The most general perspective on the legitimacy of a social institution relies upon theacceptance that the legitimised subject has a right to govern, and that the governed recognise that right. Understanding it this way, legitimacy can be analysed from twoperspectives: normative when it concerns objective criteria that permit evaluationwhen the institution is legitimate (normative foundations for its appointmentsand rules for its functioning); and empirical, when it pertains to the awareness ofcitizens that a particular institution is legitimate. Over the last 25 years, a numberof important works on the subject of legitimacy of the police were understood viaempirical means. Based upon these, one can differentiate two opposing approachestowards police-citizen relations. Although both rely on collaboration, they indicatealternate conditions which might determine this. The first approach instrumentallycharacterises itself as achieved by citizens using a cost-benefit analysis of the results ofworking with the police; citizens are more amenable to co-operation when the possiblebenefits are higher than the incurred costs. From this perspective, citizens accept theactivities of the police and declare a willingness to work with them, if in their eyes thepolice are applying realistic sanctions towards people who disturb the norms of the law,are fighting effectively against criminal and undesirable behaviours, and are treating allcitizens in an equal manner. Different motives for working with the police accompanycitizens in their attitudes to trials. In this case, co-operation results from internalrecognition of the legitimacy of the police by citizens. If citizens believe their policeto be legitimate, they will be more inclined to co-operate with them and obey the law.Legitimacy results here, above all, from the conviction that the police are fulfilling theirduty in a just procedural manner.The most empirically-supported research into attitudes about trials has beendetermined by the American model by T.R. Tyler. Legitimacy in his view assumes trusttowards police by citizens and their internal convictions about service in regards totheir recommendations. Understood this way, legitimacy is strongly determined by thefairness of police procedures, and is itself an essential influence on the willingness ofcitizens to co-operate with the police and their readiness to abide by their laws.After a period of domination in police research about the concept of legitimacybeing strongly linked to procedural fairness, there were attempts at revising andmodifying this theory. An alternative to Tyler’s definition of police legitimacy wasproposed by British researchers J. Jackson and B. Bradford. In their view, the police’slegitimacy is formed from three elements: internal conviction about police services,shared social value of the police, and the legality of the police’s activities. However,to independently differentiate, police legitimacy produces here the same effects as inTyler’s concept, and so determines for citizens their willingness to co-operate with thepolice and their readiness to abide by the law.Presented in the following study of research on the legitimacy of the police,a methodology is given for testing both of the previously-mentioned concepts, i.e.Tyler’s model, where trust of the police is a basic element of legitimacy, and Jacksonand Bradford’s model, where trust is treated as a separate social phenomenon, thoughit is linked with the legitimacy of many related factors. The fundamental goal of thepresented research determined however to attempt answering questions about whichtheoretical principles of the procedural model of police legitimacy, including former ARCHIVES OF CRIMINOLOGY 379foreign research within this scope, do they find applied in the Polish socio-culturalcontext. Polish research was undertaken in 2013 under the auspices of the internationalresearch project “Legitimacy Policing and Criminal Justice in Central and EuropeanEurope” amongst 374 law students from various academic centres via an online survey.The research had an exploratory character and was to establish a starting point forfurther research into the legitimacy of the police in Polish society.

One of the state entities which have the task of preventing and combating terrorism is the Police, while the Police Academy in Szczytno is their intellectual base. It is not only an organisational unit of the Police, but also a higher education institution with legal personality. This status entitles it to teach at different levels of civilian higher education, as well as conduct in-service training for police officers. Education in the area of terrorist threats and counteracting them is aimed, on the one hand, at making the students aware of the scale of such threats and their accurate identification, as well as the ways of responding to them by the state and its institutions, and, on the other hand, at learning specific reflexes that will allow anyone who finds themselves in an area threatened by a terrorist attack to quickly assess the resulting threat and to react immediately. The goals set in this way are reflected in the employment structure of the academy, which includes specialist organisational units, and among the scientific and teaching staff are experts, including practitioners, who in the past carried out the tasks of the state at different levels of the system for counteracting terrorist threats. They systematically participate in scientific undertakings, including research projects, scientific conferences and publication work, participate in the work of expert teams, both national and international, and cooperate extensively with external entities. The result of their multidimensional activities is shaping and deepening social awareness of terrorist threats and desired attitudes towards them, as well as appropriate preparation of police officers, but also other services, to safely perform tasks related to the elimination of terrorist threats.

