The protection of immovable monuments requires a proper spatial planning policy. Of particular importance are communal acts of spatial planning, which ensure the protection of immovable monuments previously covered by various forms of protection and included in the communal register of monuments, but also independently create the protection regime. The aim of the article is to analyse to what extent such acts in the Polish spatial planning system constitute instruments of protection of immovable monuments and how they strengthen the system of monument protection. It discusses, among other things, conservation protection zones. The article also refers to the issue of determining the principles and conditions for the location of billboards and advertising devices, small architectural objects and fences, as well as numerous interpretational doubts related to this issue.

Due to the complexity of planning processes, as well as the desire to satisfy stakeholders and entities involved in spatial development and planning procedures, there is a clear need to create a platform for managing spatial development planning information. The aim of this paper is to present a project and pilot version of an urban platform (spatial planning geoportal), which is intended to be a solution used for the creation, analysis, and presentation of spatial data related to spatial planning. To implement the concept of the geoportal, one of the models used in systems and software engineering known as incremental execution was used, together with the language for documenting phases of an IT project – the Unified Modeling Language (UML). The concept includes a formal description of the geoportal functionalities using UML as well as the perspective of solution users and stakeholders. This paper also shows the functionality of the pilot version of the geoportal, which refers to spatial planning at the local level and local spatial development. The spatial planning geoportal presented in this paper adheres to the reform of spatial planning and is intended to help in conducting spatial policy, both at the local and central level. Establishment of the spatial planning geoportal may contribute to increasing the efficiency and quality of the spatial planning system in Poland, as well as other areas such as management of local government units, local and regional transport, and regional planning.

Community self–reliance, which is guaranteed in article 165 of the Polish Constitution of 2 April 1997, does not preclude judicial review in relation to the resolutions of the municipal council, which is made in relation to the determination of land use and ways of its development in the zoning plan. The possibility of such control gives the complaint, which must be filed under article 110 of the Act of the Local Government of 8 March 1990. This raises the question of whether any property owner may bring an action on a resolution of the municipal council, taken in connection with the fixing of land use. At issue is primarily a possibility effectively to challenge a resolution on the study of conditions and directions of spatial management. Besides, it was necessary to draw attention to the possibility of using an application as a tool for land owners that are not covered by the boundariesdrawnup and enacted local plans. Also pointed to the problem of complaints by the successors of property owners who have acquired ownership of the entry into force of the resolution of the municipal council.

The author of the petition in question calls for the initiation of legislative action aimed at enacting a statute repealing all resolutions of commune councils on commencing the preparation or amendment of a local spatial plan for a commune, adopted on the basis of the indicated statutes. In the opinion of the author of the paper, the petition is unjustified. Some of the problems identified by the petitioner have been resolved by an amendment to the Planning and Spatial Development Act. It was questioned whether complying with the demand included in the petition could contribute to solving the problem of oversupply of land for residential development.

The aim of this paper is to assess the functioning of spatial planning in Poland in the context of public management objectives. Drawing on the concepts of New Public Management, we use the category of stakeholders and public value generated for stakeholders. Two groups of stakeholders in spatial planning are distinguished, namely public (national and local government) entities, and private entities (including individuals and businesses). We describe the mechanisms of stakeholders’ influence on spatial planning and the effects of this influence on the development of space. We found that the actual spatial planning mechanisms in Poland are aberrational from the perspective of public management. The ubiquity of these aberrations (in diverse municipalities) allows us to rule out the most obvious types of causes, particularly the incompetence or corruption of local authorities or administrative apparatus. Therefore, it is postulated that the causes of the aberrations are structural and inherent to the legal system that impacts spatial planning both directly and indirectly. We propose solutions to improve the situation through the appropriate management of relations with stakeholders in processes implemented by a public entity. The article presents a model of such management. A change in the legal context – above all an amendment of the law regulating spatial planning procedures – provides an opportunity to balance the impact of various stakeholders on spatial planning arrangements.

Professor Walerian Pańko in his two works, „The right of property and its present functions” and „Ownership of land space in the planned economy” recognizes the concept of property and its protection as a key to planning. This belief is also divided today, when ownership and functions have been modified, but the principles of planning meet other tasks. The views of this eminent professor of law who has the visionary talent will provide a starting point for discussion about the contemporary importance of planning for rural areas and the impact of spatial planning through the lens of ownership completed their functions. The authors seek to answer the question of whether the views presented more than thirty years ago, in a different economic and legal systems, spatial planning are still applicable? The answer to this question may help to use the modern legislator of the solutions proposed by Walerian Pańko in the field of space. The authors show that the majority views of the Walerian Pańko are still topicality.

