Opis:: Military wireless tactical systems has faced the problem of limited spectrum resources. This is a reason why Cognitive Radio (CR) is one of the most popular topic studied by research institutes in the field of mobile telecommunications. CR technology is based on cognitive cycle, used for making decisions based on observation and orientation. To support this activity, radios need also information on current position, electromagnetic situation, legal issues etc. These functions can be provided by Radio Environment Map (REM) database. It enables more flexible spectrum utilization and coexistence of Primary and Secondary Users (PUs, SUs) without harmful interferences. This paper presents a proposal of REM database structure and graphical user interface (GUI). It also describes GUI implementation in MATLAB and data structure. Database was implemented using the database engine - SQLite. The proposed REM database is a part of cognitive radio network simulator developed in the Institute of Telecommunications.

Opisana metoda może być z powodzeniem zastosowana w wielu dziedzinach nauki i techniki, wymagających dokładnych liczbowych danych o mikropowierzchniach analizowanych elementów. Podano wzory wyrażające zależności pomiędzy współrzędnymi przestrzennymi powierzchni i tłowymi dla podstawowych przypadków wykonania zdjęć, a również zestawiono otrzymane dokładności w zależności od zakresu powiększenia obrazów REM.
The paper presents photogrammetrical way of working up images from electronic microscopes (REM). The method described here can be applied with success in many fields of tcchniqe and science requiring precise numerical data of elements’ microsurfaces. The formulae shown in the paper concern the dependence between surface 3D coordinates and image coordinates for basic cases of images. At the end there is a short list o f accuracies in dependence of blowup scale of REM-images.

Opis:: Narcolepsy is well known disease from many years. Its diagnosis in Poland is rarely in the contrary to western countries or United States where its frequency is estimated from 5 to 10 cases per 10 000 people. Narcolepsy is characterised by excessive and repetitive daytime sleepiness, catalepsy, sleep paralysis and hypnagogic hallucinations. In healthy people the sleep is beginning from non-REM phases, but in the narcoleptic patients is immediately beginning from the REM phase of sleep. The association of narcolepsy with HLA DR2 and recently with HLA DQB1*0602 has been found. In humans, the hypocretin deficiency in the cerebrospinal fluid and a loss of the hypocretin neurons in the brain hypothalamus post mortem has been found. The prostaglandin D2 takes part in the process of sleep, which are synthetised in the human brain by the synthetase of prostaglandins. Many years ago in the treatment of narcolepsy were used amphetamine or ephedrine. Broughton et al. in 1988 year start with modafinil in the treatment of narcolepsy with very good results. Recently were trials of narcolepsy with GABA derivates, for example Xyrem, unfortunately this drug
Narkolepsja jest chorobą znaną od dawna. Częstotliwość jej występowania szacowana jest przez niektórych japońskich autorów na 5-10 przypadków na 10 000 osób. W Polsce jest rozpoznawana znacznie rzadziej. Na obraz kliniczny składają się: wzmożona i powtarzająca się senność, katapleksja, napady czuwania (czyli porażenia przysenne) oraz halucynacje przysenne (czyli omamy hipnagogiczne). Mimo że zapis snu nie należy do obrazu klinicznego, stwierdza się u tych chorych brak fazy snu NREM, a sen zaczyna się u nich od razu od fazy REM. Niedawno wykryto w podwzgórzu neuropeptyd zwany hipokretyną (oreksyną). W narkolepsji ilość produkowanej hipokretyny jest zmniejszona. Neurony hipokretynowe posiadają połączenia neuronalne z środkami zaangażowanymi w stan czuwania, a zatem z układem adrenergicym, serotoninergicznym, dopaminergicznym, histaminergicznym, cholinergicznym i glutaminergicznym. Stwierdzono w procesie zasypiania także udział prostaglandyny, zwłaszcza D2, która powstaje w mózgu dzięki syntazie prostaglandynowej. Uprzednio w leczeniu narkolepsji stosowano leki pobudzające, np. efedrynę czy amfetaminę. Wprowadzenie przez Broughtona i wsp. modafinilu do leczenia narkolepsji okazało się nad wyraz skuteczne. Obecnie są podejmowane próby leczenia przy pomocy pochodnych kwasu GABA; ich skuteczność jest wysoko oceniana, niemniej autorzy zwracają uwagę na możliwie wysoce niepożądane objawy uboczne – jako tzw. pigułka gwałtu. Wzwalczaniu objawów katapleksji niezmiennie dobrą skuteczność wciąż wykazują tzw. trójcykliczne leki przeciwdepresyjne – imipramina, klomipramina czy amitryptylina. Można też zalecać leki z grupy SSRI.

