    Over the last years, an increase has been observed in taking out from Poland of large amounts of refunded medicines, mainly those that save health and lives of patients, such as insulins, anti-asthmatics, antithrombotic and anti-cancer drugs. The uncontrolled taking out of these medicines has reached the level that cannot be socially acceptable, and that does not allow for providing patients with permanent access to important medical products. Pharmacies, instead of selling drugs to patients, sold them back to pharmaceutical wholesale companies. The latter, in turn, took them out on a massive scale to countries where they are much more expensive. Such a situation was an incentive for NIK to conduct a planned coordinated audit entitled “State Pharmaceutical Inspectorate’s performance of tasks set out in the Act: Pharmaceutical Law”.

    This paper presents issues regarding the administrative and legal aspects of retail trading of the medicinal products. Because one of the most important goods protected by law is health, the regulations included in the branch of administrative law are to serve its protection. Nor can one forget that public authorities must protect public health. The state carries out its tasks, among other things, by introducing restrictions on retail trade of the medicinal products. Such limitations have been inscribed into the essence of the social market economy, which is characterised by parallel economic and social goals. Although all kinds of restrictions on the issue are justified, they are somewhat restrictive.

    A clinical trial is each trial conducted in humans to discover or confirm the clinical, pharmacological, including pharmacodynamic, effects of action of one or more investigational medicinal products, or to identify the adverse reactions to one or more investigational medicinal products, or to monitor absorption, distribution, metabolism and excretion of one or more investigational medicinal products, taking into consideration their safety and efficacy. It ought to be remembered that clinical trials may be conducted with the use of medicinal products. Clinical trials must be conducted in a way which is in line with the primary principle that clinical trial participants’ rights, safety, health, and welfare override the interest of science and society.

    Polish legislation has indicated e-prescription as the preferential way of prescribing drugs, the traditional paper form of prescription is still more common. The Polish Pharmaceutical Law Act defines the information that must be included in a prescription. Pharmacists have noted that a large number of paper prescriptions do not contain all the required information. These shortcomings can be classified as prescription errors. According to international literature, prescription errors can be divided into errors of omission and errors of commission, which require the absolute intervention of a pharmacist. The first error type is the situation in which the document lacks important, required information or it is illegible or unclear. The aim of this study was to examine the type and frequency of problems related to the dispensing of paper-based prescriptions. The study included a detailed analysis of formal prescription deficiencies with respect to the place where the prescription was prescribed and the qualifications of the prescriber. 2044 prescriptions were collected in regard to problems and formal errors. This study provided data on the type and frequency of problems related to the dispensing of paper prescriptions. An higher percentage of not dispensed prescriptions was noted in pharmacies where the majority of prescriptions came from hospital emergency departments. The most common problems were related to the lack of a drug in the pharmacy stock and the legibility of the prescription. It was also noted that the higher the percentage of prescriptions issued by dentists, the greater the number of problem situations.

    In the proposed draft position the author the author finds that Article 94a para. 1 of the Pharmaceutical Law is not compatible with particular provisions of the Constitution. This Article which imposes a complete ban on advertising of pharmacies, interferes with the freedom to create the conditions for business activity. This extensive interference in the freedom of economic activity, manifested in a total ban on advertising of pharmacies, does not meet the proportionality test. In fact, it excludes the possibility of engagement in substantial activity included in the participation in the market, such as advertising and communication of neutral information about their business for customers, as guaranteed by the Constitution.

    The article raises the question of the influence of the EU clinical trials of medicinal products legislation on the Polish criminal law. Although this issue does not fall within the scope of the Article 83 of the Treaty on Functioning of the European Union, its significant importance results from the expected beginning of application of the Regulation No. 536/2014 of the European Parliament and of the Council of 16 April 2014 on clinical trials on medicinal products for human use, and repealing Directive 2001/20/EC. The impact of the EU legislation on member states’ criminal law in the field of clinical trials is based on the principle of pri- macy. Three directions of this impact can be distinguished concerning Regulation No. 536/2014. The first is the exclusion of the unlawfulness of the acts prohibited by the chapter 19 of the Polish Criminal Code within the scope of the prerequisites for the admissibility of clinical trials. The second is the de facto depenalisation of the behaviors described by in Article 126a (1) (3–5) of Pharmaceutical Act. The indicated two effects may take place ex lege with the beginning of application of Regulation No. 536/2014, if there is no change in the Polish law beforehand. The realisation of the third direction depends on the decision of the Polish legislator, who is required to introduce effective, proportionate and dissuasive penalties applicable to infringements of the Regulation No. 536/2014. The type of these measures is left to the discretion of the member states, but the current legal situation combined with the principle of assimilation prompts us to suppose that the choice of criminal penalties will be sustained.

    In recent years, a significant increase in intra-sector competition has been observed in the community pharmacy market. This phenomenon has been intensified by the increase in the concentration of owners and the emergence of so-called pharmacy chains. It was supported by two noticeable market trends: closing pharmacies by entrepreneurs who own individual pharmacies and opening new pharmacies by entrepreneurs who own many entities. Several major factors contributed to the development of this trend: the development of the pharmaceutical market and a large number of new drugs, expansion of cities and villages and the related need to create new pharmacies, caring for health and greater social awareness, aging of the society multiple morbidities. The above tendencies resulted primarily from high price competition mainly in the OTC (over the counter) segment of medicines or other products offered in pharmacies, e.g. cosmetics. As a consequence, the prices of products offered by chain pharmacies were significantly lower than those in individual pharmacies. An attempt to limit competition from the chain pharmacies was to amend the Pharmaceutical Law (the so-called "pharmacy for pharmacists"). The main restrictions introduced in 2017 include: ownership, quantitative and territorial restrictions, whose purpose was to limit the risk of complete market monopolization by large international entities and to reduce the degree of liquidation of small Polish entrepreneurs. The main purpose of the article is to present changes on the public pharmacies market as a result of the introduction of the "pharmacy for pharmacists" act. The article characterizes the community pharmacy market, indicates the factors of pharmacy competitiveness, and describes the legal regulations for the functioning of community pharmacies, together with an indication of the provisions on competitiveness in this market segment. The last part summarizes the impact of legal regulations changes on the structure of the pharmaceutical market.
    W ostatnich latach na rynku aptek otwartych obserwowany był znaczący wzrost konkurencji wewnątrzsektorowej. Zjawisko to nasilone zostało poprzez wzrost koncentracji właścicieli i powstawanie tzw. sieci aptecznych. Próbą ograniczenia konkurencji ze strony sieci aptek było wprowadzenie zmian w ustawie Prawo farmaceutyczne (tzw. „apteka dla aptekarzy”). Głównym celem artykułu jest zaprezentowanie zmian na rynku aptek ogólnodostępnych w wyniku wprowadzenia ustawy „apteka dla aptekarzy”. W artykule dokonano charakterystyki rynku aptek ogólnodostępnych, wskazano na czynniki konkurencyjności aptek, opisano również prawne regulacje funkcjonowania aptek ogólnodostępnych wraz ze wskazaniem na przepisy dotyczące konkurencyjności w tym segmencie rynku. W ostatniej części podsumowano wpływ zmian regulacji prawnych na strukturę rynku farmaceutycznego.

