The ruling under review deals with an issue that has long been present in doctrine and jurisprudence. The commented judgement is yet another statement of the Supreme Court concerning the jurisdiction of the court in cases relating to civil claims of reinstated officers. However, the analysed judgement is signifi cant because it determines not only the jurisdiction of common courts (which has already been confi rmed in previous case law) but also determines the character of the benefit granted under Article 42 paragraph 5 of the Police Act. The interpretation of this provision adopted by the Supreme Court opens the way for reinstated officers to seek compensation from the State Treasury over the limit specified in this provision,

Józef Kratko urodził się w 1914 r., w robotniczej rodzinie żydowskiej. W młodym wieku związał się z ruchem komunistycznym, był działaczem kilku młodzieżowych organizacji, m.in. Komunistycznego Związku Młodzieży Zachodniej Ukrainy. Po uzyskaniu matury wyjechał do Warszawy, gdzie przez rok kształcił się w Państwowym Konserwatorium Muzycznym. Jednocześnie rozpoczął działalność w Komunistycznej Partii Polski. Za swoją nielegalną w II Rzeczypospolitej aktywność był kilkakrotnie zatrzymywany przez policję. Po wybuchu II wojny światowej Kratko wziął udział w kampanii polskiej, a następnie wyjechał do ZSRS. Tam do 1942 r. był m.in. nauczycielem muzyki. Po ataku Niemiec na ZSRS został przez Komintern skierowany do tzw. Armii Władysława Andersa, gdzie miał prowadzić działalność agitacyjną. Ostatecznie z wojska tego odszedł i w 1943 r. zaciągnął się do tworzonej przez komunistów 1 Dywizji Piechoty im. Tadeusza Kościuszki. Tam służył w różnych oddziałach, np. w Polskim Samodzielnym Batalionie Specjalnym. W 1944 r. został zrzucony na obszar okupowanej Polski i dołączył jako ofi cer polityczno-wychowawczy do Zgrupowania „Jeszcze Polska nie zginęła”. Po opanowaniu wschodniej Polski przez oddziały Armii Czerwonej Kratko został przyjęty do pracy w Komendzie Głównej Milicji Obywatelskiej.
Józef Kratko was born in 1914 to working-class Jewish parents. At a young age he became involved with the communist movement and was an activist in several youth organizations, including the Communist Youth Union of Western Ukraine. After graduating from high school, he left for Warsaw where he studied for a year at the State Music Conservatory. During this period, he became an active member of the Communist Party of Poland and was imprisoned several times by the authorities for conducting illegal activities. At the outbreak of World War II Kratko took part in the Polish campaign, after which he fl ed to the Soviet Union where he worked predominantly as a music teacher. After the Germans attacked the Soviet Union in 1941 Kratko was sent by the Comintern to serve with the so-called Władysław Anders’ Army, where he was supposed to conduct agitation activities. He left this unit in 1943 and enlisted in the 1st Tadeusz Kosciuszko Infantry Division that was created by the communists. His role involved serving in various units, e.g. the Polish Independent Special Battalion. In 1944, he parachuted into occupied Poland and joined the „Jeszcze Polska nie zginęła” Organization as a political and educational offi cer. Aft er the Red Army took over eastern Poland, Kratko was hired to work at the Headquarters of the Citizens’ Militia.
Józef Kratko wurde 1914 in einer jüdischen Arbeiterfamilie geboren. Schon in jungen Jahren engagierte er sich in der kommunistischen Bewegung und war Aktivist in mehreren Jugendorganisationen, darunter dem Kommunistischen Jugendverband der Westukraine. Nach dem Abitur ging er nach Warschau, wo er ein Jahr lang am Staatlichen Musikkonservatorium studierte. Zur gleichen Zeit wurde er in der Kommunistischen Partei Polens aktiv. Wegen seiner illegalen Aktivitäten in der Zweiten Polnischen Republik wurde er mehrmals von der Polizei verhaft et. Nach dem Ausbruch des Zweiten Weltkriegs nahm Kratko am Polenfeldzug teil und ging anschließend in die UdSSR. Dort war er bis 1942 u. a. als Musiklehrer tätig. Nach dem deutschen Angriff auf die UdSSR wurde er von der Komintern in die so genannte Władysław-Anders-Armee geschickt, wo er agitatorische Aktivitäten durchführen sollte. Schließlich verließ er diese Armee und trat 1943 in die von Kommunisten aufgestellten 1. Tadeusz-Kościuszko-Infanteriedivision ein. Dort diente er in verschiedenen Einheiten, darunter in der Polnischen Unabhängigen Spezialbataillon. Im Jahr 1944 wurde er in das besetzte Polen abkommandiert und schloss sich der Gruppierung „Jeszcze Polska nie zginęła” als politisch-pädagogischer Offi zier an. Nach der Einnahme Ostpolens durch die Einheiten der Roten Armee wurde Kratko in das Hauptquartier der Bürgermiliz übernommen.

