The article aims at restoring local self-government as a research problem of political theory. In contemporary political science literature, local self-government is not treated as one of its normal, standard research problems. The main obstacle of its ambiguous position within political theory is, as I argue, the forced and imposed apolitical character of local self-government considered as a part of public administration. Despite some degree of organizational, especially institutional and legal, self-determination, the local self-government is not a political, i.e. sovereign entity. However, its non-sovereign status, which is legally established, does not exclude the existence of political potency in it.

The article considers public security as a component of national security. Public security is one of the priorities of state policy in the field of national security. Successful public safety is the implementation of a set of measures in the field of landscaping: installation of traffic lights in appropriate public places, construction of underpasses, construction of indoor stops for citizens waiting for the arrival of public transport, etc. A well-thought-out system of planning and construction of settlements or public places, maintaining them in good condition, which promotes work and recreation of citizens, reduces the degree of threat to public safety from the occurrence of unexpected and dangerous situations. And neglect of public amenities can lead to favorable conditions for those who commit offenses and encroach on public safety. A special place is occupied by local governments, they are the closest power to the population, have the necessary powers and resources to attract citizens to maintain public order, increase their social activity in creating decent living conditions in a given area. The state defines local self-government as an independent level of government to which the people are entitled. First of all, it presupposes the organizational separation and independence of local self-government from state power, its independence in resolving issues of local importance, but independence within its own powers, as provided by the constitution. The main powers of local governments to ensure public safety and public order include: monitoring compliance with the law in the territory; application of measures of state coercion (usually, it is a question of bringing to administrative responsibility for the offenses connected with local government); protection of public order, carried out mainly by the police; ensuring the safety of citizens. Accordingly, local governments may be endowed with additional powers in the field of public order and protection of citizens’ rights. Protecting the rights of citizens is an important component of ensuring security both at the individual level and at the level of the entire state. The sense of security that is transmitted inside and outside the country can be considered part of the attractiveness of the image of the country abroad.

The following paper employs a normative approach and focuses on the problem of the current state of the local self-government in the South Caucasus countries: Georgia, Armenia, and Azerbaijan. Since all these countries are members of the Council of Europe, a reference point for decentralisation is the European Charter of Local Self-Government. The paper's main thesis is that despite showing some similarities, the countries have introduced different models of decentralisation that do not fully meet the Council of Europe’s criteria. Such variation is in line with the different political systems of these states and their level of democratisation. The more democratic the state is, the stronger the decentralisation it has adopted. Thus, decentralisation in Georgia follows the European model of public policy, while Azerbaijan is preserving the former Soviet model of weak self-government, with central authorities playing the leading role in public services. The current changes in Armenia’s model resemble the Georgian track of reforms. The findings of this paper may be applicable both in further theoretical research and in implementing reforms of local self-government in various post-Soviet states.

Local self-government constitutes a part of executive power in the state, with the state’s law underlying its functioning. Local government remains under the state’s supervision, representing a form of the political system within the decentralized public administration. 2018 marks 20 years of the functioning of local self-government based on a three-tier structure. The aim of the paper is an attempt at finding the answer to the question whether or not the organizational solutions adopted by the legislator and established in practice need to undergo reforms and if so, to what extent? The question thus formulated relates directly to the argument that the organization of local government system is not sound while the criteria assumed in the territorial breakdown of the local government organization do not correspond to the conditions in which those units operate, and therefore what appears necessary is for the system to be reorganized and the number of units at individual tiers to be reduced. The paper presents selected problems of the local administration in the context of a systemic organization and suggest possible (or necessary) changes which, in the author’s view, should become a subject of discussion (and in practice are such) between local selfgovernment and government administration.

The core of the local self-government stems from the Western (Latin) civilization values. European Nations have always fought for the qualities and perseverance of local self government. Currently it is considered an attribute of local democracy, although in the European tradition it has long been related to the pluralist values of social life organization. The communes; freedom, and their independence from the local government have been derived from natural law and seen as a condition for a healthy social system. Contemporarily, local self-government as a law and ability for local communities to manage a range of public matters independently, has been anew recognized as a social system value in uniting Europe. Yet there have also revived certain historical threats to the local selfgovernment arisen from central and local bureaucracy, particularism, and bribing local power elites. In such case, the fight for a local government that complies with Latin civilizational values acquires a special meaning.

