    Following the linguistic turn in analytical philosophy, concern for language underlies some of the most important strands of philosophical practice, making issues of mind, language and discourse virtually inseparable elements of scientific inquiry. Just as philosophy looks to language and linguistics to endorse different ontological and epistemological postulates, linguistics looks to philosophy in addressing its key questions of meaning, function and use. In this paper I argue that pragmatics and discourse analysis are areas where the relation between language, linguistics and philosophy is particularly salient. Crucially, philosophy, its conceptions and frameworks, should never be viewed as ‘external’ to discourse. Rather, discourse and discourse study involving pragmatic tools are, in themselves, areas of intense philosophical practice. Results of this practice are relevant and of interest to not only language philosophers, but also to those exploring ontological and epistemological matters of general philosophy.

    The purpose of this essay is to analyze the metaphor of the “defect of a declaration of will” in the legal language. The secondary goal is to note that a reflection on the metaphor is a CONTAINER image schema. Simultaneously, the metaphor of the “defect of a declaration of will” is in fact a dead metaphor. This essay is also focused upon an analysis of a function fulfilled by the metaphor in normative acts, judicial decisions, and legal doctrine.

    Celem niniejszej glosy jest przedstawienie problematyki dozwolonego zakresu interpretacji prawa przez sądy w polskim porządku prawnym i jego wpływu na praktykę orzeczniczą, dla której punktem wyjścia jest omawiany wyrok Trybunału Konstytucyjnego. Komentowane orzeczenie dotyczy istotnego, z punktu widzenia praktyki stosowania przepisów Kodeksu postępowania cywilnego2 oraz Prawa o notariacie3, charakteru prawnego dokonania przez notariusza odmowy dokonania czynności notarialnej. Zgodnie z art. 83 § 1 Prawa o notariacie notariusz może odmówić dokonania czynności notarialnej, na którą to odmowę przysługuje zażalenie. Wobec tego pojawia się pytanie, czy decyzja notariusza o odmowie dokonania czynności notarialnej zastępuje orzeczenie sądu pierwszej instancji. W niniejszej pracy zastosowano metodę analizy aktów prawnych oraz orzecznictwa i literatury odnoszących się do tego zagadnienia. Trybunał Konstytucyjny w komentowanym orzeczeniu przychylił się do stanowiska, że orzeczenie sądu okręgowego wydane na skutek zażalenia na odmowę dokonania czynności notarialnej nie jest zaskarżalne. W konsekwencji uznał notariusza za quasi-sąd, a dokonaną przez niego odmowę jako quasi-orzeczenie. Przeprowadzone badania pozwalają na sformułowanie tezy, że rozumowanie Trybunału Konstytucyjnego, choć w wielu miejscach trafne, opiera się na orzecznictwie sądów, w tym Sądu Najwyższego, które stoi w sprzeczności z teorią racjonalnego prawodawcy. Autorka w glosie podejmuje kwestię precedensu jurydycznego oraz jego oddziaływania na obowiązującą w polskim porządku prawnym koncepcję racjonalnego prawodawcy, a także dopuszczalnych granic interpretacji przepisów przez sądy.
    The aim of this commentary is to present the issue of the permitted scope of interpretation of the law by Polish courts under the Polish legal system and its impact on the practice in judicial decisions. The starting point is the discussed judgement of the Constitutional Tribunal. This judgment addresses the legal nature of a notary’s refusal to perform a notarial act, which is significant from the practical point of view. Pursuant to Article 83(1) of the Law on Notaries, a notary may refuse to perform a notarial act and such a refusal may be complained against. Therefore, a question on the nature of the complaint against a refusal to perform a notarial act arises. The research method used in this article consists in the analysis of legislative acts, judicial decisions and relevant literature. In its judgement, the Constitutional Tribunal agrees with the position that a decision of a regional court issued as a response to a complaint against is refusal in question is non-appealable. In consequence, the Constitutional Tribunal recognized the notary’s decision as a quasi-judgment of the first instance court. The research conducted allows the formulation of a thesis that the Tribunal’s standpoint, although accurate in many places, is mainly based on judicial decisions, including those of the Supreme Court, which are contrary to the rational legislator theory. What is more, despite many amendments to the act, the legislator did not decide to settle this problem directly in the regulation in force. The author addresses the issue of a juridical precedent and its impact on the rational legislator concept that is in force in the Polish legal order and also refers to the issue of the permissible limits of courts’ interpretation of laws.

