    The subject of the text is a reflection on the interpretation of the conditions for applying impunity clauses from art. 15 § 1 c.c. and art. 297 § 3 c.c., which occurred against the sentence of the Court of Appeal in Katowice. The focus is on dogmatic analysis of the concept of “voluntariness”, which is the subjective condition of the institution of active repentance. The author does not share the position of the appeal which is expressed in the decision. It is justified by the fact that in the realities of the facts there were circumstances allowing establishing premises excluding criminal liability. On the other hand, the argumentation motivating the position chosen does not indicate the exclusion of voluntary referred to in the aforementioned provisions. However, this statement may raise doubts about cases of a more complex nature and thus put an accent on slightly different factors in the court’s argumentation.

    The article proves the scientific validity of a model of civil society developed by Dekker and Van den Broek, which includes community, market and state. Its main indicators: social capital and public discourse are applied to compare the developments of civil society in the Netherlands and Poland. This model includes a guiding principle – voluntariness. It serves to interrogate a correlation between the strong normative conditions: religious behavior and shared historical experience on the one hand, and the weak level of the civil society developments in Poland on the other.
    Artykuł analizuje model społeczeństwa obywatelskiego rozwinięty przez Dekker’a i Van den Broeka, uwzględniający złożony ład społeczny obejmujący triadę społeczeństwo-rynek-państwo. Jego główne wskaźniki, kapitał społeczny i dyskurs publiczny, zastosowane są w analizie naprzeciwległych przykładów holenderskich i polskich. Artykuł poddaje analizie centralne uwarunkowanie koncepcyjne modelu, a więc wolontariat, które służy interpretacji fenomenu korelacji silnych trendów społecznych, religijności i wspólnoty historycznej, oraz niskiego poziomu społeczeństwa obywatelskiego w Polsce.

    Artykuł stanowi próbę zarówno opisania, jak i sklasyfikowania kontraktu socjalnego jako przykładu zastosowania w zawodzie pracownika socjalnego – umowy o charakterze mieszanym. Opracowanie rozpoczyna się zwięzłą definicją negocjacji i ich elementów kluczowych, następnie wymienia różne rodzaje umów w pomocy społecznej, na zakończenie prezentując nie tylko bardziej szczegółowy opis kontraktu socjalnego, lecz również analizę jego niejednoznacznej natury prawnej.
    The paper is an attempt to both describe and classify social contract – as an example and result of negotiation in social work - as a contract of a mixed nature. It starts with a brief definition and crucial elements of negotiations, then lists various sorts of contracts applied to social work, ending up with more detailed description of social contract. It also gives a try to an analysis of its ambiguous nature.

    Influence is synonymous, and sometimes even perceived as equivalent, with power. While power is a relationship of authority and subordination, and hence the decisions of power are of a subordinating nature, influence does not stem from coercion or subordination. Another difference lies in the possibility of mutual interactions between the influencing entities. While a power wielder is of a concentrated  nature (regardless of whether it is an individual or an authority comprised of many people), the influencing entities can also assume deconcentrated forms. There is a potential for mutual dependency. The voluntary nature of subordination should not be ignored. An influencing entity does not have at its disposal the array of decision enforcement instruments which are typical of power. Instead, it uses attractiveness, persuasion, social modelling, systems of values, etc.

    The author of the article characterizes the idea of voluntary service, its basic indicators, its essence and importance in the social life, emphasizing, at the same time, its Christian aspect. The general objective of the present paper is to draw particular attention to the issue of voluntary service as a chance for restoration of social bounds and rebuilding moral foundations in contemporary societies, as well as to present it as a place of volunteers' self-realization. At the same time, the author indicates the factors, which are connected with the time management of a volunteer's work, determine its correct proceeding, and finally success. The analysis leads to defining volunteering as an opportunity for everybody: above all for a man in need, for his family, but also for the volunteers themselves, who thanks to such help get a chance to learn more about themselves and to develop.
    Autor artykułu charakteryzuje wolontariat, jego ideę, podstawowe wyznaczniki, istotę oraz znaczenie w życiu społecznym, podkreślając zarazem jego chrześcijański aspekt. Głównym celem niniejszego opracowania jest jednak zwrócenie uwagi na wolontariat jako działania dające możliwość restytucji więzi społecznych i odbudowywania fundamentów moralnych we współczesnych społeczeństwach, a także jako miejsce pozwalające na samorealizację wolontariusza. Autor wskazuje jednocześnie czynniki, które związane są z organizacją pracy wolontariusza oraz warunkują jej właściwy przebieg i pomyślność. Dokonane analizy prowadzą do określenia wolontariatu jako szansy dla wszystkich: nade wszystko dla człowieka potrzebującego, dla jego bliskich, ale także dla samych wolontariuszy, którzy dzięki niemu mogą poznawać i rozwijać siebie.

