grup obywateli samorząd przyczynia się do podniesienia efektywności funkcjonowania władzy publicznej w wymiarze terytorialnym i specjalnym. Wychodząc z tego założenia należy zauważyć, że samorząd nie jest pojęciem jednowymiarowym odnoszącym się wyłącznie do stosunków terytorialnych. Ważną rolę w systemie reprezentowania interesów określonych środowisk odgrywa także samorząd specjalny, który wyodrębnia się według innych kryteriów. W jego ramach wyróżniamy przede wszystkim samorząd zawodowy i gospodarczy. Warto również podkreślić, że samorząd należy obecnie rozpatrywać z nieco innej perspektywy, nie tylko ze względu na kontekst administracyjno-instytucjonalny, ale również z punktu widzenia realizacji interesów zorganizowanych grup społecznych, a więc w kategoriach governance, co może poprawić funkcjonowanie systemu władzy lokalnej, na przykład w kontekście kształtowania się obszarów metropolitalnych. Harmonijny rozwój wszystkich form samorządu, bez względu na charakter więzi łączących ich członków, a także wzmacnianie procesów partycypacyjnych jest zatem jednym z warunków petryfikacji demokratycznego systemu politycznego.

One of the greatest achievements of the socio-political transformation process in Poland is the profound decentralization of public governance. In administrative law, decentralization is perceived as a system with a larger number of independent hubs, vested with competences in terms of public law, and a single center. Therefore, decentralization is a process of delegating certain public functions which formerly were reserved for the central government to groups of citizens organized in corporations. Although local government exemplifies decentralization it is not a one-dimensional no- tion that refers exclusively to territorial relations. In the system of representation specialized self-government bodies, formed with different criteria, play a highly significant role represen- ting the interests of various groups. They are divided into self-governing bodies focused on the economy and the professions. Formal and legal homogeneity, though, does not translate into the appropriate political position of these two forms of self-governing bodies in Poland. While the professional self-governing body is clearly an association governed by public law, the so-called economic self-governing body is based on concepts that emphasize the volunta- ry nature of the ties between entrepreneurs, associated in chambers of commerce. The differences in their legal status and the resulting powers bear no influence on the fact that both economic and professional self-governing bodies are now facing equally serious threats in Poland. In both cases these are related to how the state approaches the extra-territo- rial form of decentralization. We can speak of different motivations here. The state, or rather the state administration, is excessively interested in the professional self-governing bodies and is curbing the autonomy they have traditionally been vested with. The situation is quite different with respect to the economic self-governing bodies, where the public authorities are scarcely interested in becoming involved in supporting them. It should be realized then, that the success of Polish decentralization reform will only be complete when all forms of self-government develop harmoniously irrespective of the rela- tions between their members, whose empowerment will serve democracy and strengthen civic society.

The scope of this article is to show selected problems concerning constitutional regulations of financial autonomy of self-government units in Poland, in the light of the legislator’s freedom to determine their incomes by bills. It appears that in the light of the current regulations, the freedom of the parliament is too great, which significantly limits the financial independence of local government units. The article will present proposals for changes to Polish constitutional regulations in this area in order to increase the self-government financial autonomy, with reference to the solutions in force in selected European countries. It is necessary to increase the influence of self-government about bills concerning their incomes and expenses, so it should be a constitutional obligation to consult such projects on the forum of the Joint Government and Self-Government Commission. The postulate of transforming the Senate into a Self-Government Chamber is also worth considering.
Celem artykułu jest przedstawienie wybranych problemów związanych z konstytucyjną regulacją samodzielności finansowej jednostek samorządu terytorialnego w Polsce, w kontekście swobody ustawodawcy w dziedzinie określania dochodów JST. Wydaje się, że w świetle aktualnych regulacji wspomniana swoboda ustawodawcy jest zbyt duża, co powoduje znaczne ograniczenie samodzielności finansowej JST. W artykule przedstawione zostaną propozycje zmian polskich unormowań konstytucyjnych w tej dziedzinie w celu zwiększenia wspomnianej samodzielności, w nawiązaniu do rozwiązań obowiązujących w wybranych państwach europejskich. Przede wszystkim konieczne jest zwiększenie wpływu organów samorządu terytorialnego na przebieg procedury ustawodawczej w przypadku projektów ustaw dotyczących dochodów i wydatków tych jednostek. Najbardziej wskazane byłoby wpisanie do ustawy zasadniczej obowiązku konsultowania takich projektów na forum Komisji Wspólnej Rządu i Samorządu Terytorialnego. Godny rozważenia jest też postulat przekształcenia Senatu w Izbę Samorządową.

The aim of the article is to indicate a new direction of research on the evolution of system models of local self-government in Germany in the perspective of communalization and de-communalization. Communalization can be used to explain legal regulations of a local government, which are similar to the South German model and, on the other hand, to explain how analogous regulations that strengthen the role of the legislative body, both in the municipal self-government and in the county self-government, function in the same federal states. De-communalization enables to investigate the role of starosta (Starost) in the organizational structure of county self-government. The core result of the study is the fact that on the basis of the three research criteria (geographic, historic, and the range of relations between legislative and executive bodies) the process of communalization of municipal self-governments and county self-governments in 11 federal states has been duly corroborated.

The right for electing the representatives of authority bodies is one of the fundamentals of democracy. This right entitles citizens for active public participation through expressing their support (votes) for candidates, which will respectively represent their voters in certain institutions. Polish electoral law, which regulates the local self–government elections is very controversial. The existing legal rules were changed many times since 2011. Among the subjects being discussed one can mention electoral campaigns, candidate registration rules and organization of elections. Frequent changes in the electoral law result in misunderstandings and unwillingness to participate in elections. Their effect is low voter turnout and a large number of invalid votes. To sum up considerations over a political model of large cities, it is worth to indicate that during the last 25 years of operation of Polish local government none of political models of big cities was adopted.

Local self-government, as a structure within which civil society can thrive, where the digital competencies of the local and regional community come to life, must have the right tools to ensure adequate cybersecurity. These days, e-government, also at the local self-government level, is a common form of performing public tasks, and as a result, its activities in cyberspace must be properly secured. Many tasks are performed using ICT systems that are exposed to external attacks, and therefore, they should meet the appropriate security standards. In the case-law and in the literature on the subject, there is disagreement as to whether it is permissible to regulate in the statute of the auxiliary unit the principles and procedure for dismissal of a member of the resolution body of that auxiliary unit. Such a possibility also does not arise directly from the Act on Communal Self-government, as it does not regulate the issue of dismissal of members of legislative bodies coming from direct elections. If it is assumed that a community council had been given the opportunity to make decisions on specific matters related to the local community, then it is justified in the context of the interests of that community to discipline community councillors, e.g., depending on their attendance at the council sessions.

After the collapse of the Union of Soviet Socialist Republics (USSR), Kazakhstan’s policymakers recognized that the existing model of state governance had proved ineffective and needed to be changed. One of the necessary solutions was to carry out decentralization. The primary purpose of the following article is to outline the barriers that Kazakhstan needs to remove if it is serious about building local self-government independence. Confronting these with the President’s vision of the transformation of local self-government led to the following research questions: What organizational and legal issues remain unresolved or constitute a barrier to the construction of independent local government structures in the Republic of Kazakhstan after the collapse of the Soviet Union?; to what extent do the changes proposed by President Kasym Tokayev meet the real challenges in the context of expanding the autonomy of local power structures? Answering the questions posed was possible by analyzing legal acts and finding literature and press materials.

Opis:
Samorząd terytorialny w naukach prawnych był do niedawna przedmiotem badań jako konstrukcja prawna (wyodrębniona wspólnota lokalna samodzielnie wykonująca funkcje administracji publicznej). Podjęcie przez samorząd nadto innych funkcji właściwych współczesności spowodowało zmianę akcentów badawczych. Na plan pierwszy wysuwają się nowe funkcje samorządu, wykraczające poza administrację publiczną (działalność na rzecz dobra wspólnego i społeczeństwa obywatelskiego). Stają się one niekiedy głównym elementem definiującym samorząd terytorialny, osłabiając dotychczasową główną funkcję samorządu w znaczeniu prawnym (wykonywanie administracji publicznej). To zaś rodzi niebezpieczeństwo traktowania samorządu jako zjawiska wyłącznie politycznego, wychodząc naprzeciw działaniom osłabiającym pozycję samorządu terytorialnego, zwłaszcza w państwach autorytarnych, rządzonych przez partie populistyczne.
Until recently, the institution of local self-government has been studied in the legal sciences as a legal structure (a separate local community autonomously performing public administration functions). The fact that local government has embraced other functions applicable in contemporary times has resulted in a shift in research focus. New functions of self-government, going beyond public administration (acting for the common good and civil society), have come to the fore. These functions sometimes tend to become the main element in the definition of local self-government, weakening the existing main function of self-government in the legal sense (the exercise of public administration). This, in turn, creates the danger of self-government being treated as a purely political phenomenon, thus seeking to weaken the position of local self-government, in particular in authoritarian states ruled by populist parties.