Undercover police operations are used for the most serious crimes when the possibilities of other operational methods have been exhausted. The specifi city of this non-standard tactic of police operations is associated with many threats to the participating offi cers who work undercover. This study aims to examine the threats accompanying secret operations conducted in Poland and determine the extent to which the UCO’s experience infl uences the risk assessment and behaviour of policemen participating in such operations. Empirical research was conducted using a diagnostic survey method. The research results do not unequivocally confi rm the relationship between the experience of undercover policemen and risk estimation. However, they allow for inference about their behaviour during undercover operations.

Artykuł ma na celu zwrócenie uwagi na problem ochrony danych osobowych i roli oraz zadań Inspektora Ochrony Danych w archiwach państwowych. Wraz z wprowadzeniem unijnego rozporządzenia o ochronie danych osobowych zmieniło się wiele w postrzeganiu osób, którą tymi zagadnieniami się zajmują. Inspektor Ochrony Danych zajmuje się przede wszystkim należytym postępowaniem z dokumentacją, która jest wytarzana w toku działalności każdej jednostki organizacyjnej, w tym również archiwom państwowym. Rola i zadania Inspektora Ochrony Danych w archiwach państwowych jest taka sama jak w innych jednostkach organizacyjnych. Ze względu na specyfikę działalności państwowej sieci archiwalnej i specyfiką instytucji jaką są archiwa państwowe zadania Inspektora Ochrony Danych są niezwykle ważne. Z jednej strony państwowa służba archiwalna posiada dokumentację o wieczystym przechowywaniu tzn. kategorię A, a z drugiej strony działa jak normalny urząd obsługujący petentów oraz ze swoją strukturą organizacyjną. Właśnie zarządzanie bezpieczeństwem informacji w dobie społeczeństwa opartego na wiedzy jest kluczowym problemem w  każdej instytucji, za który odpowiada Inspektor Ochrony Danych. Sam system bezpieczeństwa informacji musi być systemowy i dobrze przemyślany. Ustawodawca unijny w swoim zamyśle stworzył funkcję Inspektora Ochrony Danych, aby chronić także naszą prywatność. System ochrony danych osobowych działa w Polsce od dwudziestu pięciu lat, a po wdrożeniu RODO (wraz z karami o nienależyte przetwarzanie danych osobowych) coraz bardziej podchodzimy do tego jako naszego niezbywanego prawa, aby nasze dane osobowe były dobrze przetwarzane i nie udostępniane osobom nieupoważnionym. 
This article aims to assess the issue of data protection and the role and tasks of theData Protection Offi cer in the National Archives. With the introduction of the EU Data Protection Regulation (GDPR), much has changed in the perception of those who deal with these issues. The Data Protection Offi cer’s main concern is the proper handling ofrecords that are produced in the process of any organizational unit’s activities, including those of the State Archives. The role and responsibilities of the Data Protection Offi cer in the state archives are the same as in other organizations. Due to the nature of the activities of the state archive network and the specifi c nature of an institution such as the archives, the duties of the Data Protection Offi cer are extremely important. On the one hand, the state archives service holds records with permanent retention, i.e. category A, and on the other hand it operates like a normal offi ce serving the public with its organizational structure. The management of information security in the age of the knowledge societyis the key issue in any institution, for which the Data Protection Offi cer is responsible. The information security system itself must be well designed and thought out. The EU legislator intended the function of the Data Protection Offi cer to protect our privacy as well. The system of personal data protection has been in place in Poland for twenty-six years, and after the implementation of the GDPR (along with penalties for improperprocessing of personal data), we are increasingly considering it as our inalienable right to have our personal data well processed and not shared with unauthorized persons.

