The essay compares selected Kantian ideas stated in The Perpetual Peace with the institutions established by the Charter of the United Nations and the Statute of the International Court of Justice. The concept of a nation and its position in international law in view of the Charter will be presented and linked with the Kantian theory of sovereignty of Nations. The core of the paper is an afterthought on the supremacy of three separate powers over the Nations, hence the question of the rules of procedure held by the International Court of Justice will be regarded as the consequence of the idea of sovereign equality. The Kantian concept: "Nations, as states, may be judged like individuals”: (Kant, 1917, p. 128) is observed from the perspective of state’s demand for independence. The institution of the International Court of Justice is presented as a universal supreme body. The key issue of the essay is the federative character of union as a guarantee of eternal peace seen as common point in both of the documents discussed.

Opis:
The present contribution focuses on the presence of Gulag argot in Julija Nikolaevna Voznesenskaja’s The Women’s Decameron, more specifically on the short stories told by Zina, the former Lager prisoner by means of linguistic analysis and the recently published Dictionary of Russian Slang Expressions: The Lexicon of Penal Servitude and Camps in Imperial and Soviet Russia by Leonid Gorodin. The following study aims to describe the aforementioned stylistic strategy from The Women’s Decameron as a form of skaz, but also to underline how language works in this context as lieu de mémoire. It is possible to define the Gulag argot as a site of memory, especially when considering the recent study and exhibition by the Gulag Museum in Moscow, named The Language of Unfreedom. This exhibition called attention to the extent in which the lexicon of Gulags has become part of everyday language, its violent heritage ignored, and this original violence underplayed. The work of the Gulag Museum in Moscow underlines the important role of language in preserving history. The memory of Gulag camps is also a recurring theme in Julija Voznesenskaja’s literary and journalistic work; therefore, the usage of Gulag argot cannot be interpreted only as a literary motif, but also as a way to preserve the tragic memory of concentration camps.

One of the key problems of the modern world is the entrance onto the path of sustainable development, where in theory, the concept of sustainable devel-opment implies steady progress on economic and social in harmony with the natural environment, to ensure a high quality of life for present and future gen-erations. Thus, this article raises the question of how a man, and more broadly: the progress of humanity, is the starting point and also the point of arrival of this concept? For ambivalence (which can easily be noted here), creates a varie-ty of dilemmas, which opens a new field of discussion in various disciplines, including philosophy, and bioethics. One of them (speaking more in detail) is whether the concept of sustainability in the matter of human development and environmental protection means the same as the Aristotelian principle of “golden mean”? The answer, which is given, is negative. The author proposal: is the need to assimilate the principle of the “golden mean” in the framework of the concept of human development and environmental protection. This will be her love for the human person, discovered in a free and flawless conscience.

Analizą objęte zostały działania bibliotek publicznych w województwie śląskim w latach 2017–2018 w zakresie popu-laryzacji globalnych Celów Zrównoważonego Rozwoju.
Global education plays a pivotal role in the process of upbringing and citizen engagement in the rapidly changing worlds. The aim of the article is to pre-sent the process of implementing the Sustainable Development Goals. The analysis includes public libraries in the Silesian Voivodeship, which actively took part in the popularization of the Sustainable Development Goals in the year 2017–2018.

