The subject of the article is an analysis of the non-custodial sentencje known in Poland as curtailment of liberty (and thus excluding fines) as an important instrument of penal policy in the 1970-1998, the main focus being on two strands or this policy–legislative policy and penal policy–to the exclusion of the latter’s administrative aspects. In the light of the guiding principles of the 1969 Criminal Code non-custodial sentences were intended to become an important penal policy measure for treatment of perpetrators of  minor offenses and at the same time to provide a substitute for short terms of imprisonment, which had been found relatively ineffective as a means of achieving rehabilitation of convicted offenders. However, the normative extent of the code’s provision for non-custodial penalties proved to be relatively narrow. Within the range of alternatives to custodial punishment curtailment of liberty was an option available only under 17.5% of the defined offenses. Under Article 54 §1 sentencing to curtailment of liberty was admissible for 24% of all offenses and under Article  57 §1.3 for 27.9% of the total. The potential possibilities of non-custodial treatment of offenders were circumscribed by the provisions of Articles 54 §2, 52, 59 and 60.       A significant influence on the frequency of sentencing to curtailment of liberty was the actual incidence of criminal acts punishable by alternative form of treatment. Based on an analysis of Ministry of Justice and judicial statistics it appears that such acts were not among the most frequently committed offenses, amounting to about 10% of all convictions. The systematic growth of the proportion of sentences to curtailment of liberty, from 6.2% in 1970 to l8% in 1980, should, therefore, be regarded as achievement of the maximum level of possible sentences of this kind. If we consider the share of curtailment of liberty in the structure of sentences for offenses punishable by alternative forms of treatment we will find that there was a judicial bias towards curtailment of liberty. The frequency of such treatment of offenders fluctuated between 32.83% and 56.54%, while the range for fines came to 21.26%‒5I,99 % and for imprisonment to 3,4%‒21.26%. It can, therefore, be said that in the first decade following the 1969 Criminal Code’s entry into force curtailment of liberty fulfilled the purpose envisaged by the lawmakers, that is as an alternative to short terms of imprisonment. Undoubtedly, a factor contributing to the increase in the proportion of non-custodial sentences in the structure of final and conclusive judgments was the jurisprudence of the Supreme Court, in particular its guidelines for the administration of justice and judicial practice issued on 30 May 1979 (VII KZP 31/1977) concerning sentencing policy with respect to offenses for which the prescribed punishment is, interchangeably, imprisonmet, curtailment of liberty or a fine. Imprisonment, these stated, should be a penalty imposed only in the last resort when non-custodial forms of treatment are deemed incapable of performing the function of protection of the legal order.        If a salient characteristic of the 1970s was stability of legislative policy, which  precluded the possibility of shaping penal policy by means of legislation, the 1980s, or more precisely the period from 12 December 1981 to 1989, saw the emergence of a tendency in the opposite direction. For it brought the adoption of numerous basic amendments in criminal legislation, the general thrust of which was towards severer difinition of criminal responsibility. This was reflected in a decrease in the proportion of non-custodial sentences in the structure of final and conclusive judgments (from 15.6% in 1981 to 8.2% in 1984) and a concurrent increase in the frequency with which courts sentenced offenders to imprisonment (from 25.3% in 1981 to 33.1% in 1984).         During the years in which the rigorous provisions of the Special Criminal Responsibility Act were in force, that is in the period from 10 May 1985 to 30 June 1988, there was a systematic rise in the proportion of curtailment of liberty in the structure of sentences (from 10.1% in 1985 to 17.4% in 1987), which might have something to do with the introduction by the May legislation of provisions allowing for non-custodial treatment of offenders in summary proceedings.        The 1988 amendments to the Criminal Code, aimed at relaxing definitions of criminal responsibility, included, albeit in only a limited degree, provisions relating to the applicability of curtailment of liberty. These changes reflected a desire to increase the significance of non-custodial treatment in penal policy. However, in judicial practice there ensued a decrease in sentencing to curtailment of liberty, from 10.5% in 1989 to 5.3% in 1990.        The period of political, economic and social change in Poland which began  in 1989 stimulated criminal law reform. The aim of numerous legislative change which followed was to reduce the punitive  character of the Criminal Code. One reflection of this was greater provision for non-custodial treatment of offenders (introduced by the new Criminal Code enacted in 1995) through a broadening of the grounds for commuting sentences of imprisonment to curtailment of liberty or a fine under Article 54), reduction of the role of repeated criminality as an aggravating circumstance in punishment of offenders, and abolition of extended sentences for offenses classified as "hooligansm" or committed by repeat offenders.        In 1991-1995 the share of curtailment of liberty in the structure of sentences held steady at a level of 3.5%‒3,9%, making it the lowest ever for the period in which the 1969 Criminal Code was in force. This was not a result of the greater repressiveness of the criminal justice system since we observed a drop in the frquency of sentences of imprisonment. The courts tended to favor the use of conditional suspension of custodial sentences (the share of which rose from 43.9% in 1989 to 55.1% in 1997) and fines (up from 4.9% in 1989 to 27.4% in 1997). The explanation should, rather, be sought in problems with execution of sentences to curtaiment of liberty, chief among them the job shrinkages caused by changes in the free-market economy.       Analysis indicates that curtailment of liberty did not fulfill the expectations associated with this form of punishment. It did not become a significant instrument of penal policy nor did it contribute to reducing the scale of sentencing to terms of imprisonment. Even after a substantial widening of provision for punishment by curtailment of liberty its share of sentences ordered by the courts reached a level of only 5.2% (in 1977).       The new Criminal Code has substantially expanded the possibilities of sentencing offenders to curtailment of liberty. This form of punishment is intended to be an important instrument of penal policy with respect to misdemeanors and minor offenses and to replace imprisonment and even fines if ordering the latter is thought to serve no purpose. At the same time the Criminal Code has introduced modifications in the legal shape of this punishment. By preserving, contrary to the intentions of the code’s original drafters, multivariate forms of punishment it gives curtailment of liberty some of the hallmarks of probation by introducing the possibility of imposing certain additional conditions and establishing supervision. The new elements in the design of curtailment of liberty have met with numerous criticisms of the doctrine (including by the authors of the article). How it will affect the functioning of the institution analyzed the immediate future will tell.

