The clean-up operations following the Chernobyl accident were arguably the greatest in the history of mankind. This paper is not intended to give a comprehensive review of the Chernobyl related research, we present only a review of the scientific literature available till now about the “liquidators”, i.e. people who performed the task of decontamination work near the damaged Chernobyl nuclear power plant. Most of the approximately 300,000 liquidators who took part in the mitigation of the local consequences of the Chernobyl accident between 1986 and 1989 received only low radiation doses which are comparable or lower than those documented in nuclear worker registries. The health consequences from these radiation doses are too small to be identifiable in any epidemiological study that does not target specific sub-groups with potentially higher exposure. From our review of the published literature, several criteria are derived which could be used to identify potentially suitable sub-populations; in particular, among those being the liquidators who participated in the clean-up work during in 1986, including CNPP staff, special groups such as the “sarcophagus workers” (39), helicopter crews (3, 48), liquidators from the Institute of Biophysics who had participated in clean-up work in Chernobyl (12, 20), the Samoilenko group (12), sarcophagus builders (12) and groups other that the aforementioned.

The purpose of this paper was to specify what is the share of narrowly understood micro-ideology in the political thought of Law and Justice. Embarking on the analysis of the above-stated problem, we first and foremost fixed particular methodological assumption. As a point of departure for our analysis we adopted the conception of the ideological morphology by Michael Freeden. In line with it, we assumed that ideologies are not fully distinct entities but they interact with one another. They are also partly overlapping and thus they share some contiguous points. In accordance with the concept of populism, as worked out within our framework, we focused our attention on the problematics of elites and the people. As conceived of by Law and Justice, elites did not discharge their duties, alienating themselves from the society and caring mainly about their own socio-economic interest. Furthermore, the critique of elites was mainly related to their non-democratic genesis and artificially created putative “super-expertise”.Eventually, we proved that populism may be regarded as one of the phenomena characterizing the political thought of Law and Justice.

W ostatnich latach politycy coraz częściej odwołują się do woli suwerena, jako do motywatora podejmowania decyzji. W artykule zostanie podniesiona kwestia wątpliwości kryjących się za zasadą reprezentacji – naczelną zasadą demokracji. To właśnie dzięki reprezentantom lud sprawuje władze w państwach demokratycznych. I jak głoszą populiści, system trzeba zmienić, by przywrócić ludowi głos. Zostaną również poruszone kwestie realności takiego rozwiązania. Wybrani reprezentanci są jednocześnie podlegli ludowi, jak i rządzą nim. Wywołuje to pytania o zakres władzy, jaką mają rządzący. Gdzie powinna kończyć się władza ludu oraz w jakich okolicznościach rządzący powinni wiedzieć lepiej niż vox populi? Zwłaszcza że współcześnie powstaje coraz więcej nisz, do których suwerenny lud nie ma dostępu.
During the last few years, politicians have increasingly referred to the will of ‘the people’ to justify their decisions. This article discusses the limits of the idea of representation, which is the main principle of democracy. In democratic countries ‘the people’ exercise their authority through representatives. According to populists, the democratic system needs to be changed to give voice to ‘the people’. Elected representatives are both subordinate to ‘the people’ and govern them. This construction raises questions about the extent of power which representatives have. Where should the power of ‘the people’ end and in what circumstances should representatives know better than vox populi? Today there are many areas to which ‘the people’ have no access.

Today the notion of popular sovereignty is seen as the standard of political legitimation. However, there is an important theoretical discussion to be had about the helpfulness of this notion since it is not clear who constitutes the ‘people’ or whether ‘the people’ possess the necessary agency in order to enact sovereignty. This discussion takes on practical interest in light of recent popular struggles for democracy, as evidenced by the Arab Spring of 2010-12 as well as the uprisings in Syria. This paper seeks to discover how far these popular revolutions of the early 21st century can be understood as conforming to or diverging from the liberal notion of popular sovereignty derived from the dominant social contract model.

