The aim of the article was discuss the elections to the European Parliament in Poland in 2014, taking into consideration the political situation before the elections in particular. The influence of the parliamentary elections in 2011 on the Polish political scene, and the activity of governmental coalition of the Civic Platform and the Polish Peasant Party, as well as the emergence of new political entities actively participating in electoral competition, has been analysed. A detailed analysis was done regarding the course of election campaign, paying attention to the elements of negative campaigning as well as the course of the elections themselves. The final reflections were dedicated to the election results and their influence (consequences) on the Polish party system.

A study of the Euro-barometer performed at the end of January and beginning of February 2009 showed that not even 34% of the surveyed in all the 27 countries of the European Union declares the desire to cast their vote in the approaching election to the Euro-community. 15% of the respondents answered that they would de! nitely not vote in the coming election. The participation in the European Parliament Elections has fallen from election to election. This tendency persists and no signs of improvement of the situation can be seen. In 1994, 56.8% of the entitled to vote participated in the elections in all the member countries. Ten years later, only 45.6% of voters cast their votes. New member countries with low level of interest in European matters have considerably contributed to the fall in the level of legitimisation of the European Parliament.

In this paper we address the following question: Taking as decisional units national chapters of European political parties, is there a difference between a priori voting power of national groups in the case of "national" coordination of voting and in the case of "partisan" coordination of voting? By coordination of voting we mean two step process: in the first step there is an internal voting in the groups of units (national or partisan), in the second step there is a voting of aggregated groups (European political parties or national representations) in the EP. In both cases the voting has an ideological dimension (elementary unit is a party group), difference is only in dimension of aggregation (European parties versus national representations). Power indices methodology is used to evaluate voting power of national party groups in the cases of partisan and national coordination of voting behaviour.

Artykuł ma na celu przybliżenie instytucji petycji. Została ona stworzona, aby umożliwić nawet pojedynczemu obywatelowi Unii Europejskiej, skargę na postępowanie organów administracji publicznej, które mogą być niezgodne z prawem unijnym. Możliwość złożenia petycji do Komisji Petycji przy PE dało Polakom wstąpienie do Unii Europejskiej w 2004 roku. W pierwszej części artykułu przedstawiony jest sposób rozpatrywania petycji, czyli kto, gdzie i w jaki sposób może petycje złożyć, jak i skąd zasięgnąć informacji o składanych petycjach. Kolejna część to sposób rozpatrywania petycji, gdzie zawarte są informacje odnośnie dopuszczalności petycji, a także jakie działania może wykonać Komisja Petycji w sprawie złożonej już petycji, czyli między innymi możliwość przekazania petycji odpowiedniej Komisji, wydania opinii czy przeprowadzenia wizytacji w danym kraju, gdzie mogło dojść do naruszenia prawa unijnego. Dalej artykuł przybliża sprawy polskie, które rozpatrywała Komisja – jedną z pierwszych, dotyczącą podatku akcyzowego na sprowadzane spoza terytorium auta, jak i jedną z najnowszych, dotyczącą planów budowy odkrywkowej kopalni na Dolnym Śląsku. Podsumowanie artykułu to zwieńczenie informacji w nim zawartych, a także możliwości które daje złożenie petycji do Parlamentu Europejskiego, jak i rozwojowy charakter tej instytucji, wskazując jednocześnie na potrzebę rozpowszechniania możliwości złożenia petycji wśród obywateli Unii Europejskiej.
Petition to the European Parliament aims to introduce the institution of the petition that was created to enable even a single citizen of the European Union to make a claim against the proceedings of public administration authorities, which may have been incompatible with the European law. The accession of Poland to the European Union in 2004 gave the Poles the possibility of petition to the Committee on Petitions of the European Parliament. In the first part, the article presents the way of handling the petitions, i.e. who, where and how can submit the petition, also how and where the citizens can receive information on the submitted petitions. Then, the article presents the manner of handling petitions, where the information regarding the admissibility of petitions can be found, as well as possible actions of the Committee on Petitions regarding the submitted petition, i.e. the possibility of submitting a petition to the appropriate Committee, issuing an opinion or organizing a fact-finding visit in a particular country where the breach of the EU law could have occurred, among others. Furthermore, the article describes some Polish cases handled by the Committee - one of the first - on the excise duty levied on cars imported from outside the territory, and one of the newest - on the construction plans of a strip mine in Lower Silesia. The summary is the presentation of information gathered in the article, and the possibilities arising from the submission of the petition to the European Parliament, as well as a progressive nature of this institution, while simultaneously indicating the necessity of promulgating among the EU citizens the possibilities of submitting the petition.

Ensuring cyber security in scope of cyber defense is currently among the top priorities of the EU Common Security and Defense Policy (CSDP). Matters included in scope of cyber defense are a competence of the Member States and cooperation at EU level in this area is governed by decisions of the EU Council based on unanimity. This means that the European Parliament (EP) in the field of cyber defens acts only as an opinion-forming body expressing its position through the adoption of non-legislative resolutions. The aim of the article is to analyze the content of these resolutions and present the EP’s opinion on the challenges facing the EU in the field of cyber defense. It should be stressed that the EP is the EU body that strongly emphasizes the need for a common EU approach to these issues. Given that the area of cyber defence is subject to intergovernmental cooperation mechanisms, the EP considers that the EU needs to develop not only cooperation and coordination mechanisms at the level of its institutions, but also to take action to enhance the EU’s capability to counter cyber threats. These significant cyber defense capabilities should be essential elements of the CSDP and of the development of the European Defense Union, as it is becoming increasingly difficult to counter cyber attacks for the Member State level alone. The role of the CSDP should be to ensure that the EU, in cooperation with NATO, has an autonomous strategic capability to act in the field of cyber defense.

Ensuring the energy security is currently one of the EU’s top priorities. The EU energy policy, after the entry into force of the Treaty of Lisbon, is regulated by Article 194 TFEU, which guarantees a solid legal basis for European Union actions in this area on the basis of the Community method. The European Parliament, within the scope of its Community competences, as a participant in the decision-making process, contributes to shaping the face of the EU energy policy. Furthermore, by adopting nonlegislative resolutions, the EP expresses its position on the most crucial issues included in this policy and has an indirect influence on its shape. The aim of this article is the analysis of the content of these resolutions and presentation of the EP’s opinion on the challenges facing the EU in the field of energy. It should be highlighted that the European Parliament is the EU body with a strong emphasis on a supranational approach to energy security. The European Parliament prefers the view that all Member States, in a spirit of solidarity, must take actions to guarantee the EU’s common energy security. In favour of a common, integrated European energy market, the EP puts great emphasis on the necessity to implement ambitious climate policy objectives within its framework, the key element of which is the reduction of greenhouse gas emissions.

The article presents the determinants of creating candidate lists in European Parliament elections in Poland. Its subject context is the evaluation of importance of selected factors with reference to the effect obtained in the election. The main study hypothesis assumes different patterns of creating candidate lists in EP elections in comparison to parliamentary elections, involving the combined occurrence of several determinants. The first of them is the tendency to fill the highest positions in candidate lists with popular people well-known in the media, who have an advantage over anonymous ones. The second factor is territorial bonds connecting candidates with the electoral district where they stand for election. Another determinant taken into consideration is the territorial form of the candidate list. The last important element of analysis is the concentration of support, determined by the position on the candidate list.

European Parliamentary election 2014 were the third elections for countries that joined European Union in 2004, including Poland. As we may observe from the very beginning of the EP’s history, elections suffer constant drop in voter turnout, and since 1999 the turnout total for less than 50%. There are many theories explaining this state of affairs, with most notable “second-order elections” and democracy deficit theories. Polish profile of voter turnout in EP elections seems to fit into frameworks of these theories, and is positioned among EU’s members with the lowest turnout. What is specific for electoral behaviour in Poland is stability: the turnout and support for political parties seems to stable and even petrified. This assessment seems to be supported by the results of election within past four years, both on aggregate and individual levels of data.

The migrant crisis in Europe, which reached its zenith in 2015, made EU politicians realize the urgent need for a more effective migration policy that would rely more on supranational cooperation. Absence of this policy triggers migrant influx to Europe, in particular of unqualified labour force, and enhances illegal migration from which organized criminal groups profit enormously. Moreover, uncontrolled migration processes give rise to a number of social, economic, political and cultural problems all across the EU, and thus nurture the Eurosceptic mood. This leads to societal negation of the European integration project and provides fertile soil to the spread of radicalism and xenophobia. The aim of the study is to capture the position of European Parliament on recent migrant crisis. The Parliament, a democratically legitimate body, which claims the right to represent European societies, advocates adoption of systemic EU approach to migration which should be based on the respect of human rights and creation of legal migration pathways for refugees and workers needed by Europe. The solution of the present migrant crisis is sought by the EP in moving towards a common, comprehensive European immigration policy and enhanced solidarity of EU member states in response to increased influx of refugees from conflict zones.

The paper refers to the essential problem of the European political space, namely the insufficient implementation scale of accountability standards, which has a direct effect on the democratization of the European political system, specifically on the democracy deficit. The paper was presented the accountability standard on the background on the EP election in 2014, with the strong focus on the relations between the voters and the EP candidates. In the analyses the factors characterizing the quality of political discourse were considered taking into account both, the electorate political activity (principal – in the meaning Principal-Agent-Theory), as well as the offer of the running politicians (as the agents).

In 2004, Polish women took part in the elections to the European Parliament for the first time. It was a long road that led them to take seats there. The beginnings of the Polish women’s movement date back to the 19th century when it was closely connected with the struggle for the independence of Poland. It was then that the stereotype of the Polish Mother emerged, the guardian of the hearth and home, and promoter of patriotism. These, among other things, were the social, cultural and political stereotypes that women seeking to increase their presence in public life needed to face up to. Polish women obtained voting rights rela- tively early on, in 1918. Despite their political rights, they did not participate in the political life of interwar Poland on a larger scale. The women’s organizations that emerged after WWII implemented the ideology that was officially propagated in those times, and strictly followed the policies of the authorities. Significant changes in the women’s movement occurred in the 1980s when authentic women’s initiatives formed around the Solidarity movement. At pres- ent, approximately 300 women’s organizations operate in Poland. Polish accession to the European Union has given Polish women an opportunity to intensify their activities in supra- national politics. Polish women took seats in the European Parliament, although their numbers thus far have been relatively low. During the 6th parliamentary term, out of 54 Polish Members of the European Parliament, 7 were women. In the EP elections held in 2009, 11 Polish women were elected as MEPs. Regardless of this low level of representation, Polish women are very active and resilient and seriously committed to working in European Parlia- mentary structures.