Inspiracja do podjęcia tytułowego zagadnienia zrodziła się z aktywnej postawy członków Samorządu Studenckiego Gnieźnieńskiej Szkoły Wyższej Milenium, obserwacji zmian zachodzących w ich własnym funkcjonowaniu, rozwoju kompetencji oraz płynących z nich korzyści.
This publication is not only an analysis of the theoretical aspects of student government activity, but also an attempt to look for answers to questions about the importance of broadly understood social competences, shaped by human activity, in relation to his professional and personal life. It also reflects the implications of the implications of knowledge, action and human existence. Is this connection legitimate and why should it serve? The inspiration to take up the title issue arose from the active basis of the members of the Student Government of the Gniezno Higher School of the Millennium, observation of changes taking place in their own functioning, development of competences and benefits resulting from them.

The Sejm’s position is that the examined provision of the Act, which is being challenged by over a dozen communal and city councils, is in compliance with the principles of: non-retroactivity of the law, protection of trust towards the state and statutory law and constancy of tax law during a tax year, which are derived from the Constitution. The applicants demanded an examination of the constitutionality of the provision providing for a retroactive entry into force of the provisions giving new wording to the articles and the appendix to the Construction Law Act and the Act on Investments in Wind Farms. These provisions concern changes in the scope of the real estate tax on wind farms, which is the source of income for local self-government units. In the justification of the position, it was stated that the withdrawal from the cited constitutional principles is motivated by values approved in the Constitution.

Big cities in Poland as well as abroad are the focus of many scientists of different disciplines. The authors of this study join these researchers and concentrate on a previously neglected segment of the Polish big cities’ political actors – city councillors. The aim of this paper is a socio-demographic description of the big city elite. The authors analyze its main characteristics: gender, age, occupational position, and local government experience. They also try to compare the big city elite with other parts of the political elite, especially with the simultaneously studied medium city elite. The paper is based on survey research conducted by the authors in the 12 biggest Polish cities.

The author states that in the case of the death of the chairperson of the voivodship (regional) council, his or her duties shall be assumed by the vice-chair indicated in the authorisation. A similar rule applies in the absence of the chairperson of the voivodship council. In the absence of such authorisation, the oldest vice-chair should assume the chairperson’s duties. The opinion also stresses that the voivodship council is obliged to elect a new chairperson, if this position becomes vacant.

The legal order of contemporary democratic states consists of a supervisory institution which cannot be used for political purposes or used in a discretionary manner. Poland, returning to the maps of Europe in 1918, was a country in which territorial self-government functioned, differing in many aspects from the model we encounter today. The differences concerned, among others supervision, which also played an important role in the activities of local government units in the Second Republic of Poland. The purpose of this article will be to show the evolution of supervision over territorial self-government in Poland.
Współczesne państwa demokratyczne w swoim porządku prawnym posiadają instytucję nadzoru, która nie może być wykorzystywana do celów politycznych, bądź stosowana w sposób uznaniowy. Powracająca na mapy Europy w 1918 r. Polska, była państwem, w którym funkcjonował samorząd terytorialny, różniący się w wielu aspektach od modelu, z którym mamy styczność w dzisiejszych czasach. Różnice dotyczyły m.in. nadzoru, który również w II RP pełnił ważną rolę w działalności jednostek samorządu terytorialnego. Celem niniejszego artykułu będzie ukazanie ewolucji nadzoru nad samorządem terytorialnym w Polsce.

Ze względu na fakt, że budżety te są popularne i w wielu przypadkach są skutecznymi inicjatywami, w Polsce sięga po nie wiele samorządów lokalnych. Od kilku lat inicjatywy te wykorzystują również samorządy regionalne, które są większymi strukturami, a na szeroką skalę jako pierwsza zastosowała ją Małopolska. W niniejszym artykule autor chce przeanalizować zjawisko regionalnego budżetu obywatelskiego właśnie na przykładzie Małopolski, spróbować wyodrębnić jego cechy charakterystyczne oraz zastanowić się nad tym, w jaki sposób budżet partycypacyjny wpisuje się w zadania samorządu regionalnego.
Participatory budgets are currently one of the most popular instruments of involving the society in managing local communities. As these budgets are popular and in many cases effective initiatives, many local governments in Poland use them. For several years, this mechanism has also been used by regional self-governments, which are larger structures, and it was first used by Małopolska on a large scale. In this article, the author wants to analyze the phenomenon of the regional civic budget, using the example of Małopolska, try to distinguish its characteristic features, and consider how the participatory budget fits into the tasks of the regional self-government.

Discussion whether to formalize participatory budgeting or not has been solved. Again, this time it has happened without scholars’ engagement. Given this situation, can we say that whoever is satisfied? The amendment of the act that introduced legal form of participatory budgeting as a new tool of public consultation does not meet anyone expectations. The reason to think so is that there is no new and compulsory form of public engagement in financial decisions. Moreover, organizational framework and the huge variety of using participatory budgeting have been turned to uniform pattern. Equally, it is hard to agree that implemented solutions, previously though as a way to increase citizens’ involvement in functioning and scrutiny part of public bodies, have been met.

The following paper employs a normative approach and focuses on the problem of the current state of the local self-government in the South Caucasus countries: Georgia, Armenia, and Azerbaijan. Since all these countries are members of the Council of Europe, a reference point for decentralisation is the European Charter of Local Self-Government. The paper's main thesis is that despite showing some similarities, the countries have introduced different models of decentralisation that do not fully meet the Council of Europe’s criteria. Such variation is in line with the different political systems of these states and their level of democratisation. The more democratic the state is, the stronger the decentralisation it has adopted. Thus, decentralisation in Georgia follows the European model of public policy, while Azerbaijan is preserving the former Soviet model of weak self-government, with central authorities playing the leading role in public services. The current changes in Armenia’s model resemble the Georgian track of reforms. The findings of this paper may be applicable both in further theoretical research and in implementing reforms of local self-government in various post-Soviet states.

In the first of Czechoslovak republic, mainly under the influence of the normative theory, started many legal researchers to pay attention to public law branches. Administrative law and self-government were not the exceptions. The discussion about self-government was focused mainly on the issue of its function in society. On the one hand, we are confronted with a political concept of self-government, and on the other hand, with a legal concept of self-government. The political concept of self-government was based on the historic originality of local authorities and on the idea that self-government is a collective version individual that has natural rights. The theory of legal concept of self-government was based on the fact that, despite the historic originality of the municipalities, the State is the only sovereign on its territory. The municipality is therefore only subject of its power and its competence is being delegated by the state. Self-government is therefore a collective organization created by state.

In accordance with the Electoral Code a person employed as a secretary or a treasurer of a commune (district, voivodeship) has a right to stand for election for a head of commune, a mayor and a president of the city. However, combining the function of a secretary or a treasurer with the post of the head of commune, the mayor or the president of the city in a single or in different local self-government units is inadmissible Self-local government officials employed on official posts are restricted, during a potential election campaign, by their labour duties, in particular they are not allowed to undertake activities “causing reasonable suspicion of partiality or acting in self-interest” as well as they cannot disclose information constituting a statutorily protected secret learned with in connection with the performed professional duties.

The Act on the Exercise of the Mandate of a Deputy or Senator constitutes legal basis for requiring by the Deputy the access to recordings from the session of a communal council. However, there are no sanctions in case of local self-government unit’s infringement of such an obligation towards Deputies and Senators. The lack of specific legal instruments does not exclude the possibility of taking action on general terms, i.e. on the basis of provisions concerning control and supervision over local self-government. A Deputy may demand, from the chairperson of the council, an explanation of reasons for the inability of the realization of such right.

Within the current state of law, all activities related to contracting a consolidation credit must be included as a revenue and expenditure in the budgetary resolution of a local self-government unit, at the same time affecting the amount of an individual debt ratio. There is no legal basis for directing instructions to the Regional Audit Chambers to change an interpretation of the currently binding legal norms. An amendment to the Act on Public Finances is in the process of drafting, aiming at making possible for local self-government entities to restructure debt through, inter alia, repayment of the existing debt with a new, more favorable consolidation debt.