Pochodzący z Częstochowy por. Hieronim Dudwał był jednym z najskuteczniejszych pilotów początkowego okresu II wojny światowej. Absolwent dęblińskiej Szkoły Podchorążych Lotnictwa wszystkie cztery zwycięstwa powietrzne odniósł podczas walk na polskim niebie w 1939 r. Sukces ten jest tym większy, że młody pilot używał sprzętu mniej zaawansowanego technicznie niż ten, który stosował przeciwnik. Po ewakuacji do Rumunii szybko, bo w trzy tygodnie, przedostał się koleją do Francji. W odtworzonym u boku sojusznika lotnictwie znalazł się w kadrowym I DM, ale jednostka ta nie weszła w całości do akcji. Po ataku z 10 maja 1940 r. podzielono ją na klucze i przydzielono zarówno do jednostek frontowych, jak i patroli chroniących przed atakami Luftwaffe miasta związane z francuską produkcją zbrojeniową. Na początku czerwca Hieronim Dudwał został skierowany do operującej na froncie GC II/10. 7 czerwca, podczas walki z przeważającą liczbą samolotów przeciwnika, 27-letni oficer został zestrzelony i zginął, rozbijając się w lesie o nazwie La Marre. Spoczywa na cmentarzu żołnierzy polskich w Aubérive. Pośmiertnie był odznaczony Krzyżem Srebrnym Orderu Wojennego Virtuti Militari.
Lieutenant Hieronim Dudwał was one of the most successful fighter pilots during the initial period of World War II. He shot down four German aircraft during the 1939 Polish Campaign. After escaping across the Polish border, Dudwał arrived in France three weeks later and joined I Polish Fighter Squadron. This unit never participated in action as a whole squadron and after the German invasion of France on 10 May 1940 it was split up, with some pilots being assigned to frontline squadrons whilst others flew protective patrols over French cities that focused on war production. At the beginning of June 1940 Dudwał was moved to the frontline and posted to GC II/10 squadron. On 7 June 1940, the 27-year-old offi cer died when his plane crashed into „La Marre” forest aft er being shot down whilst singlehandedly engaging several Messerschmitt 109s. He is buried in the Polish soldier’s cemetery in Aubérive. He was posthumously awarded the Silver Cross of the War Order of Virtuti Militari.
Der aus Tschenstochau stammende Leutnant Hieronim Dudwał war einer der erfolgreichsten Piloten in der Anfangszeit des Zweiten Weltkriegs. Der Absolvent der Offi zierskadettenschule der Luftstreitkräfte in Dęblin errang alle seine vier Luft siege während der Kämpfe im polnischen Luftraum im Jahr 1939. Dieser Erfolg ist umso größer, als der junge Pilot ihn mit einer Ausrüstung erzielte, die technisch weniger fortgeschritten war als die des Feindes. Nachdem er nach Rumänien evakuiert worden war, gelangte er innerhalb von drei Wochen mit der Bahn nach Frankreich. In der an der Seite der Alliierten wiederaufgebauten Luft streitkräft e fand er sich in der 1. Jagdstaff el wieder, doch die Einheit kam nicht in vollem Umfang zum Einsatz. Nach dem Angriff vom 10. Mai 1940 wurde sie in Staff eln eingeteilt und sowohl an der Front als auch auf Patrouille eingesetzt, um die mit der französischen Rüstungsproduktion verbundenen Städte vor den Angriff en der Luftwaffe zu schützen. Anfang Juni wurde Hieronim Dudwał dem an der Front operierenden GC II/10 zugeteilt. Am 7. Juni wurde der 27-jährige Offi zier im Kampf gegen eine überwältigende Anzahl feindlicher Flugzeuge abgeschossen und starb beim Absturz im Wald von La Marre. Er ruht auf dem polnischen Soldatenfriedhof in Aubérive. Er wurde posthum mit dem Silbernen Kreuz des Kriegsordens Virtuti Militari ausgezeichnet.

