Opis:

Activity connected directly with preventing results of environmental degradation that are negative for health creates for public authority a sphere of action which combines both environmental protection and health protection. Environmental protection is a legal term with its definition in Art. 3 of Environmental Protection Act of 27 April 2001. Direct connection between environmental protection and health protection finds its reflection in the Act of 28 July 2005 on medical care, health care, health care protection areas and health care communities (called the Act on health resorts). This article contains an analysis of legal conditions connected with awarding a community the status of a health resort, according to the provisions of the Act of 27 March 2003 on spatial planning and development, as well as to the provisions of the above mentioned Act on health resorts.

The rules for the organisation of health policy on immunization are defined by each state in relation to its citizens. The laws of individual EU countries make the possibility of vaccinating minors dependent on, among other things, the age of the person to be vaccinated and the consent of one or both parents or other legal guardians. Opis:

Authors focus on the importance of counseling centers in health protection and in promotion and development of public health in the Slovak Republic. Health is not only one of the most important rights of every citizen, but it also an obligation to take care of it. Chronic diseases can be prevented by adopting the principles of good nutrition, sufficient physical activity and avoiding of smoking, alcohol and stress. Level of control of major risk factors, especially of hypertension, should be increased. Also the motivation for patients to eliminate their risk factors through the instruments of state policy adequate education and the availability of better quality health care should be improved. Health counseling centers are designed for healthy people who are interested in the quantification of selected health status indicators related to cardiovascular disease, based on which is assessed the risk of cardiovascular diseases.

The paper deals with the issue of mapping the awareness of Constantine the Philosopher University students about the safety and health protection at work. The aim of the survey was to find out whether the field that the higher education students study has an effect on the results achieved in the survey. Westudied the students´ orientation in the area of basic terms associated with the safety at work as well as the level of their legal consciousness.

Článok pojednáva o problematike BOZP. Poukazuje na jej význam pre zamestnancov a zamestnávateľov, definuje hlavné dokumenty v tejto oblasti na Slovensku. Pozitívny ekonomický vplyv zlepšenia pracovných podmienok, špeciálne BOZP je spojené s vyššou produktivitou práce, efektivitou ale aj kvalitou práce a kvalitou poskytovaných služieb, čo môžu tvoriť len zdraví a motivovaní zamestnanci. Pretože veľa zamestnávateľov ako aj zamestnancov má veľmi nízke právne povedomie týkajúce sa BOZP je dôležité poskytnúť študentom a učiteľom kvalitný systém vzdelávania v tejto oblasti. Tento článok podáva informácie ako je výchova k BOZP implementovaná v základných a stredných školách a špecifikuje výchovu budúcich učiteľov k BOZP predovšetkým na UMB v Banskej Bystrici. Je veľmi dôležité mať dobré učebnice alebo učebné materiály (skriptá, monografie, e-learning) pre tento účel čo je aj obsahom tohto článku.
The article is concerned to the issue of Safety and Health Protection. It shows off its meaning according to the employers and employees, it defines main documents of the area in the Slovak Republic. The quality and level of safety at work and the employees´ health in a wider context presents culture, social and economical maturity of both – employers and the state. The positive economical influence of the improvement of working conditions, especially Safety and Health Protection, is conveyed with higher productivity, efficiency as well as the quality of work or quality of the services provided, which is created only by healthy and motivated employees. Since many employers as well as many employees have low legal awarness related to Safety and Health Protection, it is neccessary to provide both students and teachers in that area with high quality system of education and the article gives information such as education towards Safety and Health Protection which is implemented at primary and secondary schools and it specifies education of the next teachers to Safety and Health Protection more at the University of Matej Bel in Banská Bystrica. Itis very important to have good textbook or educative material for this purpose, various kinds of textbooks, monographies, internet web sites, e-learning, everything is briefly described in this article.

The bill, to the extent to which it (in most of the cases) do not limit the number of human embryos created in the in-vitro procedure does not comply with the provisions of the Constitution of the Republic of Poland. The bill involves the outright separation of human embryos into capable and incapable of developing normally and permits destruction of embryos placed in the second group, and does not provide for any formal procedure of assessment of that “capability”. Nor does it guarantee that the donors of reproductive cells (parents) can influence the decision to destroy the embryo. The bill is also incompatible with the Constitution to the extent to which it does not prohibit the use of supernumerary human embryos for experimental or industrial purposes and to the extent to which it allows the identification and selection of embryos to be transferred to the mother’s body. Provisions of the bill excessively restrict the right of children conceived through in-vitro fertilization to know their genetic origin.

Some permissive and, at the same time, controversial solutions proposed in the bill are wrongly presented as the implementation of European Union law. This applies, in particular, to the construct of “donation”. This permissive idea, unknown to European law, creates the opportunity of far-reaching abuse, including the acceptance of the practice of surrogacy and the acquisition of parental rights by persons living in homosexual relationship. The bill treats instrumentally participants of assisted reproduction procedures, especially those who are in the embryonic stage of human development, violating thereby the constitutional guarantees of human life and dignity. It also allows for eugenic selection of human embryos, providing a very narrow limitation in this respect. The anonymity of a donor of reproductive cells, proposed in the bill, breaches in many respects the principle of protecting the child’s interests.