    Opis:
    Background: Services of general economic interest are part of the European Union’s legal order for free competition and state aid. They concern the entrustment of certain public services for a particular reward, known as compensation, by a public body. The paper reviews the mechanism of entrusting SGEI from the perspective of agency theory. Research purpose: The aim of the paper is to analyse whether there is an analogy between the mechanisms of entrusting public services and the mechanisms identified to mitigate the effects of the problem of the agency and draw conclusions, based on economic theory, to improve legal regulation. Methods: The analysis of selected Polish and English literature on the agency theory and SGEI was carried out. A review and interpretation of legal regulations in the field of public aid was made, with a focus on services of general economic interest. The paper has a conceptual character. Conclusion: The conclusion is that there is a clear analogy between the mechanisms of entrusting public services and the mechanisms adopted to mitigate the agency problem. This means that the achievements of economic sciences in the field of the agency theory should be taken into account in the development of legal regulations on public services and in the preparation of the SGEI entrustment contracts.
    Przedmiot badań: Usługi w ogólnym interesie gospodarczym są częścią porządku prawnego Unii Europejskiej dotyczącego swobodnej konkurencji i pomocy publicznej. Dotyczą one powierzenia przez podmiot publiczny świadczenia określonych usług publicznych za określone wynagrodzenie, zwane rekompensatą. W artykule przeanalizowano mechanizm powierzenia UOIG z perspektywy teorii agencji. Cel badawczy: Celem artykułu jest zbadanie, czy istnieje analogia między mechanizmami powierzenia usług publicznych a mechanizmami zidentyfikowanymi w celu złagodzenia skutków problemu agencji oraz sformułowanie w oparciu o teorię ekonomiczną wniosków służących udoskonaleniu regulacji prawnych. Metoda badawcza: Dokonano analizy wybranej literatury polskojęzycznej i anglojęzycznej w przedmiocie teorii agencji i UOIG. Dokonano przeglądu i interpretacji regulacji prawnych w zakresie pomocy publicznej ze szczególnym uwzględnieniem usług świadczonych w ogólnym interesie gospodarczym. Artykuł ma charakter koncepcyjny. Wyniki: W ramach przeprowadzonej analizy wykazano, że istnieje wyraźna analogia między mechanizmami powierzania usług publicznych a mechanizmami przyjętymi w celu złagodzenia problemu agencji. Oznacza to, że osiągnięcia nauk ekonomicznych w dziedzinie teorii agencji powinny być brane pod uwagę przy opracowywaniu regulacji prawnych dotyczących usług publicznych i przygotowywaniu umów powierzenia UOIG.

    The article examines the specific correlation (interdependence) between the identification and intentional explanation of conventional acts (in particular, legally significant conventional acts). The author describes this interdependence as ‘constitutive’ because in this case intentional explanation plays a constitutive role for the identification of a conventional act. This can be expressed through the formula: ‘person P performed conventional act CA1’ only if ‘person P performed conventional act CA1 because person P was driven by the intention to perform conventional act CA1.’ The article analyses the logical and argumentative structure of the abovementioned correlation. On the basis of the analysis, the author claims that a constitutive correlation indicates that a relevant intention should be perceived as an element of the act itself (in contrast to the view adopted in the theory of conventional acts) and that verification rules relevant for the given act exist alongside the constitutive rules. Recognizing the relevant intention as an element of the conventional act stands in opposition to causalism, which treats intentions as the causes of actions.
    Artykuł dotyczy specyficznej współzależności między identyfikacją a intencjonalnym wyjaśnianiem czynności konwencjonalnych (w szczególności prawnie doniosłych czynności konwencjonalnych). Autor charakteryzuje tą współzależność jako „konstytutywną”, ponieważ odgrywa ona konstytutywną rolę przy identyfikacji danej czynności konwencjonalnej. Można wyrazić to formułą: „osoba O dokonała czynności konwencjonalnej CK1” tylko wtedy, gdy „osoba O dokonała czynności konwencjonalnej CK1, ponieważ osoba O kierowała się intencją dokonania czynności konwencjonalnej CK1”. W artykule analizowana jest logiczna i argumentacyjna struktura wskazanej współzależności. W świetle dokonanej analizy autor uznaje, że konstytutywna współzależność skłania do traktowania odpowiedniej intencji jako elementu samej czynności konwencjonalnej (w przeciwieństwie do poglądu przyjmowanego w teorii czynności konwencjonalnych) oraz postulowania istnienia, obok reguł konstytutywnych, właściwych dla danej czynności reguł weryfikacji. Uznanie odpowiedniej intencji za element czynności konwencjonalnej przemawia zaś przeciwko kauzalizmowi, traktującemu intencje jako przyczyny zachowań.

