The organization diagnosis, places emphasis rather on organizational frame work of individuals activity than on individuals themselves. This is so because a man is by nature more complex than a machine and, consequently, he does not correspond precisely to aur notions about stability, durability and regularity of the functioning of elements usually identified with the concept of Structure, the organizational structure is determined by status, knowledge and responsibility level of individuals. And conversely: a place of individuals within a structure, course of their careers, and conditions of work depend on type of an enterprises structure. Two prerequisites: the first that an organic network ensuing from the structure is primary in relation to a network of individual teis, and the second that an individual network is, more dispersed and uncertain that an organic network lead to a conclusion that an organizational unit constitutes a framework, within which an individual theoretically preserves some freedom of activity this freedom, together with a certain rigidity of the structure, which it complements, constitute elements of a balanced system of an organization's functioning.

From time immemorial, man has been striving to ensure his safety. He did it alone and together with others. The perception of a situation as a state of non-danger, peace, certainty is referred to as sense of security. Both the situation in which a person functions and the conviction of the individual that he can meet the requirements of the moment have an impact. The latter is partly the result of social influences of other people from the individual’s environment, who cooperate with them in a positive or negative way. The desire to ensure individual security, in the subjective dimension, motivates the individual to seek support in the social environment. This environment modifies individual behavior to the extent to which individuals themselves would be unable to.
Człowiek od niepamiętnych czasów dążył do zapewnienia sobie bezpieczeństwa. Czynił to sam i wspólnie z innymi. Odczuwanie sytuacji jako stanu niezagrożenia, spokoju, pewności nosi miano poczucia bezpieczeństwa. Wpływ na nie ma zarówno sytuacja, w której człowiek funkcjonuje, jak również przekonanie tej jednostki, że potrafi sprostać wymaganiom chwili. To drugie jest po części skutkiem wpływu społecznego, którego źródłem są inne osoby z otoczenia człowieka, które z nim współpracują pozytywnie lub negatywnie. Chęć zapewnienia sobie bezpieczeństwa indywidualnego w wymiarze subiektywnym motywuje jednostkę do poszukiwania wsparcia w otoczeniu społecznym. To otoczenie modyfikuje zachowanie indywidualne w takim stopniu, do jakiego jednostka w samodzielnym istnieniu nie byłaby zdolna

Opis:

The paper presents results of a few preliminary simulation experiments of a self-reproduction system realized in a programming environment for individual-based modelling of physical systems and discusses the advantages and difficulties of such modelling. The programming environment named an abstract universe, is aimed at modelling of complex systems which manifest the self-organization, self-modification, growing and emergent behavior. The central idea of the universe are specific interactions of its entities in a two dimensional space. The entities move and collide according to rules like those of classical mechanics, and interact between themselves according to function encoded in them modifying their structures and functions.

Aim. The aim of this paper is to theoretically substantiate individual’s attachment as a need for ontological security, to outline the educational aspects of supporting the ontological security, and to empirically investigate the attachment styles and coping strategies of individuals in early and middle adulthood. Methods. The article is based on an extensive review of the literature, which involves the use of such methods as interpretation (of previously unexplained psychological aspects of ontological security) and comparative analysis (of the views of Ronald Laing and family psychotherapists). An empirical study was conducted. The study group consisted of 90 persons: 45 male and 45 female, at the age of early and middle adulthood. The research used a number of psychological methods to study different types of attachments, relationships, personality traits and coping strategies that help overcome ontological insecurity. The method of statistical and mathematical analysis of results was also applied. Results. Ontological security is a marker of positive types of attachment. Our empirical research has shown that people with anxious attachment more often overcome ontological insecurity by positively rethinking the problem, which can lead to an underestimation of the possibilities of its effective solution. People with a reliable attachment are ontologically secure due to mutual trust, responsibility, problem analysis and planning, which eliminate escape strategies and problem avoidance. Conclusions. Ontological security-insecurity manifests itself in different types of attachments and corresponding coping strategies. The results showed the importance of developing and adapting the methodology of ontological protection for Ukrainian socio-cultural realities. This technique is being prepared to be operationalized with the scales of psychological techniques used in this study.

The article addresses the issue of the social implications of participating in religious groups, with particular emphasis on shaping the type of social capital among members of the mentioned religious groups or any group of a religious nature. It is not sufficiently represented in research work on modern sociology, especially the sociology of religious and modern lives, considering the context of the functioning of a modern man in their interpersonal space. To this end, qualitative research was carried out involving individual case studies. Various qualitative techniques were used: interviews, an analysis of document contents, photographs, biographies, observing participants in their social activities, trust, social ties (among members of the mentioned groups), the social roles of members, the implementation of social functions, participation in the common good, and the values and norms of social coexistence that guide the studied person. These imply the emergence of negative social capital, closing social capital, amoral familism and strong bonds in the norms developed by the group to which the analysed case belongs.

The paper is devoted to the construction and design solutions of the power supply and drive systems of a prototype, lightweight LHD (Load-Haul-Dump) loader with an innovative "in-wheel drive" transmission system. The loader is a Battery Electric Vehicle (BEV) with replaceable energy storage. It is intended for use in underground mines with no explosion hazard, especially in metal ore mines. The developed model contains four independent, electric drive systems installed in the road wheels. The paper presents the results of simulation tests, which enabled estimating the required driving power and electricity demand in various regimes and working conditions of the loader. The results of the calculations were used to determine the parameters of the drive system components and the battery capacity. Challenges and problems faced by constructors of BEV LHD loaders with an in-wheel drive have been pointed out.

Opis:

The issue of identity is the subject for research in many sciences, especially psychology and sociology. Two types of identity are distinguished: personal and social ones. Personal identity provides an individual with a sense of one’s own uniqueness while social identity indicates that a man has a sense of belonging to other people, given groups or organisations and is aware of one’s own place in the world. The identity worldview model uses such concepts as ‘value’, ‘cultural pattern’ or ‘ethos’. The concept of identity is, in this case, understood as a set of permanent features of one’s self developed among the members of a given group. The premises originate from the features of the social structure or entirely, anthropologically understood culture of the given community. The identity worldview model also refers to a thesis on a change in the conditions of an individual’s psychosocial existence in the contemporary society.
Problem tożsamości jest przedmiotem badań wielu dziedzin nauki, szczególnie psychologii i socjologii. Odróżnia się tożsamość osobistą od tożsamości społecznej. Tożsamość osobista zapewnia poczucie własnej niepowtarzalności, natomiast tożsamość społeczna wskazuje, iż człowiek ma poczucie przynależności do innych ludzi, do określonych grup, organizacji, a także ma świadomość posiadania swojego miejsca w świecie. Światopoglądowy model tożsamości posługuje się takimi pojęciami, jak wartość, wzór kulturowy lub etos. Koncepcja tożsamości pojmowana jest w tym przypadku jako zbiór trwałych przesłanek obrazu własnej osoby, ukształtowanych wśród członków danej zbiorowości. Przesłanki te wywodzą się z cech struktury społecznej lub całościowo, antropologicznie pojmowanej kultury tejże zbiorowości. Światopoglądowy model tożsamości odwołuje się również do tezy o zmianie warunków psychospołecznej egzystencji jednostki we współczesnym społeczeństwie

