Opis:
Reduction of ecological risks of shipping is a challenging task that requires methods of legislative and regulatory control, organizational measures, and technical and technological support. Furthermore, the matter concerns not only the reduction of possible risks but also the level of existing impact on the marine environment because of exhaust gas emissions by ships, discharge of waste and ballast water, as well as control of ecological consequences of accidents. The purpose of this study is to analyse possible sources of environmental impact during ship operation cycles, identify significant risks, review existing potentials to reduce the risk of ship accidents and their environmental consequences, and develop solutions to existing problems. This study offers results, which can serve as the initial basis for the formation of comprehensive measures on the reduction of environmental risks, and consequences of possible accidents for the environment caused by ships and international shipping.

Looking at the high flow of the shipping industry and many things related to the ship operations that have to be done every day, several ship owners have collaborated with Ship Management Company (SMC) to assist them in managing their ships' operations. SMC is required to be responsible for the daily operational management of the ship on behalf of the ship owner such as crewing, technical management, administration, and chartering. Seeing the importance of collaboration and the diversity of services provided by the SMC, it is necessary to evaluate each determinant factor by the ship owner for the selection of an SMC to assist the ship owner in choosing an SMC that suits their needs. It is also to improve the service prioritized by the owner to SMC. The purpose of this research is to identify the determinant factors of SMC selection from the owner’s perspective, evaluate the importance of each of these factors, and obtain different views between the owner and SMC in the selection of ship management. The Fuzzy Analytical Hierarchy Process (Fuzzy AHP) method is used for evaluating weight based on the opinions of the owners and SMC who are experts in their fields. Then, the different perspectives between the owner dan SMC were obtained from the processing result. The results show that owners placed their top priority on factors that they can get the most from SMC, such as human resource factors and services. Meanwhile, SMC placed its priority on cost and its services factors that described the things they must manage well and optimization provided to owners.

Recently, there has been a significant development of ecological propulsion systems, which is in line with the general trend of environmentally friendly “green shipping”. The main aim is to build a safe, low-energy passenger ship with a highly efficient, emission-free propulsion system. This can be achieved in a variety of ways. The article presents the main problems encountered by designers and constructors already at the stage of designing the unit. The research conducted made it possible to create a design with an effective shape of the hull, with the prospect of an energy-efficient and safe propulsion system with good manoeuvrability. The scope of the research included towing tank tests, recalculation of the results in full-scale objects and a prediction of the energy demand of the propulsion system. The results obtained were compared to indicate power supply variants depending on the hull shape.

Simultaneously with a decreasing sea ice cover in the Arctic region an increase in ship traffic is experienced in these waters, meaning a higher probability of accidents and incidents to occur. The capability to handle emergency situations for shipowners, operators and rescuers in a cold climate environment are heavily affected by the risks present in polar waters and depends on limited emergency response resources covering extremely large areas. In 2017, the International Code for Ships Operating in Polar Waters (The Polar Code) was adopted by the International Maritime Organization (IMO), applicable for the Arctic and Antarctic regions. The goals of the functionally based regulation are to provide for safe ship operations and the protection of the polar environment, by addressing risks present in polar waters and to ensure these are mitigated sufficiently. A qualitative pilot study, with individual expert interviews, has been conducted in order to examine the Polar Code's implications for safe ship operations in the Arctic region. The study concludes that the discussions raised in the aftermath of the Polar Code has led to an increase in focus and a strengthen consciousness about hazards and risks associated with polar water ship operations and additional measures required to mitigate these. Further, the implementation of the Polar Code is considered as a milestone by establishing an international regulation, mandatory for polar water ship design and for voyage planning. However, the study points out that the main principle of the Polar Code is risk-based, meaning the performance of safe ship operations are depending on those subjects to the regulation, to conduct thorough operational risk assessments covering all actual hazards, and to ensure that those are mitigated sufficiently. In this regard, authority presence is found crucial, to validate the adequacy and the dimensioning of the implemented measures. The purpose of the present paper is to present the most important aspects for competency-based education and training for both maritime and the Inland Waterways sector, to ensure that every student/trainee in the EU possesses the same competencies on operational level (OL) and management level (ML) after graduating from their study or training. To reach these goals, trainers need to be able to educate and train students in the competency based system, which serves two purposes: defining minimum key competencies needed for crew members on board maritime and IWT vessels throughout the EU or worldwide, and thereby improving safety of navigation at sea and on the European interconnected waterways, and an increased level of labour mobility for crew members educated with the competencies as laid down in STCW 2010 and the new European directive.