Opis:

Construction objects arise during the implementation of construction projects. Participants in these projects are interested in taking systematic actions to improve the state of occupational safety and health protection. The effectiveness of these activities requires that they be carried out as part of a comprehensive system of managing the construction project implementation process. The safety management and health protection system is part of the overall project management system, which includes: organizational structure, planning, responsibility, rules of conduct, procedures, processes and resources and requires analysis of safety and health protection issues in its individual areas, phases and stages. This is primarily due to the fact that proper management is the most effective way to ensure an adequate level of safety and health protection (S&HP), desirable both due to the need to comply with legal provisions in force in construction, social expectations, and the possibility of obtaining positive economic effects by individual process participants in the scale of the entire construction project. The article proposes a theoretical model of the built undertaking that can be used to recognize the state of bioses. The model distinguishes parts, activities and areas in accordance with the logical course of the process, which was assigned to individual stages of the project. A research tool - RADAR S&HP - was developed to identify the factors affecting S&HP. To assess the condition of bioses, an analytical and mathematical model of the examined undertaking was formulated to ultimately determine the directions of preventive actions in the field of safety and health protection at individual stages, phases and areas of the construction project implementation process.

An epidemic caused by the coronavirus SARS-CoV-2 has been existed in Europe and worldwide for several weeks now. On 11 March 2020, the WHO declared it a global pandemic. At the time of writing, Europe, in particular Italy, is the largest outbreak of coronavirus. Italy is attempting to tackle the virus with increasingly drastic legal measures. On 31 January 2020, its Council of Ministers declared a state of emergency related to the sanitary risk of coronavirus infection. Italy has started the fight against the virus using two legal instruments: the first is the Council of Ministers’ declaration of a six-month state of emergency on 31 January 2020, and the second is a decree-law (decreto legge) issued by the Prime Minister temporarily restricting the freedom of movement throughout the state. In exceptional cases, the Italian Government has the right to issue normative legal acts. Recent legislative acts issued in Italy have undoubtedly limited the fundamental rights granted by the Constitution of 1947. These limited rights include the right of movement, but also freedom of assembly, the right to work, freedom of economic activity and freedom of conscience and religion. As a result of the legal solutions introduced, fundamental human rights are subject to justifiable restrictions in order to protect the constitutionally guaranteed right of the community to health care. In situations of epidemiological threats, protecting the lives and health of citizens is essential. Any restrictions on rights and freedoms are intended to protect these goods. However extensive these restrictions may be, in a democratic state this must be introduced under strict control and for a specified period of time linked to the duration of an epidemic.

The Act responds to an urgent and important social need. It is also indispensable to implement the EU directives mentioned in the explanatory note to the bill. The bill draws on the acquis communautaire and seems to correspond to the requirements of the directives, as well as the Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine of 1997. The lack of regulation of the procedures, particularly medical procedure of in vitro fertilization, currently results in inability of control the operation of clinics carrying out this kind of medical treatment. There is, however, need to clarify the proposed legislation, including the definition of partner donation, fertility security for the future, phenotypic data, anonymous embryo donation, the use of embryos after the death of the donor. The bill should specify the maximum age for a woman who wishes to undergo in vitro fertilization. It should also specify the attributes of an offense involving the destruction of the embryo which was created out of the medical procedure. The bill needs more work.

Opis:

The method of regulating the issue of infertility treatment, including the use of in vitro fertilization procedures, does not raise any substantive doubts. The solutions adopted in the bill correspond to international standards and do not raise objections of a constitutional nature. The bill is a result of a reasonable compromise between the need to recognize the rights of people affected by infertility and the need to protect the embryo and the concerns for the welfare of the unborn child. It may, however, give rise doubt as to the granting of rights to use the procedures of medically assisted procreation only to people who are in marriage or partnership relations, which could be seen as discrimination against single women. Moreover, the imposition of a statutory limitation on the number of oocytes undergoing fertilization is detrimental to women’s health. The bill requires editorial corrections.

Opis:

Bacterial infections that are due to consumption of poor quality water are still an important threat to human health and life. The aim of the article was to investigate the bacteriological threat of water from home wells. The results of water testing from individual wells constituted research material. On their basis, the health risk of fecal streptococci, coliforms and Escherichia coli was assessed and an attempt was made to assess the impact of pollution on the health of residents. The results of water testing in private wells showed unacceptable values for bacteriological pollution. A significant health risk was found for fecal streptococci, coliforms and Escherichia coli. The authors pointed out the need to take extensive actions aimed at raising environmental and health awareness of the inhabitants in terms of water quality used for living purposes, in particular for consumption.

