Opis:: At the beginning of the 1990s Poland, like the majority of the Central and East European countries (CEECs) undergoing transformations, overcame its initial distrust and began to recognize that the only path to regional stability and national economic growth was economic integration. The Central and Eastern European Free Trade Agreement (CEFTA), signed by the Czech Republic, Hungary, Poland, and Slovakia on 21 December 1992 in Cracow, provided for the elimination of a number of trade barriers and the growth in commercial exchanges between the signatory nations, aimed at facilitating their integration with the European Union at a later stage. This article constitutes an attempt to assess the main effects of the implementation of CEFTA on the functioning of its member states as well as their further integration as Member States of the EU. It also presents the main provisions of the modernized CEFTA 2006, and the current problems related to implementation of the agreement. It also discusses the opportunities and prospects for Croatia, as a former CEFTA member state, upon its scheduled accession to the EU in July 2013. This article is intended as an introduction to further and deeper analysis in this area.

Opis:: Troxerutin is a well and for a long time known substance, it is a semi-synthetic bioflavonoid derived from rutin. Original substance is supplied from flowers of Styphnolobium japonicum tree. The author discusses actual medical effects of troxerutin, including antioxidant, anti-inflammatory, antithrombosis and protecting endothelium of small vessels. Being water-soluble, it can be used as ophthalmic drops in treatment of subconjunctival haemorrhage, vitreous haemorrhage and early stages of diabetic retinopathy.

Opis:: On the European continent, the banking system is a leading element of the financial market. In particular, the banking system in democratic countries is characteriz by a two-tier level, i.e. an independent central bank, whose main task is to ensur stable price levels, and the commercial banking sector providing services directly the economy. hTe Polish banking system underwent a major transformation between years 1989-1992, along with the systemic changes of the whole country. Polish banking had to undergo adjustment processes in the efild of law, changes in the banking culture an changes in the way of thinking of people managing individual chains in the banking system. In the author's opinion, Polish banking system has made good use of the past 30 years, both in terms of the functioning of the central bank and strengthening t environment that consists of commercial banks, including cooperative banks and several state-owned banks. eTh proof of a positive assessment of the banking system may be the successful maintenance of the Polish currency in the acceptable range deviations from the inflation target and the global crisis in 2007-2014, which Polish banks (a Polish bank is a bank that operates on the territory of the Republic of Pola and obeys applicable law) have passed without noticeable dificulties in financial liquidity. It is worth mentioning that during recent crisis in Western Europe lar banks went bankrupt (TBTF) or threatened with bankruptcy, had to be saved by governments using public funds. eThre was no such necessity in Poland.

Opis:: The article describes the design of a proven technology for the production of metal foam and porous metal by the foundry. Porous metal formed by infiltrating liquid metal into a mould cavity appears to be the fastest and most economical method. However, even here we cannot do without the right production parameters. Based on the research, the production process was optimised and subsequently a functional sample of metal foam with an irregular internal structure - a filter - was produced. The copper alloy filter was cast into a gypsum mould using an evaporable model. Furthermore, a functional sample of porous metal with a regular internal structure was produced - a heat exchanger. The aluminium alloy heat exchanger was cast into a green sand mould using preforms. Also, a porous metal casting with a regular internal structure was formed for use as an element in deformation zones. This aluminium alloy casting was made by the Lost Foam method. The aim is therefore to ensure the production of healthy castings, which would find use in the field of filtration of liquid metal or flue gases, in vehicles in the field of shock energy absorption and also in energy as a heat exchanger.

Opis:: The article is an attempt at philosophical reflection on the possibility of rational justification of religion and its place in today’s world by recreating Leszek Kołakowski’s intellectual path to the Absolute as a guarantor of the value and its apology of Christianity in this context. Following the movement of thoughts in works from Religious consciousness and The Church Bond through The Presence of Myth to Main Currents of Marxism, the author shows how Kołakowski came to the position that faith is an inalienable element of the human condition; we cannot believe it at all, only the objects of our faith can be different. Analyzing Kołakowski’s texts, taking into account their chronology, it can be seen that from the perspective of Marxism he tried to capture the essence of religion, while studying religion allowed him to see the features of religious thinking in Marxism. As a consequence, he noticed that faith, next to reason, is an indelible way of our knowledge, and the myth can be removed only by replacing it with another myth. The climax of this thinking seems to be Horror Metaphysicus – according to his own declaration – the opus magnum of Kołakowski. The author argues that the entire apology of Christianity, which dominates in the late philosophical activity of Kołakowski, should be understood in this context. The paper also shows why we should defend Christianity – even if, according to the author of The Presence of Myth, is one of the myths – as the best combination the individual and social dimension of our existence.

