Opis:
The article analyzes the methods and criteria for evaluating the effectiveness of e-governance and e-democracy used in the countries of the European Union and the United States in the context of their implementation in the activities of state authorities and local self-government in Ukraine. It is emphasized that the main activity of the executive power is the provision of services to citizens, therefore, the concept of the effectiveness of the activities of state authorities and local self-government is inextricably linked with the effectiveness of the provision of public services. It is proved that modern information and communication technologies are an important tool for improving the efficiency of the provision of public services, which should be able to be used correctly, because according to the results of evaluating the effectiveness of the provision of electronic public services by the executive power, it is possible to judge the effectiveness of its activities as a whole. It is noted that currently the effectiveness of e-government is evaluated in two ways: 1) assessment of the readiness of e-government and 2) assessment of the socio-economic effects of e-government. It is emphasized that for Ukraine today, one of the priority tasks in the implementation of administrative reform is the active use of the national system of indicators for evaluating the effectiveness of e-government, taking into account the methodological approaches proposed by the world community. This will allow quickly responding to problems and risks on the way to promoting reforms.

Opis:
Reformowanie administracji publicznej jest procesem złożonym i długotrwałym, szczególnie w krajach tzw. przemian, o tradycjach niedemokratycznych. Praktycznie przez pierwsze ponad dwadzieścia lat od momentu odzyskania niepodległości Ukraina tworzyła jedynie zręby zdecentralizowanej administracji publicznej, łącząc częściowo wzorce zachodnie oraz funkcjonujące przez dziesięciolecia struktury administracji sowieckiej. Dopiero w drugiej dekadzie lat dwudziestych XX wieku wykonano krok milowy w kierunku istotnej przebudowy struktury i funkcji administracji publicznej, kierując się standardami demokracji zachodnich. Zwieńczeniem procesu reformowania sektora publicznego było utworzenie samorządu terytorialnego na poziomie gromad. Wraz z procesem tworzenia samodzielnych jednostek terytorialnych pojawiła się potrzeba formułowania wieloletnich planów rozwoju, jako podstawowych instrumentów polityki rozwoju społecznego i gospodarczego na poziomie lokalnym. Proces ten w wielu przypadkach był i jest wspomagany aktywnością i doświadczeniem polskich instytucji realizujących na Ukrainie różne projekty, których celem jest opracowanie strategii rozwoju dla jednostek terytorialnych. Celem niniejszego artykułu jest prezentacja uwarunkowań decentralizacji terytorialnej na Ukrainie po odzyskaniu niepodległości na początku lat 90. oraz wyników projektu strategicznego zrealizowanego w 2021 roku przez pracowników Katedry Administracji Publicznej Instytutu Nauk o Polityce i Administracji UMCS. Głównym produktem zrealizowanego projektu było opracowanie Strategii Rozwoju Gromady Herca w obwodzie czerniowieckim na Ukrainie w oparciu o model partycypacyjno-ekspercki. Przedstawione poniżej odnoszą się w szczególności do opisu procesu opracowania strategii rozwoju oraz wniosków z przeprowadzonej analizy strategicznej.
Reforming public administration is a complex and lengthy process, especially in so-called transition countries. Practically, for the first twenty years after regaining independence, Ukraine was only creating the foundations of a decentralized public administration, partially combining Western models and the structures of the Soviet administration that had been functioning for decades. It was only in the second decade of the 2000s that a milestone was made towards a significant reconstruction of the structure and functions of public administration, guided by the standards of Western democracies. The culmination of the process of reforming the public sector was the creation of local government at the community level. Along with the process of creating independent territorial units, a need arose to formulate long-term development plans as the basic instruments of social and economic development policy at the local level. This process in many cases was and is supported by the activity and experience of Polish institutions implementing various projects in Ukraine, the purpose of which is to develop a development strategy for territorial units. The aim of this article is to present the conditions of territorial decentralization in Ukraine after regaining independence in the early 1990s and the results of the strategic project implemented in 2021 by the employees of the Department of Public Administration of the Institute of Political Sciences and Administration of UMCS. The main product of the implemented project was the development of the Herca Municipality Development Strategy in the Chernivtsi Oblast in Ukraine, based on the participatory-expert model. The results presented below refer in particular to the description of the process of elaborating the development strategy and the conclusions of the strategic analysis carried out.