Several different isolates of Tomato black ring virus (TBRV) have been collected in Poland from cucumber, tomato, potato and black locust plants. Biological tests showed some differences in the range of infected plants and the type of symptoms, which was the basis for selection of seven the most biologically different TBRV isolates. According to the sequence of TBRV-MJ, several primer pairs were designed and almost the entire sequence of both genomic RNAs was amplified. The RT-PCR products derived from all tested TBRV isolates were digested by restriction enzymes. On the basis of the restriction patterns, the variable and the conserved regions of the TBRV genome were defined and the relationships between the Polish TBRV isolates established.

Restricting food intake to a level below that consumed voluntarily (85%, 70% and 50% of the ad libitum energy intake for 3 or 30 days) and re-feeding ad libitum for 48 h results in an increase of malic enzyme (ME) gene expression in rat white adipose tissue. The increase of ME gene expression was much more pronounced in rats maintained on restricted diet for 30 days than for 3 days. The changes in ME gene expression resembled the changes in the content of SREBP-1 in white adipose tissue. A similar increase of serum insulin concentration was observed in all groups at different degrees of caloric restriction and refed ad libitum for 48 h. Caloric restriction and refeeding caused on increase of ME activity also in brown adipose tissue (BAT) and liver. However, in liver a significant increase of ME activity was found only in rats maintained on the restricted diet for 30 days. No significant changes after caloric restriction and refeeding were found in heart, skeletal muscle, kidney cortex, and brain. These data indicate that the increase of ME gene expression after caloric restriction/refeeding occurs only in lipogenic tissues. Thus, one can conclude that caloric restriction/refeeding increases the enzymatic capacity for fatty acid biosynthesis.

Opis:
This article presents the main issues relating to the goals of modern Polish competition law. It examines the relationship between the subject-matter of competition law, its function and its goals. It identifies various goals of competition law as well as their acceptance in the legal doctrine and jurisprudence. The study shows that the goals of Polish competition law have always been limited to enhancing efficiency and consumer welfare, with this latter term being understood in a post-Chicago-school fashions, rather than accordingly to its Chicago-school origin. This article shows how an 18-years competition law system, rather accidentally than deliberately, took the best ideas from both the American and the European legal tradition and mix them up into an incoherent, yet workable system of competition protection which is favourable towards efficient operations and, at the same time, safeguards consumers against exploitation and diminished choice.