Opis:: Zdecydowana większość podróży odbywana samochodem rozpoczyna się i kończy na parkingu, gdzie każde miejsce postojowe zużywa w przybliżeniu około 15 m2 powierzchni, a przeciętny kierowca w ciągu dnia wykorzystuje od 2 do 5 miejsc postojowych. Deficyt miejsc parkingowych powoduje, że kierowcy w poszukiwaniu wolnego miejsca przyczyniają się do powstawania zatorów komunikacyjnych oraz zwiększają ryzyko kolizji lub wypadków z udziałem pieszych. Umiejętne i skuteczne zarządzanie przestrzenią parkingową ma istotny wpływ na jakość życia mieszkańców miast, zmianę zachowań i środków transportowych, a zarazem stanowi wyznacznik rozwoju obszarów zurbanizowanych i ich systemów transportu. Niniejszy artykuł przedstawia założenia oraz rezultaty realizowanego przez Gminę Miejską Kraków międzynarodowego projektu pn. PUSH & PULL – Parking management and incentives as successful and proven strategies for energy-efficient urban transport, którego celem jest m.in. opracowanie katalogu innowacyjnych i sprawdzonych działań związanych z zarządzaniem przestrzenią parkingową, w tym przetestowanie wybranych rozwiązań oraz wdrożenie tzw. podstawowego mechanizmu finansowania, który zakłada, że część dochodów z parkowania zostanie przeznaczona na promocję zrównoważonego transportu w mieście.
The vast majority of travels made by car begins and ends at the parking lot, where each parking space consumes approximately 15 m2 of the surface, and average driver uses 2 to 5 parking spaces during the day. The deficit of parking makes drivers in search of free space resulting with the formation of congestion and increase the risk of collisions or accidents involving pedestrians. Skilful and effective management of the parking spaces has a significant impact on the quality of inhabitants life, changing behaviours and means of transport, and also is an indicator of urban development and it’s transport systems. This article presents the assumptions and the results of international project PUSH & PULL – Parking management and incentives as successful and proven strategies for energy-efficient urban transport project, realized by the Municipality of Krakow. Its objective, among others, is to develop a catalogue of innovative and proven activities on parking space management, including the testing of selected solutions and implementation of the so-called core funding mechanism, which assumes that part of the revenues from parking in the city will be used to promote sustainable transport.

Opis:: Artykuł jest próbą spojrzenia na zagadnienia związane z produkcją szkła w Polsce, zwłaszcza w kontekście obecnej i perspektywicznej bazy zasobowej piasków szklarskich jako podstawowego surowca omawianej branży. Przedstawiono sytuację polskiego przemysłu szklarskiego, z uwzględnieniem rysu historycznego, struktury produkcji wyrobów ze szkła, charakterystyki głównych producentów w poszczególnych sektorach produkcyjnych (szkło budowlane, opakowaniowe, gospodarcze) w świetle zmian zachodzących w czasie ostatniej dekady. W dalszej kolejności zaprezentowano obecną strukturę krajowej podaży piasków szklarskich. Na tym tle autorzy omawiają aktualną bazę zasobową złóż piasków kwarcowych przydatnych do produkcji piasków szklarskich, z uwzględnieniem formacji geologicznych tych utworów, a także perspektywy powiększenia bazy zasobowej, z wydzieleniem obszarów perspektywicznych i oszacowaniem wielkości zasobów perspektywicznych.
The paper is the trial of outlook for the issues connected with the production of glass in Poland, especially in the context of proven reserves and perspective resources of the glass sand as a main raw material for discussed industry. It presents the situation of the Polish glass industry with regard to: historical outline, structure of the glass production, characteristics of main producers (of construction glass, containers and tableware glass), in relation to market changes during the last decade. Paper discusses also current structure of domestic supply of glass sand. On this background, authors review current reserve base of quartz sand with regard to their geological formations, as well as the perspectives of enlargement of resources. A proposal of perspective areas and estimation of perspective resources of glass sand was also presented.