    Tematem artykułu jest sporna w nauce prawa karnego problematyka wzajemnej relacji między istotą czynu zabronionego (niem. Tatbestand) a pozostałymi elementami struktury przestępstwa, tj. bezprawnością czynu oraz winą. Autor szczególną uwagę poświęca zagadnieniu charakteru relacji między stroną podmiotową czynu zabronionego i winą. Ma to związek z wysuwaną w nauce polskiej tezą o konieczności radykalnej separacji tych płaszczyzn, która jest realizowana w przepisach polskiego kodeksu karnego z 1997 roku. Charakterystyczne dla takiego stanowiska są regulacje, których przedmiotem jest błąd co do znamienia sytuacji wyłączającej bezprawność czynu (art. 29) oraz błąd co okoliczności stanowiącej znamię typu (art. 28 § 1 w brzmieniu nadanym nowelizacją z 20 lutego 2015 r.). U podstaw tych regulacji leży założenie, że znamiona podmiotowe (umyślność i nieumyślność) należą wprawdzie do zespołu znamion typu czynu zabronionego, jednakże nie mają żadnego konstytutywnego znaczenia zarówno przy ustalaniu bezprawności czynu, jak i winy sprawcy. Umyślność i nieumyślność są ostro oddzielone od winy (rozumianej „czysto normatywnie”). W takim ujęciu zespół znamion typu czynu zabronionego (istota czynu) ma charakter deskryptywny i jest wolny od jakiegokolwiek wartościowania. Stanowisko takie prezentował w nauce niemieckiej twórca „finalizmu” H. Welzel, a w nauce polskiej A. Zoll. Autor artykułu przeprowadza analizę poglądów H. Welzla po jego „ontologicznym zwrocie” w szóstej dekadzie XX wieku. Denormatywizacja pojęcia m.in. umyślności na płaszczyźnie znamion typu czynu zabronionego, jego oddzielenie od każdego kontekstu wartościującego doprowadziło finalistów do przyjęcia tzw. ścisłej teorii winy (die strenge Schuldtheorie). Podobnie rzecz przedstawia się na gruncie systematyki przestępstwa akceptowanej w ośrodku krakowskim (A. Zoll). Urojenie znamienia okoliczności wyłączającej bezprawność nie wyłącza bezprawia czynu umyślnego i rozstrzygane jest wyłącznie na płaszczyźnie winy (art. 29 polskiego kodeksu karnego). Wyrazem poglądu o konieczności denormatywizacji znamion podmiotowych typu jest również nowe brzmienie art. 28 § 1. Autor opracowania prezentuje stanowisko odmienne, opowiadając się za społeczno- wartościującym (normatywnym) ujęciem istoty czynu i umyślności (zamiaru). Oznacza to, że przy określaniu przedmiotu zamiaru (świadomości sprawcy) są lub mogą być istotne nie tylko „okoliczności faktyczne” będące podstawą znamion typu, ale również ich społeczny (normatywny) kontekst i znaczenie, świadomość społecznej szkodliwości), a być może nawet ocena prawna czynu. Pominięcie tego całego kontekstu (umyślność ujęta „naturalistycznie”) prowadzi zaś do tzw. ścisłej teorii winy. Zdaniem Autora, trafna jest koncepcja całkowitego wyłączenia bezprawia umyślnego: w wyniku urojenia znamienia kontratypu sprawca chce obiektywnie czegoś zgodnego z prawem. Jednocześnie umyślność musi znaleźć swoje miejsce (również) na płaszczyźnie winy (kompleksowa, psychologiczno-normatywna teoria winy). Realizacja znamion typu niesie ze sobą zarówno ujemną ocenę w sferze bezprawia (bezprawności), jak i winy. Na obydwu płaszczyznach pełni ona funkcję „wskaźnikową”, a więc typizacja czynu obejmuje również elementy zawinienia. Zdaniem Autora, zamiar bezpośredni należy lokować zarówno w bezprawiu, jak i winie. Kompleksowy, mieszany charakter można również wykazać w przypadku tzw. zamiaru ewentualnego oraz nieumyślności. Dlatego Autor krytycznie ocenia postulaty rezygnacji z kompleksowych konstrukcji lekkomyślności i niedbalstwa oraz wspomnianą wyżej nowelizację art. 28 § 1 kodeksu karnego. Jego zdaniem, swego rodzaju domniemanie winy umyślnej może wynikać z wartościującego charakteru umyślności (funkcja w obszarze winy). Konsekwentna denormatywizacja pojęcia nieumyślności (dawnej „lekkomyślność”, „niedbalstwo”) doprowadziła w nauce polskiej do konstatacji, że strona podmiotowa „nieumyślności” to po prostu „brak zamiaru”. Nowe brzmienie art. 28 § 1 kodeksu karnego wraz z określonym otoczeniem normatywnym i jego wykładnią (negatywne sformułowania art. 1 § 3 i 28 § 1, obiektywistyczna interpretacja art. 9§2) prowadzi do niedającego się zaakceptować na gruncie prawa karnego demokratycznego państwa prawnego rezultatu: przyjęcia domniemania winy nieumyślnej na podstawie realizacji li tylko znamion przedmiotowych czynu zabronionego. Potrzeba pozytywnego ustalania możliwości przewidzenia sprawcy na podstawie konkretno-indywidualnie (subiektywnie) interpretowanej przesłanki art. 9 § 2 kodeksu karnego („mógł przewidzieć”) wynika z braku wskaźnikowej funkcji nieświadomej nieumyślności, realizacja znamion takiego typu nie niesie ze sobą ujemnie ocenianej decyzji sprawcy.
