In this paper, parametric rolling is divided into 5 heavy grades, establishing a classification for parametric rolling. This is achieved by a multi-parameter application in the simulations. For this purpose, parametric rolling, established criteria and the state of the art are considered and the results are summarized. Based on this, parametric rolling is successfully simulated using discrete simulation in MARIN [1]. Five heavy grades are introduced so different classes of parametric rolling can be distinguished. Furthermore, dependencies and probabilities for the occurrence of parametric roles in relation to the see are determined numerically. This will later be used in an assistance system on board ships to compute the prediction of parametric roll using an AI.

In the deepwater exploitation of oil and gas, replacing the polyester rope by a wire in the chain-wire-chain mooring line is proved to be fairly economic, but this may provoke some corresponding problems. The aim of this paper is to compare the fatigue damage of two mooring system types, taking into account corrosion effects. Using a semisubmersible platform as the research object, two types of mooring systems of the similar static restoring stiffness were employed. The mooring lines had the chain-wire-chain and chain-polyester-chain structure, respectively. Firstly, the numerical simulation model between the semi-submersible platform and its mooring system was built. The time series of mooring line tension generated by each short-term sea state of South China Sea S4 area were calculated. Secondly, the rain flow counting method was employed to obtain the fatigue load spectrum. Thirdly, the Miner linear cumulative law model was used to compare the fatigue damage of the two mooring system types in long-term sea state. Finally, the corrosion effects from zero to twenty years were considered, and the comparison between the fatigue damage of the two mooring system types was recalculated.

Opis:
The immunity of a state aircraft is an interesting research area, but rarely addressed in international law or discussed in the doctrine of international law. Little interest in this regard is surprising if we compare it with the relatively broadly discussed issue of immunity of state vessels. The result of the research process presented in the article is the thesis that an aircraft owned or operated by a State for non-commercial purposes is entitled to immunity under certain multilateral conventions. Interestingly, crucial in this respect are treatises related to the law of the sea, rather than air law. It is also justifiable to claim that the discussed immunity arises from general international law.
Immunitet państwowego statku powietrznego stanowi interesujące zagadnienie badawcze, które jak dotąd nie zostało w sposób wyraźny uregulowane w prawie międzynarodowym i stosunkowo rzadko jest omawiane w doktrynie prawa międzynarodowego. Niewielkie zainteresowanie immunitetem państwowego statku powietrznego budzi pewne zaskoczenie, jeżeli porównamy je ze stosunkowo dużym znaczeniem, jakie przypisuje się immunitetowi państwowych statków morskich.

The creation of the European Union in 1992 reflected an attempt to rethink some of basic modern political concepts as national sovereignty and citizenship. But in recent years the European spatial development policy discourse has taken an evident territorial character with the enforcement of the idea of territorial cohesion and territorial continuity. The spatial predominant EU’s conception contributes to an evident emergence of a modern territorial building of the European space. Moreover, nowadays the instrument of hard and closed border and the sharp inside/outside dichotomy are accepted as the normality in Europe. Due to this notion of territoriality, the idea of the EU as a “non-Westphalian new empire” (according to the “neo-medieval paradigm”) is at least unrealistic. Its borders are getting more territorial, physical and visible, in deep contrast with an imperial historical structure. Hard border policies and practices on the borders mirror the existence of a de facto barrier and of a deep “Westphalian memory” in the way to use the territory as support of political unity. The EU’s drive to re-territorialise Europe is not a mere academic question; it has real consequences for people and places. Supra-nationalism reveals itself as a metaphor of “re-territorialization”, a paradox with strong political and economic consequences. In the macro-regional dimension of the Adriatic Sea region the EU’s “re-territorialisation” can impede seriously the cooperation across the EU’s external borders.