Opis:: In 2013, the Swedish government introduced a career reform for teachers (SFS 2013, p. 70) that established two new career-track positions, namely, lead teachers and senior subject teachers. This study analyses the process of integrating this career reform into the Swedish school system in its early stage and focuses on lead teachers’ professional development and learning when trying to interpret and translate this new career position in their daily working life. The study explored teacher´s ideas, strategies and actions to govern themselves in relation to the demands for research and proven experience within the career reform, as well as their underlying views of career. For the empirical data collection, we interviewed twelve lead teachers. The analysis of the data generated four different governmentalities that these teachers used to govern themselves when trying to handle the career reform in their practices: the school developer, the process manager, the subject specialist and the involuntary careerist. Teachers relate their rationalities to different career discourses where organizational, individual and professional discourses are prominent to various degrees. Furthermore, underlying representations of career relate to both hierarchical views, and to a perspective of exchange. In addition, two new representations of career emerged: career as a non-hierarchical or equal level position, and career as a sorting tool. The results indicate that lead teachers have found themselves caught in tensions between multifaceted meanings of career, research-based education, and personal and organizational pressures associated with the intentions of the career reform.
W 2013 r. szwedzki rząd wprowadził reformę ścieżki rozwoju zawodowego dla nauczycieli (SFS 2013, s. 70), która ustanowiła dwa nowe stanowiska, mianowicie nauczycieli wiodących i doświadczonych nauczycieli przedmiotowych. Badania, których wyniki prezentuje niniejszy artykuł, analizowały proces wprowadzania tej reformy do szwedzkiego systemu oświatowego na wczesnym etapie, koncentrowały się na rozwoju zawodowym i uczeniu się nauczycieli, próbujących jednocześnie zinterpretować i wprowadzić nowe stanowisko do codziennego życia zawodowego. Zbadano postrzeganie kariery zawodowej przez nauczycieli, a także ich pomysły, strategie i działania związane z radzeniem sobie z wymaganiami nowej reformy dotyczącymi pracy badawczej i udokumentowanego doświadczenia zawodowego. W celu zebrania danych empirycznych przeprowadzone zostały wywiady z dwunastoma nauczycielami wiodącymi. Analiza danych wygenerowała cztery różne rządomyślności stosowane przez nauczycieli, próbujących poradzić sobie w swojej praktyce z reformą zawodową: deweloper szkoły, kierownik procesu, specjalista przedmiotowy i mimowolny karierowicz. Badanie wykazało, że nauczyciele odnoszą swoją racjonalność do dyskursów zawodowych, w których w różnym stopniu istotne są dyskursy organizacyjne, indywidualne i profesjonalne. Ponadto podstawowe reprezentacje kariery dotyczą zarówno poglądów hierarchicznych, jak i perspektywy wymiany. Dodatkowo pojawiły się dwie nowe reprezentacje kariery: kariera jako pozycja niehierarchiczna lub równa i kariera jako narzędzie podziału. Wyniki wskazują, że nauczyciele wiodący znaleźli się między wielowymiarowymi znaczeniami kariery a edukacją opartą na badaniach oraz presją osobistą i organizacyjną związaną z założeniami reformy rozwoju zawodowego.

Opis:: Celem artykułu jest porównanie zakresu zastosowania przepisów prawa karnego, prawa ochrony konkurencji oraz prawa zamówień publicznych chroniących zamawiającego przed zmowami przetargowymi. W artykule omówiono rodzaje zmów przetargowych oraz tzw. ustawienia przetargu, wskazano, które z nich mogą podlegać ocenie z punktu widzenia poszczególnych dziedzin prawa, a także przedstawiono możliwe sankcje dla przedsiębiorcy oraz osób fizycznych. Zwrócono również uwagę na aspekty proceduralne, w szczególności w zakresie możliwych do wykorzystania środków dowodowych oraz standardu dowodu opartego na poszlakach. W artykule poruszono również kwestię potencjalnej odpowiedzialności osób zarządzających za zawarcie antykonkurencyjnych porozumień przetargowych oraz oceniono zasadność tego rozwiązania w świetle zasady ne bis in idem.
The purpose of this article is to compare the scope of the application of criminal law, competition law and public procurements law in protecting the procuring party against tender collusions. The article discusses the different types of tender collusions as well as “bid rigging”, it indicates which of them may be examined under the provisions of each legal branch, and presents potential sanctions to business entities and natural persons. Addressed also are procedural aspects of the issue, in particular the type of evidence which can be used and the standard of proof in proceedings based on circumstantial evidence. The article continues on to describe the issue of potential liability for tender collusion of persons holding an executive position and assesses it in the light of the ne bis in idem principle.