Artykuł, oparty na analizie aktów prawnych, dokumentów oraz literatury przedmiotu, traktuje o istocie i ewolucji kas chorych w systemie ubezpieczenia zdrowotnego w Polsce. Poddane analizie rozwiązania instytucjonalne wprowadzone zostały do polskiego porządku prawnego ustawami z dnia 19 maja 1920 r. o obowiązkowym ubezpieczeniu na wypadek choroby oraz z dnia 6 lutego 1997 r. o powszechnym ubezpieczeniu zdrowotnym. W artykule scharakteryzowano organizację oraz zasady działania kas chorych na gruncie stanu prawnego ukształtowanego przez wskazane akty prawne. Punkt wyjścia przeprowadzonej analizy stanowi status prawny kas chorych, jako osób prawnych prawa publicznego. W ramach struktury organizacyjnej omówione zostały rozwiązania normatywne odnoszące się do samorządnych organów kas chorych, wyposażonych w kompetencje uchwałodawcze, zarządzające lub nadzorcze. W dalszej części przedstawiony został kierunek rozwoju struktury organizacyjnej ubezpieczenia zdrowotnego w Polsce zakładający odejście od instytucji samorządnych kas chorych na rzecz scentralizowanych jednostek organizacyjnych.
In the present study the practical application of the institution of national health societies to the public system of health protection is presented, which is illustrated by the organisational structure of Polish national health societies, especially according to acts from 1920 and 1997. The research yields the analysis of law regulations which govern the nature of the national health societies. It is emphasised that the self-government, which functioned in the Polish health insurance, has not successfully adapted to the changes taking place in the Polish society. The author also underlines the infl uence of the centralization on the foundation of Polish’s social and economic policy. Furthermore, he comes to a conclusion that radically changes of the rules, the forms and the range of social policy have negative infl uence on health insurance system, which should works effectively and which is aimed at the protection of the insured from the disease risk. The author also presents his views on the development of the system of national health societies in Poland.

Objectives Music educators are subjected to many physical and psychological stresses encountered in the workplace. These stresses could be counteracted by certain work-related behavior and experience patterns as personal resources to reduce the negative consequences of stress. The aim of the study was to determine the existing work-related behavioral and experiential patterns and the characteristics of the Work-Related Behavior and Experience Patterns (Arbeitsbezogenes Verhaltens- und Erlebensmuster – AVEM) questionnaire dimensions in the professional group of music educators according to age group. Material and Methods A total of 205 music educators (66.3% female) from various music schools in Germany participated in the online survey. The subjects were divided into 3 age groups (AG): AG I: ≤35 years, AG II: 36–45 years, AG III: ≥46 years. In addition to sociodemographic and occupational data, the standardized AVEM questionnaire was used according to Schaarschmidt and Fischer. The age and occupation-related data were evaluated in a correlation analysis with the expression of AVEM dimensions. Results A total of 71.4% of the music educators were ≥46 years old group. Another 12.8% belonged to AG II, and 15.8% belonged to AG III. The sex distribution in the 3 age groups was comparable (p = 0.261). The expression of all AVEM dimensions was within the reference range. The most pronounced dimension, with a stanine value of M±SD 5.2±2.15, was the willingness to spend. There was also no significant difference in the assignment to the 4 patterns in the 3 age groups (p = 0.669). Age showed a negative correlation with the experience of social support (ρ = –0.354). Conclusions The age-independent and high intervention-requiring expressions of the AVEM risk patterns A and B led to the recommendation of workplace prevention and health promotion measures. Therefore, it seems reasonable to promote appropriate stress management measures and resilience during studies.

Dlatego w artykule przedstawione zostały regulacje dotyczące powyższych zagadnień w polskich przepisach prawa. Należy podkreślić, jak to wynika z treści analizy obowiązującego stanu prawnego, że ochrona zdrowia pracujących na statkach rybackich obejmuje m.in. następujące obszary: predyspozycje psychofizyczne kandydatów do pracy na statkach rybackich, szkolenia medyczne, wyposażenie w sprzęt medyczny, warunki środowiska pracy, wymagania higieniczno-sanitarne. Dokładne regulacje prawne zawarte są w kilku aktach prawnych, które zostały omówione w poniższym tekście.
Working on fishing boats not only requires the necessary skills, but also very good health and a high level of worker protection while fishing. The article presents the regulations of these issues under Polish law. As a result from the analysis of the current legal status, it should be emphasized that the health protection of people who are working on fishing boats includes the following areas: the psychophysical predispositions of job candidates for fishing boats, medical training, medical equipment, the conditions of the work environment, hygienic and sanitary requirements. Precise regulations are contained in a few legal documents which are discussed in the following article.

The creation of conditions aimed at ensuring the health of the population is a supreme value. Polish legal solutions make it a constitutional obligation of the State and local self-government. The current Constitution of the Republic of Poland of2 April 1997 does not define the limits of this obligation; it only states that the conditions for ensuring everyone’s right to health protection and the scope of health services that are financed from public funds are to be specified by statute. In fact, the system leaves almost complete freedom in this area to the legislator. In the article the solutions adopted by local self-government units in 1991–2018 are evaluated. In order to fulfil certain competences and tasks imposed by law on the commune, poviat and self-governing regional bodies, the legislator has determined two spheres of their activity: (i) implementation of their own tasks in the field of health protection and health promotion, and (ii) establishment and running of entities which before 2011 were termed public health care facilities and after 2011 changed their name into medical entities which are not entrepreneurs. In neither of these spheres of activity is the participation of local government units identical. In the first sphere, the differences result from both the constitutional acts shaping their own tasks in the field of health protection, as well as health programmes which they adopt for their implementation. In the second sphere, however, the differences are a result of statutory solutions that base the model of health care on values that are not uniformly understood. Before 2011, they were conducted and maintained fully, or to a limited extent, from public funds, whereas after 2011 they were maintained from public funds only, when a budgetary unit was selected as an organisational formula of a self-government medical entity. The solutions of the Act of 2011 in its original wording pointed tended to favour commercialisation of the public health sector. The negative side of the solutions adopted is the extraordinary lack of diligence in exercising legislative diligence, especially in the scope of defining the competences and tasks of local self-government units in relation to the medical entities created/ run by these units.