Opis:: The results of application of REM stereophotogrammetric method for determination of spatial coordinates of points of microsurface of loessial soil using their REM images, which were obtained on REM Hitachi S800 with magnification 1000ˣ and 3000ˣ are shown. When magnification (scale) of REM mage is M=1000ˣ, the accuracy of the method is: m_x,y = 0.06÷0.1 mkm, m_z(h) = 0.7÷1.2 mkm and when M=3000ˣ then m_x,y - 0.02÷0.05 mkm, m_z(h) = 0.3÷0.6 mkm. The examples of application of program SURFER for graphical interpretation of microrelief of surface of loessial soils as microplans with contour lines, profile lines and axonometrical projections.
Podano rezultaty zastosowania metody autora - stereofogrametrycznego opracowania obrazów REM- dla otrzymania przestrzennych współrzędnych punktów mikro-powierzchni gruntu lessowego. Wykorzystano obrazy otrzymane za pomocą REM Hitachi S800 o powiększeniach 1000ˣ i 3000ˣ. Przy powiększeniu (skali) REM M=1000ˣ dokładność metody wynosi m_x,y = 0.06÷0.1 mkm, m_z(h) = 0.7÷1.2 mkm, a dla M=3000ˣ - m_x,y - 0.02÷0.05 mkm, m_z(h) = 0.3÷0.6 mkm. W artykule zamieszczono również przykłady zastosowania programu SURFER dla graficznego interpretowania mikro-rzeźby powierzchni gruntu lessowego w postaci mikro-planów z warstwicami, profili i w rzucie aksonometrycznym.

Opis:: The article deals with the automatic method of "sewing together" the superimposed REM-images based on the identification of the boundaries of their particularities. The evaluation of a similarity of the form is fulfilled with the use of Walsh descriptors and is used as a key information with a discernment of conjugate areas. The frequency representation of the boundaries allows to determine parameters of optimum transformation of particularities of one image to another. The procedure of identification of an apart from the factor of a similarity of the form, takes into account orientations coherence of the identified areas. The results of a model experiment confirm the effectiveness of a method application.

Opis:: Based on the BA thesis Urban Spaces of Motion Pictures: Modern Architecture in the Perspective of Audiovisual Studies, this paper explores the links between architecture and cinema. My goal is not only to show some theoretical concepts regarding this topic (including ones by Sergei Eisenstein, Walter Benjamin and Jean Baudrillard), but also, and primarily, to study the actual effect which the cinematic perception has on the fi eld of modern architecture. Therefore, I analyse two projects of Rem Koolhaas (Embassy of the Netherlands in Berlin and ZKM in Karlsruhe) in the perspective of audiovisual studies. In my analyses, I examine such notions as “the narrativity of architecture” and “the architectural media screen”, using some methodological tools borrowed from the field of film studies.

Opis:: The gloss was devoted to the problem of the subjective side of the crime of misappropriation and assessment of criminal law refusal to return the subject of the lease after the expiry of the lease agreement and cessation of payment of the leasing installments. The Court of Appeal in Warsaw took the position that the intention to keep things for themselves under Article 284 § 2 of the Penal Code is evidenced by the fact that the accused did not contact the lessor for more than two years, unlawfully using the car as his own. The author thoroughly analyzes the applicable legal provisions, not only in the field of criminal law, but also civil law, indicating what criteria should be taken into account in assigning the perpetrator of the intention animus rem sibi habendi. Due to the frequency of similar facts to the underlying judgement, it deserves special attention.
Glosa została poświęcona problemowi strony podmiotowej przestępstwa sprzeniewierzenia oraz ocenie prawnokarnej odmowy zwrotu przedmiotu leasingu po wygaśnięciu umowy leasingu i zaprzestaniu płacenia rat leasingowych. Sąd Apelacyjny w Warszawie stanął na stanowisku, że o zamiarze zatrzymania rzeczy dla siebie z art. 284 § 2 Kodeksu karnego świadczy fakt, że oskarżony nie skontaktował się z finansującym przez okres ponad dwóch lat, bezprawnie korzystając z samochodu tak, jak z własnego. Autorka poddała szczegółowej analizie obowiązujące przepisy prawne, z dziedziny nie tylko prawa karnego, lecz także prawa cywilnego, wskazując, jakie kryteria należy wziąć pod uwagę w zakresie przypisania sprawcy zamiaru animus rem sibi habendi. Z uwagi na częstotliwość występowania zbliżonych stanów faktycznych do tego orzeczenia zasługuje ono na szczególną uwagę.

