Objectives: The core aim of this paper is to improve our knowledge base on the innovation process comparing how public and private organisations can develop abilities to innovate in order to cope with the challenges created by the changing priorities of the political market, the intensification of global competition and the higher speed of the technological changes. The authors intend to identify and compare the creative/learning capabilities of the workplaces in the EU-27 countries. Research Design & Methods: In testing empirically the various types of jobs our analysis uses the data sets of the fourth (2005), fifth (2010) and sixth (2015) waves of the European Working Conditions Survey (EWCS). The EWCS is a crosssectional survey taken in every five years since 1990, organised by the European Foundation for the Improvement of Living and Working Conditions (Eurofound, Dublin). The recent editions of this survey cover more than 40,000 workers in the EU member states and in various other European countries (Eurofound, 2017). We used a cluster analysis in order to identify three clusters of jobs in Europe and their prevalence in different countries and country groups. Findings: The data from the European Working Condition Surveys (2005, 2010 and 2015) shows that in the public administration boosts creative workplaces in all countries. The ability of organisations to mobilise their internal resources into efficient and dynamic routines depends on intangible resources (e.g. creativity) and less on such traditional tangible factors such as physical or financial sources. Powering public sector innovation is inhibited by the following major factors: unfavourable institutional settings; weak innovation leadership; lack of systematic knowledge of the innovation process; and a shortage of the systematic data collection at both the EU and Member State levels. Implications & Recommendations: The increasing rate of creative jobs may speed up the implementation of the “High-Engagement Civil Services” to improve both efficiency and quality of work in the public sector. A more profound and evidence-based understanding of the innovation processes at the workplace level would allow us to exploit the full potential thereof in terms of positive impacts on both employment and job quality. Contribution & Value Added: Despite the fact that innovation studies have been at the heart of socio-economic research for decades now, relatively little attention has been paid on innovation in the public sector. This research topic has gained more importance only in the 2010s and thus there is often a lack of empirical evidence for this sector, which plays a crucial role in all developed economies as a major employer as well as the main actor shaping the regulatory environment. This article is among the first attempts aimed at giving insights into the job characteristics of public sector organisations.

An agreement on public-private partnership is concluded in order to carry out public tasks. The responsibility for their appropriate performance lies with the public entity that has been equipped with legal instruments which allow for influencing the private partner. One of these instruments is the right of the public entity to audit the realisation of the undertaking in progress. Such audits are an important element of the contract on public-private partnership, since they contribute to the protection of public interest by providing a guarantee of achieving the contract’s objective.

Dla Habermasa sfera publiczna jest centrum życia społeczno-politycznego. Jest ona niejako buforem między społeczeństwem a płaszczyzną władzy i polityki. Właściwy jej kształt zapewnia możliwość trafnej oceny problemów i przekazywania ich do centrów decyzyjnych władzy. Sfera publiczna jest sferą prywatnych ludzi gromadzących się w publiczność, jednak nie jako biernych widzów, ale aktywnie włączających się w definiowanie i rozwiązywanie wspólnie tematyzowanych problemów. Jej ideał Habermas upatruje w XVIII-wiecznej sferze mieszczańsko-obywatelskiej, po której jednak następuje jej rozpad. Media stają się elementem opiniotwórczym i manipulującym publicznością.
For Habermas, the public sphere is the centre of social and political life. It is a kind of buffer between the public and the plane of power and politics. Its proper shape provides the possibility of accurate assessment of the problems and their transfer to the centres of decisions. The public sphere is a sphere of private people gathering as an audience, not as passive spectators, but actively participating together in defining and solving problems. The public ideal sphere is seen by Habermas in the eighteenth-century bourgeois-civic sphere, which, however, disintegrates. Element of influence and manipulation become part of the media.

