The Author concludes that the Rules Deputies’ and Immunity Affairs Committee should not continue to examine application request of the subsidiary prosecutor after the court of appeal has finally dismissed the criminal proceedings. It should be assumed that revoking of a valid procedural decision terminating these proceedings will give rise to the necessity of submitting a new application for waiver of immunity. An entity that submitted an application for waiver of immunity may freely dispose of it until the Sejm adopts a resolution regarding the consent to bring the Deputy to criminal accountability or until the Deputy’s submission of the statement referred to in Article 105 para. 4 of the Constitution.

The opinion is an answer to a question submitted by the Marshal of the Sejm, whether a former Deputy is still entitled to immunity protection in case of acts committed within the scope of the mandate. According to the author, the former Deputy (or a Senator) may be held responsible for actions violating rights of the third persons which took place during the exercise of the mandate of that Deputy, but only upon a permission of an appropriate house of Parliament. The author notes that the loophole in legislation should be filled by an amendment.

Opis:
Recurrent respiratory tract infections in children are the most common cause of outpatient visits. Due to the necessity of treatment of chronic, frequent use of antibiotics and the dangers of complications are a major clinical problem. Big hopes are now with the possibility of the use of immunostimulation as prevention of these infections. The paper discusses the most important methods of stimulation of the immune system in children. In the light of previous reports were evaluated effects of this type of therapy.

The author indicates that the legal structure of the Polish immunity regulations excludes the possibility of adopting a resolution by the Sejm on giving consent to bring several deputies to responsibility. In each individual case, the Sejm should consider a separate motion and adopt a separate resolution. Referring to the principle of discontinuity, the author concludes that regarding the two former Deputies, new motions for consent to bring them to a civil law liability should be submitted, while in the case of a Deputy holding a mandate also in the 9th term, the proceedings on the motion concerning him should be continued.

The author states that a Deputy does not have an obligation to make available document received from a private person, regardless the content of the document. Parliamentary immunity, according to the author, does not release the Deputy from an obligation to testify as a witness or does not release the Deputy from an obligation to provide public authorities with a document which may serve as an evidence. However, pursuant to Article 21 the Act on the Exercise of the Mandate of a Deputy or Senator, the Deputy might refuse to provide information about a person who has provided an information to a deputy. This principle applies to civil procedure, criminal procedure and other investigative procedures that include an obligation to testify. The scope of this privilege contains also the possibility of refusing to issue a document received within limits of exercising of the mandate whose content would reveal information of a deputy’s informer.

The application concerns a person who held the mandate of a Deputy during the seventh term of the Sejm, but is not currently a deputy. According to the art. 105 paragraph 1 sentence 2 of the Constitution, a Deputy may be brought to a court accountability for action violating the rights of third parties, which have been taken within the scope of the mandate, only upon the consent of the Sejm. This rule applies to a possible court accountability of former Deputies concerning acts committed in the course of exercise of their parliamentary mandate. The subject of the resolution adopted by the Sejm must include a whole set of behaviors constituting a persecuted act, regardless of whether all behaviors are within the scope of the mandate. Content of the application meets the required precision only with regards behaviors belonging to the third group of activities. The behaviors of the first and second group have been indicated in the application in a very general way, what means that the application does not meet the requirement under art. 7b paragraph 4 Section 4 of the Act on performance of the mandate of Deputy and Senator.

The article critically assesses the decision of the Polish Supreme Court in Natoniewski v. Federal Republic of Germany. It argues that the decision as such reflects contemporary international law practice. Consequently, the holding of the Supreme Court that State immunity is applicable to acts de iure imperii committed on the territory of the forum State during an armed conflict even though they may amount to war crimes seems to be correct. This conclusion also means that the Court refused to engage in law-making activity by declining to endorse interpretation, which would permit to reject State immunity by attaching superior importance to human rights. Although the article recognizes that the reasoning of the Supreme Court as well as the choice of arguments is well-balanced and convincing, it also identifies certain instances in which the Court is not entirely persuasive. In the opinion of the author, one of the most important drawbacks in the reasoning relates to the characterization of State immunity as a procedural, rather than substantive, issue.