Su-22 fighter-bomber

Opis:

The Su-22 fighter-bomber is a military aircraft used in the Polish Air Force (PLAF) since the mid 1980’s. By decision of the Ministry of National Defence Republic of Poland, the assumed service life for this type of aircraft was prolonged up to 3200 flight hours based on the Full Scale Fatigue Test (FSFT) results. The FSFT was conducted using the real load profile defined during the Operational Load Monitoring Program (OLM) and the 3200 hour service life was also based on this load profile. In order to assure safe operation of all the 18 Su-22 aircraft, the Individual Aircraft Tracking program was introduced. The program was based on the results of the FSFT as well as the analysis of the flight parameters recorded by the THETYS onboard flight recorder. In this paper, the authors present the methodology, assumed fatigue hypothesis and preliminary results of the IAT program for the Polish Su-22.

Opis:

This article focuses on human rights – a central topic in Bob Dylan’s works since the beginning of his career. Analysing a selection of texts in which this winner of the Nobel Prize for Literature refers to the situation of black Americans, the author tries to capture and define Dylan’s recurring narrative regarding the responsibility of individuals, structures and institutions, and their mutual relationships. The analysis focuses on the motif of accusation: who and what is it addressed to? In his discussion of Dylan’s narrative, the author refers to the concept of habitus proposed by Pierre Bourdieu. It is defined as a set of rules incorporated by an individual from the environment and later applied in individual attitudes and actions. Based on the analysis of Dylan’s most important works on human rights, the article shows that the American artist’s perception of the scope of individual and structural responsibility is similar to the concept described by Bourdieu, and as such belongs within a specific borderline sphere.

In reply to increasing ecological environmental crisis, arises the conception of sustainable development which was defined by the Brundtland Commission in the report "Our Common Future". According to the definition, sustainable development means meeting the needs of the present generation without compromising the ability of future generations to meet their own needs. The concept of "Sustainable Development" raises several critiques at different levels because of the lack of effects and for its utopia. The author believes that this is the result of the lack of simultaneous development of individuals, especially their spiritual development. The thesis of this paper is that the practical realization of sustainable development ideas needs simultaneous spiritual development of an individual.

The main goal of this paper is to analyze how the age factor behaves as an alleged individual difference (ID) variable in SLA by focusing on the influence that the learning context exerts on the dynamics of age of onset (AO). The results of several long-term classroom studies on age effects will be presented, in which I have empirically analyzed whether AO works similarly across settings and learners or whether it is influenced by characteristics of the setting and the learner—and if so, whether there are contextual variables that can help us understand why thoseoutcomes are different. Results of multilevel analyses indicate that macro-contextual factors (i.e., the wider school context) turn out to have a mediating effect on the relation between AO and L2 proficiency increase, exerting both positive and negative influences and thus suggesting that AO effects are malleable, which is what one would expect if we are dealing with an ID variable. In contrast, no such phenomenon can be observed in relation to lower contextual levels; learners within classes do not vary with regard to how sensitive they are to AO. Since the broader social environment in which learning takes place seems to be more influential than the cognitive state assumed to be a characteristic of the individual, I suggest that an ID model that assumes that age is a “fixed factor” (Ellis, 1994, p. 35) is not entirely satisfactory.

This article offers a proposal for using film as supplements for future therapists’ education in respect of the social construction of their relations with patients. A film pedagogy proves indispensable in a pandemic situation, when empirical therapeutic practice becomes impossible. The analysis refers to the concepts of pedagogy of cinema and mediated experience and points to a proposal of an exemplification of their functioning in the form of a selected cinematic picture (“Three Christs”, 2017), based on an actual psychotherapeutical experiment undertaken by Milton Rokeach at the Ypsilanti clinic.

The article attempts to portray transformations of the research on the idiolect in Polish linguistic studies of the last two centuries. In this research some distinct tendencies can be observed: inscreasing number of works devoted to different idiolects, widening circle of described individuals, as well as new theoretical approaches to the problem, closely related to main paradigms of contemporary linguistics: above all the concept of the idiolect as an individual communication competence or as a structure containing the individual worldview. The evolution of understanding the idiolect is still involving new phenomena considered as idiolect components into the field of research. Some linguistic currents regard the idiolect as more primal than the common language, which is treated as the overlap of many idiolects. Because of all these the research on idiolects are clearly put forward from margins of linguistics towards its centre. It seems there are new currents and linguistic disciplines that influence discovering the value of the idiolect as an object of linguistics. Focusing on the idiolect results also from tendencies present in other disciplines as well as from the individualistic aspect of the contemporary culture.

particularly over the last 40 years. In my way of understanding social pedagogy I draw on multiple sources of inspiration. Theoretically, I am inspired by German social philosophy and German pedagogical traditions. In this article I want to show how some of these inspirations could be transformed into practice in a way that both the community and the individual benefit. Drawing upon three different conceptual models of social pedagogy, I will discuss that the pedagogical approach in combination with a social and philosophical approach have a broader ethical and human potential than former models. Social pedagogical work is based on many different values related to attitudes among professionals, related to community and community building, and related to relations and social interaction. This calls for reflections on the relation between the individual and the group, on concepts of the ‘other’, on education and professionalism.

In an attempt to describe an individual realization of the sermon as a genre pattem, the article characterizes a collection of a few dozen sermons delivered by one preacher. In accordance with the conventions typical of altemating pattems, i.e. modifications of individual components of the canonical pattem, the preacher uses above all the mechanism ofreduction. He omits the classic introduction, uses only argumentative schemata in the main bodies of his sermons, and formulates the ending as a conclusion or an appeal. It appears as important for the author to differentiate individual segments of the whole and arrange them in such a way so as to achieve persuasive effects. The preacher assumes the role of an interpreter of the w ord of God, and constructs his sermons in the form of intemally dialogized monologues. The choice of stylistic devices is dictated above all by the principle of appropriateness. The preacher avoids bombastic and official forms, uses religious or colloąuial lexis in order to render the transfer of message more vivid, imagelike and suggestive. Taking into account the basie features of the altemating pattem of the sermon as a genre, the said author attempts to speak from his own perspective, but in sucha way as to preserve the message of God.