Asbestos has been declared a proven human carcinogen by the U.S. Environ-mental Protection Agency and by the International Agency for Research on Cancer of the World Health Organization. Since 1983, the European Union has enforced health protection directions in this field, which have been the basis for legal acts of Member States. The Estonian Republic is a country where asbestos and asbestos-containing materials have been used in quite large quantities, especially during the Soviet period. Today the use and sale of asbestos minerals and asbestos containing products are prohibited in Estonia. Unfortunately there has been no substantial overview of the health status of workers exposed to asbestos. The objective of this study was to evaluate the extent of health risks of workers exposed to asbestos in Estonia.

Opis:

Health is considered to be the greatest invaluable good. This article concentrates on the level of advancement of medical services in Poland and in certain countries of the European Union. This research uses such indicators as: expenditure on health care, the level of morbidity, mortality, sick leaves, number of doctors, hospitals, as well as the average life expectancy. Dynamic indices were used in the determination of developmental trends. To capture similarities and differences in the level of medical services advancement, multidimensional scaling method was applied. Results of the study allow stating that a significant advancement in the development of medical and social care services can be observed. However, Poland still lags behind other countries where development of these services remains on a high level.
Zdrowie jest największym i bezcennym dobrem, dlatego w artykule została zwrócona uwaga na poziom rozwoju usług medycznych w Polsce i wybranych krajach Unii Europejskiej. Do badania wykorzystano takie wskaźniki jak: wielkość wydatków na ochronę zdrowia, poziom zachorowalności, śmiertelność, absencję chorobową, liczbę lekarzy, liczbę szpitali, czy też przeciętne dalsze trwanie życia. Do określenia tendencji rozwojowych wykorzystano indeksy dynamiki. W celu uchwycenia podobieństw lub różnic w poziomie rozwoju usług medycznych zastosowano metodę skalowania wielowymiarowego. Wyniki badań pozwalają stwierdzić, że obserwuje się znaczny postęp w rozwoju usług medycznych i społecznych, niemniej Polska pozostaje nadal w tyle za państwami, w których rozwój tych usług jest na wysokim poziomie.

Research on job satisfaction has attracted significant attention of both theoreticians and practitioners of psychology and management. The basic challenge related to carrying on job satisfaction research is a choice of appropriate questionnaire. In the paper we analyze one of the most popular tools helping to assess the level of job satisfaction – Minnesota Satisfaction Questionnaire (MSQ). On the basis of the research carried out among 75 employees of chosen hospital we verify two resarch hypotheses related to the dimensions of job satisfaction and their relationship with declared, general level of job satisfaction. Research results reveal 5 factors of studied construct, and regression analysis partly supports hypothesis describing relationship between dimensions of job satisfaction and declared, general level of job satisfaction.

Bazując na danych statystycznych przedstawiono zróżnicowanie regionalne uwarunkowań infrastrukturalnych wdrażania technologii ITC w ochronie zdrowia. W drugiej części artykułu zaprezentowano krótki przegląd wybranych przykładów regionalnych dobrych praktyk w zakresie rozwiązań e-zdrowia. Podsumowanie rozważań i kierunki dalszych badań kończą niniejszy tekst.
The article aims to the issue of the impact of e-health tools to improve access to medical services in the region. Based on the literature and current legislation the concept of e-health and the benefits of this type solution are explained. The newest trends in the implementation of e-health tools are presented. Regional variation of infrastructure conditions of ICT implementation in health care are shown based on the statistical data. In the second part of the article a brief overview of selected examples of regional good practices in the field of e-health solutions is presented. Summary of considerations and directions for further research ends this text.

The purpose of this work is to analyze the regulatory environment for tobacco use, with particular reference to changes made in the last 10 years. An attempt was made to answer the question of the extent to which the regulatory environment has a real impact on the achievement of the objective set out in the existing legal provisions, which is to protect the health and rights of the persons concerned. An analytical method was used in the work to assess the application of legal principles. A method of analyzing the current line of jurisprudence was also used. In the process of final evaluation of public utilities, certain functional methods were used. The assessment was subjected to Polish law, within the scope of the currently binding Act on Health Protection Against the Consequences of Using Tobacco and Tobacco Products of 1995. The study states that the provisions of this Act are only a formal guarantee of protection. The liability arising from the application of its standard is illusory because the procedure for imposing penalties is ineffective. The pursuit of any property claims related to violation of the rights of related entities, as envisaged in this Act, is complicated. This does not apply to a case which is not affected by the decision.