Opis:: The interpretation of “purpose of the performance” within the meaning of Art. 410§ 2 of Polish civil code is one of the most difficult problems of Polish unjustifiedenrichment law. According to the first concept, the purpose of the performanceshould be interpreted narrowly as a counter-performance or other equivalent fromthe recipient’s side, however outside the scope of contracts. Followers of the second,much broader concept, postulate that this notion should refer to any licit future eventor legal effect.Both interpretations can be supported in the sources of Roman law. The mostimportant field of application of the Roman condictio ob rem referred to the Romandoctrine of innominate contracts (contracts which did not create enforceableobligations), where the party who gave his performance afterwards claimed itsrestitution, because the other party did not fulfil his obligation. In that case thepurpose of performance was to receive counter-performance from the recipient.However, there were several typical cases where the purpose was different, especiallyif it did not relate to the behaviour of the recipient. The most important of them weredowry (given on the account of a future marriage) and donation (in contemplation ofdeath). Moreover, some general settlements of Roman jurists supported the idea ofthe wider meaning of purpose of the performance. That can be seen as a clue for thecontemporary interpretation of Art. 410 § 2 of the Polish Civil Code.
Wykładnia „celu świadczenia” w rozumieniu art. 410 § 2 kodeksu cywilnegojest jednym z najtrudniejszych problemów prawnych współczesnej instytucjibezpodstawnego wzbogacenia. Zgodnie z pierwszą koncepcją cel świadczeniapowinien być interpretowany wąsko jako świadczenie wzajemne lub inny ekwiwalentze strony odbiorcy, jednakże uzyskiwany poza zakresem umów. Zwolennicy szerszejinterpretacji podnoszą, że pojęcie to powinno odnosić się do wszelkich dozwolonychprawnie przyszłych zdarzeń lub skutków prawnych. Obie koncepcje znajdująuzasadnienie w źródłach prawa rzymskiego.Najważniejszym obszarem zastosowania rzymskiej condictio ob rem były kontraktynienazwane, tj. umowy, które nie tworzyły egzekwowalnych zobowiązań w ius civile,w których ta strona, która spełniła swoje świadczenie mogła żądać jego zwrotu,jeżeli druga strona nie spełniła uzgodnionego świadczenia wzajemnego. W tymprzypadku celem świadczenia było uzyskanie świadczenia wzajemnego od odbiorcy.Jednakże było kilka typowych przypadków, w których cel świadczenia był inny,w szczególności nie miał związku z zachowaniem odbiorcy. Najważniejsze z nich toświadczenie tytułem posagu na poczet małżeństwa, które miało zostać w przyszłościzawarte i darowizna na wypadek śmierci. Ponadto, niektóre uogólniające wypowiedzirzymskich jurystów wspierały koncepcję szerszego ujęcia celu świadczenia. Stanowito wskazówkę przy wykładni art. 410 § 2 kodeksu cywilnego.

