Condemnation to the school of gladiators (damnatio in ludum) was one of the most intriguing penalties in Roman Criminal Law. Condemned were sent to ludus to train gladiatorial skills and fight during the games. Of course, its existence was closely connected with ludus, and thus it appeared in public law in I century b.C., after the gladiatorial schools were widely built (at least from 105 b.C. – Val. Max. 2, 3, 2; Cic. Tusc. 2, 41; Plin. Nat. 33, 16). From I century A.D. on, it was definitely quite common penalty (Plin. Epist. 31; lex Petronia de servis). The most important thing however is, that it was not a death penalty – it deprived condemned of liberty, they became slaves, and also they had to stay in ludus, as in the prison (D. 48, 19, 8, 11; P. S. 5, 17, 2), but they did not have to die during the games. Even more, after three years of service they could be liberated from the penalty, and after another two years – regain their freedom (Coll. 11, 7, 4). As it was a general rule in Roman Criminal Law, slaves and humiliores could be condemned in such a way (D. 48, 19, 8, 12; P. S. 5, 23, 4). Damnatio in ludum was very similar to damnatio ad metallum, so one can draw some conclusion on such comparison. Some authors suggest, that criminals were condemned to ludus in cases of sacrilege, arson, homicide, robbery and desertion (thesis based probably on Quint. Decl. Mai. 9, 21 and Flor. 2, 8, 8), but closer analysis of Roman legal regulations shows, that it was a penalty of lesser crimes or mitigation of punishments (D. 48, 13, 7; P. S. 5, 20, 2 and 5; P. S. 5, 23, 4; D. 49, 16, 3, 1; D. 48, 19, 28, 15). Though from one point of view it was a severe penalty, resulting in death sometimes, in general it may be compared with damnatio ad metallum and other non-lethal penalties. The discipline in ludus might have been cruel and hard, but there was also a chance to survive the time of punishment (according to some even in case of loss during games - missio) and regain freedom, not to mention quite good physical care like attention of doctors or massages. Its close connection with gladiatorial games was also the reason of its disappearance from Roman Criminal Law, as late as the end of IV century A.D. (C. Th. 15, 12, 1; C. Th. 9, 40, 8; C. Th. 15, 12, 3).

In Ancient Rome, there was a group of penalties closely connected to gladiatorial games, like damnation to the beasts (damnatio ad bestias), damnation to the school of gladiators (damnatio in ludum) and, the object of this paper, damnation to gladiatorial games (damnatio ad gladium ludi). As it seems, on the basis of very few textual sources, the latter was a kind of death penalty executed in the arena at noon. The condemned were supposed either to kill each other with sword, either be executed by one of them or a professional gladiator. The most interesting however is the form of functioning of this phenomenon. It looks that Roman Criminal Law did not know this penalty, there is only one doubtful legal source, which may refer to it. On the other hand, it is hard to deny its existence – quite a few historical sources confirm, that at noon a number of condemned were killed in the arena. As it seems, there was a variety of forms of executions in Ancient Rome, which took place during the gladiatorial games. They depended mostly on the discretional power of the organizer of the games and the will of the people. Damnatio ad gladium ludi was a collective category for all of them, no matter what the actual sentence stated, whether it was crucifixion, burning alive or other death penalties. In that way, it was possible to present in the arena mythological and historical enactments known from the sources.

Damnatio ad bestias is definitely one of the most amazing institutions of Roman criminal law. It was an aggravated form of death penalty used in public procedure, mostly against noncitizens and humiliores, from I century a. D. As it seems however, it had already appeared before in domestic jurisdiction of the owners of the slaves, in the frames of ius vitae ac necis, but not as a death penalty. Such slaves were sold to lanistae in order to fight with wild animals. The interesting point about damnatio ad bestias is, that it was omitted in the legal catalogues of inflicted penalties. It was the consequence of its characteristic – it depended on organization of the games and some infrastructure, like amphitheatres or animals. So there were just few occasions during the year to inflict this penalty. Other aggravated forms of death penalty, crucifixion and burning alive, were equivalent and could be inflicted interchangeably with analyzed punishment, despite few exceptional texts. Damnatio ad bestias could be also executed in the situations of aggravation of perpetrator’s responsibility resulting from the use of arms, in cases of organized crimes or committed by night. Sometimes it was also replacing other traditional penalties, like for example poena cullei.