Opis:

Economic development of nations leads to a higher living comfort of the society. Rich societies want to move safely and independently and demand immediate availability of purchased goods or – in the case of Internet shopping – delivery in the shortest possible time. Such an approach facilitates a continuous growth in the number of road vehicles. At the current level of technology advancement, an increasing number of vehicles results in a growth of the consumption of fossil fuels, which entails increased exhaust emissions and that, in turn, has a negative impact on the health of the living organisms. Another negative consequence of an increased number of vehicles (increased road congestion) is the emission of noise. This problem is particularly significant in large agglomerations where people are surrounded by moving vehicles. This paper presents the extent of influence of the automotive industry on the natural environment and the extent of changes in vehicle design and organization of road infrastructure that were instituted to reduce the transport’s environmental burden. The further part of the paper presents a definition of the development of sustainable transport, its advantages and hurdles that we may encounter when modernizing a transport system. Subsequently in the paper, the measurements under actual vehicle operating conditions were described together with the possibilities of analysis of the research results and the advantages resulting from such an approach during the assessment of the impact of the automotive industry on the natural environment.

The SARS-CoV-2 coronavirus pandemic has changed how almost every sphere of our lives functions. Its greatest impact can be seen in the functioning of the health care sector, whose task was not only to care for the sick or people suspected of infection, but also to take all measures to prevent the spread of infections. The imposition of a state of epidemic threat in Poland, and then the state of epidemic, provided a basis for imposing a number of restrictions that had a significant impact on the realisation of patients’ fundamental rights. The purpose of the considerations is to present and analyse the limitations of selected patient rights during the SARSCoV-2 pandemic. This article first presents issues related to patient rights in genere, emphasizing their importance for the proper functioning of the health care system in the country. Next, the limitations of selected patient rights, which unquestionably occurred in the era of COVID-19, are presented. It is shown that the rights indicated were not only limited, and sometimes even excluded. The article also presents an analysis of the annual reports of the Patients’ Rights Ombudsman, which in their content confirms the great increase in the number of violations of patient rights in the period of SARS-CoV-2 pandemic. Consequently, this resulted in a far-reaching negative impact on the perception of the health care system in our country.

Opis:

The SARS-CoV-2 pandemic has undoubtedly become a challenge for all lawmakers around the world - implying, among others, the need to introduce restrictions on freedom of expression due to health protection. Different countries dealt with this challenge in various ways, which was influenced not only by the systems in force in these states, but also by the specific characteristics and conditions of these countries. Hence, the purpose of this study is to answer how did the pandemic affect the legal situation in the Republic of Poland, with particular attention being paid to: 1) statements whose purpose or effect was to make it difficult or impossible for the state to perform the obligations implied by "health protection"; 2) statements substantively contesting the official information policy of the state on pandemic issues; 3) statements of representatives of the authorities, which are a reaction to the expression referred to above in points 1 and 2. Of course, this study - due to the modest volume - does not pretend to be exhaustive. Its purpose is only to outline the title topic and related issues.

The article presents the issues of legal regulation of termination of pregnancy in the context of the jurisprudence of the Constitutional Court (CC), in particular the ruling in the case K 1/20.The discussion opens with an analysis of models of abortion practices regulations, as well as the solutions adopted in the Polish legal system, with a short historical introduction. It is emphasized how important is the issue, which results from the fundamental differences in worldviews between the supporters and opponents of the permissibility of the practice of termination of pregnancy, which is expressed in the name given to this medical practice.The right to life as an element of the human rights system is discussed, both in terms of international law and the provisions of the Polish constitution.Next, the Polish provisions on the admissibility of termination of pregnancy are presented along with a historical outline, with particular emphasis on the ruling in the case K 26/96. Based on the above discussion, the resolution in the case K 1/20 was discussed, in which the CC found the so-called embryopathological premise for termination of pregnancy to be incompatible with Polish Constitution. A polemic with the justification of the decision is presented, including the errors of interpreta-tion committed by the CC with regard to the constitutional and international form of the right to the protection of life. It is indicated that in the Polish legal system only the right to protection of life exists, not the right to life, which is referred to both by the CC and most of the doctrine.Despite the fact that this resolution does not remove the norm from the legal system, the author draws attention to the practical consequences of issuing it, in particular the occurrence of the so-called ‘chilling effect’ and unjustified activity of the law enforcement authorities.The final part of the article presents conclusions on how to legally regulate the termination of pregnancy.