The professional performance of public tasks results in the necessity to employ persons who treat the performance of these tasks as a profession and therefore should be employed within the framework of an employment relationship. Therefore, it is not possible to employ proxies under a civil law contract to perform official tasks. Employment on such a position under a civil-law contract can be assessed as a circumvention of rules, according to which local government employees should be employed – including the rules established in terms of recruitment, qualifications and duties.

Progress of the climate change and limited water resources in Poland are forcing a change in the approach to rainwater and snowmelt, so that it is treated as an element of sustainable development in urban areas. This generates the need to provide financial resources for the implementation of rainwater and snowmelt management plans. The conducted analysis concludes that the rainwater fee has the characteristics of a tax and should be established in this form. The correct model for im‑ posing rainwater and snowmelt fees on residents is the administrative-legal model. Municipalities currently have no clear statutory basis for its introduction. In the author’s opinion, this situation requires urgent intervention by the legislator.

Water resources are basic condition for survival and development of mankind on certain territory. The quantity of water resources in community depends on geographical location and certain hydro-geological, hydro-logic and hydro-biologic conditions on certain area. It means, that water resources are measurable and strictly defined. Due to consumption of water to different purposes (municipal entrepreneurship, industry, agriculture), the quantity of water resources may be depleted both quantitatively and qualitatively. The local self-government, according to provisions of law has possibility and obligation to pursue a policy of providing ecological security for its citizens. Creation of civic consciousness among the citizens of communities is also an important factor for providing the ecological security.

This study offers a short introduction to the development of cities in general, their types, functions, position and points of differentiation. It stresses the importance of multifarious factors that determine the importance of particular entities. The main part of the study though is concerned with Polish cities. It takes into consideration their origins, geographical location, administrative and political importance, city reforms, demographic and economic factors as well as their functions and finance to assess the role and salience of different city categories. An especially significant area in the activity of territorial self-government units is the execution of investment undertakings. However, it requires taking into account various factors influencing their launch and performance. Investment expenditure enables a reduction in differences as far as the development of territorial self-government units is concerned. The scale and range of investment activity pursued by territorial self-government units depend on the financial standing of these entities and it is budget analysis that serves the purpose of its examination. Finance is the key element of functioning of territorial self-government units and the basic marker of practicability and success of each investment. The article aims at presenting financial conditioning related to the budgetary situation of territorial selfgovernment units in Poland and their impact on the execution of investments by these entities. Thus, the parameters that were characterised were investment expenditure, own revenue, budgetary result and operating surplus in the years 2007-2015. The research procedure made use of non-reactive methods, namely the method of analysis of official documents and the historical and comparative method.

In 2015 we celebrate the twenty-fifth anniversary of the first free local elections to self-governing bodies. Those elections activated local citizens initiatives and greatly contributed to the transformation in our social awareness, leading to real change in Poland’s political regime. The underlying rationale of free local elections, however, was the package of laws adopted on 8 March 1990 which created real self-government, enabled the elections to commune and municipality councils of 27 May 1990 and introduced a new dynamic to the process of the decentralisation of the state. Changes are always the result of dreams and our ability to realise them. It is possible to make them if there exist organisational structures and institutions which allow such changes to be made. The need for political transformation had long been felt and deliberated on by those involved in spatial development or and for whom the state monopoly status quo was unacceptable. To quote the late and much missed Professor Jerzy Regulski, the implementation of self-governance was departure from the monopoly of central government, which in turn meant an actual change in the political regime. The reform of 1990 broke up five monopolies of an authoritarian state which had existed in Poland since the end of the World War II: the political monopoly of one party, of centralised power, of uniform state ownership, of public finances and the state budget, and of the uniform public administration of the state. However, it must always be remembered that the possibility of realising dreams of a change in the nature of the state was shaped in the first triumphant stage of the Solidarity period in 1989, and later became a stable basis for the future in the resolution of the First National Congress of Solidarity Delegates and in the ‘Samorządna Rzeczpospolita’ (A Self-governing Republic) document. The success of the real change of 1990 was rooted in the long term determination and persistence of those whose personal experiences were involved in the quest for rationality in land management. Both Professor Jerzy Regulski and Professor Michał Kulesza drew their inspiration to change the political regime from the need to ensure that society worked in a way that would allow the local needs and initiatives be articulated, and inhabitants having the ability to take concrete decisions about the surrounding environment. In this way, the existing possibility of active involvement in local initiatives, incapable of being realised in the former political system, would become a reality and the citizens would be able to make collective decisions about their local area. This would also give a chance to oppose formally the investment logic resulting from the central planning of those times. The analytic work aimed at the transformation of the political regime that Professor Regulski started in the 1970s during his employment at the University of Lodz were subsequently continued at the Economic Institute of the Polish Academy of Sciences and led to the formation of a group of individuals for whom self-governance became a core value of the new regime and a way of looking at the modern state. The change that took place in 1990 was the beginning of the building of a de-centralised, modern state, the status of which was subsequently confirmed when Poland adopted the Council of Europe Framework Convention for the European Charter of Local Self-Government. Self-government is never an institution whose constitution is ever finished. This was shown during the reform carried out by Prime Minister Jerzy Buzek’s government, which continued the break-up of the monopoly of power and implemented subsidiarity principles at the regional level enabling them to exercise powers locally, in newly created districts (powiat), as well as in the later legislative changes pertaining to the regulations governing the election of mayors (wójt or burmistrz) or the work of the Komisja Wspólna Rządu i Samorządu (Joint Committee of the Government and Self-Government). Today, after 25 years of our experience with self-government, we are much more aware of the changes needed in the self-governing system. They include the strengthening of actual independence of self-government achieved through the ensured free choice of the manner in which self-government bodies will carry out their tasks, guaranteed revenues and the possibility given to commune and municipality authorities of exercising real influence on their size, improved cooperation between communes and municipalities (gmina) and districts (powiat), and, fore and foremost, by ensuring all citizens a chance of co-decision on matters which directly affect them. Changes in the regime of self-governance are a consequence of its assessment by external, independent experts but are also motivated by the natural dynamics of the changes resulting from the very essence of self-governance and its institutions, communes and municipalities (gmina), districts (powiat) and regions (voivodships). In 2010 associations of self-governing units realised the need for change and amendments to the law on self-governance. Thus, they formulated a number of proposals which were included in a document called ‘Requests to the President of the Republic of Poland to commence work on the white book of territorial self-government in the year of the 20th anniversary.’ This document initiated work on a draft law which in 2013 became the subject of a legislative initiative put forward by President Bronisław Komorowski. The purpose of the new law on the collaboration of self-governing bodies in local and regional development is to strengthen the role of the citizen as well as the community in the work of self-government in Poland. The effort that Professors Jerzy Regulski and Michał Kulesza in their capacity as Advisors to President Komorowski put into the legislative work remains invaluable. It is believed that the involvement of individual citizens constitutes the strength of self-government and is a guarantee of its role at the service and in the interest of communities, individual inhabitants and businesses. Hence the need for enhanced collaboration and the partnership of different bodies of self-government and the increased involvement of citizens. There is draft law that contains regulations supporting these activities. Under the draft law, a local referendum is seen as an important tool to ensure the participation of citizens in decision-making processes, including those concerning local development plans. Local referenda should constitute a mechanism used to solve local issues of material importance to residents. Their result should be binding regardless of the turnout. Self-governance helps to create and strengthen the natural inclination of individuals to act together in areas where because of their social, business or cultural ties, a local community spirit develops. In today’s world of global challenges and competition, we are looking for a space for the individual which provides a feeling of security. Another important value of self-governance is the possibility of creating affiliations with a community as well as individual entrepreneurship, social activity and a regard for the collective memory of the symbols of a place. The ability to participate in community life is inseparable from the functioning of democracy at a local level, with the consultation process, election of public officers, or participation in referenda. Self-governance is a special value which gives each of us a chance to exercise a real influence on local matters. It therefore occupies a very special place where politics has a personal dimension. The variety of self-governance means at the same time a variety of development policies since there are different communities, with different emotions, different experiences or ability to participate in democratic management. This variety is a special asset in the process of the stabilisation of the state as a whole. The diversity of opinions and experiences, appointments to public office of citizens not affiliated to or necessarily recommended by any party creates the solid foundations of a democratic state. This feeling of freedom within self-governing communities must be continued and promoted. The authors of many of the texts published in this issue of Ruch Prawniczy, Ekonomiczny i Socjologiczny devoted to self-governance are, at the same time, authors of the transformation of Polish law and Poland’s administration in the last 25 years. Contributions submitted by, among others, Prof. dr hab. Irena Lipowicz, Prof. Jerzy Stępień, Prof. dr hab. Jerzy Buzek, Prof. dr hab. Leon Kieres or Prof. dr hab. Hanna Gronkiewicz-Waltz are the best proof of the capital importance that self-governance plays in a democratic state. I thank Professor Teresa Rabska and the editorial staff of Ruch Prawniczy, Ekonomiczny i Socjologiczny for their active involvement in questions of self-government from the very beginning. This issue is entirely devoted to a range of legal, economic and sociological aspects of new challenges facing self-government and its regime. Once again I thank them for such active involvement and participation in the jubilee celebrations of Self-Government and this special issue of the journal. We need self-governance not only to feel that we can influence decisions being made about local issues but also to be continually able to renew our confidence in institutions at a local level, and through their collaboration at the national level.