According to Montesquieu tripartite system, formed in the European constitutionalism, the organs of authority, in a democratic state, affect each other in an inhibitory way, balancing mutually. Traditionally, it is understood that the executive power is performed by the Head of State (monarch, president) and government, legislative power belongs to the parliament, whereas the judicial power is exercised by independent courts. Analyzing the political reality of member states it is necessary to note, that the executive participates in the national legislative processes more actively, for example, through executing constitutionally granted right of legislative initiative (usually together with deputies), by issuing acts with the power of law, or incorporating Community directives into the internal legal order.

The goal of the article is the presentation of the chosen aspects of the evolution of the European Parliament. The author presents the beginnings of this body in the structure of the European Coal and Steel Community, the European Economic Community and the European Atomic Energy Community. The leitmotiv of the article is to show the increase of the importance of the European Parliament during almost 60 years of its existence, from the advisory body to the co-deciding institution in the area of legislation of the European Community. The important manifestation of the European Parliament’s aspiration to strengthen its prerogatives was also the struggle to introduce the general election to this body. In the final part of the article the author tries to analyze the current position of the European Parliament in the institutional structure of the European Union.

This article describes and evaluates 2014 Czech European Parliament (EP) election. Starting with the context of the election, it goes through all relevant party actors participating in the election and introduces them both in general ideological terms as well as in relation towards the European integration. After results of election are discussed, the article concludes that 2014 EP election confirmed recent changes in the Czech party system – inter alia destabilization of the system as a whole, reconfiguration on its right wing and emergence of populism. Concerning the European message of the election, their results confirmed their second-order character.

The 2014 European Parliament elections in Lithuania were successful for mainstream political parties: no new-born political movement came up in the political scene; no open Euro-sceptic party was able to gain any seats. But such a victory came at a price: the major European topics (joining the euro-zone, land-ownership by the foreigners) were left aside; the EP electoral campaign was overshadowed by Presidential elections with populist discussions about Russian threats and national security. The coincidence of two political campaigns boosted the voter turnout and made a significant impact on the distribution of MEP seats; because of the higher turnout, smaller parties were able to enter the EP, while two established parties with devoted core voters suffered some losses compared to the 2009 EP elections.

The European Union, together with the Member States of this organisation, is the largest donor of humanitarian aid in the world. The European Parliament is one of the EU’s key institutions and the only one of them to be directly elected. The aim of the peper is to examine Parliament’s position on humanitarian aid, from the adoption of the European Consensus on Humanitarian Aid in 2007 to the end of June 2018. The research method is an analysis of the various forms of Parliament’s activity in the field under examination. One of the conclusions is to define Parliament’s dilemma of trying to reconcile the principles of humanitarian aid with the particular interests of EU Member States.
Unia Europejska wraz z państwami członkowskim tej organizacji jest największym dawcą pomocy humanitarnej na świecie. Parlament Europejski jest jedną z kluczowych instytucji UE i jedyną spośród nich, wyłanianą w wyniku wyborów bezpośrednich. Celem tekstu jest zbadanie stanowiska Parlamentu wobec pomocy humanitarnej, począwszy od przyjęcia Konsensusu europejskiego w sprawie pomocy humanitarnej w 2007 r. do końca czerwca 2018 r. Metodą badawczą jest analiza różnych form działalności Parlamentu w badanym zakresie. Jedną z konkluzji jest zdefiniowanie dylematu Parlamentu, polegającego na próbie pogodzenia zasad pomocy humanitarnej i partykularnych interesów państw członkowskich UE.

One of the key issues in the process of preparing for an election to the European Parliament is to determine the number of seats for each country. The Treaty of Lisbon, signed by Member States of the European Union, has obliged the European Parliament to establish rules guaranteeing that the distribution of seats should be done according to, inter alia, the principle of degressive proportionality. The purpose of this paper is to explore how the principle of degressive proportionality is actually implemented, and to propose a compromise – a mathematical solution, guaranteeing that the distribution of seats is consistent with the requirements of the Lisbon Treaty.

One of the main factors that determines voter turnout is the mobilisation of the constituency of a given party compared with that of its opponents. The turnout in the 2019 European Parliament election in Poland was twice what it had been in previous years, and the result was forecast accordingly. The media initially reported that the victorious PiS had benefitted from new votes. The present article shows that drilling down to the lowest level of administrative unit (viz. the gmina) actually reveals a negative correlation between higher frequency and increased support for PiS in many cases. This implies that PiS did not win solely as a result of new voters being mobilised, but also, and perhaps predominantly, because KE voters switched their allegiance to PiS. Many new voters actually voted for the opposition.

RESEARCH OBJECTIVE: This article aims to present the principles of decision-making, distribution of competences regarding the common commercial policy (CCP), with attention given to the evolution of European Parliament’s (EP) role and to identify actions taken by the EP in relation to the CCP. THE RESEARCH PROBLEM AND METHODS: Due to the Member States’ delegation of powers to the supranational level and decision-making procedures, allegations that there is no democratic legitimacy in the European Union are of particular relevance to the CCP. In this context, special importance is given to the role of the European Parliament and powers vested in it, especially over the past years. The article employs an analytical and descriptive method. THE PROCESS OF ARGUMENTATION: The first part presented decision-making principles for the EU’s common commercial policy. Next, the evolution of the European Parliament’s role in the shaping of the CCP was discussed. Finally, the last part gives attention to the EP’s actions in practice and attempts to assess what was a decisive factor behind the Parliament’s specific position. RESEARCH RESULTS: The Treaty of Lisbon increased the formal powers of the European Parliament with regard to the CCP, but at the same time, diminished the role of Member States’ national parliaments (which was due to the fact that the CCP coverage was extended and the scope of the EU’s exclusive competences was broadened). The research conducted has revealed that the EP is more and more often taking advantage of its position in the shaping of the EU commercial policy. CONCLUSIONS, INNOVATIONS, AND RECOMMENDATIONS: Due to the fact that the role of the European Parliament in the decision-making process has increased, the issue of a democracy deficit in the shaping of the CCP, which was raised in the pre-Lisbon Treaty period, is currently becoming less formally legitimate.

This paper presents the attitude of the European Parliament to those issues that fall within the scope of interest of the Eastern Partnership. In the analysis of this attitude, the author stresses the significant role the EP has played in developing EU Eastern policy, in particular as concerns the promotion of democratic ideas and values within the scope of this policy. It should be emphasised that the EP is exceptionally interested in the advancement of democracy in East European partner countries, whose geopolitical significance the EP appreciates, frequently calling for the tightening of relations with these countries, and even opening European prospects to them. The deepening of cooperation between the EU and East European countries is conditioned by the EP by their adoption of what is called European values (i.e. democracy, rule of law, protection of human rights, etc.). Acting as the ‘guard of democracy,’ the EP is an institution of political influence which allows it to shape Eastern policy in ways that go beyond the formal rights vested in it by the treaties.

This article focuses on the issue of equality of elections, in the context of the 2014 European Parliament election in Poland. Most often the definition of principles of elections’ equality comes down to emphasizing its two aspects: the formal one and the material one. The first of them refers to guaranteeing each person with the active voting right the same number of votes. The material aspect of the equality principle is connected with striving to guarantee the same “voting power” to the election participants. Most briefly, it means that a given number of people elect as many representatives as another group with the same numerical strength. The main aim of this article is focus on the material aspect of implementing the principle of equality in EP elections. In the article will be emphasized three issues decisive for the specific features of the electoral system (electoral districts, election threshold and electoral formula), at the same time influencing the range of implementation of the material equality of elections. General findings will be confronted with empirical data, which will allow to formulate conclusions about the degree to which the European Parliament election conducted in Poland on 25th May 2014 met the principle of material equality.

Republika Austrii, 1 lutego 1994 r. podpisała traktat akcesyjny i z dniem 1 stycznia 1995 r. stała się pełnoprawnym członkiem Unii Europejskiej. Członkostwo zobowiązało Austriaków do “dostarczenia” Wspólnocie odpowiednich osób do objęcia różnych stanowisk w różnych unijnych organach. Nie inaczej było także w przypadku Parlamentu Europejskiego. Ważnym aspektem stało się dostosowanie poszczególnych norm ustawowych i własnej konstytucji do nowych rozwiązań. Celem niniejszego opracowania jest właśnie przedstawianie austriackich rozwiązań w tym temacie na tle rozwiązań europejskich, ze szczególnym uwzględnieniem unormowań rzadko spotykanych lub wręcz odrębności sytemu Republiki Austrii. Rzecz wydaje się być interesująca zarówno z punktu widzenia praktyki ustrojowej państw członkowskich Unii Europejskiej, jak i z punktu widzenia czytelnika. To drugie podejście pozwoli na ocenę austriackich rozwiązań na tle niedawno wprowadzonej ordynacji wyborczej do PE zawartej w Kodeksie Wyborczym, ale również może podsunąć pewne pomysły, co do przyszłych nowelizacji. Autorzy zwrócili szczególną uwagę na dwa rozwiązania: obniżenie cenzusu wieku czynnego prawa wyborczego oraz jednookręgowy system wyborczy. Austriackie doświadczenia mogą być również pomocne państwom, które wprowadzają możliwość głosowania korespondencyjnego. Są to propozycje szczególnie interesujące z punktu widzenia przyszłych, możliwych nowelizacji systemów wyborczych państw członkowskich.
On 1 February, 1994 the Republic of Austria concluded the Accession Treaty and on 1 January, 1995 became a full member of the European Union. Membership obliged Austrians to ‘provide’ the Community with appropriate personnel to take up different posts in various EU authorities, as well as in the European Parliament. The most important issue was to alter particular statutory regulations and the Austrian Constitution to adjust to the new situation. The paper aims at presenting the Austrian solutions in this matter in the context of European Union law, with particular emphasis on regulations which are uncommon or specific to the Republic of Austria. The matter of interest is the constitutional practice of EU member states and the reader’s perspective is taken into account. The latter approach not only evaluates the Austrian solutions in the context of the electoral law to the European Parliament contained in the Election Code, but could also suggest some ideas in regard to prospective amendments. The authors would, in particular, like to pay attention to two issues: the lowering of the voting age, and the single constituency electoral system. The Austrian solutions might be valuable to refer to in the countries where a system of correspondence voting is just being introduced. These resolutions are particularly interesting taking into consideration prospective, possible amendments to the electoral laws of the EU member states.