    Aim. The main purpose of research presented in this article is to analyse mediation principles as an alternative way of dispute resolution and features of their application in the educational environment of Ukraine. For which purpose it was necessary to perform the following tasks: - the concept and role of mediation principles were studied; - certain types of mediation principles were defined; - the essence and significance of the most important mediation principles were revealed; - and the application of mediation principles in Ukraine was clarified. In Ukraine, civil society institutions have been trying on their own to introduce and promote mediation as a way of alternative dispute resolution. However, systemic problems of access to justice require finding other ways to resolve conflict situations. Mediation becomes especially relevant in the context of COVID-19 coronavirus pandemic, when access to the court system is limited. Methods. The study is based on the analysis of enacted regulations and their comparison in different countries, as well as information obtained from the study of literature, including works by authors of both legal and other social sciences where mediation is used as a means of compromise, including psychology, medicine, ecology, along with the use of tools and comments specific to the study of law. To study the prospects and effective application of mediation principles in the educational environment, sociological surveys of various participants of the educational process were conducted. Results. The results of study showed that certain types of mediation principles are applied in different countries taking into account the peculiarities of national legal systems. Notwithstanding, such principles as the rule of law, the principle of equality (equal rights) of the parties, the principle of voluntariness, confidentiality and mediator behaviour (independence and impartiality, trust and justice) are applied in most of the studied national models of mediation, consequently they can be called fundamental. The survey results have revealed the readiness of the educational environment to introduce mediation as a tool for resolving conflicts in the educational environment.  In Ukraine, the draft law “On Mediation” defines general principles of mediation; however, the problem is insufficiently clear criteria for disputes that cannot be transferred to mediation. In addition, the principle of the rule of law should be defined as one of the fundamental principles of mediation. Conclusions. The specifics of the implementation of mediation principles in Ukraine and their correlation with the principles of the judicial process require further research.

    Tekst stanowi studium prawnoporównawcze instytucji mediacji występującej na gruncie czterech regulacji procesowych, tj. Ustawy z dnia 6 czerwca 1997 r. Kodeks postępowania karnego, Ustawy z dnia 17 listopada 1964 r. Kodeks postępowania cywilnego, Ustawy z dnia 14 czerwca 1960 r. Kodeks postępowania administracyjnego, a także Ustawy z dnia 30 sierpnia 2002 r. Prawo o postępowaniu przed sądami administracyjnymi przeprowadzonej na podstawie metody dogmatycznej. Analizie poddano te rozwiązania, które – zdaniem autora – pozwalają postawić tezę o daleko idącej zbieżności podstawowych, a zarazem mających normatywną proweniencję zasad rządzących tymi mediacjami. Do zasad tych zalicza się w tekście polubowność, dobrowolność (fakultatywność), powszechność, lojalność wobec stron, zasadę poufności i niejawności prowadzenia mediacji, a także bezstronności mediatora. Wspomniana zbieżność nie oznacza całkowitej homogeniczności poszczególnych rozwiązań, ani też ich niewadliwości, co wykazuje się m.in. na przykładzie art. 2591 k.p.c. oraz art. 83 § 4 k.p.a. Wskazano na zgodność krajowych rozwiązań z rozwiązaniami rekomendowanymi przez Komitet Ministrów Rady Europy.
    The article constitutes a comparative legal study of mediation based on for proceduralregulations, i.e. Act of 6 June 1997: Code of Criminal Procedure, Act of 17 November 1964:Code of Civil Procedure, Act of 14 June 1960: Code of Administrative Procedure, and Actof 30 August 2002: Law on the Proceedings before Administrative Courts carried out withthe use of a dogmatic method. The author analyses the solutions that, in his opinion, makeit possible to propose a thesis on far-reaching convergence of the basic, and at the sametime of normative provenance, principles of mediation. The principles include amicability,voluntariness (optionality), commonness, loyalty to parties, confidentiality and non-opennessof mediation, as well as a mediator’s impartiality. The above-mentioned convergence doesnot mean complete homogeneity of particular solutions or their non-defectiveness, which isexemplified by Article 2591 CPC and Article 83 § 4 CAP. It is also shown that the domesticsolutions are in conformity with the solutions recommended by the Committee of Ministersof the Council of Europe.