BACKGROUND Desulfovibrio desulfuricans belong to the heterogeneous group of anaerobic, sulphate-reducing bacteria (SRB), widely distributed in various environments. As a result of dissimilatory sulphate reduction, they release hydrogen sulphide (H2S), which has a cytotoxic effect in human and animal organisms. It has been shown by many authors, that Desulfovibrio was the genus predominating in patients with ulcerative colitis. Some of these bacteria can act as opportunistic pathogens associated with primary bacteremia and abdominal infections such as abscesses. MATERIAL AND METHODS Fifteen (soil and intestinal) strains of Desulfovibrio desulfuricans species were cultured in modified sulphate-free Postgate’s liquid medium with pyruvate for 10 days. Bacterial DNA was extracted by using a commercially available kit and DNA was used as a template for amplification of the full-length 16S, 23S rDNA and the intergenic spacer region. Digested with restriction enzymes (AluI, EcoRI, HaeIII, HindIII, HinfI, MboI and PstI) PCR amplicons were resolved by electrophoresis on 2% agarose gels. RESULTS Digestion of rrn operon of Desulfovibrio desulfuricans by seven restriction enzymes allowed to obtain the characteristic restriction profiles for all 15 investigated strains. The results allow us to suggest three of used enzymes: HinfI, AluI and HaeIII as a useful for confirmation of the similarity within of rrn operon of isolates belonging to this species. Considering the restriction profiles received with HindIII, and EcoR1 enzymes it seems that their application is insufficient, but PstI enzyme is not acceptable for the analysis of rrn operon of these bacteria. CONCLUSIONS The obtained data have shown that ARDRA can be used for establishment of phylogenetic relations among isolates of Desulfovibrio desulfuricans species, providing the appropriate restriction enzyme is used.
WSTĘP: Bakterie Desulfovibrio desulfuricans należą do szerokiej grupy beztlenowych bakterii redukujących siarczany (BRS), rozpowszechnionej w różnych środowiskach. Jako rezultat dysymilacyjnej redukcji siarczanów uwalniają do środowiska siarkowodór (H2S), który wpływa cytotoksycznie na organizm ludzi i zwierząt. Wielu autorów wykazało, iż rodzaj Desulfovibrio jest dominujący u osób cierpiących z powodu wrzodziejącego zapalenia okrężnicy. Ponadto niektóre gatunki tego rodzaju odgrywają role oportunistycznych patogenów wywołując bakteriemię, infekcje w obrębie jamy brzusznej oraz wrzody. MATERIAŁY I METODY: Piętnaście szczepów Desulfovibrio desulfuricans (glebowych i jelitowych) hodowanych było na modyfikowanym podłożu Postgata z dodatkiem pirogronianu przez 10 dni. Po wyizolowaniu genomowego DNA tych bakterii przeprowadzono reakcje PCR w celu namnożenia fragmentu operonu rrn obejmującego geny 16S, 23S oraz odcinek zmienny pomiędzy nimi. Otrzymane amplikony poddane zostały trawieniu enzymami restrykcyjnymi (AluI, EcoRI, HaeIII, HindIII, HinfI, MboI and PstI), a otrzymane fragmenty rozdzielono w 2% żelu agarozowym. REZULTATY: Przeprowadzona analiza restrykcyjna operonu rrn bakterii Desulfovibrio desulfuricans pozwoliła na otrzymanie charakterystycznych profili restrykcyjnych dla wszystkich piętnastu badanych szczepów. Uzyskane rezultaty pozwoliły uznać trzy z zastosowanych enzymów (HinfI, AluI oraz HaeIII) za odpowiednie do potwierdzenia podobieństw w obrębie operonu rrn bakterii tego gatunku. Biorąc pod uwagę profile otrzymane po trawieniu enzymami HindIII, EcoR1, możemy stwierdzić ich małą użyteczność w analizach operonu rrn gatunku Desulfovibrio desulfuricans, zaś enzym PstI w ogóle nie nadaje się do tego celu.

W pracy przedstawiono przyczyny dla których polski rolnik, pomimo iż potrzebuje informacji fachowej (głównie ekonomicznej i technicznej) i jest skłonny za nią zapłacić w tak małym stopniu preferuje nośnik informacji jakim jest Internet. Badania prowadzono w roku 2007 w wybranych gminach województwa małopolskiego. Wyniki badań wskazują, że podstawowymi przyczynami dla których przedstawiciele gospodarstw wiejskich Małopolski w tak małym stopniu preferują nośnik informacji jakim jest sieć Internet jest zbyt wysoka cena świadczenia tych usług oraz brak doświadczenia i wiedzy fachowej potrzebnej do prawidłowego i skutecznego korzystania z zasobów internetowych.
The paper presents the reasons why Polish farmers prefer the Internet as an information carrier to so little extent, although they need professional information (mainly economic and technical), and are prone to pay for it. The research was carried out in 2007 in selected boroughs of Małopolskie (Lesser Poland) Voivodship. Test results indicate that basic reasons, for which representatives of rural farms in Małopolskie Voivodship prefer the Internet as an information carrier to so little extent, include too high price of providing these services and lack of experience and professional knowledge required for correct and efficient use of the Internet resources.

