The paper describes the possible evolution of the European Union’s structural policy in a new policy and budget programming period starting after 2013. The paper consists of an introduction that describes the current situation in this area and follows up with an analysis of conditions resulting from the changing model of the European cohesion policy. A key part of the article is a discussion of some vital problems that should be subject to debate, including the comprehensive nature of structural policy, the “Lisbonization” of the EU’s policies, more effective use of EU funds, territorial cohesion, and the relationship between economic policy and employment in the context of the new structural policy. The authors also define the role of regions and states in this policy and look at the benefits of cohesion policy for environmental protection and natural values. In the final part of the paper, the authors comment on the current organization and course of debate on the reform of cohesion policy and list challenges faced by Poland’s policy makers in the context of European policy reform. The analysis takes into account the EU’s strategic guidelines included in its key documents such as the 2007 Cohesion Report. The authors look at the matter from a Polish perspective and outline Poland’s priorities in the ongoing debate on the need to reform the EU’s structural policy.

Opis:
Expenditure on structural policy is the second largest item in the European Union’s budget. Structural funds and the cohesion fund are intended for the bloc’s poorest countries and regions, and their aim is to increase the cohesion of the entire community. Under the EU reform treaty, the traditional model of economic and social cohesion would be expanded to include a third dimension-territorial cohesion. The authors analyze the implications of the introduction of territorial cohesion to European structural policy. They evaluate EU program documents and research in this area. Szlachta and Zaleski set out to explain why the territorial dimension of European structural policy is important to Poland and why European cohesion policy should be modified after 2013. The paper describes the theoretical foundations of European structural policy, paying special attention to the role of regional factors for community-level intervention and the course of convergence processes. Against this background, the authors describe the EU’s regional policy and its territorial dimension over the past 20 years. The paper also discusses the most important conclusions from a public debate on territorial issues in Europe, and mentions issues such as the EU Green Paper on territorial cohesion and its importance for reforming the EU’s structural policy after 2013.

W artykule przedstawiono dane pozwalające ocenić sposób absorpcji środków unijnych w latach 2007 - 2013 przez województwo świętokrzyskie. Zaprezentowane zestawienia pokazują, jak ważną rolę dla innowacji, rozwoju przedsiębiorstw, infrastruktury trans-portowej oraz społeczeństwa pełnią środki unijne. Aktywność jednostek samorządu terytorialnego województwa świętokrzyskiego jest zróżnicowana, jednak uzyskane i wykorzystane środki unijne pozwoliły umocnić pozycję województwa oraz wchodzących w jego skład powiatów na tle całego kraju. Kolejny okres pro-gramowania 2014 – 2020 niewątpliwie jest szansą, aby w jeszcze bardziej efektywny sposób zwiększyć możliwości rozwoju regionu kieleckiego.
The article presents data allowing to assess the way of the absorption of EU funds in years 2007 - 2013 by the Świętokrzyskie Voivodeship. Presented statements show how important role EU funds play for the innovations, enterprise development, transport infrastructure and community. The activity of local government units in the Świętokrzyskie Voivodeship is diverse, however, the obtained and used EU funds have allowed to strengthen the position of the voivodeship and the counties which are composed in it, on the background of the whole country. The next programming period 2014 - 2020 is undoubtedly a chance to increase opportunities for development of Kielce region in a more effective way