The Polish Financial Supervision Authority (hereinafter: KNF) is the key element of the economic security system of the Polish State. By establishing the KNF, the Polish legislator applied the concept of integrated financial supervision (covering bank supervision, insurance supervision and capital market supervision) located outside the central bank. The KNF has been vested with a broad mandate, including powers to supervise authorised entities. However, the scope and nature of measures available to the KNF in the prevention of economic crime are determined by the institutional position of the KNF, which has not been established as a law enforcement authority or a uniformed or special service but rather an institution engaged in the fight against economic crime by providing expertise, supporting other state services specialised in this area. The KNF and the Office of the Polish Financial Supervision Authority (hereinafter: UKNF) actively support, among others, the police units that fight crime in the financial market and work to increase the economic security of the Polish State. Therefore, it is imperative to ensure broad and efficient cooperation between the police and the KNF. However, such collaboration must not be limited to relations between the institutions’ management; it should also involve, as far as possible, working and operational activities carried out at both institutions by individuals responsible for day-to-day tasks. This paper provides a closer perspective on the formal and organisational framework of said cooperation and discusses its examples.

The main task of this publication is to present the psychological care and psycho-education system in the Polish Police. The aim of the mental health care system is to provide help and psychological support to police officers and police employees, and to relieve their tensions caused by negative external factors, called stressors. This help and support is necessary due to the fact that the profession of a police officer is considered a ‘high-risk’ job, one of the most stressful in the world and resulting in many difficult experiences, burdens and problems in the psychological sphere. Persistent mental disorders are often the cause of somatic diseases. Police officers on duty are confronted with many difficult situations, stressful events and they are exposed to numerous challenging and risky situations, which in consequence are the cause of the professional stress in officers. This, in turn, leads to psychological tensions and various ailments, somatic and mental illnesses. The article presents a number of factors that occur in the external service that are sources of work stress. Reference has also been made to the fact that a very common source of this stress is an inappropriate management process within the Police. The reason for numerous tensions are often conflicts between superiors and subordinates. However, the key to the publication is the description of the functioning of the mentioned system. The history of its creation is the first step in its presentation here. The organisational structure of the system, the relatively full range of tasks assigned to officers, the organisation of their work, as well as the catalogue of events requiring their intervention and the forms of psychological assistance have all been presented. The paper also focuses on the psycho-education system — the one carried out directly by police psychologists, and this performed in a broader sense, called the psychological education which is carried out by the lecturers and management of the Police. As part of this psychological education process, future and current managers are equipped with a wide range of psychological knowledge. It is necessary for managers at various levels to be the first to provide the necessary psychological support and ‘first aid’ to their subordinates in cases of occupational stress and psychological load caused by service conditions. The conclusion shows that a well-functioning system of psychological care and psycho-education has a positive impact on the mental condition of police officers and employees, on their level of satisfaction with police service, and indirectly on the quality and effectiveness of the police work.

