The reviewer gets involved in a polemic with the authors of "The Economic and Professional Self-Government in the Political System of Poland" by Robert Kmieciak, Paweł Antkowiak, and Katarzyna Walkowiak. In the postmodern era, Europe, including Poland, is strikingly characterised by the migration of citizens, caused among others by the process of European integration or globalisation, enhanced by the fact that territorial, transport and language barriers cease to exist. There are two types of migration: external (among countries) and internal (among regions or municipal units). The process mentioned, apart from all its positive aspects, may simultaneously lead to a weakening or even loss of local identity as well as social bonds on the local level. These two elements, however, are absolutely vital for the proper functioning of a local self-government community. The process of erosion of social bonds is also influenced by a consumerist and hedonist lifestyle. Therefore, a question arises about the future shape of the self-governmental community, which consists of all the inhabitants of a principal unit of administrative division of a country. Such a community with its territory constitutes the local self-government, which not only takes part in exercising public authority, but also as a result of the process of decentralising public authority, accomplishes an essential part of its objectives. Thus, the first element of the presentation will be introducing the political shape of the local self-government, set by the norms laid out in the constitution and the European Charter of Local Self-government, based on legal dogmatics and empirical method (analysis of the jurisdiction of the Constitutional Tribunal, the Supreme Court and the Supreme Administrative Court). Second, the presentation will attempt to verify the thesis concerning the level of threats for the future functioning of the institutions of the local self-government, caused by contemporary social, economic and cultural changes. A measurable factor verifying the thesis will consist in the analysis of the participation of the local communities in the direct way of exercising authority by the members of the self-governmental community, namely the attendance in local elections). A positive answer to the thesis formed may constitute a basis for de lege ferenda conclusions, concerning the shape of local self-government institutions in Poland.

The need for rationalization of expenditures, the desire for greater financial discipline and the search for savings as a part of economy of physical and financial resources determine the need of development and continuous improvement of mechanisms (instruments) aimed at enlarging the efficiency of self-government finances. Internal audit is an instrument that could enhance management of self-government entities in the rationalization of finances, as well as in protecting society against wasteful and inefficient spending of public funds. This article attempts to assess the internal audit as an instrument supporting the efficiency of self-government finances. According to the survey it is demonstrated that internal audit in its current statutory form and in the way it is realized by the majority of self-government entities is focused primarily on legality criteria, paying less attention to the economic criteria for evaluating local finances, ie. efficiency and thriftiness.

Public administration in Poland has taken the form of a system of entities with different tasks and objectives, as well as different competences. It is a part of the classical model based on the functioning of two separate components, such as the state administration, including the government and local self-government. From the perspective of a democratic state governed by the rule of law, the existence of local self-government is extremely important, and even becomes a necessity. Therefore, the deliberations addressed in the paper focus on the functioning of this form of public administration at the lowest level of basic division of the state, which is the commune. The presented research is an attempt to indicate the legal status and position of commune self-government not only in the broadly understood local self-government but also in the whole public administration system.

The reform of Polish self-government in the 90's has led to the restoration of local democracy. However, the self-governmental institutions soon fell into crisis, having nearly lost the social trust required for the realisation of their mission. The principal cause behind this phenomenon was the atrophy of moral, political and legal responsibility of the local authorities towards the communities that have elected them. There is a twofold source of weaknesses and dangers for Polish self-government: the erroneous way of introducing changes in the system of government, and the forthcoming sociopolitical phenomena that hampered or even made it impossible to achieve some of the goals of the reform. We support the radical revision of legal regulation to remove these weaknesses. The basis for such a change will be the principle of subsidiarity as a governing rule for the entire system of public authority. This will ensure that the communities of inhabitants are seen as primary subjects of self-governmental power, and their power is rooted in citizens' rights to self-government. It is also necessary to ensure a truly pluralistic character of territorial power. Thus the citizens and their associations will have an influence on the election and functioning of the selfgovernmental bodies. The Author warns against the risk of emergence of a class of local and regional 'mandarins' in Polish public life – a class of practically ineradicable and systematically deficient leadership, likely to emerge should the mechanisms of democratic responsibility fail to be restored into the governmental bodies. The article ends with suggestions of particular legal changes aiming at the correct formation of Polish self-governmental institutions in both morally and socially rightful sense.

The professional self-government, as a component of the decentralised public authority, is an institution which derives its legitimacy from the supreme legal act, the Constitution of Poland. Its basic framework is set out in Article 17(1) of the Constitution, according to which: “By means of a statute, self-governments may be created within a profession in which the public repose confidence, and such self-governments shall concern themselves with the proper practice of such professions in accordance with, and for the purpose of protecting, the public interest”. The ratio legis of this regulation is the possibility of statutory entrustment of certain professional corporations with the performance of public tasks in authoritative forms appropriate for public administration. This study presents of the functions and tasks that the legislator has provided for the professional self-government of judicial officers. Currently, the provision regulating the tasks performed by the judicial officers’ self-government is Article 195 of the Act of 22 March 2018 on judicial officers, according to which the tasks of the judicial officers’ self-government include in particular: 1) supporting the administrative supervisory bodies in supervising the conscientious performance of service by judicial officers and the proper performance of duties by assessors and trainees, 2) participating in ensuring the conditions for the performance of the statutory tasks of judicial officers, 3) representing judicial officers and assessors, 4) the professional development of judicial officers and assessors, and participation in the training of trainees, 5) establishing and promoting the principles of professional ethics and ensuring their observance, 6) conducting research into the functioning of judicial enforcement. The authors analyse the normative material regulating the issue in question. Looking through the prism of theoretical concepts of professional self-government, they also assess the legitimacy of the solutions adopted by the legislator. Consequently, they make de lege lata remarks and de lege ferenda postulates.

