The article is about the legal character of the institution of forfeiture (article 412 of the Civil Code). It aims to determine the character (civil or criminal) of this institution. It demonstrates the purpose of the regulation and the history of its development. It shows the perceived character of article 412 of the Civil Code in several periods, and presents a detailed analysis of the expression doctrine of individual periods relating to forfeiture. Particular attention is paid to the mechanism of action of the institution, its similarity to forfeiture as known in criminal law. Establishing the nature of the provision is based primarily on functions and purposes of the forfeiture provision.

The article considers the organizational and legal framework for ensuring the right of access to public information in Ukraine. The positive tendencies of legal support of realization of this public right of physical persons and shortcomings of the legal practice revealed in this sphere are defined. It was found that the object of influence of the administrative and legal mechanism to ensure the exercise of the right of access to public information is public relations in the field of satisfaction of the right of access to public information, by creating opportunities for free access to statistics, archives, libraries and museums. , other information banks, databases, information resources, information on the powers and activities of the subjects of power. Forms, methods and means of ensuring the right of access to the public are described. It was found that the purpose of the administrative and legal mechanism to ensure the exercise of the right of access to public information is to create conditions under which every individual can freely exercise the right of access to public information. The author’s definition of the key concept of a scientific article is offered.

The article shows that an effective tool of minimization of losses from non-probability measurements AT the stage of production is the use of risk management system. The expediency of evaluation of metrology risk of quality of products on the manufacturing stage in a kind of the generalized relative index - index of metrology risk - was grounded. This index must represent the loss of efficiency and effectiveness of the system of production metrology provision. The expressions for the estimation of the metrological risk index were offered and methodology of ranking production by the level of metrology risk was developed.

Opis:
Utility service provision is designed to satisfy basic human needs. The main objective of the research is to investigate mathematical methods for evaluating the feasibility of using a more efficient approach for utility services provision, compared to the current diversity of utility products delivered to households. Possibilities for alternative utility service provision that lead to more sustainable solutions include reducing the number of delivered utility products, on-site recycling and use of locally available natural resources. The core of the proposed approach is the simulation system that enables carrying out feasibility study of so-called transformation graph, which describes direct transformations and indirect transformations of the utility products into defined services. The simulation system was implemented in C# and .NET 3.5, while the XML database was implemented using eXist-db. The XML database stores information about all devices, utility products, services and technologies that can be used to define and solve services-provision problems. An example of such problem and its solution is presented in this paper. This research is a part of the All-in-One Project.

The article discusses the pension of police officers upon their retirement and is an analysis of the rules related to the granting police pensions and the determinants conditioning their amount and form. Police officers, as well as other representatives of uniformed services, are covered by the pension system which differs significantly from the general pension system provided by the Social Insurance Fund. This difference results mainly from the nature of the police officers’ work and the duties imposed on them. The differences are manifested by the rights granted to officers, which include, among other things, the possibility of a faster retirement benefit in comparison with other workers. The current legal provisions regulating the matter of granting and shaping benefits of police officers’ pensions have been reviewed several times. As a result, retired officers have been now covered by a police pension in three options. These options differ in terms of the length of service for which a policeman in question is entitled to a pension and the manner in which the pension can be increased. Classification into any of the possible pension variants depends on the date of commencement of service in the uniformed formation. In addition, regulations were also introduced involving the possibility of reducing the size of pension in the case of officers employed at the time when Poland was a totalitarian state. The variety of benefits granted within a single formation and the complexities associated with the regulation of police pensions cause many problems arising from their interpretation and the determination of pension benefits for present and former officers.

Cultural, educational and professional frameworks recognised by our civilization have been formulated as texts. Translation is the only method allowing for their global dissemination. Religions, literatures, learning theories and organizational cultures are products of translation. Yet, the relevance of translation is not only a matter of the past. It is argued in this article that translation is relevant today. In its educational aspect, translation can help realize that language differences are a resource in text comprehension and meaning making. Professional benefits of translating include language fluency that is more than a technical skill: it enables recognising nuances of meaning and sense, allowing for realistic language use. It can be a core advantage for specialists in creative industry, for industry analysts and for lots of other professionals engaging in cross-cultural interactions. Finally, being a translator one has a transversal competence of service provision.

Elastyczność stanowi wyzwanie współczesnej logistyki. Może być ona (elastyczność) rozpatrywana w wymiarze kontroli w zakresie podsystemu zaopatrzenia. Zaopatrzenie jest jednym z podsystemów logistycznych związanych z rynkiem. Stanowi ono połączenie między podsystemem dystrybucji dostawców a podsystemem produkcji w danym przedsiębiorstwie. Podsystem zaopatrzenia stanowi wsparcie dla pozostałych podsystemów systemu mikrologistycznego. Prawidłowe działanie tego podsystemu wpływa na jakość produktu, logistyczną obsługę klienta oraz na koszty całego systemu mikrologistycznego. Celem referatu jest rozpoznanie działań uelastyczniających podsystem zaopatrzenia w wymiarze kontroli w teorii i praktyce gospodarczej. W referacie przedstawiono koncepcję elastyczności podsystemu zaopatrzenia w wymiarze kontroli i wyniki badań empirycznych przeprowadzonych w przedsiębiorstwach.
The flexibility constitues the challenge of modern logistics. The flexibility can be viewed within the control dimension in the provision subsystem. The provision is one of the logistics subsystems connected with the market. The provision constitutes a link between the distribution subsystem of suppliers and the production subsystem in a given enterprise. The provision subsystem constitutes the support for the other subsystems of the micrologisics system. The correct functioning of the provision subsystem influences the product quality, the logistic customer service and the costs of the whole micrologistics system. The aim of the article is the recognizing of flexible operations of the provision subsystem within the control dimension in theorical and practical aspect. In the following article the conception of the provision subsystem flexibility in the control dimension and the results of empirical research have been presented.