RESEARCH OBJECTIVE: The main goal of this explorative study is to investigate the public perception of private healthcare providers in Kurdistan region in Iraq. Moreover, the research aims to test the questionnaire and research technique (face-to-face) interviews in terms of their usefulness and adequacy for a further representative survey, which is planned in the upcoming years. THE RESEARCH PROBLEM AND METHODS: The research problem is to analyze patients’ perception and satisfaction from healthcare services offered by private hospitals in Kurdistan region of Iraq. THE PROCESS OF ARGUMENTATION: Developing countries have an increasing difficulty in providing cheap and effective healthcare sector for the entire society. In this regard, the autonomous regions like Kurdistan are in a doublydisadvantaged position, as they have to overcome the problems of poor infrastructure, while designing a new health system, at the same time struggling with military conflict with ISIL. RESEARCH RESULT: The research result show surprising gaps in public knowledge about the private hospitals and their healthcare service quality. The study finds, among other, that the easiest way to improve patients’ satisfaction is to improve hygiene and cleaning standards in private hospitals. Although these findings are purely explorative, they should be taken into the account when designing a research project which should produce representative, reliable findings for the entire region. CONCLUSIONS, INNOVATION AND RECOMMENDATIONS: As there is no alternative to increase of the role of private providers in Kurdistan region, the regional authorities should monitor the quality of healthcare services offered by both public and private providers to ensure a reasonable standard of healthcare system. Thus, the further studies on healthcare market in Kurdistan should include comparisons between private and public providers.

The text discusses the context and background for development of public-private partnership in the education sector. This development is based in the concept of New Public Management (New Governance) widespreaded in the policy and practice of governments since 1980 s. The article discuses an example of involvement of non-public actors in providing education: The Private Financial Initiative (PFI). PFI has become the predominant model for building and operating of new schools in the United Kingdom. The British experiences have been employed by other countries as the number and volume of educational investments conducted in the PPP formula is steadily growing. This process has been illustrated by the relevant European Investment Bank data. The text also features the Polish approach to contracting out public education services i.e. when local authorities entrusts the operation of public school to a private entity. This concept corresponds with the idea of community schools where local communities become authentic owners of the school itself and its assets.

The study deals with the issue of using public-private partnership to implement public tasks. This article aims to assess the development of public-private partnerships in Poland. The publication also attempts to identify obstacles and threats that hinder the use of public-private partnerships in Poland. The enactment of new regulations contributed to development of public-private partnership in Poland. It resulted in 82 contracts for public-private partnership, which were implemented between 2009-2014. The weakness of the polish PPP market is the low efficiency of proclaimed proceedings. The sectoral structure and the low value of the projects differentiate the PPP market in Poland from the market in Europe and the world.

Sposób zagospodarowania terenu obok Centrum Sztuki Współczesnej (CSW) w Toruniu to przykład nowego w polskich warunkach modelu prywatyzacji przestrzeni publicznej. Przykład Torunia jest istotny dlatego, że pozwala zauważyć, jak w polskich warunkach działa partnerstwo publiczno-prywatne i marketing miejsca oraz jak w ramach jednego projektu powiązane zostają sfery kultury i konsumpcji. Przy okazji budowy CSW prywatny inwestor próbuje stworzyć centrum handlowo-kulturalne na terenie atrakcyjnego, choć zaniedbanego obszaru rekreacyjno-sportowego. Celem tekstu jest przeanalizowanie dynamiki sposobów i strategii stosowanych do przeprowadzenia procesu prywatyzacji przestrzeni publicznej.
The privatization of the Center of Contemporary Art (CCA) area in Torun allows us to observe relatively new processes in Polish urban reality. The case shows how private-public partnership and place marketing are constructed and how partners combine spheres of culture and commerce to realize the investment. Private investor, using the cultural arguments, tries to create a shopping mall in the recreation area located next to the historical center of the city. The aim of the paper is to analyze the dynamics of the process of privatization and strategies used to privatize the public space in an attractive district of Torun.

Discussions on the importance and opportunities of the public-private partnership have been taking place for many years. The article presents an analysis of public-private partnership which is usually considered a form of realisation of public tasks. It is less frequently regarded as a tool for introducing changes in the public administration as such. In their article, the authors emphasise the specific role that public-private partnership can play in designing public sector policies, and its application related to the lack of funds for effective realisation of public tasks. Public-private partnership allows then for changes in the public management model, by transforming public administration towards administration that is responsible for the whole society.