The paper is devoted to one of the oldest and major organs of the European Union, namely the European Parliament. It presents the origin and development of this institution dating back to the first European Communities i.e. European Coal and Steel Community of 1952 and the European Economic Community of 1957. The author describes the prerogatives of the Parliament acquired progressively together with the development of the European Communities and the EU, its members and structure and the organization of work. A lot of emphasis is put on the role of the European Parliament in the integration process and building the united Europe. The paper also contains a lot of Polish aspects e.g. it describes the Polish road to the EU and the European Parliament and the course and results of the election to this EU institution in June 2004 when Poles (for the first time in history) elected their members of the European Parliament. The author also attempts to present the perspectives of the European Parliament in the enlarging European Union stressing the fact that before it is possible a new vision of the EU and the uniting Europe has to be worked out, the vision which does not seem to be easy to achieve. The concept like this is still non-existent and the author doubts that we can soon expect its creation.

The aim of this paper is to present the results of an automated research conducted on the most popular Polish Internet news portals in the week of the 2009 European Parliament election as well as during four weeks prior to this event. Detailed analysis of the exposure levels of main political parties is included and compared with the election results. This paper describes the quantitative analysis of the data gathered. The main similarities and differences in covering the election between portals are also discussed. Moreover, this article aims at introducing basic concepts of research tools, which allow to automate the procedure of gathering data from the Internet and processing it.

In European Union there are three levels of law governing elections to the Europen Parliament. First of all, European Union election law is regulated by the primary law and directive 93/109/WE as well as by the jurisprudence of the European Court of Justice. The second level is that of the Council of Europe – set out in the European Convention of Human Rights and interpreted by the European Court of Human Rights – to guarantee basic election principles. The third level of election law is national law. This, naturally, must conform to the wording of the Convention and decisions of the ECtHR in all member states of the Council of Europe and to the European Union election rules in 27 EU member states. The author of the article presents European Union law regulations concerning to the all stages of the electoral process and proposals of changes in this area. Stages of electoral process regulated in the European Union law are: ordering the elections, nomination of elections, setting roster of persons which have right to elected and right to be elected, electoral campaign, voting, establishing of the voting results and announcing of them, establishing of the elections results, affirmation of the validity of the elections, expirations of the mandate and by-elections. The author presents the opinion, that there are two ways of evolution of European Union regulation concerning to the elections to the European Parliament. First is gradual widening regulations of Act concerning the election of the members of the European Parliament by direct universal suffrage, and second is establishing the all-European constituency, in which right to present candidates would have only European political parties.

The Kuyavian-Pomeranian Voivodeship constitutes one of the smallest of the Polish voivodeships. It is composed of nineteen land districts and four city counties, including Bydgoszcz, Torun, Wloclawek and Grudziadz. According to the data provided by the Public Electoral Commission (PKW), in 2009 the Kuyavian-Pomeranian Voivodeship was inhabited by more than 2 million people, 1.65 million of whom had the right to vote. Despite the relatively small number of inhabitants, due to provisions of the act regulating the process of voting for the Members of the European Parliament, the voivodeship in question became a separate electoral district with the electoral commission located in Bydgoszcz. This decision was infl uenced mostly by members of the Democratic Left Alliance (SLD) representing this region in the Polish Parliament. This lobbing activity seemed benefi cial from the party’s perspective, since SLD has been gaining extraordinary support in the region. But for this lobbing, the voivodeship under consideration would have been included in one district together with the Pomeranian Voivodeship, where the majority of voters are prone to give their support to the right-wing and centre-wing parties.

The draft position of Polish government on the proposed directive does not raise doubts, and the impact assessment of the proposal contained therein is consistent with the assessment by the Bureau of Research of the Chancellery of the Sejm. The draft position was submitted to the Sejm 30 days after the expiry of the time limit specified by the so-called Cooperation Act.

In the article the main characteristics of the European Parliament elections in 2014 in relation to the characteristics of the both previous elections to the Parliament were analysed. First, the legal framework is presented, followed by the presentation of candidate lists. As it is frequently the case, the authors for the analysis employed the analytical framework presented by Reif and Schmitt (1980). Following the framework, it is obvious the elections in Slovenia again demonstrated many elements of the second-order elections framework, for example in terms of the turnout, success of the governmental parties, success of small parties, as well as almost complete absence of party programmes, Euroscepticism and European topics in the campaign. Since several important domestic events happened just before the EP elections (e.g. resignation of the government at the beginning of May and the fact the leader of the biggest opposition party was by the court found guilty of corruption activity and sent to the prison at the end of April) such developments did not come as a big surprise.

Politicians and political campaigns are not inadvertent to the development of social media platforms as environments that allow access to a larger audience. Not relying solely on the traditional media as a mouthpiece for their messages and taking matters into their own hands offers new segues for analyzing political communication. However, not all elections are of equal interest, both for the electorate and for the candidates, as second-order election theory suggests (Reif & Schmitt, 1980; Hix & Marsh, 2004). Th is paper investigates the area situated at the intersection of these two research directions. This quantitative study aims to analyze how Romanian political parties and candidates used Facebook in the electoral campaign for the European Parliament, in May 2019. The study follows the correlation between Facebook metrics, like frequency of posts and the popularity of the pages, and the political agendas refl ected in each party’s Facebook posts. The conclusions are consistent with second-order elections theory, but raise questions about the dependable nature of Facebook metrics.

Целью этих соображений является анализ избирательной кампании в Европарламент в Польше в 2019 году. Были рассмотрены следующие пункты: политическое предложение, сформулированное партиями во время избирательной кампании, и явка избирателей. В качестве основ-ных субъектов анализа были выбраны два избирательных комитета: Европейская коалиция и Объединенные правые. Выборы в ЕП в 2019 году интересны из-за двух явлений. Во-первых, из-за мобилизации элек-тората на выборы текущая средняя явка избирателей не превысила 25% поддержки. Во-вторых, в каком степени влияние на выборы и явку Поляков имело то, что «Право и справедливость», выступая с политическим предложением перед выборами, «случайно» не купило голоса избирате-лей.

Just before the 2019 European Parliament (EP) elections many authors have indicated their exceptional nature. In this article the author attempts to analyze how these particular characteristics and fi rst decisions taken after the elections by the key EU level actors may shape the EU integration process in the coming years. The article focuses on how the fragmentation of the EP may infl uence the choice of the European integration directions in the near future. One of the first observed effects of this fragmentation was the failure of leading candidates system during the appointment process of the Commission President. Another one is Ursula von der Leyen’s political programme for the European Commission, built on the strong awareness of the need to create a governing coalition between the EP and the European Commission. Acknowledgment of the challenge of the EP diversity by the New Commission President may have a positive effect on the EU-level democracy, however with a decrease in the efficiency of the EP legislative process.

Election of Members of the European Parliament on Polish territory for the first time took place in 2004. This election is a historic moment, because Poland and Polish people for the first time we were able to choose their representatives to the European Parliament. For the first time will Parliamentarians have its European family, the structures of the Polish accession to the European Communities, so that we share responsibility for the further development and future of our Europe. The elections were conducted under the Act of 23 January 2004 – Elections to the European Parliament. The literature on this subject is small, they are mainly publications concerning mechanisms for passing laws and discussing its main goals. Existing data do not cover the whole subject, as appeared before the majority of the Ordinance implementing acts. I hope that my article although the closer the issue of electoral law and the holding of elections to the European Parliament, and will be for the reader an introduction to the handbook and knowledge for entry to the course of European integration, European communities law and will bring the functioning of the institutions of the European Union.

The European Union (UE) is a unique organization, the representative organ of which – European Parliament (EP) – is chosen in universe elections. It was established in 1951 under Treaty of Paris as the General Assembly of the European Coal and Steel Com- munity. The Rome Treaties, establishing the European Economic Community and the European Community of Atomic Energy, continued the idea of a representative body by creating the Assembly of the European Communities. In 1962 the members changed the name from Assembly to European Parliament. A new name was officially recognized by the European Single Act in 1986. At the beginning, the members of the Assembly were appointed by national parliaments, since 1979 they have been elected in direct elections in accordance with the national law of the Member States. The aim of this article is to analyze EP direct elections through depicting the process of their implementation, discuss the turnout and introduce a new proposal for the electoral system such as electronic voting (e-voting).

This article discusses the problem of the definition of degressive proportionality. This term is used in many areas of economics but its meaning is not standardized. It is understood differently when related to tax issues compared to distribution of seats in the European Parliament. The differences are small but significant. The article provides and analyzes the different meanings of the concept of degressive proportionality and proposes to introduce two new concepts – concave degressive proportionality and convex degressive proportionality.

This article analyses the position of European Parliament (EP) in the question of the lasting from 2010 association process of the South Caucasus countries with the EU. The process is aimed at the establishment of close, extensive political and economic cooperation of the countries with the EU. The author stresses the importance attached by EP to the association negotiations, which according to the Parliament should have a crucial impact on the democratization process in Azerbaijan, Armenia and Georgia. It should be underlined that the development of democracy in those EU’s partner countries is of special interest to EP, which in recognition of their geopolitical importance with its numerous resolutions requires making closer relations with them and even providing the countries with a potential European perspective (Georgia). However the more extensive cooperation of the EU with the countries is made dependent by EP on the incorporation by Azerbaijan, Georgia and Armenia of the values defined as European (democracy, rule of law, protection of human rights etc.). That is why so important for EP are the questions of human rights observance, observance of the rules of democracy and law, including transparency and fairness of the processes in the countries. In case of violating rules constituting foundations for democratic and lawful country’s functioning, EP responds in a determined way and usually takes un unambiguous stand quite often contrasting with more “weighted” opinions of other Union institutions.