    The paper tackles the mutual relation between the essence of a criminal offence (Tatbestand in German) and other elements comprising the structure of a criminal act, i.e. illegality and fault, a matter contentious in the study of criminal law. Special attention is devoted to discussing the character of the relation between the mens rea of an offence and fault. This is related to a postulate often put forward by Polish academic commentators that it is necessary to radically separate these two notions. This view is reflected in the provisions of the 1997 Polish Criminal Code. In line with such an argument are regulations whose subject is error as to the existence of a circumstance excluding illegality (Article 29) and error as to an element of an offence (Article 28 § 1 as amended on 20 February 2015). Underpinning these regulations is the assumption that the elements of mens rea (intention and non-intention) belong to the elements of an offence, however they have no constitutive significance both as regards establishment of illegality of an act as well as the offender’s fault. Intention and non-intention are sharply separated from fault (perceived “purely normatively”). According to this account the totality of elements of a prohibited act (the essence of an act) is of a descriptive character and remains free from any evaluation. The view has been endorsed by H. Welzel, the founder of “finalism” in the German literature, and A. Zoll in Poland. The paper attempts an analysis of the view of H. Welzel following his “ontological swerve” in the 1960s. Denormativization of, inert alia, the concept of intention as an element of an offence, separation thereof from any evaluative context, has led finalists to adopting the so-called strict theory of fault (die strenge Schuldtheorie). The situation is similar as regards the systematics of offences accepted by representatives of the Cracow school of thought (A. Zoll). Error as to the existence of a circumstance excluding unlawfulness does not exclude the illegality of an intentional act and this shall be resolved exclusively by reference to fault (Article 29 of the Polish Criminal Code). Also, the new wording of Article 28 § 1 is a manifestation of the view that mens rea elements of an offence shall be subject to denormativization. The author argues contrary in the paper, contending in favour of a societal-evaluative (normative) account of the essence of an act and intention (intent). This means that, when the object of intention (the offender’s consciousness) is ascertained, of significance are or may be not only “factual circumstances” forming the foundation of the elements of an offence, but also their societal (normative) context and meaning, awareness of social harmfulness), or even, potentially, the legal assessment of an act. To overlook this entire context (intention perceived “naturalistically”) leads to the so-called strict theory of fault. The author maintains that the concept mandating total exclusion of intentional illegality is correct: in cases of error as to the existence of a circumstance excluding unlawfulness the offender objectively wants something legal. At the same time, intention must (also) finds its place alongside fault (comprehensive, psychological-normative theory of fault). Actualization of the elements of an offence triggers a negative assessment both in the realm of illegality and that of fault. For in both realms it performs a “directional” function, therefore the typification of a criminal act shall already encompass elements of fault. The paper argues that direct intention shall be located both within illegality and fault. A comprehensive, hybrid character may also be proven as regards so-called dolus eventualis and non-intention. This is why the author furnishes a critique of the views in support of renouncing comprehensive theories of carelessness and negligence and of the aforementioned amendment to Article 28 § 1 of the Criminal Code. In his estimation, some form of presumption of intentional fault may result from the evaluative character of intention (its function within the realm of fault). Consistent denormativization of the notion of non-intention (previously known as “carelessness”, “negligence”) led Polish academic commentators to the conclusion that the mens rea of “non-intention” is simply “lack of intent”. The new wording of Article 28 § 1 of the Criminal Code, together with certain normative context and its construction (negative formulations of Articles 1 § 2 and 28 § 1, the objectivist interpretation of Article 9 § 2) gives rise to an account unacceptable in the criminal law within a democratic state governed by the rule of law: endorsement of a presumption of non-intentional fault based upon the actualization of the actus reus of a criminal offence. The need to positively establish the possibility of an offender’s foresight by reference to a concrete-individual (subjective) interpretation of the requirement Article 9 § 2 of the Criminal Code (“could have foreseen”) stems from unconscious non-intention’s lack of directional function, and an actualization of the elements of such offence does not induce a negative assessment of the offender’s decision.