Opis:
Celem rozważań jest rozstrzygnięcie wątpliwości związanych z interpretacją przepisu art. 2b ustawy z 11 kwietnia 2003 r. o kształtowaniu ustroju rolnego. Przepis ten nałożył zasadniczo na każdego nabywcę nieruchomości rolnej dwa uniwersalne obowiązki: nakaz prowadzenia gospodarstwa rolnego, w skład którego weszła nabyta nieruchomość rolna, przez okres co najmniej 5 lat od dnia nabycia przez niego tej nieruchomości, a w przypadku osoby fizycznej – prowadzenia tego gospodarstwa osobiście, oraz zakaz zbywania nabytej nieruchomości lub oddawania jej w posiadanie innym podmiotom w ramach tego 5-letniego okresu. Przeprowadzona analiza przepisu pozwoliła ukazać wiele praktycznych problemów, jak również przedstawić zastrzeżenia co do jego zgodności z fundamentalnymi zasadami Konstytucji RP oraz prawem Unii Europejskiej. W konsekwencji w ramach uwag de lege ferenda został sformułowany postulat dokonania daleko idącej modyfikacji tej regulacji, a nawet jej eliminacji z systemu prawa rolnego w Polsce.
L’articolo si propone di chiarire i dubbi sorti riguardo a come interpretare le disposizioni dell’art. 2b della legge dell’11 aprile 2002 sul regime agrario. Esse impongono due obblighi universali all’acquirente del terreno agricolo: l’ordine di gestire l’azienda agricola, parte del terreno acquisito, per un periodo di almeno 5 anni dalla data d’acquisto, e, nel caso l’acquirente sia una persona fisica, di farlo a titolo personale, nonché, sempre entro lo stesso periodo, il divieto di vendere oppure di cedere il terreno ad altri. L’analisi svolta ha permesso non solo di individuare molti problemi di natura pratica, ma anche di avanzare rilevanti obiezioni circa la conformità ai principi fondamentali della Costituzione della Repubblica di Polonia e del diritto dell’Unione europea. Di conseguenza, come osservazioni de lege ferenda, è stato formulato un postulato di dover apportare modifiche, di vasta portata, alla regolazione in oggetto, oppure di procedere a rimuoverla dall’ordinamento agricolo polacco nella sua totalità.
The aim of the considerations was to resolve doubts regarding the interpretation of the provision of Article 2b of the Act of 11 April 2003 on shaping the agricultural system. This provision imposes, in principle, two universal obligations on each acquirer of agricultural real estate (i) to run an agricultural holding contained in the agricultural real estate acquired, for a period of at least 5 years from the date of acquisition, or, in the case of a natural person, to run the holding personally, and (ii) not to dispose of the acquired real estate or give it in possession to other entities within the same 5-year period. The analysis of this provision enabled to identify many practical problems, and to formulate substantial reservations as to its compliance with the fundamental principles of the Constitution of the Republic of Poland and European Union law. As a consequence, de lege ferenda comments have been formulated, calling for a far-reaching modification of this regulation or its removal altogether from the Polish agricultural law system.

The United Nations Convention on Contracts for the International Sale of Goods (the so-called Vienna Convention, CISG) is considered one of the most important and influential private law acts of the past decades. The most compelling evidence of the impact of the CISG is the European private law. It is especially evident in case of consumer sales law of the European Union. The Consumer Sales Directive (99/44) and, to some extent, even the Directive on Consumer Rights (2011/83/EC) were based on principles and institutions derived from the CISG. The most important influences are of course the objective liability of a debtor and the institution of conformity of the goods; however, even the basic terms (such as “conformity of goods” and “non-conformity of goods”) are defined per analogiam. And even though European legislator did not borrow from the CISG its’ concept of the fundamental breach of contract, the further cases of CISG’s impact are seen in cases of Nachfrist and remedies available to the parties of a contract. Since European consumer sales law is one of the most important spheres of EU interests and influences national civil law systems, CISG may easily be described as the model and backbone of future private law harmonization.

Taken globally the community development faces unique situation that can be characterized by the unification of socio-economic policies and long-term strategies, as well as movements and initiatives aiming to foster community diversity. Enhancing the sustainability of indigenous community life is inevitably linked with socio-educational regional specifics that are to be expanded and supported both nationally and internationally. Our globalised world, where the issues such as war and intercultural conflicts, economic and social risks or environmental crisis are daily articulated should redefine the general concept of cultural diversity and its attachment to community life. This text describes strategies and initiatives of the United Nations which on global field operate in order to support the sustainable development of local communities and community development work and their relation to global issues in the context of education.
Rozwój społeczności na całym świecie stoi przed niepowtarzalną sytuacją, którą polega unifikacji polityk społeczno-gospodarczych i strategii długoterminowych, ale także z drugiej strony ruchów i inicjatyw mających na celu promowanie różnorodności społeczności. Wzmacnianie zrównoważonego rozwoju rdzennych społeczności jest nieuchronnie związane ze społeczno-edukacyjną specyfiką regionalną, która być może być rozszerzona i wspierana zarówno na poziomie krajowym jak i międzynarodowym. W naszym zglobalizowanym świecie, w którym kwestie takie jak wojna, konflikty międzykulturowe, zagrożenia gospodarcze i społeczne lub środowiskowe są codziennie odczuwalne, należy przedefiniować ogólną koncepcję różnorodności kulturowej i jej powiązanie z życiem wspólnotowym. Tekst zawiera opis strategii i inicjatyw Organizacji Narodów Zjednoczonych, które na polu globalnym realizowane są w celu wspierania zrównoważonego rozwoju społeczności lokalnych i działań na rzecz rozwoju społeczności i ich stosunku do problemów globalnych w kontekście edukacji.