The Uniform European Act was passed on July 1st, 1987. It modified some articles of the Tracts which create the European Community as well as introduced some new articles: They concern also the decision-making process on the part of the European Community and the place of the European Parliament in it. The European Parliament many a time expressed its opinion on the Uniform European Act during negotiations on its text and after its ratification. The European Parliament has been endowed with new opportunities of participation in the decision-making process of the European Community by: 1/ establishing the procedure of cooperation /or joint action/ and expanding the procedure of consultation in the legislative process, 2/ establishing the procedure of acceptance as regards the membership contracts, association end other forms of cooperation with the European Community, 3/ incorporating European Parliament in European Political Cooperation. It is meant to bring about a greater participation of the European Parliament in the decision-making process of the European Community and, consequently, create such an opportunity for the citizens of the European Community. It is since 1979 on that the members of the European Community have been elected in direct suffrage.

The present paper offers an analysis of the attitudes of Polish citizens towards the process of European integration. Two major points can be highlighted, based on the data obtained from various opinion surveys, e.g. CBOS, PBS, ISP, OPTEM, and Eurobarometer. The first one concerns the initial high level of scepticism in Poland about the decision to join the EU. The results of the public opinion polls indicated that Poles had agreed to be the Member State more “under pressure exerted by the course of history and that of the current European affairs” rather than “by an informed choice”. It may well be that due to this scepticism, Poland, as one of the few countries to join the EU, did not experience the socalled post-accession shock. On the contrary, the results of surveys suggested that there was a rapidly growing belief among Poles in positive repercussions of the accession, at least until the time when the effects of the economic crisis began to transpire. The second problem deals with how Poles see themselves as the members of the European Community. The data show that Polish citizens consider the membership in the EU as a fact of life, an existing condition that does not stimulate their action if the affairs are not directly associated with their own interests. That is probably the reason why Poles do not feel co-responsible for the European project. They still see the Union as an organisation that is supposed to bring profit but, at the same time, they do not feel obliged to actively take on responsibilities that follow.

In April 2017, a delegation from the Committee on Budgetary Control of the European Parliament inspected selected EU projects in Poland. Some 20 projects were examined in Wrocław, Wieluń, Bełchatów, Stryków, Warka and Warszawa, as well as some road investments. Since NIK conducts annually at least five audits directly dedicated to the management and spending of the EU funds, the Committee delegates had a meeting with the leaders of NIK so as to benefit from NIK’s expertise in EU funds utilisation in Poland.

The main research concern of this paper is the marketing tools used in the electronic media by political entities for the purpose of winning social support. The author refers to the two election campaigns preceding the European Parliament elections in 2004 and 2009. The theoretical foundation for the research was provided by the concept offraming of media messages. On account of the abundance of the material collected, the paper presents observations made with reference to audiovisual commercials and the content of the websites belonging to the political entities that won EP mandates in those elections. The analysis evidences the attachment of political entities to the dissemination of their promotional materials via television, on the one hand, and their consistently increasing interest in Internet campaigns on the other. A clear trend of the presidentialization of politics can be noted, as the key role in election campaigns and persuasive message dissemination is played by party leaders.
Główne refleksje badawcze w artykule koncentrują się na zastosowanych przez podmioty polityczne narzędziach marketingowych w mediach elektronicznych celem pozyskania poparcia społecznego. W kręgu zainteresowań autorki znalazły się dwie dotychczasowe kampanie wyborcze poprzedzające wybory do Parlamentu Europejskiego w 2004 oraz w 2009 roku. Teoretyczną podstawą badań była koncepcja ramowania (framing) przekazów medialnych. Ze względu na obszerność zgromadzonego materiału badawczego w artykule ostatecznie zaprezentowane są spostrzeżenia dotyczące reklam audiowizualnych oraz zawartości witryn internetowych podmiotów politycznych, które w wyniku elekcji uzyskały mandaty w Parlamencie Europejskim. Przeprowadzona analiza wykazała z jednej strony przywiązanie podmiotów politycznych do rozpowszechniania materiałów promocyjnych w telewizji, z drugiej konsekwentnie wzrastające zainteresowanie również kampanią prowadzoną w Internecie. Wyraźnie zarysowującym się zjawiskiem jest prezydencjalizacja polityki - kluczową rolę w kampaniach wyborczych, w tym w przekazach perswazyjnych odgrywają liderzy partyjni.

The opinion shows that, specifying the range of entities that can participate in closed committee meetings, the Standing Orders of the Sejm expressly states that such meetings may be attended by Deputies who are not members of that committee and the persons whose participation the committee deems indispensable. There is no legal basis for the admissibility of participation of MEPs in closed meetings of Sejm committees that involve classified information. The author of the opinion notes that the possible attendance of a Member of the European Parliament at such a meeting would implicate the recognition by the Commission of their attendance “as indispensable” and the requirement to present of an appropriate security clearance.

The adoption of the draft regulation constitutes a further step in the development of the electoral procedure for elections to the European Parliament. It will replace the 1976 Council Decision and the Act concerning the election of the representatives of the European Parliament by direct universal suffrage annexed to that Decision. The authors set out concerns relating to, inter alia, the proposed institution of an EU-wide constituency and common provisions for election campaigns. Further doubts are raised regarding the proposal to fix uniformly the voting day for EP elections and the institution of a ‘temporary MEP’. In the draft position of the RP, the Council of Ministers “assesses the draft regulation negatively, due to the contradiction of some of the solutions proposed in the proposal with the legal order currently in force in the Republic of Poland”.

This article analyses the position of the European Parliament on the priorities for the development of the EU Common Security and Defence Policy. The issues covered by this policy after the entry into force of the Lisbon Treaty remained the domain of intergovernmental cooperation mechanisms. Despite the changes made to the Lisbon Treaty to unify the Union’s external relations by removing its pillars and expanding CSDP tasks, the role of the EP in its creation has not increased in line with its expectations. In accordance with the provisions of the TEU, decisions on the operation of the CSDP shall be adopted by the Council, acting unanimously on a proposal from the High Representative of the Union for Foreign Affairs and Security Policy or from a Member State. As a result of such Treaty arrangements, the EP is unable to play such a role in the area of CSDP that would correspond to the importance of this body in the EU’s institutional system. Therefore, the main instrument for the implementation of the EP policy in the area of CSDP remain resolutions in which this body calls for the inclusion of transnational cooperation mechanisms in it. By expressing its position in resolutions, the EP advocates for the development of a strong, unified CSDP based on defined European security interests, as well as the development of a pan-European approach to the issues covered by this policy.

Over the years of the technological development of societies and evolution of the economic cooperation amongst states, its role and scope of responsibilities have gradually grown. The European Parliament is one of the key elements of the institutional system of the European Union, and thus, the only body, the composition of which is elected in direct election. This body, as a forum for universal representation by the elected deputies from the member states, brings together views and positions not only of the representatives but also of their electorate. The parliament is also an expression of the multinational EU community, its voice and its desire to have influence on the fate of the entire EU. This article presents the evolution of the European Parliament and of the election law concerning this body, since its formation as an institution of the European Union until now. The purpose of this article is to present changes which have taken place in the EU legislation in respect of the electoral law, on the basis of which members of the parliament are elected, since the formation of the EP. The main subject of this article covers following issues: how the evolution process of the parliament has looked like over the years, how its position in the institutional architecture of the EU has been evolving and how it has been endeavoured to harmonize electoral procedures to this body over the years. The article is about the evolutionary political position of the EP. The article focuses on selected aspects of unification of the electoral procedure for the election to the EP due to their path-breaking character and importance of the procedure being currently in force.
Jednym z najważniejszych elementów przesądzających o demokratycznym ustroju państwa jest bez wątpienia parlament, czyli kolegialny organ wyłaniany z bezpośrednich wyborów, będący jednocześnie emanacją woli obywateli jako suwerena. Na początku parlamenty wypełniały mało skomplikowane zadania, były jedynie organem reprezentacyjnym. Z upływem lat, rozwojem technologicznym społeczeństw i ewolucją realiów ekonomicznej współpracy państw ich rola oraz zakres kompetencyjny ulegały stopniowemu wzrostowi. PE jest jednym z kluczowych elementów systemu instytucjonalnego Unii Europejskiej, a tym samym jedynym organem, którego skład jest wybierany w bezpośredniej elekcji. Organ ten, jako forum powszechnej reprezentacji przez wybranych deputowanych z państw wspólnoty, skupia poglądy i stanowiska nie tylko samych reprezentantów, ale również ich elektoratu. Parlament jest również wyrazem wielonarodowej społeczności UE, jej głosem i dążeniem do wpływania na losy całej UE. Artykuł przedstawia ewolucję Parlamentu Europejskiego oraz ordynacji wyborczej w wyborach do tegoż organu od początku jego kształtowania się jako instytucji Unii Europejskiej do chwili obecnej. Celem niniejszego artykułu jest ukazanie przemian, jakie od początku tworzenia się PE następowały w ustawodawstwie UE w odniesieniu do samego PE oraz do ordynacji wyborczej, w oparciu o którą wyłaniani są jego członkowie. Podstawową tezą przedmiotowego artykułu jest zagadnienie, jak wyglądał proces ewolucji PE na przestrzeni lat, jak zmieniała się jego pozycja w systemie instytucjonalnym UE oraz jak z biegiem lat dążono do ujednolicenia procedury wyborczej w wyborach do tegoż organu. Artykuł dotyczy ewolucyjnej pozycji ustrojowej PE. Skupia się na wybranych aspektach ujednolicania procedury wyborczej w wyborach do PE z uwagi na ich przełomowość i doniosłość w obowiązującej obecnie procedurze.

