The present paper concerns translation of legal language as an act of communication and constitutes an attempt to reconstruct the presuppositions of legally binding statements that appear in messages which are sent in legal language and which are read on the directive level. The problem of the binding of a legal act might seem irrelevant from the point of view of translation. This is so because the descriptive layer of a message does not change depending on whether a given norm enters into force or not, or whether it loses its binding power or not. However, the sender of a message in legal language does not send a message devoid of information concerning legal binding. The latter is the main constitutive element of every message sent in legal language, which in turn results in communication based on presupposition.

A contrastive study can be designed as a presentation or investigation procedure. In the present contribution, they are used in a complementary way by additionally examining the already numerically divergent pure cases of German and Polish with respect to their differing syntactic roles. Particular attention was paid to the individual language-specific case change – preferably in the active-passive diathesis, under the influence of negation, and in relation to numbers / measures and quantities.

Dependent type theory has been applied to natural language semantics to provide a formally precise and computationally adequate account of dynamic aspects of meaning. One of the frameworks of natural language semantics based on dependent type theory is Dependent Type Semantics (DTS), which focuses on the compositional interpretations of anaphoric expressions. In this paper, we extend the framework of DTS with a mechanism to handle logical entailment and presupposition associated with factive verbs such as know. Using the notion of proof objects as first-class objects, we provide a compositional account of presuppositional inferences triggered by factive verbs. The proposal also gives a formal reconstruction of the type-distinction between propositions and facts, and thereby accounts for the lexical semantic differences between factive and non-factive verbs in a typetheoretical setting.

According to Kaplan’s bidimensional theory of demonstratives, the descriptive content of any indexical term (and the sentences they appear in) is only employed to determine its reference in any possible world rigidly but cannot be expressed by the sentence’s truth conditions. Kaplan then argues that an indexical sentence’s informativeness depends on what he calls its character, a property of the context that relates a particular context to a concrete content, but it cannot be a part of the proposition the sentence entertains (its content), primarily given the logical inconsistencies the opposite would show in the theory of conditionals and counterfactuals. I agree with Kaplan that indexicals should not be considered disguised descriptions. Nevertheless, I believe that their content is informative and, therefore, part of the proposition these sentences express, even though that implies accepting the existence of content shifting operators within the same context --what Kaplan dubbed monsters. This paper, therefore, presents an alternative account to indexical terms and sentences employing the Interactive Theory introduced in Colomina-Alminana (2022). This approach considers that the meaning of any sentence, the proposition it expresses, depends upon three interrelated factors: the speaker’s intentions when uttering, the audience’s potential uptakes of such statement, and the conventions established by the speech community both speaker and audience belong, or the linguistic interaction takes place. The critical element is the so-called speaker's point of view, an objective perspectival networking background that allows lexical and syntactic mechanisms to trigger and update potential conceptual presuppositional content shared by both speaker and audience and whose existence is prior to any context and circumstances.

The main aim of this article is to show the problem of presupposition from the side of the logical analysis of language. Deliberations on the topic derive from the nineteenth century and are connected to Gottlob Frege. In his work titled "On sense and reference", he asks how the expressions with a referring function should be translated into logical language. He also emphasizes "assumptions for the existence of referent (designation)", whose characteristic feature is that their authenticity is a crucial condition to provide a sentence with a logical meaning. Therefore, Frege highlighted the crucial feature of presupposition that is constancy under negation. However, Frege's concept lacks unity when it comes to the level of the language on which the assumptions should be made. An opposing view on presupposition is presented by Russell and his idea of definite descriptions, which solves the problem of sentences with non-existent subject terms, of which Frege's language philosophy does not provide a precise explanation. Russel claims that denoting phrases can be expressed in the form on conjunction of the value of the sentence and thus sentences predicating on something that does not exist happen to be false. However, Russel's view differs from the one presented by a twentieth-century philosopher, Peter Strawson. The latter maintains that the problems mentioned derive from the fact that scholars do not notice the difference between sentences and sentences used to have an assertive meaning and, consequently, that the sentences cannot be true or false since this is a characteristic feature of statements. He also emphasizes a connection between them, in which one statement is a primary condition to give a logical value to another statement. Strawson called the phenomenon a presupposition and claimed that it can be recognized as a specific kind of pragmatic deduction/presupposition. The article focuses on showing the three views on presupposition on the grounds of the philosophies of language presented by scholars mentioned above.