    Suplementy diety, wyroby medyczne oraz inne wyroby parafarmaceutyczne, ze względu na formę ich dystrybucji, miejsca sprzedaży oraz sposób ich promocji, mogą być postrzegane przez pacjentów jako leki. W artykule zostaną zdefiniowane podstawowe pojęcia i wybrane zagadnienia naukowe związane z promocją suplementów diety i leków. Zilustrowane zostaną również różnice między definicjami poszczególnych, istotnych pojęć związanych z promocją suplementów diety i leków w literaturze i przepisach prawnych. Celem autorki będzie określenie różnic i podobieństw w prawnych możliwościach promocji leków i suplementów diety, co może wpływać na postrzeganie leków oraz suplementów diety przez konsumentów. Podobieństwa i różnice zostaną określone na podstawie analizy regulacji prawnych dotyczących promocji leków i suplementów diety. Różnice i podobieństwa w kontekście promocji oraz postrzegania leków i suplementów diety mogą być ważne w kontekście społecznym. Efekty tej promocji mogą mieć wpływ na racjonalne gospodarowanie domowym budżetem oraz na zdrowie, a nawet życie ludzi. Z literatury wynika jednak, że sposób ich promocji, podział na dawki, opakowanie i sprzedaż, nie ułatwiają pacjentowi weryfikacji, jakiego rodzaju produkt kupuje – czy jest to lek, suplement diety, wyrób medyczny, a może jeszcze inny parafarmaceutyk. Dlatego te produkty mogą być często mylone.
    Dietary supplements, medical devices and other parapharmaceutical products, due to the form of their distribution, places of sale and the method of their promotion, may be perceived by patients as drugs. The article will define the basic concepts and selected scientific issues related to the promotion of dietary supplements and drugs. The differences between the definitions of individual, important concepts related to the promotion of dietary supplements and drugs in the literature and legal regulations will also be illustrated. The aim of the article will be to identify the differences and similarities in the legal possibilities of promoting drugs and dietary supplements, which may affect the perception of drugs and dietary supplements by consumers. The similarities and differences will be determined on the basis of an analysis of legal regulations and a review of the literature on the promotion of drugs and dietary supplements. Differences and similarities in the context of promotion and perception of drugs and dietary supplements may be important in a social context. The effects of this promotion may have an impact on the rational management of the household budget as well as on the health and even life of people. However, the literature shows that the method of their promotion, division into doses, packaging and sale does not make it easier for the patient to verify what type of product he is buying – whether it is a medicine, dietary supplement, medical device, or perhaps another parapharmaceutical. Therefore, these products can often be confused.

    Funkcjonowanie rynku aptekarskiego w Polsce podlega ścisłej regulacji ustawowej. Dążąc do podwyższenia jakości świadczenia usług farmaceutycznych, w 2017 roku ustawodawca dokonał istotnych zmian w przedmiocie zasad podejmowania działalności aptekarskiej obejmujących m.in. ograniczenie form działalności gospodarczej właściwych dla podejmowania działalności aptekarskiej, wprowadzenie współczynników demograficznego i geograficznego, warunkujących udzielenie zezwolenia na prowadzenie apteki oraz ograniczenie zakresu podmiotowego adresatów zezwolenia do farmaceutów posiadających prawo do wykonywania zawodu. Przedmiotem niniejszego artykułu uczyniono ocenę podstawowych zmian Prawa farmaceutycznego w ujęciu perspektyw rynku aptekarskiego ze szczególnym uwzględnieniem ich wpływu na pozycję farmaceuty jako przedsiębiorcy oraz autonomicznego właściciela apteki jako przedsiębiorstwa.
    The functioning of the pharmacy market in Poland is subject to strict statutory regulation. Aiming at increasing the quality of provision of pharmaceutical services, in 2017 the legislator made significant changes to the subject of the principles of undertaking pharmacy activities, including limiting the forms of economic activity appropriate for undertaking pharmacy activities, introducing demographic and geographical factors conditioning the granting of a permit to operate a pharmacy and reducing the scope of the recipients permitted to hold this permit only to pharmacists with the right to practice. The subject of this article was to estimate the fundamental changes in pharmaceutical law in terms of the perspectives of the pharmacy market; with particular emphasis on their impact on the position of a pharmacist as an entrepreneur and the autonomous owner of the pharmacy as an enterprise.

    The functioning of the pharmacy market in Poland is subject to strict statutory regulation. In striving to ensure the widest availability of services provided by generally accessible pharmacies to patients, the legislator introduced a solution consisting in granting county (‘powiat’) councils the power to issue local acts of law regarding the establishment of working hours of generally accessible pharmacies locally. Compliance with this obligation, however, faces various difficulties on the part of both pharmacies and self-government bodies, which negatively affects the effectiveness of the existing solution. The subject of this article is the assessment of existing legal solutions in the discussed area, together with a review of the proposed statutory changes developed by pharmacies self-government and the Association of Polish Counties (‘powiat’).
    Funkcjonowanie rynku aptekarskiego w Polsce podlega ścisłej regulacji ustawowej. Dążąc do zapewnienia jak najszerszej dostępności usług świadczonych przez apteki ogólnodostępne dla pacjentów, ustawodawca wprowadził rozwiązanie polegające na przyznaniu radom powiatów uprawnienia do wydawania aktów prawa miejscowego w przedmiocie ustalenia rozkładów godzin pracy aptek ogólnodostępnych na obszarze powiatów. Wypełnianie tego obowiązku napotyka jednak różne trudności ze strony zarówno aptek, jak i organów samorządu, co wpływa negatywnie na efektywność rozwiązania. Przedmiotem artykułu jest ocena istniejących rozwiązań prawnych w omawianym zakresie i omówienie proponowanych zmian ustawowych opracowanych przez samorząd aptekarski i Związek Powiatów Polskich.

    Z obrotem detalicznym produktami leczniczymi wiąże się wystąpienie niebezpieczeństwa zagrożenia zdrowia i życia pacjentów, dlatego obrót ten podlega rozbudowanym ograniczeniom ustawowym, począwszy od pozwolenia na dopuszczenie produktu leczniczego do obrotu, wymagań jakościowych stawianych produktom leczniczym, nazwy i opakowania produktu leczniczego, a skończywszy na aptekach, czyli przedsiębiorcach uprawnionych do uczestniczenia w obrocie detalicznym produktami leczniczymi, katalogu czynności składających się na obrót detaliczny, czy tzw. kierunek obrotu detalicznego. Przywołane przykładowo ustawowe ograniczenia dotyczące detalicznego obrotu produktami leczniczymi wywołują istotne problemy interpretacyjne. Niezależnie od nich powstaje inne kluczowe pytanie, mianowicie jak daleko sięgają te ustawowe ograniczenia, czy określają one jedynie zasady i tryb dopuszczania do obrotu produktów leczniczych oraz warunki obrotu produktami leczniczymi, czy tworzą także podstawy prawne, na podstawie których obrót produktami leczniczymi dokonuje się między apteką a pacjentem.
    The retail trade in medicinal products is associated with the risk of a threat to the health and life of patients, therefore this trade is subject to extensive statutory restrictions, ranging from the authorization of the medicinal product to the market, quality requirements for medicinal products, name and packaging of the medicinal product, and ending with pharmacies, i.e. entrepreneurs entitled to participate in retail trade in medicinal products, the catalogue of activities that make up the retail trade, or the so-called the direction of retail trade. The above-mentioned statutory restrictions on retail trade in medicinal products raise significant problems of interpretation. Regardless of them, another key question arises, namely, how far do these statutory restrictions go, do they only define the rules and procedure for authorizing medicinal products to be marketed and the conditions for trading in medicinal products, or also create the legal basis on which medicinal products are traded between pharmacies and the patient.