This study offers a short introduction to the development of cities in general, their types, functions, position and points of differentiation. It stresses the importance of multifarious factors that determine the importance of particular entities. The main part of the study though is concerned with Polish cities. It takes into consideration their origins, geographical location, administrative and political importance, city reforms, demographic and economic factors as well as their functions and finance to assess the role and salience of different city categories. It analyses the impact of the aforementioned factors, especially of administrative and self-government reforms on self-government reforms, reflecting the international trend towards the unification of self-government system, have not led to the homogenization of cities in Poland, but that provisions introduced allow for individualisation of their internal structures and functions.

Opis:
The Joint Committee of Government and Local Self-Government has been operating for over 25 years. It is an institution that was conceived as having an advisory capacity, as a unique instrument of dialogue between the government authority and local self-government. However, experience over the last four years has shown that the central authority has marginalized the role of the Joint Committee, ignoring it completely in the legislative process – the vast majority of changes in the powers of the self-government authorities were introduced through member bills, which do not require an opinion from the Joint Committee. In this article, the authors propose extensive reforms to empower local self-government through the empowerment of the Joint Committee. Its fundamental recommendations are to furnish the Joint Committee with the right of legislative initiative, the right to file a motion with the Constitutional Tribunal, and the introduction of a group legislative initiative to the governing authorities of local self-government units.
Komisja Wspólna Rządu i Samorządu Terytorialnego funkcjonuje już od ponad 25 lat. Jest to instytucja, która z założenia miała mieć charakter opiniodawczo-doradczy, stanowiąc swoisty instrument dialogu między władzą rządową a samorządem terytorialnym. Praktyka ostatnich czterech lat pokazuje jednak, że władza centralna zmarginalizowała rolę Komisji Wspólnej, pomijając ją zupełnie w procesie legislacyjnym – zdecydowana większość zmian dotyczących kompetencji władz samorządowych była wprowadzano poprzez projekty poselskie, które nie wymagają opinii Komisji Wspólnej. W prezentowanym artykule autorzy proponują szeroko zakrojoną reformę mającą na celu upodmiotowienie samorządu terytorialnego poprzez upodmiotowienie Komisji Wspólnej. Podstawowymi jej postulatami są: wyposażenie Komisji Wspólnej w prawo inicjatywy ustawodawczej, prawo do występowania z wnioskiem do Trybunału Konstytucyjnego oraz wprowadzenie grupowej inicjatywy ustawodawczej dla organów stanowiących jednostek samorządu terytorialnego.

The trend towards decentralization of government activities has prompted an increased interest in sub-national fiscal rules. The paper investigates an ex ante adaptation to the modified subnational fiscal framework. Using a panel of 2,479 Polish municipalities in the years 2011-2013 the aim is to verify the existence of the side effect of the new debt repayment rule. The empirical results show that local government units for which the new rule would have been more demanding than the former generated higher revenues per capita from asset sales.

Oczekiwania obywateli co do sposobu zarządzania ich sprawami, zwłaszcza przez samorząd terytorialny, stopniowo ulegają zmianie. Zainteresowani są oni nie tyle biernym uczestnictwem w życiu wspólnoty lokalnej, ale aktywnie chcą brać udział w realizacji spraw, które ich bezpośrednio dotyczą. Obywatele chcą być partnerami dla wybranych przez siebie władz lokalnych. Wymaga przy tym podkreślenia, że jest to trudne partnerstwo, wymagające od jego uczestników zaangażowania, wyrozumiałości, zaufania.
Citizens’ expectations of how their affairs are managed, especially by the local self- -government, have gradually changed. They are not interested in passive participation in the life of the local community, but they actively want to participate in the implementation of matters they are directly affected with. Citizens want to be partners for the local authorities they have chosen. What must be emphasised is the fact that it is a difficult partnership, requiring involvement of its participants, their understanding and trust.