Education on the area of post-war community Będzino (1945–1954) The article is based on the archives portraying the formation process of Polish schools and cultural institutions as a result of the transformations of the educational system. It presents the condition of the teaching staff and the financial base related to the density of population. The author pays attention to such problems as the lack of staff, funds and equipment. He discusses the forms of co-operation with parents and the society, the participation in all-Polish actions organized by state authorities, especially in the action of fighting illiteracy. The supplement includes the schedule and the curriculum from those times. The article is concluded with the description of the end of the existence of the community of Będzino in its primitive, post-war shape.

Until 1965 the requirements and conditions of habilitation proceedings in Poland were governed by the law on schools of higher education. The solutions adopted under that law showed a relatively high degree of stability. In the fi rst years after WWII the habilitation qualifi cation was based on the solutions governing in Poland in the 1930s, with only slight changes introduced in the fi rst month after the end of the war. The fi rst reform of higher education of 1947 left the right to confer habilitation degrees with schools of higher education then in existence and retained the existing order of the habilitation proceedings. However, it implemented a number of rather signifi cant amendments in the area of the requirements needed to be fulfi lled at each stage of these proceedings. The right to lecture remained inherent to the habilitation qualifi cation and degree. What changed was the scope of infl uence of the minister of education supervising schools of higher education regarding habilitation proceedings and the appointment of the Main Council of Higher Education with the right of fi nal say and consent to the opening of the habilitation qualifi cation and to run the habilitation proceedings. Habilitation was abandoned by the reform of 1951 and replaced, following the Soviet model, with a higher degree of a doctor of science. Further changes followed in 1958 when it was restored by relevant provisions of the Act on higher education. It was then that more than forty years after Poland regained independence, the habilitation degree was for the fi rst time tied to a successful completion of the habilitation proceedings and earning the degree of a ‘docent’. The Main Council of Higher Education continued to function but its role in habilitation proceedings was reduced to issuing opinions before the minister of higher education decided on habilitation matters. Apart from schools of higher education, the right to confer habilitation degrees was granted to the Polish Academy of Sciences and academic institutions operating outside schools of higher education.

This paper aims at clarifying the report between the President and the Constitutional Court. If we take as a starting point the constitutional mandate of these two institutions it follows that their final mission is the same, i.e., the protection and safeguarding of the constitutional system. This paper, thus, will clarify the key points in which this report is expressed. Further, this paper examines the theoretical aspects of the report between the President and the Constitutional Court, starting from the debate over this issue between Karl Schmitt and Hans Kelsen. An important part of the paper will examine the Constitution of Kosovo, i.e., the contents of the constitutional norm and its application. The analysis focuses on the role such report between the two institutions has on the functioning of the constitutional system. In analyzing the case of Kosovo, this paper examines Constitutional Court cases in which the report between the President and the Constitutional Court has been an issue of review. Such cases assist us in clarifying the main theme of this paper. Therefore, the reader will be able to understand the key elements of the report between the President as a representative of the unity of the people on the one hand and the Constitutional Court as a guarantor of constitutionality on the other hand.

The goal of the article is to present the scope of interventions by the Regional Offices for the Control of Publications and Performances in the Catholic press during the decline of the People’s Republic of Poland (PRL) and the first months of the Republic of Poland, i.e. between January 1989 and April 1990. Initial censorship was a period which preceded the Round Table talks while final censorship ended with the abolition of censorship, i.e. the passing of the act (11 April 1990) on the liquidation of the institutions for the control of publications and performances. The source material for the article were the files of the Main Office of Control of Press, Publications and Shows stored in the Archives of New Records.