The aim of the paper is to present opportunities given by applying process modelling to cost standardisation in local administration units. The main reason for choosing this research problem is the lack of explicitness in calculating designated subsidy for governmental tasks in Lesser Poland Voivodeship in the last years. Based on the output of organisation and management sciences in the field of business process modelling and analysis, the authors presented an appropriate solution for the task “disability evaluation” realised by Kraków District. In the empirical part, the results of the case study of process modelling for cost standardisation were presented. At the end of the paper the authors formulated conclusions based on their research in Kraków District and gave directions for future application of their methodological proposal.

Michał Kulesza, Jerzy Regulski, and Jerzy Stępień are three co-authors of polish self-government reform (1990 – 1998). The author of the article searches their roles as experts as well as politicians in shaping self-government system. Final conclusion is as follows: although they were “scientific owners” of the problem, their important part in resolving it was more political (bureaucratic) than professional. The matter of their professional role was generally out of question. Practically, the most difficult task was not the shape of future self-government system but the implementation of it. Key in resolving this problem was the political position of aforementioned co-authors, their participation in bureaucratic power, and openness for lobbying. It is a meaningful lesson for the future reformers, each and every one of them.

The sustainable development of the local self-government institute in modern democracies, the introduction of the principles of subsidiarity, regionalization and decentralization show a clear need for implementing the systemic reforms aimed at strengthening local initiatives in Ukraine. The opinion states that the council (sejmik) should “adopt a position” regarding comments and motions of a Deputy. However, motions submitted by the Deputy do not initiate - contrary Deputies’ interventions - any separate, formalized procedure for their consideration by councillors. If the Deputy put forward a motion regarding matters which, according to provisions of statutes or articles of organisation of a municipality (district, voivodship), fall within exclusive rights of councilors (e.g. a legislative initiative) or bodies of a given local government unit or other entities, the council (sejmik) cannot - as unacceptable – consider them. If they meet formal requirements and the way they are formulated enables putting them to a vote, the decision should be made in this form.

According to the Act on Voivodeship Self-Government, the chairman of the Audit Committee must be a member of the largest club of councilors. The fact, that submission of a candidacy meeting this requirement requires the approval of the largest political club, is determined by non-legal circumstances (political pragmatism), not normative ones. The composition of the committee must also comply with absolute statutory requirements. The author also points out that the paralysis of the audit committee due to the failure to appoint the chairman may lead to the suspension of the voivodeship self-government bodies and the establishment of a commissioner’s board on the basis of relevant rules.

The aim of the bill is to shape the procedure of changing the boundaries of municipalities in such a way, that it includes an effective mechanism of social control of this process. According to the author, it is not certain whether conflict situations will be completely eliminated within the framework of the procedure of changing the boundaries of communes proposed by the sponsors of the bill. The proposed regulations are focused on the protection of municipalities covered by the possibility of changing borders from territorial changes made despite the lack of their consent. The author stresses that a solution which would protect the interests of both the municipality applying for the change of borders and the municipality covered by the application would be to allow territorial changes only on condition that an agreement between the parties is concluded.

The Constitution of The Republic of Poland (Article 17) says that: “By means of a statute, self‑governments may be created within a profession in which the public repose confidence, and such self‑governments shall concern themselves with the proper practice of such professions in accordance with, and for the purpose of protecting, the public interest”. This regulation is based on two principles: The first is the principle of professionalism; the second embraces norms that must be observed by representatives of professions of public trust. Those groups can make the decisions of their members or profits for themselves. This puts them in a different position than other participants of social and economic life. Professional associations are not driven by market rules, nor administrative regulations (relating to the postulate of the division of labor). The problem begins when – from a social point of view – it is no longer possible to regard these organizations as trustworthy partners. The gap between legal and social perspectives raises doubts about the way in which a civil society could face professional self‑governments when they are seen as being hostile to them.

Reforma samorządu terytorialnego zapoczątkowana w 1990 roku trwa. Wprowadzenie trójstopniowego podziału administracyjnego kraju (1999 r.), to następny element w procesie instytucjonalnego zwiększania partycypacji obywatelskiej. Niedoceniany, zdaniem autora, jest obszar oddolnej aktywności obywatelskiej, którą skutecznie eskplorują jednostki pomocnicze samorządu, czyli rady osiedli. Pozbawione osobowości prawnej, mające ograniczone kompetencje rady umykają uwadze partii politycznych. Na przykładzie rad osiedli miasta Szczecin autor wskazuje, że ich apolityczność ma charakter pozorny. Są naturalnym zapleczem dla prezydenta miasta, co będzie wymuszać reakcję ze strony partii. Pierwszym działaniem jest zmiana sposobu głosowania do rady osiedla. Zdaniem autora, rady osiedli, choć powoli, staną się płaszczyzną konfliktu politycznego, w którym przyszli liderzy będą zdobywać pierwsze doświadczenie.
The reform of local government (since 1990) is still in progress. The introduction of threetiered administrative division (1999), was the next element of extension of civic participation. The bottom-up process of civic activity, which, partly, manage the auxiliary units of local self-government Councils of settlements, is underestimated, according to author. The CS, devoid of legal personality, escape the mind of political parties. Author on the case of Councils of settlements shows that apolitical is a delusion. The CS are natural backdrop of the president of Szczecin now, and will enforce a reaction from the parties. The change of voting to CS is the first action. The Councils of settlements will become a plane of political conflict, in which the future party leaders will get experience.

Over the two decades of local governance in Poland, the catalogue ofthe fundamental values of local self-government has transformed. In the first decade, when the foundations of local governance in Poland were laid, the most important aspect was the basic values of the political system: liberty, equality and universality. In the second decade, they were replaced by the values that are fundamental for the development of local governance, such as local bonds, a sense of community, social capital, political inclusion and, last but not least, civic society. These changes were accompanied by different requirements being made of local government officials. There emerged increasingly detailed legal acts of statutory status that defined such requirements and the principles the officials are supposed to abide by as public servants. The paper attempts to catalogue the set of values associated with local government in Poland. This catalogue is subjective. The author also includes among those values the principles that are recognized as valuable by a given community, thus becoming values in themselves.
Na przestrzeni dwóch dekad funkcjonowania samorządności w Polsce nastąpiły przeobrażenia w katalogu podstawowych wartości samorządu terytorialnego. W pierwszych dziesięciu latach, gdy budowano fundamenty samorządności w Polsce, najważniejsze były podstawowe, ustrojowe wartości, tj. wolność, równość czy powszechność. W drugim natomiast ustąpiły one miejsca wartościom fundamentalnym dla rozwoju samorządu terytorialnego takim, jak: więzi lokalne, poczucie wspólnoty, kapitał społeczny, inkluzja polityczna, czy wreszcie społeczeństwo obywatelskie. Równolegle następowały zmiany w wymaganiach stawianych pracownikom samorządowym. Pojawiły się i ulegały uściśleniu, akty prawne rangi ustawowej określające wymagania wobec nich, obowiązujące ich, jako realizatorów służby publicznej, zasady. Celem artykułu jest próba skatalogowania zbioru wartości kojarzonych z samorządem terytorialnym w Polsce. Ów katalog będzie subiektywny w charakterze. Jednocześnie autor jako wartości traktuje także i zasady, które poprzez uznanie ich przez daną społeczność za cenne, zyskują przymiot wartości.

Communes in Poland are entities that act on market, have defined resources at their disposal, are independent, which is legally guaranteed, and are also responsible for their decisions. Moreover, they compete with each other for various forms of capital. Their effectiveness in management and rationality of undertaken actions are essential as they can reach a specific (desired) market position. In this paper, the assumption was made that relationships of entities interested in activities of commune can have a diversified nature (not necessarily favorable from the point of view of their goals and interests), and the power of their influence may significantly facilitate or impede management in a commune and thereby influence the effectiveness of its activity. In the present conditions of commune functioning, the ability to recognize the interests of particular entities related by market relationships with the commune may guarantee and, in the case of a lack of this ability, may limit the accomplishment of interests of a commune as a collective. The reflections presented in this paper include broadly understood interests of local self-governments. This area is multi-dimensional and poorly recognized, which inspires us to make an attempt to create the system of notions. This attempt has been undertaken in further part of the paper. This constitutes an introduction to direct studies on the problems of interests of local self-government on the example of tourism economics.