Background The aim of the study was to verify the hypothesis that additional information about the perpetrator responsible for the death of subordinates at the workplace may influence the assessment of morality. The article contains the results of an empirical study conducted among young adult working Silesians (N = 262), who were asked to evaluate the morality of the person responsible for the decision, in line with which miners had started working on 6th October 2014. On that day miners died following an explosion in the “Mysłowice-Wesoła” methane mine in the Polish Silesia region. Material and Methods The study explored the stories’ method (from the moral psychology domain) as well as a short questionnaire. The respondents received information about the behavior of the perpetrator as well as emotions (socially desirable and undesirable) and (socially desirable and undesirable) views in the form of brief descriptions (stories). They were asked to evaluate the perpetrator’s morality. Results The socially desirable views of the evaluated perpetrator (lack of acceptance for the situation) and the socially desirable emotions (guilt) significantly increased the level of morality according to participants. A single piece of information about the socially desirable emotions didn’t significantly increase the perceived level of perpetrator’s morality; neither did a single piece of information about socially desirable views. Conclusions Results indicate the important role of additional information about emotions and views of the perpetrator in the process of assessing morality. It is worthwhile to implement the practical implications of this study in similar crisis situations at the workplace. Med Pr 2018;69(3):261–267

Opis:

The ruling on the application of tax overpayment is a formal act which does not prejudge the existence of tax arrears, but which provides information on the way the payment is credited. The credit is legally binding. Therefore, the ruling on the credit only confirms that it has been effected. The amount of the tax liability or arrears shall not be verified in the credit decision. The amounts shall be fixed or determined in accordance with their respective procedures. The ruling is a formal condition for the overpaid tax to be credited against outstanding and current tax liabilities. The ruling has legal effects in the sense that as for the date of crediting the overpayment, tax arrears no longer exist.

In accordance with the applicable law, an employer cares for safe and hygienic working conditions. An occupational risk analysis isone of the elements determining the level of safety. The risks that may significantly contribute to the damage are identified through the activities related to the risk assessment. The role of an employer is to counteract these threats. The COVID-19 pandemic has had many negative consequences for the functioning of enterprises and the health and safety at work. The subject of the paper is to update the occupational risk among selected employees after the COVID-19 pandemic. Depending on the work environment, an employee is exposed to various types of risks that significantly affect not only health and safety, but also comfort, quality and work efficiency. COVID-19 causes various negative consequences, so it is important for the employer to monitor the employee's return process after the infection for a long time (approximately 2 months). Adjusting working conditions and temporarily reducing work intensity (expectations and work results) relatively increase the possibility of recovery and a faster return to full productivity.

We examine the influence of a weak non-resonant illumination on the quantum dot photoluminescence spectrum. We observe that even very weak illumination affects both intensity and spectral position of emission lines in the spectrum. We discover no significant asymmetry in spatial dependence and infer that the observed effects cannot be attributed to a single neighbor center.

The article presents characteristics of the conducted research on the functioning of a human in a threatening situation and the security of a human individual. The research falls within the strand of military psychology, which has empirical traditions. Although the human psyche has been dealt with somehow in all eras and cultures, the systematic accumulation of empirical knowledge in this field began only in the 19th century as a part of the fascination with science, which can be primarily associated with the development of medical science. A specific role in the intensification of human interest in that issue was also played by socio-economic processes, which led to the development of many scientific disciplines and, through them, academic centres. In the second half of the 19th century, the state of knowledge was strongly influenced by advancements in various fields of practical (empirical) sciences and the humanities. In France, Germany, and the British Isles, attempts to interpret such, and not other, human conduct and types of activity, as well as causal forces, factors, and motives, increasingly appeared in scientific literature and widespread transmission.
W artykule przedstawiono charakterystykę podejmowanych badań nad funkcjonowaniem człowieka w sytuacji zagrożenia i jego bezpieczeństwa jako jednostki ludzkiej. Badania te wpisują się w nurt psychologii wojskowej posiadającej tradycje empiryczne. We wszystkich epokach i kulturach w jakiś sposób zajmowano się psychiką człowieka, ale systematyczne gromadzenie wiedzy empirycznej w tym zakresie rozpoczęło się dopiero w XIX wieku, w ramach fascynacji nauką, co można przede wszystkim skorelować z rozwojem nauk medycznych. Pewną rolę w intensyfikacji zainteresowania człowieka tą problematyką odegrały również procesy społeczno-ekonomiczne, które doprowadziły do rozwoju wielu dyscyplin naukowych, a poprzez to ośrodków akademickich. Na stan wiedzy w drugiej połowie XIX wieku mocno wpłynął postęp w różnych dziedzinach nauk praktycznych (empirycznych) oraz humanistycznych. We Francji, Niemczech, na Wyspach Brytyjskich w literaturze naukowej oraz przekazie powszechnym coraz częściej pojawiały się próby interpretacji takich, a nie innych postępowań człowieka i rodzajów jego aktywności, a także sił, przyczyn i motywów sprawczych.

W artykule podjęto próbę określenia podstawy teoretycznej zjawiska, jakim jest bezpieczeństwo żywności. Z reguły bezpieczeństwo żywności odnosi się do dwóch zasadniczych obszarów, tj. obecności substancji obcych w żywności, zwykle w niej nie występujących oraz fałszowania żywności. Pierwszy obszar zagadnień określa bezpieczeństwo zdrowotne żywności, drugi jej bezpieczeństwo ekonomiczne. W centrum przeprowadzonej analizy stoi „jednostka”, której status jest określany bardzo różnie w poszczególnych teoriach ekonomicznych. W rozważaniach porównano podejście do roli i charakteru jednostki we wszystkich podstawowych szkołach ekonomicznych, odnoszących się do tych spraw, począwszy od szkoły klasycznej liberalnej przez szkołę keynesowską, schumpeterowską do (neo)instytucjonalnej oraz szkoły behawioralnej. W konkluzji autor dochodzi do wniosku, że tym, co najpełniej wyjaśnia zachowanie jednostki w jej aktywności rynkowej w zakresie bezpieczeństwa żywności, jest podejście zawarte w kanonie szkoły neoklasycznej. W zakończeniu sformułowane zostały warunki niezbędne do zapewnienia konsumentom pożądanego stanu bezpieczeństwa żywności.
The paper attempts to define theoretical grounds for the phenomenon of food safety. Usually, food safety refers to two key areas: the presence of foreign substances in food and food falsification. The former describes food safety in terms of health, the latter in terms of economic aspects. The focal point of the analysis is the “individual”, whose status is very different in respective theories of economics. The discussions compared the approach to the role and character of the individual in all major schools of economic thought ranging from classical liberalism, Keynesian school, Schumpeterian school to neo-institutional and behavioural schools. The author concludes that what best explains the behaviour of individuals in its market activity as regards food safety is the neoclassical approach. Finally, the paper formulates the prerequisites to provide consumers with the desired food safety status.