The article aims to present considerations and attempts to answer the questions, what dimension – trust, loyalty, commitment and specific expectations or qualifications – influences the process of staffing authorities of the Police and what dependencies and relationships with other organizational processes constitute the basis of personal decisions in Ministry of Internal Affairs and Administration. The work presents partial results of surveys of areas associated with politicisation of the Police, especially at the management level, their reception and perception in terms of institutional efficiency of formation. Research was carried out by a survey (quantitative using paper standarised questionnaire) in two research groups: students and police officers, led to interesting results. Their presentation should be a supplement to subsequent disputes about apoliticism and human resources management in the Police. Peculiarly for further development of research on apoliticism of the Police and causes profound changes in post-election times in higher management staff of the Police, is the lack of such studies of this undoubtedly credible problem.

Undoubtedly, serving as a police officer is associated with a high level of occupational stress. The stressfulness of this profession, which keeps increasing every year, results from several reasons, of which the most important ones include frequent participation in difficult and sometimes dramatic situations, endangering one’s own life and the lives of others, making quick decisions, bearing the burden of a potentially unjustified use of weapons, and exposure to trauma and other traumatic experiences of other people. The high level of stress related to the profession of a police officer is also associated with other factors, such as low wages, shifts, or paperwork. This paper looks at the notion and consequences of burnout among police officers on the example of the Krakow Constabulary. The study rests on a detailed survey of 110 officers based on the application of the ANOVA method of analysis of variance.

The present article is focused on general characteristics of the police as armed enforcements and uniformed services. The police are one of the major authorities responsible for ensuring the safety of citizens and public order. This article aim is to depict a structure of a particular disposable group, the specificity of its work, and the tasks it performs. The police consisting of qualified people, properly verified at a recruitment stage, may have much public confidence now. The selection of candidates for service must take place at various stages since the service that officers perform is difficult, requires a lot of dedication, a high degree of discipline and most of all it requires a high sense of responsibility.

The Police are a uniformed formation intended to ensure security and public order. The formation plays an auxiliary role in relation to the society. The Police carries out assigned tasks of preventive, criminal and investigative nature. The purpose of this study is to assess the utilitarian effectiveness of the preventive anti-crime measures of the Polish Police forces. In order to achieve this goal, the authors used the method of examining relevant documents, statistics and literature. The main source of information were statistical data made publically available by the Polish Police and communications from surveys carried out by the Public Opinion Research Centre (CBOS). The period under examination included the years 2014-2017.

Niniejszy artykuł w całości został poświęcony omówieniu konstrukcji prawnej delegowania policjanta od czasowego pełnienia służby w innej jednostce Policji lub w innej miejscowości. Instytucja ta została uregulowana w art. 36 ust. 1 – 3 ustawy o Policji. Stosunek służbowy ma charakter wyłącznie administracyjnoprawny. Jego charakterystyczną cechą jest zwiększona dyspozycyjność i podporządkowanie policjanta w służbie. Jednym z przejawów tej dyspozycyjności jest możliwość delegowania policjanta. Skoncentrowano zatem uwagę na omówieniu charakteru prawnego tej instytucji oraz podmiotów uprawnionych do jej stosowania.
This article is a discussion of the legal construction for a police officer’s delegation for temporary service in another unit of the police force or in another locality. In Polish law this institution is regulated by Art. 36 (1), (2) and (3) of Ustawa o policji (the Police Act). Polish administrative law gives a definition of the nature of service in the country’s police force, and the characteristic feature of police duties it highlights is that the police officer must be fully committed to his/her job and on call for duty whenever required. One of the manifestations of this availability is the fact that he or she may be delegated to another station. This article discusses the legal character of this institution and the entities authorized to use it.

The increasing brutalisation of society results in Polish police officers becoming increasingly exposed to threats to their lives and health. In 2016, 311 assaults on police officers took place. A secure police officer equals a secure state and its citizens. This is why it is so important for Polish police forces to be in possession of proper means of physical coercion which ensure their safety while on duty. The Act on means of physical coercion and firearms of 5 June 2013 specifies the range of the means of physical coercion permissible for use by police officers. However, the most important of these are individual means with which a police officer is equipped. Research conducted among Polish police officers demonstrates which individual means of physical coercion available to them are used most frequently for the purpose of ensuring safety on duty. Undoubtedly, the key measure is the object designated by the said law to incapacitate people using electricity, colloquially referred to as an electric stun gun, a stunner or a taser. This measure of direct coercion, present in the equipment of the Polish Police since 2007, is gaining in importance, as evidenced by the conducted research and the data on the use of electric stunner by police officers.

