Programmes supporting agricultural and rural development co–financed by the EU implemented in Poland in the programming periods 2004–2006 and 2007–2013 included a series of measures that have a direct or indirect impact on thecompetitiveness of the Polish agriculture. Analysis of the goals of these measures, nature of these instruments and categories of beneficiaries eligible for support enable naming several mechanisms of the programmes’ impact on the competitiveness of the agricultural sector. These include both direct and indirect support to individual farms, as well as support for surrounding of the agriculture and the instruments for structural changes at the level of the entire sector.

Regional operational programmes provide support granted from EU funds for different projects implemented in individual voivodeships in Poland. The aim of the programmes is to improve the competitiveness of regions and to promote the sustainable development. The priorities of the regional programmes include inter alia transport, environmental protection and sustainable energy production. The aim of the article is to analyze the amount and the results of the support provided from regional operational programmes for projects in renewable energy in Poland. The projects aimed at increasing the amount of electricity or heat produced from renewable resources and included for example modernisation of hydroelectric power plants or the installation of solar thermal collectors. The article also discusses difficulties in renewable energy project implementation. The problems resulted from the uncertainty about regulations affecting the energy sector and about price of green certificates which renewable energy producers sell to electricity suppliers. The analysis includes experience from the 2007-2013 funding period. It is based on regional programme documents and data from National Information System for the monitoring of the use of EU funds in Poland.

The aim of the article is to present the Rural Development Program 2014–2020 as a new fund to support rural development in Poland. The Rural Development Programme for the period of 2014 until 2020 constitutes yet another, following the Rural Development Plan for 2004–2006 and the Rural Development Programme 2007–2013, fund financed by the EU, which has been established after Polish accession to the European Union. According to the assumptions, the RDP 2014–2020 will constitute a continuation and development of such directions of support as have been followed since Poland’s accession to the European Union, and will be particularly focused on issues related to the advancement of the competitiveness of agriculture, which issues are of particular importance from the point of view of the development of rural areas; moreover, due to structural problems and development challenges, the very advancement requires substantial and well–targeted support. The purpose of the Rural Development Programme for 2014–2020 is to improve the competitiveness of agriculture, and also to facilitate sustainable management of natural resources and climate action and balanced territorial development of rural areas.

The issue of financing regional growth is of paramount importance as it pertains to both a region as a whole and to business entities that make up this region. The currently commencing new perspective of EU programming draws up new goals, introduces new logic in terms of intervention objectives and the ways of their financing. The purpose of this paper is to present the guidelines of the new logic of financing in the programming period in the years 2014–2020 together with the significance of mezzanine financing in creating sustainable regional and corporate development. The article presents an approach to sustainable development in the new logic of funding and mezzanine capital in the financing of environmental protection. It also dicusses the idea of funding by Polish Investments for Development as a new partner in the financing of investment in regions.

Supporting SMEs development is becoming one of the most significant elements of the country’s policy at various levels: the country as a whole, provinces (regions) or at the very local level. This reflects the EU priorities, the EU policy in the previous decade and it is also becoming a priority in the new programming period for the years 2014–2020. The purpose of the article is to indicate the prerequisites of stimulating the development of SMEs by means of financial instruments (other than banking capital) in the new EU programming period. The article presents the role and importance of loan funds as a financial intermediary supporting the development of SMEs. The paper also presents the idea of a new logic of intervention in the use of funds and construction of financial instruments by loan funds.

Despite positive contribution of the Common Agricultural Policy to their development, rural areas are still facing difficult development challenges – social and economic, environmental and territorial alike. On 1st January 2014, a new package of EU regulations entered into force, providing a new shape to the Common Agricultural Policy, and, consequently, to the policy of rural areas development. The new regulations reflect the European Union’s strategic goals, including the key goal for the next decade, namely a growth that would be intelligent, permanent and inclusive. Such a growth is to be achieved thanks to the intelligent and sustainable economy, part of which is agriculture.