In the field of taxation there existed many casuistic crimes of Roman criminal law, committed both by tax payers and tax collectors, but non-payment of taxes was not one of them. As a rule taxpayers risked confiscation of property by avoiding the fulfillment of their obligation. There exists some historical evidence, however, which suggests the possibility of imprisonment of taxpayers. Was it possible to inflict criminal punishments in such cases? Legal texts give some reflections to the contrary– Roman emperors prohibited the use of imprisonment in non-criminal matters. The number of these prohibitions indicates, that there were many situations of this kind. It seems that especially in the provinces the governors abused their power and used illegal measures, such as tortures, whipping and imprisonment, to force citizens to pay taxes.

Do źródeł poznania szariatu, oprócz Koranu oraz tekstów sunny, należą również dzieła jurysprudencji islamskiej. Umdat al-Salik jest podręcznikiem tego świętego prawa napisanym w XIV wieku n.e. przez Ahmad ibn Naqib al-Misriego i jest jednym z najbardziej godnych zaufania dzieł szafickiej szkoły prawniczej. Jego tłumaczenie na język angielski dokonane przez N.H.M. Kellera zostało uznane przez autorytety świata muzułmańskiego za dzieło wartościowe i wiarygodne. Uzyskało również akceptację rządów kilku państw muzułmańskich. Podręcznik ten zawiera między innymi opis szczegółowych regulacji dotyczących najpoważniejszych przestępstw prawa islamskiego - hudud. Bezpośrednio godzą one w islam oraz całą społeczność muzułmańską, a karane są z mocy boskiego nakazu. Źródłem ich penalizacji każdorazowo musi być Koran lub sunna. W ich wypadku sędzia nie ma swobody w zakresie wymiaru kary, stwierdza jedynie winę oskarżonego, a sankcja karna jest sztywno określona w źródłach i nie można jej zmienić. Zaliczyć można do nich: cudzołóstwo (zina), oskarżenie o cudzołóstwo bez wymaganych zeznań świadków (qadhf), kradzież (sariqa), rozbój (hirabah albo tariq), picie alkoholu (khamr), bunt przeciw kalifowi (baghy) oraz apostazję (riddah).
Islamic jurisprudence is one of the sources of information on Sharia law, alongside the Quran and the Sunnah. The Umdat al-Salik is a manual of this sacred law composed in the 14th century by Ahmad ibn Naqib al-Misri, and it is one of the most trustworthy works of the Shaf’i school of law. Its English translation by N.H.M. Keller has been acknowledged by as Islamic authorities invaluable and reliable, and it has also earned the recognition of the governments of several Muslim countries. Al-Misri’s manual contains regulations concerning the hudud, the most serious offences under Islamic law. Hudud crimes directly offend Islam and the Muslim community as a whole, and are punishable on the grounds of Allah’s will. Hence the source of their penalization must always be the Quran or the Sunnah. A judge has no discretion in selecting a penalty for a hudud crime, because it is prescribed in the sources and is immutable. Te hudud crimes are adultery (zina), the bringing of an accusation of adultery without producing the required statements from witnesses (qadhf), theft (sariqa), armed robbery (hirabah or tariq), drinking alcohol (khamr), rebellion against the caliph (baghy) and apostasy (riddah).

Dzieła filozofczne stanowią jedno z ważnych źródeł poznania praw antyku. Pośród nich Etyki Arystotelesa zasługują na szczególne wyróżnienie. Bogactwo i dojrzałość jego myśli inspirować mogą do refleksji nad obowiązującym systemem prawa. Filozof poświęca znaczną część swoich rozważań rozróżnieniu działań zależnych i niezależnych od woli człowieka. Na ich tle czyni kilka ważnych uwag na temat oceny moralnej czynów popełnionych pod wpływem emocji, które odnieść można do ich oceny prawnej. W jego refleksjach wybrzmiewają też reminiscencje szerokiego wachlarza współczesnych instytucji prawa karnego: od zagadnień związanych z pojęciem czynu, rodzajem i stopniem winy sprawcy oraz przymusem i brakiem świadomości, po bardziej wysublimowane kwestie, jak niepoczytalność, zawinienie na przedpolu czynu czy właśnie czyny popełnione w „afekcie”.
Ancient works on philosophy are an important source of information on the laws observed in Antiquity, and Aristotle’s Ethics is a special instance of this phenomenon. The abundance and maturity of his ideas on the law may inspire reflection on our current legal system. Aristotle devotes a considerable part of his Ethics to the distinction between voluntary and involuntary acts. He uses this discussion as a background to some important remarks on the moral assessment of acts committed under the influence of emotions which may relate to their legal evaluation. His reflections hark back to a wide range of the criminal law institutions of his times, such as the ancient concept of an offence and issues related to this, the type and degree of the offender’s guilt, his acting under duress or lack of awareness, as well as more sophisticated issues such as insanity, culpability prior to the commission of the offence, and crimes of passion.