    Celem artykułu jest nakreślenie obszaru badawczego w ramach socjologii medycyny, który socjologowie brytyjscy nazwali socjologią farmaceutyków. Zawierają się w niej: 1) procesy medykalizacji i farmaceutykalizacji, 2) społeczny kontekst tworzenia regulacji dotyczących leków, 3) praktyki marketingowe przemysłu farmaceutycznego, 4) oczekiwania społeczne dotyczące innowacji farmaceutycznych, 5) konsumpcja leków. W artykule omówiono powstanie i rozwój socjologii farmaceutyków oraz dokonano przeglądu badań mieszczących się w tym obszarze. Przedstawiono także argumenty dowodzące użyteczności terminu „socjologia farmaceutyków” w badaniach nad społecznymi konsekwencjami korzystania z leków oraz procesem farmaceutykalizacji.
    The aim of the article is to outline the subfield within the sociology of medicine which British sociologists called the sociology of pharmaceuticals. It contains: 1) the processes of medication and pharmaceuticalisation, 2) the social context of drug regulation, 3) marketing practices of the pharmaceutical industry, 4) social expectations regarding pharmaceutical innovations, and 5) drug consumption. The article will discuss the emergence and development of the sociology of pharmaceuticals, and a review of research in this area will be made. Finally, arguments will be presented showing the usefulness of the term sociology of pharmaceuticals in research on the social consequences of drug use and the process of pharmaceuticalisation.

    The paper considers a particular case of onomastic motivation, providing examples of the use of the adjective tani ‘cheap’ in the creation of pharmacy names in Poland (e.g. Tanie Leki ‘cheap medicines’, Tania Apteka ‘cheap pharmacy’). This Polish word is frequently used in marketing, both as an element of company names and marketing slogans. In many instances tani constitutes part of a complex pharmacy name, e.g.: Całotygodniowa Apteka Familijna — Tylko Tanie Leki, Super Tania Apteka im. Zawiszy Czarnego, Centrum Tanich Leków — Apteka św. Barbary. On the basis of judgments from Polish administrative courts, the article discusses the question of the distinction or lack of one between advertisements and proper names. The significant fact is that the Pharmaceutical Law has prohibited the advertising of the operations of pharmacies since 2012 and, as a result, the use of names with the component tani was found to be in violation of the provision. In response to this, the owners of stores have argued that the proper name refers to the object alone, having no literal meaning. The controversial phrases were used to create legal names which are placed on signboards and in announcements. The paper focuses on a more general problem: chrematonyms and appellative lexis can hardly be distinguished due to their persuasive and marketing value.

    Celem niniejszego artykułu jest przedstawienie sposobu kształtowania się reakcji karnych na naruszenie zakazu dystrybucji leków w innym kierunku niż do pacjenta, a następnie dokonanie oceny regulacji penalizujących powyższe zachowania. Zasadniczym celem rozważań jest próba odpowiedzi na pytanie, czy ustawodawca, posługując się instrumentami karnymi, wystarczająco zabezpieczył prawidłowy obrót produktami leczniczymi, czy może zbyt późne lub nieudolne określenie ustawowego opisu czynu zabronionego przesądziło o braku możliwości pociągnięcia do odpowiedzialności karnej i zastosowania odpowiedniej reakcji karnej wobec sprawców działających w ramach tzw. mafii lekowej.
    The purpose of this article is to present the way in which criminal reactions to the violation of the prohibition on distributing medicines in a direction other than to the patient are shaped, and then to assess the regulations penalizing the above behavior. The main objective of the considerations is an attempt to answer the question whether the legislator, using penal instruments, sufficiently secured the proper trade in medicinal products, or maybe too late or inept definition of the statutory description of a prohibited act determined the lack of possibility to bring criminal responsibility and to apply an adequate criminal response to perpetrators acting within the so-called drug mafia.

    Reports by institutions monitoring this market show that of over PLN 7 billion spent annually in Poland on advertising, almost half is spent on advertising OTC medicines, medical devices and dietary supplements (Instytut Monitorowania Mediów, 2019). Considering this, and taking into account legal regulations that significantly limit promotion at the point of sale (Art. 93 of the Pharmaceutical Law Act), advertising seems to be the most important tool for stimulating demand for over-the-counter products as well as one a basic source of of the residents of Poland on ailments, their treatment and prevention. The study examined 71 advertisements, including 47 ads for medicines, 10 for medical devices, 12 for dietary supplements and 1 ad for food for special medical purposes. Among the sample, 27% ads contained manipulation in the marketing message. The current tools of market control institutions enable the analysis of explicit claims but not implied messages in advertising. Our analysis shows that this is not enough to protect patients and other market participants from misleading or false advertising. It is absolutely necessary to enhance the control over the advertising of medicines, dietary supplements and medical devices by analysing the implications contained in the advertisements.
    Analizy instytucji monitorujących ten rynek wykazują, że z ponad 7 miliardów złotych rocznie wydawanych w Polsce na reklamę, blisko połowa przypada na reklamę leków OTC, wyrobów medycznych i suplementów diety. W związku z tym oraz regulacją prawną znacznie ograniczającą promocję w miejscu sprzedaży (Art. 93 Ustawy Prawo farmaceutyczne) reklama produktów farmaceutycznych wydaje się najważniejszym instrumentem pobudzania popytu na produkty dostępne w aptekach bez recepty oraz podstawowym źródłem wiedzy mieszkańców Polski na temat dolegliwości i ich leczenia oraz profilaktyki. Badaniu poddano 71 badanych reklam: 47 z nich to reklamy leków, 10 – wyrobów medycznych, 12 – suplementów diety i 1 żywności specjalnego przeznaczenia medycznego, aż w 27% stwierdzono manipulację przekazem marketingowym. Obecne narzędzia instytucji kontroli rynku umożliwiają analizę treści eksplikowanych, ale nie implikowanych przez reklamę. Przeprowadzona analiza wykazuje, że nie wystarcza to, aby zabezpieczyć pacjentów i innych uczestników rynku przed nieuczciwą reklamą. Bezwzględnie konieczne jest uzupełnienie nadzoru nad reklamami leków, suplementów diety oraz wyrobów medycznych o analizę imlikatur zawartych w reklamach.