This article’s aim is to examine a dependency between local government administration at a municipal level and the level of local entrepreneurship. This paper attempts to answer the question of whether the size of the local government administration has features of stimulant or de-stimulant in the process of setting up a business. In other words, does the size of public administration at a local level (municipal level) have a positive or negative impact on creating new business entities? This is important due to at least a couple of reasons. First of all, the current research achievements are not extensive, when it comes to the publications that link entrepreneurship and the size of local government administration. Secondly, the problem of entrepreneurship determinants constitutes still topical and not fully investigated (or explained) aspects of local economy development. Thirdly and finally, the authors of this article have proposed and copyrighted an approach to the quantification of the size of local government administration, modifying commonly used measures of local public administration. Thus, this article fits not only into the explanation of the entrepreneurship phenomenon and its determinants, but also contributes to the development of knowledge about dependencies between the size of local self-government and the entrepreneurship level. It expands the knowledge resource on analyzed dependencies and re-orients current approaches to similar research.

The core of the local self-government stems from the Western (Latin) civilization values. European Nations have always fought for the qualities and perseverance of local self government. Currently it is considered an attribute of local democracy, although in the European tradition it has long been related to the pluralist values of social life organization. The communes; freedom, and their independence from the local government have been derived from natural law and seen as a condition for a healthy social system. Contemporarily, local self-government as a law and ability for local communities to manage a range of public matters independently, has been anew recognized as a social system value in uniting Europe. Yet there have also revived certain historical threats to the local selfgovernment arisen from central and local bureaucracy, particularism, and bribing local power elites. In such case, the fight for a local government that complies with Latin civilizational values acquires a special meaning.

Artykuł omawia kształtowanie się i realizację ideę samorządu terytorialnego na Pomorzu. W pierwszej części pracy autor starał się przedstawić dążenia środowisk regionalnych, w tym opozycji demokratycznej do przebudowy państwa w duchu samorządności lokalnej i regionalnej w okresie przed transformacją ustrojową na przełomie lat osiemdziesiątych i dziewięćdziesiątych XX wieku. W drugiej części przedstawiono problemy, jakie się ujawniły po wprowadzeniu samorządu gminnego w 1990 roku i próby ich rozwiązania we współpracy międzywojewódzkiej i projektowanej reformie regionalizacyjnej. Trzecia część opisuje województwo pomorskie, które powstało w związku z reformą samorządową 1998 roku i problemy związane z umacnianiem jego podmiotowości w systemie ustrojowym Rzeczypospolitej Polskiej. Artykuł podejmuje też kwestię przyszłego statusu samorządu regionalnego Pomorza.
In this article the author undertakes to answer the question on how the idea of territorial self-government in Poland as well as of Pomeranian Voivodeship evolved and how it has been implemented. In the fi rst part of the text the author presents the aspirations of various social circles in the region, including representatives of democratic opposition, for reconstructing the state so as to establish local and regional self-government. This part covers the period before the administrative reform, that is turn of 1980s and 1990s. The second part serves to identify the problems which arose after the territorial self-government was introduced in 1990. It also presents the attempts at solving them via interregional cooperation and further reforms. The third part presents Pomeranian Voivodeship established as the result of the self-government reform of 1998 as well as problems related to anchoring it in the administrative system of the Republic of Poland. The article concludes with a set of research questions on the future status of the regional self-government in Pomerania.

The study presents critical reflections on the course and results of Polish local self-government reforms from March 1990, when after 40 years of the system of territorial soviets (national councils), self-government was reintroduced into communes, until January 2018, when an attempt to improve the systemic institutions of self-government in communes, poviats and voivodships was once again revisited. The author points out significant discrepancies between the basic ethical and political values of local self-government, i.e. democracy, independence and efficiency, and the changing content of self-government systemic laws as well as the practice of local authorities’ operations, and formulates proposals aimed at repairing Polish local self-government by adjusting its organisation and functioning to the principles resulting from the Constitution of the Republic of Poland and the European Charter of Local Self-Government. He considers as the most important the elimination of pathological phenomena of simulated local democracy which include: a drastically low turnout in elections and referenda, the disappearance of democratic responsibility of local self-government bodies, and the autonomy of the directly elected executive body of the commune from the influence of the local representation. From this point of view, he positively assesses the new regulations, strengthening the guarantee of transparency of operations carried out by local self-government bodies and control rights of councillors, as well as expanding the catalogue of initiative, consultative and control powers of citizens. He points out, however, that ensuring real democracy in of the local authorities requires a deeper reconstruction of the principles of self-government, the election process, and strengthening the role of representation in creating and enforcing the responsibility of executive bodies.

The author notes that under applicable law the local self‑government unit may provide financial support for church projects involving the reconstruction of historic monuments, as laid down in the Act on the Protection of Cultural Property. However, it is not clear whether they can support the construction, extension, reconstruction of chapels aimed at creating conditions for the operation of special pastoral service in local medical establishments and nursing units. However, funding of other church projects out of the budgets of self‑government units, including the construction and development of churches, is not allowed. The author points out that in the event that during the public consultation in the local community residents have chosen to implement projects (tasks), which are not related to the tasks of the municipality, this does not bear a duty to recognize them in the draft budget or local self‑government or in the approved budget. If the local self‑government authorities have taken such a decision, the regional chamber of audit should declare it null and void, due to non‑compliance with the law.