Este artículo se propone analizar las cuatro cartas que el escritor y periodista argentino Rodolfo Walsh, cuadro político de la organización guerrillera Montoneros, escribe entre la muerte del poeta Paco Urondo y la suya propia. “Mi querido Paco”, “Carta a Vicki”, “Carta a mis amigos”, “Carta abierta a la Junta Militar”, escritas todas en el marco de la divergencia de Walsh con la conducción de Montoneros, difieren en sus destinatarios explícitos y en sus formas, pero tienen en común la marca política. La hipótesis con la que se trabaja es que Walsh las escribe, no solo porque con ellas se remite a uno de los objetivos más primitivos de la escritura, el del culto a los muertos, sino también porque la carta es más íntima y pública a la vez que otros géneros; la carta es la forma con la cual Walsh puede expresar afectividad y a la vez intervenir políticamente. Además, siguiendo a Foucault, por un lado, la escritura es siempre escritura de sí y eso significa autoconocimiento y cuidado de sí; por otro lado, para el pensador francés la práctica de libertad está asociada a ese cuidado de sí, de ahí que las cartas puedan ser leídas como gestos de libertad.

It is critical that persons with disabilities as well as incapacitated persons have a right to employment in order to enjoy living and working in the community as equal citizens. Under Polish law, persons under partial guardianship, or partially incapacitated retain the right to work (Article 22 § 2 of the Labour Code), but the current Polish regulations are unclear on the rights of fully incapacitated persons regarding their employment rights. Although Poland signed the UN Convention on the Rights of Persons with Disabilities already on 30 March 2007, it ratified it only on 6 September 2012. The Convention regulates certain standards concerning the rights of persons with disabilities and has a rather symbolic dimension, being a specific constitution of rights of persons with dysfunctions, accepted by many countries. The final assessment of the impact of the Convention on the situation of the incapacitated in Poland will only be possible when all applicable provisions of the Convention on the Rights of Persons with Disabilities have been fully incorporated in the Polish law.
Zapewnienie rzeczywistego dostępu do zatrudnienia osobom ubezwłasnowolnionym jest podstawowym warunkiem, by mogły one żyć i pracować w społeczeństwie jak równoprawni obywatele. O ile z przepisów Kodeksu pracy wprost wynika, że ubezwłasnowolnienie częściowe nie stanowi przeszkody w podjęciu zatrudnienia (por. art. 22 § 2 k.p.), o tyle niejasna w tym zakresie wydaje się obowiązująca w Polsce regulacja dotycząca osób ubezwłasnowolnionych całkowicie. Można oczywiście podawać w wątpliwość, czy osoba ubezwłasnowolniona całkowicie jest w stanie podjąć zatrudnienie i wykonywać powierzone jej obowiązki służbowe. Z uwagi jednak na szerokie możliwości i różnorodność pojawiających się obecnie form zatrudnienia oraz działania społeczności międzynarodowej mające na celu aktywizację zawodową osób niepełnosprawnych, kategorycznie negatywna odpowiedź na pytanie dotyczące możliwości podjęcia zatrudnienia przez osobę ubezwłasnowolnioną całkowicie nie wydaje się uzasadniona, tym bardziej że Polska podpisała i ratyfikowała Konwencję ONZ o prawach osób niepełnosprawnych.

Opis:
Organizacja Narodów Zjednoczonych jest międzynarodową organizacją działającą na rzecz pokoju międzynarodowego, promującą go oraz służącą swoją bezstronnością w rozwiązywaniu konfliktów. Na forum Rady Bezpieczeństwa, najważniejszego organu ONZ, społeczność międzynarodowa szuka rozwiązań dla wybuchających i trwających konfliktów oraz implementuje te rozwiązania. Weto, którym dysponują stali członkowie Rady Bezpieczeństwa może skutecznie paraliżować pokojowe wysiłki innych członków czyniąc ONZ nie zawsze efektywną instytucją. Przykładem stosowania weta przez stałego członka Rady Bezpieczeństwa, wbrew oczekiwaniom innych członków ONZ, jest ochrona, której USA udziela Izraelowi niedopuszczając do przegłosowywania niekorzystnych dla Izraela rezolucji. Wspieranie Izraela przez USA na forum ONZ umożliwia mu prowadzenie, kosztem Palestyńczyków, ekspansywnej polityki na Bliskim Wschodzie. Taka polityka, zarówno USA, jak i Izraela, czyni konflikt izraelsko-palestyński niemożliwym do rozwiązania. Celem rozważań w niniejszym artykule badawczym jest właśnie przedstawienie wspierającej Izrael polityki USA w ONZ oraz konsekwencji takiego działania. Poniższa analiza systemowa pokazuje, że wetowanie niekorzystnych dla Izraela rezolucji Rady Bezpieczeństwa przez USA ma istotny wpływ na trwanie konfliktu izraelsko-palestyńskiego stanowi przeszkodę dla społeczności międzynarodowej w wysiłkach na rzecz pokoju na Bliskim Wschodzie.
The United Nations is an international organisation acting for international peace, promoting it and serving with its neutrality in conflict resolution. In the C forum, the most important body of the UN, the international community is looking for solutions to the bursting out and lasting conflicts as well as it implements those solutions. Veto, disposed by the permanent members of the Security Council, may effectively paralyse peaceful efforts of other members making the UN not always an effective institution. An example of the application of veto by a permanent member of the Security Council, contrary to expectations of other UN members, is the protection provided by the US for Israel, preventing voting down resolutions unfavourable for Israel. The support given to Israel by the US in the UN enables it carrying out, at the expense of Palestinians, an expansionist policy in the Middle East. Such a policy, both of the USA and Israel, makes the Israeli-Palestinian conflict unresolvable. An aim of considerations in this research article is just to present the US policy supporting Israel in the UN as well as consequences of such an activity. The below specified systems analysis shows that vetoing the unfavourable for Israel resolutions being made by the Security Council by the USA has a material impact on persistence of the Israeli-Palestinian conflict and is an obstacle for the international community in efforts for peace in the Middle East.