The principle of degressively proportional distribution of seats in the European Parliament has been legally sanctioned under the terms of the Lisbon Treaty. Thus there appeared a solution which defied the perception of justice of distribution according to culturally shaped proportional allocation rules. Previous methods of determining the composition of collegiate bodies generally used the rule of proportional to the population of each constituency, composition of the legal body representing the society. On this basis, there are many socially accepted methods which have been tried and tested. In the field of electoral law regulations the rule of degressive proportionality is a new solution, and as such it still lacks tradition and already shaped approval that may justify its use. This article aims to find justification for this solution as opposed to the socially accep- table methods of distribution of goods and debts. In order to arrive at this argument the article reaches back to Aristotle’s philosophical concept, as well as solutions taken from the Talmud. It turns out that the degressive proportionality falls within the accepted concepts of equitable distribution. It offers an intermediate solution between equal and proportional allocation. There are also legitimate reasons for the use of degressively proportional rule in the process of allocating seats in the European Parliament. The problem is only the lack of unambiguity of the rule and the lack of precise reasoning to determine the boundary conditions at the level set in the Lisbon Treaty. This creates a very high degree of freedom of interpretation, leaving room for political negotiations on the acceptance of specific proposals. This situation has led to the point that, since the legal acceptance of the principle of degressive proportionality, the rule has not been applied in practice. Proposals for the composition of the European Parliament presented at the beginning of 2013 for the term 2014-2019 indicate that over the next five years exceptions to this rule will be approved. The second part of the paper presents proposals on solving the problem that can be found in the literature, as well as two other directions for seeking fair allocation. They cannot be deprived of discretion, as, of course, it is not possible to obtain conclusive decisions without the introduction of additional postulates. These postulates aim at clarifying the determination of the boundary conditions in such a way as to reduce the number of possible solutions or introduce an additional rule that will allow for an unambiguous (for a given population) specification of composition of the European Parliament. This is possible thanks to, inter alia, the ability to generate all feasible solutions. In this situation the solution of the problem is to select one out of a finite number of known divisions according to an established criterion. This frees the process of selecting the composition of the European Parliament from political considerations, and moves the weight of the debate to the ground of determining the said additional criterion. The current problem concerning the distribution of seats in the European Parliament is of course more general. The conditions that caused sanctioning of such a solution are of economic and social origin. It is expected that in the future the number of problems associated with allocation of goods, that are solved in this way, will be greater than they are currently. Undoubtedly, inequalities in various aspects of social existence favor the issue.

Members of the European Parliament are entitled to a transitional allowance in the amount of their salary for the period of one month for each year in which their mandate has been exercised. In case of exercising the mandate of a Deputy to the Sejm of the Republic of Poland, the allowance should be reduced by the amount of the Deputy’s salary. Should a former MEP be entitled simultaneously to the payment of the transitional allowance and the old-age pension, he or she must choose one or the other. While exercising the mandate of a Deputy to the Sejm the European Parliament old-age pension is reduced by the amount of the Deputy’s salary.

The withdrawal of Great Britain from the European Union turned out to be important not only for the citizens of this country but for all Member States of the European Union. One of the important consequences of the notification of the withdrawal from the organization was to determine the constitution of the European Parliament taking into account variants of the moment when Brexit takes effect. The paper analyzes the impact of the UK’s withdrawal from the European Union on the conduct of elections and the appointment of seats in the European Parliament. This issue is presented primarily on the example of the elections held in Poland. The first part of the article discusses the procedure for the withdrawal of Great Britain from the EU and related problems. The second part is devoted to the impact of Brexit on the distribution of seats in the EP depending on the moment of Great Britain’s withdrawal from the European Union. The third part of the article examines problems associated with the procedure for indicating a Polish representative awaiting his mandate and his status.

The salary of a Member of European Parliament is taxed on the same terms as salaries of officials and other employees of the European Union. Benefits related to exercising of a MEP mandate are tax free (exempt from EU tax). MEPs’ salaries, parliamentary allowances and other incomes are exempt from Polish income tax. The Polish domestic MPs’ salaries are taxed with a personal income tax as an income from employment. The parliamentary allowance and certain other benefits are exempt from the income tax.

For a growing group of voters the UKIP party ceases to be a second choice, and it becomes a main party. But, contrary to popular belief, its electoral success is only partly due to its Eurosceptic program. Its growing support is rather the result of disappointment in policies of the main parties and a sense of alienation of a growing social group, failing to find its way in a liberal, multicultural society. Note, however, that the UK electoral system rewards parties that have geographically concentrated support, yet in case of UKIP it is distributed fairly evenly. For this reason, even a significant popular support will translate only in a small degree into the seats in the House of Commons. UKIP electoral successes has forced the major political parties to modify their policies, which manifested mainly in radicalization of their programs in the area of immigration and asylum policy, as well as their attitude towards the UK’s membership in the European Union.

Traktat o Unii Europejskiej stanowił nie tylko istotny etap na drodze do integracji gospodarek krajów „Starego Kontynentu”, ale był także praktycznym wyrazem woli zmierzania w kierunku Europy federacyjnej, która to koncepcja obecna była już u samego zarania wspólnot europejskich.
The Treaty on European Union has widened the scope of the European Communities, which were united in one body – The European Community. The Treaty has also introduced the term and institution of the “European Citizenship”. The position of the European Parliament was strengthened significantly due to broadening the range of co-decision procedure. The EU Treaty had been not only an important stage of European integration but also a display of will of states of the “Old Continent” to follow the path of federalized Europe, what was already set as a goal in early beginnings of the European Communities.

The study concerns the relations between the Polish Constitution of 1997 and the regulations of EU treaties in the area of granting EU citizens who are not Polish citizens electoral rights on the territory of the Polish state. These rights refer to active and passive electoral law with regard to elections to the European Parliament and to local self-government (commune). Electoral rights are treated as an institution intended only for Polish citizens. Thus there is a situation of incompatibility between the constitutional standard and the electoral rights of all EU citizens. This problem has been considered by the Polish Constitutional Tribunal, but due to its complexity and its systemic nature has not been resolved.

For some, thoughts and ideas of a famous statesman are fascinating and for others is the future influence of NGO’s on local communities. One thing, one time is said to have enough potential to unite attention of most of political scientists, as this is an event when they may observe how matters that they are especially interested in are apprehended. This mentioned event is, in my opinion, what elections indeed are and some may even say that elections are the festival of politics and sometimes of democracy.

The Polish electoral system to the European Parliament has been criticized for as long as it has been in operation; that is, uninterruptedly since 2004. The commonest objections and criticisms concern the lack of the fixed assignment of seats to territorial districts; significant and unjustified differences in population size among districts; risk of not winning a single seat by the smallest districts; unequal territorial representation; overcomplicated and unclear mechanism of translating votes into seats and in consequence creation of an illusion of a territorial representation. However, there are at least four alternative elector - al systems which are able to eliminate all the drawbacks of the current model while war- ranting the proportional seat distribution both among electoral districts in accordance with the principle of material equality of each vote and among election committees pursuant to the requirements set for the electoral systems of the member countries by the European Union law. The aim of the paper is to compare these alternatives with the cur- rent model, pinpoint the drawbacks and advantages of each solution and indicate which criteria are optimized by the respective electoral systems.
Obowiązujący w Polsce nieprzerwanie od 2004 r. system wyborczy jest krytykowany od samego początku jego funkcjonowania. Zastrzeżenia i uwagi najczęściej dotyczą nieprzypisania mandatów na stałe do okręgów terytorialnych, nieuzasadnionych i znaczących różnic populacyjnych w obrębie okręgów, ryzyka nieuzyskania ani jednego mandatu przez najmniejsze okręgi, nierówną reprezentację terytorialną, skomplikowanie i nieprzejrzystość systemu podziału głosów na mandaty, paradoksalne podziały mandatów pomiędzy okręgi wyborcze, a w konsekwencji stwarzanie iluzji reprezentacji terytorialnej. Tymczasem istnieją co najmniej cztery alternatywne systemy wyborcze, które eliminując wszystkie wady obecnego modelu gwarantowałyby proporcjonalny podział mandatów zarówno pomiędzy okręgi wyborcze zgodnie z zasadą równości materialnej głosy, jak również pomiędzy komitety wyborcze zgodnie z wymaganiami stawianymi krajowym systemom wyborczym przez prawo europejskie. Celem tego artykułu jest porównanie tych alternatyw z obecnym modelem, wskazanie wad i zalet każdego rozwiązania oraz kryteriów optymalizowanych przez każdy z nich.

The article offers a discourse-analytic examination of original (English) and interpreted (Polish) versions of several extracts from plenary speeches by three Members of the European Parliament (Janusz Korwin-Mikke, Nigel Farage and Guy Verhofstadt). Controversial statements that have met with adverse reactions of the audience and/or the media are selected for analysis. The author endeavours to assess the degree to which pragmatic equivalence has been achieved by Polish interpreters. Another pertinent question is whether the identified shifts are due to some systemic differences between the pragmatics of the source and target languages or to other factors, such as the constraints typical for simultaneous interpreting or specific, local problems.

This article addresses the problem of the EP’s role in the process of multi-level governance illustrated with the example of EU expansion policy through the accession of the West Balkan states. As an effect of the European integration process, resulting in the transfer of decision-making competences from the state level to the transnational level, nation-states have lost their monopolistic position in the European decision-making process. This has enabled the formation of multi-level political system within the EU. Within the system, there is a multi-level governance model, with the EP as its crucial element. This article reveals an important role of the EP as a transnational decision-making centre, which with its specific competences (giving consent to the accession of a country to the EU, giving consent to sign international agreements crucial for the integration process, budget rights, co-decisions on the form of the EU law with an ordinary law making procedure) considerably forms the policy of the EU in relation to the Balkan countries. The explanation of the policy’s functioning and its outcomes are based on the concept of multi-level governance, which is analyzed herein in depth.
Artykuł porusza problem roli, jaką odgrywa PE w procesie wielopoziomowego zarządzania na przykładzie polityki rozszerzania UE o kraje Bałkanów Zachodnich. Wskutek rozwoju procesu integracji europejskiej, skutkującego transferem kompetencji decyzyjnych ze szczebla krajowego na ponadnarodowy, doszło do utraty przez państwo narodowe monopolistycznej pozycji w europejskim procesie decyzyjnym. Pozwoliło to na ukształtowanie się w ramach UE wielopoziomowego systemu politycznego. W ramach tego systemu funkcjonuje model wielopoziomowego zarządzania, którego PE stał się istotnym podmiotem. W artykule ukazano znaczącą rolę PE jako ponadnarodowego ośrodka decyzji, który poprzez posiadanie określonych kompetencji (wyrażanie zgody na przyjęcie państwa do UE, wyrażanie zgody na zawarcie kluczowych dla procesu integracji umów międzynarodowych, uprawnienia budżetowe, współdecydowanie o kształcie prawa UE w ramach zwykłej procedury ustawodawczej) w sposób istotny kształtuje politykę UE wobec państw bałkańskich. Wyjaśnienie funkcjonowania tej polityki i jej skutków autor publikacji oparł na koncepcji wielopoziomowego zarządzania, która w artykule jest przedmiotem pogłębionej analizy.