Opis:: Autor opracowania usiłuje zgłębić okoliczności przyjęcia i treść kolejnych umów między Polską a Stolicą Apostolską, wskazuje na szczególny charakter konkordatów, ich przedmiot i ewolucję w zakresie formy określania norm prawnych istotnych dla obu stron. Postuluje przy tym nowe lub dodatkowe uregulowanie niektórych spraw, w tym tych dotyczących instytucji małżeństwa, ochrony życia ludzkiego, szkół doktorskich w kościelnych jednostkach naukowych i organów uprawnionych do nadawania stopnia doktora w tych jednostkach, ochrony zabytkowych obiektów sakralnych i dokumentów o dużej wartości historycznej i artystycznej przechowywanych w archiwach kościelnych. Wspomniane wnioski de lege ferenda podyktowane są zmianami społecznymi i nowymi regulacjami niektórych kwestii w prawie Unii Europejskiej i prawie polskim.
The author of the work attempts to outline the circumstances of execution of consecutive agreements between Poland and the Holy See, and their content. What is pointed at is the specific type of concordats, their subject and evolution in terms of the method of specifying legal norms crucial for both contractual Parties. At the same time, he proposes a new or additional regulation of some issues, including those relating to the institution of marriage, protection of human life, doctoral schools in church research units and bodies authorized to award the doctoral degree in these units, protection of historic sacred buildings and documents of great historical and artistic value stored in church archives. The aforementioned de lege ferenda conclusions are dictated by social changes and new regulations on certain issues in the European Union and Polish law.

Opis:: W dawnej Polsce po śmierci jednego ze współmałżonków, pozostający przy życiu ojciec lub matka przejmowali nie tylko opiekę nad osieroconymi dziećmi, ale także nad ich majątkiem, czyniąc wszelkie zabiegi, by nie doprowadzić do jego roztrwonienia. Sytuacja w rodzinie Marianny i Eustachego Potockich, zmarłych niemalże w tym samym czasie (w lutym 1768 r.) spowodowała, że do opieki nad dziećmi należało wyznaczyć krewnych lub zaufanych współpracowników generała artylerii litewskiej. Ostatecznie tutorstwo nad młodymi Potockimi przejęła ich ciotka, młodsza siostra Eustachego – Katarzyna z Potockich Kossakowska (zm. 1803), kasztelanowa kamieńska i sprawowała je w okresie od 1768 do 1772 r., otrzymując na ten czas od swego brata w dzierżawę wszystkie dobra należące do Potockich. Sprawowanie opieki nad dziećmi Potockich wiązało się więc bezpośrednio z przejęciem przez Kossakowską zarządu nad ich majątkiem. Podstawą źródłową do napisania niniejszych rozważań stały się listy kierowane do kasztelanowej kamieńskiej przez zarządców dóbr, ekonomów, plenipotentów, którzy wcześniej byli poddanymi Eustachego i Marianny z Kątskich, a po ich śmierci, wraz z dzierżawionymi przez Kossakowską dobrami, przeszli na jej służbę i niemalże od razu podjęli starania o zdobycie jej akceptacji, zaufania oraz utrzymanie się na dotychczasowych stanowiskach, regularnie przy tym raportując nowej dobrodziejce o stanie ekonomicznym gospodarstw. Treść przebadanej korespondencji pozwala więc spojrzeć na relacje, jakie łączyły poddanych z ich mocodawczynią oraz wskazać gospodarcze i społeczne podstawy funkcjonowania dóbr Potockich pod okiem Kossakowskiej.
In old Poland, when one of the spouses died, the surviving parent took over not only the care of the orphaned children, but also of their property, making every effort to prevent it from squandering. As the consequence of the almost simultaneous death in February 1768 of the married couple Marianna neé Kątska, and Eustachy Potocki, the care of their children had to be assigned to the relatives or trusted associates of the late Lithuanian artillery general. Eventually, the responsibility for the upbringing of the young Potockis fell upon Katarzyna Kossakowska née Potocka (d. 1803), their aunt and Eustachy’s younger sister. Kos sakowska was married to the castellan of Kamień. She carried out this duty between 1768–1772 and throughout this period she was also a legal leaseholder of the Potockis’ property. This meant that the guardianship of the Potockis’ children was directly connected to Kossakowska’s taking over the management of the property and preventing it from dissipating. This discourse is based on letters addressed to Katarzyna Kossakowska written by property administrators, stewards, and plenipotentiaries who had been subjects of the late parents. After their death, all of their staff, together with the leased property, ended up under Kossakowska’s management. Almost immediately, the staff began striving for her acceptance and trust to keep their positions, regularly reporting to the new benefactress on the economic condition of the lands and estates. The content of the studied correspondence allows us to witness the relations between the subjects and their benefactress and determine the economic and social background of the functioning of the Potockis’ estates under Kossakowska’s watchful eye.