Głównym celem prezentowanego artykułu jest odpowiedź na pytanie, jakie znaczenie w powojennej polityce zdrowotnej państwa i w społecznym postrzeganiu problemów zdrowotnych miały choroby nowotworowe. Jako choroby cywilizacyjne dotykające w coraz większym stopniu ludzi na całym świecie z uwagi na swą „tajemniczość” i wysoką śmiertelność, budziły z reguły wiele lęków i uprzedzeń. W jakim stopniu i formie lęki te dostrzegane były również w powojennym społeczeństwie polskim i jaki wpływ na ich występowanie miała polityka zdrowotna państwa (oświata i infrastruktura onkologiczna, programy rządowe) – to główne pytania, na które odpowiadam w tekście. “When the C-word is uttered, people began to whisper”. A social history of cancer in Poland after 1945 The main subject of research presented in the article are the ways of perceiving malicious tumour diseases by the society, medical community and the state authorities responsible for the health protection policy. The text brings up both the questions of registering and increasing cancer rates, and changing attitude of Polish people to oncologic care. On the basis of archival sources, both the press articles and narrative texts, the author outlines problems with the oncology education, extremely limited before the 1970s, and with popular social belief (and fears) related to cancerous diseases. An important element of the analyses are also limitations of the public health infrastructure of the contemporary People’s Poland and lines of the so-called “cancer policy” defined in the form of Governmental Programme against Cancerous Diseased (PR6) launched in 1976.

Ochrona zdrowia jest jednym z najważniejszych obszarów polityki społecznej każdego państwa. Choć usługi medyczne z uwagi na swój charakter mogą istnieć jako dobra prywatne, w większości krajów świadczenia zdrowotne są, w mniejszym lub większym stopniu, dostarczane przez sektor publiczny i wykorzystywane zbiorowo przez społeczeństwo. Celem niniejszego artykułu jest analiza wydatków na ochronę zdrowia w Polsce, ze szczególnym uwzględnieniem finansowania ochrony zdrowia w ramach sektora publicznego oraz prywatnego. Za hipotezę przyjęto, iż wzrost wydatków na ochronę zdrowia prowadzi do rozwoju prywatnego sektora opieki zdrowotnej. W wyniku wykonanej analizy wskazano, iż wzrost wydatkowania na ochronę zdrowia może się stać impulsem do rozwoju prywatnego sektora opieki zdrowotnej.
Health protection is one of the most important topic of social policy of each country. Although medical services, can exist as private goods, in most countries health services are mostly provided by the public sector and used collectively by society. The purpose of this article is to analyse the healthcare expenditures in Poland, with particular emphasis on financing health care within the public and private sector. The hypothesis assumes that the increase in health care expenditure leads to the development of private health care sector. As a result of conducted analysis, it was pointed out that the increase in spending on health care could become an impulse for the development of private health care sector.

Opis:

Purpose: The authors analyze the decisions made from March to September 2020 which affected the functioning of Polish health care facilities. According to the authors, that period determined and significantly influenced the decisions taken by state authorities during the subsequent waves of the SARS-CoV-2 pandemic. Design/methodology/approach: The analysis of the issue presented in the paper will be a descriptive one. The research exploration will be carried out using the desk research method. Findings: Analyses of secondary and compilation documents showed that the authorities of the Republic of Poland were not prepared to manage the state in unprecedented conditions caused by the first wave of the pandemic, and the decisions taken at that time by public administration bodies were chaotic, not always well thought out and often influenced by public opinion. Originality/value (mandatory) The article can be considered original due to the fact that it combines an analysis of Polish legal acts issued during the first wave of the COVID-19 epidemic with, above all, an analysis of their social effects. The analyses showed that Polish authorities were not prepared for the pandemic crisis. The article is addressed to state administration employees as well as employees and students of universities with majors in national defense, public safety, medicine, medical rescue and public health. It may become a basis for developing legal acts of a preventive nature, which can be immediately applied in the event of another epidemic.

Ponadto przeprowadzono analizę i ocenę wskaźników udziału kosztów bezpieczeństwa pracy i ochrony zdrowia w ogólnych kosztach ZZL oraz wskaźników efektywności zarówno wśród przedsiębiorstw o dobrym poziomie ZZL i pozostałych, jak i w przedsiębiorstwach ujętych w trzech dużych grupach działalności.
This article presents research on the effectiveness of human resources management (HRM) in companies in terms of occupational safety and health. The study was conducted in 25 companies. It analysed HRM including OSH and prevention costs. Moreover, HRM costs of OSH within the overall costs of HRM were analysed and evaluated as were the level of effectiveness in companies with a good HRM level and other ones (and in companies described by 3 groups of activity).

Physical agents cause several physical and mental health disorders and reduce human capability for work, in most severe cases they cause disability. Usually the influence of these physical factors takes place in the work environment and depends on the factor’s intensity, exposure time, and individual characteristics. Influence is cumulative and may manifest itself after a long period of time, in several years. It is recommended to follow internationally recognized limit values of factors and introduce medical control of people before they start working as well as periodical medical control. From the most widespread risk factors, this article deals with noise with the data obtained from objective studies on Estonia.

It is mandatory, in the light of legal provisions, that all important information should be saved in personal medical documentation of a patient. This procedure is of vital importance, because it not only records the medical treatment of a given patient applied by medical staff, but it also provides a form of mutual informing on the patient’s condition during diagnosis and therapy. The procedure for creating and providing access to medical documentation has not been audited by NIK to date. However, pre-audit examination revealed that the manner in which such documentation is kept does not meet the current standards, and that patients have difficulties with accessing their documentation when they wish to continue treatment at another medical entity, or when they claim that a doctor has made a mistake during therapy.

