The article presents a system for testing the independence of solutions to algorithmic problems sent by students as part of the student programming competition. First, the context was discussed, as well as the need to organize programming competitions resulting from this context. Then, an algorithm was proposed to study the mutual similarity of source codes of programs sent as part of a programming competition. Since, after implementation, the algorithm was used in practice, examples of its application for detecting the plagiarism of source codes of solutions in two programming competitions conducted as part ofmclasses on Algorithms and Numerical Methods were also presented. Finally, the effectiveness of the solutions used in the work was discussed.

The article presents the dispute between Freud and Fließ concerning the bisexual theory of the latter. According to Fließ, Freud inadvertently conveyed the main ideas of this theory to his patient, Hermann Swoboda, who included them in his article, which he published. Not enough of this. The latter conveyed them to Otto Weininger, who also drew on them in his famous book Sex and Character. The result was public accusation of plagiarism made by Fließ against Swoboda and Weininger and the breaking of friendship with Freud. In the article, I argue that in this case the issue of alleged plagiarism is problematic and at least ambiguous, not allowing the formulation of categorical opinions.

The development of the intelligent system for searching for plagiarism by combining two algorithms of searching fuzzy duplicate is considered in this article. This combining contributed to the high computational efficiency. Another advantage of the algorithm is its high efficiency when small-sized documents are compared. The practical use of the algorithm makes it possible to improve the quality of the detection of plagiarism. Also, this algorithm can be used in different systems text search.

Opis:
The struggle against pathology in the form of plagiarism or data falsification is undoubtedly necessary. However, limiting such efforts to building a system of control will turn this struggle into a cops-and-robbers game played by controllers and dishonest scientists. In this kind of game, the robbers will prevail sooner or later. Institutional solutions should therefore lead to building a system enabling open access to raw data and making it possible to publish results in which no statistically significant differences were found between conditions. What is even more important is organic work in the academic community and the realization that dishonesty will hit all of us.

Francis Bacon says knowledge is power. The creation of knowledge and its dissemination largely depends on the creation of literary works. The great works of Shakespeare, da Vinci, Homer, Picasso, Milton, Tagore etc. have been a treasure trove of mankind. Human beings have enjoyed the work, been inspired by the work, taken joy and eternal bliss in such works. However, the creation of knowledge is dependent on pre existing knowledge. Creators create a work which requires hard work, imagination, creativity and which is incentivised by recognition of their work. The legal order of a couth society affords protection to such a work by copyright law & fair use. Fair use allows a person to use a work by duly acknowledging and referencing the work. Issue of plagiarism and abuse of fair use was aggravated by human greed. The economic implication of copyright infringement aggravated the whole issue. Referencing turned into war. The Bluebook, the Maroonbook, the ALWD, the APA and OSCOLA citation styles engaged in some kind of a war. Reference management systems like Zotero, Endnote, Mendeley etc. just fanned the flame. Disruptive and generative artificial intelligence has created a serious challenge to academic research. In this paper, the author attempts to delve into the inter linkage of academic writing, research, citation, copyright, referencing mechanism and plagiarism in contemporary society, and the aftermath of it. The author attempts to investigate the challenges of writing and the protection of works vis a vis referencing tools and techniques.

The article consists of two parts. In the first, the author discusses the criminal law aspects of the crime under Art. 115 paragraph 1 of the Act on Copyright and Related Rights. The second part presents the results of empirical research. In order to learn the dynamics of convictions over the years, characteristics of perpetrators and types of punishments imposed by courts, the author collected and developed statistical data obtained from the Ministry of Justice. In order to examine the factual circumstances of plagiarism cases, as well as the correctness of the legal classification of offenses used by the courts, the author conducted a case study. The research covered cases ended with a final conviction in 2013–2017. The summary includes comments regarding problems with the legal classification of infringements of copyright and related rights as well as de lege ferenda postulates.

