Opis:: W XXI w. możemy zaobserwować przeobrażenia wynikające z niezwykłej jak dotychczas w historii ludzkości skali postępu cywilizacyjnego. Także w świadomości społecznej zachodzą gruntowne przemiany dotyczące wielu obszarów życia społecznego, zwłaszcza tych, gdzie dotychczas dominowały stereotypowe, konserwatywne poglądy. Jeszcze kilkadziesiąt lat temu wytatuowaną osobę utożsamiano z kryminalistą, w najlepszym zaś razie z określoną subkulturą. Obecnie, w związku z różnymi trendami w modzie, także w dziedzinie tatuażu, osoby z „rysunkami na ciele” nie budzą już tyle negatywnych emocji. Zagadnienie posiadania tatuaży przez policjantów dotychczas nie było przedmiotem zainteresowania naukowego. W niniejszym opracowaniu przedstawiono fenomen zjawiska na przykładzie prawodawstwa wybranych państw europejskich w aspekcie policyjnej pragmatyki służbowej.
In the 21st century we are observing transformations due to an unprecedented scale of progress in civilisation. Profound changes are taking place in many areas of social and public life, especially those hitherto under the predominant inﬂuence of stereotypical, conservative views. Only a few decades ago, a person covered with tattoos was thought to be a criminal, or at best a member of a specific subculture. Nowadays, thanks to a wide variety of fashion trends including tattoos, eyebrows are no longer being raised at the sight of “body art people.” Up to now tattooed policemen have not been a subject of scientific interest. This article presents the phenomenon by looking at the legislation of selected European countries from the pragmatic aspect of service in the police force.

Opis:: The fundamental rights and freedoms, as the highest values in a democratic society, need to be adequately protected, thus states create the mechanisms to protect them. This mechanism of protection of fundamental rights and freedoms also includes the police, especially the Police Force, whose primary task is to protect the life, health, fundamental rights and freedoms of citizens and individuals in the Slovak Republic. The role of the Police Force defining the basic aspects forms the content of this study, with a further focus on the tasks performed by the police. Following the above, the study focusses on the activity of police officers, carrying out service actions and interference with fundamental rights and freedoms. The procedure of the police in carrying out service actions tends to be the subject of further examination due to their appropriateness and legality. This issue is considered highly serious in the society, and recently it has been a subject of not only scientific discussions in the Slovak Republic. Currently, the Academy of the Police Force in Bratislava is carrying out a research project which focussing on service actions with the cooperation of the police experts. The core material is presented in the paper, which aims to point out the basic organisation and activities of the Police Force as the authority responsible for the protection of fundamental rights. The emphasis is put on the selected issues of the police while interfering in human rights and freedoms. Chronologically, from general to specific matters, the paper introduces fundamental rights and freedoms and the police interventions into this area. Theoretical research is supplemented by practical cases, conclusions and possible recommendations for the police practice by the use of several methods, in particular analysis, abstraction and deduction.

Opis:: Niniejszy artykuł w całości został poświęcony omówieniu konstrukcji prawnej delegowania policjanta od czasowego pełnienia służby w innej jednostce Policji lub w innej miejscowości. Instytucja ta została uregulowana w art. 36 ust. 1 – 3 ustawy o Policji. Stosunek służbowy ma charakter wyłącznie administracyjnoprawny. Jego charakterystyczną cechą jest zwiększona dyspozycyjność i podporządkowanie policjanta w służbie. Jednym z przejawów tej dyspozycyjności jest możliwość delegowania policjanta. Skoncentrowano zatem uwagę na omówieniu charakteru prawnego tej instytucji oraz podmiotów uprawnionych do jej stosowania.
This article is a discussion of the legal construction for a police officer’s delegation for temporary service in another unit of the police force or in another locality. In Polish law this institution is regulated by Art. 36 (1), (2) and (3) of Ustawa o policji (the Police Act). Polish administrative law gives a definition of the nature of service in the country’s police force, and the characteristic feature of police duties it highlights is that the police officer must be fully committed to his/her job and on call for duty whenever required. One of the manifestations of this availability is the fact that he or she may be delegated to another station. This article discusses the legal character of this institution and the entities authorized to use it.

Opis:: Niniejszy artykuł został w całości poświęcony problematyce związanej ze statusem policjanta pełniącego służbę na stanowisku radcy prawnego. Co do zasady funkcjonariusze Policji nie są uprawnieni do wykonywania tego zawodu, chyba że pełnią służbę na stanowisku służbowym radcy prawnego. Status policjanta radcy prawnego regulowany jest zarówno ustawą o radcach prawnych, jak i ustawą o Policji. Normy zawarte w obu aktach prawnych wzajemnie się uzupełniają. Skoncentrowano zatem uwagę na omówieniu kwestii odnoszących się do praw i obowiązków szczególnej grupy policjantów pełniących służbę na stanowisku służbowym radcy prawnego. Wykazano, że pełnienie przez policjanta służby na tym stanowisku nie modyfikuje kształtu stosunku służbowego ani też nie zwalnia go z obowiązków ustanowionych w pragmatyce służbowej dla wszystkich funkcjonariuszy.
This paper addresses issues related to the legal status of a police officer serving as a legal adviser. As a rule, under Polish law police officers are not authorised to practise in this profession unless their duties in the police force involve giving legal advice as a legal adviser. The legal status of a police officer who performs the services of a legal adviser is regulated by two acts of legislation, Ustawa o radcach prawnych (the Legal Adviser Act), and Ustawa o policji (the Police Act). The provisions in these two acts are complementary. Hence, in this paper I have focused on issues relating to the rights and obligations of this particular group of police officers, whose duties in the Polish police force entail the performance of a legal adviser’s services. I show that the legal aspect of a police officer’s employment relationship does not change if he is performing a legal adviser’s job in the course of his duties in the police force; neither doesit exempt him from carrying out the duties binding on all policemen.

Opis:: This study has been dedicated to counter-terrorism forces which form part of the Police Force. Its officers deal with physical neutralisation of terror threats and they take part in fighting against organised crimes on the Slovak Republic territory. The material also addresses the issue of special use of firearms by operators and police sharpshooters who perform their daily duty in specialized counter-terrorism units. The study has been prepared within the framework of the realization of international scientific and research project implemented under the Horizon 2020-FCT-2015 operational programme, No: 700688, entitled: Understand the Dimensions of Organized Crime and Terrorist.
