Opis:
The author analyses the position of a candidate for member of a governing body in an entity supervised by the Polish Financial Supervisory Authority (PFSA) and discusses the related problems. The aim of the article is to identify the area of an increased risk level in financial institutions in the process of appointing members of the governing bodies of supervised entities. The PFSA assumes that the selection of the candidates for members of the governing bodies in Pension Fund Companies may be carried out by either the management board or the supervisory board. This leaves a large space for the activity of the boards. The management board can gain influence over the course of these proceedings. When the selection is conducted by the supervisory board, the risk is significantly reduced. The second aspect addressed therein concerns the position of a candidate for member of the governing bodies in supervised entities in legal proceedings. In jurisprudence it has been established that a candidate is to be treated as a party to the proceedings. The administrative courts found that inadmissibility of a candidate as a party would violate Article 77(2) of the Constitution by closing the judicial path for the candidate and preventing them from asserting protection of their rights and freedoms. Despite this, the Act of 21 July 2006 on Financial Market Supervision (Journal of Laws of 2020, item 2059, as amended) was amended in April 2021 to the effect that a candidate was not a party to the proceedings thus enhancing the risks, including conflicts of interest. The effect of these provisions has been instrumentalisation of those to whom a great deal of responsibility is entrusted – if the approval of the PFSA is obtained. The PFSA's decisions may affect the career path of candidates. In certain cases, they may even 'block' it, leaving little room for defence and narrowing the possibilities of adjusting the competence level to the positions held. There is also no timeframe for the PFSA’s decision. The risks associated with such situation have been described in the article.

Opis:
Social judgments regarding the assessment of the work of the representatives of the preparatory proceedings organs are often formulated prematurely. Actions taken in favor of properly conducted proceedings often require commitment, which is difficult to qualify in specific assessment categories. Advances in technology mean that committing offences is often simpler, resulting in the possibility of committing more and more new crimes (including, among others, cybercrime). Such realities oblige the representatives of the procedural authorities to take effective remedial actions to combat criminogenic behavior, which sometimes correlates with taking actions that are on the fringes of the law or ethics (among others, Art. 168 a and 168 b of KPK (the Code of Criminal Procedure)). The effectiveness of the preparatory proceedings carried out is therefore dependent on many factors, the derivative of which is the decision of the trial resolution, which, in the theoretical assumption, should meet not only the statutory objectives of the proceedings, but also be a testimony to achieve a social sense of justice. The stereotypical verification of the work of prosecutors and the Police officers makes it difficult to make a proper assessment of the actions taken by them, thus distorting the actual image of the bodies of proceedings. The subject and purpose of this study is to emphasize the social perception of the representatives of the organs of preparatory proceedings. The theoretical reflections were formulated on the basis of the developed conclusions from the analysis of the court files examined.

Opis:
The article touches upon the issue of internal transparency of rehabilitation proceedings and reinvestigations which take place following the annulment of the final judgment. Depending on the rehabilitation prerequisites, it is possible to obtain an acquittal or a judgment equal to an acquittal in three exceptional and appeal modes, i.e. cassation, revision and annulment with regard to persons who experienced repression on the grounds of their involvement in actions aimed at maintaining the independence of the Republic of Poland. The full inclusion of the defendant and their defender in the court proceedings guarantees that the efforts to expunge the defendant’s criminal record will be carried out in accordance with the rules of directness, contradictoriness, equality, orality, the right to defense and broadly understood rule of conscientiousness. This type of procedure upholds the possibility of voluntary participation of the defendant in proceedings aimed at establishing the probability or certainty of the emergence of grounds for employing exceptional appeal modes, while the restrictions, exclusion or expansion of the involvement of the defendant are regulated according to particular exceptions.

This article reflects general court and mass media communication in Russia, based on history and law. W artykule w oparciu o  wiedzę historyczno-prawną scharakteryzowano ogólnie stan relacji między rosyjskim sądownictwem a  środkami masowego przekazu. Szczególną uwagę zwrócono na zastosowanie w Rosji ogólnoeuropejskich zasad sądownictwa, takich jak: jawność, otwartość, konkurencyjność (kontradyktoryjność), jak również na sytuację dziennikarzy specjalizujących się w relacjonowaniu procesów sądowych. Przedstawiono tendencje rozwojowe w zastosowaniu we współczesnym sądownictwie rosyjskim demokratycznych zasad funkcjonowania sądów.