In this article, I will focus on the evolution of the systems of elections to the commune councils in Poland. Between 1990 – 2014, seven elections to the commune councils were organized in Poland, conducted on the basis of four different voting systems. The most important alterations in the ordinations between 1990 and 2011 included: changing the category of entities qualifying for majority election system, modification of the dimension of the constituencies, changing the mode of distribution of seats, introducing electoral threshold, diminishing the number of councilors, implementing the procedure of “grouping list”. Analysis of changes in the electoral regulations leads to the conclusion that the elections to municipal councils have been politicized.

The aim of this paper is to highlight specific features related to the performance of public duties by local self-governments, focusing on their autonomy. Hence, it is essential that the conceptual boundaries of such notions as ‘public duties’ and duties associated with ‘public services’ are established at the outset. The current lack of clarity contributes to the complexity of the issue, and this is further complicated by a lack of clear legal regulations which would explicitly define the acceptable way in which public duties assigned to local self-governments are to be implemented. These issues suffice to explain the choice of the topic tackled in this study. Admittedly, it will not provide answers to all the problems associated with the public utility services which fall within the scope of the public duties discharged by particular local self-government units: gmina (municipality/commune), powiat (county), or województwo (voivodeship). However, it may form the basis for further research to be conducted in this field. Therefore, within the framework of this paper, issues related to local self-governments, their autonomy, and the concepts of ‘public duties’ and ‘duties in the field of public utility’ will be discussed. These issues are important, as they are inextricable from the decentralization of public authority, which consists in assigning numerous public duties to be fulfilled by local self-governments.

Przedmiotem rozważań autora są najważniejsze problemy wiążące się z ustawą z dnia 9 marca 2017 r. o związku metropolitalnym w województwie śląskim, która weszła w życie 7 kwietnia 2017 r. Uchwalenie jej było nieodzowne, albowiem na podstawie poprzedniej ustawy z dnia 9 października 2015 r. o związkach metropolitalnych nie utworzono żadnego związku. Tymczasem aglomeracja górnośląska to region, który zamieszkuje około 2 mln ludzi, składający się z miast charakteryzujących się zaawansowanymi procesami urbanizacyjnymi, powiązanych ze sobą funkcjonalnie. Analizowanej tutaj tematyki nie sposób zatem przecenić. Autor niniejszego opracowania koncentruje się wokół zasadniczych kwestii prawnych, aczkolwiek nawiązuje także do dorobku innych dziedzin nauki, m.in. do koncepcji wypracowanych przez prakseologię. Konstatacje autora prowadzą do konkluzji, wedle której związek metropolitalny wyraźnie różni się od związków komunalnych uregulowanych przepisami ustawy o samorządzie gminnym oraz ustawy o samorządzie powiatowym. Zauważyć nadto należy, że interesy poszczególnych jednostek samorządu terytorialnego wchodzących w skład związku metropolitalnego często bywają rozbieżne. Czas pokaże, czy dalsza działalność związku metropolitalnego będzie mogła zostać oceniona pozytywnie, czy też negatywnie.
The subject of the author’s deliberations are the most important problems related to the Act of 9 March 2017 on the Metropolitan Union in the Silesian Voivodship, which entered into force on 7 April 2017. It was indispensable to pass it because on the basis of the previous Act of 9 October 2015 on Metropolitan Unions no union was created. Meanwhile, the Upper Silesian agglomeration is a region inhabited by about two million people, consisting of cities characterized by advanced urbanization processes, functionally connected with each other. The subject matter analyzed here cannot be overestimated. The author of this study concentrates on the fundamental legal issues, although he also refers to the achievements of other fields of science, including to concepts developed by praxeology. The author’s conclusion is that the metropolitan union is clearly different from communal unions regulated by the provisions of the Act on municipal self-government and the Act on poviat self-government. It should be noted, moreover, that the interests of individual territorial self-government units within the metropolitan union are often divergent. Time will tell if the further activity of the metropolitan union can be assessed positively or negatively.

The socio-political changes which began in Poland over three decades ago resulted in, inter alia, the activation of various occupational groups that have decided to operate on the basis of the then existing public law. This meant the creation of corporate selfgovernment organizations that are based on associations of persons with compulsory membership. Ever since the political reforms in Poland have been undertaken, professional self-government has been considered an important element of the state’s administrative system. The basis for creating such institutions was the need to protect certain professions which, in the social interest, required the highest qualifications and impeccable ethics. The professional self-government has significantly strengthened its position by taking over a number of the state’s administrative powers regarding, inter alia, the supervision of certain professions. For several years in Poland there has been a public debate on the future of the professional self-government during which arguments have been raised that question the need for the continued functioning of this type of organizations. Moreover, doubts have been raised as to whether the chambers of professional selfgovernment strengthen democratic aspirations and the development of self-governance, or whether they are anachronistic structures that threaten the consolidation of the free market order in Poland. Therefore, it is not only worth pointing out the essence and the tasks of the institution of the professional self-government, as well as its historical development in the country, but it is of paramount importance to draw attention to the significance of this type of entities in creating democratic state institutions and in accelerating participatory processes.

This paper presents changes that have occurred at the local level in Poland and new German federal states during the process of the post-communist system transformation. The stages of rebuilding the local self-government and its structures are analyzed. The experiences of Poland and Eastern Germany – two states where the system transformation took different courses – were compared. At the same time, both countries have different constitutional orders of the unitary state and federal state, and this context are interesting fields for a comparative analysis. This paper also confronts the two methods of institution building – the importing of well-established institutions and developing them in the evolutionary way, where in both cases path a dependency can be well observed. In Germany this is considered a special case (Sonderfall) of institutional transformation, in which the key role was played by the transference of institutions, personnel and financial means. This was also done much quicker and in a more structured and comprehensive way than in Poland. In the case of Poland, the creation of local self-government structures or shaping the political actors was a grassroots and evolutionary process. This article points out the most important factors that had a crucial significance in the course and results of the transformation and explains different ways of developing the system of democratic local self-government.

The distribution of public revenues is one of the fundamental elements in the shaping of the system of public finance in any country. The process is difficult from both the political and economic points of view. Also the objective conditions make the ideal distribution impossible and any solution results in a greater or lesser fiscal imbalance. An attempt to solve the problems of vertical and horizontal fiscal imbalance and consequences of a greater contribution of territorial self-government tasks and finance leads to complex fiscal relations between the state and the territorial self-government. The aim of this paper is to point out the basic characteristics of the financing system of the local government and the areas of fiscal relations between the national and local government in Poland against the traditional principles of fiscal federalism. Statistical measures of financial independence of territorial self-government entities and their restrictions have also been presented here. The paper ends with conclusions which synthetically present the current problems in fiscal relations in Poland and conclusions de lege ferenda.

Projects and programmes realized in the public sector, including self-government entities, are supposed, above all, to satisfy the needs of the society. From the perspective of self-government entity the objective of the task is a given local or regional community. The vast majority of projects and programmes are realized with the use of debt instruments. Self-government public debt is subject to limitation; therefore, it is important not only to comply with the legally binding limits in terms of incurred debt but also to plan the structure of self-government public debt together with the instalments due for payment in a given period and together with the buyout of debt instruments. The purpose of the following paper is to present the significance of the planning approach in creating stable and balanced local development in the perspective of empirical study, and the current approach towards debt planning by self-government entities (SGE).

The paper attempts to determine the impact of applying new debt limits in the territorial self-governments introduced pursuant to the 2009 Act on Public Finance on the ability of territorial self-government units of the Lower Silesian Voivodeship to incur liabilities. The analyses comprised years 2007-2012. As a result, it was established that for the analysed period the new debt limit would decrease the formal ability of territorial self-government units from the Lower Silesian Voivodeship to incur liabilities. Simultaneously the poorest borrowing ability would be demonstrated by rural poviats (districts) and the highest ability by urban poviats (districts).