The entity entitled to bring a complaint to the Provincial Administrative Court is anyone with a legal interest in this. The mere fact of submitting a complaint based on an individual’s individual legal interest results in an obligation on the part of the Provincial Administrative Court to examine the interest of the complainant. If the court, during the examination, does not find a connection between the action or action complained about and the interests of the complainant, it will be forced to disregard the complaint, which will result in its dismissal. The analyzed article expresses a very important principle known as the right to a fair trial. This is a consequence of the rule that only the court is the body that ultimately decides about the freedoms, rights and obligations of an individual. The right of an individual to assert his rights before a competent, independent, impartial and independent court.
Podmiotem uprawnionym do wniesienia skargi do Wojewódzkiego Sądu Administracyjnego jest każdy, kto ma w tym interes prawny. Sam fakt wniesienia skargi opartej o indywidualny interes prawny jednostki rodzi po stronie Wojewódzkiego Sądu Administracyjnego obowiązek zbadania interesu skarżącego. W przypadku, gdy sąd podczas rozpoznania nie odnajdzie związku pomiędzy zaskarżanym działaniem lub zaskarżaną czynnością a interesem skarżącego będzie zmuszony nie uwzględnić skargi, co będzie skutkowało jej oddaleniem. W analizowanym artykule wyrażona została bardzo ważna zasada, którą określa się mianem prawa do sądu. Jest to konsekwencja reguły, że tylko sąd jest organem decydującym ostatecznie o wolnościach, prawach i obowiązkach jednostki. Prawo jednostki, która dochodzić swych praw przed właściwym, niezależnym, bezstronnym i niezawisłym sądem.

„Gorgiasz” Platona jest jednym z wcześniejszych dzieł filozoficznych jednego z najbardziej wpływowych filozofów starożytności. Podejmowane są w nim tematy różnic między sztuką a umiejętnością retoryki, prawdy, sprawiedliwości czy prawa, przede wszystkim jednak natury ludzkiej. To właśnie wokół tego ostatniego problemu koncentrują się rozważania dwóch rozmówców zabierających głos jako ostatni w dialogu. Podczas sławnego starcia idei stają przeciwko sobie Kallikles, zwolennik bezwzględnej supremacji prawa natury, zgodnie z którego nakazami silni dominować muszą nad słabymi, oraz Sokrates, mistrz Platona, poprzez którego ten ostatni kreśli wizje ponadludzkiej sprawiedliwości, prawodawstwa zgodnego z ideałem zdrowej duszy i piękna. Te przekonywające stanowiska wykładane są ze swadą godną najlepszych dzieł ateńskiego myśliciela. W istocie rozważania na temat roli prawa w życiu jednostki ukazane w „Gorgiaszu” na przykładzie rozmowy Sokratesa i Kalliklesa należą do najbardziej znaczących ustępów z twórczości Platona poświęconej tematyce prawnej. Osadzenie tego starcia w szerszym kontekście historyczno-filozoficznym, a także przedstawienie struktury narracyjnej dialogu, umożliwia ponadto wniknięcie w istotę „Gorgiasza”, dialogu poświęconego najbardziej podstawowym zagadnieniom antropologicznym, poprzez który ponadto Platon rozwiązuje problem własnego stanowiska wobec śmierci swojego mistrza, Sokratesa.
Plato’s „Gorgias” is considered to be an early work of one of the most influential philosophers of antiquity. It raises subjects such as differences between the arts and ability of rhetoric, truth, justice and law, most of all however – human nature. Contemplations of the last two dialogi personae orbit around exactly this problem. Famous clash of ideas takes place between Callicles – staunch proponent of callous supremacy of law of pure nature according to which the strong must dominate the weak – and Socrates, Plato’s mentor, through whom the latter drafts a vision of supernatural justice, law-making in accordance with ideals of healthy soul and beauty. Both of these convincing visions are laid out as amply as can be expected from the best works of Athenian philosopher. In fact deliberations upon the importance of law in one’s life as presented in „Gorgias” in conversation between Socrates and Callicles are to be considered as one of the most profound pieces of legal thought ever produced by Plato. Putting this confrontation in broad historical and philosophical context, as well as presenting narrative structure of the dialogue make it possible to pierce the heart of „Gorgias” and uncover all meanings of the dialogue devoted to the most fundamental anthropological subjects, through which Plato also resolves very personal dilemma of his own stance towards death of his master - Socrates.

Opis:

Globally, it is worth stressing that international law, European law and national laws must fulfill the same standards, considering the human rights laws. Since the end of the Second World War, the sphere of international human rights law, including the set of rights of human beings, increased tremendously. In the sphere of human rights, the set of refugees’ rights is one of the most important. On the other hand, the sphere of human rights since September 11 had to face the problems of security on a global scale. Today, security impacts the governments, international organizations, NGOs as well as human beings. Let us say that security influences both local and global policy. From this point of view, the article analyzes an important question: Is the human rights system able to function properly with the growing lack of security both in international and regional relations? Can the European Union and its Member States afford total acceptance of international refugee rights regulations referring to African natives? The article refers to the facts from the last few years which totally changed the attitude to human rights laws. It seems that today international organizations such as the United Nations and its specialized agencies should again work on the system of human rights referring to refugees, including legal aspects of counterterrorism. The author also takes into account the necessity of cooperation between the governments in a wider scale, including mutual cooperation and legal activity.
W opracowaniu analizie został poddany status obywatela Unii Europejskiej z punktu widzenia jego praw podmiotowych w kontekście praw uchodźców wynikających z regulacji międzynarodowych. Zasadniczym celem było określenie granicy pomiędzy prawami obywatela UE a prawami uchodźców. Opisano także wpływ Arabskiej Wiosny Ludów na problem migracji oraz związane z tym zagrożenia bezpieczeństwa wewnętrznego państw członkowskich UE. Zasygnalizowano problemy, które pojawiają się w związku z destabilizacją sytuacji na arenie międzynarodowej w rejonie Afryki Północnej i Środkowego Wschodu, rozwojem skrajnych ruchów islamistycznych oraz efektywnym zetknięciem się warstwy jurydycznej norm ochrony praw człowieka i bezpieczeństwa międzynarodowego.