Opis:
General debates of the annual sessions of the United Nations General Assembly (UNGA) get public attention. For the Mediterranean region the debate in the 67th GA session was significant due to the appearance of new political leaders emerging after the 2011 Arab Spring. Revolutionary changes in the MENA region resonated in the key speeches of the general debate that in turn anticipated events which we are facing today. As such, general debates of UNGA sessions provide a valuable source of information as well as an important agenda-setting mechanism.
Debaty generalne dorocznych sesji Zgromadzenia Ogólnego (ZO), w których udział biorą wysokiej rangi przedstawiciele państw członkowskich Narodów Zjednoczonych (NZ) przyciągają uwagę opinii publicznej. Dla regionu BMŚ debata podczas 67. sesji miała szczególne znaczenie ze względu m.in. na fakt, że wzięło w niej udział po raz pierwszy wielu nowych przywódców państw po wydarzeniach arabskiej wiosny z 2011 r. Odbiły się one szerokim echem w kluczowych wystąpieniach przywódców państw, antycypując wydarzenia, z jakimi przyszło nam się mierzyć w ostatnich latach. Debaty generalne dorocznych sesji ZO stanowią więc cenne i systematyczne źródło informacji, ale także inspirację do działań na uniwersalnym forum, jakim są agendy systemu NZ.

Artykuł koncentruje się na efektywności globalnych struktur zarządzania w obszarze bezpieczeństwa na tle narastającej konfrontacji między potężnymi graczami geopolitycznymi, napięć między krajami bogatymi i biednymi oraz walki o zasoby i rynki. Celem artykułu jest określenie roli i zarysowanie perspektyw globalnego zarządzania bezpieczeństwem, w szczególności na przykładzie odpowiednich instrumentów ONZ. Rada Bezpieczeństwa ONZ jest postrzegana jako instrument utrzymywania pokoju. Nakreślono jej status i uprawnienia. Operacje pokojowe ONZ są uważane za zjawisko systemowe. Zidentyfikowano problemy, które negatywnie wpływają na skuteczność i powodzenie operacji pokojowych oraz tendencje w dalszym rozwoju działań pokojowych sił ONZ. Te ostatnie powinny być gotowe do szybkiego podjęcia zadania neutralizacji zagrożeń i unikania konfliktów zbrojnych. Twierdzi się, że system bezpieczeństwa wymaga reorganizacji i usprawnienia poprzez rozbudowę sił pokojowych ONZ oraz tworzenie nowych wspólnych formacji wojskowych na stałe.
The article focuses on the effectiveness of global governance structures in the field of security against the background of increasing confrontation between powerful geopolitical players, tensions between rich and poor countries and the struggle for resources and markets. The aim of the article is to define the role and outline the prospects of global security governance, in particular based on the example of relevant UN instruments. The UN Security Council is seen as a peacekeeping instrument. Its status and powers are outlined. UN peacekeeping operations are argued for as a systemic phenomenon. Problems that negatively affect the efficiency, effectiveness and success of its peacekeeping operations and trends in the further development of UN peacekeeping activities have been identified. The latter are called upon to be ready to promptly address the task of neutralizing threats and avoiding military conflicts. It is argued that the security system needs to be reorganized and improved through the expansion of the UN peacekeeping force and the creation of new joint military formations on a permanent basis.