Celem artykułu jest ukazanie istoty samodzielności prawotwórczej jednostek samorządu terytorialnego, scharakteryzowanie poszczególnych form prawnych, które przybierają ich formalne decyzje, oraz wyodrębnienie i zdefiniowanie – posługując się dorobkiem doktryny i orzecznictwem – poszczególnych kategorii aktów tworzonych przez organy samorządowe. Zastosowana metoda badawcza oparta została na analizie prawnoporównawczej oraz badaniach literaturowych, ocenie stanu prawnego istniejącego w zakresie omawianej problematyki, a także na analizie poglądów prezentowanych w nauce prawa administracyjnego oraz w orzecznictwie. Autorka zwraca uwagę, że ustawodawca przyznał organom samorządu terytorialnego dużą samodzielność prawotwórczą. Jej źródeł można doszukać się w Konstytucji RP, a w następnej kolejności w samorządowych ustawach ustrojowych. Unormowania te są dodatkowo wzmocnione przez przepisy Europejskiej karty samorządu lokalnego, stanowiącej o prawie społeczności lokalnych do pełnej swobody działania na swoim terytorium z poszanowaniem zasady legalizmu. Przypisanie przymiotu samodzielności jednostkom samorządowym zostało utrwalone również w orzecznictwie Trybunału Konstytucyjnego. Z daleko idącą niezależnością samorządów mamy do czynienia w wielu dziedzinach ich działalności, jednak prawodawstwo wydaje się jedną z najistotniejszych. Akty prawne wyznaczają normy i reguły postepowania, gdyż wiążą określone grupy adresatów i wpływają na ich sytuację podmiotową: prawa i obowiązki.
The purpose of this paper is to highlight the essence of the law-making autonomy of local self-government units, to describe the various legal forms that their formal decisions take, as well as to distinguish and define – using the achievements of the doctrine and jurisprudence – the various categories of acts created by local government bodies. The research method used was based on comparative legal analysis and literature research, evaluation of the legal status existing in the field of the discussed issues, as well as on an analysis of views presented in the science of administrative law and in the case law. The author points out that the legislator has granted local self-government bodies a large degree of law-making independence. Its sources can be found in the Constitution of the Republic of Poland, and then in local government system acts. These norms are additionally strengthened by the provisions of the European Charter of Local Self-Government, which provide for the right of local communities to act freely on their territory while respecting the principle of legalism. The attribution of the quality of autonomy to local government units has also been consolidated in the jurisprudence of the Constitutional Tribunal. The far-reaching independence of self-governments can be seen in many areas of their activity, but legislation seems to be one of the most important. Legal acts set the norms and rules of conduct, binding certain groups of addressees and affect their personal situation. in terms of their rights and obligations.

The article analyses models of administrative supervision of local self-government in the Baltic States (Latvia, Lithuania, Estonia) highlighting the advantages and disadvantages of these models. The research done in this article defines the theoretical concept of administrative supervision of local self-government; gives an overview of the legislative framework underpining the key administrative supervision bodies of local self-government in the Baltic States; discusses the issue of legal regulation and the present state of administrative supervision over local self-government units in the Baltic States; gives some theoretical and practical suggestions to develop this field in the Baltic States. The research methods employed in preparation of this article are theoretical methods of analysis of scientific literature and sources, legal acts and documents as well as comparative and logical analysis, induction and generalisation. Three Baltic States similar in their area, number of inhabitants, and governmental peculiarities have been chosen for the analysis.

After the collapse of the Union of Soviet Socialist Republics (USSR), Kazakhstan’s policymakers recognized that the existing model of state governance had proved ineffective and needed to be changed. One of the necessary solutions was to carry out decentralization. The primary purpose of the following article is to outline the barriers that Kazakhstan needs to remove if it is serious about building local self-government independence. Confronting these with the President’s vision of the transformation of local self-government led to the following research questions: What organizational and legal issues remain unresolved or constitute a barrier to the construction of independent local government structures in the Republic of Kazakhstan after the collapse of the Soviet Union?; to what extent do the changes proposed by President Kasym Tokayev meet the real challenges in the context of expanding the autonomy of local power structures? Answering the questions posed was possible by analyzing legal acts and finding literature and press materials.