The article discusses academic youth’s attitude towards cheating and plagiarism. The authors present the results of empirical studies conducted in 2015 among students of Cardinal Stefan Wyszyński University (Uniwersystet im. Kardynała Stefana Wyszyńskiego) in Warsaw. Consumption culture, stimulating this type of behavior, is the theoretical background for the analysis. However, such a theoretical perspective does not mean that the propensity for cheating and plagiarism has appeared in Polish conditions at the beginning of the 1990s (and the development of consumption culture).
Tematem artykułu jest stosunek młodzieży akademickiej do ściągania i plagiatu. Zostały w nim zaprezentowane wyniki badań empirycznych zrealizowanych w 2015 r. wśród studentów Uniwersytetu Kardynała Stefana Wyszyńskiego. Teoretyczne tło dla analizy stanowi kultura konsumpcyjna, która stymuluje tego typu zachowania, jednak ta perspektywa teoretyczna nie oznacza, że skłonność do ściągania i plagiatu pojawiła się w polskich warunkach wraz z początkiem lat 90. (i rozwojem kultury konsumpcji).

Patrick Matthew’s (1831) prior-publication of the complete hypothesis of natural selection “anticipated” Darwin’s Origin of Species by 28 years and Darwin’s and Wallace’s (1858) Linnean papers on the same topic by 27. Founded on the premise that no naturalist read it before 1860, Darwin’s and Wallace’s claims of duel independent discovery of Matthew’s hypothesis have been accepted by the scientific community. However, the central premise upon which those claims have been accepted — that no naturalist read Matthew’s ideas before 1858 — is a proven fallacy, because the famous and hugely influential naturalist Loudon reviewed Matthew’s book in 1832, commenting that it appeared to have something original to say on “the origin of species”. The fact that Loudon was a naturalist has been totally ignored until now. Furthermore, it is newly discovered that after reviewing Matthew’s book he went on to edit the journal that published two of Blyth’s highly influential papers on organic evolution. Blyth was Darwin’s most prolific and helpful correspondent on the topic. Further new discoveries reveal that, besides Loudon, whose work was well known to Darwin and his associates, six other naturalists read Matthew’s book and then cited it years before 1858. One, Selby, sat on several scientific committees with Darwin, and was a friend of his father. Selby went on to edit Wallace’s famous Sarawak paper on organic evolution. Another, Robert Chambers, a correspondent of Darwin, who met with him, went on to write the influential Vestiges of Creation, which both Darwin and Wallace admitted was an influence on their work. Undeniable potential knowledge-transfer routes did exist before 1858, therefore, between those who read Matthew’s ideas and commented upon them in the literature, and Darwin and Wallace. In light of the fact that influential naturalists, known to both Darwin and Wallace, did read Matthew’s original ideas before 1858, veracity in the history of discovery requires now an investigation into the possibility of cryptomnesia or deliberate pre-1860 plagiarism by Darwin and Wallace. In that regard, the notion of “knowledge contamination” is proposed and presented in a three-fold typology of escalating culpability for replicators of prior published work with citation. Future research in this area should turn to the neglected correspondence and private journal archives of those naturalists known to Darwin and Wallace who read Matthew’s ideas before 1860.

The article discusses the problem of counteracting academic promotion won on the basis of apparent achievements. Attention was drawn to the growing problem of so-called “Slovak habilitation and degrees”, to the pedagogical promotion of persons from outside of pedagogy that is not justified by achievements of good quality, but is based on popular science publications, to the phenomenon of softening and ignoring negative reviews and the reviewers’ tendency to mitigate the final conclusions of their opinions. Some ways to prevent promotional pathology are also recommended as worth using in academic practices.

Z punktu widzenia prawa, kwestia przynależności danego przekazu do któregokolwiek z gatunków dziennikarskich bądź literackich nie ma szczególniejszego znaczenia. Przekaz dziennikarski, niezależnie od tego, w ramach jakiego gatunku się mieści, może narazić twórcę na odpowiedzialność karną bądź cywilną. Nie można także zapominać o odpowiedzialności dyscyplinarnej, chociaż wyegzekwowanie przestrzegania kodeksów etycznych jest niezwykle trudne, o ile wręcz niemożliwe. Dziennikarze nie powinni także zapominać o wymogach wynikających z treści prawa autorskiego i wystrzegać się popełnienia plagiatu. Ważne jest również przestrzeganie przez nich prawa do autoryzacji, chronienie czci i godności innych osób.
From a legal point of view, assignment of a message to any of the journalistic or literary genres does not matter. Journalistic material, whatever genre it is, may expose the writer to criminal or civil liability. Disciplinary liability can’t be forgotten, although enforcing compliance with ethical codes is extremely diffi cult (if not impossible). Journalists should also not forget about the requirements of copyright and to avoid plagiarism. It is important to respect the right to authorize, to protect the honor and dignity of the concerned persons.