Opis:: Osoby niedosłyszące bardzo często borykają się z problemem nieodpowiednio dobranego aparatu słuchowego. Najczęstszym problemem wśród osób noszących pomoce słuchowe jest niewłaściwe rozumienie mowy w różnych warunkach akustycznych. Obecnie aparaty ustawiane są za pomocą specjalistycznych programów i urządzeń na podstawie subiektywnych odczuć pacjenta. Przedstawiona w niniejszym artykule metoda dopasowania aparatów słuchowych przy użyciu systemu SpeechPro i urządzenia Avant REM Speech+ pozwala na obiektywne dopasowanie aparatu słuchowego każdej osobie niedosłyszącej bez jej czynnego udziału. Wyniki i dyskusja: Urządzenie Avant REM Speech+ całkowicie spełnia swoje zadanie – dopasowuje aparat słuchowy do danego ubytku słuchu bez ingerencji protetyka słuchu oraz subiektywnych odczuć pacjenta. Ustalenie natężenia dźwięku na zewnątrz i wewnątrz ucha pacjenta pozwala protetykowi słuchu dobrać rzeczywiste wzmocnienie niezbędne do danego niedosłuchu. Urządzenie jest bardzo dokładne, zakres błędu wynosi ±/1 dB. Wykres audiogramu oraz charakterystyka dopasowania są zbliżone do siebie, co odpowiada bardzo dokładnemu uzyskaniu skutecznego dopasowania aparatu słuchowego.
Deafness is civilization disease, which affects, not only older people, but also young people and children. The most common problem among hearing aid users is improper speech understanding in various acoustic conditions. The method described in following article is about hearing aid fitting, using SpeechPro and Avant REM Speech+ device allowing objective fitting of hearing aids to any hearing impaired person without active participation. Results and discussion: The Avant REM Speech+ device completely fulfills its purpose – it fits hearing system to the specific hearing loss without intervention of the hearing care professional and the subjective feelings of the patient. The chart of audiogram and fit characteristics are close to each other, which responds to very accurate attainment of effective fit of the hearing instrument.

Opis:: The morphology of G20Mn5 specimens made of non-modified and rare earth metals (REM) modified cast steel was investigated. Molten metal was treated with a cerium-rich mischmetal contain 49.8% Ce, 21.8% La, 17.1% Nd, 5.5% Pr and 5.35% other rare earth metals making up the balance. The melting, quenching (920°C/water) and tempering (720°C/air) were performed under industrial conditions. Analysis included G20Mn5 cast steel fracture specimens subjected to Charpy V-notch impact testing at 20°C, -30°C and -40°C. The purpose of the analysis was to determine the influence of REM on the microstructure and mechanical properties of G20Mn5 cast steel and the REM effect on the morphology, impact strength and character of the fracture surfaces. In addition, a description of the mechanism by which fracture occurred in the two materials was proposed. The author demonstrated the beneficial effects of adding REM to molten steel, manifested by a 20 - 40% increase in impact toughness, depending on test temperature, as compared to the non-modified cast steel. Important findings included more than 100% increase in impact strength in comparison with the required impact toughness of 27J at -40C for heat treated steels (EN 10213).

Opis:: Pewne wyrażenia prawne, znane niegdyś ogólnie, z czasem stają się niezrozumiałe. Ciekawym przykładem tego jest sformułowanie ex iure manum consertum omawiane przez antykwarystę. Aulus Gellius zapytał Sulpiciusa Apollinarisa słynnego wówczas znawcę literatury co oznaczają słowa ex iure manum consertum. Ten w odrzekł mu, że jest znawcą literatury a nie prawa, a tego sformułowania nie ma na kartach Annales. Kiedy jednak Gellius wyrecytował tę frazę z dzieła Enniusa, Supicius Apollinaris skonstatował, że Ennnius zaczerpnął je od jakiegoś jurysty i odesłał Gelliusa do jurystów i ich dzieł. Gellius po zbadaniu sprawy doszedł do wniosku, że, jeśli toczył się spór (in iure) o jakąś rzecz (de re) znajdującą się (in re praesenti) przed pretorem, czy to o grunt, czy o coś innego, trzymając tę rzecz w ręku (in iure manum consererent), dokonywano jej windykacji w uroczystych słowach. Z czasem, po rozszerzeniu granic państwa, pretorzy nadmiernie zajęci w sprawach dotyczących windykacji udawali się niechętnie daleko położonych spornych rzeczy. Zatem, za milczącym przyzwoleniem (tacito consensu), wbrew Ustawie XII Tablic zezwolili, aby toczący spór udawali się na grunt, o który toczył się spór, i przynosili grudkę jakąś z niego, jakby całą ziemię przed pretora na sąd (in ius) i przy pomocy tej grudki (ex iure manum consertum), tak jakby na całym gruncie dokonywali windykacji.
Some legal expressions which once used to be generally known after some time become incomprehensible. An interesting example is the expression ex iure manum consertum, which occurs in Aulus Gellius’ Attic Nights. Aulus Gellius asked the well-known literary expert Sulpicius Apollinaris what it meant. Sulpicius Apollinaris said that he was a connoisseur of literature, not a legal specialist, and that the phrase did not occur in the Annals. But when Gellius told him it was a quote from Ennius, Sulpicius Apollinaris replied that Ennius must have cited it after a jurist, and told Gellius to ask the jurists and look in their works. Gellius conducted a search and eventually reached a conclusion that the expression applied to proceedings before a praetor’s court for the recovery of goods, often real property or some other property, which was to be presented to the praetor by “being brought in the hand” (de re in re praesenti in iure manum consererent). Recovery of the goods in question was then eﬀected in an official proclamation. With time, as the state expanded, praetors were too busy with cases for the recovery of real property and did not want to travel to distant places to inspect the contested goods in situ, so they permitted the parties to the litigation to fetch a lump of earth from the disputed land and present it in court. This was done in contravention of the Law of the Twelve Tables, but with the tacit consent of the parties involved. The lump of earth “lawfully brought to court” represented the whole of the property, which was thereby recovered.