The 19th and 20th century in the history of Poland was primarily a time of foreign domination by neighbouring countries, mainly Russia and Germany. Except for the inter-war period of 1918–1939 when there was an attempt to rebuild an independent country, Polish culture in its social and economic dimension underwent a vicious destruction for almost 2 centuries. For that reason, political changes initiated in Poland in 1989 resulted in the emergence of new hope for the revival of its sovereignty and its restoration as a sovereign and democratic country. After years of enslavement the regenerated Poland was economically weak in almost all its dimensions. Due to decisions made in the 1990s and the first years of the 21st century there was a hope for a clear acceleration of social and economic growth. The activities required the necessity of implementation of economic and rational procedures in financial management as well as the allocation of huge financial resources mainly for investment in the area of public utilities, and also for the implementation of modern technologies and methods in nearly all areas of economic and social life. The article is dedicated to the problem of the financial security of the country in relation to the burdens of debt of local authorities, particularly those at the lowest level of the governance structure of the country. Assuming that local authorities in the Polish legal system are public-legal unions equipped with a legal identity that act in their own name and at their own responsibility, it is the members of organisations who are directly responsible for an excessive indebtedness which can affect not only the financial security of the whole public-legal union which is a local self-government, but also the financial security of citizens.

This contribution provides for the picture of revenue sources of municipalities as the basis of local self-government in Slovak Republic with respect to the state of the art and recent changes in legislation relevant thereto, as well as pending proposals for future changes towards increasing the financial independence of local self-government. Authors will analyse the above mentioned issues in order to evaluate the overall situation and confirm or disprove the hypothesis that current own revenue resources of local self-government are insufficient and systematic changes need to be made. Opis:
Dynamika zmian ekonomicznych, politycznych i społecznych powoduje, że ciągle pojawiają się nowe zagrożenia dla trwania i kreatywnego rozwoju podmiotów (państwowych oraz wspólnot ludzkich). Państwo pozostaje głównym podmiotem odpowiedzialnym za tworzenie podstaw bezpieczeństwa, przy czym istotne jest badanie sposobów i metod kształtowania bezpieczeństwa wspólnot lokalnych. W przyjętych rozwiązaniach ustrojowych istotną rolę w zapewnieniu bezpieczeństwa przypisano samorządowi terytorialnemu i instytucjom samorządowym. W tekście poruszono kwestię kształtowania bezpieczeństwa społecznego na poziomie lokalnym z wykorzystaniem podejścia logistycznego. Poprawa skuteczności zapewnienia bezpieczeństwa społecznego jest możliwa przy wykorzystaniu metod logistycznych oraz filozofii logistyki społecznej ukierunkowanej na realizację celów społecznych, a w mniejszym stopniu kierującej się ekonomicznością celów. Artykuł ma charakter przeglądowy i teoretyczny, jego celem jest wskazanie na konieczność poszukiwania skutecznych metod zapewnienia bezpieczeństwa na poziomie lokalnym.
The state remains the main entity that is responsible for creating the basics of security, while it is crucial to study the ways and methods of forming social security of local communities. In the accepted structural solutions, the municipal government and local institutions have the significant role in assuring the security. The key issues are the efficiency and effectiveness in functioning of the local entities because the quality of citizens’ lives depend on them. The text raises an issue of forming the social security on the local level with using the logistic approach. The improvement of effectiveness of the social security assurance is possible by using the logistic methods as well as social logistics philosophy. It is focused on the achievement of social goals and, to a lesser degree, it is guided by the economy of goals. It is a relatively new approach that complements the traditional perception of military and business logistics. The constantly increasing number of social threats makes one search for the effective methods of reducing their effects and the help for people who are excluded or marginalised for various reasons.

