    Opis:
    The fundamental rights and freedoms, as the highest values in a democratic society, need to be adequately protected, thus states create the mechanisms to protect them. This mechanism of protection of fundamental rights and freedoms also includes the police, especially the Police Force, whose primary task is to protect the life, health, fundamental rights and freedoms of citizens and individuals in the Slovak Republic. The role of the Police Force defining the basic aspects forms the content of this study, with a further focus on the tasks performed by the police. Following the above, the study focusses on the activity of police officers, carrying out service actions and interference with fundamental rights and freedoms. The procedure of the police in carrying out service actions tends to be the subject of further examination due to their appropriateness and legality. This issue is considered highly serious in the society, and recently it has been a subject of not only scientific discussions in the Slovak Republic. Currently, the Academy of the Police Force in Bratislava is carrying out a research project which focussing on service actions with the cooperation of the police experts. The core material is presented in the paper, which aims to point out the basic organisation and activities of the Police Force as the authority responsible for the protection of fundamental rights. The emphasis is put on the selected issues of the police while interfering in human rights and freedoms. Chronologically, from general to specific matters, the paper introduces fundamental rights and freedoms and the police interventions into this area. Theoretical research is supplemented by practical cases, conclusions and possible recommendations for the police practice by the use of several methods, in particular analysis, abstraction and deduction.

    Opis:
    W XXI w. możemy zaobserwować przeobrażenia wynikające z niezwykłej jak dotychczas w historii ludzkości skali postępu cywilizacyjnego. Także w świadomości społecznej zachodzą gruntowne przemiany dotyczące wielu obszarów życia społecznego, zwłaszcza tych, gdzie dotychczas dominowały stereotypowe, konserwatywne poglądy. Jeszcze kilkadziesiąt lat temu wytatuowaną osobę utożsamiano z kryminalistą, w najlepszym zaś razie z określoną subkulturą. Obecnie, w związku z różnymi trendami w modzie, także w dziedzinie tatuażu, osoby z „rysunkami na ciele” nie budzą już tyle negatywnych emocji. Zagadnienie posiadania tatuaży przez policjantów dotychczas nie było przedmiotem zainteresowania naukowego. W niniejszym opracowaniu przedstawiono fenomen zjawiska na przykładzie prawodawstwa wybranych państw europejskich w aspekcie policyjnej pragmatyki służbowej.
    In the 21st century we are observing transformations due to an unprecedented scale of progress in civilisation. Profound changes are taking place in many areas of social and public life, especially those hitherto under the predominant influence of stereotypical, conservative views. Only a few decades ago, a person covered with tattoos was thought to be a criminal, or at best a member of a specific subculture. Nowadays, thanks to a wide variety of fashion trends including tattoos, eyebrows are no longer being raised at the sight of “body art people.” Up to now tattooed policemen have not been a subject of scientific interest. This article presents the phenomenon by looking at the legislation of selected European countries from the pragmatic aspect of service in the police force.

    Komunikacja wewnętrzna w Policji stanowi fundament skuteczności jej funkcjonowania, a także określa ramy wewnętrznych procesów w komunikacji zachodzących w tej organizacji. Bez odpowiedniej komunikacji w Policji różne jej zasoby przestają być użyteczne. Stąd sprawne zarządzanie wymaga stosowania właściwych instrumentów komunikacyjnych w celu bieżącego wspomagania kierowania, stosowania właściwych metod porozumiewania się, wspomagających system motywacyjny oraz wykorzystywania instrumentów komunikacyjnych w celu identyfikowania potrzeb rozwojowych kadry kierowniczej. Celem niniejszego artykułu jest zaprezentowanie istoty komunikacji wewnętrznej i jej percepcji przez samych policjantów. Zamierzeniem autora było wskazanie, jaką rolę pełni komunikacja wewnętrzna w aspekcie informowania i komunikowania się policjantów między sobą. Ponadto autor wskazał na procesy komunikacyjne, które zachodzą w relacjach pionowych pomiędzy poszczególnymi jednostkami i komórkami organizacyjnymi Policji. Wsparł się przy tym wywiadami przeprowadzonymi w pracownikami Policji Komendy Miejskiej Policji w Poznaniu.
    Internal communication is the cornerstone in police force. It improves its functioning, and also provides a framework for internal communication processes taking place in this organization. Without adequate communication in its various resources, police force is no longer useful. Hence, effective management requires the use of appropriate communication tools to support current management, the use of the appropriate methods of communication, motivation and support system using communication tools to identify the development needs of managers. The purpose of this paper is to present the essence of internal communication and its perception by police officers themselves. The author's intention was to identify the function of internal communication in terms of informing and communicating between police officers. Furthermore, the author focuses on the communication processes that occur in the vertical relationships between individuals and the organizational units of police force. This is supported by the interviews carried out in the City Police Headquarters in Poznań. Keywords: police force, internal communication, public relations, management system.