This paper refers to the problem connected with the unification of the electoral law to the European Parliament. The idea of creating the electoral law which is unified and common for all Member States of the European Union is an initiative of relatively rich tradition. This tradition has been accompanying development of the European Union for several dozen years. The author of this paper talks about the most important historical events relevant to the discussed topic and tries to describe their influence on the current binding legal regulations. According to the accepted legal regulations the European Parliament is an institution appointed in the elections which are carried out not only on the basis of the European Union law, but also on national regulations. Further part of this paper is devoted to the analysis of current legal regulations based on the European law. What is more, national legal regulations adopted in the Member States are assessed and compared in this paper. The last part of this paper is the final conclusion in which the author estimates the outlook for introducing unification of the electoral law in all Member States.
W niniejszym artykule omówiona została problematyka dotycząca unifikacji prawa wyborczego do Parlamentu Europejskiego. Inicjatywa powołania do życia jednolitej, wspólnej wszystkim państwom członkowskim ordynacji wyborczej w wyborach do Parlamentu Europejskiego posiada bardzo długą i bogatą tradycją. W niniejszym opracowaniu jego autor przybliża najważniejsze wydarzenia historyczne związane z analizowanym tematem oraz omawia ich wpływ na kształt aktualnie obowiązujących rozwiązań prawnych. W chwili obecnej Parlament Europejski jest instytucją, której skład wyłaniany jest w wyborach przeprowadzanych zarówno na podstawie prawa Unii Europejskiej, jak i przepisów prawa właściwych poszczególnym państwom członkowskim. W dalszej części opracowania autor dokonuje analizy obowiązujących uregulowań prawnych oraz charakteryzuje systemy wyborcze poszczególnych państw członkowskich w wyborach do Parlamentu Europejskiego. Całość rozważań wieńczy ocena perspektyw związanych z unifikacją prawa wyborczego w wyborach do Parlamentu Europejskiego.

The aim of the article was to present factors influencing voting behaviours of the Subcarpathian Voivodeship citizens during European Parliament elections in 2014, in the light of the conducted empirical research. The indicators that guided voters when casting votes to ballot boxes were analysed on the basis of a set of variables, such as: the attractiveness of election programmes and political parties, competences of candidates, the role of the Catholic Church during the election campaign, or the awareness of voters (self-reliance in making electoral decisions or its lack). The analysis and interpretations from the conducted research were preceded by a voting description of the Subcarpathian Voivodeship, treated, on a electoral map of Poland, as a specific region due to its above average support given to candidates and parties of right-wing provenance. In the final part conclusions drawn from the analytical process were presented.

As a cultural institution for debate on European history, the House of European History in Brussels is a perfect example for the complementary relation between history and the present, since its main aim, as it is being claimed, “gives visitors the opportunity to learn about European history and to engage them in critical reflection about its meaning for the present day”. The main focus of the article is the analysis of the speeches of German and Austrian MPs presented in the plenary debates of the European Parliament in spring 2011 on the expenditures on the building, in which the House of the European History is to be established. The focus of the analysis lies on the lexical level in order to prove the typical aspect of the political language in the European Parliament, which is the special mixture of various specialist languages.

The opinion points out that the rules and procedures of Sejm’s international cooperation, especially contacts within the European Union, must be regulated by the Standing Orders of the Sejm. Currently, both EU law and national law allow the Sejm to cooperate with the European Parliament on impact assessment of European Union legislation, involving the transfer to the European Parliament of the possessed materials relating to the exercise of EU law. It is advisable to regulate the cooperation on the basis of Article 9 of the Protocol (No. 1) and – prior to the adoption of the said regulation – the cooperation should be based on the structure of COSAC.

Opis:
Parliament – an institution of a democratic state – a member of the Union – is not only an authority but also, as in the case of the European Union, the only directly and universally elected representative body of the European Union. The article presents questions related to the essence of parliament and that of a supranational parliament which are vital while dealing with the subject matter. It proves that the growth of the European Parliament’s powers was the direct reason for departing from the system of delegating representatives to the Parliament for the benefit of direct elections. It presents direct and universal elections to the European Parliament in the context of presenting legal regulations applicable in this respect. It describes a new legal category – citizenship of the European Union – primarily in terms of active and passive suffrage to the European Parliament, as a political entitlement of a citizen of the European Union.

The main axis of the narration in this article is the analysis of the electoral activity of young Poles from the perspective of the formal program of Citizenship Education in the area of shaping the attitudes of young people as active voters. The first part of the article presents the context of Polish civil society and the electoral activity of young Poles. The Author connects the analyses of youth electoral patterns to with the assessment of effectiveness of formal education, including textbook messages, in shaping and developing civic engagement in youth. The article presents the analysis of textbooks for civic education, as well as indicates some non-textual contexts for implementing civic education in Poland. The analysis of citizenship education textbooks becomes an opportunity to approximate multi-faceted challenge of shaping civil attitudes among young people in Poland.

Debates and controversies about the democratic legitimacy of the EU have of course accompanied the Union from the very beginning. The “democratic paradox” of the EU exists because while committing itself to promote and scrutinize democracy in its member states, in candidate states, and in third states with whom it enters into contact, it does not display equivalent democratic features in its own functioning. Some commentators tried to define the problem out of existence; by pointing out that the EU is not a state-like polity, they argued that state-specific criteria of legitimacy, such as representative, participatory or deliberative democracy, do not apply. They postulated outcome-based or, at best, public reasons based, conceptions of legitimacy as applicable to the EU, and concluded that it satisfies those standards. But this argument is based on a non sequitur: from the statement that the EU is not a state (not even a quasi-federation or federation in statu nascendi) it does not follow that it should not be judged by the standards of democratic legitimacy. The EU is a complex, untidy polity which amalgamates inter-governmental and supranational elements in its constitution, and therefore this article postulates a bifurcated approach to democratic legitimacy. In so far as the EU contains inter-governmental elements, indirect legitimacy is all that is required, i.e., democratic legitimacy of governments representing their respective states in the Council. The second face of the EU – its supranational character – calls for democratic legitimation of its institutions, in particular, in accordance with the promise contained in Art. 10 TEU, proclaiming representative democracy in the institutional setup of the EU. This requires changes to the electoral system of the EP in order to provide incentives for a more trans-European electoral process; strengthening of the supervisory role of the EP over the Commission; the strengthening of the role of the EP with regard to legislation, and endowing it with the competence of legislative initiative. Overall, the idea is for the institutional setup to resemble a canonical model of separation of powers and inter-institutional accountability, with the EP in a dominant position. Additionally, the first gesture towards direct democracy in the EU, the European Citizens’ Initiative, should be strengthened, both by upgrading the status of successful initiatives and by lowering thresholds and administrative requirements.

The article deals with the research of cooperation and political dialogue between the European Parliament and the Verkhovna Rada of Ukraine. Parliamentary dialogue holds one of the key places in the system of foreign policy. The League of Polish Families campaigned on the position that the European Union threatened the political, economic and cultural sovereignty of the Polish state. The danger was the aspiration towards closer integration of the EU which, according to the opinion of party’s leaders, was the first step towards the creation of a transnational system, and a Poland (and others among the poorer European states) dependent on the decisions of the EU’s author-ities. In the new EU Poland would have to execute orders from Brussels, contrary to Polish national interests and preclusive its development. LPR took part in the election to the European Parliament, because of their desire to have their own deputies within the EU’s structures, who could stand up for better conditions of Polish membership, advan-tageous decisions in the EP and popularize their own political ideas in Polish and interna-tional environment. LPR took advantage of the lack of enthusiasm of Polish citizens towards Polish accession to the EU, so their anti-EU and national propaganda gained the support of a large proportion of the electorate and strengthened their position on Polish politi-cal scene.

Proportionality is an intrinsic feature of parliamentary democracy. It is a principle stating that, depending on its size, each political party has a commensurate ability to influence legislature. This is confirmed by comparative studies which show that proportionality is a significant principle in the distribution of parliamentary posts in a majority of West European states. Consequently, even deputies from the smallest parties can chair commissions or lead sessions of the chambers, and by this token participate in the political decision-making process. This softens the domination of the majority party and – in line with Arend Lijphart’s concept – generates consensual democracy, based on the search for broad compromises instead of simply outvoting the opponent. Given this picture, a question emerges whether the situation is similar in the representative institution of the European Union, i.e. the European Parliament. The paper answers this question positively. The standard of proportionality has strong roots in the European Parliament forming a fundamental principle expressed in terms of d’Hondt’s formula applied to distribute posts among different political groups. This mainly concerns the division of the members of the Presidium and commission chairmen, who exercise the most important decisive functions. The implementation of the idea of appropriate representation may not be ideal, but divergences are rare, insignificant and usually they result from political bargaining that favors smaller fractions. The proportionality principle is also binding when distributing parliamentary posts inside political groups. There is a strong and positive correlation between the size of national delegations and the number of key posts they obtain in the Parliament – members of the Presidium, commission chairmen and coordinators. Only in the case of the latter is proportionality subjected to certain distortions, following from their key political importance. This, however, does not interfere with the general picture of symmetric participation of national groups in appointing parliamentary posts. In conclusion, the standard of proportionality allows all political groups to adequately participate in the work of the European Parliament, which deserves to be emphasized, the more so, as it is not formalized.