W tekście zaprezentowano wyniki badania ankietowego przeprowadzonego z udziałem 1 217 pracowników administracji publicznej w Polsce. Jego celem było określenie kulturowych determinant wprowadzania reform zgodnych z zaleceniami Nowego Zarządzania Publicznego (NZP) i New Public Governance (NPG) w polskiej administracji. Wyniki świadczą m.in. o tym, że polscy urzędnicy niechętnie akceptują wdrażanie mechanizmów konkurencji w urzędzie oraz że preferują rozwiązania typowe dla logiki hierarchicznej. Wśród czynników sprzyjających wprowadzaniu reform zidentyfikowano wyższy niż w całej populacji poziom deklarowanego zaufania oraz świadomość, że obecny stan administracji publicznej w Polsce jest niezadowalający. Przeanalizowano również, w jaki sposób przekonania urzędników zmieniają się w zależności od miejsca zajmowanego w hierarchii administracyjnej, oraz porównano ich przekonania z deklarowanymi przez ogół populacji Polaków.
The paper is based on an opinion survey of 1217 Polish public administration employees, which was conducted in order to asses cultural determinants of the successful introduction of the New Public Management and the New Public Governance reforms. The results show that Polish public administration employees are not very eager to accept the implementation of competitive mechanisms in their workplace, and that they prefer solutions rooted in the hierarchical logic. It was concluded that factors positively affecting the probability of successful reforms are: the level of trust, which is higher among them than among the general public, and high awareness of the present dismal state of the administration. The opinions shared by the public administration employees were also compared with those expressed by the general population; regional differences in opinions were also analyzed.

Different authors at different times have given an unequal definition to the term of public administration compared to what it is used today. The author Georges Vestel has defined the public administration as “the set of activities aimed at maintaining the public peace and meeting other needs of the general interest. This definition corresponds to the etymology of the term administration - “administration” which means “to serve”. But Jean-Jacques Rousseau in his work, Social Charter, defined the public administration under the government term. He stated that: “I call a government or a supreme administration the legitimate exercise of the executive power. Some authors use “administrative” and “executive” terms in an alternate way, with the same meaning. Other authors make a clear distinction between terms. They define the state administration as “an activity which is carried out for the concrete fulfilment of the functions of the state and the duties of the organs of the state administration”. So these authors distinguish the state administration from the executive activity which the executive bodies perform. The paper aims to suggest a set of strategies and improvements by starting from a theoretical background of the definition of power balance and separation in public administration and governing bodies and its evolutionary definition over time, and by reflecting those findings as a set of suggestions, by considering the actual Albanian Code of Administrative procedures, strategies and practices.

The article looks at the relations between the financial law in Poland and various public management theories. The author claims that institutional design of the Polish financial law seems to be rooted in administrative law and orthodox conceptions of bureaucracy, although new ideas and institutions that are implemented might stem from the New Public Management. The author argues that such implementation without prior substantial systemic changes may result in counter-productive effects. Although changes are unquestionably necessary, current reform proposals lack holistic vision of the public finance sector and aim at short-term political benefits.

Local self-government constitutes a part of executive power in the state, with the state’s law underlying its functioning. Local government remains under the state’s supervision, representing a form of the political system within the decentralized public administration. 2018 marks 20 years of the functioning of local self-government based on a three-tier structure. The aim of the paper is an attempt at finding the answer to the question whether or not the organizational solutions adopted by the legislator and established in practice need to undergo reforms and if so, to what extent? The question thus formulated relates directly to the argument that the organization of local government system is not sound while the criteria assumed in the territorial breakdown of the local government organization do not correspond to the conditions in which those units operate, and therefore what appears necessary is for the system to be reorganized and the number of units at individual tiers to be reduced. The paper presents selected problems of the local administration in the context of a systemic organization and suggest possible (or necessary) changes which, in the author’s view, should become a subject of discussion (and in practice are such) between local selfgovernment and government administration.

