The article deals with the issue of using on a non–contract basis properties from the Agricultural Resources of the State Treasury managed by Agricultural Property Agency. Above–mentioned problem is regulated in the art. 39b of the act on management of agricultural property owned by State Treasury. General provisions regarding to the problem of payment for using thing without contractual basis is governed by Civil Code, but the legislator introduced that special provision referring to the legal consequences of possessing state–owned properties. Author states that the result of the literal interpretation of art. 39b leads to unjust results and violates axiological values associated with this regulation. There are no axiological justification to assume that the possessor acting in good faith should be treated in the same way as possessor acting in bad faith. Only the result of functional interpretation is acceptable, because it leads to conclusion that possessor acting in good faith is not obliged to pay for using property without contractual basis.

Opis:
The purpose of the paper is to present functions of the integrated computer system of MST within the scope of exercising the owner’s supervision. In achieving the objective there has been used the method of analysis of literature on the exercising the owner’s supervision in the business entities with the share of the State Treasury (ST) and the method of analysis of the documents of MST and the Supreme Audit Office. The first part of the paper presents the essence of owner’s supervision system over companies with the share of the State Treasury. It is also characterized as Integrated Computer System (ICS) which was purchased in 1999 and implemented in MST. The next part indicates the features and capabilities of the subsystem modules „Monitoring of the Owner’s Transformations and Supervision over the Property of ST”. Moreover, the module ”Generator of Quarterly Questionnaires” is evaluated based on own studies paying special attention to supporting the internal mechanism of the owner’s supervision.

One of the main directions of activities conducted by the Agricultural Property Agency is to support agricultural farms. The most significant manifestation of such activities, aimed at supporting this objective, is the sale of land from the Agricultural Property Stock of the State Treasury to individual farmers who wish to enlarge their family farms, under a restricted tender procedure. Although the Act on the Management of the Agricultural Property Stock of the State Treasury also provides for other categories of entities – i.e. other potential participants of such restricted tenders, the procedures aimed at individual farmers are of the greatest importance in the Agency’s activities in this field. However, it should be noted that the statutory regulation concerning tenders for the sale of land with a view to supporting family farms is not complete and does not provide for any legal instruments designed not only to ensure that the land will be acquired by persons with adequate qualifications, but also that such land will be used by the purchaser for the conduct of agricultural activity. Therefore, the Agency introduces appropriate clauses into agreements with such purchasers in order to ensure that agricultural activity is conducted on the land acquired by them. However, the acceptability of such clauses may raise reasonable doubts.

Opis:
The main tasks of the Agricultural Property Agency have been changed during the last eighteen years. These tasks are defined in art. 6 of the act on management of agricultural property of the State Treasury. The most important changes in this respect were made in 2003 as a result of regulations introduced by the act on formation of agrarian system. In particular the Agricultural Property Agency is obliged to carrying out of the privatization and restructuring of the agricultural properties owned by the State as well as to support improvement of family farms structure. The Agricultural Property Agency, carrying out its tasks, sales and leases the state property by using the tender procedures. To improve family farms structure, the Agency was granted with a statutory pre–emption right as well as with a right of acquisition of agricultural property. However, the final results of its activity are not satisfactory, as in the Agricultural Resources of the State Treasury still remains 2,6 million hectares of land.

Opis:
The modern concept of the state dates its roots to the beginning of the Renaissance. Created at that time, the concept of ‘the national interest’ realized the existence of a sphere of rights and interests of a particular country, which must be protected in a particular way. To this end, national bodies responsible for protecting the rights and interests of the state were established. Despite the different conception of the state, the origins of institutions dealing with the legal protection of interests and rights of the state can be found in the Roman institution advocates fisci. Even then, numerous provisions governing the organization and functioning of the institution arose. In Poland the institution which deals with this king of protection is the State Treasury Solicitors’ Office. The object of this elaboration is to identify similarities and differences between those two institutions.

NIK has carried out an audit at the Ministry of Sport and Tourism entitled Protection of the State Treasury’s interest by the Minister of Sport and Tourism in contracts concluded by the National Sport Centre company. In the audited period, the National Sport Centre (NCS) concluded six contracts on behalf of and to the benefit of the State Treasury, related to football matches on the National Stadium. NIK has assessed three contracts for the organisation of those matches, in which the State Treasury is obliged to pay high contractual fines. In his article, the author presents the detailed findings of the audit.