    At the foundation of this research lies the belief that the sex can directly differentiate the perception of counterproductive behavior at work and also can be a moderator of the influence of different variables on the perception of counterproductive behaviors. The survey research was carried out in June 2017, with the use of Internet-based survey questionnaire (CAWI). There were altogether 198 police officers examined. The hypothesis of the occurrence of the dependence between the sex and the perception of counterproductive behaviors was subjected to verification. The chi-square test of independence and test of significance of differences between means were applied. The conclusions following from the research offer significant implications for elaboration of relevant procedures in the sphere of managing human resources in the police force, among others, with the aim to have the principle of equality of chances and that of equal treatment of women and men respected.

    Prezentowany tekst poświęcony został analizie zmian sytuacji kadrowej Policji w kontekście najmłodszych stażem funkcjonariuszy i stanowi głos w dyskusji na temat procesów kadrowych, jakim w tym zakresie podlega Policja. Analizy oparte zostały na danych udostępnionych przez Komendę Główną Policji w portalu https://dane.gov.pl/ i dotyczą informacji na temat grup wiekowych oraz stażu służby funkcjonariuszy policji w latach 2005-2021. Obejmują one również dane dotyczące liczby przyjęć i odejść ze służby w tym okresie (z wyjątkiem roku 2012 – brak danych). Przeprowadzone analizy pokazały, że sytuacja kadrowa Policji jest trudna, choć w liczbach bezwzględnych nie widać istotnych problemów kadrowych. Procesy, które miały miejsce w ostatnich latach, doprowadziły do sytuacji, w której w perspektywie czasu Policja może się zmagać z istotnym brakiem funkcjonariuszy. Obecnie poziom rekrutacji najmłodszych funkcjonariuszy jest niski (choć zdaje się rosnąć) i nie gwarantuje uzupełnienia potencjalnych braków wynikających z faktu, że coraz większą część ogółu policjantów stanowią funkcjonariusze starsi, którzy mają prawa emerytalne.
    The article presents an analysis of changes in the staffing situation in the Polish police force in the context of the youngest officers in service, and is a voice in the discussion on the personnel processes in the police force in this respect. The analyses were based on data made available by the Police Headquarters at https://dane.gov.pl/ and focus on information on age groups and length of service of police officers in the years 2005-2021. They also include data on the number of police officers admitted to service and leaving the service during this period (except for 2012 – no data available). The conducted analyses have shown that the staffing situation of the police is difficult, although the overall figures do not show any significant staffing problems. The processes that have taken place in recent years have led to a situation where the police may face a significant shortage of officers in the long term. At present, the level of recruitment of the youngest officers is low (although it seems to be increasing) and does not guarantee that the potential staff shortages, resulting from the fact that an increasing proportion of the total number of police officers are older officers who have pension rights, will be made up for.

    Niniejszy artykuł w całości został poświęcony omówieniu konstrukcji prawnej delegowania policjanta od czasowego pełnienia służby w innej jednostce Policji lub w innej miejscowości. Instytucja ta została uregulowana w art. 36 ust. 1 – 3 ustawy o Policji. Stosunek służbowy ma charakter wyłącznie administracyjnoprawny. Jego charakterystyczną cechą jest zwiększona dyspozycyjność i podporządkowanie policjanta w służbie. Jednym z przejawów tej dyspozycyjności jest możliwość delegowania policjanta. Skoncentrowano zatem uwagę na omówieniu charakteru prawnego tej instytucji oraz podmiotów uprawnionych do jej stosowania.
    This article is a discussion of the legal construction for a police officer’s delegation for temporary service in another unit of the police force or in another locality. In Polish law this institution is regulated by Art. 36 (1), (2) and (3) of Ustawa o policji (the Police Act). Polish administrative law gives a definition of the nature of service in the country’s police force, and the characteristic feature of police duties it highlights is that the police officer must be fully committed to his/her job and on call for duty whenever required. One of the manifestations of this availability is the fact that he or she may be delegated to another station. This article discusses the legal character of this institution and the entities authorized to use it.