Drunkenness – a “Passion” in Roman Criminal Law?SummarySince ancient times jurists and lawyers have had to handle offencesconnected with alcohol abuse. There are only three texts on drunkenness in the Roman legal sources: two relate to offences committed byinebriate soldiers, and the third contains the basic division into intentional offences, accidental offences, and crimes of passion. In all threecategories drunkenness was a mitigating factor, which may be surprising for modern lawyers. Other Roman sources present public opinionon drinking, which seems to have depended on the circumstances– heavy drinking and alcoholism were disapproved of. A precise analysis of the rhetorical writings shows elaborate distinctions betweenintentional and unintentional acts. Drunkenness was regarded as anemotional state which could influence the penalty, but the specific circumstances of the offence were crucial. The rhetorical works confirmthe views presented in poetry and philosophy. Contrary to the legalsources, the facts seem to show that a judge could sentence an offenderto a severe or mild punishment, or even acquit him if drunkenness hadbeen a factor contributing to the offence. The rhetorical works may beconsidered to provide not only an important theoretical background tothe legal sources, but also crucial supplementary information givinga better insight into Roman criminal law.

The opinion that Roman jurists were giants in the field of private law and dwarfs in criminal law is nowadays a little bit out of date. However, upon a closer analysis of the use of the term ‘accident’ (casus), such a statement seems to be justified. Casus for Roman jurists was not only, as in the sphere of private law, a pure random fact, but also a culpable human act. It is not hard to guess that their writings and opinions were inconsistent in that field and sometimes suggested quite surprising legal classifications of deeds committed in such a way. In order to understand this paradox it might be helpful to take a closer look at historical regulations of crimes committed unintentionally, including above all homicide, but also rhetorical sources, especially works of Cicero. His writings were a canon for learning rhetoric in later times, as well as inspiration for next generations of Roman jurists. His remarks and specific character of the metaphorical phrase si telum manu fugit quam iecit, constituting a kind of definitional topos of crimes committed unintentionally, can lift the veil of secrecy and enable penetration of Roman jurists’ philosophy of life and their intellectual formation.

In the 14th-century treatise Ars cantus mensurabilis mensurata per modos iuris, the principles of menstrual music are explained by references to ius commune. This article aims to trace their Roman roots and to show that music too is sometimes governed by Roman law.

Following paper introduces the nonlinear method of determining the velocity of a vehicle before the impact-the Equivalent Energy Speed (EES). To estimate the magnitude of EES, the method utilizes the deformation work Wdef of the vehicle, defined by the quotient of deformation coefficient Cs and plastic deformation. Combined with the introduction of the B-spline tensor products and least square approximation with probabilistic weights, method shows promising results.

Detailed analysis of literature showed that there is no method that can be used in order to investigate skid marks left by vehicles equipped with ABS. Authors decided to identify braking trace by using IR spectroscopy. Preliminary studies have been performed and results were promising. Due to that fact authors decided to conduct detailed research where the influence of various factors on the possibility of revealing breaking traces would be taken into account. This article is the first in a series of articles taking into account the influence of various factors on the possibility of revealing breaking marks using IR spectroscopy. In this article the influence of the type of asphalt was studied. Authors conducted tests with the most popular types of asphalts used for the wearing course. 100 samples from 5 different types of asphalt were prepared. Each sample was measured 3 times to create its spectrum. The results were analyzed thoroughly using the dedicated SpectraGryph software. The analysis showed that for 4 out of 5 types of tested asphalt, the braking traces were visible at a wavelength of approximately 11 500 nm. Only for the rubberized asphalt there weren’t possibility to reveal skid mark.

This paper presents calculations of the theoretical cycle of engines with an active combustion chamber depending on energy delivery and dissipation. In the case of ACC engines, a different calculation approach is required to account for the possibility of additional volume change, independent of the piston-crank system. The introduction presents a schematic diagram of volume change, accomplished by two independent piston-crank systems and an active combustion chamber, as proposed by the authors. Moreover, the diagram, which is the basis for analysis in this paper, illustrates characteristic points of the cycle. In existing theoretical cycles of combustion, this issue does not present any difficulties, since the solution is exact and based on known equations. In the case of theoretical ACC engines, however, the situation is different, since this engine can perform not only in typical cycles, but also in new ones. To explain the challenges of these new cycles, authors present a few of the most probable calculation variants, taking into account the new kinematic capabilities of ACC engines. Each comment justifying the choice of a certain calculation variant is illustrated with a theoretical cycle figure and closest approximation of induced pressure course of the ACC engine. At the same time, however, the authors show that this problem can have many interpretations. It has been concluded that the solution depends on the assumptions made about the active combustion chamber, namely its principle of operation.