Opis:

One of the important factors binding an ethnic group is a language. From this point of view, it has to be stressed that in the territory of the historic Duchy of Teschen we have recorded the presence of members of Polish, Czech and German, and – to a lesser extent – Jewish, Slovak, Ruthenian and Wallachian nationalities. The political history of this region was unusually disruptive – change of citizenship was typical and, as a result, spoken and official language changed as well. Over the centuries, Latin, German, Czech and Polish have been used as official languages. Regarding the current usage of standard language varieties, the formal Czech, Polish and – to a lesser extend – Slovak are used. As far as dialects are concerned this group belongs of the southern subgroup of Silesian dialects, the majority of which are located in the polish territory. The dialect is used by the local inhabitants of both Polish and Czech nationalities. Apart from dialect, other language forms used are standard Czech (it is a compulsory class in Polish-language schools), standard Polish as a code of pedagogical communication in local Polish schools, the language of Polish minority magazines; Polish plays on the Polish stage of the Těšín Theater are also shown in Polish language. Polish is used at the events organized by Polish organizations and Polish church services. The Těšín Silesian dialect is probably the most widespread communication code and performs the function of natural, commonly spoken language. Its usage is not determined by age or ethnicity. Generally speaking, the inhabitants of the area are bilingual and, depending on the communication situation, choose the appropriate language code. However, the ethnic identity cannot be derived only from language usage, although language identity is one of its important elements. In the past the inhabitants of Czech Těšín region felt the need similar to that of other inhabitants of other border regions with multi-ethnic, multicultural and multilingual character – the necessity for self-identification. Nowadays, the situation is different – the Czech majority does not feel the need to emphasize its ethnicity, and Polish minority, thanks to Polish schools, organizations, democratization processes and participation in Polish cultural life, declares Polish nationality, but stresses its specific region origin.

Opis:

Financial derivatives are used in economic activity undertaken not only by legal, but also by individual persons. According to the tax consequences of transactions consisting in implementation of the rights arising from derivative financial instruments, it must first be determined whether the effects of this title shall be settled within the revenue sources which is non-agricultural economic activity or revenue sources from capital gains. The article analyzes the key issue, namely, whether there is any connection of the derivative transaction with a business. The conditions were specified that, in the author's opinion, allow to settle revenues / costs arising from the implementation of the rights of the derivative financial instruments in the course of business, when the turnover in derivative financial instruments is not the subject of this activity.

W pracy poruszono problem wolności jednostki we współczesnej cyberprzestrzeni. Wolności rozumianej jako świadome, niepodlegające kontroli czynników zewnętrznych korzystanie ze współczesnych zdobyczy teleinformatyki. Przeanalizowano formy i intensywność korzystania z dostępnego oprogramowania, zwłaszcza umożliwiającego korzystanie ze wszystkich funkcjonal-ności dostępnych w sieci Internet. Zwrócono uwagę na stopień opanowania przez użytkowników cyberprzestrzeni podstawowych technologii, jakimi się ona posługuje. Wskazano na konieczność systematycznego podnoszenia umiejętności w zakresie ich wykorzystania. Poruszono rolę, jaką powinny odegrać programy nauczania technologii teleinformatycznych i informatyki w systemie edukacji jako czynnika mającego wpływ na funkcjonowanie członków społeczeństwa informacyj-nego. Stwierdzono, że wolność jednostki we współczesnej wirtualnej rzeczywistości jest radykal-nie ograniczona ze względu na brak możliwości kontrolowania przez nią wykorzystywanych technologii teleinformatycznych, a zwłaszcza używanego oprogramowania.
This work discusses a problem of freedom of an individual in the modern cyberspace. Such free-dom is understood as independent of external influence awareness of using modern achievements of teleinformatics. The form and intensity of use of available software has been analyzed, especially that allowing to access all functionalities of the Internet. Attention has been drawn to a degree of mastering by cyberspace users of basic technologies widely used there. A need for systematic increase in skills to use the cyberspace has been appointed. It is also mentioned, what role should be played by programs of computer science learning in the educational system, being essential in shaping the behavior of infor-mation society members. It was stated, that a freedom of an individual in the modern virtual reality is drastically limited by the lack of control of the technologies it uses, especially the software.

Poniższy artykuł dotyczy problemu pogwałcenia prawa do prywatności, które może pojawić się w procesach karnych. Podkreślono, iż istnieje sprzeczność interesów – publicznego i prywatnego. Ten pierwszy przejawia się w utrzymaniu porządku publicznego, zapobieganiu przestępczości i karaniu przestępców, przy jednoczesnym zapewnieniu informacji publicznej dotyczącej postępów i wyników toczących się procesów karnych. Drugi rodzaj prawa – prawo prywatne, wyrażone jest w prawie do ochrony życia prywatnego i rodzinnego, honoru i dobrego imienia, a także w prawie do podejmowania decyzji dotyczących życia prywatnego. Konfrontacja tych dwóch interesów często prowadzi do zrzeczenia się jednego z nich, ponieważ w każdym kraju ustawodawstwo właściwie równoważące prywatny interes przed interesem publicznym musi zdecydować, czy i w jakim zakresie zapobiegać zakłócaniu prywatność osób. Rozważania należy zacząć od zdefiniowania „prawa do prywatności”. Problemem badawczym podjętym w niniejszym badaniu była próba określenia „prawa do prywatności” wraz ze wskazaniem obszarów ryzyka. W tym celu autor odniósł się do prawa międzynarodowego. Różnorodność tego prawa nie nakłada konieczności omówienia prawa do prywatności oddzielnie dla każdego międzynarodowego systemu prawodawczego. W związku z tym, prawo do prywatności w systemie prawnym Narodów Zjednoczonych, Rady Europy, czy Unii Europejskiej zostało oddzielnie komentowane. W ten sposób lista elementów prawa do prywatności powinna być "skonfrontowana" z przepisami regulującymi postępowanie karne w celu uzyskania odpowiedź na pytanie, w jaki sposób poszczególne elementy prawa do prywatności mogą być naruszone w postępowaniu karnym i tym samym, który z tych obszarów wymaga szczególnych środków ochrony. Należy podkreślić, iż sposoby ochrony przeciwko pogwałceniu prawa do prywatności powinny wynikać z przepisów prawa oraz powinny być jasne i jednoznaczne. Jednostki, których prawo do prywatności zostało pogwałcone powinny wykorzystać wszelkie środki prawne w celu obrony przed tym pogwałceniem.
The present article addresses the issue of infringement of the right to privacy that can occur in criminal proceedings. It is noted that there is a clash between two interests, public and private interest. This former manifests itself in the maintenance of public order, crime prevention and punishment of their perpetrators, whilst ensuring the public information on the progress and results of the ongoing criminal proceedings. The latter interest - private, is expressed in right to the protection of private and family life, honor and good name and the right to make decisions about one’s personal life. The confrontation of these two interests often leads to relinquishing one of them because in each country the legislature properly balancing the private interest against the public interest has to decide whether and to what extent prevent interference in the privacy of individuals. Thus, the direction and scope of concessions are problematic concessions. The starting point for the considerations in this regard must be defining the content of the "right to privacy". The research problem which was approached in the present study was an attempt to fulfill the concept of "right to privacy" with individual designations indicating risk areas. To obtain a collection of such designates which are universal of nature, the author referred to achievements of the international law. Heterogeneity of this law has imposed the need to discuss the right to privacy separately for each of the legislative centers of the international system. Therefore, the right to privacy in the legal system of the United Nations, the Council of Europe the European Union was separately discussed. In this way a list of elements of the right to privacy should be "confronted" with the rules governing criminal proceedings in order to subsequently obtain the answer to the question of how the individual elements of the right to privacy may be violated in the criminal proceedings and thus, which of these areas require special protection measures. It should be emphasized that measures to protect against violations of the right to privacy should result from the act and should be clear and unambiguous. The more the law provides for such measures, the more real the enforcement of rights and interests becomes. An entity whose personal rights were violated should use the maximum possible legal means of defense against such violation.