Local self-government is considered a manifestation of civil society. This view is justified, among others, by the practice of social life and social teaching of the Catholic Church. This article includes reflections on Catholic social teaching in recognizing local self-government as an important element in building a civil society and promoting civic attitudes. Its authors attempt to indicate the position of Catholic social science regarding this issue, with particu-lar emphasis on the interpretation and contribution of Pope Benedict XVI. The main aim of the article is to reconstruct the teaching of Pope Benedict XVI on local self-government as a manifestation of civil society and to answer the question: “How did Pope Benedict XVI understand the idea of local self-government as a civil society in relation to Catholic social science”. The authors seek answers to this question based on the method of analyzing the sources, which are the encyclicals of Pope Benedict XVI: Deus caritas est (2006) and Caritas in veritate (2009). In addition, the teaching of Pope Benedict XVI in the context of the analyzed issue is completed with the fragment concerning its interpretation in the practice of social life, presented in the first part of the article. It is to show the understanding of this phenomenon in the public sphere and combine it with the understanding functioning in the religious sphere, in order to show that both approaches significantly correspond with each other. The authors argue that Pope Benedict XVI treated local government as an element of disseminating civic attitudes, and thus a factor strengthening civil society.

Przeprowadzone w 1990 r. reformy obejmujące reaktywowanie samorządu terytorialnego stanowiły jeden z najważniejszych elementów przemian ustrojowych w naszym kraju i były one istotnym elementem działań reformatorskich w ramach realizacji trzech głównych celów transformacji ustrojowej po roku 1989: demokracja, wolny rynek, decentralizacja. Postulat przywrócenia samorządu terytorialnego znalazł się w 1981 r. w programie Solidarności i powrócono do niego podczas obrad Okrągłego Stołu w 1989. Wśród zwolenników i propagatorów tej idei w opozycji antykomunistycznej byli przedstawiciele nauki prawa administracyjnego, którzy przewidywali stworzenie całkowicie nowej instytucji, niemieszczącej się w ramach ustroju komunistycznego. Zakładano zatem jednoznaczne odrzucenie starego systemu władz lokalnych. Przeprowadzona w 1990 r. reforma samorządowa stanowiła jednocześnie potężny wstrząs dla nauki ustrojowego prawa administracyjnego, które utraciło swój przedmiot badań w postaci problematyki rad narodowych, traktowanych odtąd wyłącznie w kontekście „negatywnych doświadczeń”. Reaktywowaniu samorządu terytorialnego w 1990 r. towarzyszyły dyskusje i spory wokół koncepcji jego istoty, podstawowych założeń ustrojowych i szczegółowych zasad funkcjonowania. Reforma nie zakończyła się w 1990 r., gdyż prawo samorządowe charakteryzuje się znaczną dynamiką przemian dotyczących konkretnych rozwiązań, co znajduje swój wyraz w licznych nowelizacjach ustaw samorządowych. Kolejnym reformom towarzyszyła działalność ekspertów z zakresu nauki prawa administracyjnego. Jednocześnie odnotować należy znaczny rozwój nauki prawa administracyjnego w zakresie problematyki samorządowej.
The reforms carried out in 1990, which included the reactivation of local self-government, constituted one of the most important elements of the systemic transformation in our country. They were also an important element of the reform measures undertaken to implement the three main goals of the political transformation after 1989: democracy, the free market and decentralization. The postulate of restoring local self-government was included in the Solidarity programme in 1981, and it was the subject of renewed focus during the Round Table talks in 1989. Among the supporters and propagators of this idea in the anti-communist opposition were representatives of the study of administrative law, who envisioned the creation of a completely new institution that would not be indebted to the communist regime. It was therefore assumed that the old system of local authorities had been rejected. The self-government reform carried out in 1990 was at the same time a powerful shock to the study of systemic administrative law, which lost its subject of research, namely the issues of national councils, which from then on were treated only in the context of ‘negative experiences’. The reactivation of the local self-government in 1990 was accompanied by discussions and disputes on the concept of its essence, basic political assumptions and detailed rules of functioning. However, the reform did not come to an end in 1990, as local government law is characterized by a significant dynamic of changes concerning specific solutions, which is reflected in numerous amendments to local government laws. Subsequent reforms were accompanied by the activities of experts in the field of administrative law. At the same time, one should note significant development in the study of administrative law with regard to the consideration of local self-government issues.

The research done in this article defines the theoretical concept of administrative supervision of local self-government; gives an overview of the legislative framework underpining the key administrative supervision bodies of local self-government in the Baltic States; discusses the issue of legal regulation and the present state of administrative supervision over local self-government units in the Baltic States; gives some theoretical and practical suggestions to develop this field in the Baltic States. The research methods employed in preparation of this article are theoretical methods of analysis of scientific literature and sources, legal acts and documents as well as comparative and logical analysis, induction and generalisation. Three Baltic States similar in their area, number of inhabitants, and governmental peculiarities have been chosen for the analysis.

The article contains a draft position of the Sejm relating to the application submitted by a city council to the Constitutional Tribunal. Contested provisions of the Act on Maintaining Cleanliness and Order in Municipalities adopted on 13 September 1996 provide for mandatory tender for the collection and management of municipal waste. Based on detailed analysis, author claim that Article 6d (1) and Article 6e of the contested Act do not violate the constitutional standard of autonomy of local government units and the European Charter of Local Self Government. In this draft position, she proposes to apply for discontinuance of the proceedings for other parts of the claim due to the inadmissibility of a judgment.

Young people are generally recognized and make up a large population of each region. Their active activity is an important element for regional development. This article discusses the development of youth unemployment in the context of selected measures to combat unemployment. The main obje- ctive of the contribution is to present the analysis and evaluation of the various youth employment tools by the state in order to reduce the unemployment rate of young people in the regions. Tools are implemented by the state to reduce the proportion of unemployed young people in self-governing regions. The tools are based on the needs of the regions and provide strategic solutions to long-term unemployment in the individual regions of Slovakia in order to support the creation of new jobs, the provision of labour mobility or the possibility of recruiting young people after graduation.In the con- tribution, we will focus on identifying and evaluating these tools.

Introduction. Cervical cancer is the fourth neoplasm in women with respect to incidence. In Poland, both cervical cancer incidence and corresponding mortality are gradually decreasing. Despite these improvements, the epidemiological situation significantly deviates from European standards. Poland has one of Europe’s lowest five-year survival rates at 54.1% for patients diagnosed in 2000–2002, compared to the European mean value of 62.1%. Objective. The aim of this study is to present health policy programmes related to HPV vaccinations run by local self-government units in 2009–2016. Materials and method. The research is based on analysis of already existing data developed by provincial governors and annual information reviews on health-policy programmes implemented by local self-government units presented to the Ministry of Health. All the programmes that included HPV vaccinations have been subjected to analysis. Results. In 2009–2016, local government units implemented a total of 1,204 health policy programmes that covered HPV vaccinations. Under these programmes, 2.05% of girls aged 10–14 were vaccinated. Percentage-wise, these were communes that contributed the most financially to the HPV vaccination programmes, whereas the counties the least. Conclusions. Local self-government’s programmes covering HPV vaccinations conform with the trends outlined in strategic documents on fighting neoplastic diseases. It is possible that the availability of HPV vaccination was limited for girls living in rural communes. Differences in the number of programmes, number of vaccinated girls and the financial outlays allocated for the implementation of HPV vaccination programmes in particular provinces, may be determined by the epidemiological situation in a given region, measured by the incidence rate of cervical cancer.

The article discusses the organisational issues of self-government organisations of the professions of public trust in Poland, in the context of the implementation of the principle of incompatibilitas, as a sine qua non condition for their proper functioning and due performance of the public tasks entrusted to them. The analysis covers the self-government organisations of advocates, attorneys-at-law, notaries, bailiffs, patent attorneys and tax advisers, taking into account their different structures and the legal basis (statutory law or bye-laws) for the prohibition on the one-handed holding of multiple functions or mandates in the bodies of these professional associations. The study found that the phenomenon of holding multiple functions in the self-government of attorneys-at-law constitutes a problem. The study outlines the cause of this situation and draws conclusions for the law as it should stand, which concern the introduction of a prohibition of accumulating functions to the optimum extent, in line with the solutions applied by the self-government of advocates. The aim of the article is not only to substantiate the necessity of these changes, but also to show how they should be made. This proposal can be implemented by amending the internal rules governing the self-government of attorneys-of-law, which should be treated as intra-corporate normative acts and only ultimately through legislative intervention.
Artykuł dotyczy zagadnień organizacyjnych samorządów prawniczych zawodów zaufania publicznego w kontekście realizacji zasady incompatibilitas jako warunku sine qua non właściwego ich funkcjonowania i rzetelnej realizacji powierzonych im zadań publicznych. Przeprowadzona analiza dotyczy samorządów: adwokatów, radców prawnych, notariuszy, komorników, rzeczników patentowych i doradców podatkowych, z uwzględnieniem ich zróżnicowanej struktury oraz podstaw obowiązywania (ustawa lub/i akty prawa wewnętrznego) zakazu łączenia funkcji lub mandatów w organach tych samorządów zawodowych. W wyniku przeprowadzonych badań ustalono, że zjawisko łączenia funkcji stanowi problem w samorządzie radców prawnych. W opracowaniu przedstawiono przyczynę tego stanu oraz sformułowano wnioski de lege ferenda, które dotyczą wprowadzenia zakazu łączenia funkcji w optymalnym zakresie na wzór rozwiązań obowiązujących w samorządzie adwokackim. Celem artykułu jest nie tylko udowodnienie tezy o konieczności tych zmian, lecz także wskazanie sposobu ich wprowadzenia. Postulat ten można zrealizować poprzez zmianę przepisów wewnętrznie obowiązujących samorządu radców prawnych, które należy traktować jako akty normatywne o charakterze wewnątrzzakładowym, a dopiero ostatecznie w drodze ingerencji ustawodawcy.