The purpose of the article is to present institutional forms of political competition treated as arbitrational issue of the authorities based on the election. The analysis was conducted on the basis of the three forms of political competition; namely conflict, public order and the configuration between the ruling party and the opposition. The direct background to the above-mentioned forms was the election to the Euro-pean Parliament in the Subcarpathian Voivodeship in 2014. Analysis was also carried out taking into consideration specifics of this Voivodeship, when treated as a specific region on the electoral map of Poland.

The text contains a catalog of the functions of electoral law (creating, expressing the will of the voters, legitimizing, controlling and integrating) and a brief description of their character. Then, the European Parliament is described, focusing on regulations concerning the election procedure, both on a European and national level. The next part presents an evaluation of each function’s implementation, through the norms of electoral law to the European Parliament, particularly in the context of the elections of the 25th May 2014 from the Subcarpathia district, especially on the basis of the elec-tion’s results, stated in the declaration of the State Election Commission of the 26th May 2014.

In 2004 before the election to the European Parliament social democratic and liberal parties were expected to succeed. These parties cooperated with Socialist International (SI); Party of European Socialists (PES); Party of European Liberals, Democrats and Reformers (ELDR). Polish political scene did also change. Number of rightist and central parties’ supporters increased. Around 1900 candidates, among them those who were against the accession and their programmes made the PE election kind of the test before the national ones (parliamentary and national). Election campaign was short, boring and did not seem to be the first PE campaign. Attendance around 20,78 and was much more shorter than in referendum (2003). Platforma Obywatelska gained fifteen seats in European Parliament, four seats won liberal Unia Wolności. Social Democratic parties lost a lot of supporters- Sojusz Lewicy Demokratycznej, Unia Pracy and Socjaldemokracja Polska gained together eight seats. Radical national rightists, centre and populists attained twenty seven seats among all Polish fifty four.

The Treaty establishing the European Community (TEC), in Article 19 paragraph 2 introduced both a right to vote and a right to stand for election to the European Parliament. The objective of this paper is to present the solutions adopted in the Polish electoral laws to the European Parliament in the context of the Community regulations and to conduct a brief comparative analysis on legal requirements imposed by the Union legislator. The amendment of electoral laws always poses some questions. What is the aim of the amendment? Is this the issue of some shortcomings of the law (like in the case of the Polish reform) or perhaps the reason was not on the merits? Another question is whether the Polish legislator made most of the electoral reform in Poland to introduce amendments into the electoral law to the European Parliament even if the initial legislation might have complied with the EU guidelines. The act which originally regulated these issues is the Act of 23 January 2004 the Electoral Law to the European Parliament as well as the currently binding Election Code of 5 January 2011, which superseded the aforementioned Act. The change of the electoral law is also a good moment to verify the efficiency of the previous legislation.
Traktat ustanawiający Wspólnotę Europejską (TWE) w art. 19 ust. 2 wprowadził czynne i bierne prawo wyborcze w wyborach do Parlamentu Europejskiego. Celem niniejszego artykułu jest właśnie przedstawienie rozwiązań przyjętych w polskich ordynacjach wyborczych do Parlamentu Europejskiego na tle przepisów wspólnotowych. Chodzi o akt pierwotnie regulujący te kwestie, czyli ustawę z dnia 23 stycznia 2004 r. Ordynacja wyborcza do Parlamentu Europejskiego oraz obecnie obowiązujący kodeks wyborczy z 5 stycznia 2011 r., który zastąpił powyższą ustawę. Zmiana ordynacji wyborczej rodzi zawsze pytanie o cel tej nowelizacji. Czy np. w przypadku polskiej reformy wynikało to z niedociągnięć pierwotnej ustawy czy powód miał tak naprawdę niemerytoryczny charakter. Z drugiej strony, nawet jeżeli początkowy stan prawny wypełniał wytyczne unijne, czy polski ustawodawca wykorzystał reformę wyborczą w Polsce do wprowadzenia zmian w ordynacji do Parlamentu Europejskiego. Problemem jest jednak fakt, że w według kodeksu wyborczego, który wszedł w życie 1 sierpnia 2011 r. nie zostały przeprowadzone żadne wybory do Parlamentu Europejskiego. Stąd należy zaznaczyć, że niniejszy artykuł może być jedynie wprowadzeniem do przyszłej oceny nowelizacji ordynacji wyborczej.

The paper presents the stance of the European Parliament (EP) on the gravest threats to the security of the EU, in particular, the proliferation of weapons of mass destruction and the issue of international terrorism. Prevention of these threats lies predominantly within the competence of EU member states and its intergovernmental bodies. Such situation is implied by the fact that these issues fall within the scope of EU’s Common Foreign and Security Policy (CFSP) within which intergovernmental collaboration mechanisms play a dominant role. This means that the EP’s role in the shaping of EU’s policy on the prevention of weapons of mass destruction proliferation and international terrorism is limited and basically confined to the expression of non-binding opinions in its resolutions. However, relevant resolutions passed by the EP, though not binding in legal terms, have political significance and allow the EP, in contrast to other EU’s institutions, to articulate its position in an unequivocal and clear way. This is possible since the EP is the only supranational EU institution that has democratic legitimacy and can claim the right to exercise parliamentary control over the EU’s policy with respect to the prevention of the gravest threats to European security. This is particularly vivid as it comes to the fight against terrorism which is also the subject of interest for the common space of freedom, security and justice which employs intragovernmental collaboration mechanisms.

Voting Advice Applications are getting more and more popular throughout Europe and a lot of research prove that they have effects both on turnout and decisions of the electorate. This paper brings up the issue of possible agenda setting and framing effects which occur during the process of statements choice and construction in four European VAAs. Its aim is to check whether the statements are well-balanced or whether they suggest users a certain ideology, which is vital because if such an ideological bias is present in the Voting Advice Applications, it may influence the voters’ political decisions. The research also checks whether the statements focus on the European levels of elections or include also internal political conflicts as well as what the main topics covered by the VAAs are. The outcomes prove that the bias in the medium of Voting Advice Applications is noteworthy, especially when it comes to pro-/anti-European Union dimension. The research also proves that there are a lot of statements which did not focus on the European level of the election as well as shows a map of dominant topics present in all European VAAs.

The article discusses the role played by the European Parliament (EP) in the EU–Ukraine Association Agreement. The aim of this process is to establish a close and mutual political and economic cooperation on both sides. By stressing the importance of EP as the only EU body having democratic legitimacy, and thus defines itself as a „guardian of democracy” in the modern world, analyzing its position on the conclu-sion of an EU association agreement with Ukraine. It should be noted that the EP pays particular attention in the context of the association to the development of democracy in Ukraine and its respect of democratic standards. This authority recognizing the geopo-litical importance of Ukraine is in favour of deepening the EU’s cooperation with that country through the conclusion of an association agreement and calls for granting Ukraine a potential European perspective. However, what is worth noting the EP in numerous resolutions makes conditional the progress in the bringing Ukraine to the EU from the incorporation of the values defined as European (democracy, rule of law, protection of minorities etc.) by Kiev. Therefore, events that indicate a crisis of democ-racy in Ukraine pay such important matter for the European Parliament (e.g. the imprisonment of opposition politicians, including former Prime Minister Yulia Tymoshenko) to which the authorities usually adopt a clearly negative position, often contrasting with more „balanced” opinions of other EU institutions.

The European Parliament is the only parliamentary assembly of supranational character in the world, which is not composed of members of national parliaments but elected by direct suffrage. When in 1976 the Council of Ministers of the European Community decided to introduce direct universal suffrage, the elaboration of a uniform electoral procedure common to all Member States was expected to happen in the near future. Until the act was ready Member States could apply their own electoral procedures, whereas the community law regulated only essential matters, necessary to hold the elections in the Community. Obstacles which contributed to problems with the establishment of a uniform electoral system for elections to the European Parliament in the entire European Union led to the adoption of “common principles” of the European Parliament electoral procedures in 2002. Since 2002 several proposals for the modification of the electoral law have been made in each term of the European Parliament, aiming at its harmonisation. The aim of the article is to evaluate whether currently it is possible to modify the election system to the European Parliament, which would go further than the provisions of 2002 and whether it would improve the uniformity of applied electoral procedures.
Parlament Europejski jest jedynym na świecie zgromadzeniem parlamentarnym o charakterze ponadnarodowym, które nie składa się z przedstawicieli parlamentów narodowych, lecz wybierany jest w bezpośrednim głosowaniu. Gdy w 1976 roku Rada Ministrów Wspólnoty Europejskiej decydowała o wprowadzeniu powszechnych i bezpośrednich wyborów, przewidywano opracowanie w nieodległej perspektywie jednolitej procedury wyborczej, wspólnej dla wszystkich państw członkowskich. Do czasu przygotowania tego aktu państwa mogły stosować swoje własne procedury wyborcze, natomiast prawo wspólnotowe regulowało tylko niezbędne zagadnienia, konieczne dla przeprowadzenia wyborów w całej Wspólnocie. Trudności z doprowadzeniem do uchwalenia jednolitego systemu wyborczego do Parlamentu Europejskiego w całej Unii Europejskiej, spowodowały, że w 2002 roku postanowiono przyjąć common principles prawa wyborczego do PE. Od roku 2002, w każdej kadencji Parlamentu Europejskiego pojawiają się propozycje reform prawa wyborczego zmierzających do daleko idącej harmonizacji. Przedmiotem niniejszego artykułu jest ocena czy obecnie możliwe jest zreformowanie systemu wyborczego do Parlamentu Europejskiego, która szła by dalej niż postanowienia z roku 2002 i zwiększała jednolitość stosowanych procedur wyborczych.

Opis:
The spectrum and the polarization of the magnetic flux density (B-field) of 6 induction heaters and 1 arc oven were measured by means of a PMM (Italy) spectrum analyser. The spectrum analysis showed that no substantial harmonics were observed while the polarization analysis revealed that the operator’s exposure was non-homogeneous within a distance of 1.5 m from the heater. When the distance was larger, the body was homogeneously exposed. In general we can state that the B-field strongly varied between heaters and that exposure exceeded the occupational reference levels recommended by the International Commission on Non-Ionizing Radiation Protection (ICNIRP) (1998) and European Directive 2004/40/EC in 5 of the 7 heaters. Within the framework of the Directive some protection actions should be taken. Whereas mitigation of existing/old induction ovens is difficult, the design of new induction heaters and their housing should be based, among others, on electromagnetic reducing engineering concepts.