Multidimensional changes are taking place in the modern world. Generally speaking, these changes concern what is broadly understood as culture, civilization, and religion. These changes can be perceived through their connection with technology, which affects how societies are organized, how people exercise power (politics), the types and features of social bonds, what the economy looks like, man and his existential situation, and man’s relationship with himself and his surroundings. These changes also definitively impact administrative enforcement proceedings, which can use coercion to make the obligor fulfill his obligations. Because coercive measures may be used on the obligor during the course of administrative enforcement proceedings, they should be carried out with due care for the good of the individual. This study analyzes principles for respecting the obligor’s mandatory subsistence minimum as well as his role in counteracting excessive interference on the part of public administrational bodies in his individual rights and freedoms.
Zachodzące we współczesnym świecie przemiany mają wielowymiarowy charakter. W sensie najogólniejszym dotyczą szeroko pojętej kultury i cywilizacji oraz religii. Dostrzegalny jest ich związek z techniką i technologią, co przekłada się na sposób organizacji społeczeństw i sprawowania władzy (politykę) oraz na rodzaj i charakter więzi społecznych, a także kształt gospodarki. Wyraźnie zauważalny jest ich wpływ na samego człowieka, jego sytuację egzystencjalną, stosunek do samego siebie i do otoczenia. Zachodzące zmiany mają też określony wpływ na administracyjne postępowanie egzekucyjne. Jest ono nacechowane elementem przymusu służącego wyegzekwowaniu realizacji obowiązku, którego zobowiązany dobrowolnie nie wykonuje. Z uwagi przede wszystkim na istotną dolegliwość środków przymusu, które mogą być stosowane wobec zobowiązanego w ramach tego postępowania, powinno być ono prowadzone z zachowaniem odpowiedniej dbałości o dobro jednostki. Przedmiotem niniejszego opracowania jest analiza treści zasady poszanowania minimum egzystencji zobowiązanego oraz jej roli jako jednego z instrumentów przeciwdziałających nadmiernej ingerencji organów administracji publicznej w sferę praw i wolności jednostki.

Artykuł przedstawia Rousseau i Kanta wizje historii w perspektywie zależności tej drugiej od pierwszej. Przede wszystkim skupia się na ukazaniu ich wewnętrznych trudności  i wewnętrznych napięć, zdecydowanie więcej miejsca poświęcając filozofii historii Kanta. Koncepcję tę ujmuje jako zwieńczenie teleologicznej struktury rozumu ludzkiego, nadając jej status praktyczno-moralnej fikcji i odrzucając jej wykładnię teoretyczno-naturalistyczną. Następnie analizowane są trudności odnoszące się do wykładni moralnej. Analiza ta prowadzi do tezy, że właśnie pod ich ciężarem moralnie rozumiana historiozofia Kanta faktycznie załamuje się, nie będąc w stanie znieść nieusuwalnego napięcia między porządkami moralnym i legalnym historii i ostatecznie kryjącego się za nim napięcia między jednostką i historią; tkwiło ono więc w samych moralnych podstawach tej ostatniej.
The article presents Rousseau’s and Kant’s vision of history from the perspective of dependence of the latter on the former. It concentrates above all on presentation of their difficulties and internal tensions, but pays more attention to Kant’s conception of history. The article views this conception as the culmination of the theological structure of human reason, giving it the status of moral-practical fiction and rejecting a theoretical-naturalistic interpretation of it. Subsequently, it analyses difficulties connected with the moral interpretation. The analysis leads to the thesis that it is precisely under their weight that Kant’s moral historiosophy collapses, because it is not able to bear the unerasable tension between the moral and legal orders of history, and, ultimately, the underlying tension between the individual and history. This tension was embedded in the moral foundations of the latter.

The main aim of this paper is to learn about an informal structure of a third grade sport class with extended curriculum in athletics of Junior Sport School no. 47 in Kraków and to show the relationship between students’ popularity and their physical fitness and safety in a group of peers. The research included 23 schoolgirls of III de class with extended curriculum in athletics. All participants were 15 year old. The following research techniques have been used: the sociometric method, the test of physical fitness, an analysis of school documents, an interview. In the light of the obtained results it can be stated that physical fitness in the examined III de class plays a significant role on becoming likeable and accepted among peers, there is high correlation between physical fitness and participants’ popularity, which is a positive phenomenon. In order to support students who have been rejected appropriate educational measures, aiming to change their image for better in the eyes of their peers and raise their status in the popularity hierarchy, should be taken.

Opis:

This study consists of two parts. The first contains a theoretical interpretation of lexeme taboo with a particular emphasis placed on the issue of etymology and varied semantics of this concept. This analysis is based on the use of dictionary definitions as well as ethnological and linguistic research. It is also significant to reveal the connection between tabooisation and security culture. The second section is an attempt of response to the question on the tabooisation of the subjects related to body and sexuality in the youth newspaper. The analytic part is intended to depict ways and reasons of this phenomenon. The combination of theoretical description and examples study is meant to illustrate the concept of safety in the context of taboo – the concept, which is nowadays defined not only as a military category, but also as a quality valued as safety culture.

Opis:

So far, the parties to administrative proceedings, in order to counteract the slowness of the body conducting the proceedings, have been able to file a complaint about not handling the case on time or on the lengthy conducting of the proceedings themselves. The legislator, taking into account the experience to date, as a result of the amendment to the Code of Administrative Procedure, decided to replace the complaint with a reminder. The article describes the constituent elements of this form of urgency, as well as practical issues related to the application of this measure by the parties and authorities conducting the proceedings.