Research objective: The aim of the article is to analyse the thought of J.J. Rousseau and J. Madison (counted among the most prominent theorists of popular or republican government in the Eighteenth century), with a special emphasis on the issue of citizenry. The research problem and methods:  The author focuses on the relationship between the accounts of the people and the associated concepts of citizenship. He wonders whether they can provide us with any coherent vision of the citizens’ role in government or – rather – reveal serious discrepancies within a broader doctrinal tradition. To that purpose the author refers to  main works of these authors, supporting his conclusions by critical references to secondary sources, dealing especially with their views on popular sovereignty. The process of argumentation:  The article begins with the analysis of Rousseau’s thought, turning then to that of Madison. It finishes with a sort of summary, which gives an opportunity to emphasise the main similarities and – above all – differences between their arguments. Research results:  The analysis of the both authors’ thought indicates that there were at least two different views on citizenship within the Eighteenth century tradition of popular sovereignty. It points out that Rousseau viewed the common citizenry in a very active role of a sovereign, insisting on frequent assemblies of the people as a necessary means of identifying the general will. In that respect, Madison kept warning against a more direct or locally-oriented citizens’ activity, looking for such electoral and constitutional devices of majority rule that would more appropriately serve the public interest, securing the rights of minorities as well. Conclusions, innovations, recommendations: The far-reaching conclusion is that the two depicted models of citizenship reveal in fact considerably broad possibilities of defining popular sovereignty and – more specifically – the constitutional function of civic activity. The latter will be ultimately determined by assumptions of the public sphere and evaluations of the moral and political capacities of the very citizens.
Cel naukowy: Celem artykułu jest analiza myśli Jean-Jacques’a Rousseau i Jamesa Madisona (zaliczanych do najbardziej znaczących teoretyków powszechnego czy też republikańskiego ustroju w XVIII wieku), ze szczególnym uwzględnieniem tematu obywatelstwa.  Problem i metody badawcze: Autor skupia się na powiązaniach między ujęciami ludu i wynikającymi z nich koncepcjami obywatelstwa. Zastanawia się czy składają się one na spójną wizję roli ustrojowej obywateli czy też – przeciwnie – ukazują one poważne rozbieżności w obrębie szerszej tradycji doktrynalnej. W tym celu sięga autor do najważniejszych prac tych pisarzy, wspierając swe wnioski krytycznymi odniesieniami do literatury sekundarnej, dotyczącej zwłaszcza ich poglądów na temat suwerenności ludu. Proces wywodu: Artykuł rozpoczyna się on analizy myśli Rousseau, przechodząc następnie do myśli Madisona. Jest on zakończony rodzajem podsumowania, które daję okazję do uchwycenia zasadniczych powiązań i – przede wszystkim – różnic między ich argumentami. Wyniki analizy naukowej: Analiza myśli obydwu autorów wykazuje, że w obrębie osiemnastowiecznej tradycji doktryny suwerenności ludu. Wykazuje ona, że Rousseau postrzegał zwykłych obywateli w kategoriach bardzo czynnego zwierzchnictwa, domagając się częstych zgromadzeń ludu, uznanych za konieczne narzędzia ujawniania woli powszechnej. W tym względzie Madison ostrzegał stanowczo przed bardziej bezpośrednią czy zorientowaną lokalnie aktywnością obywatelską, poszukując takich mechanizmów wyborczych i ustrojowych tzw. rządów większościowych, które bardziej służyłyby interesowi publicznemu, zabezpieczając jednocześnie prawa mniejszości.  Wnioski, innowacje, rekomendcje: Dalej idącym wnioskiem jest ten mianowicie, że dwa opisane modele obywatelstwa odsłaniają w istocie stosunkowo szerokie możliwości definiowania suwerenności ludu i – ściślej biorąc – roli ustrojowej aktywności obywatelskiej. Ta ostatnia będzie zależeć ostatecznie od założeń dotyczących dziedziny publicznej oraz oceny możliwości moralnych i politycznych samych obywateli.

Tis postulate was not fulflled in the case of the vetting of the Jesuit Stefan Filipowicz, as a result of which he suffered unpleasant consequences. In this contribution, I reveal the circumstances of his vetting.