American and Chinese interests seem to be at one time in agreement and at another at loggerheads over issues that involve armed services, diplomacy, economics, human rights, intelligence, trade and culture. Part of what may appear to be a growing déracinement, or mutual disenchantment, arising from diverse viewpoints over infrastructure development globally but especially in sensitive developing areas such as the stand-off in the South China Sea and elsewhere along the Pacific coastline of Southeast Asia, and the Western Pacific Rim. China seems to be reconstructing its ancient feudal empire, actual or imaginary, in the territory to its South, the ASEAN bloc. This article will address some issues of compatibility and conflict that unite China but that sometimes divide it from the United States and the West, then assesses what alternative strategies should be adopted or abandoned in the interests of global and regional harmony coupled with security. It urges greater cooperation and collaboration, a development of a code of conduct for state behavior in the Indo-Asia-Pacific region, together with a concerted East–West effort to maintain a stable economy for China and a sustainable trade relationship between China, Europe, and North America.

The article presents possible application of the theory of semi-Markov processes in creating the eight-state model of the process of appearance of the propulsion systems ability and inability states on sea-going vessels performing transportation tasks in a relatively long operating time t (t → ∞). The model has been proved to be able to be successfully used for determining the reliability of the abovementioned systems. The probability of faultless operation in time t was assumed the measure of system reliability. Operating situations of sea-going vessels were characterised, with special attention being paid to the fact that the loads of propulsion system components of these vessels are of random nature. These loads lead to damages which for this reason were also considered random events. It was also assumed that the damages provoke the appearance of states of inability of particular ship propulsion system components which means that these states are random events as well. The states of ability of a given ship propulsion system have been assumed to exist when all components of this system are in the state of ability. In case when at least one component is in the state of inability, the entire system is in the state of inability. Conditions were formulated for the reliability model of an arbitrary system to be able to be worked out in the form of the semi-Markov process. The need for the use of technical diagnostics in reliability examination of sea-going ship propulsion systems was indicated. In conclusions, certain qualities of the article were highlighted which are, in author’s opinion, of highest importance in reliability examination of sea-going ship propulsion systems.

The 21st century rivalry of the maritime powers took the form of substitute activities. These are military incidents, control, or seizure of a shipping entity, and activities that threaten shipping itself. This determines the state of maritime security of Poland, because the Baltic has become one of the areas of its conduct. The adopted form of importing energy carriers along with the forming an alliance with the US construction of the alliance with the USA creates the possibility of taking hostile actions against it. It is necessary to adapt the form of operation of the Polish Navy to these threats. Based on the analysis of international, and national legal regulations, strategic documents of maritime powers, and applied forms of maritime activity, the scope of changes in Polish maritime policy was determined. Modifications of the definition of terms maritime piracy and unlawful assault at sea in Polish legal regulations were considered necessary, they should also include activities of maritime terrorism, subversion and sabotage of offshore facilities and installations, as well as ships operating. The principle of linking defense tasks against the sea attack, and maintaining navigation continuity was proposed as an element determining the construction method of the Polish Navy and the scope of combat training. On this basis, its combat potential and scope of training were determined. It should cover four areas (preparation for defense operations, combating nontraditional risks, how to respond to provocative, and criminal activities).

This article tries to show the relationship between one important set of deficiencies included in the Paris Memorandum of Understanding on Port State Control procedures, propulsion and auxiliary machinery, the importance of this set of deficiencies for the PSC inspection and also its importance for the Maritime Safety. The maintenance of the propulsion and auxiliary machinery systems has become less important that it deserves, that means while the ship sails everything is supposed to be properly maintained, this is the most extended policy in the Companies and accepted and supported by the Owners. This article studies the deficiencies included in the category propulsion and auxiliary machinery detected by the Port State Control Officers (PSCO) of the Paris MOU area, and tries to demonstrate how important they are in these inspections. At the same time can be seen the professional profile of the PSCO’s as well as the assessment made by them of those areas included in this set of deficiencies.

