This article sets out to contribute to the on-going discussion regarding the relationship between competition law and sector-specific regulation, as well as the parallel application of competition law and regulatory instruments. Thus, this article attempts to provide a systematic outline of arguments which are conclusive for the proposition that sector-specific regulation must remain fully autonomous, while taking a critical stance with respect to the views of both the Supreme Court and academic lawyers who advocate the supremacy of competition law.
Le sujet du présent article est la relation entre le droit de la concurrence et le droit des secteurs regulés, ainsi que l’application parallele des institutions du droit de la concurrence et des instruments regulatoires. Le but de l’article est de presenter les arguments selon lesquelles les regulations des secteurs doivent rester autonomes. Il est important de polemiquer avec l’avis exprimé par la Cour Superierure polonaise et par certains juristes qui croivent le droit de la concurrence superieur aux autres regulations.

In the last few years the behavior of undertakings operating in the regulated utility markets, such as energy, water and communications, has been in the focus of the Bulgarian Competition Authority (hereinafter, BCA). Typically, these companies are dominant due to their exclusive licenses to operate in a certain territory and thus the contents of their contractual relationships with customers are often defined in general terms and conditions (hereinafter, GTCs) adopted or approved by the respective sector regulator. Most or all aspects of their pricing policy is also subject to sector regulation. By analysing critically two landmark decisions of the BCA concerning abuses of companies active in the energy markets, this paper raises the following questions: (1) to what extent the BCA is competent to intervene and sanction those undertakings for conduct which is subject of regulatory control by the sector regulator (the Energy and Water Regulation Commission (hereinafter, EWRC)) and (2) whether in its enforcement practice against those undertakings, the BCA is following the legal standards adopted by the EU courts.

Opis:
Private enforcement in Lithuania is still at the early development stage, as only a few infringement decisions of the national competition authority – the Competition Council of the Republic of Lithuania – have been followed on by private antitrust claims. Nevertheless, it might be observed that victims of competition law infringements tend to initiate standalone claims for compensation of damages in Lithuania. However, not all of those cases are successful. On 3 March 2017, the Court of Appeal of Lithuania rejected a damages claim for EUR 2.9 million brought by a company that claimed to have been refused infrastructure access (an essential facility) by the dominant state-owned telecommunication company; infrastructure access was necessary for the provision of its own services. The case is interesting and worth mentioning due to the complexity and interrelation of competition law and the regulation of electronic communications (such as the interrelation of dominance in competition law and significant market power under the regulatory framework). The case is also noteworthy becaouse of the lack of involvement by the Competition Council and the Communication Regulatory Authority as well as their position in the dispute. Of relevance is also a change made to the laws related to the dispute and further consequences of the dispute.

This paper will be devoted to the most acute point of intersection between sector specific regulation and the enforcement of competition law – a parallel scrutiny of the market position and behaviour of EMITEL TP, an incumbent infrastructure holder in the Polish broadcasting transmission field, by the national telecoms regulator and the antitrust authority. After presenting the relevant EU background, the discussion will focus on four basic factors that have influenced the relationship between antitrust and regulation in this case. The peculiarities of national legislation transposing the EU liberalisation package will be considered first, followed by the state of competition in Polish telecoms and the potential existence of prohibited market practices. Emphasis will be placed here on the use of the antitrust concept of relevant market definition in the framework of sector-specific regulation. The analysis will continue with an assessment of the differences between the two types of market intervention noted by the authorities in the context of a potential competence dispute. In conclusion, the need will be presented to shift the current focus placed on the separation of antitrust enforcement and regulation, which has made them both ineffective in achieving their purpose, towards that of their combination in order to facilitate the emergence of competition in the Polish broadcasting transmission services field.
L’article concerne le point le plus aigu d’intersection entre la réglementation sectorielle et le renforcement de la loi de concurrence – le contrôle parallèle de la position sur le marche et le comportement de EMITEL TP, le propriétaire d’infrastructure dans le domaine de la radiodiffusion en Pologne, par le régulateur national des télécommunications et l’autorité chargée de la politique de concurrence. Après avoir présenté le contexte de l’UE, la discussion se concentrera sur quatre facteurs clés qui ont influencé les relations entre les politiques de concurrence et la réglementation sectorielle dans ce cas-là. Les particularités de la législation nationale transposant le train de mesures de libéralisation de l’EU seront considérées d’abord, suivies par l’état de concurrence dans les télécommunications en Pologne et l’existence potentielle des pratiques du marche interdites. L’emphase sera mise ici sur l’usage de la définition du marché en cause aux fins du droit de la concurrence, dans le cadre de la réglementation sectorielle. Dans la partie suivante, l’analyse sera centrée sur l’évaluation de la différence entre les deux types d’intervention sur le marche notés par les autorités dans le contexte d’ un conflit possible en matière de compétence. Dans la conclusion, le besoin de tourner l’attention mise actuellement sur la séparation du renforcement de la loi de concurrence et la réglementation sectorielle, qui les avait faits inefficaces en atteignant leurs objectifs, vers la combinaison de les deux, afin de faciliter l’émergence de la concurrence dans le domaine des services de radiodiffusion.

This essay raises a number of theses in support for a more liberalised approach to EU Net Neutrality rules. It offers a graded system of levels of regulatory intervention, arguing that soft Net Neutrality rules are capable of meeting all positive objectives of regulation without causing the problems generated by Hard Net Neutrality rules, such as those currently in place in the EU. Hard Net Neutrality rules prevent Internet Service Providers (ISPs) from making disruptive innovations. Meanwhile, they enable some Content and Application Providers (CAPs) to monopolise many markets via (disruptive) innovations, resulting in newly established dominant positions which have, in many instances, been abused. The hypothesis of the essay is that loosening the rules on Net Neutrality would create competition between ISPs and CAPs as well as (which is even more important) between different CAPs for limited premium speed traffic. Such newly established competition could remedy some antitrust conundrums faced by EU competition enforcers and sectorial regulators vis-à-vis disruptive innovators in the area of electronic communications.
Cet article soulève un certain nombre de thèses en faveur d’une approche plus libéralisée aux règles de l’UE concernant la neutralité du Net. Il offre un système progressif de niveaux d’intervention réglementaire, affirmant que des règles non contraignantes de la neutralité du Net sont en mesure de répondre à tous les objectifs positifs de la réglementation sans causer les problèmes engendrés par les règles contraignantes, telles que celles actuellement en vigueur dans l’UE. Les règles contraignantes de la neutralité du Net empêchent les fournisseurs de services Internet de développer des innovations perturbatrices. Dans le même temps, ils permettent à certains fournisseurs de contenus et d’applications de monopoliser nombreux marchés via des innovations (perturbatrices), donnant ainsi lieu à des nouvelles positions dominantes, qui ont souvent fait l’objet d’abus. L’hypothèse de l’article est que desserrant les règles sur la neutralité du Net créerait la concurrence entre les fournisseurs de services Internet et les fournisseurs des contenus et d’applications, ainsi que (ce qui est encore plus important) entre les différents fournisseurs des contenus et d’applications pour le trafic de vitesse limitée premium. Cette concurrence nouvellement établie pourrait remédier à certains problèmes de concurrence soulevés par les autorités de la concurrence de l’UE et les régulateurs sectoriels vis-à-vis des innovateurs perturbateurs dans le domaine des communications électroniques