Abstract In this article Authors present the continuation of the calculations for theoretical ACC engine cycle, considering additionally “VCR function” – changeable compression level. For this purpose the self-acting volume change, realized by ACC system, was used. The ACC system was adjusted appropriately to control the compression level. The analysis is based on three cases, representing delayed, premature and optimal reaction of ACC system. Reactions are presented in form of plots with indicated pressure in the combustion chamber. As the result of the conducted analysis and interpretation of obtained graphs, the calculation approach of compression ratio for ACC presented in previous article is being challenged. For the optimal reaction of ACC system, the theoretical operation schematics are devised and presented in the key points of the work. Based on the schematics, the values of theoretical efficiency were calculated for different cycles of theoretical ACC engine, in which regulation of compression ratio takes place. Moreover, the presented analysis includes graphs with optimal courses of indicated pressure for significantly different work parameters of ACC engine, showing its regulation possibilities. Also the time scaled graphs (with millisecond as basic time unit) are presented to show the possibilities of dynamic ACC systems, which are comparable with the combustion time (from 3 to 0,5 ms). In this paper the general discussion is started about the compression ratio in more complex kinematic systems including ACC.

Presented paper discusses a new, nonlinear approach to EES (Equivalent Energy Speed) parameter determination in frontal car collisions. This method is based on tensor product of Legendre polynomials and in this case considers Luxury car class. Methods that are used up till now are based on a linear dependency between mass, velocity and deformation. This is of course a simplification that was necessary, due to limitation in computation power of computers when this method was introduced decades ago. The contemporary resources allowed Authors to develop a much more sophisticated method. The mathematical model was developed using data shared by National Highway Traffic Safety Administration (NHTSA). This database covers a large number of test cases along with various information including vehicle mass, crash velocity, chassis deformation etc. New method proves to be more accurate than the currently used approach utilizing linear dependency of deformation force and deformation of the vehicle.

Opis:
Transport of fresh or powdered chicken eggs uses conveyors with elements made of steel or plastics, and surfaces often coated by Teflon. Various forms of eggs contact with said surfaces and are subject to friction processes between them. The frictional resistances cause a load on the devices driving the conveyors and a local and temporary increase in temperature in the contact zones and allow the abrasive wear of both the surfaces of the conveyors, packages and the eggshells themselves. This study aimed to determine such the coefficient of friction and wear intensity at various contacts. The friction and wear tests were conducted on two tribotesters and the results are shown in the article.
Transport świeżych lub sproszkowanych jaj kurzych wykorzystuje przenośniki z elementami wykonanymi ze stali lub tworzyw sztucznych, a powierzchnie często pokryte teflonem. Różne formy jaj stykają się ze wspomnianymi powierzchniami i podlegają procesom tarcia między nimi. Opory tarcia powodują obciążenie urządzeń napędzających przenośniki oraz lokalny i tymczasowy wzrost temperatury w strefach styku i pozwala na zużycie ścierne powierzchni przenośników, pakietów i samych skorupek jaj. Badanie to miało na celu określenie takiego współczynnika tarcia i intensywności zużycia w różnych stykach. Testy tarcia i zużycia przeprowadzono na dwóch tribotesterach, a wyniki pokazano w artykule.

The drive from the crankshaft to the camshaft in an internal combustion engine is usually carried out by means of a cogged belt transmission or a chain transmission when high millage is required without service operations. The valvetrains in CI engines sometimes use the gear transmissions, and the historical rather bevel gear can be found in old cars of collectors or in some motorcycle engines. The chain gear used in SI engines has a two- or three-row chain with high strength, due the unevenness of loads that additionally induce chain pulling and valve timing deregulation. The chain transmission requires the use of pre-tensioners, usually self-acting and driven by springs or oil pressure. The vibrations and chain runout are limited using plastic guides placed on the outside of the long straight sections of the chain. The model of the chain transmission developed with the use of the Finite Elements Method, which operates under oil lubrication conditions, was analyzed. Such the model allowed obtaining weight and mass inertial moments of components. The aim of the study was to evaluate the effect of SiO2 nanoparticles content in engine oil on the friction between chain transmission components. The resulted values of the friction torque in the chain transmission operating in different conditions of lubrication have been presented in the paper.