This paper addresses the importance of the development of maritime safety culture, in terms of sustainable shipping through continuous improvement of the safety management system (SMS) that enables a shipping company’s personnel to effectively implement the company’s safety and environmental policy. The main aim of the International Management Code for the Safe Operation of Ships and for Pollution Prevention (International Safety Management Code – ISM Code), which was adopted by the International Maritime Organization (IMO) and became mandatory, by virtue of its entry into force on the 1st of July 1998, in SOLAS Chapter IX on the Management for Safe Operation of Ships, is to provide an international standard for the safe management and operation of ships as well as pollution prevention. Thus, compliance with the ISM Code and its effective enforcement is necessary to ensure adequate standards of safety and pollution prevention. The purpose of this paper is to show that the internationally unified legal measures that have been developed under the IMO in the ISM Code are an instrumental consequence of maritime safety values, and allow them to be achieved in practice. The result of this research is the justification of the thesis concerning the need to create a safety culture as a condition for sustainable shipping, including the safe operation of ships in the environment.

Inland ports in Europe, having undergone transformation for several decades, have become multifunctional economic spaces. Currently, these are not only transport nodes in land-water traditional transport chains but today also supply the locations of intermodal terminals, distribution centers, service and production companies, or technology parks. Multifunctional inland ports also form part of the economic systems of cities and regions, contributing to their development. The aim of this article is to present the best practices in managing inland ports in Europe. In the article, using the results of research on inland waterway transport, it is pointed out what practices in managing inland ports have led, in many cases, to their increased importance in both multi-branch transport systems and the economic development of cities and regions. The study used literature on the subject, specific information on selected European inland ports, and development strategies for selected regions in Europe, including inland waterway transport. On the basis of the above, best practices leading to the long-term development of inland ports and maximizing the added value arising in their areas were determined.

In recent years, there has been a significant development in “green” and energy efficient propulsion systems, which fits into the general trend of environmentally friendly “green shipping”. The pursued goal is to construct a safe passenger ship that is low in energy demand and equipped with a highly energy efficient, emission-free propulsion system. The paper presents main problems encountered by designers of a small, hybrid-powered ferry powered lithium batteries. The conducted research allowed to create a design of an energy efficient hull shape, which decreases the demand for energy. Completed remote control model tests resulted in a proposal of an energy efficient and safe propulsion system with good manoeuvring capabilities. Measurements completed on an existing ferry permitted completing energy balance and forming an energy management policy. The paper contains the emission calculations computed for the existing ferry that are necessary for the environmental impact analysis. The soon to be constructed, newly designed vessel will provide a valuable contribution to hybrid-propulsion, energy management and unmanned technologies research.

The need to prioritize activities aimed at increasing the use of inland waterway transport to support seaports and their staging is of primary importance for ports that have natural conditions (direct access to inland routes), but do not meet the basic requirements for their development (access to high-quality inland waterway connections). Due to the cost- and time-consuming nature of many of the recommended activities, it is crucial to properly plan internal and external measures by placing them on a timeline and assigning responsibility for their implementation to various stakeholders, including port authorities and waterway managers. Revitalizing the linear waterway infrastructure of these ports will be of paramount importance.

Techniczne i operacyjne środki efektywności energetycznej dla statków morskich takie, jak projektowy wskaźnik efektywności energetycznej (EEDI) oraz plan zarządzania efektywności energetyczną statku (SEEMP), mają na celu poprawę efektywności energetycznej międzynarodowej żeglugi morskiej. Badania pokazują, że bezwzględny poziom emisji z międzynarodowej żeglugi morskiej wzrośnie pomimo ich obowiązkowego stosowania. Z tego względu istotna jest ocena wpływu w zakresie skuteczności stosowania obowiązkowych środków efektywności na przyszłe emisje. W Międzynarodowej Organizacji Morskiej opracowywane są kolejne środki w celu kontroli emisji ze statków, w tym w szczególności gazów cieplarnianych (GHG), przyczyniających się do zmian klimatu. W styczniu 2019 r. wprowadzono system gromadzenia danych o zużyciu paliwa przez statki (Ship Fuel Oil Consumption Database). Środki efektywności energetycznej wypracowane przez Komitet Ochrony Środowiska Morskiego IMO, początkowo jako fakultatywne, następnie jako obowiązkowe, wykazują silny charakter prewencyjny. Obligatoryjne stosowanie środków efektywności energetycznej przez statki morskie, jak i rozwój polityki zarządzania efektywnością energetyczną przez przedsiębiorstwa żeglugowe, przyczynia się do ochrony klimatu oraz adaptacji do zmian klimatu.
Technical and operational energy efficiency measures for ships, such as the energy efficiency design index (EEDI) and ship energy efficiency management plan (SEEMP), aim to improve the energy efficiency of international shipping. Studies show that absolute emissions from international shipping will increase despite their mandatory application. For this reason, it is important to assess the impact on the effectiveness of the application of mandatory efficiency measures on future emissions. Further measures are being developed at the International Maritime Organization to control emissions from ships, in particular greenhouse gases (GHG) that contribute to climate change. In January 2019, a system of collecting fuel consumption data by ships (Ship Fuel Oil Consumption Database) was introduced.Energy efficiency measures promoted by the IMO Maritime Environment Protection Committee, initially as facultative, then as mandatory, show strong preventive character. The mandatory use of energy efficiency measures by ships as well as the development of energy efficiency management policies by shipping companies contributes to climate protection and adaptation to climate change

Na podstawie zgromadzonych danych wygenerowano model procesu oraz przeprowadzono ocenę jego funkcjonowania. Szczególną uwagę w artykule zwrócono na problematykę postaci danych wejściowych dla omawianego przykładu.