For Ukraine strategic partnership with NATO is an integral part of the European integration course as complementary to the process of internal reforms in the context of the implementation of the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and Ukraine, of the other part. The significant part of the thesis is devoted to classifications of indicators that measure the European integration progress. In addition to the existing classifications, the author suggests using a new one that analyzes all indicators according to two parameters: (1) as markers of how public administration values (legality, integrity/honesty, transparency, accountability, effectiveness) are adjusted and level of trust for public institution was changed over time; (2) as measurements of ability to integrate into different fields (policies, economy, law approximation, social field etc). The analysis of these indicators helped to generate their taxonomy to measure a progress. The author has specified that the lack of deep relations within regional trade agreements with democratic countries results in poor quality of regulation and ineffective governmental performance in Ukraine.

Reforms known as New Public Management in Anglo-Saxon countries are well known to Polish readers, at the same time the literature connected with these reforms implemented in Germany virtually does not exist. The issue of New Public Management settled in Germany is more important to us because structural and functional basis of Polish administration are much more similar to continental than to the Anglo-Saxon model of public administration. The article aims at presenting efforts made to adjust German administration to the efficiency requirements in two ways. The first way are grassroots initiatives taken by local governments whose purpose is to reconfigure their internal structure in order to measure efficiency and gain concrete outputs. The second way is based on deep system-wide reforms: structural, functional and territorial. The specifics of the depicted reforms taken up in Germany are variety and multiple enhanced by federal nature of state; at the same time preferential treatment the rule that administration acts within the law and under the law whose rules reflect classical Weberian's model of public administration.

The role of health technology assessment in pharmaceuticalsreimbursement in PolandThe methodology of health technology assessment has been introduced into Polish health care system officially in 2005, and practically in 2006. It is provided by the Agency for Health Technology Assessment (AOTM, AHTAPol), the institution which role is advisory for the Minister of Health. AOTM collects evidence, performs analysis and independently delivers recommendations on financing health care benefits of public funds. The main part of AOTM tasks concerns drug technologies. We describe Agency’s procedures fulfilling the processes of the assessment of drug technologies, their background according to actual legislation as well as methodology. We explain the directions and the strength of potential impact of AOTM recommendations on the final administrative decision on financing the drug of public funds.

The system of public administration in Ukraine as a set of state bodies and institutions, officials who are authorized to perform management functions in all spheres of state and public life has been considered in the article. It is emphasized that the process of reforming the bodies of public administration in Ukraine continues, which reaffirms the thesis of the permanent modification of the state power and administrative functions connected with the emergence of new realities of social development. The article analyzes the important methodological provision of the relevant processes in this way so that the obtained results have the ability to ensure not only the accomplishment of the tasks set, but also in general realize the goals and directions of the whole system of public administration. It is generalized that the improvement of administrative procedures in the state has an important methodological value for the implementation of public administration.
W artykule rozważono system administracji publicznej na Ukrainie jako zespół organów państwowych i instytucji, urzędników uprawnionych do pełnienia funkcji zarządczych we wszystkich sferach życia państwowego i publicznego. Podkreśla się, że trwa proces reformowania organów administracji publicznej na Ukrainie, co potwierdza tezę o permanentnej modyfikacji władzy państwowej i funkcji administracyjnych związanych z pojawieniem się nowych realiów rozwoju społecznego. Artykuł analizuje w ten sposób ważne dostarczanie metodologiczne odpowiednich procesów, aby uzyskane wyniki miały zdolność zapewnienia nie tylko realizacji wyznaczonych zadań, ale także w ogóle realizowały cele i kierunki całego systemu administracji publicznej. Uogólnia się, że usprawnienie procedur administracyjnych w państwie ma ważną wartość metodologiczną dla wdrażania administracji publicznej.

Edukowanie społeczeństwa oraz wspomaganie procesu identyfikowania podatników z grupy ryzyka lub niewywiązujących się z obowiązku podatkowego to czynniki warunkujące osiągnięcie podstawowego celu administracji skarbowej, czyli stanu, w którym podatnicy dobrowolnie wypełniają swoje powinności. Jednakże na żadnym etapie nie można się zatrzymać nawet na chwilę. Rozwój świadomości społeczeństwa polskiego wymusza rozwój wszystkich gałęzi, nie tylko w sektorze prywatnym, lecz także publicznym. W celu sprostania oczekiwaniom naszego społeczeństwa administracja, w tym również podatkowa, musi nieustannie poszukiwać nowych rozwiązań i nowych narzędzi.
Society education and supporting taxpayers identification processes of a risk group or tax duty avoidance are factors which necessary in order to reach a basic goal of fiscal administration, which means the state in which taxpayers comply with their duties voluntarily. However, you cannot stop for a moment at any stage. Polish society development enforces development in every branch, not only in the private sector but also in the public one. In order to fulfill the expectations of our society, administration, also tax administration, must search continually for new solutions and new tools.