    In this article the author analyses the most important issues arising from the interaction between intellectual property law, competition law and the damages law. For almost ten years, the European Commission has been monitoring the various market practices used by participants in this market, which may result in infringement of competition law. In particular, there are some doubts about reverse payment patent settlements aimed at delaying the introduction of generic medicines to the market, as well as other practices intended to disrupt the normal operation of the pharmaceutical market. The analysis of different practices in the pharmaceutical sector (in addition to the aforementioned settlements, they may involve various patent strategies, such as the creation of patent thickets) may bring us to the conclusion that such behaviour can be seen as a form of abuse of patent rights, but also the abuse of a dominant position (or other forms of restraints to competition), simultaneously raising questions about the consequences in the field of law of damages. As such market practices show, they can also influence the position of consumers and others interested in lowering the price of generic drugs (as substitutes for original drugs that can be marketed after the original drug’s patent protection expires) but also affect the health policy of the state. Except the consumer, who is the “last link” of the generic supply chain, the economic interest of the public or private co-financiers of patients’ access to medicines should also be taken into account. In Poland, commercialization of generic drugs undoubtedly remains in the interest of the National Health Fund and the state budget. The author discusses different legal instruments which aim to delay introduction of generic drugs to the market and indicates their legal consequences.
    Celem niniejszego opracowania jest przybliżenie najistotniejszych zagadnień powstających na styku prawa własności intelektualnej, prawa konkurencji i prawa odszkodowawczego. Od niemal dziesięciu lat Komisja Europejska monitoruje rozmaite praktyki rynkowe stosowane przez uczestników tego rynku, których skutkiem może być naruszenie prawa konkurencji. W szczególności pewne wątpliwości budzą ugody patentowe o odwróconej płatności, których celem jest opóźnienie wprowadzenia na rynek leków generycznych, a także inne praktyki, prowadzące do zakłócenia normalnego funkcjonowania rynku farmaceutycznego. Analizowane w artykule zachowania (oprócz wspomnianych ugód może chodzić o rozmaite strategie patentowe, jak tworzenie gąszczy patentów) mogą być jedną z form nadużywania patentu, ale i pozycji dominującej, rodząc jednocześnie pytania o konsekwencje natury odszkodowawczej. Jak się bowiem okazuje tego typu praktyki rynkowe mogą także wpływać na pozycję konsumentów oraz innych podmiotów, zainteresowanych niższą ceną leku generycznego (substytutu leku oryginalnego, który może być wprowadzony do obrotu po upływie ochrony patentowej leku oryginalnego), ale także wpływać na politykę zdrowotną państwa. Oprócz konsumenta, stanowiącego „ostatnie ogniwo” łańcucha nabywców generyków, na względzie należy mieć także interes ekonomiczny podmiotu publicznego czy prywatnego współfinansującego dostęp do leków przez pacjentów. W Polsce wprowadzenie na rynek generyków niewątpliwie pozostaje w interesie Narodowego Funduszu Zdrowia i budżetu państwa, jako podmiotów istotnych z punktu widzenia refundacji. Autorka analizuje różne instrumenty prawne mające na celu opóźnienie wprowadzenia na rynek leków generycznych, wskazując na ich konsekwencje prawne.

    Celem artykułu jest przedstawienie czym są leki cyfrowe, czy mogą one stanowić zagrożenie dla bezpieczeństwa danych osobowych oraz – jeśli – w jakich kontekstach mogą być te dane legalnie wykorzystane. Przeprowadzona zostaławielowątkowa analiza prawna, uwzględniająca przepisy dotyczące m.in. ochrony danych osobowych, świadczenia usług drogą elektroniczną, prywatności, świadczenia usług zdrowotnych przez lekarza oraz hospitalizacji psychiatrycznej. Rozważania mają charakter prospektywny, ponieważ leki cyfrowe do tej pory nie znajdowały się i nie znajdują ani na europejskim, ani na polskim rynku farmaceutycznym.
    The aim of the paper is to present what digital drugs are, whether they can pose a threat to the security of personal data and – if – in what contexts these data may be legally used. A multi-layered legal analysis was carried out, includingprovisions regarding: personal data protection, electronic provision of services, privacy, provision of health services by a doctor and psychiatric hospitalization. The considerations are prospective because digital drugs have not been found onthe European or Polish pharmaceutical market so far.

    The below article is a review regarding sociological and factual context of the implementation of Falsified Medicine Directive with a particular focus on Poland. In order to clarify the subject, a brief description of the phenomenon of falsified and counterfeit medicines, including an attempt at definition and disambiguation of those terms, is given. Further, the authors briefly describe the circumstances and effects of the implementation of the said directive in Poland. This includes outline of the solutions required and forced by the European and Polish law (serialization, anti-tempering devices, and personnel training) as well as practical information (and scientific background) on how provisions of the Directive are fulfilled in the setting of Polish community pharmacies and medicine wholesalers and which agents are responsible for the process of integration of the Directive into Polish law and reality. The presentation of the prevalence and extent of the phenomenon of falsified and counterfeit medicines in Poland and around the world includes mention of the most notable cases in the field along with research conducted and countermeasures undertook to tackle the issue. The part dedicated to review of the sociological context gives overview of the most notable of the very few research published in the field, both by Polish and foreign authors. Referenced articles describe awareness of the issue of counterfeit medicines among medical professionals and the general public. Investigated studies are immersed almost solely in the quantitative approach (authorial questionnaire used in cross-sectional studies) with a limited number of studies based on a qualitative approach, which constitutes an important gap in current knowledge. The authors conclude that counterfeit medicines pose an ever-growing threat to public health on both local and global level, that international cooperation and legislature dedicated to unification of laws aimed at counterfeit medicines, as exemplified by the said Directive, is an effective approach to the issue and that the current state of research does not allow for full understanding of patients’ perspective on the topic falsified medicines.
    Poniższy artykuł przeglądowy ma na celu przybliżenie okoliczności oraz przebiegu wdrożenia tzw. Dyrektywy „fałszywkowej” (Dyrektywy 2011/62/EU Parlamentu Europejskiego i Rady Europy z dn. 8.06.2011). Autorzy podejmują w nim próbę definicji i ujednolicenia centralnego dla tego aktu pojęcia: „lek sfałszowany” (ang. falsfied medicine/ counterfeit medicines) by następnie dokonać opisu procesu implementacji ww. Dyrektywy w polskich realiach. Nowe ramy prawne w istotny sposób zmieniły łańcuch dystrybucji produktami leczniczymi, w tym nałożyły nowe obowiązki na pracowników aptek ogólnodostępnych i szpitalnych. Zatem, w kolejnych akapitach zostają opisane rozwiązania zastosowane na poziomie aptek ogólnodostępnych oraz hurtowni leków mające na celu wypełnienia zapisów dyrektywy (m.in. serializacja, anti-tempering devices) wraz z krótkim komentarzem na temat ich walidacji oraz uzasadnienia dla ich stosowania. Kontekst społeczno-historyczny oraz rozpowszechnienie zjawiska leków sfałszowanych zostaje opisany w trzech częściach – opis skali zjawiska i ważniejszych przykładów w Polsce, opis skali zjawiska wraz z odniesieniami do najważniejszych opisów przypadków na świecie, oraz kontekstu socjologicznego z krótkim przeglądem dorobku naukowego poświęconego temu zjawisku, w większości badań opartych na podejściu ilościowym. Autorzy konkludują, że zjawisko sfałszowanych produktów leczniczych jest ważnym wyzwaniem dla zdrowia publicznego, zarówno na poziomie lokalnym jak i światowym i że międzynarodowe wysiłki legislacyjne, takie jak ww. Dyrektywa są efektywnym sposobem na walkę z nim.Weryfikacja autentyczności produktów leczniczych wpisuje się w rolę apteki jako placówki ochrony zdrowia publicznego, a sama czynność serializacji może być wpisana do szeroko rozumianego katalogu usług zwanych opieką farmaceutyczną. Co więcej, zwracają oni uwagę na niewielką ilość dostępnych opracowań naukowych i potrzebę przeprowadzania badań jakościowych celem dogłębnego zrozumienia istoty zjawiska.