This paper presents the possible use for IR spectroscopy to reveal skid marks left by cars equipped with Anti-lock Braking System. Detailed analysis of literature showed that there is no method that can be used in order to investigate this kind of tire marks. Up till now only two techniques have been devised. The first one is Method of Image Refinement which consists of transforming the image from the scene of the accident using dedicated graphics software. Second method includes analysis of traces using a thermal imaging camera. This study presents an innovative approach to the problem. Numerous analyses using IR spectroscopy were conducted to check the suitability of this method. The research performed on a Thermo Scientific FTIR Nicolet iS50 Spectrophotometer with an ATR attachment. 40 samples from 10 different types of asphalt were prepared. Each sample was measured 3 times to create its spectrum. The results were analyzed thoroughly using the dedicated SpectraGryph software. Analysis show that the wavelength which makes the braking marks visible is found within the mid-infrared range. Finally, it was found wavelength in which skid marks should be visible. This range is located in the mid-infrared.

Presented paper discusses two different nonlinear approaches to precrash velocity determination for vehicles from Intermediate Car Class. Data that was used to perform analyses introduced in this paper was taken from National Highway Traffic Safety Administration (NHTSA) database. Such database is comprised of substantial number of crash cases and main focus was put on frontal impacts. Hitherto used energy methods are based on linear model which proves to be inaccurate and producing significant errors. Presented considerations concern the inverse system and tensor product of Legendre polynomials. The focus of those methods is to establish the value of nonlinear coefficient bk which is the slope factor of precrash velocity Vt and deformation ratio Cs function.

Opis:
Serious damage to the inner rim of the rear twin wheel in one dump truck was noted during the operation of the fleet performing transport tasks. It was a drive wheel, and its damage occurred while driving with a load exceeding the permissible value. The examination of selected fragments of the damaged rim surface was conducted visually as well as using a digital microscope with a portable head. The measurements of the Vickers hardness and microscopic observations of the material structure of the sample cut along the thickness of the rim disk were carried out. The drive torque loading of the twin wheels of the tipper-truck rear axle, under their mating with different kinds of road roughness and under various vertical loads of the wheels was calculated. An analysis of stress distributions in the rim modelled using the Finite Element Method was also conducted for several possible scenarios of wheel loading. The damage to the rim was caused by simultaneous action of several factors, such as overloading the car, poor condition of the tires, loading the drive wheel by a part of the vehicle weight and the driving torque, and hitting a wheel on a cavity in a dirt road, causing a temporary relief of one of the tires on a twin wheel.

A new non-linear method utilizing the work W of car deformation is considered in this study. The car deformation is defined as an algebraic function of deformation ratio Cs. The method of variable correlation is exploited in order to develop experimental data. To determinate mathematical model parameters, data from the NHTSA database including frontal crash tests are used. Such database is comprised of substantial number of crash cases and main focus was put on frontal impacts. In the non-linear method used so far, the so-called energetic approach, collisions are considered non-elastic. The speed threshold defining the elastic collision was set to be 11 km/h. This simplistic approach is used to determine the linear relation of energy loss during deformation on deformation coefficient Cs. Deformation points C1-C6 are taken into account while calculating a mean value that defines this coefficient. A more accurate non-linear method as well as more complex form of deformation coefficient is suggested to determine the work of deformation in this paper. The focus of those methods is to establish the value of nonlinear coefficient b_k which is the slope factor of precrash velocity Vt and deformation ratio Cs function.

In 1970-2010, during the period of spring circulation and summer stagnation, hydrochemical studies were conducted in Lake Ińsko (Western Pomeranian Lake Region, Poland) with determination of the lake susceptibility to degradation and trophic changes. Also, the effect of the catchment area on the water quality in this waterbody was assessed. The waters of the study lake were characterised by low static index, which is an additional indicator of low dynamics of water masses, and low susceptibility to degradation. In spite of this, significant changes in the lake quality and trophy were observed. The hydrochemical parameters defining water quality of the study lake continued to improve. In the 70’s, the water quality was at the border of class II and III, while in 2006 and 2010 it reached the level characteristic for class I waters. Moreover, in the 70’s and 80’s of the previous century, Lake Ińsko Duże was a mesotrophic lake. Then, an increase in the lake trophy was observed, resulting in signs of eutrophy. At the end of the 90’s and in the first decade of the 21st century, the study lake returned to the state of mesotrophy. No restoration works were undertaken in Lake Ińsko in the study period. The improvement in water quality, called oligotrophication, resulted most probably from the lake reaction to changes in the soil use in the catchment area, since fewer phosphorus and nitrogen compounds flow into the lake, and also from the regulation of the wastewater management in the town of Ińsko.