Opis:
The qualitative development of a democratic society and the improvement of the functions of the rule of law in our country are closely connected with the understanding of human rights, including in the field of land relations. After all, the land, its subsoil and other natural resources located on the territory of Ukraine, in accordance with the Constitution of Ukraine, are the objects of property rights of the Ukrainian people exclusively, and are a national treasure. Today, Ukraine is undergoing a complex process of reforming land relations and adapting them to modern political, economic and social needs, especially in an open market for agricultural land. With an extremely strong agro-industrial potential, Ukraine has a significant role to play in overcoming the global food crisis. However, in the current system there is no competent and balanced state policy, and appropriate mechanisms for its implementation, on the integrated development of land relations and adaptation of land reform in Ukraine. As never before, there is a need for quality and effective public administration in the field of land use within the functioning of the agricultural land market in Ukraine. With the beginning of land status in Ukraine, new questions arose about the directions and mechanisms of improving land relations, the formation of the land market, the solution of which involves scientific and practical clarification of a wide range of problems in its infrastructure. Due to the introduction of a new wave of land reform in Ukraine, public administration in the field of land use of state and communal property should acquire a modern character. Along with the introduction of a transparent market for agricultural land, the reform also aims at transparent and efficient land management. One of the mandatory components of this goal is the introduction of an effective system of public administration in the field of land use of state and communal property. Thus, the formation of effective public administration in the field of land use within the functioning of the agricultural land market in Ukraine, including taking into account international experience, would ensure quality and rational use and protection of land in Ukraine, guarantee the rights of land owners and users and effective governance, which requires a systematic and scientific approach to addressing issues.
Якісний розвиток демократичного суспільства та вдосконалення функцій правової держави в нашій країні тісно пов’язане з розумінням прав людей, в тому числі у сфері земельних правовідносин. Адже земля, її надра та інші природні ресурси, що знаходяться на території України, відповідно до Конституції України є об’єктами права власності виключно українського народу, і являються національним багатством. На сьогодні Україна проходить складний процес реформування земельних відносин та адаптації їх до сучасних політичних, економічних та соціальних потреб, особливо в умовах відкритого ринку землі сільськогосподарського призначення. Маючи у володінні надзвичайно потужний агропромисловий потенціал, Україна має відігравати значну роль у подоланні глобальної продовольчої кризи. Однак на сучасний лад відсутня грамотна та виважена державна політика, та доцільні механізми її реалізації, щодо комплексного розвитку земельних відносин і адаптації завдань земельної реформи в Україні. Як ніколи існує потреба в якісному та дієвому публічному адмініструванні у сфері користування землями в межах функціонування ринку землі сільськогосподарського призначення в Україні. З початком набуття землею статусу товару в Україні виникли нові питання щодо напрямів та механізмів вдосконалення земельних відносин, формування земельного ринку, вирішення яких передбачає науково-практичне з’ясування широкого кола проблем по його інфраструктурному забезпеченню. Внаслідок впровадження нової хвилі земельної реформи в Україні публічне адміністрування у сфері користування землями державної та комунальної власності повинно набути сучасного характеру. Поряд з запровадженням прозорого ринку земель сільськогосподарського призначення метою реформи є також прозоре та ефектине управління земельними ресурсами. Однією із обов’язкових складових реалізації такої мети є впровадження ефективної системи публічного адміністрування у сфері користування землями державної та комунальної власності. Таким чином, формування ефективного публічного адміністрування у сфері користування землями в межах функціонування ринку землі сільськогосподарського призначення в Україні, в тому числі з врахуванням міжнародного досвіду, дало б можливість забезпечити якісне та раціональне використання та охорону земель в Україні, гарантувати права власникам та користувачам земельних діялнок та здійснювати дієве управління, що потребує системного та наукового підходу для розв’язання проблемних аспектів.