    Konsument podejmuje rozważne i świadome decyzje odnośnie do zachowań rynkowych, tylko jeżeli dysponuje dostateczną wiedzą o przedmiocie ewentualnej transakcji. Ma to szczególnie istotne znaczenie w sytuacji, gdy dokonuje wyborów związanych z jego zdrowiem. Do takich należy rozstrzygnięcie o tym, czy daną potrzebę zaspokoi produkt leczniczy, suplement diety, kosmetyk, wyrób medyczny lub inny artykuł. Mechanizmy ich oddziaływania na organizm człowieka różnią się znacząco. Świadomość nabywców co do statusu prawnego poszczególnych preparatów powinna więc być jak najwyższa. W niniejszym artykule zaprezentowano wyniki dogmatycznej, porównawczej, aksjologicznej i socjologicznej analizy polskiego i unijnego prawa w kontekście zapewnienia przejrzystości rynku produktów z pogranicza, zagrożonej przez praktykę podwójnej rejestracji towarów podobnych zwłaszcza do produktów leczniczych, z uwzględnieniem interesów profesjonalnych uczestników obrotu. Obowiązujące regulacje polskiego prawa krajowego i prawa wtórnego Unii Europejskiej mające przeciwdziałać przedmiotowej praktyce mają wiele niedoskonałości. Ponadto część innych rozwiązań normatywnych umożliwia dokonywanie podwójnej rejestracji produktów z pogranicza. Warto więc sformułować postulaty de lege ferenda, których spełnienie może przyczynić się do zwiększenia transparentności rynku produktów z pogranicza.  
    Consumers make prudent and informed decisions regarding market behaviour only if they have sufficient knowledge of the subjects of the transactions. This is particularly important in situations where they make choices related to his or her health. These include deciding whether a medicinal product, dietary supplement, cosmetic, medical device or other article meets their needs. The mechanisms of their impact on the human body differ significantly. Therefore, consumers’ awareness of the legal status of individual preparations should be as high as possible. This article presents dogmatic, comparative, axiological and sociological analyses of Polish and EU law in the context of ensuring the transparency of the borderline products market, endangered by the practice of double registration of goods similar to medicinal products, taking into account the interests of professional market participants. Binding provisions of Polish national law and secondary EU law aimed at counteracting the discussed practice are imperfect. In addition, some normative solutions enable the double registration of borderline products. It is therefore worth formulating the de lege ferenda postulate, the fulfilment of which may contribute to the transparency of the borderline products market.

    Autor przedstawia europejskie regulacje prawne, które mają zwiększyć dostępność produktów leczniczych poprzez zwiększenie ochrony patentowej oraz wsparcie finansowe i organizacyjne badań nad nowymi produktami leczniczymi. Braki na rynku tych produktów powodują, że dopuszczone do obrotu leki są stosowane poza zakresem dopuszczenia, co określa się pojęciem off label use. Artykuł objaśnia zakres tego pojęcia. Sygnalizuje ponadto przyczyny, skalę zjawiska stosowania leków poza zakresem dopuszczenia do obrotu oraz ryzyka dla zdrowia pacjenta. Autor przekonuje, że praktyka off label występuje nie tylko w pediatrii i leczeniu chorób sierocych. Prawodawca europejski ustanowił jednak system zachęt do badań klinicznych nad lekami na rzadkie schorzenia oraz lekami stosowanymi u dzieci. Ocena tych regulacji wypada pozytywnie. Są one jednak niewystarczające z uwagi na skalę zjawiska oraz ryzyka, na jakie narażeni są pacjenci.
    The author presents European regulations, which are to increase the availability of medicinal products by increasing patent protection as well as financial and organizational support for research into new medicinal products. Shortages of medicinal products cause authorized medicines to be used outside the scope of their authorization, which is defined as the concept of their off label use. The article clarifies the scope of this concept. It also brings up the causes, the scale and the risks to the patients’ health related to the phenomenon of the use of drugs outside the scope of their authorization. The author argues that the practice of the off label use of drugs occurs not only in paediatrics and the treatment of orphan diseases. The European legislator has established, however, a system of incentives for clinical trials on drugs for rare diseases and drugs for paediatric use. The evaluation and outcome of these regulations is positive. However, they are insufficient, given the scale of the phenomenon andthe risks to which patients are exposed.

Autor szczegółowo analizuje przepisy prawa farmaceutycznego oraz rozporządzenie Ministra Zdrowia w sprawie wysyłkowej sprzedaży produktów leczniczych, pod kątem znalezienia odpowiedzi na przyczynę małego zainteresowania środowiska aptekarskiego dalszym rozwojem omawianej formy sprzedaży leków. Przedmiotem zainteresowania autora jest także analiza przepisów regulujących wysyłkową sprzedaż leków pod kątem zapewnienia bezpieczeństwa pacjentów.
    The subject matter of this article concerns the question of distance selling of medicinal products considered from the perspective of national legislation. The author analyzes in detail the provisions of the Polish Pharmaceutical Law and the Ordinance of the Minister of Health of 26 March 2015 on mail-order sales of medicinal products in order to find the answer to the question why pharmacists show little interest in further developing this distribution channel for medicine. The author focuses also on the analysis of the provisions governing mail-order sales of medicines in terms of ensuring patient safety.

    Zasady prowadzenia badań klinicznych, postępowania w sprawie dopuszczenia do obrotu, wytwarzania, importu, reklamy i obrotu weterynaryjnymi produktami leczniczymi często stanowią drugorzędny przedmiot zainteresowania przedstawicieli doktryny prawa farmaceutycznego. Trudno to krytykować ze względu na priorytetowe znaczenie ochrony życia i zdrowia pacjentów oraz znaczne podobieństwo stosownych unormowań do przepisów regulujących funkcjonowanie rynku leków przeznaczonych dla ludzi. Problematyki owej nie należy jednak pomijać. Medykamenty stosowane w weterynarii mogą zagrażać nie tylko zwierzętom, ale i aplikujących je osobom, konsumentom żywności pochodzenia zwierzęcego oraz środowisku naturalnemu. Celem artykułu jest zbadanie wybranej materii w tym kontekście z uwzględnieniem postulatu zwięzłości tekstu prawnego. Wykorzystano w związku z tym metody: dogmatyczną, aksjologiczną i prawno-porównawczą.
    The principles of conducting clinical trials, the marketing authorization procedure, manufacturing, importing, advertising and marketing of veterinary medicinal products are often secondary subjects of interest of pharmaceutical law doctrine’s representatives. It is difficult to criticize it, because of the priority importance of patients’ protection and the significant similarity of relevant regulations to regulations governing the functioning of the market of medicines for people. However, this problem should not be ignored. Medicines used in veterinary medicine may pose a threat not only to animals, but also to people applying them, consumers of food of animal origin and the environment. The aim of the article is to research mentioned matter in this context, taking into account the requirement of conciseness of the legal text. The following methods were used: dogmatic, axiological and comparative.