The adoption of the New Law for Local Government Financing is currently underway in a Serbian Parliament procedure. The goal of the new law is the creation of clear government regulations which will define the system of financing for local government entities. This will furthermore create an environment of stability and predictability with regard to revenue planning when preparing local government entities’ budgets, as well as achieving a vertical balance when distributing revenues amongst various state levels. Additionally, these goals are reflected in the establishment of a system to increase the share of public investment in the total expenses of counties and cities, as well as in the vertical balance with regard to the distribution of revenue and jurisdiction at various state levels. In that sense, it is preferable to understand financial models such as public-private partnerships, which have still not, to an adequate degree, been adopted in Serbia, but one which could potentially contribute to the introduction of additional sources of local government financing. In order to better perceive the current capacities of this model of financing local government in Serbia, a study was conducted during the spring and summer of 2016, taking into account a sample of 150 examinees. The results of the study indicate very low human resource and technical capacities in local government with regard to realizing and comprehending the concept of public-private partnership.

The development of public-private partnership is especially important in the present financial situation of the state. The growing public debt (that reaches almost 1 billion zlotys) and the costs of its servicing, pose a threat to budget liquidity. Limited finances for public services and investments have become more and more visible. Public-private partnership may be a potential antidote for this situation. Businesses’ involvement in providing public services results, in turn, in an economic revival in financial institutions, which should more and more influence the development of the public-private partnership. When we compare threats and benefits, the latter outweigh (which was clearly communicated in the findings of this audit of NIK).

The article focuses on the issues and problems caused by the economic crisis of 2008 for public-private partnership (PPP). The challenges faced are presented from the point of view of a public entity, a private partner and a financial institution, as well as the relationships between these parties and the influence of economic issues on these relations. The most crucial of these challenges seems to be: the pressure on public finance and growing difficulties in financing the public infrastructural investments, the rise of the economic risk of investments and the necessity of sufficient and appropriate transfer and management of risk, and finally – the lack of interest of financial institutions to finance long-term liabilities. The aim of the author is to provide a precise description and diagnosis of the issues mentioned above, which might improve the strategic management of PPP market as well as management of projects. The article is based on experience, documents and working papers concerning the countries and markets of the European Union but the presented conclusions should be of more universal nature.

Over the last two decades the attention given to the research on Public-private partnerships (PPPs) has been steadily increasing. Literature surveys on the research trends of PPP in English language publications suggest some emerging trends in the topics dedicated to the PPP. A similar compilation of PPP literature is not readily available on the grounds of national scientific research. That is why the aim of the article is to present contemporary trends that are being developed in Poland in the PPP filed. The indication of possible further research in the area of PPP is also an essential issue tackled in this article.

This article presents the main difficulties surrounding private enforcement of antitrust law in Poland, currently the key implementation problem in the field of antitrust law. Whereas the basic standards concerning the public pillar of antitrust enforcement have already been established, either in the European Community (EC) or in its Member States, the private pillar of antitrust enforcement has not yet been fully developed. The fact that private enforcement of antitrust law is possible, and in fact equal, to public enforcement is not yet commonly recognized. In response to the European Commission’s White Paper on Damages actions for breach of the EC antitrust rules, private enforcement of antirust law is presently under intense discussion in EC Member States. This article should be considered as one of the contributions to this debate. It presents the main legal framework of private enforcement of antitrust law in Poland. In order to do so, it directly refers to the Polish Act on competition and consumer protection, the Civil Code and the Civil Procedure Code. This article also discusses Polish case law in this area. It aims to assess whether existing Polish legal provisions are, in fact, sufficient to ensure effective private enforcement of Polish as well as EC antitrust law. The article refers to the main proposals of the European Commission’s White Paper. It is concluded that private enforcement of antitrust law is indeed possible in Poland on the basis of currently applicable procedural rules, even if there are no special instruments designed to facilitate it. However, it cannot be expect that in the current legal climate, private parties will eagerly and frequently apply for damages in cases of a breach of Polish antitrust law. Antitrust cases are special in many aspects and, thus, they require specific solutions in procedural terms. This article aims to pinpoint those areas, where the Polish law needs to be changed in order to develop and promote private enforcement of antitrust law in Poland.