The progressive process of European integration has shaped and developed the policy of the European Community. The structural policy meant the Community intervention in the economic structures of the Member States. This policy, however, did not include the Community interventions in a social structure. The concept of the regional policy appeared in the 30's of the twentieth century and it was used only at the state level. The cohesion policy for 2007–2013 has aimed at the increase of economic growth and employment in all regions and cities of the European Union. It has been implemented mainly by two structural funds, namely: the European Regional Development Fund (ERDF), European Social Fund (ESF) and the Cohesion Fund (CF). In the perspective of 2007–2013 the differences between the legal bases for the operations of the European Regional Development Fund and the European Regional Development Fund and the Cohesion Fund have been blurred. In November 2013, the European Parliament adopted a budget for 2014– –2020. For the first time the multiannual financial framework for the EU will actually lower than the previous ones.

The 2014 European elections in Romania represented a test for the political parties preparing for the presidential elections at the end of the same year. Firstly, we analyze the political context in which the European elections took place. Since 2012 the changing governing coalitions have created an unstable party system with many politicians shifting party allegiances. Several high ranking party officials were considered suspicious for corruption acts and this affected the nomination of candidates. Secondly, we show that although the ideological allegiance of citizens and political parties increased since 2012, the match between policy preferences of political party and their supporters continues to be remarkably low. Finally we discuss several effects of the European elections, including difficulties in appointing candidates and creating electoral coalitions for the presidential elections encountered by the center right wing parties.

The main objective of this paper is to present the opinions of Polish press journalists about the results of the elections to the European Parliaments held in Poland and Germany in 2014. It stresses the methods applied in the election campaigns by Polish and German political parties and the foci of election platforms of parties in either country. The main winners and losers of the 2014 elections to the European Parliament are also presented.
Zasadniczym celem artykułu jest przedstawienie opinii publicystów prasy polskiej na temat wyników wyborów do Parlamentu Europejskiego przeprowadzonych w Polsce i w Niemczech w 2014 roku. W publikacji zwrócono uwagę na metody prowadzenia kampanii przez polskie i niemieckie ugrupowania polityczne oraz punkty ciężkości w programach wyborczych partii w obu krajach. Przedstawiono również głównych zwycięzców i przegranych Eurowyborów z 2014 roku.

In order to better understand the Poland-EU conflict over the rule of law I interviewed selected Polish Members of European Parliament [MEPs] on EU integration in the peak of the controversy in 2018. Drawing from discourse analysis and “practice turn” in European studies I studied the MEPs narratives. They appeared to be deeply rooted in two discourses: neofunctionalism and intergovernmentalism, both considered as dominant narratives in the EU studies. As right-wing MEPs were convinced the EU was politically biased, protecting sovereignty played a crucial role in their narratives regarding the rule of law conflict. The European People’s Party [EPP] and Socialists and Democrats [S&D] MEPs emphasized the need to abide by EU rules, but their attitude towards imposing sanctions against Poland was mixed. In the rule of law conflict they didn’t firmly stand by its side as a polity protecting its laws. The notion of sovereignty showed cleavages in their narratives, usually full of belief in the supranational community of values.

Głównym materiałem badawczym były wyniki wyborów przedstawione przez Główną Komisję Wyborczą na Litwie oraz dokumenty związane z tematem.
The article deals with the issues of the elections to the European Parliament (EP) in Lithuania, which took place in may 2014 year. Author’s research interest is the Polish minority in Lithuania, the largest ethnic group after the Lithuanians in the country. For many years, the representatives of the Polish minority were actively involved in different types of elections. At first by the Union of Poles in Lithuania (ZPL), and then by the Electoral Action of Poles in Lithuania (AWPL). The aim of the paper was to an-alyze the results of elections in Lithuania, with particular focus on the Vilnius region and AWPL participation. The main research material were the results of the elections presented by the Main Election Commission in Lithuania as well as documents relat-ed to the topic.

Analyzes of individual election campaigns in which the Solidarna Polska party took part showed the dominant position of Law and Justice on the right side of the political scene. Jarosław Kaczyński’s party, receiving 37.58% of votes in the parliamentary elections in 2015, as the first after 1989, independently took over the governments. Zbigniew Ziobro’s party undertook program activities and initiatives that would distinguish it from the PiS and contribute to the fact that it would become an alternative to right-wing voters. Unfortunately, she did it without much success. Solidarna Polska managed to win a small electorate, and support not exceeding 5% did not make it a strong party dominating the right and threatening Law and Justice.

The article is an attempt to look at the process of shaping Ukraine’s electoral law in terms of the European Parliament’s initiatives. The research aim is to demonstrate the influence of the European Parliament in this regard. The research was based on a qualitative methodology with the use of institutional and legal analysis and critical analysis of strategies. The research showed that the European Parliament was the main initiator of changes in Ukraine’s electoral law after the entry into force of the Association Agreement. European Parliament significantly contributed to the reforms’ implementation and made Ukraine one step closer to the European Union.
Статья представляет собой попытку взглянуть на процесс формирования избирательного законодательства Украины с точки зрения инициатив Европейского Парламента. Цель исследования - продемонстртровать влияние Европейского Парламента в этом отношении. Исследования основано на качественной методологии со стратегией институционально-правового анализа и критического анализа источников. Исследованиe показывают, что Европейский Парламент был главным инициатором изменений в избирательном законодательстве Украины после вступления в силу Соглашения об ассоциации. Европейский Парламент внес значительный вклад в реализацию реформ и сделал Украину на шаг ближе к Европейскому Союзу.

Opis:
The article presents the problem of the functioning of factions within the European Parliament and the formation of coalitions between individual political groups basing on the Rules of Procedure and data from the seventh term of the EP. The article involves an analysis of the principles for forming factions as specified in the Rules of Procedure of the EP and the consequences for the cooperation of national parties in the Parliament arising from these regulations. In the second part of the article, matters concerning coalition formation between political groups within the EP are discussed together with the phenomenon of ‘grand coalitions’, related definitional problems and the functioning of the entire political system of the EU in this context.
Artykuł przedstawia problem funkcjonowania frakcji w Parlamencie Europejskim i tworzenia koalicji między poszczególnymi grupami politycznymi na podstawie Regulaminu i danych z siódmej kadencji PE. W artykule analizie zostały poddane zasady tworzenia frakcji określone w Regulaminie PE oraz wynikające z tych przepisów konsekwencje dla współpracy partii narodowych na forum Parlamentu. W drugiej części artykułu przedstawione zostały kwestie związane z tworzeniem koalicji między grupami politycznymi w PE, fenomen „wielkich koalicji” oraz problemy definicyjne związane zarówno z tym zagadnieniem, jak i funkcjonowaniem całego systemu politycznego UE w tym kontekście.

W artykule podjęto zagadnienie stosunku Polaków do Unii Europejskiej w kontekście ich aktywności wyborczej. Specyfika wyborów w Polsce wyraża się bowiem m.in. przez stosunkowo niską frekwencję wyborczą. Przyczyn takiego stanu rzeczy badacze upatrują w wielu czynnikach. Niemniej na szczególną uwagę zasługują, z tego względu właśnie, wybory do Parlamentu Europejskiego, gdyż frekwencja w tych wyborach w Polsce jest jedną z najniższych w całej Unii Europejskiej. Jest to tym bardziej zaskakujące, że jednocześnie zdecydowana większość Polaków deklaruje, iż popiera obecność Polski w strukturach unijnych i nadal, pomimo kryzysu migracyjnego i Brexitu, postrzega to jako jeden z priorytetów w polityce międzynarodowej państwa.
The following article introduces the problem of the attitude of Poles towards the European Union (EU) in the context of their electoral activity. The elections in Poland are characterized by, among others, relatively low voter turnout. There are many different factors to such state of affairs. Nevertheless, the emphasis ought to be put on the election to the European Parliament, as the voter turnout in this particular election in Poland is one of the lowest in the whole EU. It is even more surprising given the fact that the vast majority of Poles declare their support for Poland’s presence in the EU and, despite the refugee crisis and Brexit, still perceive it as one of the priorities in Poland’s foreign policy.

Problemem badawczym, który znajduje się w centrum rozważań niniejszego artykułu, jest przyszłość wyborów do Parlamentu Europejskiego (PE) w świetle istniejących propozycji reform. Artykuł stanowi krytyczną refleksję nad stanem dyskusji wokół reform związanych z wyborami do PE. Na gruncie jakościowej analizy obecnego stanu organizacji wyborów do PE oraz proponowanych zmian, autor stawia tezę, że odgórne próby reformy wyborów skazane są na niepowodzenie, nie tylko z powodu instytucjonalnego oporu państw członkowskich oraz wewnątrz PE, ale również ze względu na istotę proponowanych zmian. Rozpoznane wyzwania w sferze proceduralnej, przedstawicielskiej i partycypacyjnej wymagają uwzględnienia stanu rozwoju procesu integracji. Jeśli rzeczywistym celem reform ma być wzrost demokratycznej legitymizacji procesu integracji, to należy wyjść poza ramy istniejących obecnie propozycji reform. Jednym z możliwych wariantów jest sięgnięcie po mandat imperatywny.
The main research problem of this article is the future of the elections to the European Parliament (EP) in the context of the ongoing debates and reform proposals. This article is critical reflection on the content of the discussions about EP elections reform. Based on qualitative analysis of the EP elections status quo and the reform proposals, the author claims that the top-down efforts for election reforms are doomed to fail not only due to the existing institutional resistance from the Member States and inside the EU, but also due to the essence of the proposed changes. The identified procedural, representative and participative challenges underline the necessity of the integration process analysis. Should the genuine aim of the reforms be the growth of democratic legitimisation of the integration process, there is a need to go behind the framework of the existing reform proposals. One of the possible solutions can be the imperative mandate.