Santos Port is located in São Paulo State Coast (Brazil), in an estuarine area inside Santos Bay named Baixada Santista. The currents behavior is forced by tides. The resulting tidal level variability (high tide, mean sea level and low tide) recorded from Santos Dock Company tide gauge (1940 to 2014), the longest series of continuous record of tides in Brazil, shows a consistent increasing trend. The estimation about the magnitude of mean sea level rise (MSLR) in recommendations, guidelines or requirements issued by different countries and agencies from 1990 provide examples of different approaches used around the world in comparison with the local trends obtained for Santos Port. It is concluded that MSLR will have a considerable impact upon the port, with approximately 1.0 m rise estimated from 1990 to 2100. Baixada Santista is a lowland situated a few meters upper from the sea level and some areas are possible to be submerged in the end of this century. Other two locations in São Paulo State Coast, Cananeia and Ubatuba, respectively to the SE and NW of Santos, were also compared with the port tidal data to evaluate the consistency of the trends.

W artykule przedstawiono koncepcję oceny stanu umocnień dna w basenach portowych, w rejonie cumowania statków wykorzystujących własne urządzenia napędowe i sterujące, w szczególności promów i statków ro-ro. Omówiono czynniki wpływające na stan systemu. Do opisu procesu degradacji systemu umocnień dna zaproponowano proces gamma (Xt)t≥ 0, który może być określony na podstawie fizycznych charakterystyk degradacji systemu. Podano przykład badań symulacyjnych i obliczeń numerycznych umożliwiających przewidywanie oddziaływania strumieni zaśrubowych statku na dno i nabrzeże podczas manewrów.
This paper presents a concept for the assessment of the state of a seabed protection system in docks, in the area of self-berthing operations, performed by ferries and ro-ro vessels. The factors influencing the system state are described. The Gamma process (Xt)t≥ 0 has been proposed do describe the process of degradation of seabed protection systems, which can be described by physical characteristics. The example of ship motion simulation and CFD calculation were presented to demonstrate the possibility of predicting the influence of a propeller jet on seabed protection and quay wall during manoeuvres.

Historycznie, ukraińska państwowość powstała od początku istnienia Rusi Kijowskiej w średniowiecznym prawie międzynarodowym, którego jednym z instytutów było prawo morskie. Na wszystkich etapach rozwoju swojej państwowości Ukraina była aktywna w działaniach morskich i do pewnego stopnia posiadała status państwa morskiego. Doświadczenia żeglugi i operacji bojowych na rzekach i morzach z czasów Rusi-Ukrainy zostały z powodzeniem zastosowane i opracowane w przyszłości przez państwo kozackie. W XVII-XVIII w. na Morzu Czarnym i Azowskim dominowała morska żegluga kozacka, której celem była z jednej strony obrona ziem ukraińskich, z drugiej – walka prowadzona o wolność handlu morskiego i rzemiosła. Po zniszczeniu państwa kozackiego Rosja przypisała sobie całą dotychczasową historię ukraińskiej państwowości, w tym doświadczenie morskiej działalności narodu ukraińskiego. Rozpad ZSRR i przywrócenie niepodległej Ukrainy wyznaczyły nowy sposób historycznego rozwoju Ukrainy jako pełnoprawnego podmiotu nowoczesnego międzynarodowego prawa morskiego.
Historically, Ukrainian statehood has arisen since the formation of Kievan Rus’ in the age of Medieval international law, one of the institutes of which was the law of the sea. At all stages of the development of its statehood, Ukraine was active in maritime activity and in varying degrees possessed the status of a maritime state. The collapse of the USSR and the restoration of independent Ukraine marked a new way of historical development of Ukraine as a full rights subject of modern international law of the sea.