Opis:: This paper presents influence of rare earth metals (REM) on the properties of GP240GH cast carbon steel. The research has been performed on successive industrial melts. Each time ca 2000 kg of liquid metal was modified. The rare earth metals were put into the ladle during tapping of heat melt from the furnace. Because of this the amount of sulphur in the cast steel was decreased and the non-metallic inclusion morphology was significantly changed. It was found that non metallic inclusions the cracking mechanism of Charpy specimens and the impact strength were all changed. The following properties were tested: mechanical properties [...], plastic properties (necking, elongation) and impact strength (SCI). In the three-point bend test the KJC stress intensity factor was evaluated.

Opis:: Współczesna koncepcja świadczenia w zamierzonym celu, który nie został osiągnięty, uregulowana w art. 410 § 2 k.c., ma swe korzenie w rzymskiej condictio ob rem. W niniejszym artykule odnoszę się do jednej z najważniejszych przesłanek konstrukcyjnych tej kondykcji w postaci porozumienia co do podstawy prawnej świadczenia, jego jurydycznego charakteru, treści, funkcji i celu. Porozumienie to nie jest czynnością prawną, nie wynikają zatem z niego roszczenia (zaskarżalne zobowiązania), nawet gdy odnosi się do przyszłego zachowania oczekiwanego od odbiorcy świadczenia. Kondykcja ta nie jest stosowana na gruncie zaskarżalnych zobowiązań umownych. Porozumienie wyznacza cel świadczenia i zarazem przyszłą podstawę prawną świadczenia, która urzeczywistni się, jeżeli cel świadczenia zostanie osiągnięty. Jeżeli cel świadczenia nie zostanie osiągnięty, podlega ono zwrotowi, gdyż nie uzyskało oczekiwanej podstawy prawnej. Porozumienie stanowi podstawę zatrzymania przez odbiorcę uzyskanego świadczenia, dopóki nie okaże się, czy cel świadczenia został osiągnięty. Zbyt wąskie jest często przytaczane w orzecznictwie i doktrynie ujęcie ograniczające cel świadczenia do niewymuszalnego świadczenia wzajemnego oczekiwanego od odbiorcy świadczenia, cel ten może być bowiem dowolnym, przyszłym dozwolonym stanem faktycznym. Cel świadczenia jest odróżniany od motywu, którym kierował się świadczący. Zamiar osiągnięcia celu świadczenia stanowi przy tym przyczynę sprawczą świadczenia, bez której świadczenie nie zostałoby w ogóle spełnione. W przeciwieństwie do motywu świadczenia cel jest zawsze znany odbiorcy świadczenia i przez niego aprobowany co najmniej w sposób dorozumiany.
The roots of the contemporary concept of performance for a specific purpose which has not been achieved, as regulated in Art. 410 § 2 of the Polish Civil Code, go back to the Roman concept of condictio ob rem. In this paper I deal with one of the basic prerequisites of its application, an agreement between the parties concerned as to the legal grounds for performance, its juridical character, contents, function and purpose. This kind of agreement cannot be regarded as a legal transaction, it does not generate claims (enforceable obligations), even if it refers to the conduct expected of the recipient of the given performance. Condictio ob rem cannot be applied in actionable claims on the grounds of a contract. In the condictio ob rem agreement, the parties determine the purpose of the performance and its prospective legal grounds, which will be applicable if and when the purpose of performance is achieved. If the purpose is not achieved, the giver may claim the restitution of his performance, because it has not met the predetermined legal grounds. The condictio ob rem agreement gives the grounds entitling the recipient to retain the performance until such time when it is clear whether or not the purpose has been achieved. The popular view in Polish case law and civil law doctrine that the purpose of condictio ob rem performance may refer only to an unenforceable mutual performance expected of the recipient is too narrow. In fact, the purpose may refer to any future licit event or state of aﬀairs and should be distinguishable from the giver’s motive. The giver’s intention to accomplish the purpose of the performance should constitute the eﬀective cause of his action, without which performance cannot be achieved. Unlike the giver’s motive, the purpose must be known to and approved by the recipient, at least per facta concludentia.