This review article presents fundamental mechanisms of the local mucosal immunity in selected regions of the respiratory tract in healthy birds and in some pathological conditions. The respiratory system, whose mucosa come into direct contact with microorganisms contaminating inhaled air, has some associated structures, such as Harderian gland (HG), conjunctive-associated lymphoid tissue (CALT) and paranasal glands (PG), whose participation in local mechanisms of the mucosal immunity has been corroborated by numerous scientific studies. The nasal mucosa, with structured clusters of lymphoid tissue (NALT – nasal-associated lymphoid tissue) is the first to come into contact with microorganisms which contaminate inhaled air. Lymphoid nodules, made up of B cells with frequently developed germinal centres (GC), surrounded by a coat of CD4+ cells, are the major NALT structures in chickens, whereas CD8+ cells are situated in the epithelium and in the lamina propria of the nasal cavity mucosa. Studies into respiratory system infections (e.g. Mycoplasma gallisepticum) have shown the reactivity of the tracheal mucosa to infection, despite a lack of essential lymphoid tissue. Bronchus-associated lymphoid tissue (BALT) takes part in bronchial immune processes and its structure, topography and ability to perform defensive function in birds is largely age-dependent. Mature BALT is covered by a delicate layer of epithelial cells, called follicle-associated epithelium (FAE). Germinal centres (GC), surrounded by CD4+ cells are developed in most mature BALT nodules, while CD8+ lymphocytes are dispersed among lymphoid nodules and in the epithelium, and they are rarely present in GC. Macrophages make up the first line of defence mechanisms through which the host rapidly responds to microorganisms and their products in the respiratory mucosal system. Another very important element are polymorphonuclear cells, with heterophils being the most important of them. Phagocytic cells obtained from lung lavages in birds are referred to as FARM (free avian respiratory macrophages). Their number in chickens and turkeys is estimated to be 20 times lower than that in mice and rats, which indicates a deficit in the first-line of defence in the birds’ respiratory system. There are numerous B cells and antibody secreting cells (ASC) present throughout the respiratory system in birds. Their role comes down to perform antigen-specific protection by producing antibodies (IgM, IgY or IgA class) as a result of contact with pathogenic factors.

On 29 October 2007, Winicjusz Natoniewski filed the lawsuit against the Federal Republic of Germany in the Circuit Court in Gdansk (Poland), demanding a payment of PLN 1,000,000 as a redress for injuries he suffered as a result of activities of the German military forces during World War II. The Circuit Court, Appellate Court and the Supreme Court rejected the lawsuit stating that the State immunity of the Federal Republic of Germany excluded the jurisdiction of Polish courts in this case and thereby deprived Natoniewski of the right to dignity guaranteed by Polish, European, and international law. The actions taken by German forces in the Natoniewski case constitute a war crime and a crime against humanity. In the case of such serious crimes, a State cannot invoke its immunity. The infringement of fundamental human rights entails the withdrawal of all benefits and privileges provided by international law, and thus is an implied waiver of the State immunity. This consequence results from the principle that no one can benefit from his/her unlawful conduct. Granting immunity to a State in case of international crimes committed by the State is contrary to the foundations of international law and it destroys the values which are the most important for the international community.

The auditor immunity is necessary to ensure appropriate performance of state audit tasks. Persons who do this job must be protected against potential charges of legal and penal nature, formulated due to performance of their professional activities. The auditor immunity cannot be considered as impunity, because the protection that it provides is not abused by the Supreme Audit Office. Motions to waive immunity are in fact very rare. However, the lack of exhaustive legal regulations in this regard does not allow for sufficient assurance as to the proceedings that are applied, especially in such a crucial area as the right to defence. In her article, the author presents the details of the procedure for waiving the auditor immunity by the Council of NIK.

The author analyzes the possibilities and consequences of the disclosure of classified information by a person covered by the motion for waiver of immunity at a sitting of the Sejm, in the course of examination of the motion. He claims that a person to whom the motion to waive immunity pertains is entitled to comment the information contained therein, including the use of classified information, insofar as they relate to the circumstances of the case and the allegations formulated in the motion. This is a guarantee of the right to defence in the course of proceedings relating to waiver of immunity. The author points out that such proceedings must respect basic procedural standards and, in particular, take into account the constitutional right to defence.

The aim of the study was to determine immunostimulant properties of chitosan administered alimentary to BALB/c mice. We observed that chitosan feeding effected in activation of cells from the peritoneal cavity. The cells produced less nitric oxide with simultaneous enhanced activity of arginase and higher expression of receptor for IL-4. What is more, chitosan caused increased number of cells expressing MHC class II. The study confirms that chitosan can stimulate immune system what potentially makes it useful candidate for adjuvant.