When it comes to deciding upon a review model of normative acts regulating the situation of self-government, the Constitutional Tribunal regards the Constitution as the main source of such a model. However, the Constitutional Tribunal also invokes provisions of the European Charter of Local Self-Government as the source of a review model of normative acts that regulate the situation of self-government. The latter, however, is done only to support the rationale of judgments based on the Constitution, thus in the process of a Constitutional Tribunal review of normative acts, the European Charter is an ancillary document. At the same time, it is permissible to exclude the provisions of the European Charter when it is impossible to determine a review model due to the fact that an issue regulated in the European Charter has not been addressed in the Constitution. The significance of this, however, may only become apparent in the future, if certain amendments to the Constitution have been made, resulting in a constitutional omission.
Trybunał Konstytucyjny uznaje Konstytucję za podstawowe źródło wzorców kontroli (konstytucyjne wzorce kontroli) aktów normatywnych (ustaw, przepisów prawa wydawanych przez centralne organy państwowe), stanowiących o sytuacji samorządu terytorialnego. Trybunał przywołuje również postanowienia Europejskiej karty samorządu lokalnego jako źródło wzorców kontroli aktów normatywnych, które regulują sytuację samorządu terytorialnego. Przywoływanie to ma jednak przede wszystkim charakter wspierający argumentację i jej wyniki, które Trybunał wywodzi z Konstytucji. Karta w trybunalskiej kontroli zgodności aktów normatywnych, stanowiących o sytuacji samorządu terytorialnego, pełni tym samym rolę aktu pomocniczego. Trybunał dopuszcza zarazem wyłączność Karty w tej kontroli, jeżeli Konstytucja nie pozwala na ustalenie wzorca kontroli w sytuacji zaniechania przez ustrojodawcę ujęcia w Konstytucji problemu, który został uregulowany w Karcie. Pogląd ten ma jednak znaczenie prospektywne i odnosi się do ewentualnych zmian w Konstytucji, które prowadziłyby do takiego konstytucyjnego zaniechania.

Artykuł dotyczy aktywności samorządów w obszarze komunikacji perswazyjnej. Celem jest określenie zasadności i zgodności z przepisami podejmowanych działań oraz wskazanie na uwarunkowania, którym odpowiadać powinna polityka reklamowa administracji publicznej. Przedstawiono charakterystykę przedsięwzięć promocyjnych realizowanych zarówno bezpośrednio przez gminy lub powiaty, jak i za pośrednictwem nadawców zewnętrznych, a w tym środków masowego przekazu. Zaprezentowano ponadto wyniki badań empirycznych dotyczących technik i narzędzi reklamy jednostek samorządu terytorialnego, ich społecznego zasięgu oraz wysokości nakładów budżetowych przeznaczanych na promocję.
The article concerns the activity of local self-governments in the area of persuasive communication. What it aims at is determining the legitimacy and compliance of the actions taken with the applicable regulations and also at indicating the conditions that should be met by public administration advertising policy. The characteristics of promotional schemes implemented directly by municipalities and communes as well as through external broadcasters, including mass media, was presented. Furthermore, the article presents and discusses the results of empirical research on advertising techniques and tools available to local selfgovernment units, their social outreach and the amount of budgetary expenditure allocated for promotion.

This study examines the role of institutional mechanisms in local government accountability by undertaking a comparative assessment of the Nigerian institutional provisions against the European Charter of Local Self-Government. The specific objectives of the study are to examine the institutional mechanisms for local government accountability in Nigeria, evaluate the Nigerian mechanisms, using the provisions of the European Charter of Local Self-Government and subsequently determine how the effective deployment of institutional mechanisms may enhance the prospects of local government accountability. The study adopts as methodology a comparative analytical framework, under which it uses the provisions of the European Charter of Local Self-Government to evaluate the Nigerian institutional mechanisms. Findings of the study led to a conclusion that for emerging political systems, which Nigeria typifies, institutionalized mechanisms of (political) accountability in the local government system, are truly less effective than the non-institutionalized or informal mechanisms. For the effective deployment of institutional mechanisms to enhance the prospects of local government accountability, the study concludes that a judiciary component of the local structures of governance is an unconditional necessity, as in the absence of such conditions; the incidence at the local level, totally ceases to be describable as government.

The aim of the paper is to verify a thesis according to which countries which are considered to be the most representative examples of implementing the national cultural autonomy concept (Hungary and Serbia) in fact use the construct of national minority self-government, which, according to administrative law commentaries, is classified as non-territorial, or special self-government. In order to fulfill this task two decentralisation solutions which are aimed at pursuing national and ethnic minorities’ ambitions to maintain and enhance their cultural identity: national minority self-governments and national cultural autonomy has been presented. These legal constructs are not equivalent, although in international literature on the subject they are often treated as synonyms. In this context Serbian and Hungarian regulations has been presented and assessed.

The creation of conditions aimed at ensuring the health of the population is a supreme value. Polish legal solutions make it a constitutional obligation of the State and local self-government. The current Constitution of the Republic of Poland of2 April 1997 does not define the limits of this obligation; it only states that the conditions for ensuring everyone’s right to health protection and the scope of health services that are financed from public funds are to be specified by statute. In fact, the system leaves almost complete freedom in this area to the legislator. In the article the solutions adopted by local self-government units in 1991–2018 are evaluated. In order to fulfil certain competences and tasks imposed by law on the commune, poviat and self-governing regional bodies, the legislator has determined two spheres of their activity: (i) implementation of their own tasks in the field of health protection and health promotion, and (ii) establishment and running of entities which before 2011 were termed public health care facilities and after 2011 changed their name into medical entities which are not entrepreneurs. In neither of these spheres of activity is the participation of local government units identical. In the first sphere, the differences result from both the constitutional acts shaping their own tasks in the field of health protection, as well as health programmes which they adopt for their implementation. In the second sphere, however, the differences are a result of statutory solutions that base the model of health care on values that are not uniformly understood. Before 2011, they were conducted and maintained fully, or to a limited extent, from public funds, whereas after 2011 they were maintained from public funds only, when a budgetary unit was selected as an organisational formula of a self-government medical entity. The solutions of the Act of 2011 in its original wording pointed tended to favour commercialisation of the public health sector. The negative side of the solutions adopted is the extraordinary lack of diligence in exercising legislative diligence, especially in the scope of defining the competences and tasks of local self-government units in relation to the medical entities created/ run by these units.

W polityce spójności na plan pierwszy wysuwa się spójność terytorialna, rozumiana jako możliwość współdziałania regionów i układów lokalnych. Przedmiotem oddziaływania staje się w takim ujęciu terytorium. Terytorium rozumiane jako dynamiczny, zmieniający się w czasie i przestrzeni układ różnorodnych powiązań, wykraczający poza istniejące podziały administracyjne.
Much has been written about metropolises. Unfortunately, the problem of the structure of metropolitan areas has yet to be resolved. Therefore, new projects which propose solutions to this problem continually appear. The justification for these works is that the growing needs of residents and their efforts to improve the quality of life have a significant impact on the issue of how best to manage urban areas. In cohesion policy, territorial cohesion comes to the fore, understood as the possibility of cooperation between regions and local systems. In this approach, it is territory that exerts an influence. Territory is thus understood as a dynamic arrangement of various connections, which changes in space and time, and goes beyond the scope of administrative division.

Financing investments is one the most important issues in the policy of local governments. One of the ways of supporting local governments are targeted grants for investments from the state budget. Recent years have been characterized by a change in the policy of financing local governments in this area, which was mainly related to the change of priorities from investment to social policy support. The aim of the article is to present the legal possibilities and actual use of available sources of financing local and regional development by local governments units coming from targeted grants from the state budget of an investment character in the period of 2014-2018.
Finansowanie inwestycji jest jednym z najważniejszych zagadnień w polityce samorządów. Sposobem wsparcia dla samorządów są dotacje celowe z budżetu państwa, mające charakter inwestycyjny. Ostatnie lata charakteryzuje zmiana polityki finansowania samorządów w tym obszarze, co związane było głównie ze zmianą priorytetów z inwestycyjnych na wsparcie polityki socjalnej. Celem artykułu jest przedstawienie prawnych możliwości oraz faktycznego wykorzystania w okresie 2014-2018 dostępnych źródeł finansowania rozwoju lokalnego i regionalnego przez jednostki samorządu terytorialnego, pochodzących z dotacji z budżetu państwa, mających charakter inwestycyjny.