Opis:: This article examines adult learning and sleep habits. It is commonly assumed that learning occurs during the daytime. However, how does a good night’s sleep or shortage of sleep contribute to our learning? Do we learn during sleep? This paper seeks to critically examine previous research into two myths concerning adults: adults cannot learn when they get older, and the second older adults need less sleep. But what can research say about this? What do we know about sleep in the first place? What do we know about adult learning and especially biographical learning? How do sleep patterns/habits influence adult learning? The author discusses these questions below as well as the consequences of a good quality and quantity of sleep for adults’ memory and biographical learning. The author also seeks to identify some guidelines and advice from previous research into better sleep to enhance learning in older age.
Opierając się na badaniach w neurobiologii i teoriach biograficznego uczenia się, artykuł rozpatruje możliwy związek między uczeniem się dorosłych a nawykami dotyczącymi snu. Powszechnie przyjmuje się, że uczenie się ma miejsce w ciągu dnia. Jak dobry sen lub brak snu przyczynia się do naszego uczenia się? Czy uczymy się podczas snu? Niniejszy artykuł ma na celu krytyczne przeanalizowanie wcześniejszych badań nad dwoma mitami dotyczącymi dorosłych: że dorośli nie mogą się uczyć, gdy się starzeją, a drugi, że starsi ludzie potrzebują mniej snu. Ale co mogą na ten temat powiedzieć badania? Co wiemy na temat snu? Co wiemy o uczeniu się dorosłych, a zwłaszcza uczeniu się biograficznym? Jak nawyki senne wpływają na uczenie się dorosłych? Autorka omawia te pytania, jak również konsekwencje dobrej jakości i ilości snu dla pamięci dorosłych oraz uczenia się biograficznego. Stara się również zwrócić uwagę na porady wynikające z poprzednich badań dotyczące jakości snu w celu poprawy warunków uczenia się w starszym wieku.

Opis:: Aim: The aim of the article is to analyze the supervisory measures available to the Polish Financial Supervision Authority in relation to the management board of banks operating in Poland and to indicate whether these measures have a real impact on their functioning and internal structure. On this basis, the proposed changes for the Polish supervision model will be indicated. The article is to be the basis for a discussion on the actual possibilities of supervisory authorities in individual European countries. Design/ Research methods: dogmatic and legal method, reflection on the Polish banking law, Polish and foreign legal literature. Conclusions/findings: The analysis of the indicated subject matter led to the conclusion that the possibility of using measures of an imperative nature is an element included in the concept of the Polish Financial Supervision Authority as a public administration body. Despite the powers vested in it, each time there must always be premises for the supervisory authority to apply certain sanctions to members of the bank’s management board. Therefore, the Polish Financial Supervision Authority is not fully independent. Originality/ value of the article: The article is of value for legislative bodies, it indicates de lege ferenda postulates that should be applied for the Polish Financial Supervision Authority to be independent in the field of supervision over bank management boards. Implications of the research: The changes to the Polish banking law are necessary for the Polish Financial Supervision Authority to be able to exercise actual supervision, especially within the banking segment.