Opis:

The article refers to the issue of judicial protection of the rights of an individual acting as an organ (also a member of an organ) in the local government. The author presents two situations in which the judicial protection of these rights is important. The first includes cases where the individual violates the law, which leads to specific actions (e.g. confirmation of expiryof the mandate) and justifies the need to provide judicial protection. The second category includes situations in which the resignation from performing the function in the local government takes place, which – especially in the case of withdrawal of the statement of resignation – raises the need to provide judicial protection. The considerations presented in the article focus on the judicial protection of the rights of the individual in the proceedings before the administrative court.

Development which led to the creation of information society also resulted in the appearance of new technologies, including considerable advancements connected with the Internet. Cyberspace has become a place into which people have transferred a considerable part of their life. This paper discusses the potential threats to Internet users. A list of threats compiled by the author relates to the main problems that are likely to occur every day. All the threats detailed by the author are connected with one another and intertwined, which means that it is sometimes difficult to categorize an incident unequivocally as belonging to one particular group. The threats listed in the paper are already present and will continue to develop. Therefore, it is vital to learn about them and about how to counteract them. Modern society, i.e. information society, needs to know how to protect itself from Internet threats and how to function safely on the Internet. Therefore, the purpose of this paper is to introduce and systematise the classification of threats that an Internet user can encounter in cyberspace, as well as emphasise possible recommended ways of protecting oneself against them.

W rezultacie inspiracji, której dostarcza filozoficzne dziedzictwo Edith Stein, autorka sformułowała problemy wyrażające się w pytaniach: Czy możliwe jest rzetelne poznanie cudzych stanów psychicznych (zwłaszcza emocji, uczuć, nastrojów)? Czy dany człowiek ma dostęp do przeżyć innego psychofizycznego indywiduum? Autorka rozważyła też sposoby prezentowania się owemu indywiduum przeżyć psychicznych innych ludzi, istotę „wczucia” (pozwalającą odróżnić je od innych aktów, takich jak spostrzeganie, równoczesne doznanie zbiorowe, ideacja, przypomnienie czy antycypacja cudzych stanów psychicznych, wyobrażenie własnych bądź cudzych przeżyć), jego genezę (podłoże genetyczno-psychologiczne) i rodzaje. Opierając się na poglądach Stein, która ujmowała wczucie jako rodzaj doświadczania drugiego człowieka (konstytucji psychofizycznej: cielesności i duchowości), autorka uznaje wczucie za formę współobecności, która pozwala doświadczyć podobieństw i różnic między własną a cudzą psychiką i w ten sposób kształtować postawę przychylności wobec społeczności powszechnej – ludzkości. Autorka podejmuje próbę zestawienia stanu wiedzy dotyczącej zagadnienia wczucia z osiągnięciami nauk szczegółowych w zakresie empatii, przywołując sposób ujmowania empatii w psychologii i pedagogice i skupiając się na analizie koncepcji, odmian i znaczenia empatii. Znaczenie współodczuwania trudno przecenić, gdyż stanowi ono doznanie duchowe, emocjonalne, moralne i społeczne, sprzyjając rozwojowi więzi uczuciowej, ułatwiając proces przywiązania oraz komunikację społeczną (zwłaszcza konstruktywne rozwiązywanie problemów bądź konfliktów wewnątrzosobowych i interpersonalnych) i adaptację w nowym środowisku. Umiejętność ta może również generować inne korzystne zmiany w rozwoju filogenetycznym i ontogenetycznym człowieka, na przykład profilować dyspozycje psychiczne, takie jak allocentryzm, altruizm, wyrozumiałość, takt, autentyczność, wrażliwość uczuciowa i moralna. Postawy otwartości na innych ludzi, tolerancji, afirmacji życia czy miłości jawią się jako skutek doskonalenia między innymi zdolności współodczuwania. W końcowej części artykułu autorka akcentuje, że w namyśle naukowym nad wczuciem (jako pojęciem filozoficznym) a empatią (pojęciem przyjętym w psychologii i pedagogice) warto nie tracić z pola widzenia zadań priorytetowych, którymi są zarówno rzetelne poznanie fenomenu współodczuwania, jak i kształtowanie w społecznościach tej cennej ludzkiej umiejętności pozwalającej dostrzegać w obcym przyjaznego członka ludzkiego rodu.
Inspired by the philosophical output of Edith Stein, the author raises the following problems: Is it possible to have reliable knowledge of another person’s mental states (especially of his or her emotions, feelings, or moods)? Can a given person gain access to the experiences of another psycho-physical individuum? The author discusses the ways in which other people’s mental states present themselves to an individual, the essence of Einfühlung (thus distinguishing it from other acts, such as perception, simultaneous collective experience, ideation, remembering or anticipating another person’s mental states, imagining one’s own or another person’s experiences), its origin (the genetic-psychological background), and types. Following the ideas of Stein, who understood Einfühlung as a mode of experiencing another human being (his or her psycho-physical constitution: corporeality and spirituality), the author describes Einfühlung as a form of co-presence that enables the experience of similarities and differences between one’s own and another person’s psyche, shaping in this way the attitude of benevolence towards the universal community: humankind. The author attempts to compare the present knowledge on Einfühlung with the results of sciences concerning empathy, discussing the ways in which the latter is perceived in psychology and pedagogics, its various concepts, kinds and significance. The importance of co-feeling can hardly be overestimated. As a spiritual, emotional, moral and social experience conducive to the development of emotional relationships, it facilitates the process of emotional attachment and social communication (especially constructive solving of intrapersonal or interpersonal problems and conflicts), as well as adaptation to a new environment. Co-feeling may also generate other favorable changes in the phylogenetic and ontogenetic development of the human being by promoting such psychological dispositions as allocentrism, altruism, forbearance, tact, authenticity, as well as emotional and moral sensitivity. Openness to others, tolerance, affirmation of life and love also emerge as a result of perfecting, among others, the capacity for co-feeling. In the final part of the article the author emphasizes that scholarly reflection on the concepts of Einfühlung (as it is used in philosophy) and ‘empathy’ (as a psychological and pedagogical notion) must not becloud the priority tasks: to gain a comprehensive understanding of the phenomenon of co-feeling and to shape, in human communities, the valuable skill that makes it possible to perceive strangers as friendly members of the human race. The aim of the article is to analyze the problem of healthcare system with taking under the consideration the point of view of fundamental rights of individuals. The article also presents possible ways to enforce healthcare rights belonging to individuals. The author tries to define the right to healthcare in the context of fundamental and social rights. To prove the thesis presented in the article, the author mentions judgments of the courts and the views established among legal scholars.
Celem artykułu jest przedstawienie problematyki ochrony zdrowia z punktu widzenia publicznych praw podmiotowych jednostek. W pracy rozważana jest możliwość dochodzenia przez jednostkę roszczeń z zakresu ochrony zdrowia. Podejmowana jest również próba zdefiniowania prawa do ochrony zdrowia w kontekście istniejącej systematyki praw podstawowych oraz praw socjalnych. W ramach omawianego tematu przytaczane są również poglądy polskiego orzecznictwa, jak i doktryny.