Do idei efektywnego rynku i – w tym kontekście – sprawnego państwa można podejść z perspektywy ekonomii instytucjonalnej. Oznacza to przede wszystkim, że uogólnienie tworzone jest bardziej na bazie obserwacji gospodarki niż w oparciu o jej modelowanie. Jako pozytywny przykład przedstawiono procesy w gospodarce Japonii w okresie industrializacji i szybkiego wzrostu po II wojnie światowej. Polityka strukturalna w tym przypadku dowodzi sprawności państwa w tworzeniu warunków dla uczestników rynku, które sprzyjają efektywnej konfrontacji z konkurentami. Podstawową przesłanką jej skuteczności była dynamiczna równowaga sił pomiędzy reprezentującymi państwo biurokratami ekonomicznymi oraz przedstawicielami wielkich grup przemysłowo-finansowych. Przy tym siła przetargowa państwa w gospodarce opartej na własności prywatnej polegała w gruncie rzeczy na ustawowym prawie do dysponowania częścią zasobów pieniądza. Dozując ten rzadki zasób w formie kredytu dla sektora prywatnego, państwo zapewniło sobie wpływ na decyzje wiodących podmiotów ekonomicznych. Analizowany przypadek wspiera tezę, że o sukcesie gospodarczym w gospodarce rynkowej nie decyduje ani samo państwo, ani wyłącznie rynek. Wręcz przeciwnie, spektakularny sukces w konkurencji międzynarodowej jest często efektem symbiozy państwa i rynku.
The concept of effective market and – in this context – capable state can be discussed from the perspective of institutional economy. This indicates that generalizations are made on the basis of observing the economy rather than through its modeling. Processes in Japanese economy within the time of industrialization and dynamic growth after the Second World War prove the presented thesis. In this particular case structural policy confirms the capability of state in creating conditions for market players that facilitate effective competitiveness. The capability of state resulted from dynamic balance of forces between economic bureaucrats representing the state and representatives of large industrial-financial groups. The bargaining power of state in private ownership-based economy was reflected in the state’s right to have a part of currency reserves at its disposal. Disbursing these scarce reserves in tranches of credit to private sector, the state could influence decisions of leading economic entities. The analysed case proves the thesis that neither the state itself nor the market alone decides about economic success in market economy. And reversely, a spectacular success in international competition is often an aftermath of state-market symbiosis.

Unia Europejska aktywnie zastosowała szereg narzędzi planistycznych i programowych w kształtowaniu procesów rozwoju, szczególnie w ramach implementacji polityki strukturalnej. Wdrożono skoordynowany w całej organizacji jednolity system wymagań stawiany wobec państw członkowskich, dając większą swobodę w kształtowaniu rozwiązań na poziomie kraju. Powstałe (ujęte nowelizowanym pod każdą wieloletnią perspektywę prawem wspólnotowym) rozwiązania spowodowały, że plany i programy były wdrażane zgodnie z przyjętymi w nich horyzontami czasowymi i szerokością zaplanowanej nimi interwencji, przyczyniając się tym samym do realnego kształtowania polityki rozwoju w wymiarze UE, a przez to również na poziomie poszczególnych krajów-beneficjentów polityki strukturalnej UE. Przedstawiona analiza obejmuje zarówno przygotowanie się Polski do członkostwa w latach 90-tych do roku 2004, pierwszy okres programowania obejmujący lata 2004-06, prace przygotowawcze i wdrożenie kolejnej perspektywy finansowej Wspólnoty na lata 2007-13, jak i wstępne propozycje wobec programowania UE po roku 2013.
The European Union has effectively applied numerous planning and programming tools in shaping development processes, notably within structural policy implementation. In the whole organization a homogenous system of requirements concerning member states has been launched. Yet, much more freedom has been allowed in developing solutions on a country’s level. The development solutions (stipulated in the amended for each multi-year perspective legislation) have resulted in the fact that both plans and programmes have been launched in line with assumed time horizons and the scope of the intervention planned. This contributed to the real shape of development policy within the EU as well as in its member states – beneficiaries to the Union’s structural policy. The presented analysis discusses both Poland’s preparations to the EU membership in 1990’s to the year 2004, the first stage of programming within 2004-06, preparatory work and the launch of the Union’s financial perspective within 2007-2013 as well as initial concepts of the EU programming ahead of the year 2013.

The analyses made in the article are concentrated on characterization of the structural policy of the European Union in the historical approach, with the institutional current strongly stressed. According to the thesis that has been put forward about the national model of the regional development policy being dependent on its European match, an attempt is presented of a complex evaluation of the evolution of the Union’s structural policy, as result of which it is proven that the basic determinant of rationalization of the reforms carried out up till now are their systemic consequences. Despite the recognition of the member-states’ competences as far as forming the aims and principles ruling the policy of developing the intra-national territorial arrangements is concerned, the European model consistently makes the actions undertaken within it dependent on the principles and aims of the Union’s policy by co-financing projects encouraging development. The proven superiority of the systemic context of the reforms undertaken in the EU directs the evolution of the national model, promoting the systemic approach to the policy of regional development and in this way rejecting – as not rational in the above meaning – actions with a provisional character.