    Europejski nakaz aresztowania jest decyzją sądową, umożliwiającą bardziej sprawne aresztowanie i przekazanie osoby podejrzanej lub oskarżonej o popełnienie przestępstwa i wydanie jej do kraju, w którym zostanie postawiona przed sądem lub przekazana do wykonania wcześniej orzeczonej kary. W artykule przedstawiono podstawy prawne oraz procedury dotyczące wykonania ekstradycji na terenie Unii Europejskiej. Zaprezentowano również praktyczne rozwiązania organizacyjne i planistyczne stosowane przez polską Policję w celu wykonania ENA. Materiał został sporządzony na podstawie analizy przepisów prawnych przedmiotowej tematyki oraz przeprowadzonych wywiadów eksperckich z policjantami zajmującymi się organizacją i wykonywaniem międzynarodowych konwojów osób zatrzymanych.
    The European Arrest Warrant is the decision of a judicial authority which facilitates the detention and conveyance of persons suspected or indicted of having committed criminal actions in another country and the extradition of aforesaid persons to the respective country in order to bring them to justice or where a sentence already imposed has to be completed. The article presents the legal bases and procedures that regulate and control the extradition proceedings within the European Union. Following, this paper outlines the operational implementations applied by the Polish police force in the course of the EAW procedure. The material presented in this article is based on the analysis of the respective applicable international law, supplemented by expert surveys conducted with police officials responsible for the organization and operation of convoys of detainees transferred beyond Polish borders.

Its officers deal with physical neutralisation of terror threats and they take part in fighting against organised crimes on the Slovak Republic territory.     ObjectivesThis paper describes some operational tactical procedures (OTP) and discusses the results of a 14-year-long study, spanning the period 2003–2016, conducted by the Municipal Police of Cádiz, Spain, which comprised 3 time periods: 2003–2006, when the officers were trained in traditional policing procedures; 2007–2013, when the officers were taught an innovative set of OTP in the form of a basic set of self-defense and arrest mechanisms, different from the traditional policing procedures that rely on martial arts and combat sports; and finally 2014–2016, when the OTP training was discontinued. The aim of this study was to improve policing and reduce officer injuries resulting from interventions in controversial or violent situations, such as problematic arrests.Material and MethodsThe study involved 162 police officers and commanders of the Municipal Police of Cádiz, who were in street duty for their first time. There were 8 females and 154 males aged 24–55 years. Three OTP stages are shown as examples.ResultsBased on the analysis of “training hours” and “physical interventions in problematic arrests,” the results were: 1) the number of sick leaves in the police was identical according to the number of arrests, and 2) data on sick leaves show remarkable differences among the 3 periods under analysis.ConclusionsThe OTP-based training substantially reduced officer sick leaves. The overall reduction in sick leaves in the period 2007–2013 was observed that cannot be ascribed to a decrease in criminal acts, and hence in police physical interventions.

    Príspevok sa zaoberá otázkami rovnosti príležitostí v Policajnom zbore Slovenskej republiky, v ktorom, tak ako aj v ostatných zložkách pracovného či profesijného života, sa realizujú, a sú zastúpené obe pohlavia. Uplatňovanie rodového princípu je podstatným a dôležitým faktorom charakteru modernej a demokratickej spoločnosti. Slovenská legislatíva ustanovuje rodovú rovnosť ako základné právo a základnú hodnotu našej society. Napriek prijatým právnym opatreniam sa však vyskytujú nerovnosti napr. v odmeňovaní, ponuky rovnakých príležitostí, vedúcich pozíciách a pod. V našej spoločnosti sa často stretávame s určitými rodovými stereotypmi, ktoré sa týkajú pojmov gender (rod) a pohlavie. Ide o skreslené až iracionálne predstavy reality týkajúcich sa „mužskosti“ a „ženskosti,“ čo mnohokrát vedie k tomu, že zamestnávatelia či poskytovatelia služieb neposudzujú jednotlivca podľa schopností a zručností, ale podliehajú stereotypným názorom. Tento rodovo podmienený tlak je vyvíjaný predovšetkým na ženy, u ktorých sa akoby automaticky čakala absencia istých vlastností, z čoho sa pomerne jednoducho skĺzava segregácie, ktorá môže vyústiť do diskriminácie vo všetkých jej formách.
    The article deals with issues of gender equality in the Police Force of the Slovak Republic, which, as well as in other components of working or professional life, are implemented, and are represented by both sexes. Gender is an essential principle and an important factor in the character of a modern and democratic society. Slovak legislation provides for gender equality as a fundamental right and a fundamental value of our society. Despite the adoption of legal measures, however, such disparities occur. pay, offering equal opportunities, and under the leadership positions. In our society we often meet with certain gender stereotypes concerning gender concepts (genus), and gender. This is a distorted reality to irrational ideas concerning „masculinity” and „femininity” which often leads to the fact that employers and service providers are not assessed according to individual abilities and skills, but are stereotypical opinions. This gender-based pressure is developed especially for women who have been waiting automatically as the absence of certain properties, of which quite simply slides down the segregation that might result in discrimination in all its forms.