    SummaryThe Supreme Administrative Court judgement which is glossed in this article concerns reimbursement due to a patient for medications not normally available in Poland on a reimbursed prescription but admitted in special cases as an individual (targeted) import on the grounds of a central permit. In this judgement the Court ruled that contrary to the literal interpretation of Art. 39 of the Reimbursement for Medications, Special-Purpose Foodstuffs, and Medical Products of 12 May 2011 (Ustawa z dnia 12 maja 2011 r. o refundacji leków, środków spożywczych specjalnego przeznaczenia żywieniowego oraz wyrobów medycznych; Dziennik Ustaw 2016, Item 1536), patients who have a central permit admitting a medication they are taking for individual (targeted) import can claim a reimbursement for their expenses incurred due to the import of the medication. I fully agree with this ruling, especially as it takes a pro-constitutional approach to the interpretation of the provisions on reimbursed medications.
    StreszczenieGlosowany wyrok Naczelnego Sądu Administracyjnego dotyczy refundacji leków posiadających tzw. centralne pozwolenie na dopuszczenie sprowadzanych w trybie importu docelowego. W przedmiotowym orzeczeniu, Sąd stwierdził, że wbrew literalnej wykładni art. 39 ustawy z dnia 12 maja 2011 r. o refundacji leków, środków spożywczych specjalnego przeznaczenia żywieniowego oraz wyrobów medycznych (Dz.U. z 2016 r. poz. 1536) możliwa jest refundacja leków posiadających centralne pozwolenie na dopuszczenie do obrotu. Autor w pełni zgadza się z glosowanym wyrokiem, w szczególności wskazując na zasadność stosowania prokonstytucyjnej wykładni przepisów związanych z refundacją leków.

    Opis:
    The study analyzes the jurisprudence of administrative courts regarding the scope of application of Art. 99 sec. 3 and 3a of the Pharmaceutical Law. The application of an extensive interpretation of this provision was deemed unconstitutional. Such an interpretation assumes that it is applicable not only in the procedure for granting a permit to operate a pharmacy, but also in the procedure for its amendment and withdrawal. The authors express the conviction that it is necessary to stabilize the position of the courts in this matter and to adopt the view expressed in the latest judgments of the Supreme Administrative Court that Art. 99 sec. 3 and 3a of the Pharmaceutical Law Act is a clear and coherent provision of a purely competence nature. Deriving from this provision the obligations of an entity running a pharmacy that have not been expressed by the legislator violates fundamental constitutional principles and values.
    W opracowaniu poddano analizie orzecznictwo sądów administracyjnych dotyczące zakresu stosowania art. 99 ust. 3 i 3a ustawy Prawo farmaceutyczne. Za niekonstytucyjną uznano praktykę rozszerzającej wykładni tego przepisu, przyjmującej, iż ma on zastosowanie nie tylko w postępowaniu o udzielenie zezwolenia na prowadzenie apteki, ale także w postępowaniu w sprawie jego zmiany i cofnięcia. Autorzy wyrażają przekonanie o konieczności ustabilizowania się stanowiska sądów w tej materii i przyjęcia poglądu wyrażonego w najnowszych wyrokach Naczelnego Sądu Administracyjnego, iż art. 99 ust. 3 i 3a u.p.f. jest jasnym i spójnym przepisem o wyłącznie kompetencyjnym charakterze. Wywodzenie z niego niewyrażonych przez ustawodawcę obowiązków podmiotu prowadzącego aptekę narusza fundamentalne zasady i wartości konstytucyjne.

    In this paper, the author characterizes the relationships between the entities that execute tasks associated with safety, efficiency and quality of medicinal products. He is interested in the correlations between the international and Europeans planes at the level of International Conference on Harmonisation of Technological Requirements for Registration of Pharmaceuticals for Human Use as well as relationships between European and national planes. The discussion of the aforementioned issues embraces comments concerning the justification of the need to intervene in the pharmaceutical market in terms of safety, quality and efficiency of such products. The investigation of relationships between global and European planes includes the characteristics of their structures, information on the implementation of the European Union guidelines, and their similarity to the guidelines of the European Medicines Agency with respect to, inter alia, recommended procedures for medicinal products assessment. The author analyzes correlations at the plane of relations between European Union member states and the European Medicines Agency with respect to medicinal products registration procedures in the European Union.
    Autor przedstawia relację między podmiotami realizującymi zadania w zakresie bezpieczeństwa, skuteczności i jakości produktów leczniczych. Zajmuje go powiązanie płaszczyzn międzynarodowej oraz europejskiej na poziomie International Conference on Harmonisation of Technological Requirements for Registration of Pharmaceuticals for Human Use oraz relacje płaszczyzny europejskiej i krajowej. Omówienie powyższych zagadnień obejmuje uwagi dotyczące uzasadnienia potrzeb ingerencji w rynek produktów leczniczych w zakresie bezpieczeństwa, jakości i skuteczności produktów leczniczych. Odniesienie się do powiązań płaszczyzn globalnej i europejskiej obejmuje charakterystykę struktury ICH, informację o implementacji wspomnianych wytycznych w Unii Europejskiej oraz o ich podobieństwie do wytycznych Europejskiej Agencji Leków m.in. w zakresie zalecanych procedur oceny produktów leczniczych. Autor analizuje powiązania na płaszczyźnie relacji pomiędzy państwami członkowskimi a Europejską Agencją Leków na poziomie procedur dopuszczenia produktów leczniczych do obrotu w Unii Europejskiej.

    For many years, the subject of aggressive marketing campaigns conducted by pharmaceutical companies has been raised in Poland. Drug ads are everywhere, on television, the radio, magazines and on the Internet. Therefore, it is extremely important is to ensure both their legal and ethical dimension. This article will present the differences between direct-to-consumer advertising of medicines in Poland and in the US. The dissimilarities result mainly from differences in legislation. In Poland, the law is much stricter than in the US. For example, in the United States companies are allowed to advertise prescription drugs directly to patients. In the whole of the European Union, and thus in Poland, it is strictly prohibited. The article will also present other regulations existing in Poland and in the United States and it will compare them. It will offer examples of violations of the law and ethics in the advertising of medicine in both countries. Lastly, it will briefly outline the negative consequences of unacceptable pharmaceutical marketing.