The article contains the definition of stress and lists its types. The author presents stressors which are characteristic in the police profession. These are among others: participation in situations connected with death, apprehension of aggressive (attacking) person, contact with victims of violence, the obligation to inform family and relatives about the death of their loved ones, searching for missing persons, participation in court proceedings as a witness, providing protection of mass events and public events. In the article, there are presented statistical data concerning factors influencing stress prevalence among policemen. The issue of stress prevalence in the police profession was undertaken due to the gravity of police tasks connected with security of citizens. Many medical representatives and psychological it observed, that threat grows up in epidemic sizes with stress. This concerns also policeman’s profession.

The article is devoted to the subject of proceedings’ standards in disciplinary proceedings against the Police officers. The author discusses in details each of the standards in accordance to the provisions of the Police Act. Views presented in the article lead to the conclusion that current regulations of the Police Act on officers’ disciplinary proceedings realize values identified with described proceedings’ standards. The idea of the proceedings’ justice is realized by the Polish disciplinary proceedings against the Police officers.
W niniejszym artykule autorka przedstawia standardy proceduralne w postępowaniu dyscyplinarnym prowadzonym wobec funkcjonariuszy Policji, omawiając jednocześnie w sposób szczegółowy poszczególne standardy w kontekście regulacji zawartych w ustawie o Policji. Przedstawione rozważania prowadzą do konkluzji, iż przepisy o postępowaniu dyscyplinarnym wobec policjantów realizują utożsamiane z poszczególnymi standardami wartości, wypełniając przesłanki stosowania idei sprawiedliwości proceduralnej.

This paper focuses solely on issues related to the obligatory suspension of police officers from official duties. The relevant provisions are contained in Art. 39 (1) of the Act of 6 April 1990 on the Police. Suspension from official duties is obligatory when the stage of preparatory proceedings conducted against a police officer changes from in rem to ad personam. Such change automatically results in loss of impeccable opinion, which is a necessary condition for serving in the Police. Attention is focused on the objective to be achieved by the institution. The limits of the meaning of the phrase “initiation of proceedings against a police officer” were also indicated as a prerequisite for the application of the legal construction of Art. 39 (1) of the Police Act.

The article is divided into two main parts. It refers to selected data on hate crimes recorded in Poland and Police effectiveness while preventing, investigating and combatting it. Based on available sources, there is no problem with extremist activity on a large-scale in Poland nowadays, but for sure there is an urgent one with the increasing number of hate-motivated incidents, both with their social impact. Awareness-raising and educational campaigns that aim at prompting respect for human rights and tolerance for diversity are very needed in this matter. Also, law enforcement agencies, including the police, play a key role while tackling racism and bias. Uncontrolled and unpunished manifestation of hate, both with the lack of appropriate and unequivocal state response to such incidents, also quiet, social approval to hate-motivated behaviours, seem to be the main components of extreme movements growing. Thus, the main aim of the article has been to describe the phenomenon of hatemotivated incidents that were reported in Poland within past years and to diagnose Polish police officers’ skills, knowledge and qualification in this field, together with qualitative analyses of accessible training programmes. Selected terms (racism, discrimination, intolerance, xenophobia and hate speech) and symbols (the Celtic Cross, the SS-Totenkopf and the Triskele) that promote hate were defined (part 1) both with police officers’ identification accuracy. Research results presented in this article were gathered by using variety of methods and techniques, both theoretical and empirical (part 2). The data that refers to police competence in the context of preventing, investigating and combatting hate crimes was mainly collected as a part of a doctoral research conducted by the author in 2012–2014.

The article describes the system of police education in the Czech Republic on the basis of the mandatory obligations that regulate it. Most importantly, it is act No. 361/2003 Coll. on Service Relationship of Members of the Security Corps, whose section 45 contains the obligation of the Security Corps’ members to educate themselves. Having described the specificity of the Czech Police in the light of the abovementioned regulations, and having depicted the educational system that prepares Czech policemen to their service, the authors follow on to the assessment of the current state of police education in Czech Republic backed up by statistic data. Finally, fact-based scenarios are presented on how the contemporary Czech police education system may be improved in the future.