In the literature there are many methods of measuring the eff ectiveness of an employee. However the majority of them focuses on the quantitative nature of the work and evaluate it in this sense. In response to the search for a convenient method of analysis of the eff ectiveness of employees, whose work is qualitative, it has been determined that usage of a method DEA is recommended. Mostly because its measurement should allow the recognition of effi ciency in a qualitative way. Based on a study of groups of the accountancy offi ces from Tricity, an eff ectiveness scheme analysis of generically similar employees is presented. The inference is based on a innovative survey, which allows evaluation of work for each employee in the sample. The aim of the analysis is the justifi cation for the choice of the DEA method. It is also to show its opportunities with respect to measuring the eff ectiveness of the accountancy offi ces employees, as representatives of a group whose work is diffi cult to measure. The issue of measuring the eff ectiveness of the accountancy offi ces encouraged an attempt to identify the characteristics of eff ective units, which could help to stimulate effi ciency features. W literaturze spotyka się wiele metod pomiaru efektywności pracownika, większość z nich skupia się jednak na ilościowym charakterze pracy. W odpowiedzi na poszukiwania dogodnej metody analizy efektywności pracowników, których praca ma charakter jakościowy, udało się ustalić, iż metodą taką jest metoda DEA. Na podstawie ankiety i badania grupy księgowych ukazany zostanie schemat analizy efektywności podobnych rodzajowo pracowników. Przedstawione wnioskowanie bazuje na autorskim badaniu ankietowym opisującym ocenę własną pracy każdego badanego. Celem analizy jest uzasadnienie wyboru metody DEA i ukazanie jej możliwości względem pomiaru efektywności reprezentantów grupy pracowników umysłowych. Zagadnienie mierzenia efektywności pracowników biur rachunkowych oraz próba wskazania cech jednostek efektywnych pozwoliły dodatkowo na wydzielenie cech stymulujących efektywność. Wnioski wskazują, że kontrola efektywności pracowników biur rachunkowych jest możliwa. Po zapoznaniu się z wynikami można zauważyć, że metoda DEA jest dobrą metodą do analizy efektywności pracowników umysłowych w skali przedsiębiorstwa lub grup pracowników.

Opis:
The subject of this study is the characteristics of Polish law enforcement authorities in the fi eld of preventing and combating the crime of traffi cking in human beings. The author points out that, based on existing legal regulations in Poland, the foremost burden related to prevention and prosecution activities of this type of crime lies within the scope of duties of the prosecutor’s offi ce, the Police, and the Border Guard. Thus, the article is devoted to a concise description of the indicated entities in terms of their legal instruments which make it possible to effectively implement the tasks and duties imposed by law and regulations upon the institutions. In the author’s assessment, the key role in the system is played by the prosecutor, who is the only authority sanctioned to make decisions on initiating the investigation and entrusting its conduct in its entirety or the indicated scope to other authorities, primarily the Police or the Border Guard. The prosecutor’s special role also results from the fact of being solely entitled to draw up and support an indictment in court in cases involving traffi cking in human beings. Nevertheless, according to the author, in practice, the main responsibility to carry out procedural and operational activities in this category of cases lies with the Police and Border Guard. The author points out that, at present, the Polish law enforcement system has appropriate instruments, both at the legal and institutional levels, ready for the effective prevention of and combat against crimes of human traffi cking. However, bearing in mind that the phenomenon of human traffi cking has, in principle, a cross-border dimension, the article highlights the aspect of international cooperation between the relevant institutions established to detect and prosecute these crimes.

The article presents issues concerning juvenile prisoners of three special camps in Kozielsk, Starobielsk and Ostashkov. The author draws attention to the lack of definition of the legal status of minors after 1918, and thus — the lack of provisions on ensuring the safety of children in the international standards governing the treatment of prisoners of war in force during World War II and internal legal acts of the Soviet Union. The article emphasizes that the participation of children in armed conflicts was regulated as late as ten years after the outbreak of World War II in international humanitarian law, adopting on 12 August 1949 “The Geneva Convention relative to the Protection of Civilian Persons in Time of War” (Fourth Geneva Convention), under which children are entitled to special treatment or protection measures. The provisions of conventions protecting children during the war included, among others, regulations concerning the creation of special zones and sanitary facilities, evacuation from the besieged zone, provision of necessary food and clothing, provision of medical and hospital care, education or transfer to a neutral country. The author notes that the Fourth Geneva Convention does not contain a provision on special protection and care for juveniles, and that children during warfare are classified exclusively as civilian population. The circumstances of the Soviet captivity of minors after September 17, 1939, their stay in and leaving the camps, the reasons for selection, after which they were left alive and not included in the “death transports”, described in the article, make it possible to determine the number of rescued and murdered.