The delicate balance between the private and the public sphere affects families in a unique way, whose social place is to be found at the border of the two. Families are fundamental resources for the public – primarily due to their capacity to reproduce – however, they also rely strongly on the frameworks provided by the public. The latter affects especially the time schedule of families. Two current events have also challenged the sensitive balance between the two speres. The COVID-19 pandemic pushed certain public roles and activities over to the private sphere due to social distancing rules and compulsory lockdowns. Meanwhile, the energy crisis caused by the war delegates these public roles and activities to the private sphere.

Ogólny zarys finansów publicznych w śląskich samorządach przedstawia trudną sytuację w tym regionie. Wydatki w ogólnej wysokości przewyższają uzyskiwane dochody. Ujemne wyniki finansowe oraz wysoki poziom zadłużenia wymuszają poszukiwanie nowych metod realizacji zadań publicznych. Duże zalety w tej dziedzinie ma metoda partnerstwa publiczno-prywatnego. Obecnie na Śląsku realizowanych jest najwięcej projektów w tej formule, jednakże nie we wszystkich jednostkach. Perspektywy rozwoju oraz ograniczenia tejże metody w województwie śląskim są oparte na wynikach badań ankietowych.
An overview of public finances in the Silesian local government shows the difficult situation in the region. Expenditure the total amount exceed the revenue generated. Negative financial results and a high level of debt to enforce searching for new method implementation of public tasks. Many of advantages in this field has a method of public-private partnerships. Currently in the most implemented projects in this formula, however, not in all units. Development prospects and limitations of that administrative methods are based on the results of the survey.

The subject of the review is a monograph focusing on looking for the causes and determinants of changes taking place in the education system of sociologists in Poland. In the publication, its author presented the results of theoretical analysis and conducted empirical research. The research is in-depth and consistent in a methodological sense, and the approach to the description, diagnosis and interpretation of the most important thematic problems is balanced. The paper presents the leading trends and dynamics of educating Polish sociologists in a comparative aspect, relating to public and private universities. The cognitive and application values of the monograph are the basis for the search for solutions increasing the importance of sociological education in Poland.

Opis:
Public-Private Partnership (PPP) is a form of cooperation between the public sector and the private in order to carry out projects or services traditionally supplied by the public sector. This mode of investment is most commonly applied to the creation of technological infrastructure projects. According to the author PPP will allow coastal tourist communes (gminas) to speed up the implementation of the communication infrastructure, and the sport and recreational infrastructure which are presently major barriers to the development of the tourist economy. This is further confirmed by examples presented in this work.