Opis:: The claims are rights in personam but the assignment of claims has a hybrid nature. Abolishing the “nomina ossibus inhaerent” rule has increased commercial significance of the assignment of claims. However, the contemporary legal situationleaves parties with great legal uncertainty, as to the question under which circumstances does the cross - borders assignment is valid. A recent judgment of the CJEU of 9 October 2019 (C - 548/18) in case BGL BNP Paribas SA v. TeamBank AG Nürnberg has augmented this uncertainty. The Luxemburg Court ruled that: “Article 14 of the Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 (‘Rome I’) must be interpreted as not designating, directly or by analogy, the applicable law concerning the third-party effects of the assignment of a claim in the event of multiple assignments of the claim by the same creditor to successive assignees”. In this situation, one would highly welcome an attempt to establish a new set of conflict of laws rules relating to the law applicable to third - parties effects of the assignment of claims. This attempt has recently been made by the European Commission in its Report “on the question of the effectiveness of an assignment or subrogation of a claim against third parties and the priority of the assigned or subrogated claim over the right of another person”, dated 29 September 2016. In the present article, the author reviews the most important propositions formulated in the conflicts’ doctrine through the “lens” of the international insolvency law. Multiply provisions of the Regulation (EU) 2015/848 of 20 May 2015 on insolvency proceedings (recast) - despite many judgments of the CJEU in this area - also lack certainty. Insolvency is a foreseeable risk, but without clear rules concerning the third parties’ effects of the assignment of claims, it may become unenforceable for the creditors of the assignor.

Opis:: Rem Koolhaas wydał „Deliryczny Nowy Jork. Retroaktywny manifest dla Manhattanu” w 1978 roku. Książkę zamyka serią lapidarnych, spekulatywnych projektów będących jego ilustracją. Pierwszy z nich, Miasto Uwięzionego Globu, stanowi wieloznaczną i wciąż na nowo interpretowaną metaforę wielkomiejskości i związanego z nią stylu życia. Odczytany jako synteza „retroaktywnego manifestu”, Uwięziony Glob pozwala zrozumieć ideowe tło urbanistycznej myśli Koolhaasa i jego pracowni OMA. W latach 1995-2007 OMA realizowała projekt nowego centrum miasta Almere koło Amsterdamu. Poprzez trzy wymienione w tytule postulaty Miasta Uwięzionego Globu, autorzy podejmują próbę pogłębionego odczytania założenia w Almere, wychodzącą poza analizę jego cech formalnych.
Rem Koolhaas published Delirious New York: A Retroactive Manifesto for Manhattan in 1978. He closes the book with a series of concise speculative projects to illustrate his point. The first of these, „The City of the Captive Globe”, is an ambiguous and constantly re-interpreted metaphor for metropolitanism and the lifestyle associated with it. Interpreted as a synthesis of the „retroactive manifesto”, Captive Globe allows us to grasp the ideological background of the urban design thought of Koolhaas and OMA, his design studio. Between 1995 and 2007 OMA carried out the project for the new City Center of Almere near Amsterdam. Through the three postulates of the City of the Captive Globe, the authors attempt an in-depth understanding of Almere master plan, going beyond the analysis of its formal features.

Opis:: Evgeniy Vaskovsky always enjoyed well-deserved reputation, in the first place as a specialist in the civil process. His fame as a material civil lawyer and, in particular, as a civil lawyer-educator, somewhat less; even in Russia, the star of his civil-name is eclipsing by other many civil stars, more bright and flashy. The article attempts to at least partially fix this obvious injustice – tell about “The Handbook of Civil Law” by Evgeniy Vaskovsky. Unfortunately, the Handbook was left unfinished: it was limited to only two parties – the General Provisions and the Rights in Rem. Despite this fact, as well as those one hundred thirty years that have passed since its publication, “The Handbook of Civil Law” by Evgeniy Vaskovsky continues to be more than relevant, useful and even instructive piece not only academic, but also scientific as well as practical destination.