Twardość endospermu odgrywa ważną rolę w charakterystyce jakościowej ziarna pszenicy uprawnej (Triticum aestivum L.) i ma znaczący wpływ na mielenie, wypiek i jakość końcową produktu. Zmienność genowej sekwencji oraz mutacje dwóch puroindolinowych genów (Pina-D1 i Pinb-D1), zlokalizowanych w lokus Ha na chromosomie 5D, w większości wyjaśniają zakres zmienności tekstury pszenicznych ziarniaków. Celem przedstawionych badań było charaktery¬zowanie form allelicznych puroindolinowych genów w odmianach pszenicy zarejestrowanych w Polsce. Łącznie dla 69 odmian przeprowadzono pomiary SKCS twardości ziarna oraz zidentyfiko¬wano obecność puroindolinowych alleli stosując markery molekularne. Na podstawie średnich wartości SKCS twardości, 8 odmian zakwalifikowano do twardego typu pszenic, 60 odmian do pośredniego oraz 1 odmianę do miękkiego. Wszystkie krajowe odmiany posiadały allel Pina-D1a. Do rozróżnienia alleli genu Pinb-D1, produkty PCR tego genu rozkładano na mniejsze fragmenty stosując enzym restrykcyjny BsrBI. Wśród badanych prób, 35 odmian posiadało allel dzikiego-typu Pinb-D1a.
Endosperm hardness plays an important role in quality characteristics of cultivated wheat (Triticum aestivum L.) and has a significant effect on milling and baking processes and on the quality of the final product. Gene sequence variation and mutations to the two puroindoline genes (Pina-D1 and Pinb-D1), located at the Ha locus on the chromosome 5D, account for the majority of variation in wheat kernel texture. The objective of the presented study was to characterize the allelic forms of puroindoline genes in Polish wheat cultivars. For a total of 69 wheat cultivars the measurement of SKCS grain hardness was performed, and puroindoline alleles were identified by molecular markers. On the basis of mean SKCS hardness eight cultivars were classified as a hard type, 60 cultivars as a mixed one and one as a soft type. In all the cultivars the Pina-D1a allele was identified. To identify alleles of Pinb-D1 gene, PCR product of this gene was digested to small fragments by BsrBI restriction enzyme. Among the grain samples, 35 cultivars were found to possess the wild-type Pinb-D1a allele.

Following John Ziman's motto: "The goal of science is to understand, not to collect data and formulas", it has been presented how important role the principle of virtual work plays in general mechanics. On the base of some examples it has been proved that this principle can be also applied to the problems occur in mining practice.

This paper deals with the problem of nonstationarity of regressors in binary choice model. The limit distribution of the ML-estimator is mixed normal, but restriction testing shall not be based on standard t-statistic. The results of the conducted Monte Carlo experiment demonstrate that the true size of the restriction test is far from the significance level. Therefore, the t -Student statistic should be modified and this paper proposes its modification. The results of the Monte Carlo investigation point to the superiority of the new statistic.

Opis:
Calorie restriction (CR) is known to extend life span from yeast to mammals. To gain an insight into the effects of CR on growth and development of the silkworm Bombyx mori at protein level, we employed comparative proteomic approach to investigate proteomic differences of hemolymph and fat body of the silkworm larvae subjected to CR. Thirty-nine differentially expressed proteins were identified by MALDI TOF/TOF MS. Among them, 19 were from the hemolymph and 20 from the fat body. The hemolymph of the CR group contained two down-regulated and 17 up-regulated proteins, whereas the fat body contained 15 down-regulated and five up-regulated ones. These proteins belonged to those functioning in immune system, in signal transduction and apoptosis, in regulation of growth and development, and in energy metabolism. Our results suggest that CR can alter the expression of proteins related to the above four aspects, implying that these proteins may regulate life span of the silkworm through CR.

The article is devoted to the influence of European competition law on the application of Polish competition rules by Polish courts. It covers references to EU law that has been made throughout 20 years of its history. It aims at identifying various instances where EU law has been invoked to provide Polish competition rules with the actual content as well as different modes of referrals to EU law.
L’article concerne l’influence de la loi européenne de la concurrence sur l’application des règles polonaises de concurrence par des tribunaux polonais. L’article couvre les références a la loi de l’UE développée au cours des 20 années de son histoire. Son but est d’identifier des instances où la loi de l’EU a été invoquée pour donner aux règles polonaises de la concurrence le contenu actuel et les modes de référence a la loi de l’UE.

In this paper, we place some left restrictions on derivations in CD grammar systems with phrase- structure grammars, controlled by the regular languages. The first restriction requires that every production is always applied within the first k nonterminals in every sentential form, for some $k \ge 1$. The second restriction says how many blocks of non-terminals can be in each sentential form. The third restriction extends the second restriction and says how many blocks of non-terminals with limited length can be in each sentential form. We demonstrate that under these restrictions, the grammar systems generate different families of languages. Indeed, under the first restriction, these systems generate only context-free languages. Under the second restriction, even one-component systems characterize the entire family of recursively enumerable languages. In the end, the family of languages generated by grammar systems under the third restriction is equal to the family of languages generated by programmed grammars with context-free rules without $\epsilon$- rules of nite index.