    Celem opracowania jest próba oceny konstytucyjności przepisu art. 103 ust. 2 pkt 10 ustawy – Prawo farmaceutyczne, znowelizowanego ustawą o zawodzie farmaceuty z 10 grudnia 2020 r. Przepis ten rozszerza zakres stosowania sankcji cofnięcia zezwolenia na prowadzenie apteki na przypadki naruszenia przez podmiot ją prowadzący (przedsiębiorcę) samodzielności zawodowej farmaceuty, o której stanowi art. 35 ust. 1 ustawy o zawodzie farmaceuty. Krytycznej analizie poddano dyskusje parlamentarne nad potrzebą doprecyzowania charakteru wskazanego naruszenia o kryterium „uporczywości” w kontekście konstytucyjności stosowania w przepisach prawa pojęć niedookreślonych. Zgodnie z główną tezą opracowania rezygnacja z tego kryterium podaje poważnie w wątpliwość zgodność art. 103 ust. 2 pkt 10 Pr. farm. w związku z art. 35 ust. 2 u.z.f. z zasadą określoności prawa, zaufania obywatela do państwa i stanowionego przezeń prawa oraz pewności prawa i bezpieczeństwa prawnego, a także zasadą proporcjonalności ingerencji w sferę wolności działalności gospodarczej i prawa własności.
    The aim of the study is an attempt to assess the constitutionality of the provision of Art. 103 sec. 2 point 10 of the Pharmaceutical Law Act, amended by the Pharmacist Profession Act of 10 December 2020. This provision extends the scope of the sanction of withdrawal of a pharmacy authorization to cases of violation of the professional independence of a pharmacist by the entity running it (entrepreneur), as provided for in Art. 35 sec. 2 of the Pharmacist Profession Act. Critical analysis was also applied to the parliamentary discussions on the need to clarify the nature of the violation in question with the criterion of „persistence” in the context of the admissibility of using vague terms in the law. According to the thesis of the study, the resignation from this criterion seriously questions the compliance of Art. 103 paragraph 2 point 10 Pharmaceutical Law Act in connection with Art. 35 sec. 2 Pharmacist Profession Act with the principle of specificity of law, the principle citizens’ trust in the state and the law it enacts, as well as the principle of legal certainty and legal security, and the principle of proportionality of interference in the sphere of freedom of economic activity and property right.

    In 2009, the European Commission published a final report on its market inquiry into the pharmaceutical sector. The report revealed the authority’s concerns regarding market practices of pharmaceutical originator companies aimed at delaying the market entry of cheaper generic pharmaceutical products. One of the delaying practices identified by the European Commission were patent settlements between an originator and a generic company including: (i) a value transfer from the originator to a generic company, and (ii) an obligation of a generic company not to enter the market. These patent settlements were called pay-for-delay agreements since the payment was allegedly made in exchange for the non-mark-entry obligation. The European Commission continued the investigation of patent settlements by its continuous monitoring. It also initiated antitrust proceedings that terminated with huge fines imposed on pharmaceutical companies. The appeals are now pending before the EU courts. Ten years after the publication of the final report on the market inquiry, this article aims to summarize the development of the case law and provide its critical analysis. The article focuses on the analysis of pay-for-delay agreements as infringements of Article 101 TFEU only and does not consider the conclusion of these agreements as an abuse of a dominant position.
    En 2009, la Commission européenne a publié un rapport final sur son enquête de marché concernant le secteur pharmaceutique. Le rapport a révélé les préoccupations de la Commission concernant les pratiques de marché des laboratoires pharmaceutiques visant à retarder l’entrée sur le marché de produits pharmaceutiques génériques moins chers. L’une des pratiques retardatrices identifies par la Commission européenne était les règlements de brevet entre un laboratoire et un fabricant de produits génériques, notamment : (i) un transfert de valeur du laboratoire de vers un fabricant de génériques, et (ii) l’obligation pour un fabricant de génériques de ne pas entrer sur le marché. Ces accords de brevet étaient qualifies d’accords de paiement pour retard, puisque le paiement était apparemment effectué en échange de l’obligation de ne pas entrer sur le marché. La Commission européenne a poursuivi l’enquête sur les accords de brevet en exerçant une surveillance continue. Elle a également lancé des procédures antitrust qui se sont terminées par l’imposition d’amendes considérables aux sociétés pharmaceutiques. Les recours sont maintenant en cours devant les tribunaux de l’UE. Dix ans après la publication du rapport final sur l’enquête de marché, cet article vise à résumer l’évolution de la jurisprudence et à fournir une analyse critique. L’article se concentre sur l’analyse des accords de paiement des retards en tant qu’infractions à l’article 101 du TFUE uniquement et ne considère pas la conclusion de ces accords comme un abus de position dominante.

Drug ads are everywhere, on television, the radio, magazines and on the Internet. Therefore, it is extremely important is to ensure both their legal and ethical dimension. In my article I will present the differences between direct-to-consumer advertising of medicines in Poland and in the US. The dissimilarities result mainly from differences in legislation. In Poland the law is much stricter than in the US. For example, in the United States companies are allowed to advertise prescription drugs directly to patients. In the whole of the European Union, and thus in Poland, it is strictly prohibited. The article will present other regulations existing in Poland and in the United States and it will compare them. It will show examples of violations of the law and ethics in the advertising of medicine in both countries. It will briefly outline the negative consequences of unacceptable pharmaceutical marketing.

    Od grudnia 2008 r. polscy absolwenci prawa mogą zostać specjalistami w dziedzinie zdrowia publicznego. Głównym celem kształcenia w tym zakresie jest stworzenie kadry profesjonalistów realizujących zadania z zakresu zdrowia publicznego na szczeblu administracji rządowej, samorządowej i organizacji pozarządowych, w zakresie nadzoru sanitarnego (zwłaszcza Państwowego Inspektoratu Sanitarnego) i ochrony przed zagrożeniami środowiskowymi, w ambulatoryjnych zakładach opieki zdrowotnej i innych instytucjach propagujących zdrowy tryb życia. Prawnik – specjalista zdrowia publicznego może wykonywać zadania z różnych dziedzin związanych z polityką zdrowotną państwa. Specjaliści z gruntownym wykształceniem w zakresie prawa i zdrowia publicznego są potrzebni w dziedzinach, w których uwarunkowania prawne wywierają wpływ na takie sfery, jak modelowanie zachęt finansowych w służbie zdrowia, akredytacja placówek medycznych, tworzenie zasad ubezpieczeń zdrowotnych oraz w instytucjach związanych z przemysłem farmaceutycznym.
    Since December 2008, Polish law graduates can become specialists in the area of public health. The main goal of education in this domain is to create an array of professionals who would realize tasks pertaining to public health at the level of government administration, local self-government and NGOs, in the domain of sanitary supervision (especially by the State Sanitary lnspectorate) and protection against environmental threats, in outpatients health care facilities and other institutions that promote a healthy lifestyle. A lawyer – specialist in public health can perform tasks in various fields pertaining to the health policy of the State. Professionals who have thorough education in law and public health are needed in spheres where legal factors exert influence on such spheres as modeling financial incentives in health service, accreditation of medical institutions, creation of rules of health insurance and in institutions connected with pharmaceutical industry.

    The main theme of this discussion is the subject matter of products called food supplements which are also known as a supplementary food in U.S. The purpose of taking those products is intended to supplement the human food diet and provide some nutrients, such as vitamins, minerals, fiber etc. that may be missing or may not be consumed in sufficient quantities in a person's diet. The food supplement in Europe is defined as a concentrated source of nutrients or other substances with a nutritional or physiological effects. It is marketed "in dose" form i.e. as pills, tablets, capsules, liquids in measured doses etc. This nature often causes some misunderstanding what will be discussed.The author presents legal issues of food supplements, concentrate on legal regulation in European Union and legal guides in regarding to this topic. Especially the aim is to focus on the issue of delimitation between those foodstuff and pharmaceutical products. In the general opinion, as showing a recent scientific research, the average customer does not see, in many cases, the difference between those two groups of products and at this point it is necessary to add that considering legal and factual view it is impermissible to treat food supplements and pharmaceutical products the same. Because of this problem the author tries to show firstly, the legal provisions in force and subsequently to point out the differences statutory provisions. What is more, it is taken an attempt to point actual, still difficult to describe differences between both groups and quoting the opinions and judicial decisions of E.U. legislator in this object. In the conclusion of the article the reader may find out the consideration in the subject of some legal loopholes and ideas and models preventive points.