This paper presents results of our research on the process of building development intensification within the Niepołomicka Forest surroundings in 1978-2003, and spatial policies of communes in relation to those areas, as well as results of those policies. Our research demonstrated diversification in the types of spatial structure transformation processes occurring in various parts of the metropolitan area, a considerable influence of even small but ecologically susceptible areas on the natural spatial structure of development, as well as justifiability of determining natural functional areas for the coordination of spatial policy on a trans-local level, in particular within metropolitan areas subjected to strong investment pressures.

Planowanie przestrzenne w Polsce nie służy porządkowaniu działań podmiotów publicznych i prywatnych w przestrzeni. Rozstrzygnięcia podejmowane w aktach prawnych planowania przestrzennego, na które składają się akty planowania ogólnego i specjalistycznego, nie są związane z zasobami finansowymi sektora publicznego i prywatnego; nie gwarantują one, że zagospodarowanie terenu odbywać się będzie zgodnie z wymogami planu w określonym czasie. Proces planistyczny nie służy, wbrew głoszonym doktrynalnym deklaracjom, wyważaniu całości praw i obowiązków w korzystaniu z przestrzeni podmiotów prywatnych i publicznych.
Spatial planning in Poland does not help to organize the activities of private and public entities. Decisions made in general and special spatial planning acts are not associated with any financial resources of the public and private sector; they do not guarantee that the development of an area will be carried out in accordance with the planning's requirements in a specified time. The planning process, contrary to the proclaimed doctrinal declarations, is not balancing all the rights and obligations of the private and public entities in land use.

The game of space is an element of spatial development of each administrative unit. The spatial conflicts are the basis of this game caused by different goals of local actors. In Polish conditions there were many conflicts about the location of wind turbines in rural areas. The conditions were changed with the new act on investments relating to wind power plants. Provisions contained in the act include requirements for a distance of wind farms from residential areas.The article is an attempt to show areas where can be located wind turbines and some alternatives for provisions of the act. The aim of the article is to show difference between the location of wind turbines in the distance equal of ten times of height of wind turbine and the distance equal of six times of tower height of wind turbine. The article shows how the provisions of the act on investments relating to wind power plants can interact on different space users on the rural areas.

The general normative model of spatial planning is not adequate to the current needs of the organization of rural development. Expanded and procedurally unwieldy local spatial development plan serves well as an instrument of organizing urban development (within the administrative boundaries of cities). Used for rural development focuses on the use of the agricultural production space, notwithstanding the fact that rural areas are not only the areas of agricultural production but also a multifunctional areas, inhabited by people working outside agriculture. The doctrinal proposal is the postulate to consider the legitimacy of separation two categories of local spatial development plans: urban and rural.

This paper is concerned with spatial policy in Ireland. It adopts an historical lens to help explain why Ireland currently finds itself at the bottom of the European league table with regard to local governance. After categorising the Irish political and planning system as highly centralised, bureaucratic and linear, the paper uses a case study of the Moycullen village plan to show an alternate path towards place development in Ireland. This case study sets out to contrast the desire of a people to collaborate in the authorship of their place with the top down nature of spatial planning in Ireland. By making clear the methods and results of the project, this paper highlights the latent demand that exists in a community that is subject to national planning system that reduces their ability to affect change. Through the use of some innovative approaches, this project has sought to fire the geographic imaginary of a people with respect to their place.

The paper discusses the problems connected with effects of revitalization. The authors concentrate on the differences resulting from ways as well as used base to carry out process of revitalization. The aim of the paper is assessment of the revitalized place carried out without analysis based on historical function of that place. To this end the authors used one of Wroclaw district conducted the desk research and field research. The authors used the method of observation and case studies. As a result, it can be said that revitalization process should be carried out with maintaining the historical function and the needs of inhabitants of revitalized places. The authors also refer to another example of revitalization process and compare it in the context of used ways and effects. According to the conducted research it can be said that the process of revitalization result from both legal principles and form awareness of local authorities in the context of quality of live and inhabitant needs.