Opis:
Intelligent IoT functions for increased availability, productivity and component quality offer significant added value to the industry. Unfortunately, many old machines and systems are characterized by insufficient, inconsistent IoT connectivity and heterogeneous parameter naming. Furthermore, the data is only available in unstructured form. In the following, a new approach for standardizing information models from existing plants with machine learning methods is described and an offline-online pattern recognition system for enabling anomaly detection under varying machine conditions is introduced. The system can enable the local calculation of signal thresholds that allow more granular anomaly detection than using only single indexing and aims to improve the detection of anomalous machine behaviour especially in finish machining.

Opis:
Ustawa o petycjach nie reguluje w sposób kompleksowy postępowania w sprawach dotyczących petycji i w zakresie nieuregulowanym odsyła do odpowiedniego stosowania kodeksu postępowania administracyjnego. Odesłanie zawarte w art. 15 jest odesłaniem zewnętrznym, dalszym, ogólnym, typu dynamicznego. Postępowanie w sprawie petycji nie jest jurysdykcyjnym postępowaniem administracyjnym i nie zmierza do rozpatrzenia sprawy administracyjnej, lecz ma cechy samodzielnego jednoinstancyjnego postępowania administracyjnego uproszczonego. Ze względu na specyfikę postępowania petycyjnego odpowiednie stosowanie kodeksu postępowania administracyjnego zawiera w sobie trzy możliwości działania: stosowanie przepisów kodeksu postępowania administracyjnego wprost, z pewnymi modyfikacjami oraz wyłączenie ich stosowania z powodu bezprzedmiotowości oraz sprzeczności regulacji zawartej w kodeksie postępowania administracyjnego z przepisami ustawy o petycjach. Przepisy jurysdykcyjnego postępowania administracyjnego będą stosowane w ograniczonym zakresie, między innymi w sprawach doręczeń, obliczania terminów, a także przez stosowanie niektórych zasad ogólnych. W szerszym zakresie odpowiednio stosowane będą przepisy działu VIII kodeksu postępowania administracyjnego z uwagi na zbliżony charakter petycji oraz skarg i wniosków.
The Polish Petitions Act does not prescribe a comprehensive manner of proceedings regarding petitions, and in matters which it does not regulate refers to the provisions of the Polish Code of Administrative Procedure (CAP). The reference the Petitions Act makes in its Article 15 is external, further, general and dynamic. Proceedings relating to petitions are not jurisdictional administrative proceedings and are not intended to handle administrative matters. They have the features of independent single-instance simplified administrative proceedings. In view of the nature of petitions, there are three ways in which the CAP may be properly applied: by the direct application of its provisions, by its application with some modifications, and by its disregard due to non-applicability, or to the contradictory nature of the respective provisions in the Code and in the Petitions Act. The provisions for jurisdictional administrative proceedings are to be applied to a limited extent for matters such as serving notice, defining deadlines, and also by the application of certain general principles. The provisions of Section VIII of the CAP are to be applied in a broader scope, due to the similar nature of petitions and complaints and requests.

The article covers the problem of analytical provision for managing innovation activities within a company, taking into account the interests of stakeholders — this is connected with the possibility of ensuring the competitiveness, assessment of innovation activities and choice of innovation strategy. The purpose of the study is to identify the conditions and trends of innovation activities within companies as well as to develop a methodological approach to the evaluation of their innovation activities on the basis of accounting and analytical data considering the interests of stakeholders. The study of the current state and general trends of innovation activities at enterprises was conducted in a logical sequence as follows: 1) the number of innovatively active enterprises, 2) the share of industrial enterprises among the innovatively active enterprises, 3) the estimation of the amount of financing and the level of expenditures on innovations and 4) strategic priority directions of innovation activities that allowed to identify and analyze barriers to the development of an effective innovation policy. This provided an opportunity to develop the structure of analytical provision for the system of managing innovation activities within a company as a logical chain of strategic results for achieving economic success. However, a number of limitations and risks were identified. The assessment of the impact of innovation on the economic, environmental and social efficiency of a manufacturing production process is argued to be based on systematic and structured accounting and analytical Information and reflected in non-financial reporting (in particular, the G4 Sustainability Reporting). In view of this, we consider it advisable to supplement the sustainability reporting with the indicators that characterize the effectiveness of innovation management. The results of the study are relevant and useful for large and medium-sized enterprises in the context of ensuring the implementation of an innovation model of development as well as for conducting applied research in the field of business strategies to ensure sustainable company development.

W referacie przedstawiono koncepcję elastyczności w wymiarze reagowania oraz wyniki badań empirycznych. Badania empiryczne przeprowadzono w przedsiębiorstwach zlokalizowanych na Dolnym Śląsku.
The provision subsystem constitutes the support for the other subsystems of the micrologisics system. The correct functioning of the provision subsystem influences the product quality, the logistic customer service and the costs of the whole micrologistics system. Flexibility of the provision subsystem in the respond dimension is essential. The aim of the article is the description of strategical and operational flexibility fundamentals, the introduction of the autorship theory of the flexibility in the respond dimension and the recognizing of strategical and operational flexibility signs in the range of enterprise’s provision subsystem. In the following article the conception of the flexibility in the respond dimension and the results of empirical research have been presented. The studies have been conducted in enterprises situated in Lower Silesia.