Opis:: This paper deals with search, in Polish civil law, for expressions of an actio in rem institution derived from ancient Rome. W. Bojarski pointed out that the actio in rem in Roman law had two meanings, i.e. a complaint in the proceedings and a claim in the substantive law. In ancient Rome it was not possible to make use of one actio (action, complaint) to assert all rights. Actio in rem was the institution of procedural law, an action against thing, for the protection of property. In Polish civil process actio in rem does not exist as a claim (complaint) against things. However, there are some institutions having the features of actio in rem or claims associated with the thing in Polish property law. The main attention was paid to the pledge/lien, mortgage and property claims. The author briefly discussed the definition of actio in rem under Polish law as well as the concept of property rights.
Niniejsze opracowanie traktuje o poszukiwaniu przejawów wywodzącej się ze starożytnego Rzymu instytucji actio in rem w polskim prawie cywilnym. W. Bojarski wskazał, iż actio in rem w prawie rzymskim miała dwa znaczenia – jako skarga w postępowaniu i jako roszczenie w prawie materialnym. W starożytnym Rzymie nie można było za pomocą jednej actio (powództwa, skargi) dochodzić każdego prawa. Actio in rem była instytucją prawa procesowego, powództwem rzeczowym służącym ochronie władztwa nad rzeczami. W polskim procesie cywilnym actio in rem nie występuje jako powództwo (skarga) przeciwko rzeczy, jednakże można znaleźć w prawie rzeczowym materialne instytucje mające cechy actio in rem, czyli roszczenia związane z rzeczą. Główne rozważania dotyczą zastawu, hipoteki oraz roszczeń petytoryjnych i posesoryjnych. Pokrótce omówiono także definicję actio in rem w prawie polskim oraz pojęcie prawa rzeczowego.

Opis:: Artykuł przedstawia stosowaną przez sądy powszechne, a dostrzeżoną przez Sąd Najwyższy, praktykę ustanawiania obrońcy na etapie postępowania in rem, dla osoby jeszcze niebędącej oskarżonym i nieobecnej w postępowaniu karnym, jak również osoby podejrzanej, w celu umożliwienia takiemu obrońcy wzięcia udziału w przesłuchaniu małoletniego pokrzywdzonego w trybie art. 185a Kodeksu postępowania karnego. Polski Kodeks postępowania karnego jako jedną z przesłanek powtórzenia przesłuchania małoletniego pokrzywdzonego przewiduje nieobecność obrońcy w trakcie pierwszego przesłuchania. Autor pochyla się nad opisaną wyżej praktyką w kontekście doktrynalnej konstrukcji obrońcy w polskim prawie karnym procesowym oraz instytucji pełnomocnika osoby niebędącej stroną, a także stara się usytuować ją w kontekście uregulowań międzynarodowych, w tym standardów prawa do ochrony wynikających z dyrektywy Parlamentu Europejskiego i Rady 2013/48/UE oraz wyznaczonych w orzecznictwie Europejskiego Trybunału Praw Człowieka.
The article presents the practice, followed by common courts and noticed by the Supreme Court, of appointing a defence counsel at in rem proceedings for a person who is not yet charged and absent from criminal proceedings as well as for de facto suspect, ordered to allow such a counsel to participate in the interrogation of a minor victim in accordance to Article 185a of the Code of Criminal Procedure. The Polish Code of Criminal Procedure provides for the absence of a defence counsel during the first interrogation as one of the grounds for repeating the interrogation of a minor victim. The author analyses the practice described above in the context of the doctrinal construction of the defence counsel in Polish criminal procedural law, as well as the institution of a non-party’s attorney and also tries to place it in the context of international regulations, including the standards of the right to defence arising from Directive 2013/48/UE and set out in the case law of the European Court of Human Rights.

Opis:: This paper presents the influence of the rare earth metals (REM) modification on mechanical properties and fracture toughness of G17CrMo5-5 cast steel at low temperatures. The REM was in the form of mishmetal. The research has been performed on serial (several) industrial melts. The fracture toughness values of unmodified and modified cast steel at the temperature range from −80°C to 20°C were tested. The reference temperatures of the brittle-to-ductile transition, T_Q, for both unmodified and modified cast steel were determined. The positive influence of the modification by REM on the fracture toughness and the reference temperature T_Q are shown.
Artykuł przedstawia wpływ modyfikacji metalami ziem rzadkich na własności mechaniczne i odporność na pękanie staliwa G17CrMo5-5 w obniżonych temperaturach. Metale ziem rzadkich wprowadzano w postaci mischmetalu. Badania prowadzone były na wytopach przemysłowych. Odporność na pękanie była badana na staliwie niemodyfikowanym i modyfikowanym metalami ziem rzadkich w zakresie temperatur od −80°C do +20°C. Została wyznaczona temperatura przejścia w stan kruchy T_Q dla obu wytopów tj. modyfikowanego i niemodyfikowanego. Przedstawiono pozytywny wpływ modyfikacji na odporność na pękanie oraz temperaturę T_Q.