This paper discusses the problem of rational forming of the financing system for local self-government entities. The concept of fiscal federalism as well as the role and importance of own revenues and revenues from the state budget transfers, which are slightly different from other unitary countries, have been referred to in this context. The aim of this paper is to statistically analyze the selected categories of local self-government revenues in Poland with regard to the local self-government total revenue in 2013 and the total expenditure between 1999 and 2013. The study involved methods for the analysis of dynamics of mass phenomena such as, first of all, fixed base indexes, the average rate of change indicator and the correlation and regression coefficients from time series. The correlation and regression coefficients from time series were calculated with the first difference method. The results of study demonstrate a statistically significant role of transfer revenues in the expenditure (with the exception of voivodeships) and a statistically insignificant effect of sensu stricto own revenues in the case of cities with poviat status, poviats and voivodeships. The results reveal that the spending policy of local self-governments in Poland is highly dependent on a specific category of revenue, which is referred to as “other revenue” in the study, as a result of the inflow of EU funds. In the long term, once this specific, incidental source of revenue has been exhausted, the local self-government finance may face serious disruption. Such conclusions may serve as a practical contribution to the creation of an early warning mechanism in the shaping of present and future fiscal policies.

The paper examines the prerequisites and effects of indebtedness of local government units in Poland, as well as identifies the determinants of their indebtedness, divided into legal-financial, political, economic-social and organisational-management ones. The level of indebtedness of these units in the years 2003–2020 is also presented. Cities with powiat status and municipalities are most heavily indebted, which is primarily related to local government investments carried out by them.

The article analyses a regulatory role played by the administrative commune’s organs and the communal administration subordinated to them. An impact exerted by the public authorities on economic activity, for which they are responsible, is an expression of the self-government intervention. This issue is linked with a change of the public power model, which has to be entrepreneurial and apply solutions promoting higher effectiveness. An important place is held in this process by the regulator’s position, which poses high specialist requirements before communal employees dealing with performance of this function in relation to operators of public services.

This article deals with economic autonomy of municipalities in the Czech Republic. It analyses how the principles mentioned in the European Charter of Local Self-Government are met in the Czech legal system. The article brings the definition of local tax as an essential source of local self-government revenues and analyses possibilities of municipalities to influence local taxes. The article is relatively critical, because municipalities in the Czech Republic do not have enough revenue from local taxes. So due to their dependence on the state budget it is not possible to talk about real economic autonomy of the municipalities. The method to improve existing status is to give to the municipalities more power to decide on local taxes. The example of this solution can be found for example in Slovakia.

In the postmodern era, Europe, including Poland, is strikingly characterised by the migration of citizens, caused among others by the process of European integration or globalisation, enhanced by the fact that territorial, transport and language barriers cease to exist. There are two types of migration: external (among countries) and internal (among regions or municipal units). The process mentioned, apart from all its positive aspects, may simultaneously lead to a weakening or even loss of local identity as well as social bonds on the local level. These two elements, however, are absolutely vital for the proper functioning of a local self-government community. The process of erosion of social bonds is also influenced by a consumerist and hedonist lifestyle. Therefore, a question arises about the future shape of the self-governmental community, which consists of all the inhabitants of a principal unit of administrative division of a country. Such a community with its territory constitutes the local self-government, which not only takes part in exercising public authority, but also as a result of the process of decentralising public authority, accomplishes an essential part of its objectives. Thus, the first element of the presentation will be introducing the political shape of the local self-government, set by the norms laid out in the constitution and the European Charter of Local Self-government, based on legal dogmatics and empirical method (analysis of the jurisdiction of the Constitutional Tribunal, the Supreme Court and the Supreme Administrative Court). Second, the presentation will attempt to verify the thesis concerning the level of threats for the future functioning of the institutions of the local self-government, caused by contemporary social, economic and cultural changes. A measurable factor verifying the thesis will consist in the analysis of the participation of the local communities in the direct way of exercising authority by the members of the self-governmental community, namely the attendance in local elections). A positive answer to the thesis formed may constitute a basis for de lege ferenda conclusions, concerning the shape of local self-government institutions in Poland.

Local self-government, as a structure within which civil society can thrive, where the digital competencies of the local and regional community come to life, must have the right tools to ensure adequate cybersecurity. These days, e-government, also at the local self-government level, is a common form of performing public tasks, and as a result, its activities in cyberspace must be properly secured. Many tasks are performed using ICT systems that are exposed to external attacks, and therefore, they should meet the appropriate security standards. The article refers to the legal solutions in the field of cybersecurity operating within local self-government in Poland and Hungary.