Po pierwsze, autorka pokazuje jaki wpływ miało drugie wydanie Czeskiego pytania, opublikowane w 1908 roku, na dyskusję o sensie czeskiej historii. Po drugie, autorka analizuje strategie pisania Masaryka, pokazując, do jakiego stopnia chodzi w nim o kreację, a do jakiego o analizę czeskiej historii.

    Wypowiedzi performatywne – akty mowy, kształtujące rzeczywistość pozajęzykową występują często w różnego rodzaju dokumentach prawnych. Jednym z takich dokumentów jest akt notarialny, sporządzony przez notariusza i zawierający oświadczenia stron, które kreują nową rzeczywistość prawną. Nie wszystkie jednak oświadczenia w akcie notarialnym stanowią wypowiedzi performatywne – część z nich opisuje rzeczywistość, nie zmieniając stosunków cywilnoprawnych pomiędzy stronami. Szczególnym przypadkiem wypowiedzi performatywnej jest podpis stron, potwierdzający oświadczenia spisane w imieniu stron przez notariusza. Niniejsza praca ma na celu ukazanie różnorodności wyrażeń, które można zaliczyć do wypowiedzi performatywnych i tym samym ukazać, że katalog tych wyrażeń jest znacznie szerszy, niż często wskazuje się na to w literaturze językoznawczej.
    Performative utterances, or speech acts, shaping the extra-linguistic reality occur frequently in legal documents. One of such documents is a notarial act, drawn up by a notary and containing declarations of the parties which change the civil law relations. However, not all declarations in a notarial act are performative utterances: some of them describe the reality, without changing the civil law relations between the parties. A special case of a performative utterance is the signature of the parties, confirming the declarations written by a notary on behalf of the parties. This paper aims to illustrate the diversity of expressions which can be classified as performative utterances, and thus shows that the catalogue of these expressions is much broader than it is often presented in the linguistics literature.

    The theme of the article is a description of possibilities of articulating a directive speech act. The author makes the form of expressing a DEMAND conditional on non-linguistic relationships between participants of a communication act. Based on the degree of interlocutors’ interdependence the form of a DEMAND may be the one of superiority, subordination or symmetry. The article describes various forms of verbalizing DEMANDS depending on relationships between a speaker and a listener as well as the ability of interpreting the directive speech act by the speaker and the listener.