Goal – the goal of the paper is to put into perspective the institutional and legal framework of the decentralization reform in Ukraine, as well as to identify problems, explore trends, and provide proposals in reference to the relevant foreign experience in the field. It argues that the decentralization reform in Ukraine has positive results and is an important step towards increasing the autonomy of local authorities. In concludes with arguing that Ukraine should apply the relevant experience of foreign countries while conducting its decentralization reform. Research methodology – the methods used in the article are analysis of official docu ments coming from the Ministry of finance, the Ministry of Economics and the Tax Service of Ukraine, as well as analysis of the factors that promote the autonomy of local government in Ukraine. Score/results – the article is distinguished by a sufficient level of scientific analysis and has provisions, suggestions and practical recommendations that can be used for further research on decentralization issues. Originality/value – the article presents the original complex approach to the problem of decentralization reform in Ukraine and provides substantial analysis of its legal and institutional framework.

The goal of the paper is to indicate similarities and differences between strategic priorities of socio-economic development on the basis of research conducted in two local communities: Tymbark and Slopnice. The paper is based on a methodological approach called the AHP method, which is used to evaluate the benefits and costs of the basic criteria of socio-economic development and prioritizing models of development. The research indicates key factors of local development in the framework of the endogenous development paradigm. Moreover, the preferred development models have been chosen in the compared communities.

The petition contains a proposal to supplement the subjective catalogue of the lustration act in connection with the entry into force of the Act on the Metropolitan Union in the Śląskie Voivodeship, establishing the authorities forming the organizational structure of the union. The legal nature and scope of tasks of the metropolitan union means that in the doctrine this relationship was called a new institution of a local self-government. Pursuant to the provisions of the lustration act, individuals holding positions in local self-government authorities are subject to the provisions of that act, therefore they should be subject to its obligations. The lack of explicit specification of these individuals in the lustration act raises doubts as to the intentions of the lawgiver. An appropriate amendment to the act would clearly determine the lustration obligation of individuals sitting in the authorities of a metropolitan union.

The municipality, acting in the sphere of dominium, independently decides on the use and manner of use of individual assets. However, the trade in real estate constituting the subject of ownership of this local self-government unit requires compliance with a number of legal regulations, the most significant of which is the Act of August 21, 1997 on Real Estate Management (consolidated text Journal of Laws of 2021 item 1899, as amended). However, none of the provisions of the law refers explicitly to the freedom and limits of shaping by the municipality of the terms and conditions for the disposal of real estate, which in the case of a non-tender route are determined in negotiations conducted with the buyer, while in the case of a tender they are announced in the contract notice. The content established in this manner is then included in the protocol, which forms the basis for the conclusion of the contract, and thus directly affects the shape of the contractual legal relationship. The purpose of the publication will therefore firstly be to set out the legal framework for the municipality’s determination towards the future buyer of the real estate of the specific manner, in which the investment is to be carried out, as well as to answer the question as to the real possibility of the former owner (municipality) co-shaping the investment proces on the sold real estate after the buyer has signed the contract. The importance of the issue under consideration is expressed in the decision as to whether the creation by the municipality of its own lex contractus by means of the terms and conditions for the disposal of the real estate relating to specific deadlines for the commencement and completion of the investment process, the manner of use and development of the real estate, as well as the liability of the new owner towards the previous owner for their violation, is legally effective and can actually be enforced by the municipality.

Skuteczne działania w tym obszarze pozwalają na efektywne komunikowanie z lokalną społecznością, a także są elementem praktycznej realizacji prawa obywateli do informacji. Jak wynika z przeprowadzonych badań, samorządy wojewódzkie w Polsce wykorzystują w swoich działaniach narzędzia polityki informacyjnej o różnym charakterze. Są to zarówno narzędzia, których funkcjonowanie jest wymagane przez przepisy prawa (Biuletyn Informacji Publicznej), media własne samorządów wojewódzkich, jak i działania realizowane w ramach polityki media relations.
The information policy is one of the elements that significantly affect the image and reception of the activities carried out by local government units. Effective activities in this area allow for effective communication with the local community, and are also a part of the practical implementation of citizens' right to information. According to the research, voivodship self-governments in Poland use various information policy tools in their activities. These are both tools, the operation of which is required by law (Public Information Bulletin), own media of voivodship self-governments, as well as the activities implemented under the "media relations" policy.

Cyprus, an island located in the Eastern part of the Mediterranean, in fact, is divided into three states that control some parts of it. This situation stemmed from a serious political conflict that has lasted at least since Cyprus became independent in 1960. The main goal of this paper is to present model of the local self-government, one of the main elements of a democratic state. It discusses the origins of this model, the heritage of Ottoman Empire and the period of British domination, legal aspect of a current situation, its main weaknesses and possible reforms.
Cypr, wyspa położona we wschodniej części basenu Morza Śródziemnego, faktycznie podzielona jest pomiędzy trzy państwa sprawujące jurysdykcję nad jej poszczególnymi częściami. Sytuacja ta jest konsekwencją głębokiego kryzysu politycznego, który trwa od momentu uzyskania przez Cypr niepodległości w 1960 r. Celem artykułu jest zaprezentowanie jednego z istotnych elementów ustroju państwa, jakim jest samorząd lokalny. Omówiono genezę aktualnego modelu, wskazując na elementy dziedzictwa osmańskiego i brytyjskiego, obecny ustrój samorządu, jego główne słabości, a także postulowane kierunki reform.

Artykuł przedstawia kształtowanie konstytucyjnych postanowień dotyczących samorządu terytorialnego i omawia zjawisko rozszerzania zakresu konstytucjonalizacji tego zagadnienia ustrojowego. Wskazuje etapy tego rozszerzania: 1) wprowadzenie do unormowań konstytu-cyjnych zasady udziału samorządu terytorialnego w sprawowaniu władzy (1989), 2) ukształ-towanie konstytucyjnych podstaw dla utworzenia samorządu terytorialnego w postaci wpro-wadzenia do konstytucji rozdziału regulującego samorząd terytorialny (1990), 3) rozszerzenie zakresu konstytucyjnej regulacji materii dotyczącej samorządu terytorialnego o zakres wy-konywanych zadań (październik 1992 r.), 4) uchwalenie obowiązującej konstytucji z 1997 r., której rozdział reguluje konstytucyjne podstawy funkcjonowania samorządu terytorialnego.
The article describes the process of shaping constitutional provisions concerning lo-cal selg-government and presents a phenomenon of increasing constitutionalisaton of this element of state policy. Author indicates four stages of this process: 1) establish-ing a principle of local self-government participation into system of public authority (1989), 2) establishing a constitutional chapter regarding structure of local self-govern-ment (1990), 3) complementing this regulation with provisions concerning self-govern-mental tasks (1992), 4) adopting the Constitution 1997, in which a chapter concerning local self-government.

Cooperation between local government authorities and residents forms the basis for creating optimal living conditions for local communities. The success of such cooperation depends to a large extent on the level of knowledge of residents about the functioning of local government units. Literature studies haveshown that these important issues have been studied to a limited extent. The main purpose of the survey was to assess the level of knowledge of issues related to the budget of local government units by repre-sentatives of the 55+ generation. In addition, check the level of their activity in the work related to the preparation of the budget of the local government unit in their area of residence. The conducted surveys have shown that issues related to the activities of local government units are not foreign to the majority of representatives of the 55+ generation. However, the level of their knowledge on this subject is relatively low. It was also found that the majority of respondents believe that residents should have the opportunity to express their opinion on the budget shape of the local government unit. Unfortunately, these opinions did not coincide with the activity of the respondents in this field.

This article presents reflections on the assumptions, goals and tools used by the district authorities of Podkarpackie Province in their external information policy. The authors have tried to answer the following questions: whether the counties maintain conscious relations with the media, what these relations look like, and also whether the journalists are interested in the issues of self-government (according to local authori-ties). Moreover, the intensity of the use of selected communication tools – standard and non-standard – has been described. The article has also aimed to determine what tools of external communication will be used by the counties in the future. The conclusions presented in the article were based on the results of a survey conducted by the authors with the heads of Podkarpackie counties in the first half of 2012.