In Section 2 of his paper (which follows the introductory section) Gary Malinas „summarises three arguments that have been advanced in recent discussions of free agency and responsibility. The first concludes that free agency and responsibility are incompatible with determinism. The second concludes that free agency and responsibility are incompatible with indeterminism. The third concludes that the concept of a free and responsible agent is incoherent. Taken collectively, they entail the conclusion of the practical sceptic: No one acts freely and responsibly. If the summary case can be filled out so that it is sound, it undercuts a number of the commitments of the thick conception of persons the fulfilment of which, arguably, is required for free and responsible action. I believe that the summary case can be filled out so that it is sound. I will adopt this belief as an unargued assumption. It entails that no one acts freely and is truly responsible for their actions. I also believe that it is true that people act freely and responsibly. Once the case for practical scepticism has been put, I devote the remainder of this paper to the vindication of this latter belief. My claim is that practical scepticism is sound, yet nevertheless, it is also true that people act freely and responsibly. The onus of the vindication will be to disarm what appears to be an explicit contradiction. Section 3 proposes a definition of free and responsible action in terms of the concept of exculpation. It argues that judgements concerning agents' responsibility for their actions are often true under the presuppositions which are in place in the settings in which the judgements are made. Those presuppositions restrict the domains over which the judgements are semantically evaluated. The practical sceptic contests those presuppositions and thereby alters the domain of semantic evaluation. Under the influence of sceptical argumentation, possibilities of exculpation which had been properly ignored can no longer be ignored. Section 4 sketches an account of presupposing and when exculpatory possibilities are properly ignored. Section 5 considers the question of whether I have conceded too much to the practical sceptic”.

Discursive and communicative strategies of persuasion in opinion forming media: the case of film reviewsThis study aims at analysing the discourse as a way of using language for specific purposes. On the basis of a corpus consisting of forty reviews of the French comedy Intouchables (2011) selected from various film magazines and web pages, the author offers a reflection on the nature and functions of the genre “film review”. Thus, different invariant elements of the mentioned genre can be established in the light of discursive and communicative strategies whose persuasive dimension is connected both with the presence of informative and evaluative elements about the film and the situation of the participants. Thanks to the described strategies, activating various kinds of hidden and connotative meaning i.e. implications, presuppositions, cultural associations, the journalist contributes to the co-creation of human perception.

The language of politics (in its numerous variations and forms) continues to be one of the fundamental objects of political science research. The academic analysis of this object of research, however, continues to generate considerable difficulties for political science as a result of the incompatibility of language studies methodology with the function and tasks of modern political science. Therefore, there emerges a need to develop a method of text analysis for political science that will allow us to use language to discover and present the assumptions that shape the attitudes and ideologies of political entities, or in other words – the content of general political environment. This paper responds to this need by presenting a method that distinguishes three basic levels of analysis: a conventional layer of text, a descriptive one and a presuppositional one. Analyzing the inaugural addresses given by Polish presidents the specificity of their individual dimensions is presented: the situational determinant (level one), the creation of content to boost image (on a descriptive level), and – most importantly to the political scientist – a mechanism revealing the assumptions concealed at the presuppositional level.
Jednym z fundamentalnych przedmiotów badań nauki o polityce pozostaje niezmiennie język polityki (w swoich licznych odmianach i formach). Analiza naukowa tego przedmiotu badań przysparza jednak politologii nadal szereg problemów, wynikających z nieprzystawalności metod językoznawstwa do funkcji i zadań współczesnej nauki o polityce. Pojawia się więc potrzeba wypracowania politologicznej metody analizy tekstu, która to metoda pozwoliłaby – za pomocą języka – odkryć i wyeksponować założenia kształtujące orientacje i postawy podmiotów politycznych, czyli treści tworzące ogólną przestrzeń polityczną. Propozycją odpowiedzi na to zapotrzebowanie jest prezentowana w artykule metoda, wyróżniająca trzy podstawowe poziomy analizy: konwencjonalną warstwę tekstu, opisową oraz presupozycjalną. Na przykładzie analizy inauguracyjnych orędzi polskich prezydentów, ukazano specyfikę poszczególnych wymiarów: determinant sytuacyjny (na pierwszym poziomie), kreację treści korzystnych wizerunkowo (na poziomie deskryptywnym), wreszcie – najistotniejszy dla politologa – mechanizm odkrywania założeń ukrytych na poziomie presupozycjalnym.

In the canon law doctrine there is an agreement regarding the fact that the notion of legal accountability is wider than sanity. Legal sanity is based on previous existence of physical, psychological, moral and legal sanity and it means theoretical and practical judgement on the basis of which we assign a given person as an author concrete activity which is conscious and voluntary and which infringes moral norm or criminal regulation or criminal order. Consequently this subject must bear responsibility before the society. Pursuant to the canon 1321 § 2 of the Canon Law we distinguish two sources of legal sanity: wilful misconduct and negligence. Presumption of sanity is the supposition of freedom of the man who infringed a given legal regulation. This canonical presumption is based on the supposition that man, as a rule, is accountable for his actions because, as a rule, he acts freely.