    Schaeffler zeigt mit seinen Beiträgen sehr deutlich, dass das Gebet keine sinnlose sprachliche Äußerung ist und arbeitet sehr gut die Spezifika religiöser Sprache heraus, was besonders an Beispielen in Psalmen und am Magnificat deutlich werden konnte. Er wies auf das Selbstverständnis der Beterin/des Beters hin und zeichnete dies am Beispiel Mariens nach. An ihrem Beispiel konnten wir sehen, wie religiöses Sprechen die eigene Person zur Sprache bringen kann und wie in der Sprache der Adressat berücksichtigt wird in Rückgebundenheit auf die eigene Existenz. Das Gebet hat Bestand durch die Zeit hindurch und ruft somit eine immer größere Gemeinschaft zusammen, die dieselben Worte ein und desselben Gebetes weitergeben kann und somit ermöglicht, eine Tradition aufrechtzuerhalten, in der Geschichte und Gegenwart zusammenfließen und einen Bestand für die Zukunft garantieren. Die gemeinsame Gebetssprache, wie z.B. die Psalmen oder das „Vater Unser“, ist ein wichtiger Faktor, der ein Erblühen und Weiterblühen einer Gemeinde möglich macht. Gott kann durch die Zeit hindurch als ein und derselbe erkannt werden. Auch über den Wandel zahlreicher Zeitalter hinaus erkennen wir immer wieder neu die Bedeutung des Aufstrahlens Gottes. Das biblische „Siehe, da“ weist auf eine Tat Gottes hin, die plötzlich zu geschehen scheint und doch große Wirkung weit über diesen einen Moment hinaus zu wirken vermag. Um diese Zeit der religiösen Erfahrungswelt ständig wach zu halten, bedarf es einer Treue der Erinnerung. Durch das Gebet im Gegenüber von Gott findet die Beterin/der Beter erst ihre/ seine Identität. Gebet ist identitätsstiftend. In diesem Artikel wurde der Hauptakzent auf Gebetssprache gelegt. Es wurde darzustellen versucht, dass diese Form so verschieden sie von der Alltagssprache sein mag, alles andere als sinnlos ist. Sowohl die Begriffe „Gebet“, wie „Sprache“ sind Begriffe, die viele Bedeutungen haben können und jeder/jede kann darunter etwas anderes verstehen, je nach Vorverständnis. Doch konnte aufgewiesen werden, wie wichtig deren Eigenheiten mit ihren tiefen Bedeutungen sind.
    The following article analyses the theory of language of prayer introduced by Richard Schaeffler, a German philosopher and theologian. The author of the article refers to the following writings by R. Schaeffler: „Das Gebet und das Argument. Zwei Weisen des Sprechens von Gott. Eine Einführung in die Theorie der religiösen Sprache“ (Prayer and argument. Two ways of talking about God. Introduction to the theory of religious language), „Kleine Sprachlehre des Gebets“ (On the language of prayer) and „Religionsphilosophie“ (The philosophy of religion). What he attempts to demonstrate is that, if we base on the Schaeffler’s inquiries, a statement, which is a prayer, is never senseless. Despite the fact that, as we can read in the preface, the statement does not function as a informational or motivational tool, it still serves as a lingual act, which sacramentally builds a relation between God and a human. Schaeffler shows the unique nature of religious language, he especially seeks for examples in psalms and the Magnificat. He emphasizes the self-awareness of a praying man, as exemplified by Mary. Her example allows us to see how we can express ourselves through praying, and how we refer to prayer’s addressee in the context of our own existence. Prayer has existed for centuries and binds more and more people into a community. The community has been sustaining the tradition through passing down the words of the same prayer. In the tradition in question the past and the present are combined which guarantees its lasting. The common language of prayer, e.g psalms or the Our Father, is an important factor which allows the community to last and develop. God has been recognized for centuries as the one and the same. People find Him over and over again in the changing historical periods. The evangelical texts tell about particular events (e.g. calming the storm, Mt 8, 23–25), one-time acts of God, still having influence in subsequent periods and changing people’s lives. To sustain the religious world of experiences alive being faithful to memory is required. Only through prayer, in contact with God, a praying man can find and create his own awareness. What has been greatly emphasized in the article is the language of prayer. The author attempts to show that this language, no matter how different from everyday language, certainly has its own sense. The lexemes prayer and language have many meanings and everyone can understand them differently, depending on the knowledge and experience gained. What has been made evident here is how important the deep meanings of these lexemes truly are.

    Politicians, philosophers, sociologists, educators, and priests often declare their belief that there is a universal crisis of political, civil, and existential commitment among the youth and adults. E. Mounier’s philosophical and existential output is undoubtedly one of the more interesting reflections on authentic commitment in twentieth-century thinkers. It seems, however, that the thought of the French personalist has not been sufficiently accepted, nor appropriately appreciated. It is not just a matter of the moment. His theory of act and commitment is firmly based on the ethics of responsibility for one another and the indispensable dignity of the human person. This paper is an attempt to bring closer some aspects of Mounier’s theory of act. His work may open a horizon for further reflections. After all this sketch should allow the reader to better grasp the concept of commitment from the angle of Christian personalism that is fundamental for the understanding of the mystery of the person.