This article aims to discuss the objectives and instruments of the European regional policy with particular reference to the current period of its programming. Programming is a particular feature of the implementation of the Community policy, therefore this study is also intended to present a short overview of the programming of this policy in Poland. The main information about the existence and evolution of European regional policy is presented. Special attention is given to its political programming (tasks and spheres of financial intervention), especially budget programming. The main purposes of solidarity policy in Poland are presented. Its programming tools which are implemented according to the main document, which characterises directions of financial support from the EU, are given. This document entitled the National Strategic Frames presents a diagnosis of the social and economic situation of the country and the intentions of its regions towards development of solidarity. It contains a chapter about financial resources sharing according to operation programs as well as a description of the realization system.

The crisis of the euro area is undoubtedly a continuation of the global crisis that started on the real estate market in the USA; and from there spread to Europe; touching Greek economy the hardest. The purpose of this article is the analysis of causes of economic crisis in Greece and to determine high performance methods to its overcoming. To develop effective methods to combat the crisis and prevent future breakdowns changes must cover not only Greek economic policy; but also a mechanism for international cooperation. The crisis of the euro area turned out to be not only a crisis of the economies of member countries; but also of the mechanism of integration. It is especially about the economic policy carried out at the level of the EU institutions that affects the economic policies of individual member countries. Hence the article tries to find an answer to the question; what changes should be made in Greek economic policy as well as in the EU institutional framework to overcome the present crisis and to prevent its occurrence in the future. A permanent solution of the crisis can be only a transformation of Greek economy that was most acutely affected by a decline in production and an increase in unemployment.

Celem artykułu jest próba odpowiedzi na pytanie, czy w świetle obowiązujących przepisów prawa wspólnotowego i krajowego dopuszczalne jest wprowadzanie do obrotu przez uznane grupy producentów rolnych produktów dostarczonych przez członków lub podmioty spoza tego grona po ich przetworzeniu. Problem nie był dotąd podejmowany w literaturze, a ma istotny walor praktyczny. Kwestia przetwarzania produktów rolnych przez grupy uznane na podstawie ustawy o grupach producentów rolnych i ich związkach ma bezpośredni wpływ na ocenę spełniania przez grupy warunków uznania, a także utrzymania lub utraty tego statusu i co za tym idzie – przywilejów z nim związanych w postaci pomocy finansowej ze środków UE, zwolnień podatkowych czy dopłat do kredytów preferencyjnych. W artykule dokonano analizy prawa wspólnotowego pierwotnego i wtórnego oraz przepisów dotyczących pomocy finansowej ze środków Unii Europejskiej, a także wyroku Trybunału Sprawiedliwości. Wnioski prowadzą do twierdzącej odpowiedzi na postawione pytanie.
L’articolo si propone di rispondere alla domanda se permettere, alla luce della vigente normativa dell’Ue e di quella nazionale, ai gruppi riconosciuti di produttori agricoli di immettere in commercio i prodotti trasformati, forniti loro da soci o soggetti al di fuori del gruppo. Finora il problema non è stato discusso in letteratura, nonostante una significativa dimensione pratica. La questione di come i prodotti vengano trasformati ha un impatto diretto sul processo in cui si valuta se i gruppi di produttori agricoli (che conseguono il riconoscimento ai sensi della legge sui gruppi di produttori agricoli e le loro associazioni) continueranno a soddisfare i criteri per il riconoscimento accordato, e di conseguenza se riusciranno a mantenere lo status assegnato, e in realtà i relativi privilegi, quali aiuti finanziari provenienti da fondi dell’Ue, esenzioni fiscali, agevolazioni sui prestiti preferenziali. L'autore analizza il diritto comunitario primario e secondario, nonché le disposizioni concernenti il contributo finanziario proveniente da fondi dell'Unione europea, come anche la sentenza della Corte di giustizia. Le conclusioni portano a dare una risposta affermativa alla domanda posta.
The aim of the article was an attempt to answer the question whether, in the light of the current provisions of EU law and Polish law, it is possible for recognised groups of agricultural producers to market products supplied by their members as well as entities from outside the group. This issue has not been addressed in the literature but it is of a significant practical value. The processing of agricultural products by groups recognised as such pursuant to the Act on agricultural producer groups and their associations has a direct impact on the assessment whether these groups have satisfied the conditions for recognition, which means whether they will retain or lose this status and, therefore the privileges related to it in the form of financial aid from the EU funds, tax exemptions or subsidies to preferential credits. The primary and secondary European Union law and regulations concerning financial aid from EU funds, as well as the relevant judgment of the Court of Justice in the matter in question have been analysed with a conclusion leading to an affirmative answer to the question posed.