W grudniu 2012 roku brytyjskie ministerstwo skarbu opublikowało wizję zmiany obowiązującego systemu partnerstwa publiczno-prywatnego (Private Finance Initiative – PFI) na nowy model o nazwie Project Finance 2 (PF2). Celem opracowania jest przedstawienie istoty oraz przyczyn tej reformy oraz wskazanie możliwości wykorzystania doświadczeń brytyjskich w rozwoju partnerstwa publiczno-prywatnego w Polsce. Artykuł charakteryzuje cztery główne kierunki zmian w systemie brytyjskim, tj. (1) zwiększenie wskaźnika value for money, (2) poprawę transparentności i centralizację zarządzania przedsięwzięciami, (3) zwiększenie efektywności projektów poprzez wzrost wiedzy na temat formuły PPP i rozwinięcie standaryzacji umów oraz (4) poprawę elastyczności realizowanych inicjatyw na poziomie operacyjnym. Opracowanie identyfikuje podstawowe słabości partnerstwa w Polsce – niewystarczający poziom wiedzy o istocie partnerstwa wśród potencjalnych stron umowy, niedostateczną wiedzę w zakresie ekonomii i zarządzania inwestycjami po stronie kadr podmiotów publicznych oraz niski poziom standaryzacji projektów PPP. Wzorując się na reformie brytyjskiej, przedstawiono również rozwiązania mające na celu ograniczenie tych barier, np. opracowanie systemu rozwoju kompetencji urzędników państwowych oraz rozwój standardów dobrych praktyk obowiązujących w projektach PPP.
In December 2012, the British HM Treasury published a document aiming to change the current system of public-private partnership (Private Finance Initiative – PFI), into a new model called Project Finance 2 (PF2). This paper presents the essence of and the reason behind this reform and indicates the possibilities of using British experiences in the development of public-private partnership in Poland. The article characterizes four major trends in the British system, being (1) to increase the rate of value for money, (2) to improve the transparency and centralization of project management, (3) to increase the efficiency of projects through the increase of knowledge on PPP and by developing standardization of contracts, and (4) to improve the flexibility of ongoing initiatives at the operational level. The study identifies fundamental weaknesses of the partnership system in Poland – the insufficient level of knowledge about the partnership system among the potential parties within a contract, insufficient knowledge of economics and investment management among public entities officials and the low level of PPP projects standardization. Furthermore, following the example of the British reform, the study recommends solutions to these barriers, such as introduction of public officials’ competence development system and development of standards of good practices in PPP projects.

Celem artykułu jest analiza korelacji pomiędzy przesłankami podejmowania współpracy publiczno-prywatnej a uwarunkowaniami realizacji projektów w formule PPP. Literatura przedmiotu wskazuje szerokie spektrum determinant wyboru PPP w podejmowaniu projektów inwestycyjnych przez sektor publiczny. Wiedza na temat determinant pozwala na eliminację kluczowych barier rozwoju, a także na tworzenie odpowiednich regulacji prawnych dedykowanych PPP. Wyniki przeprowadzonych badań wskazują na dużą liczbę determinant podejmowania współpracy w formule PPP, które są w dominującym zakresie (przez swą mnogość) słabo skorelowane z badanymi uwarunkowaniami realizacji projektów w tej formule.
The aim of the article is analysis of the relation between the premises of undertaking public-private cooperation and the conditions for the implementation of PPP projects. The literature on the subject indicates a wide spectrum of determinants in PPP selection in the implementation of investment projects by the public sector. Knowledge about determinants allows for the elimination of key development barriers, as well as the creation of appropriate legal regulations, public institutions dedicated to PPP, promotion of the partnership by the government among administration employees. The results of the conducted research indicate a large number of determinants of cooperation in PPP, which are in the dominant range (by their multitude) poorly correlated with the researched conditions for the implementation of projects in this formula.

This article concerns distinct contexts of schooling for migrant children who are enrolled in private and public educational institutions in Poznań, Poland. In my study, I recognized that although the schools have different methodologies and languages of instruction, teachers expect the same obvious and predictable patterns of migration – either the children will stay in a country permanently or the children will immigrate somewhere else. This factor – educator expectations – can have more consequences on migrant children’s experiences than the differences between type of school – public or private. The exploratory fieldwork was conducted twice, once in 2010 and once 2013, in the same schools with the same group of students and teachers. In the article, I tried to address some obvious and unobvious practices of schools concerning migrant children, such as the myth of the language barrier as a main obstacle to learning, the lack of basic knowledge about countries of origin, the ignorance of multiculturalism as well as the phenomenon of individual treatment in both types of schools. In the recommendations, I give suggestions on how to perceive a migrant child as a strong and influential personality and how schools could conform to liquid migrations.

The article focuses on the construction of public roads in Poland. In the introductory section the basic rules for financing such investments are discussed. It is highlighted that investment in road infrastructure is very expensive for the state budget and local government, even with financial support from the EU funds. In this context, public legal partnership (PPP) has become a very useful and cost-effective institution for carrying out public tasks. This article describes the possible partners of PPP and the legal nature of the related contract, highlighting the three main types of public-law partnerships that can be applied to the construction of public roads in Poland. The article concludes with recommendations regarding legislation governing the construction of public roads and public-private partnership.