Opis:

Physiotherapeutic procedures after surgical treatment of trochanteric fractures of femurs are a very important element of a post-operative management because they have a significant influence on the final result of physiotherapy. This is due to the nature of the frac-ture and the frequency of its occurrence. The aim of the work is, in particular, to determine the relationship between functional assessment scales in patients after trochanteric fractures treated surgically using extended statistical analysis including regression equations. Statistical analysis included a group of patients, which participated in a specialized programme of a post-operative procedure, called the ‘Individual’ Group. The matrix of research results, calculations of basic statistical measures, such as position, variability, interdependence, asymmetry and concentration were presented for this group. Regression equations representing the relationships between the considered variables, in particular concerning the applied scales and post-operative tests, were presented. Their purpose, mathematical interpretation, results of calculations and statistical tests were discussed. Attention was paid to the high correlation between the Parker and Mobility tests. The extended statistical analysis makes it possible to create an own system for assessing the treatment results of patients after trochanter-ic fractures are treated surgically.

Opis:

W gospodarstwie indywidualnym położonym w województwie opolskim przeprowadzono badania, których celem była analiza intensywności nakładów na ochronę roślin w uprawie pszenicy ozimej, rzepaku, buraków cukrowych i ziemniakach. Nakłady na ochronę roślin wyrażono za pomocą zużycia pestycydów w kg substancji aktywnej na 1 ha, w wartości zł, krotności zabiegów, kosztów przeprowadzania zabiegów ochronnych. Opłacalność określono za pomocą orientacyjnych wskaźników opłacalności. Dziesięcioletnia analiza wykazała, że od 2004 r. nakłady na ochronę roślin wzrastały w każdej uprawie, a opłacalność pogarszała się pomimo wzrostu cen produktu chronionego i uzyskiwanych plonów.
The research was conducted in the individual farm located in Opolskie Province. The purpose of investigation was the analysis of intensity of expenditure on chemical plant protection in cultivation of winter wheat, seed rape, sugar beet and potatoes. The expenditure on plant protection was expressed by pesticides usage in 1kg of active substance per 1 ha, the value PLN, treatments multiplicity and the costs of chemical treatments performance. The profitability was determined using guide profitability indices. Ten year analysis proved that since 2004 year the expenditure on plant protection had been increasing in each particular cultivation and its profitability had been getting worse despite the increasedprices of the protected product and the yield obtained.

Jedną z podstawowych wartości prawnie chronionych jest bezpieczeństwo. Ze względu na jego charakter prawodawca zabezpiecza je nie tylko w drodze przepisów ustawowych, ale też w Konstytucji RP, w związku z czym uzyskało ono wymiar ustrojowy. W aspekcie personalnym chronione jest bezpieczeństwo obywateli, instytucjonalnym – bezpieczeństwo państwa, materialnym – bezpieczeństwo publiczne, ekologiczne, ekonomiczne, społeczne itp. Z punktu widzenia bezpieczeństwa i jego znaczenia dla społeczeństwa i państwa, dopuszcza się ochronę tej wartości kosztem wolności i praw człowieka i obywatela. Ingerencja w te swobody konstytucyjne nie może jednak naruszać ich istoty, jest dopuszczalna jeżeli w inny sposób nie da się zapewnić bezpieczeństwa, a przy tym nie może być nadmierna. Ustrojodawca wyraźnie przewiduje, że ograniczenia w zakresie korzystania z konstytucyjnych wolności i praw mogą być ustanawiane tylko w ustawie i tylko wtedy, gdy są konieczne w demokratycznym państwie dla jego bezpieczeństwa lub porządku publicznego, bądź dla ochrony środowiska, zdrowia i moralności publicznej, albo wolności i praw innych osób. Podobnie w przypadku stanowienia przepisów porządkowych, bezpieczeństwo jest jedną z kluczowych przesłanek ich stanowienia. W zakresie nieuregulowanym w ustawach lub innych przepisach powszechnie obowiązujących rada gminy może wydawać przepisy porządkowe, jeżeli jest to niezbędne dla ochrony życia lub zdrowia obywateli oraz dla zapewnienia porządku, spokoju i bezpieczeństwa publicznego. Zbliżone rozwiązania prawne zostały przewidziane dla powiatu i województwa. I tak w zakresie nieuregulowanym w ustawach lub innych przepisach powszechnie obowiązujących, w szczególnie uzasadnionych przypadkach, rada powiatu może wydawać powiatowe przepisy porządkowe, jeżeli jest to niezbędne do ochrony życia, zdrowia lub mienia obywateli, ochrony środowiska naturalnego albo do zapewnienia porządku, spokoju i bezpieczeństwa publicznego, o ile przyczyny te występują na obszarze więcej niż jednej gminy. W zakresie nieuregulowanym w przepisach powszechnie obowiązujących wojewoda może wydawać rozporządzenia porządkowe, jeżeli jest to niezbędne do ochrony życia, zdrowia lub mienia oraz do zapewnienia porządku, spokoju i bezpieczeństwa publicznego. Przepisów porządkowych nie może wydawać samorząd województwa.
One of the basic, legally protected values is safety. Due to its nature, an employer provided protection not only by means of laws and regulations, but also by the Constitution of the Republic of Poland and as such the safety took on a new dimension. In the personal aspect – civil safety is protected, in the institutional aspect – the safety of the country, in the substantive aspect – public, economic, social safety etc. From the point of view of the safety and its importance for the society and the country, the protection of this value is allowed at the expense of the freedom, human and citizen rights. Such interference in the constitutional freedoms cannot however infringe their essence and it is allowed only if the safety cannot be provided by other means, but at the same time it cannot be excessive. The legislator clearly provides that any limitation upon the exercise of constitutional freedoms and rights may be  imposed only by law, and only when necessary in a democratic state for the protection of the state and public order or for the protection of the natural environment, health and public morals or for the protection of freedoms and rights of other people. Similarly to ensuring enforcement regulations, safety is one of the most important premises for their implementation. The municipal council may pass enforcement regulations within a scope not otherwise regulated in acts or other regulations commonly applicable regulations if such is necessary for the protection of human life or health and to assure public order, peace and security. Similar legal measures are meant for the voivodship and poviat.  The municipal council may pass enforcement regulations within a scope not otherwise regulated in acts or other regulations commonly applicable regulations, in duly justified cases, provided that the reasons occur within the area of more than one municipality. The voivode can pass enforcement regulations within a scope not otherwise regulated in acts or other regulations commonly applicable if such is necessary for the protection of human life or health and to assure public order, peace and security. Enforcement regulations cannot be passed by a province government.