In the course of its development, starting with the organisation of agricultural markets, the Common Agricultural Policy has been confronted with many different, also non-agricultural problems. It had to respond to the requirements of environmental protection, structural and social policy, animal welfare, energy policy or climate protection. Nowadays, there are three different methods by which the relationship between agricultural law and non-agricultural legal issues is legally shaped: separation, connection and integration.
La politica agricola comune, nelle diverse fasi di sviluppo, a partire da quella di organizzare i mercati agricoli, ha dovuto affrontare problemi diversi, non sempre connessi all’agricoltura. È stata costretta a soddisfare i requisiti in ambito di protezione ambientale, politica strutturale e sociale, benessere degli animali, politica energetica oppure tutela del clima. Al giorno d’oggi si possono osservare tre diversi metodi attraverso i quali si configura, dal punto di vista giuridico, il rapporto tra diritto agrario e materia giuridica non connessa all’agricoltura: separazione, relazione e integrazione.
Wspólna Polityka Rolna w trakcie swego rozwoju, począwszy od organizacji rynków rolnych, mierzyła się z wieloma różnymi, także pozarolniczymi problemami. Musiała odpowiadać wymogom ochrony środowiska, polityki strukturalnej i społecznej, dobrostanu zwierząt, polityki energetycznej lub ochrony klimatu. Współcześnie można dostrzec trzy metody, według których prawnie kształtowane są relacje między prawem rolnym a pozarolniczą materią prawną: separacja, powiązanie i integracja.

Aside from the single market policy and monetary integration, the cohesion policy is nowadays one of the most vital aspects of EU’s operations. That policy, its projects and financial aims, are the key element of the European integration and the economic development of the European Community, member states, regions and local communities. Regional efforts and horizontal European funds concern pre-eminently the tasks associated with transformation and the development of the modern infrastructure. European funds hold the means for protective activities as well. Their application, in the first place, contributes to the growth of competitiveness among the countries, regions and municipalities, as well as the overall internal progress. These programmes contribute in a significant manner to the development of Polish municipalities and regions, including the municipality of Szczebrzeszyn.
Polityka spójności (strukturalna) jest obecnie jednym z najistotniejszych aspektów funkcjonowania Unii Europejskiej obok jednolitego rynku wewnętrznego i integracji walutowej. Polityka ta jest kluczowym elementem integracji europejskiej i rozwoju gospodarczego Wspólnoty Europejskiej. W jej ramach realizowane są projekty i istotne zadania finansowe Unii Europejskiej, wszystkich członków, a także regionów, samorządów itp. Interwencje regionalne i horyzontalne funduszy unijnych dotyczą przede wszystkim zadań związanych z przekształcaniem i rozwojem nowoczesnej infrastruktury. Fundusze unijne posiadają środki na działania ochronne. Ich zastosowanie ma przede wszystkim przyczynić się do wzrostu konkurencyjności krajów, regionów i gmin, a także ogólnego rozwoju wewnętrznego. Realizowane projekty w sposób znaczący ułatwiają życie mieszkańcom gmin i regionów Polski a w tym mieszkańcom gminy Szczebrzeszyn.

Opis:
The cohesion policy is among the most important European policies. Its influence is particularly strong in the new member states, which have become the major recipients of aid under this policy. Cohesion policy is very wide and extends into many areas of development, such as for example education, transport or innovation support so in some member states it strongly influences national policies in various areas. This article aims to analyse the interaction between cohesion policy and national sectoral policies on some examples from Central European countries. It turns out that cohesion policy often leads to a significant reduction in national policies and in some cases may even negate their intentions. The governments need to pay more attention to coordination of these policies and also to proper institutional environment.