Celem badań była identyfikacja czynników warunkujących trwałość dzierżawy jako formy zagospodarowania nieruchomościami rolnych Skarbu Państwa. W analizie i ocenie wykorzystano wyniki badań ankietowych przeprowadzonych wśród 192 dzierżawców i nabywców gruntów rolnych z Zasobu Własności Rolnej Skarbu Państwa w województwie warmińsko-mazurskim. Wyniki badań wskazują, że dzierżawę powinno uznać się za trwałą formę zagospodarowania nieruchomośc rolnych. Jest to konieczne dla zapewnienia stabilności i pewności jej utrzymania w długim czasie i znacząco wpływa m.in. na zakres podejmowanych decyzji inwestycyjnych. Dotychczasowe doświadczenia respondentów związane z dzierżawą gruntów skłoniły ich do wykupu, bądź podjęcia decyzji o nabyciu w perspektywie kilku lat. Zamierzenia odnośnie wykupu dzierżawionych gruntów chcą zrealizować w okresie kilku lat ze względu na ograniczone możliwości finansowe wynikające m.in. z niskiej opłacalności produkcji rolnej oraz wysokiego poziomu cen gruntów. Podkreślają jednak, że ze społeczno-ekonomicznego punktu widzenia własność państwowa w rolnictwie powinna zostać zachowana, a dzierżawa nieruchomości rolnych stać się stałą formą ich zagospodarowania.
The purpose of research was to identify factors determining the permanence of lease as a form of The State Treasury’s agricultural properties’ management. The analysis and the assessment were based on results of a survey held among 192 tenants and buyers of agricultural lands of the Agricultural Property Agency of the State Treasury in the Warmia-Masuria Voivodeship. The results of the research show that the lease should be considered as a permanent form of property management. This is essential for ensuring stability and endurance of maintaining the lease in a long-term and significantly influences the range of investment decisions for instance. The previous experiences of the respondents related to a lease led them to the buy-out or to the decisions of acquiring the property in a perspective of few years. As a result of limited financial abilities (caused among others by low profitability of farm production and high level of land prices) they are planning of purchasing the land in several years’ time. Although, they emphasized that, from the socio-economic point of view, agricultural land proprietary should belong to the country, and lease should become a form of their permanent management.

Polityka dywidendy jest deklaracją zarządu spółki, która obejmuje ogólne założenia co do sposobu podziału wypracowanego zysku w przedsiębiorstwie. Jasno i precyzyjnie określona polityka dywidendy stanowi ważne źródło informacji w zakresie budowania oczekiwań względem spółki przez inwestorów. Zasadniczym celem artykułu jest analiza i ocena realizowanych polityk wypłat dywidend przez przedsiębiorstwa z udziałem Skarbu Państwa notowanych na Giełdzie Papierów Wartościowych w Warszawie. Analiza przeprowadzonych badań wskazuje na to, iż spółki z udziałem Skarbu Państwa posiadały zdefiniowane polityki wypłat dywidend, które znajdowały swój wyraz w regularnych i stabilnych wypłatach dywidend.
The dividend policy is a declaration of the company’s management board, which comprises general assumptions as to the manner of distribution of the retained earnings at an enterprise. The clearly and precisely defined dividend policy is an important source of information as regards expectations towards the company by its investors. The essential aim of the article is to analyse and assess the implemented policies of dividend pay-off by enterprises with the State Treasury’s share listed on the Warsaw Stock Exchange. The analysis of the carried out research points out that companies with the State Treasury’s share had defined policies of dividend payment that were expressed in regular and stable payments of dividends.

The European integration raises hopes for the future of united Europe, but it does not solve all the current problems of individual Member States. One of them is to protect the rights and interests of the State Treasury of individual European Union’s countries. Therefore, each country has its own system of protection of these interests also towards the European Union’s countries. This situation is far from the perspective of unification of the European Union’s interests. In Poland, the State Treasury Solicitors’ Office deals with the legal protection of the rights and interests of the State Treasury.
Integracja europejska rodzi nadzieje na przyszłą zjednoczoną Europę, ale też nie rozwiązuje wszystkich bieżących problemów poszczególnych państw członkowskich. Jednym z nich jest ochrona praw i interesów Skarbu Państwa poszczególnych państw unijnych. Stąd też każde państwo posiada własny system ochrony tych interesów również wobec państw unijnych. Ta sytuacja jest daleka od perspektywy ujednolicenia interesów unijnych. W Polsce prawną ochroną praw i interesów Skarbu Państwa zajmuje się Prokuratoria Generalna Skarbu Państwa (PGSP).