The point of departure for the considerations of the literary topos undertaken here has been the definition of this concept suggested by A. Okopień-Sławińska. We have found thirteen terms concerning the topos in it (common places, oratorical phrases, schemes of proving and of persuasion, permanent ways of elocution, permanent images, permanent motifs being a proof of continuity of the tradition, permanent motifs being externalization of archetypical patterns, settled formulations of certain subjects, model examples of filling certain places of speech, oratorical tricks, forms of elocution, forms of argumentation, forms of imagery). We have made an attempt to order them according to an accepted criterion, to put them in a hierarchical order (we treated this kind of ordering separately) and to educe them from the general formula of the topos. To order the terms we have used the differentiation introduced by G. Prince between the topos – an empty form (forme vide) and the topos – a form filled with contents (forme remplie). We have broadened the definition of the topos with the aspect of narrativeness, according to what had been settled on the ground of SATOR (configuration narrative recurrente). In our considerations we nave revealed a new aspect of the literary topos, that is its persuasiveness. It had not been included in Okopień-Sławińska's definition, or in the satorian one. Avoiding the danger of identification of the two different conceptions of the topos (Aristotle's and Curtius' ones) we accept the assumptions of the new rhetoric, according to which every statement, also the one having a topic structure, has a persuasive character.

Aim: The aim of the thesis is to introduce the concept of presupposition and present its use in the context of language manipulation in the media on selected examples. The article presents the variety of presuppositions as a linguistic form. The work also shows the multitude of types of this pragmatic figure. Method: Qualitative analysis was used to approximate the technique of using presupposition as a form of manipulation. Two examples that appeared in the media discourse were subjected to extensive qualitative research. An important aspect of the analysis is also to show the context of the statement, so that the recipient is aware of how and under what circumstances the message occurred. Results: The analysis showed how people of the media and politics use presuppositions to communicate their judgment in the subconscious mind without showing it directly. The diversity of this pragmatic figure contributes to the diversity of its applications in media discourse. Conclusions: Skilfully used presupposition is an excellent manipulative practice. Exploring this topic will contribute to expanding the awareness of the recipients of media statements, who, without proper knowledge, become good material for the use of manipulative practices. Presupposition, due to its specificity, is not easy to decipher, which makes it an interesting subject of research in the context of manipulation.
Cel: Celem pracy jest przybliżenie pojęcia presupozycji i przedstawienie jej użycia w kontekście manipulacji językowej w mediach na wybranych przykładach. Artykuł przedstawia różnorodność presupozycji jako formy językowej. Praca ukazuje również mnogość rodzajów tej figury pragmatycznej. Metoda: Analiza jakościowa posłużyła do przybliżenia techniki posługiwania się presupozycją jako formą manipulacji. Szerokiemu badaniu jakościowemu poddane zostały dwa przykłady, które zaistniały w dyskursie medialnym. Ważnym aspektem analizy jest również ukazanie kontekstu wypowiedzi, dzięki czemu odbiorca ma świadomość, w jaki sposób i w jakich okolicznościach przekaz zaistniał. Wyniki: Analiza wykazała, w jaki sposób ludzie mediów i polityki stosują presupozycje, by w podświadomości odbiorcy zakomunikować swój osąd, bez ukazania go w sposób bezpośredni. Różnorodność tej figury pragmatycznej przyczynia się do różnorodności jej zastosowań w dyskursie medialnym. Wnioski: Umiejętnie zastosowana presupozycja stanowi doskonałą praktykę manipulacyjną. Zgłębianie tego tematu przyczyni się do poszerzenia świadomości odbiorców wypowiedzi medialnych, którzy nie posiadając odpowiedniej wiedzy, stają się dobrym materiałem do stosowania praktyk manipulacyjnych. Presupozycja ze względu na swoją specyfikę niełatwa jest do odszyfrowania, co czyni ją interesującym przedmiotem badań w kontekście manipulacji.