With the development of tourism in the inland waters, various types of accidents in the waters have posed a great threat to human life, property, and the environment. This has caused concern in all circles of society. According to water tourism safety issues, and relying on Internet technology, shipping safety, and public safety management theory, this paper has proposed the concept and design plan of an Internet + maritime emergency management platform. This platform includes functions such as the intelligent perception of a ship’s navigation status, the scientific selection of a maritime emergency rescue site, the emergency rescue scene, the online dynamic management of maritime emergency resources, and the online production of a maritime emergency rescue plan. The design scheme has been used in the platform’s development. This paper has taken the application of the Internet + maritime emergency management platform for the Liujiaxia reservoir in the Gansu Province of China as an example. The results showed that the design of the platform that has been proposed in this paper is reasonable and that it can provide scientific, fast and accurate decision information for emergency command in the Liujiaxia reservoir and improve the effective control of the accident site as well as the use of resources.

W artykule autorzy przeprowadzili badania procesu transportowego na obiekcie rzeczywistym. Badaniom poddali trasę Jasło-Berlin-Szczecin-Jasło implementując system monitoringu, w celu usprawnienia procesu przewozowego. W wyniku analizy przedstawiono praktyczne aspekty planowania, organizowania i koordynowania transportu.
The transport of cargo forces appropriate experience from the freight forwarder in planning and implementing the transport process, as the fundamental goal of managing the transport process is to constantly improve the efficiency and effectiveness of freight organization while ensuring the highest of customer service. In the article, the authors carried out research of a transport process on a real object. The Jasło-Berlin-Szczecin-Jasło route was subject to research by implementing a monitoring system for the purposes of freight improvement. The analysis presents practical aspects of planning, organizing and coordinating transport.

Opis:
Instytucja zarządzania statkami morskimi (ship management) nie jest zbyt dobrze znana ani polskiemu prawu, ani polskiej doktrynie prawa morskiego, pomimo tego że rola zarządzającego statkiem (ship manager) rosła sukcesywnie przez wiele lat. Jej początki przypadają na lata osiemdziesiąte poprzedniego stulecia, w okresie poważnych zmian na rynku żeglugowym, gdy dochodziło do wielu bankructw przedsiębiorstw armatorskich i gdy banki hipoteczne musiały zwracać się do fachowych podmiotów zarządzających statkami o pomoc w prowadzeniu działalności żeglugowej.Trzydzieści lat temu, w 1988 r. BIMCO opublikowała pierwszy wzorzec umowy o zarządzanie statkiem o nazwie SHIPMAN, który zapewnił pewną równowagę pomiędzy prawami i obowiązkami armatora i zarządzającego statkiem oraz jednolitość w szeroko stosowanych na rynku żeglugowym umowach tego rodzaju, szczególnie w podziale odpowiedzialności pomiędzy stronami. Po wejściu w życie w 1998 r. Kodeksu ISM, który wprowadził do prawa międzynarodowego instytucję Company jako podmiot odpowiedzialny za bezpieczną eksploatację statku, rola zarządzającego wzrosła niepomiernie. Było to między innymi przyczyną tego, że BIMCO przygotowała nowy formularz umowy o nazwie SHIPMAN 98. Po kolejnych kilku latach formularz został uaktualniony i jego nowa wersja została wydana w 2009 r.Głównym celem artykułu jest przybliżenie czytelnikowi zagadnień związanych z zarządzaniem statkiem morskim i podmiotem nim zarządzającym (ship manager), przez omówienie i przetłumaczenie na język polski opracowanego przez BIMCO nowego wzorca umowy o zarządzanie statkiem o nazwie SHIPMAN 2009
The concept of a Ship Management is vaguely known in the Polish law and legal doctrine although the role of the Ship Manager has become quite complex through the years. It started in the eighties when there was a deep change in the shipping market as many shipping companies became bankrupt and mortgagor banks had to turn to ship managers for help.Thirty years ago in 1988 BIMCO published the first Ship Management Contract which provided the market with a standard document striking a fair balance between the rights and obligations of the owners and the managers, giving some uniformity in the widely used in house contracts, particularly in the apportionment of liability between parties. After the implementation of the ISM Code in 1998 and creating the entity called “Company” as a subject responsible for a safe operation of a vessel the ship manager’s role rose extremely. It caused, among other factors, that BIMCO issued the world wide known form of contract named SHIPMAN 98, which was then superseded by its new version issued in 2009. The main goal of this article is to bring a reader closer to the issue of a Ship Management and the Ship Manager through a Polish translation of this modern BIMCO form named SHIPMAN 2009