Th e aim of the article is to present the attempts undertaken by King John Casimir to make equal the powers of Lithuanian hetmans and thus to limit the authority of the Lithuanian grand hetman. To this end, the king, alongside with his legal attempts, appointed to the office of Lithuanian fi eld hetman Wincenty Korwin Gosiewski, closely associated with the royal court. Attention also is paid to negative consequences of King John Casimir’s actions for the combat and operational capacity of the Lithuanian army.
Celem artykułu jest pokazanie podejmowanych przez Jana Kazimierza Wazę prób zrównania kompetencji hetmanów litewskich, a tym samym ograniczenia władzy hetmana wielkiego. Król, oprócz podejmowania inicjatyw o charakterze prawnym, starał się osiągnąć zakładany cel przez nominację na funkcję hetmana polnego ściśle związanego z dworem Wincentego Korwina Gosiewskiego. There is a twofold crisis in Europe: While mass migration is a serious challenge to the whole EU, we also have member-states striking at the EU itself. Our research shows that Hungary, with its overwhelming political communication, became the first post-socialist EU member state to run official anti-Western propaganda since the end of the Cold War and it seems that other CEEcountries will follow its lead. The campaign does not go against Brussels directly: the real message is hidden between the lines. We analyzed 644 pro-government articles on migration issues. The research shows that anti-Brussels narratives were strikingly frequent, and a new “war vocabulary” propaganda campaign started, stating that the EU is fighting against Hungary, so Hungary has to strike back

The event from 1700 presented in the article was described in the diary of a contemporary municipal syndic, Johann Ernst von der Linde. A group of fugitives from the Gdańsk Penitentiary (i.e. prison) attempted to invoke the right of the church sanctuary. For this purpose they claimed sanctuary inside the Carmelite Monastery in the Old Town of Gdańsk (Danzig). The incident illustrates tendencies present in the transitional period between early modern times – when such right was accepted – and more recent times – when sense and legitimacy of such procedure were already questioned. The event took place in Gdańsk, a powerful, self-governing, economic centre with a very good system of local law, additionally being a mainstay of Protestantism in the region. The event was also a particular test of authority between the dominant religion and a religious minority. A successful escape from the municipal prison, negotiations between the stakeholders referring to the written law, custom and precedents, and the final lack of any consequences for the fugitives casts an interesting light on the penitentiary and criminal system of Gdańsk and the issue of maintaining order in the city in the late 17th and early 18th centuries.
Przedstawione w niniejszym artykule zdarzenie z 1700 r., opisane w diariuszu ówczesnego syndyka miejskiego, Johanna Ernesta von der Lindego, to próba odwołania się do prawa azylu kościelnego przez grupę zbiegów z gdańskiego Domu Poprawy, chroniących się w klasztorze karmelitów na Starym Mieście. Incydent ten ilustruje tendencje okresu przejściowego pomiędzy epoką wczesnonowożytną – skłonną to prawo akceptować, a nowszymi czasami – kwestionującymi jego sens i zasadność. Do zdarzenia doszło w Gdańsku, silnym, samorządnym ośrodku gospodarczym z doskonale ukształtowanym systemem własnego prawa, na dodatek bastionie protestantyzmu w tym regionie. Była to więc zarazem swoista próba sił pomiędzy wyznaniem dominującym a mniejszościową grupą religijną. Udana ucieczka z miejskiego więzienia, negocjacje zainteresowanych stron, odwołujących się do litery prawa, obyczaju i precedensów, wreszcie – w ostatecznym rozrachunku – uniknięcie konsekwencji przez uciekających z Domu Poprawy przestępców, w ciekawym świetle przedstawiają gdański system penitencjarny i karny oraz kwestię utrzymania porządku w mieście na przełomie XVII i XVIII w.