Harmonizacja polskiego prawa ochrony środowiska z unijnym environmental acquis zmieniła praktykę prowadzenia wykładni tych przepisów, nakierowując ją na efektywność. Obok aspektu ukierunkowania na cel regulacji, interpretacja przepisów prawa ochrony środowiska, od Traktatów unijnych począwszy, a na aktach wykonawczych skończywszy, wymaga jednak wzięcia pod uwagę ich ducha, systematyki i brzmienia. Na takim tle pojawia się pytanie: co oznacza interpretacja przepisów „w duchu prawa ochrony środowiska”? W przedmiocie tym postawić można trzy tezy: 1) Wykładnia przepisów w duchu prawa ochrony środowiska powinna być prowadzona w kontekście ochrony środowiska jako systemowego celu; 2) Właściwe skonstruowanie podstawy decyzji w sprawach dotyczących środowiska wymaga identyfikacji i harmonizacji kontekstów, w jakich osadzony jest interpretowany przepis (reguła potwierdzania); 3) Wykładnia przepisów prawa ochrony środowiska, powinna dążyć do odczytania wartości założonych u podstaw tego prawa („presupozycji aksjologicznych”).
Harmonisation of the Polish law of environmental protection and the EU environmental acquis has changed the practice of how the rules are interpreted,  directing it into efficiency. However, along with being directed towards the objective of the legislation, the interpretation of the provisions of the environmental protection law, from the EU Treaties to the implementing acts, requires that their spirit, taxonomy and wording be equally taken into account. In the light of the above, the following question arises: what does the interpretation of rules „in the spirit of the environmental protection law” mean? In this regard, three arguments may be put forward: 1) the interpretation of the rules in the spirit of the environmental protection law should be conducted in the context where environmental protection is regarded as the system objective; 2) the proper construction of the grounds for a decision in cases regarding the environment requires that the contexts of the interpreted regulation be identified and harmonised (the corroboration rule); 3) the interpretation of the provision of the environmental protection law should be aimed at identifying  the underlying values of the law („axiological presuppositions”).

When it comes to language, it’s not just the grammatical structure and the literal meaning of words that matter. The way a predicate imposes inferences on its propositional arguments is crucial to understanding the true meaning of a message. However, these inferences are influenced by many factors, such as prosody, world knowledge, speakers’ expectations regarding language use, situational stereotypes, and other implicit or contextual elements.In this paper, we examine the inferential status of the verbs referred to by Karttunen as “implicative verbs”. On the one hand, two-way implicative verbs, and on the other, one-way implicative verbs. The latter have been little studied from this perspective. This will lead us to highlight the fundamental role, too often forgotten, of prosody and focus/theme in this type of analysis and in determining the inferential status of predicates. Our analyses show that, once prosody has been considered, the classification of theoretically possible verb inferences accepted until now needs to be modified. We do not have 4 groups of one-way implicative verbs, as has been argued, but 2, namely the groups: [+/+/– // –/–] [affirmed > true or false // denied > false] of the type être capable, pouvoir and [+/+/– // –/+] [affirmed > true or false // denied > true] of the type hésiter à.The remaining two groups, considered as distinct and autonomous one-way implicative verbs with the suggested characteristics: [+ + // – +/–] [affirmed > true // denied > true or false] of the type forcer to and [+ – // – +/–] [affirmed > false // denied > true or false] of the type refuser de, belong to the canonical groups of two-way implicative verbs, respectively: forcer à to the group of verbs of the type réussir à: [+/+ // –/–] [affirmed > true // denied > false] and refuser de to the group of verbs of the type oublier de: [+/– // –/+] affirmed > false // denied > true].Naturally, this classification differentiation, important as it is, only reflects the different behaviour of certain types of predicate, and this is the most important element of these analyses with a view to automating the recognition of predicate inferences.

Opis:
The paper discusses some problems of translation from Serbian to Polish in the framework of sociolinguistic and cognitive research. The material consists of statements that include identification markers present in the speech of some characters from the novel “Russian Consul” by Vuk Drašković. In the corpus, there are 38 dialogues from the original work and the same 38 ones from the Polish translation which contains the distinctive features of a characters’ speech (the two variants of Serbian language, dialectic differentiation, improper communication of Albanians in Serbian and the interference of Russian with Serbian). With the use of the methodology that compares the language of both the original and translated text we can show formal and contextual differences between them.

Following the linguistic turn in analytical philosophy, concern for language underlies some of the most important strands of philosophical practice, making issues of mind, language and discourse virtually inseparable elements of scientific inquiry. Just as philosophy looks to language and linguistics to endorse different ontological and epistemological postulates, linguistics looks to philosophy in addressing its key questions of meaning, function and use. In this paper I argue that pragmatics and discourse analysis are areas where the relation between language, linguistics and philosophy is particularly salient. Crucially, philosophy, its conceptions and frameworks, should never be viewed as ‘external’ to discourse. Rather, discourse and discourse study involving pragmatic tools are, in themselves, areas of intense philosophical practice. Results of this practice are relevant and of interest to not only language philosophers, but also to those exploring ontological and epistemological matters of general philosophy.