Co do zasady funkcjonariusze Policji nie są uprawnieni do wykonywania tego zawodu, chyba że pełnią służbę na stanowisku służbowym radcy prawnego. Status policjanta radcy prawnego regulowany jest zarówno ustawą o radcach prawnych, jak i ustawą o Policji. Normy zawarte w obu aktach prawnych wzajemnie się uzupełniają. Skoncentrowano zatem uwagę na omówieniu kwestii odnoszących się do praw i obowiązków szczególnej grupy policjantów pełniących służbę na stanowisku służbowym radcy prawnego. Wykazano, że pełnienie przez policjanta służby na tym stanowisku nie modyfikuje kształtu stosunku służbowego ani też nie zwalnia go z obowiązków ustanowionych w pragmatyce służbowej dla wszystkich funkcjonariuszy.
    This paper addresses issues related to the legal status of a police officer serving as a legal adviser. As a rule, under Polish law police officers are not authorised to practise in this profession unless their duties in the police force involve giving legal advice as a legal adviser. The legal status of a police officer who performs the services of a legal adviser is regulated by two acts of legislation, Ustawa o radcach prawnych (the Legal Adviser Act), and Ustawa o policji (the Police Act). The provisions in these two acts are complementary. Hence, in this paper I have focused on issues relating to the rights and obligations of this particular group of police officers, whose duties in the Polish police force entail the performance of a legal adviser’s services. I show that the legal aspect of a police officer’s employment relationship does not change if he is performing a legal adviser’s job in the course of his duties in the police force; neither doesit exempt him from carrying out the duties binding on all policemen.

    Opis:
    Żandarmeria Wojskowa jest szeroko zaangażowana w realizację współpracy międzynarodowej, zarówno bilateralnej z państwami partnerskimi, jak i wielostronnej w ramach przedsięwzięć wielonarodowych. Dotychczasowe wysiłki w tym zakresie spowodowały, że Żandarmeria Wojskowa jest wiarygodnym partnerem największych formacji typu policyjnego o charakterze wojskowym na świecie, w tym między innymi Żandarmerii Narodowej Republiki Francuskiej oraz Carabinieri Włoch. Fakt ten bezpośrednio przełożył się na uzyskanie w 2013 r. statusu pełnoprawnego członka Europejskich Sił Żandarmerii. Z podobnych powodów również inicjatywa Polski zlokalizowania na terenie RP Centrum Eksperckiego Policji Wojskowych NATO spotkała się z akceptacją najważniejszych formacji partnerskich Żandarmerii Wojskowej. Przejawia się to między innymi w fakcie pozyskania sześciu państw sponsorujących NATO MP COE. Autor w oparciu o doświadczenia własne, rozmowy przeprowadzone z kluczową kadrą dowódczą formacji typu żandarmeryjnego oraz przedstawioną bibliografią prezentuje genezy, cele utworzenia i zasady funkcjonowania Europejskich Sił Żandarmerii oraz Centrum Eksperckiego Policji Wojskowych NATO. Specjalne miejsce w materiale zajmują polskie aspekty narodowe obu inicjatyw.

The efforts in this field have made The Polish Military Gendarmerie a credible partner of the biggest and most important police-type formations with a military status, including the French Gendarmerie Nationale and Italian Carabinieri. This fact directly contributed to its obtaining of the full member status of the European Gendarmerie Force in 2013. For similar reasons, the initiative of locating on the territory of Poland NATO Military Police Centre of Excellence has been accepted by the most important partner formations of the Polish Military Gendarmerie. It is among others reflected in the number of sponsoring nations adhering to the NATO MP COE. The author, using his own experience, conversations conducted with the command personnel of the gendarmerie-type formations and the listed bibliography, presents the origins, aims of the creation and rules of the functioning of the European Gendarmerie Force and the NATO Military Police Centre of Excellence. Special attention has been given to Polish national aspects of both initiatives.