The right to use health services, including spa treatment, is one of the basic patient rights. The specificity of the issues undertaken stems from at least two sources. First of all, patients are a special category of people, because human health, as the highest value possessed by every human being, is subject to legal protection and requires their rights and freedoms are guaranteed. Secondly, spa treatment, which is an integral part of the health care system, corresponds to art. 68 of the Polish Constitution, assuming the fundamental principle according to which every citizen has the right to health care. On the other hand, this treatment means providing health services, which are conducted only in a separate area of the spa commune – a spa and in specially adapted medical entities – spa treatment centers. The study covers the concise genesis of patient rights and the notion of the patient in terms of doctrine and legislation. Moreover, it contains the basic concepts related to spas. Recognition of the health needs of society is associated with a presentation of the individual types of spa treatment centers and spa treatment facilities, as well as the necessary conditions that they should meet. Due to the existing different status of patients in spa treatment institutions, the analysis covers the basis for admission, for referring and qualifying patients to these centers, and also the rules for using services guaranteed in the field of spa treatment. The patient’s right to health services is also examined in the context of using these services. Despite the fact that patients’ interest in this form of treatment increases every year, as is shown by the available data, there are a number of legal and organizational problems related to access to treatment as part of spa services.

Abstract: The author has undertaken to classify the legal instruments of environmental protection of in a health resort municipality (a spa commune) in Poland, regarding the aspect of their impacting the state of protection of natural environment. A spa commune has at its disposal a catalogue of its own tasks, which is complemented by those connected with maintaining medicinal functions of the spa and with meeting the requirements of the environment. The analysis of the content of regulations of law on environmental protection allows concluding that in relation to spas there are no – in principle – separate legal norms which regulate questions connected with protection of environment. While identifying the legal instruments of environmental protection, it was necessary to take into account a few normative areas, on the basis of which the following groups of instruments were distinguished: regulatory and “police” type, planning, control and financial. In the study, some selected legal and comparative aspects were also taken into consideration.

The article concentrates on the main reasons for the weak development of medical insurance in Ukraine and prospects for introducing medical insurance there. The author examines worldwide practice of medical insurance as a part of a system of medical support. Based on the analysis of international experiences and Ukrainian developments, the author emphasizes the gradual introduction of medical insurance in Ukraine.
Tematem artykułu jest analiza głównych przyczyn słabego rozwoju ubezpieczenia zdrowotnego na Ukrainie i możliwości jego dalszego rozwoju. Ze względu na konieczność dostosowania działań ochronnych do zagrożenia oraz potrzebę ich harmonizacji, wojewoda może również, w przypadkach ustawowo przewidzianych, podejmować czynności kierownicze i koordynacyjne na obszarze regionu. Jest on organem, który posiada szerokie kompetencje pozwalające mu kształtować terenowy system bezpieczeństwa na poziomie wojewódzkim.
One of the fields in which public administration performs its task is security. The voivodeship governor is a part of public administration as they are equipped with security measures related to public order and the protection of life and health. They undertake actions to prevent, control and deal with extraordinary situations and their consequences. Due to the need to adapt protective measures to the threat and the need to harmonize them, in cases provided by the law, the governor may also undertake managing and coordinating activities in the area of the region. It is a body that has broad competencies to shape the field safety system at the voivodeship level.

W artykule przedstawiono znaczenie etyki zawodowej w zapewnianiu i utrzymaniu właściwego poziomu bezpieczeństwa i ochrony zdrowia w życiu obiektu budowlanego.
Safety and health protection at work during the implementation of investment processes in construction is becoming increasingly important. The processes during which construction works are created are characterized by a high level of threats to the health and life of participants taking part in the implementation of a construction project. These hazards are the result of improperdesign, construction of the building and its use, working conditions, high variability of weather conditions and employee behavior resulting from applicable legal requirements, principles and culture of work safety or omission of broadly understood security issues related to the object. The article presents the importance of professional ethics in ensuring and maintaining an appropriate level of safety and health in the life of a building.