Transport morski odgrywa bardzo istotną rolę w gospodarce Unii Europejskiej. Do najważniejszych obiektów infrastrukturalnych w sektorze transportu morskiego zaliczana jest szeroko rozumiana infrastruktura portowa. Finansowanie jej budowy i rozbudowy odbywa się bardzo często z wykorzystaniem środków publicznych, jako że należy to do podstawowych zadań państwa. Jednakże w praktyce granica pomiędzy sytuacjami, w których publiczne finansowanie infrastruktury portowej stanowi pomoc publiczną, a takimi, w których nie spełnia wszystkich przesłanek z art. 107 ust. 1 TFUE, stanowiąc przejaw realizacji zadań państwa poprzez – mówiąc w uproszczeniu – budowę ogólnodostępnej infrastruktury, jest „cienką czerwoną linią”. W prawie UE brak jest bowiem w chwili obecnej jakiegokolwiek dokumentu (czy to o charakterze wiążącym, czy niewiążącym), który wyznaczałby jasne i precyzyjne zasady i standardy oceny publicznego finansowania portów morskich w dwóch aspektach: 1) Kiedy finansowanie takie stanowi pomoc publiczną w rozumieniu art. 107 ust. 1 TFUE? 2) Po spełnieniu jakich przesłanek pomoc publiczna na budowę i rozbudowę infrastruktury portów morskich może zostać uznana za zgodną z rynkiem wewnętrznym UE? Artykuł koncentruje się na pierwszym z tych zagadnień. Zaprezentowane zostanie jednak ujęcie pod kątem rodzajów infrastruktury portowej, której finansowanie przez państwo może stanowić bądź nie pomoc publiczną, nie będą zaś przeanalizowane wszystkie przesłanki z art. 107 ust. 1 TFUE. W praktyce bowiem to właśnie na omawianym polu występują największe trudności.
Transport by sea plays a vital role for the economy of the European Union. Among all the infrastructure elements necessary to conduct transport by sea, the port infrastructure (in the wide meaning of this term) is of the utmost importance. Its development is often financed form public resources, as it is one of the basic duties of a state. However, in practice a borderline between situations, when public financing of port infrastructure constitutes State Aid and those in which not all of the criteria laid down in Art. 107 (1) TFEU are met and thus such financing is a means of exercising public authority by constructing infrastructure open to all potential users, is a ”thin red line”. This is so because currently there is no act in the EU legal regime (either binding or non-binding) which lays down clear and precise rules and standards of assessment of public financing of port infrastructure in two aspects: 1) When does it constitute State Aid according to Art. 107 (1) TFEU? 2) What are the criteria of compatibility of State Aid aimed at the development of port infrastructure with the EU internal market? The present article focuses on the first of the abovementioned questions. However, the question will be analysed form the perspective of the kinds of port infrastructure, public financing of which may or may not constitute State Aid, and thus not all of the criteria stemming from Art. 107 (1) TFEU will be examined. This is so because in practice most difficulties arise in the said area.

In November 2015 Poland established a contiguous zone and, after more than a year, in January 2017, adopted the regulation on the baselines, an external boundary of the Polish territorial sea and the contiguous zone of the Republic of Poland. After many decades, it was a successful attempt to establish a contiguous zone returning to the concept of the 30’s of the last century. The United Nations Convention on the Law of the Sea (UNCLOS) recognizes that the coastal State may establish a zone contiguous to its territorial sea that extends to 24 nautical miles from the baselines of the coastal State, known as the contiguous zone, and exercise the control necessary to prevent infringement of its customs, fiscal, immigration, or sanitary laws and regulations within its territory or territorial sea, or to punish such infringements committed within its territory or territorial sea. This paper presents a few general comments on the Polish contiguous zone taking into account the international roots of that legal institution of the law of the sea, of such importance, also for the security reasons.

Opis:
Cenozoic deep−water sediments of the Lincoln Creek, Makah, and Pysht formations in western Washington State, USA, contain sunken driftwood and whale bones that were colonized by invertebrates which largely depend on this type of transient habitat. These fossil woodand whale−fall faunules yielded six new mollusk species that appear to have been endemic to these biogenic microhabitats, except for one species which also occurs in cold−seep limestones. The new gastropod species are the neomphalid Leptogyra squiresi, the buccinid Colus sekiuensis, the allogastropod Xylodiscula okutanii, and the new bivalve species are the protobranch “Nuculana” posterolaevia, the mytilid Idas? olympicus, and the heterodont Thyasira xylodia.