The mechanisms provided for spending of the EU funds make it clear that interests realised within the European Union vary and are sometimes opposing. Still, the Member States want to provide the most appropriate and compliant with the law spending of the European funds. They are willing to provide, through regulations, rigorous requirements for spending of these funds, and to make the European Commission control their compliance with these regulations. If these regulations are breached, the European Commission is authorised to take supervisory actions, which include imposing financial corrections that ensure that money is returned to the common budget. In her article, the author presents and comments on the new regulations of the European Union adopted for the 2014-2020 programming period that set forth the rules for imposing financial corrections by the Commission on the EU Member States.

The paper examines the process of absorbing European Union funds earmarked for Polish enterprises for 2004-2006. The research is based on an in-depth analysis of statistical data obtained by institutions responsible for managing EU programs in Poland as well as the country’s Central Statistical Office (GUS). Reports, opinions and surveys prepared by Polish business executives were also taken into consideration. In the paper, Ostaszewskachecks if Polish companies benefitting from EU funds were in a position to absorb these funds properly and use them to build their competitive advantage. She notes that too few enterprises in Poland have taken advantage of EU funds. Besides most these funds have been invested in non-innovative projects, she says. On the plus side, Ostaszewska says, preliminary calculations show that all the EU funds earmarked for Polish enterprises for the 2004-2006 period have reached their beneficiaries, which means there is no threat that Poland could lose part of the EU support. Polish enterprises are only beginning to learn how to put EU structural funds to good use, Ostaszewska notes. This means that some mistakes in the 2004-2006 programming period were inevitable, she says. In the years ahead, Polish businesses should be able to learn from their mistakes and absorb new funds in a better way-one that will be more beneficial for the economy as a whole, Ostaszewska concludes.

         Aim: The implementation of numerous EU projects in the period 2014-2020 is bound to require that they are compliant with EU law, domestic law, relevant guidelines, programming documents, and the content of an agreement on co-financing a project. It is in this context that the issue of public aid should be examined. On the grounds that some EU projects are subject to the regime mentioned, what becomes vital is to comply with all binding regulations in this respect. It is in this delineated form that the legal form of regional investment aid should be considered. The aim of this paper is to examine individual material elements of which the legal construction mentioned above is composed – while taking into account existing legislation.   Research methods: The method that was adopted involves an analysis of the sources of law, case-law and literature.   Conclusions: (1) The problem of regional investment aid should be considered in terms of the Treaty definition of public aid. At the same time, one has to take into account the legal regime set by the TFEU on state aid. As a rule, this aid is prohibited; still, the EU legislator allows for a number of exemptions. (2) This, in turn, means that it is necessary to develop, by issuing other normative acts (but also soft-law regulations), the Treaty provisions which allow for providing legally benefits covered by state aid. (3) The legal form at issue here should be considered in the context of the need to ensure that beneficiaries will be implementing projects in accordance with the rules of EU law, domestic law, relevant guidelines, programming documents and the content of an agreement on co-financing a project.   Value of the paper: The set of issues examined is the subject addressed by case-law and literature. The value of the paper is that it systematizes all the elements discussed. The paper is addressed to the beneficiaries of EU projects, institutions participating in the system for managing and controlling EU resources and to administrative courts.

Artykuł jest poświęcony zmianom polityki spójności, szerzej: polityki rozwoju, w okresie 2014–2020. Autor analizuje postanowienia kluczowych dokumentów mających wpływ na ostateczny kształt polityki na omawiane lata. Analizuje też zjawiska, jakie mogą spowodować wyhamowanie zmian, upatrując ich przede wszystkim w skutkach niezdecydowania i łagodności służb zarządzających, tolerujących negatywne zjawiska typu następstwo celów i inne gry prowadzące ostatecznie do wydania środków zamiast osiągania celów. Artykuł zawiera też rozważania o tym, dlaczego i w jakim stopniu istniejące zagrożenia mogą ograniczyć rewolucyjny charakter od dawna oczekiwanych reform.
The paper is devoted to analysis of the changes of Cohesion policy (more broadly: development policy) in the period 2014−2020. The author analyzes key documents influencing final solutions for that period. On top of that, he analyzes phenomena that can hamper changes, in particular, indecisiveness and leniency of managing services, tolerating negative phenomena like goal substitution and other manoeuvres leading to money spending instead of goal attainment. The author also considers why and to what extent the analyzed hazards may reduce the revolutionary character of long expected reforms.