    Przestępczość farmaceutyczna stanowi ogromne wyzwanie dla ustawodawców krajowych i społeczności międzynarodowej. W ostatnim czasie możemy zaobserwować szczególny rozwój tego fenomenu, do czego przyczynił się wybuch pandemii COVID-19. Specyfika przestępczości farmaceutycznej przesądza o tym, że w przypadku nieprawidłowości w obrocie produktami leczniczymi możemy mieć do czynienia z kilkoma reżimami odpowiedzialności – odpowiedzialnością administracyjną, cywilną, karną, jak też zawodową. Na płaszczyźnie penalnej zasadnicze znaczenie będą miały przepisy zgrupowane w Kodeksie karnym i Prawie farmaceutycznym. Dokonanie prawidłowej subsumpcji fałszowania produktów leczniczych i wprowadzania ich do obrotu może wzbudzać wątpliwości praktyczne, u podłoża których leży ustalenie wzajemnego stosunku przepisów: art. 165 § 1 pkt 2 k.k. i regulacji pozakodeksowych znajdujących się w Prawie farmaceutycznym.
    Pharmaceutical crime poses a huge challenge both to the national legislators and the international community. We have recently observed a particular development of this phenomenon, also due to the outbreak of the Covid-19 pandemic. The specific nature of pharmaceutical crime determines that in the case of irregularities in the marketing of medicinal products, we may have to deal with several regimes of liability – administrative, civil, criminal as well as professional one. On the penal level, the provisions grouped in the Criminal Code and the Pharmaceutical Law will be of fundamental importance. Correct classification of counterfeiting of medicinal products and their marketing may raise practical doubts which are based on the establishment of mutual relations between provisions – Article 165 paragraph 1 point 2 of the Penal Code and non-Code regulations found in the pharmaceutical law and extra-code regulations contained in the pharmaceutical law.

    The 2008 issue of YARS contained an overview of EU law developments in the period of time from 2004 to 2007. This overview covers the years 2008-2009. It confirms that State aid cases remained numerous (6 in total) and that the Commission’s enforcement activities in the area of State aid control continued at a similar pace as before. With respect to other areas of competition law and policy, the overall picture shows a relatively high level of scrutiny in mergers (5) and antitrust cases or inquiries (2). Moreover, EU Courts adopted several decisions in Polish cases, notably in the regulatory field (electronic communications) and State aid control (partial annulment in Huta Częstochowa (Operator) as well as the rejection of a request for interim measures in Technologie Buczek). The regulatory court cases show the Commission’s consistency in pursuing Member States in their failure to implement or to correctly implement the EU Electronic Communications package. In the state aid related Huta Częstochowa (Operator) judgement, the General Court (GC, formerly the Court of First Instance, CFI) partially annulled the scrutinised Commission decision since the Commission failed to identify the actual benefit related to the receipt of the aid in question. The jury is still out in the case concerning Technologie Buczek because the interim measures judgement says little about the potential outcome of the pending main appeals.
    Le YARS de 2008 contenait un aperçu des développements du droit de l'UE pendant la période de 2004 à 2007, alors que celui-ci couvre les années 2008-2009. Il confirme que les cas d'aides d'État sont restés nombreux (6 au total) et que la mise en œuvre du contrôle des aides d'État par la Commission a continué au même rythme. En ce qui concerne les autres secteurs du droit de la concurrence et de la politique de concurrence, le nombre de contrôles des concentrations et des cas ou des enquêtes antitrust est relativement élevé (2). En outre, les cours de l'UE ont rendu plusieurs arrêts dans des cas polonais, notamment dans le domaine réglementaire (communications électroniques) et du contrôle d'aides d'État (l'annulation partielle dans Huta Częstochowa (opérateur) ainsi que le rejet d'une demande de mesures provisoires dans Technologie Buczek). Les arrêts dans le domaine réglementaire montrent la cohérence de la Commission dans les actions contre les États membres qui ont manqué à leur obligation de mettre en oeuvre, ou de mettre en œuvre correctement, le Paquet Télécom de l'UE. Dans l'arrêt Huta Częstochowa (opérateur) concernant les aides d'État, le Tribunal (précédemment le Tribunal de Première Instance, TPI) a partiellement annulé la décision de la Commission puisque la Commission n'a pas réussi à identifier l'avantage réel de la réception de l'aide en question. Le jury est toujours en train de délibérer dans le cas concernant Technologie Buczek parce que l'arrêt sur les mesures provisoires dit peu sur les résultats potentiels des appels principaux en cours.

    Zagadnienie reklamy produktów leczniczych w Internecie pozostaje od lat centralnym punktem debaty prowadzonej przez specjalistów z zakresu nauk medycznych, farmaceutycznych, ekonomicznych i prawnych. Wyrazem tejże debaty okazało się powołanie przez Ministra Zdrowia, zarządzeniem z dnia 2 czerwca 2016 r., zespołu ds. uregulowania reklamy leków, suplementów diety i innych środków spożywczych oraz wyrobów medycznych , którego celem było opracowanie projektu zmian legislacyjnych zwiększających efektywność nadzoru. Niniejszy artykuł stanowi krytyczną analizę obowiązujących regulacji prawnych traktujących o zagadnieniu reklamy produktów leczniczych w Internecie oraz reklamy produktów leczniczych en bloc. Formalno-dogmatyczna analiza przepisów prawa obejmuje w szczególności zagadnienia reklamy kierowanej do publicznej wiadomości, reklamy zamkniętej, spammingu farmaceutycznego oraz reklamy społecznościowej, w tym tzw. reklamy partycypacyjnej. Rozważania uzupełniane są komentarzem odnośnie do faktycznego funkcjonowania przepisów prawa (law in action), ich egzekwowania przez organy nadzoru oraz praktyki państw obcych w zakresie reklamy leków w Internecie, co zwieńcza wysunięcie wniosków de lege ferenda.
    Advertising medicinal products en bloc generates a great deal of heated debate among professionals of various scientific orientations. In spite of this fact, on 2 July 2016, the Polish Minister of Health issued an ordinance summoning a special committee with the objective of preparing certain recommendations and references concerning, among others, advertising of medicinal products, dietary supplements and medical devices. The following article is structured so as to critically asses and analyze the legal framework governing the advertisement of medicinal products, with emphasis on their on-line advertisement. Particular significance is placed on: 1) the issue of pharmaceutical spam, including a discussion of the dangers it poses and the possible responses it can face, including those initiated by EU agencies (ENISA and EMA), and 2) the advertisement of medicinal products on social media (Web 2.0). The discussion provides an in-depth coverage of decisions issued by the Polish Chief Pharmacy Inspectorate (regulatory board; GIF) in relation to medicinal advertising (on-line) and features a brief summary of chosen foreign practices. The analysis also covers the issue of supervision over advertising medicinal products. In the course of the article, the author uses a formal-dogmatic assessment method, operated and supported by the legal theory of law in action, in order to close the article with conclusions and de lege ferenda postulates.