Life and health as fundamental matters are major concerns for every human being. To this end, he / she should be assisted by the community in which they live. If the foundation of social life is the personalistic principle, the recognition of the primacy of the dignity of the person, among other values, is constructed on the principles of subsidiarity and solidarity. It is the role of the healthcare institution to create such conditions, in which the safest and the most effective methods of treatment and prevention are available, and the individual can consciously select which of these realises his or her good to the greatest extent, in accordance with the recognised hierarchy of values, the accepted worldview, and life goals. The aim of this article is to analyse the relationship between the community and the individual, in the field of healthcare, under normal conditions and during epidemics. The existence of specific threats may suggest that exceptions to the fundamental rules of social life: autonomy, subsidiarity, and social solidarity, are permissible. However, the recognition of the fundamental value of the dignity of the person, requires the community to apply the same rules as in normal times, although many activities of public institutions are intensified in times of more serious danger.
Życie i zdrowie jako dobra fundamentalne są ważnym przedmiotem troski każdego człowieka. Powinien on cieszyć się w tym pomocą ze strony społeczności, w której żyje. Jeśli fundamentem życia społecznego jest zasada personalistyczna, uznanie pierwszeństwa godności osoby wśród innych wartości, budowane jest ono według reguł pomocniczości i solidarności. Zadaniem instytucji ochrony zdrowia jest stworzenie takich warunków, w których dostępne będą możliwie bezpieczne i skuteczne metody terapii i prewencji, a jednostka w sposób świadomy będzie mogła wybrać to, co w największym stopniu realizuje jej dobro, w zgodzie z uznaną przez siebie hierarchią wartości, przyjętym światopoglądem i życiowymi celami.Celem artykułu jest analiza relacji między społecznością i jednostką w dziedzinie ochrony zdrowia w stanie normalnym i podczas epidemii. Istnienie szczególnych zagrożeń może sugerować, że dopuszczalne są wyjątki od stosowania fundamentalnych reguł życia społecznego: autonomii, pomocniczości i solidarności społecznej. Uznanie jednak podstawowej wartości, jaką jest godność osoby, nakazuje stosowanie przez społeczność tych samych reguł, co w czasie zwykłym, jakkolwiek wiele działań instytucji publicznych jest w czasie większego zagrożenia intensyfikowanych.

Artykuł ukazuje obraz Ostrołęki i powiatu w czasach młodości Wiktora Gomulickiego tj. w połowie XIX wieku. Przedstawiona jest zarówno gospodarka jak też infrastruktura społeczna i życie mieszkańców. Ostrołęka była wówczas siedzibą powiatu stanowiła centrum administracyjne oraz handlowo usługowe dla sąsiednich terenów. Kondycja gospodarcza miasta po zniszczeniach w czasie powstania listopadowego, szczególnie bitwy rozegranej 26 maja 1831 roku, była słaba. Również warunki bytowania mieszkańców powiatu były bardzo ciężkie. W miejsce zajęć typowo puszczańskich ( myślistwo, bartnictwo, bursztyniarstwo) wchodziły zajęcia rolnicze (uprawa roli, hodowla zwierząt), co jednak ze względu na niską jakość gleb przynosiło stosunkowo niewielkie korzyści mieszkańcom. W artykule oprócz ogólno dostępnych opracowań wykorzystane zostały, nieznane dotychczas, materiały archiwalne, przede wszystkim z Archiwum Głównego Akt Dawnych, Archiwum Łomżyńskiego oraz Pamiatniaja kniżka łomżinskoj guberni. Szczególnie interesujące są informacje o budowie Szpitala Powiatowego oraz donacji księdza Wojciecha Dłużniewskiego.
The author of this article points out the picture of the Ostroleka district as well as the town in the time of Wiktor Gomulicki youth. He presents the economy, social infrastructure of citizens’ lives. Ostroleka was treated centre for neighbouring areas. The economic condition of Ostroleka was weak especially after devastations of November Insurection and the Bathe of Ostroleka on 26 th may 1831. The conditions of inhibitions’ existence was also very hard. The primeval forest styles of lives (hunting, wild-bee keeping) ambering animals but the poor-quality soil yielded small benefits for dwellers. The writer used not only the common and well – known papers and studies but also the unknown archives. They included information from Archiwum Główne Akt Dawnych (the Main Archive of Ancient Acts), Archiwum Łomżyńskie and Pamiatniaja uniżka Łomżinskoj guberni. The most interested information is about building of hospital (Szpital Powiatowy) and donation of priest Wojciech Dłużniewski.

Opis:

The article presents considerations on the impact of the interpretation of the constitutional right to health protection on the functioning of the public health care system. The issues include the discrepancy between the literal interpretation of the constitutional norm and the interpretation of the Constitutional Tribunal. The inconsistency of the application of a constitutional norm in legislation leads to inequality in accessing health services for some groups of citizens and affects to some extent the financial stability of health providers. To ensure higher efficiency of constitutional norms, it is necessary to analyse their socio-economic preconditions and to reflect on the effects of their introduction into the legal system. Otherwise, a dead law is created, which is interpreted in accordance with the currently applicable lower-level legal acts.
W artykule przedstawiono rozważania dotyczące wpływu wykładni konstytucyjnego prawa do ochrony zdrowia na funkcjonowanie publicznego systemu ochrony zdrowia. Rozpatrywane zagadnienia obejmują rozbieżność pomiędzy wykładnią językową normy zawartej w Konstytucji RP i jej uwarunkowaniami, a wykładnią Trybunału Konstytucyjnego. Niekonsekwencja stosowania normy konstytucyjnej w legislacji prowadzi do nierówności w dostępie do usług zdrowotnych dla niektórych obywateli oraz wpływa w pewnym stopniu na stabilność finansową świadczeniodawców zdrowotnych. Dla zapewnienia wyższej efektywności normom konstytucyjnym konieczne jest wcześniejsze rozeznanie ich uwarunkowań społeczno-ekonomicznych oraz namysł nad skutkami ich wprowadzenia do systemu prawnego. W przeciwnym razie powstaje prawo martwe, każdorazowo interpretowane zgodnie z aktualnie obowiązującymi aktami prawnymi niższego rzędu.
